NATIONAL STATEWIDE LOCAL THANK YOU FOR THESE PEOPLE HERE WHO ARE. CHOSEN BY THE CITY TO REPRESENT THEM. THEY WERE MINDFUL THAT ALL WISDOM COMES FROM YOU. AND SO HE ASKED YOU TO GIVE THEM THE WISDOM THEY NEED. VISIONARY AND YET TRUE THEY'RE CALLING OF REPRESENTATION. THANK YOU, LORD FOR THE THINGS THAT THEY'VE DONE. ANY. YES, I DO. ELIZABETH MICHELLE. SHE'S COMING. SORRY. ALL THOSE WITH MICHEL 6 TO 5, YOU GO STONE DRIVE. I'M LIKE ALL FLUFF FRAZZLE BECAUSE I WAS TRYING TO GET HERE BY SIX.

SORRY. UM. FIRST LIKE TO SAY CONGRATULATIONS TO THE NEW COUNCIL MEMBERS. DOCTORS RIGHT, FELTUS AND MR JUSTIN BELLER. HOW LOOK FORWARD TO SCRUTINIZING YOUR WORK ON THE CITY COUNCIL. NO, SERIOUSLY. CONGRATULATIONS AND I KNOW YOU'RE BOTH GIVE THIS COUNCIL SO MUCH NEEDED INSIGHT. I DID WANT TO VOICE MY OPPOSITION ABOUT SPENDING $380,000 FOR THE PAINTING OF THE SILOS A FEW WEEKS AGO, I WAS HERE ASKING THIS COUNCIL TO CONSIDER MORE FUNDING FOR MENTAL HEALTH RESOURCE IS. I STUDIED THE BUDGET AND FOUND THAT THE CITY SPENT $5 MILLION ON TRUCKS. AND SO I WOULD AGAIN LIKE TO ASK THE CITY COUNCIL TO INVEST THE MONEY WE HAVE IN THIS CITY'S COMMUNITY MEMBERS. HOPE IT HAS EXACERBATED THE MENTAL HEALTH CRISIS HERE AND EVERYWHERE AND NOW, EVEN OUR YOUNG ADULTS AND CHILDREN. WITH EVEN THERE WITH OUR YOUNG ADULTS AND CHILDREN AND EVEN GREATER LEVELS. SO I WOULD ASK YOU TO RECONSIDER SPENDING THIS $380,000 ON PAINT. I FEEL LIKE THIS IS A WANT AND NOT A NEED. I MEAN, I THINK IF WE DID A SURVEY AND ASKED THE CITY RESIDENTS MORE THAN 750 OF THEM, UH IS THIS WHAT YOU WANT? YOUR CITY COUNCIL SPENDING $380,000 ON. NOT SURE WE WOULD GET A MAJORITY FOR THAT. SO THAT'S MY OPPOSITION FOR IT. I WOULD URGE YOU TO SPEND IT ON MENTAL HEALTH FUNDING. THANK YOU. THANK YOU THIS MONTH. WILL NOW MOVE. TO OUR CONSENT AGENDA ITEMS HE'S THAT WAS CONSISTENT

[CONSENT AGENDA]

IS THERE ANY. ITEM ON CONSENT THAT SOMEONE WOULD LIKE TO PULL DOWN FOR DISCUSSION AND, IF NOT ENTERTAIN A MOTION. SHOULDN'T WE HAVE APPROVAL OF THE ITEMS ON THE CONSENT AGENDA? SECTOR. CAST YOUR VOTES.

[00:05:19]

RIGHT MOVE TO REGULAR AGENDA. PUBLIC HEARING ITEMS PORTION OF GENDER CONSISTS OF ITEMS ACCORDING INDIVIDUAL CONSIDERATION BY THE COUNCIL. FIRST ITEM HAS BEEN

[Conduct a Public Hearing to Consider/Discuss/Act on a Petition to Annex (Case No. 21-0005A) and a Request to Zone (Case No. 21-0039Z) on Certain Land (the “Property”) to “LI” - Light Industrial District, Located Approximately 750 Feet West of Almeta Lane and on the South Side of Harry McKillop Boulevard (FM 546), and Related Ordinance(s) and Agreements (REQUEST TO BE TABLED)]

REQUESTED TO BE TABLE BUT WE WILL CALL IT SINCE MAYBE SOMEBODY HERE I'D LIKE TO SPEAK ON THE ELEMENTS OF PUBLIC HEARING ON 210005, A. 21-3 92, AND THAT'S THE CONDUCTS PUBLIC HEARING AND CONSIDERING ACT ON OUR PETITION TO ANNEX CASE NUMBER 21 0005 A AND REQUEST HIS OWN CASE NUMBER 210039 Z. CERTAIN LAND TO LIGHT INDUSTRIAL DISTRICT LOCATED 700 APPROXIMATELY 750 FT WEST OF MEADOW LANE ON THE SOUTH SIDE OF HARRY MACKILLOP BOULEVARD AND RELATED ORDINANCES AND AGREEMENTS AGAIN. THIS HAS BEEN REQUESTED TO BE TABLED. BUT THIS IS A PUBLIC HEARING. MR MAYOR. I JUST WANTED TO NOTE FOR THE RECORD THAT THE REQUEST FOR TABLE NG IN IS AN INDEFINITE, EH? SO WE WOULD REQUIRE RE NOTICING FOR CONSIDERATION OF THE ITEMS SO YOU CAN CLOSE THE PUBLIC HEARING. WHEN TONIGHT, SEVER, ALL RIGHT. IS THERE ANYONE HERE THAT WOULD LIKE TO SPEAK TO THE SIDE OF YOU MADE THE TRIP DOWN? CERTAINLY LIKE ITO. THAT OPPORTUNITY AND SEE NONE. ATTAIN EMOTIONAL CLOSE THE PUPPET PUBLIC HEARING AND CONTINUE THIS ITEM IN DEFINITELY LIKE THE EMOTION.

SECOND. NEWSCASTER VOTES. EXCITED TO 10040 Z TO CONDUCT A PUBLIC HEARING TO CONSIDER AN

[Conduct a Public Hearing to Consider/Discuss/Act on a Request to Rezone the Subject Property from “PD” - Planned Development District and “SF 5” - Single Family Residential District to “PD” - Planned Development District, to Allow for Multi-Family Residential, Single Family Residential and Commercial Uses and to Modify the Development Standards, Located on the North Side of FM 1461 and Approximately 5,500 Feet East of FM 2478, and Accompanying Ordinance]

ACT ON REQUEST TO REZONE THE SUBJECT. PROPERTY FROM PD PLAN DEVELOPMENT DISTRICT S SET FIVE SINGLE FAMILY RESIDENTIAL DISTRICT TO PD PLAN DEVELOPED DISTRICT TO ALLOW FOR MULTI FAMILY RESIDENTIAL, SINGLE FAMILY, RESIDENTIAL AND COMMERCIAL USES IN TO MODIFY THE DEVELOPMENT STANDARDS LOCATE ON THE NORTH SIDE OF F M 14 61. APPROXIMATELY 5500 FT.

EAST OF F M. 24 78, ACCOMPANYING ORDNANCE AND IT'S WHEN FRANKLIN YOU'RE GONNA STEP DOWN. EFFORT THANK YOU, MR MAYOR. AS YOU NOTED, THIS IS A REQUEST TO REZONE THE SUBJECT PROPERTY. IT'S APPROXIMATELY 461 ACRES IN SIZE AND THAT LOCATION THAT THEIR SHOWS YOU THAT IT IS IN THE NORTHWEST SECTOR OF THE CITY JUST NORTH OF F M. 14 61. AS YOU NOTED, THE APPLICANT IS REQUESTING TO REZONE TO ALLOW FOR A MIX OF SINGLE FAMILY RESIDENTIAL, MULTI FAMILY, RESIDENTIAL AND COMMERCIAL USES ON THE TRACT, AND I WILL FLIP HERE. I APOLOGIZE IF THIS EXHIBIT IS A LITTLE DIFFICULT TO READ, HOWEVER, AS PART OF THAT REZONING REQUEST, THE AFRICAN IS PROPOSING TONTO DIVIDE THE PROPERTY INTO FOUR UNIQUE TRACKS. ACCIDENTALLY 400 ACRES AND TRACKED ONE WOULD BE SUBJECT TO THE CITY'S S F FIVE SINGLE FAMILY RESIDENTIAL ZONING DISTRICT. THEY ARE REQUESTING SOME SLIGHT MODIFICATIONS TO THE STANDARDS OF OUR FIVE I'M TO ALLOW FOR A WIDER VARIETY OF RESIDENTIAL LOTS ON THIS PARTICULAR TRACKED. IN TRACT, TOO, WHICH IS THAT RED ATTRACT THERE AT THE BOTTOM, APPROXIMATELY SEVEN ACRES THEY ARE REQUESTING TO REZONE THAT TO SEE TWO, WHICH IS OUR NEIGHBORHOOD COMMERCIAL ZONING DISTRICT TO ALLOW FOR COMMERCIAL USE IT. TRACKED THREE WHICH IS THAT LIME GREEN THERE ON YOUR SCREEN THEY'RE REQUESTING TO ALLOW FOR TOWN HOME USES ON BY THAT PARTICULAR TRACKED AND THEN TRACKED FOR THERE AT THE FAR RIGHT CORNER IN YELLOW. WHICH IS APPROXIMATELY 38 ACRES THEY ARE REQUESTING TO ZONE THAT PROPERTY FOR MULTI FAMILY RESIDENTIAL USES. JUST FOR A LITTLE BIT OF CONTEST CONTEXT, THE EXISTING ZONING ON THE PROPERTY HAS A SIMILAR MIX OF USES AND SIMILAR. LAYOUT OF THOSE FOUR UNIQUE TRACKS. WHAT YOU WILL NOTICE IS PART OF THIS REZONING REQUEST IS THAT TRACKS THREE THERE ON THE BOTTOM RIGHT HAND CORNER OF THE PROPERTY, THE CONFIGURATION AND SIZE OF THAT TRACT HAS CHANGED JUST A LITTLE BIT, AND THAT IS WHERE THEY'RE PROPOSING THE MULTI FAMILY USES AS PART OF THIS REQUEST. UNDER THE EXISTING ZONING. THAT TRACT IS DESIGNATED FOR WHAT WE WOULD CONSIDER INDEPENDENT LIVING, WHICH IS AN AGE RESTRICTED SERVICE PROVIDED RESIDENTIAL PROPERTY OR PROJECT. ON. BUT THIS REQUEST THEY WOULD THEY ARE SEEKING PREDOMINANTLY TO ALLOW FOR THAT TO BE MULTI FAMILY BY RIGHT FOLLOWING THE CITY'S MF THREE ZONING DISTRICT, TWO THINGS TO NOTE WITH THEIR REQUEST FOR THE MULTI FAMILY THEY ARE SEEKING MAXIMUM NUMBER OF UNITS. THE DENSITY OF 28 UNITS TO THE ACRE WITH A CAP IF I BELIEVE 750 UNITS ON THE PROPERTY, THEY'RE ALSO ASKING FORCE THE MODIFIED PARKING STANDARDS, WHICH IS FAIRLY TYPICAL OF WHAT WE SEE IN TODAY'S MULTI FAMILY REZONING REQUESTS. THE STAFF HAS WORKED AT THE APPLICANT WERE LARGELY IN SUPPORT OF THE REZONING REQUEST. UNFORTUNATELY THE INCLUSION OF MULTI FAMILY IS SOMETHING THAT STAFF CANNOT

[00:10:01]

SUPPORT. AND AS SUCH, WE ARE RECOMMENDING DENIAL OF THE REZONING REQUEST, PREDOMINANTLY DUE TO THAT MULTI FAMILY INCLUSION, IT DOES NOT CONFORM TO THE CITY'S COMPREHENSIVE PLAN. WHICH IDENTIFIES THIS AREA FOR SINGLE FAMILY USES. WHILE WE DO RECOGNIZE THAT SOME USES OUTSIDE OF THE CONFERENCE OF PLAN MAY BE CONSIDERED COMPATIBLE, THIS IS AN AREA THAT'S LARGELY UNDEVELOPED IN THE CITY'S NORTHERN STRETCH. WE DID NOT FEEL AS THOUGH THERE WAS REASON ENOUGH TO GO COUNTER TO THAT DESIGNATION ON THE CONFERENCE OF PLAN IN THIS INSTANCE. LINING AND ZONING COMMISSION HAS HEARD THE REQUEST. THEY HAVE OFFERED A FAVORABLE RECOMMENDATION AND A VOTE OF 61 ON DAY. I'M HAPPY TO ANSWER ANY QUESTIONS. ENTER FOR THE CURRENTLY THE SENIOR, OF COURSE, IS. FOR ALL INTENSIVE PURPOSES IS BUILT AS A MULTI FAMILY DEVELOPMENT, AND I BELIEVE THERE'S 1000 UNITS AVAILABLE NOW ON THAT PROPERTY.

IS THAT RIGHT? SO I'LL HAVE TO DEFER THAT SPECIFIC QUESTION TO THE APPLICANT. I'M NOT AWARE OF ANY UNIT CAPS THAT ARE INCLUDED IN THAT INDEPENDENT WHEN I LOOKED AT IT BASED ON THE ZONING AND THE DENSITY, THEY COULD HAVE UP TO 1000 UNITS. I CAN CERTAINLY YOU'RE INTERACTING WITH THE AFRICAN. I CAN CERTAINLY GO FACT. CHECK THAT FOR YOU. BUT I'LL TAKE YOUR WORD FOR THAT MOVIE LIKE IT WAS JUST MY CALCULATION. I COULD BE WRONG AND WE DO NOT HAVE A MINIMUM AGE ON. SENIOR LIVING SISTER LIVING ASSISTED LIVING NOW WITH A SISTER LIVING, THEY ARE REQUIRED TO PROVIDE ON SITE MEAL PREPARATION AND TRANSPORTATION SERVICES. YOU CALLED IT AGED, RESTRICTED. WASN'T THAT'S RIGHT. SO WE DO HAVE WE HAVE THREE OR WITH THREE CATEGORIES FOR CARE AND OUR ZONING ORDINANCES. ONE IS AN ASSISTED LIVING FACILITY. SO WHAT YOU WOULD TYPICALLY THINK OF AS A NURSING HOME, RIGHT? YOU'RE PROVIDING ON SITE CARE. WE HAVE INDEPENDENT LIVING, WHICH IS WHAT'S INCLUDED HERE, WHICH MAY OR MAY NOT INCLUDE NURSING CARE OR HEALTH CARE. BUT IT DOES REQUIRE ON SITE MEALS AND TRANSPORTATION. AND THEN WE HAVE SEEN YOUR MULTI FAMILY, WHICH IS A TRUE MULTI FAMILY PROJECT. THAT'S JUST EIGHT RESTRICTED ON WE WOULD. WHAT'S THE AGE? I BELIEVE IT'S 65. AND THIS THE WAY THIS IS OWN. THERE'S NOT AN AGE IF I'M NOT MISTAKEN. I DON'T BELIEVE THAT THERE IS ON INDEPENDENT LIVING. SO A 20 YEAR OLD COULD LIVE IN THE AGE RESTRICTED APARTMENT.

INDEPENDENT LIVING APPARENTLY, YES, I BELIEVE THAT THEY COULD AGAIN. I'LL GO PULL UP THAT DEFINITION TO MAKE SURE THAT THERE'S NO AGE IN THERE, BUT I THINK YOU'RE CORRECT. THERE'S NOT ONE SO THEY COULD BUILD A BUNCH OF APARTMENTS. CALL IT AGED, RESTRICTED AND SELL IT TO ANYBODY. INDEPENDENT LIVING EIGHT RESTRICTED DIFFERENT. YEAH AND I ONLY SAY THAT BECAUSE AGE RESTRICTED MULTI FAMILY, WE WOULD REQUIRE DEED RESTRICTIONS TO LIMIT THE AGE FOR THAT SENIOR MULTI FAMILY PEACE BUT ON INDEPENDENT LIVING BECAUSE OF THE ADDITIONAL CARE THAT. IS BEING PROVIDED OR THE END OF ETERNITY. ADDITIONAL SERVICES FOR ON SITE, FOOD AND MEAL AS WELL AS TRANSPORTATION. IT'S A DIFFERENT CATEGORY. BECAUSE I LOOKED AT THIS IS BASICALLY A REDUCTION FROM 1000 MULTI FAMILY UNITS TO 750 MULTI FAMILY INSIST HOW I LOOKED AT THIS BASICALLY. UM. ANYONE ELSE HAVE QUESTIONS OR WE BRING UP THE APP, BUT THERE STILL ARE CERTAIN CRITERIA RIGHT THAT YOU HAVE TO HAVE IN ORDER TO BE ADMITTED INTO AN INDEPENDENT.

THAT'S DRIVING FACILITY THAT IT'S NOT JUST THAT YOU COULD BE 20 AND HEALTHY DOESN'T WORK.

THAT IS CORRECT. NOT ACTUALLY THAT IT DOES. YOU CAN BE ADMITTED INTO IT. YOU THE LITERAL WITH THE REQUIREMENT IS YOU HAVE TO HAVE THE ABILITY TO HAVE MEAL PREPARATION. SERVICE BUT YOU CAN YOU CAN MOVE INTO AN INDEPENDENT LIVING FACILITY. YEAH. YEAH. PURPOSE. THAT'S THAT'S YET ANOTHER, YOU KNOW? ANOTHER DISCUSSED NOW THAT B B SYSTEM. I ONLY KNOW THIS SUBJECT WELL BECAUSE I HAPPEN TO BE IN THE MIDDLE OF PROPERTY OF THE YEAR AGO THAT HAD SOME SIMILAR. ISSUES OR OR NOT ISSUES, BUT. RESTRICTIONS WHAT'S THAT RESTRICTION INSTRUCTIONS WERE LIKE THEY'RE UP. YEAH, SO AGAIN. ANOTHER SUBJECT FOR ANOTHER DAY, POTENTIALLY TO COME BACK AND TALK ABOUT WHETHER WE SHOULD ADOPT A. AGE IN THAT INDEPENDENT, BUT CERTAINLY THAT'S THE INTENT, BUT IT'S NOT THE ENFORCEABLE. ASPECT FROM THE CITY OF THIS MAN. MR DUKE I'M SORRY. I WAS JUST GONNA SAY ACTUALLY DID PULL UP THE DEFINITION HERE JUST TO HAVE IT AND THERE IS A REQUIREMENT IN OUR ORDNANCE FOR AID. RESTRICT SO IT INDEPENDENT LIVING FACILITY. MEANS AN AGE RESTRICTED FACILITY THAT PROVIDES ITS RESIDENTS COMMUNITY DINING WITH ON SITE MEAL PREPARATION AND SERVICE AND TRANSPORTATION SERVICES. IT MAY ALSO INCLUDE LIGHT HOUSEKEEPING AND OR RECREATIONAL. ENRICHMENT SOCIALIZATION ACTIVITIES. THEY DO NOT PROVIDE ANY ON SITE, HEALTH SUPERVISION OR RELATED CARE FOR ITS RESIDENTS, BUT THERE'S NO AGE ASSOCIATED WITH NO AGE ASSOCIATED WITH IT. YEAH, THAT'S GREAT, LONG DEFINITION WITH NO AGE. THAT'S GREAT. JUST MAKE IT SIMPLE. OKAY SO WE'RE GONNA REMOVE THAT MAKING MULTI FAMILY. THAT'S THE

[00:15:01]

REQUEST TODAY. THE REQUEST REQUEST SORRY. TAKE IT FROM 7 1770. AND WHAT EXACTLY IS GOING TO BE BUILT? WHAT'S THAT? WHAT'S THE ASK? I THINK WE'LL HAVE THE APPLICANT CAN WE SPEAK THE SAME? BUT WE HAVE A QUESTION FOR STAFF. AND ONE MORE CLARIFICATION BEFORE I STEPPED AWAY, SENIOR MULTI FAMILY ASKED LOOK OF ITS 55, NOT 65 SENIOR. IF IT HAD BEEN THAT THAT'S RIGHT. IT'S A MINIMAL JUST WANTED TO CLARIFY THAT BECAUSE I KNOW I DIDN'T MISSPEAK BEFORE I'M ALMOST THERE. YEAH. ALL RIGHT. UM, THE APPLICANT IS THE APPLICANT HERE. I'M ASSUMING SIX MORE YEARS. MR MAYOR, MEMBERS OF THE CITY COUNCIL BOB ROTORS 1700 RED BUDS SUITE 300 MCKINNEY. ON BEHALF OF THE APPLICANT. I KNOW EACH OF YOU HAVE READ YOUR PACKET AND READ ALL THIS INFORMATION AND SO IN THE INTEREST OF TIME BECAUSE YOU DO HAVE A SHORT AGENDA, AND I'M NOT GONNA TAKE UP. HOLD MUCH TIME TO MAKE SURE THAT YOU'RE HERE A LONG TIME. I WANT TO FOCUS JUST ON TRACK FOUR BECAUSE I THINK THE STAFF IS FINE WITH EVERYTHING. YOU HAVE SOME DIALOGUE ABOUT THE REQUIREMENTS FOR INDEPENDENT LIVING, AND I THINK YOU'VE ALL BLAME THE FACT THAT WHILE IT SAYS A RESTRICTED, YOU COULD PUT A 20 YEAR OLD IN THERE AND. AND GET THAT YOU ALSO HAVE PROBABLY COME TO THE CONCLUSION THAT ON SITE MAIL SERVICE COULD BE AH, HOT PLATE. AND TRANSPORTATION COULD BE A VAN THAT IS WILLING TO TAKE PEOPLE TO GROCERY STORE SOMETHING LIKE THAT, SO IT'S PRETTY LOOSELY DEFINED. I WANT TO MAKE A I WANT TO MAKE A FEW OBSERVATIONS ABOUT WHY I THINK TRACK FOUR SHOULD BE ZONE WHAT IT IS BECAUSE WE CAN SPLIT. ALL THOSE OTHER HAIRS HAVE A GOOD TIME WITH IT. BUT THE REALLY IMPORTANT HERE IS. WHY IS TRACK FOR FIRE? WE'RE REQUESTING THAT LET ME START BY SAYING. THE EXISTING ZONING HAS A HAS A MULTI FAMILY TYPE COMPONENT ALREADY THERE. THAT'S ON OVER 43 ACRES. WE'VE REDUCED HIS TRACK TO JUST A LITTLE OVER 38.

I THINK YOUR MATH IS CLOSE MAYOR, I THINK UNDER THE WAY THE OLD PD WAS WRITTEN, WE WOULD PROBABLY HAVE TO APPLY A 20 UNITS PER ACRE DENSITY. TO SENIOR INDEPENDENT LIVING OR THE INDEPENDENT, LIVING JUST LIKE WE WOULD APPLY TO THE MF THREE. WHEN YOU APPLY THAT FACTOR, YOU'RE PROBABLY IN THE 900 UNITS RATHER THAN 1000. BUT YOU'RE CLOSE. MF THREE IN OUR ORDINANCES IS AN ALL INCLUSIVE KIND OF RESIDENTIAL CATEGORY IN AN M. AFTER IT, YOU COULD DO SINGLE FAMILY DETACHED. YOU CAN DO SINGLE FAMILY ATTACHED. YOU CAN DO DUPLEX INTO TOWN ON AND YOU CAN DO MULTI FAMILY. THERE'S A LOT OF FLEXIBILITY INVOLVED IN HAVING THAT KIND OF DESIGNATION THERE. AND SO I THINK ONE OF THE PRIMARY REASONS WHY I THINK IT'S APPROPRIATE TO DO MULTI FAMILY FOR TRACK FOR IS IT GIVES MIKE LACK THE FLEXIBILITY TO DEVELOP THAT TRACK FOR WHAT THE MARKET SAYS IT SHOULD BE. NOW A COUPLE OTHER FACTORS. I THINK THAT ARE WORTHY OF CONSIDERATION HERE. MY CLIENT ANNEXED THIS TRACT INTO THE CITY IN 2014. THAT WAS.

LIKE NINE. HOWEVER MANY YEARS AGO SEVEN YEARS AGO, OKAY? SO IT HAS ITS STEPPED OUT THERE.

NONE OF THE PROPERTIES AROUND IT. HAVE SEEN FIT TO ANNEX INTO YOUR CITY, AND WE'RE NOW STUCK WITH. FAIRLY ONEROUS LEGISLATION THAT KEEP YOU FROM GOING OUT AND FORCING OTHER PEOPLE THE ANNEX IN THIS SAME AREA, SO MY CLIENT GOT OUT THERE. MY CLIENT WAS THE PIONEER IN THIS AREA. ANDRE HAS NOW IT'S PROPERTY HAS BEEN SUBJECT TO THE ROLLBACKS. EVEN THOUGH IT'S IN A NAG USE. IT'S BEEN OUT THERE LONG ENOUGH THAT IT'S GONNA PAY A FULL THREE YEARS OF ROLLBACKS ON EACH SALE THAT OCCURS THERE THAT WILL COME INTO THE CITY'S COFFERS.

NUMBER ONE. NUMBER TWO THE. 2040 PLAN REALLY RECOGNIZES NO MULTI FAMILY IN THIS ENTIRE DISTRICT. WHICH I THINK IS A MISTAKE. I DON'T. I'M NOT. I CAN'T ANSWER HOW WE GOT THERE.

I WAS PART OF THAT PROCESS, BUT I WOULD HAVE TO SAY THAT'S AN OVERSIGHT. I DON'T THINK YOU'RE GOING TO SEE. 1000 ACRES OR 5000 ACRES DEVELOP WITHOUT THE NEED FOR SOME KIND OF MULTI FAMILY HOUSING. AND WHEN I LOOK AT WHERE THIS IS SITUATED, IT'S ON 14 61, WHICH IS GONNA BE THE ESSENCE A MAJOR MAJOR THOROUGHFARE COMING THROUGH THE CITY. SO WE'VE GOT GREAT LOCATION FOR TRAFFIC PURPOSES. WE'VE GOT ALSO A GREAT BUFFER. AGAINST FOR THE SINGLE FAMILY.

WE'VE GOT ALMOST 400 ACRES OF SINGLE FAMILY. NOW WE'VE ADDED 80 ACRES TO THE ORIGINAL ZONING.

[00:20:05]

SO YOU'VE GOT ALMOST 400 ACRES OF SINGLE FAMILY DETACHED DWELLINGS, HARRY. THIS IS THIS CREATES, IN MY OPINION, A BUFFER AGAINST A REALLY HIGHLY TRAVELED ROAD SYSTEM THAT IT'S GOING TO BE TO MAKE THOSE SINGLE THAT ENTIRE 400 ACRES MORE OF AN UNCLAIMED. ALONG THE CREEK. AND THE WATERWAYS THAT ARE CREATED, REALLY BEAUTIFUL SETTING FOR THIS PROPERTY. UM.

WE HAVE LIMITED THE NUMBER OF UNITS TO 750. IF YOU DO THE MATH, THAT'S GOING TO BE SOMETHING IN THE 25 ACRE RANGE. AND SO IT'S OUR INTENTION I THINK TO DEVELOP THE BALANCE OF THAT TRACK FOR IF IT IS DEVELOPED FROM MULTI FAMILY IN TOWN, HOME OR SOME OTHER TYPE OF SINGLE FAMILY ATTACHED. PRODUCT. SO AGAIN, I THINK LOCATION. TRANSPORTATION NETWORK AND ALL THAT KIND OF STUFF. FACT THAT THIS CLIENT THIS HOME OWNED THIS PROPERTY OWNER GOT OUT THERE IN FRONT. AS AS SET OUT. TO BE THE FIRST TO DO WHAT IT WANTS TO DO, AND ZONING IS AN IMPORTANT FACTOR HERE. AND THAT YOU KNOW, I WOULD. QUESTION FAVORABLE.

RECOMMEND YOUR FAVORABLE APPROVAL. LET ME STOP HERE AND ANSWERING QUESTIONS YOU HAVE QUESTIONS FOR REALLY? THANK YOU. I'M SORRY. THERE IS ONE, YOU KNOW, STRUGGLING WITH THIS ONE A LITTLE BIT BECAUSE YOU'RE SAYING IT'S NOT ZONED FOR MULTI FAMILY, BUT IT'S ZONE FROM MULTI FAMILY. I MEAN, NOT TRADITIONAL. ALL TO FAMILY, BUT THIS USES STILL A MULTI FAMILY USE, AND MY CONCERN IS THAT WE DO OFFER. STILL A WIDE VARIETY OF HOUSING OPTIONS. SO WHEN WE'RE THINKING ABOUT THE NEED FOR INDEPENDENT LIVING FACILITIES. WE'RE SHORT RIGHT NOW. I MEAN, THEY'RE GONNA BE PEOPLE WHO ARE CONSTANTLY MOVING IN HERE LOOKING FOR THAT TYPE OF OUR PRODUCT. SO IF HE THEN REMOVE THAT PRODUCT FROM THE MARKET IN THIS AREA, I MEAN, I'M CONCERNED ABOUT THAT BEING AN ISSUE. UM. YEAH, I DON'T SEE A BUNCH OF 20 SOMETHING YEAR OLD MOVING INTO. EVEN IF THEY HAVE ACCESS RIGHT, THERE'S NOT GOING TO BE ALL OF THE FANCY AMENITIES THAT YOU NORMALLY WOULD SEE WITH A MULTIPLE, A TRADITIONAL MULTI FAMILY UNIT. SO THIS IS GOING TO BE REALLY TARGETED TOWARDS A SPECIAL GROUP OF PEOPLE AND I THINK THE NEED IS THERE IN THIS CITY TO TARGET THAT GROUP, SO I WOULD HATE TO SEE THE USE GO AWAY FOR THAT REASON. LIKE FELTUS. I SHARE YOUR OBSERVATION ABOUT THE NEED IN MCKINNEY. AS I SAID, THE MF THREE IS AN ALL INCLUSIVE ZONING. SO INDEPENDENT LIVING WOULD BE A PERMITTED USE UNDER THIS, MF THREE. I LIKE TO THINK OF THESE COPPER CASES, AS HAS.

SETTING THE SCENE FOR WHAT MARKETS GOING TO DRIVE. THINK TO THINK THAT, I THINK 750 UNITS OUT THERE AT THIS TIME IS NOT IN ANYBODY'S CARDS, RIGHT? WE WANTED TO GO AHEAD AND GET THE ZONING IN PLACE BEFORE WE SOLD 400 ACRES WORTH OF SINGLE FAMILY SO THAT EVERYBODY GOING IN OUT THERE WOULD KNOW WHAT TO EXPECT. WE CERTAINLY WANTED THE ABILITY TO CREATE AN OPPORTUNITY THERE FOR HAVE THE FLEXIBILITY TO DEVELOP THAT FOR SOMETHING OTHER THAN SINGLE FAMILY, BUT IT COULD DEVELOP A SINGLE FAMILY IF THAT'S WHERE THE MARKET LEADS IT. THE QUESTIONS FOR YEAH, I KIND OF THIS IS WHERE I'M STRUGGLING WITH THIS TOO. AND I'VE BEEN THINKING ABOUT IT ALL DAY. LOOKED AT THE PACKET WHEN YOU SAID IT TO ME. BOND I KNOW THAT THE IT'S DESIGNATED LIKE URBAN LIVING, AND THAT'S HOW IT FITS THE. PROGRAM RIGHT NOW WHERE WE'RE INDEPENDENT. RESIDENTIAL WHATEVER WE'RE CALLING IT BUT I'M LOOKING AT YOU KNOW, YOU SAID THE 2040 PLANT. WASN'T DONE RIGHT? I THINK THEY DID DO IT RIGHT. TO BE HONEST WITH YOU BECAUSE IT'S URBAN. IT'S OUT THERE. UM. I DON'T FEEL THAT COMING IN AND ASKING FOR CHANGES TO MULTI FAMILY THAT GIVES YOU ALL THE OPTIONS. I THINK THERE'S ONLY ONLY OPTIONS SOMEBODY WANTS FROM THIS. I MEAN, THAT'S MY OPINION. I MEAN, I'M JUST LOOKING AT. I THINK THE ONLY ON LEE OPTION YOU COULD WANT YOU GUYS WANT IS TO MAKE IT MULTI FAMILY. WE WANT TO HAVE THAT ON THE CONTINUUM OF OPTIONS, MR FRASER. YEAH, BUT I DON'T SEE IT THAT WAY. I'VE THAT'S JUST ME. I SEE IT IS IT'S GONNA BE A MULTI FAMILY PROJECT AND THAT'S WHAT'S GOING TO BE THERE. I WOULD LOVE TO SEE FAMILIES BUILT HOMES THERE. AND IF THEY HAVE A SENIOR AREA OVER HERE FOR THEM TO TOW. TO BE CLOSE TO THEIR FAMILY RELATIVES THAT'S WORKING. WE HAVE A HERITAGE RANCH THAT THERE WAS NOTHING OVER THERE. THE CLOSEST THING WAS MCKINNEY MEDICAL. UH THAT WAS THAT'S NOT EASY TO GET TO. I THINK BAYLOR WOULD BE THE

[00:25:01]

SAME DIFFERENCE FROM HERE. SO. I'VE BEEN STRUGGLING WITH THIS TODAY. BUT I KNOW YOU HAVE TWO ROADS COMING IN, AND I HAVE POWER LINES GOING IN HERE. BUT I'M I'M WITH. UH, THAT'S WHAT FELT US ON THIS. IT ZIM STRUGGLING WITH THIS TRACK RIGHT HERE. I JUST SEE ONE THING GOING THERE. I LOVE THE TOWN HOMES, ALL THAT OTHER STUFF. I LOVE THE MIX LIKE THE COMMERCIAL, BUT THAT PIECE RIGHT THERE, AND I KNOW THAT WE'VE GONE FROM 1000 700. WE ALWAYS SEEM TO ENTERTAIN OURSELVES WITH THAT. BUT THAT THAT DOESN'T DO ME ANY FAVORS.

WHEN. WHEN I SEE THAT TRACK BEING JUST A APARTMENT COMPLEX BECAUSE I'VE ALREADY SAID BEFORE, I'LL VOTE ON IT IF YOU GOTTA LIVE, WORK AND PLAY GET IT. I DON'T SEE ANY LIVE WORK AND PLAY HERE. I JUST SEE LIVE. EXISTING ZONING LIMITS. WHAT CAN BE DONE ON THAT TRACK TO EITHER SINGLE FAMILY? OR INDEPENDENT LIVING. SERENA'S MARKET. THE MARKET HAS VERY LITTLE PLAY IN THAT. THIS TRACK COULD BE SINGLE FAMILY. IT COULD ALSO BE INDEPENDENT LIVING, AND IF WE HAVE THE FAMILIES LIVING IN THOSE 400 ACRES WORTH THE HOMES, AND THERE'S A DEMAND TO PUT A AN INDEPENDENT LIVING FACILITY OR AN ASSISTED LIVING FACILITY OR A SENIOR FACILITY. ON THAT 38 ACRES. THIS ZONING PERMITS THAT TO OCCUR. WHAT WE'RE NOT DOING IS WE'RE NOT FORCING. THE MARKET TO SAY THAT'S GOT TO BE INDEPENDENT LIVING. AND SO I THINK IF YOU'RE LOOKING FOR SUSTAINABLE USES OVER TIME. I'M GOING TO SUBMIT TO YOU THAT HAVING A MARKET DRIVEN RESULT IS PROBABLY GOING TO BE MORE SUSTAINABLE. AND SOMETHING THAT WE JUST DICTATE AND SAY IT'S EITHER GOING TO BE THIS OR THAT, YOU KNOW. THE OTHER QUESTIONS FOR MR RITTER. THANK YOU. THIS IS A PUBLIC HEARING. IS THERE ANYONE HERE LIKE TO SPEAK ON THIS ITEM? MANY LETTERS OF OPPOSITION OR SUPPORT. CIRCULAR REASONING. SO WE DID RECEIVE A LETTER OF OPPOSITION FROM A RESIDENT PRIOR TO THE PLANNING AND ZONING COMMISSION MEETING. HOWEVER HIS OPPOSITION WAS RELATED TO THE COMMERCIAL COMPONENT. HEY HAD SOME HANDSOME CONCERNS ON SOME OF THE USES THAT WERE ALLOWED IN THE SEA TO DISTRICT THAT WAS BEING REQUESTED. S O. YOU'LL NOTICE IN THE PROPOSED REGULATIONS. IT'S A BASE OF C TWO WITH A COUPLE OF USES THAT ARE EXCLUDED TO HELP RESOLVE HIS CONCERNS. I DON'T SEE THOSE FOLKS HERE THIS EVENING. CANNOT CONCLUDE THAT THEY WERE ANNOUNCED SATISFIED WITH COMMERCIAL ASPECT OF THIS PROPERTY. YOU. MAY YOU MAY OR YOU MAY BE, YEAH. SO I HAVE ANOTHER QUESTION. AND SO AS WE ANNEX IT HAS TO BE A CONTINUOUS CORRECT. UM. IS THE REASON THIS IS PART OF THE CITY'S BECAUSE IT KIND OF CONNECTS, KIND OF RIGHT RIGHT THERE. DO SOMETHING ELSE. I'M LOOKING AT THE CITY BECAUSE. HOW DOES THAT EVEN IN THE CITY LIMITS? LET ME PULL UP A CITY LIMIT MAP AND I CAN SHOW YOU WHERE IT THAT'S FINE. UH, THEY DID. YEAH, SO IT LOOKS LIKE THERE ARE A LOT OF LITTLE FINGERS AND SPINES THAT GO OFF FROM THE CITY'S LIMITS ALONG A LOT OF ROADWAYS AND RIGHT OF WAYS. BEEN THERE FOR A LONG, LONG TIME. AND SO THIS IS CONTINUOUS BASED ON THAT WHAT WE CALL A STRIP ANNEXATION ALONG 14 61 ON ITS SOUTH SIDE, SO YOU HAVE TO TOUCH THE CITY JUST HAS TO BE ON THE SAME ROAD. YEAH, IT IS. YEAH. YET, SO WE HAVE A LOT OF LITTLE RIGHT AWAY STRIPS THAT IRAN NEXT INTO THE CITY LIMITS, AND THAT ALLOWS US TO USE THAT CONTINUITY RULE WITH US. YEAH.

OKAY? THANK YOU, JENNIFER. ONE MORE QUESTION FOR YOU IF YOU HAVE THE ANSWER. SCHOOL DISTRICT IS ALL THIS. PROSPERED. I WANT TO SAY IT IS PART OF THIS IS MCKINNEY. I'VE GOT MY INTERACTIVE MAPS UP IF YOU'LL GIVE ME JUST TWO SECONDS TO CONFIRM IT, CAUSE I DO NOT WANT. OH YEAH, I HOPE SO. WITH 400 ACRES OF SINGLE FAMILY BOBS AND PROSPER. HIS PROSTATE.

YEAH. INSOLENT THANKS SO MOST GRAND SELENA 10 98. SO IT'S RIGHT. IT'S PROSPEROUS THE LINE IN MCKINNEY. GREAT ANOTHER THING WE STRAIGHT FIX. I KNOW HOW THAT GOT SO SCREWED UP.

I'VE BEAN EITHER. I MEAN, TOTALLY IN SCHOOL DISTRICTS AND ARE BLASTING CITY. THANK YOU.

JENNIFER JUST DRIVES ME CRAZY, BUT IT IS WHAT IT IS. ALL RIGHT. THERE IS NOBODY THAT HEADS I WISH TO SPEAK SO ENTERTAINING MOTION MOVED TO CLOSE THE PUBLIC HEARING.

SECOND CAST YOUR VOTES. THE HEARING IS CLOSED. THAT WAS JUST A PUBLIC HEARING MOTION.

[00:30:20]

WANT TO STAY HERE IF YOU WANT TO STAY ALL NIGHT, TRYING TO BE BETTER. UM ANY DISCUSSION. I MEAN, I'LL START IT OFF. I JUST E THINK YOU KNOW WHERE I'M AT WITH IT? IT'S A BEAUTIFUL I'VE NO THIS PROPERTY. IT'S GORGEOUS. ALL THE PROPERTY OUT THAT WAY IS GORGEOUS. I KNOW THAT IT'S GOING TO BE DONE, RIGHT? I'M VERY WORRIED ABOUT THAT LITTLE TRACK. UM, THAT'S MY I WOULD LOVE TO SEE US BUILD FOR THE FUTURE. BUT OTHER THING I'D LIKE TO SEE THE BILL FOR THE FUTURE RESIDENTS THAT HAVE BEEN HERE AND WANNA DOWNSIZE. AND THEY WANT TO BE CLOSER TO THEIR KIDS. AND SO MY BIGGEST CONCERN. AND I'VE BEEN VERY FRANK ABOUT IT. I. I DON'T WANT TO SEE US BUILD SOMETHING JUST TO BUILD IT AND SELL IT. MINUTE AND IT MOVES ON TO SOME HIGH DENSITY AREA. THINK THERE NEEDS TO BE A BETTER USE FOR IT. AND I UNDERSTAND THAT THEY GET. YOU HAVE A LOT OF OPTIONS WITH THIS ONE, BUT I FEEL THAT IT'S JUST GONNA BE APARTMENT. I AGREE WITH THAT, AND MY OTHER CONCERN IS WE STILL HAVE THIS CONVERSATION ABOUT OBTAINABLE HOUSING, AND I HEAR NOTHING ASSOCIATED WITH THIS PROJECT TO E THINK THAT MAYBE ONE ASPECT THAT MIGHT CHANGE MY MIND A LITTLE BIT. I HAVE TO AGREE WITH FREDERICK ON THIS ONE.

LOOKED AT IT FROM THE OPPOSITE END OF THE SPECTRUM, AND I WAS THANKFUL THAT IT WASN'T 430 ACRES OF APARTMENT, SMALL SECTION SO I THOUGHT IS THAT. FAIR TRADE OFTEN DO A 10% AND APARTMENTS WHEN YOU GET 403 400 ACRES OF SINGLE FAMILY HOUSING, SO I WAS OKAY WITH IT. I'M ON THOSE GROUNDS AND I'M OKAY WITH THIS. WELL, I KNOW THAT. THE MARKET IS ABSOLUTELY GONNA DICTATE BECAUSE WE HAVE SOMETHING THAT HAS A ZONING. THAT DOESN'T MEAN IT GETS BUILT. BUT IT GETS BUILT BECAUSE THERE'S A MARKET PEOPLE CAN DEVELOP, CAN BUILD IT AND RENT IT AND IT'S VIABLE AND SUSTAINABLE. IF THAT IS THE IF THAT USES DESIRABLE, THEY HAVE THE ABILITY TO DO THAT, REDUCING IT FROM 48 ACRES TO 38, REDUCING THE NUMBER OF MULTI FAMILY UNITS. BUT WHETHER WE LIKE THE FACT OR NOT, THERE IS NO ACTUAL AGE RESTRICTION.

AND, UM. SO TO ME, I SEE THIS AS A REDUCTION IN UNITS THE FLEXIBILITY OF STILL BEING BILLED, SENIOR LIVING OR WILL ANY OF IT ASSISTED ADULT SENIOR AIDE RESTRICTED OR STRAIGHT MULTI FAMILY AND IT'S A REDUCTION IN UNIT'S OVERALL OR. IF MARKET DICTATES IT'LL IT COULD BE TOWN HOMES THAT COULD BE SINGLE FAMILY SO MAYBE IT'S A. IT LETS THE MARKET DICTATED AND IT DOES IT IN A SMALL PERCENTAGE WAY OF ALL THE SINGLE FAMILY FOR ME. I JUST FIND IT INTERESTING THAT WAY HAVE THIS. SEVERAL MONTHS AGO WE WEIGH VOTED WITH ON PAINTED TREE. AND. I MEAN, IT WAS IT WAS KIND OF SAME THING, TONS HOUSING, AND WE HAD A LITTLE BIT OF MULTIFAMILY AND S. SO I JUST THOUGHT IT'S A BIG AND DEVELOPMENTS AND EMILY'S NOT ANYWHERE. IN THE VICINITY OF THIS AREA, SO IT'S. YOU'RE GONNA HAVE TO HAVE MULTIFAMILY IN THE CITY SOMEWHERE. SO I DIDN'T HAVE. I HAVE HEARTBURN OVER THIS, BUT ON THIS PARTICULAR PROBLEM, JUST LIKE PAINTED TREE. I COULD SEE THIS WORKING. WHAT IF I. ON THE PAINTED TREE ONE. I'M PRETTY SURE THAT WE DID THAT THE RESIDENTIAL CAME BEFORE THE APARTMENTS. PUT IN THERE. I DON'T KNOW. DON'T THINK SUCKS. I DON'T THINK WE COULD MARK IS THAT. REPRESENT. THERE WAS SOMETHING THERE CENTERS A COUNTER. THERE'S A COUNTERMEASURE IN THERE. I'M PRETTY SURE I DO NOT RECALL THAT THERE IS WHEN THERE ARE SOME LIMITS ON THE MIX THAT'S ALLOWED WITHIN THE RESIDENTIAL COMPONENTS, BUT I DO NOT BELIEVE THAT THERE'S A TIMING TRIGGER. DENSITY MIXED ON I WILL I WILL NOTE ON THE PAINTED TREE PROJECT. IN PARTICULAR. THERE WAS SOME DESIGNATION IN THE CONFERENCE OF PLAN IN THAT PARTICULAR AREA THAT WOULD HAVE ALLOWED FOR SOME CONSIDERATION OF MULTI FAMILY. YEAH. IF WE PUT SOMETHING IN THERE LIKE THAT. PRESIDENTIAL HAD TO BE BUILT BEFORE THE MULTI FAMILY SO THE MULTI FAMILY JUST DOESN'T GET BUILT AND SOLD, NOT SAYING IF THEY DID THE MONTH OUT FAMILY FIRST I'D HAVE TO MAKE IT AFFORDABLE TO GET SOMEONE WANT. DRIVE ON THE WAY UP THERE. DO YOU HAVE AN APARTMENT? SO IT MIGHT KILL TWO BIRDS WITH ONE STONE. IT'S ALONG WITH THE MIDDLE OF NOWHERE APARTMENT IN THE MIDDLE OF NOWHERE, BUT YOU GO READ IT.

[00:35:01]

THAT'S CALLED AFFORDABLE HOUSING. WAS THE MARKET WITH THEM DICTATE. DISCUSSION.

ENTERTAIN A MOTION. MAKE A MOTION THAT WE APPROVE IT HAS PRESENTED. SECOND. YOUR BOOTS.

I'VE KEPT LOOKING. THE MAYOR SAID EVERYTHING THAT I WOULD HAVE SAID THAT IT'S A GOOD PROJECT. MOTION PASSES. OFTEN TALKED A LOT DOWN HERE. JUST SO YOU GUYS KNOW. OH 2100510

[Conduct a Public Hearing to Consider/Discuss/Act on a Request to Rezone the Subject Property from “PD” - Planned Development District and “REC” - Regional Employment Center Overlay District to “C2” - Local Commercial District, Located on the Northeast Corner of Collin McKinney Parkway and Alma Road and Accompanying Ordinance]

CONDUCT A PUBLIC HEARING TO CONSIDER AN ACTION REQUEST TO RESIGN THE SUBJECT PROPERTY FROM PLANNED DEVELOPMENT DISTRICT AND REASON EMPLOYMENT CENTER OVERLAY DISTRICT TO SEE TWO LOCAL COMMERCIAL DISTRICT LOCATED ON THE NORTHEAST CORNER OF COLIN MCKENZIE PARKWAY AND ALMA ROAD. THANK YOU, MR MAYOR. JENNIFER ARNOLD, DIRECTOR OF CLEANING AS YOU READ. THIS IS A REZONING REQUEST TREES ON THE SUBJECT PROPERTY FROM PD TO SEE TWO NEIGHBORHOOD COMMERCIAL ZONING DISTRICT. THE PROPERTY IS APPROXIMATELY FOUR ACRES IN SIZE, AND IT'S LOCATED THERE JUST ON THE EAST SIDE OF ALMA AND NORTH OF COLIN MCKENZIE PARKWAY. IN OUR CONVERSATIONS WITH THE APPLICANT, THEIR DRIVER FOR THE REQUESTED RE ZONE IS TOMO BOTH MODERNIZED.

THE USE OF VIOLENCE IS IN DEVELOPMENT STANDARDS ON THE SUBJECT, PROPERTY. MY UNDERSTANDING IS THAT THEY WERE HOPING TO DO A RETAIL STRIP CENTER THAT WOULD ALLOW FOR SOME DRIVE THROUGH RESTAURANTS ON THE IN CAPS OF THAT PARTICULAR BUILDING. IN LOOKING AT THE REZONING REQUEST. WE HAVE NOTED THAT IT IS IN ALIGNMENT WITH THE CITY'S COMPREHENSIVE PLAN, AND THE PROPERTY IS LOCATED AT THE CORNER OF TWO ARE TWO MATERIAL ROADWAYS. WITH THOSE FACTORS IN MIND STAFF HAS RECOMMENDED APPROVAL OF THE REQUEST. THE PLANNING AND ZONING COMMISSION IS ALSO REVIEW. THE ITEM IS IT IS OFFERING A FAVORABLE RECOMMENDATION AND A VOTE OF 61. AND I'M HAPPY TO ANSWER ANY QUESTIONS THAT YOU HAVE. THE LETTERS OF OPPOSITION IS CLEAN. THE HOUSE IS RIGHT BEHIND IT. NO PROBLEM. SO DO NOT BELIEVE THAT WE HAVE RECEIVED ANY LETTERS OF OPPOSITION. IS THE HOUSE IS CLOSEST TO THE DRIVE THROUGH WINDOWS AREN'T BUILT YET. OKAY? RIGHT? DID YOU GET HOME LATE LEAST KNOW WHAT'S COMING SO THEY CAN DETERMINE IF THEY WANT TO BUY IT. I DIDN'T THROW IT AT HIM. IS THE APPLICANT HERE. I BELIEVE THAT THEY ARE HOW DO YOU NOT HAVE. MY NAME IS DANA GARNET AND I WORK FOR THE BEST COMPANIES IN THERE FOR 23 YEARS AND I WORK ON THE DEVELOPMENT CONSTRUCTION SIDE. YES. I JUST WANT TO THANK YOU FOR YOUR CONSIDERATION AND APPROVING THIS REZONING. AND ARE YOU HAVE ANY QUESTIONS FOR ME? SENSE FOR THE UP HERE. THANK YOU SO MUCH. THANK YOU.

APPRECIATE IT. THANK YOU. THIS IS A PUBLIC HEARING. IS THERE ANYBODY HERE THAT WOULD LIKE TO SPEAK TO THIS ITEM? SEEN NONE ENTERTAIN A MOTION. TO APPROVE THIS ITEM. WAS SECURING CLOSED PROBLEM. HEARING IN APPROVE ASYLUM ELSE SECOND CAST YOUR VOTES. NEVER FORGET. DOCTORS HERE. DID YOU TELL HER SHE GOT FIRED? FIRED TODAY. MOTION PASSES. CITIZEN COMMENTS ON

[CITIZEN COMMENTS ON MATTERS NOT ON THE AGENDA]

MATTERS NOT ON THE AGENDA. I DON'T HAVE IT. SO DO I DO HAVE SOMEONE TAMRA JOHNSON? YOU'RE THE ONLY ONE THAT SIGNED UP. ALSO, HOW ARE YOU? MM. FIRST OFF. I WOULD LIKE TO BACKTRACK BY PREVIOUS CONGRATULATORY COMMENTS TO THE NEW LEADERSHIP IN THOSE WHO'VE BEEN DULY ELECTED TO SERVE ON THIS COUNCIL. I WOULD LIKE TO ON THE RECORD APOLOGIZED TO DR JURY FELTUS. TOTALLY MISSPOKE YOUR NAME AND IF SOMEONE WHOSE NAME IS MISPRONOUNCED DAILY.

APOLOGIZE. PLEASE FORGIVE ME. WITH THAT BEING SAID, I NOW WOULD LIKE TO WELCOME THE NEW MEMBERS OF THIS CITY COUNCIL DISTRICT THREE COUNCILWOMAN, DR JURY FELTUS AND DISTRICT ONE COUNCILMAN JUSTIN BELLER. CONGRATULATIONS ON YOUR REELECTION TO MAYOR FULLER AND COUNCILMAN PHILLIPS. I'VE NOTICED THAT THE OUTSTANDING ISSUES REGARDING THE STATUE IN THE SQUARE IN THE NAME CHANGE OF THROCKMORTON STREET ARE NOT ON THE AGENDA FOR THIS MEETING.

THERE REALLY NEEDS TO BE A VOTE ON THAT STATUE ON THE DOWNTOWN MCKINNEY SQUARE. THE STATUE IS

[00:40:03]

THIS DARK? REMINDER OF THE NEGATIVE TIMES OF THE PAST. IT APPEARS THAT THERE SEEMS TO BE A SENTIMENT OF AVOIDANCE IN DEALING WITH THESE ISSUES AND RECENT NEWS, ACCORDING TO AN ARTICLE ENTITLED TEXAS GOP PASSES LEGISLATION BANNING TEACHERS FROM DISCUSSING RACISM. DERRICK MAJOR ON THE BLACK ADDER SIDE ENTERPRISE WEBSITE. THE QUOTE IS THE BILL APPEARS TO BE A PART OF A LARGER PARTISAN PUSH TO HIDE. WHITEWASH OR FLAT OUT, STOP TEACHING ABOUT RACISM AND THE PLIGHT BLACK AMERICANS HAVE FACED IN THE U. S BEFORE, DURING AND AFTER SLAVERY. MANY RED STATES ARE BANNED. BANNING CRITICAL RACE THEORY CRT. IN THIS NATION, THERE HAS SOMEWHAT BEEN A SHIFT TOWARD INCLUSION. THAT STATUE IS A RELIC OF THE OLD GUARDS PAST. I KNOW THE CAN HAS BEEN KICKED DOWN THE ROAD AND THE ISSUE HAS BEEN TABLED.

THERE NEEDS TO BE SOME CLOSURE AND A DECISION MADE AS TO WHEN AND WHERE IT WILL BE MOVED. IN ADDITION, THERE NEEDS TO BE A NAME CHANGE TO THROCKMORTON STREET. THERE'S SO MANY POSITIVES ABOUT TO TAKE PLACE ON THE EAST SIDE OF MCKINNEY. AND TO HAVE THAT OFFENSIVE REMINDER OF OPPRESSION CONTINUE TO RUN THROUGH THE COMMUNITY. IT'S JUST THAT GOOD. PLEASE MAKE A DECISION ON WHEN AND WHAT THE STREET WILL BE RENAMED. AND DON'T FORGET TO REINSTATE THE ORIGINAL NAMES OF THE NEIGHBORHOOD'S LEWISVILLE, LOMAS LOMA. LOVELY HILL AND ROCK WALL. HIS NEIGHBORHOOD NAMES ON THE 2040 COMPREHENSIVE PLAN. I'M A DISTRICT ONE.

COUNCILMAN LES, SHADY AND SHAME WILL DECLARED PROPHETICALLY THE BLACK STATE OF EMERGENCY IN OUR COUNTRY. SINCE LAST YEAR, THERE HAVE BEEN MULTIPLE DEATHS OF AFRICAN AMERICANS AT THE HANDS OF LAW ENFORCEMENT, INCLUDING OUR OWN NATIVE SON, MCKINNEY RESIDENT VARIOUS TARVER. AND HERE IN OUR LOCAL COLLEAGUE, COUNTY DETENTION CENTER. MARVIN'S GOT THE THIRD TO NAME A FEW OF THE MANY. I ASK THAT THIS COUNCIL ACKNOWLEDGED THESE DISPARITIES AND STOP KICKING THE CAN DOWN THE ROAD AND RIGHT ALONGSIDE THE STATE OF TEXAS, AVOIDING THE TRUTH OF RACISM.

TAKE YOUR CAMERA. COUNCIL COMMENTS. WE'LL START DOWN A JURY AND MR OH, YOU HAVE. YEAH.

ARE SORT OF POLICY. UNFORTUNATELY IT HAS TO BE FOR SEX. I APOLOGIZE. MM. IF I IF WE DEVIATE THEN THE. FUSING DOWN THE ROAD IF WE DO NOT. YEAH, BUT WE'LL SHARE IT WITH THE COUNCIL IS WITH COMMENT IS WRITTEN WAS CERTAINLY SHARED AND ENTERED AS A PUBLIC COMMENT. UM. COUNCIL COMMENTS. JUST A BELL COUNCILMAN BETTER WE'LL START WITH YOU. DON'T

[COUNCIL AND MANAGER COMMENTS]

HAVE ANYTHING TONIGHT. APOLOGIZE FOR MISSING WORK SESSION. OH, DON'T WORRY, JUSTIN. I JUST WANTED TO MENTION THIS WEEKEND. WE HAD A BIG EVENT. SMILES, CHARITY.

IT'S NOT AS BIG AS IT USED TO BE, BECAUSE WE'RE STILL STILL PRETTY CLOSE TO COVET, BUT. IT WAS GOOD TO SEE EVERYBODY OUT. EVERYBODY ENJOYING THEMSELVES. IT'S GOOD TO SEE THOSE EVENTS STARTING TO COME BACK. I NOTICED THERE WERE A FEW COUNCIL MEMBERS. THE MAYOR WAS THERE. IT WAS JUST GOOD TO SEE THAT IT WENT THROUGH SMOOTHLY THAT RAISED A LOT OF MONEY, SMILES. CHARITY HELPS VETERANS. WITH HOME OWNERSHIP. ACTUALLY BUILD A HOUSE FOR HIM, AND THAT'S WHAT THE MONEY DOES FOR. SO THANK YOU FOR ALL THE ALL THE VOLUNTEERS THAT HELPED ON THE SMILES, CHARITY. THANK YOU. IT'S MY TREASURE. YEAH, WE'RE YOU THINKS. AS EVERYBODY KNOWS.

THE SESSION ENDED YESTERDAY. PROBABLY GONNA BE IN. EXTENDED SESSION. SPECIAL SESSION, HOWEVER, YOU WANT TO SAY IT ON SOME AGENDA ITEMS THAT THEY SAY THEY SEE SO FIT. WE DID PASS.

UM, SOME LEGISLATION. I SHOULD SAY WE I I'M PART OF THE LAW ENFORCEMENT TEAM DOWN THERE.

THAT HELPS OUT WITH MANY OF THE BILLS THAT WE. WHICH SOMETHING YOU COME UP SHORT WITH SOME OF YOU GET US FAR AS LONG AS YOU GO, AND YOU JUST MAKE A COMPROMISE. UH SEVERAL THE BILLS THAT WERE COMPROMISED WHERE IS LIKE OUR CHOKEHOLD? THAT WE NEEDED A STATEWIDE OUR BODY CAMERA WITH OUR THERE? NO KNOCK WARRANT. WE NEED TO STAND ARISE THAT. AND YOU'RE GOING TO SEE A DUTY TO INTERVENE THAT WILL BE TAKING PLACE ON ACROSS THE STATE. SAY THAT BECAUSE YOU'RE MOST OF TIME LAW ENFORCEMENT FOLKS ONLY TALK ABOUT THE STUFF THAT HELPS THEM THAT JUSTIN, BUT THOSE BILLS ACTUALLY HELP THEM MORE THAN ME IN ALL LAW ENFORCEMENT. MORE

[00:45:04]

THAN YOU KNOW, BECAUSE STANDARDIZING LAW ENFORCEMENT ACROSS OUR STATE AND HAVING EVERY CITY DO EXACTLY THE SAME THING MAKES A BIG DIFFERENCE TO OUR PUBLIC. THAT WAY. THERE'S NO SECOND GUESSING ON WHY DID THEY DO IT THIS WAY? AND WHY DID THEY DO IT THIS WAY? AND I'VE BEEN A BIG PROPONENT OVER THIS FOR THE LAST 26 YEARS THAT WE HAVE TO HAVE A STANDARDIZED.

UNIFORMED BLANKET THAT SAYS THIS IS HOW WE DO IT. AND IF YOU DON'T DO IT LIKE THAT, THEN YOU DON'T NEED TO BE A COP. THAT'S JUST PART OF LIFE. YOU KNOW, YOU WOULD PEOPLE. SOME PEOPLE DON'T NEED TO BE PLUMBERS. SOME PEOPLE DON'T NEED TO BE ATTORNEYS. NOT YOU, BOB. BUT JUST JUST SOME, BUT JUST SOME PEOPLE. AND SO I SAY THAT NOT JUGGLING. WE ALSO DID PASS, YOU KNOW LEGISLATION. I SAID I WAS UP WITH GOVERNOR OF THIS AFTERNOON. WE SIGNED LEGISLATION ON THE FUNDING MECHANISMS. ON CITIES. YOU SEE CITIES LIKE AUSTIN THAT HAVE LOST THEY'VE LOST CONTROL. THEY'VE BEEN THAT THAT'S A BIG REASON FOR THAT LEGISLATION.

YOU'RE GOING TO SEE THAT LEGISLATION AND IT WON'T AFFECT CITIES LIKE MCKINNEY. IT'S NOT GONNA FIX THAT. HE'S EVEN REMOTELY AROUND US. IT'S GONNA FIX CITIES THAT HAVE LOST CONTROL WHERE THEY DON'T SUPPORT THE LAW ENFORCEMENT COMMUNITY. THEIR CRIME IS OUT OF CONTROL. SO YOU HAVE TO HAVE LEGISLATION IN THERE TO SAY YOU CAN'T DO THAT. AND I KNOW THAT'S BIG BROTHER TELLING LITTLE BROTHER YOU CAN'T. BUT THAT'S JUST WERE WRAPPED IN THIS. IN THIS POINT OF TIME, YOU'RE ALSO GOING TO SEE SOME ANTI RIOT BILLS THAT PASSED TWO OF THEM TODAY. ONE WAS BLOCKING THE HOSPITAL. WHERE PROTESTERS WOULDN'T LET THE HOSPITAL OPERATE, AND THAT'S NOT HOW THE PROTEST AND I'M SORRY. WE JUST DON'T HAVE THE LEGISLATION IN THERE. THE TO REMOVE THOSE FOLKS. BUT NOW WE WILL. STARTING SEPTEMBER 1ST. THAT'S A PRIORITY. SO THOSE ARE SOME THINGS THAT HAVE WORKED ON MANY MANY BILLS WORKED ON DURING THE SESSION. 648 TO BE EXACT, BUT THOSE ARE SOME OF THE BILLS THEY GOT THROUGH THE FINISH LINE. VERY PROUD OF THOSE BILLS. YOU KNOW, THERE'S THINGS DOWN THERE YOU DO SINCE JANUARY, AND YOU DON'T KNOW WHAT THE END RESULTS GONNA BE. AND THEN YOU SEE HIM COME TO THE END AND THEN YOU'RE LIKE, FINALLY FINISHED WITH US. AND I'M SORRY THAT SOME OF MY ABSENCE WERE.

IN THIS COUNCIL WERE THERE, BUT THAT'S THAT'S WHERE MY LIVELY THAT TAKES ME SOMETIMES S O. I JUST WANTED TO PUT THAT OUT THERE WITH FOLKS THAT ONE OR SO WHAT DOES HE ACTUALLY DO DOWN THERE? UH 75, THE DEBRIS THAT'S ON THE SIDE OF 75. IS RIDICULOUS. I HAVE NO IDEA WHY TEXT NOT HAS HIRED THE SHODDY CONTRACTORS THEY HAVE. TO CLEAN THIS THING UP, BUT I JUST DROVE IT AGAIN TODAY. UH MOST OF THE DRAINS THAT WE HAVE ON 75 OR COVERED IN GRASS AND MUD.

YESTERDAY WE HAD A LITTLE BIT OF RAIN, RIGHT. SO WHAT DO YOU THINK THOSE DRAINS DID NOTHING.

AND THAT THAT WATER WAS ACROSS 75 YESTERDAY. SO AND I'VE BEATEN PAUL UP OVER THIS FOR WEEKS BECAUSE WE HAVE SO MUCH DEBRIS AND IT'S NOT JUST US, OUR CITY, BUT IT'S ALL THE WAY DOWN. 75. I'M TRYING TO FIGURE OUT. HOW TO GET SOME BIGGER HEADS INVOLVED. T O DO US A SOLID BECAUSE I DON'T WANT TO DRIVE PEOPLE DRIVING THROUGH MCKINNEY AND SAYING WOW, LOOK AT THEIR ROADS. I REALLY DON'T CARE IF THEY DRIVE THROUGH PLANE. I WOULD SAY THAT, BUT I DON'T WANT TO WALK DRIVING THROUGH MCKINNEY AND SAYING THAT. SO IF WE CAN CLEAN IT UP AND GET IT DONE, I'M GOING TO GET IT DONE, UH, MADE THAT PROMISE TO SEVERAL CITIZENS THAT HAVE COMPLAINED ABOUT IT, AND I HOPE YOU GUYS ARE NOTICING IT. AND PLEASE SEND ME THE PICTURES. WHEN YOU SEE A COUCH OF THE IN THE MEDIA. THAT'S BEEN THERE FOR A WEEK.

CINDY. THAT PICTURE POSTED. I WANT TO SHARE IT WITH TEXT ON. SHOW HIM HOW GREAT OF A JOB THEY'RE DOING. BECAUSE THEY CAN DRIVE DOWN THAT ROAD LIKE WEEKEND AND SEE WHAT'S OVER THERE. UM. LAST THING IT DID CARRY THE LOAD THIS WEEKEND THAT THOSE RECENTLY DIDN'T DO.

AH SMILES CHARITY TO EVERYONE WHO DONATED TO MY CARRY LOAD PAGE, WHICH ALMOST HAS 10,000 ON IT RIGHT NOW. I CAN'T THANK YOU ENOUGH. DID 29 MILES. I WOULD HAVE DUNMORE BUT HAD TWO KIDS WITH ME. AND ONE JUST DIDN'T WANT TO GO. THAT FAR S OH, IT'S A GREAT EVENT. IT Z RIGHT HERE IN OUR HOMETOWN IN OUR YOU KNOW, IN THE NORTH TEXAS. REGION IS NOT IN MCKINNEY YET. UM SO, BUT IT'S A GREAT EVENT THAT ZITS 10 YEARS AND IT'S MAKING AND FOR THE VETERANS AND THE FIRST RESPONDERS AND THE FAMILIES THAT THEY HELP IS UNBELIEVABLE SHOW SUPPORT. ON PATRIOT PATRIOTISM THAT YOU SEE ALONG THE WAY, SO IT'S IF YOU'VE NEVER DONE IT. I ENCOURAGE EVERYBODY TO DO IT. IT'S 20 HOURS LONG. YOU DON'T HAVE TO GO FOR 20 HOURS. TRUST ME. NO, RICK, YOU DON'T HAVE TO DO FOR 20. BUT I ENCOURAGE FOLKS TO GO DOWN THERE AND JUST SEE IT ONE TIME. I PROMISE YOU IT WILL CHANGE YOUR LIFE ON WHAT YOU THINK OF OUR NATION. SO THAT'S ALL THAT. LOOKS LIKE YOUR BRAG ABOUT SOME YOUNG PEOPLE FROM MCKINNEY. WOULD. ANDREW DAVIS. AMY GILMORE, TAKE GOODWIN IN BAR LEAVE A AND JORDAN LEVEL,

[00:50:09]

HE'S ANOTHER REASON WHY MCKINNEY IS JUST A WONDERFUL PLACE TO LIVE. THIS IS A LADY WHO WHO STARTED THIS CHARITY, I THINK BACK IN THE LATE NINETIES, AND SHE PUTS DISABLED VETERANS AND HOMES. NOTHING AND FOR JUST THEIR SERVICE, AND S, SO IT WAS GREAT TO BE THERE AND SEE KIND OF A WHO'S WHO OF MCKINNEY.

PRESTON CONGRATULATIONS ON YOUR RECENT MARRIAGE JUST WANTED DID ACKNOWLEDGE THAT SAW YOU OUT THERE AND. THE OTHER THING IS I HAD A FRIEND OF MINE. HE SAYS WE COULD GO. I CAME HOME TO AN INTRUDER IN THE HOUSE. I WAS ABSOLUTELY TERRIFIED AND THE SITUATION WHERE I COULD NOT LEAVE MY HOUSE RIGHT AWAY. I WAS SHAKING FROM HEAD TO TOE BUT IS ABLE TO KEEP CALM. GET TOGETHER. SHE, UM, SPOKE TO, 911 SAYS, AND SHE GOES ON TO SAY THE POLICE. MCKINNEY POLICE DEPARTMENT WAS SO FANTASTIC AND THEIR RESPONSE BOTH IN PERSON AND ON THE PHONE. THEY WERE THOROUGH AND DID NOT LEAVE UNTIL I FELT SAFE AGAIN. HAD MY HOUSE AND STREET PHYSICALLY SURROUNDED.
