THAT SPEAKS TO THE MEAT AND CONFIRM AGREEMENT PROCESS. THAT WHAT I'M SHARING RIGHT NOW. IS REALLY NOT SPECIFICALLY ABOUT THAT AGENDA ITEM. BUT MORE SO, THE PROCESS, UM, JUST GOING FORWARD. SO THE PRESENTATION IS SMALL ENOUGH TO USE SOMEWHAT AS A CASE STUDY FOR A BROADER OPPORTUNITY. INTO AGAIN. MY COMMENTS ARE JUST TOO. IT'S JUST EASY BECAUSE IT'S A SMALL PRESENTATION. SO AS I WALKED THROUGH THE AGENDA ITEM, THREE OPPORTUNITIES CAME TO MIND THAT I HOPE WILL BE OF HELP IN AN AGENDA ITEMS GOING FORWARD. AS A GENERAL CONSIDERATION FOR AN EVEN MORE INFORMED COMMUNITY. PLEASE CONSIDER THESE THREE OPPORTUNITIES. FIRST YOU HAVE AN OPPORTUNITY TO EDUCATE THE COMMUNITY. SO JUST LOOKING AT THIS PRESENTATION. WHAT DOES IT MEAN TO MEET AND COMPARE? SO THEN. SO WHAT? WHAT DOES IT MEAN? SO FROM AN EDUCATIONAL STANDPOINT, THERE'S AN OPPORTUNITY THERE. NUMBER TWO. WHAT REALLY IS THE BUDGETARY IMPACT? ALTHOUGH THERE ARE PERCENTAGES IN THE PRESENTATION. I NEVER SAW A DOLLAR SIGN IN THE PRESENTATION TO EQUATE THE PERCENTAGES WITH THE DOLLAR AMOUNTS. SO WHAT IMPACT WILL THESE PERCENTAGES CHANGE? AND WHAT WILL THEY HAVE IMPACT WILL THEY HAVE ON THE OVERALL BUDGET? UM IS IT ENOUGH, YOU KNOW, ARE THE PERCENTAGE DID THE PERCENTAGES NEED TO BE HIGHER? HOW WILL IT IMPACT THE OVERALL PUBLIC SAFETY BUDGET AND CAN THE CITY'S BUDGET MAY BE HYPERLINKED DISCIPLINE, YOU KNOW, PROVIDING WAYS THAT THE COMMUNITY CAN. TAKE A LOOK AT THOSE PERCENTAGES AND THEN LOOK, LINK THEM TO THE OVERALL BUDGET AND THEN COULD HAVE ADDITIONAL COMMENTS BE LINKED THAT MIGHT SHED MORE LIGHT FOR PERSONS LIKE ME. WHO MAY BE FAMILIAR WITH BUDGETS BUT MAY WANT JUST A LITTLE BIT MORE INFORMATION TO BE INFORMED. AND THEN FINALLY, THE THIRD THING WOULD BE HISTORIC BACKDROP. WHAT IS THE HISTORY OF THE PROCESS? AND ACT ON A RESOLUTION RATIFYING THE THIRD MEETING CONFER AGREEMENT WITH THE MCKINNEY POLICE ASSOCIATION. HI MAYOR, MEMBERS OF COUNCIL BARRY SHELTER. THIS ISN'T CITY MANAGER. EXCUSE ME. SO THIS IS A. BRIEF PRESENTATION ON THE MEAT FOR AGREEMENT. TO BE ABLE TO ANSWER ANY QUESTIONS THAT COUNCIL HAS, BUT I CAN ALSO PROVIDE SOME INFORMATION BASED ON THE CITIZEN COMMENT RECEIVED TONIGHT. SO AS WE GO THROUGH BEFORE I GET STARTED IN THE PRESENTATION ITSELF. THE MEAT CONFER AGREEMENT IS A PROCESS THAT IS PRESCRIBED THROUGH THE LOCAL GOVERNMENT CODE THAT ALLOWS, UH. IN LIEU OF CIVIL SERVICE ELECTIONS IT ALLOWS FOR CITIES AND ASSOCIATIONS FROM THE PUBLIC SAFETY. DEPARTMENTS TO NEGOTIATE TERMS HAVE AN AGREEMENT THAT TYPICALLY DIP DICTATE. UM. BENEFITS PROCEDURES, POLICIES AND THINGS LIKE THAT. THE STAFF REPORT HAS A SECTION ON THE SECOND PAGE THAT DOES TALK ABOUT THE PREVIOUS COUNCIL. ACTIONS REGARDING INCOME FOR AGREEMENT. SO THE FIRST ONE ENTERED INTO WITH BETWEEN THE CITY AND THE. THE POLICE ASSOCIATION WAS IN 2000 AND EIGHT UM. AND THEN IT WAS FOLLOWED BY ANOTHER AGREEMENT IN 2012. AND THEN AN AGREEMENT. I'M SORRY. ME READ MY OWN STAFF REPORT HERE, UH, 2000 AND EIGHT RECOGNIZE THE PURPOSE OF MEAN CONFER DISCUSSIONS, THE FIRST ADOPTED RESOLUTION WITH A MEETING FOR AGREEMENT WAS IN 2012. FOLLOWED BY 2015 AND THEN 2000 AND 17. THIS. AGREEMENT THAT WE HAVE BEFORE YOU TONIGHT IS TO LOOK AT SOME MODIFICATIONS TO THAT WE HAVE MEAN CONFER TEAMS THAT HAVE MET. THE CITY'S TEAM THAT MET WITH THE POLICE ASSOCIATION CONSISTED OF THE CITY MANAGER PAUL GRAHAM'S MYSELF. POLICE CHIEF GREG CONLEY, ASSISTANT CITY ATTORNEY TERRY WELCH, AND THEN THE HR DIRECTOR LIKE OBI AND THE CFO, MARK HALLOWEEN. WE HAD THREE DELIBERATIONS. THESE ARE POSTED AS OPEN MEETINGS AND.

THESE ARE OPEN NEGOTIATIONS TO LOOK AT THE CURRENT CONTRACT IN ANY CHANGES BEING PROPOSED BY EITHER PARTY AS WE MOVE FORWARD. I'M GOING TO STEP THROUGH THE KEY CHANGES OF THIS AGREEMENT. AS PROPOSED, SO. CURRENTLY OUR SALARY TABLES ARE BASED ON THE AVERAGE MINIMUM MINIMUM AND MAXIMUM SALARIES OF 10 COMPARISON CITIES. CURRENTLY THE POLICE DEPARTMENT IS CALCULATED BY TAKING THAT MINIMUM. AND THE AVERAGE OF THE MINIMUM AND MAXIMUM SALARIES AND THEN WE ADD 1.5% TO THAT SO THAT WE MOVE OURSELVES A LITTLE BIT ABOVE THE 50TH PERCENTILE IN THE MARKET. THE PROPOSED HAS KIND OF RAMP RAMPING UP. TIME FRAME TO MOVE FROM 1.5% ABOVE

THAT 50TH PERCENTILE UP TO 2.25% OVER THE LIFE OF THE AGREEMENT. THIS IS AN EFFORT TO MAKE US COMPETITIVE IN THE MARKET SO THAT WE CAN HIRE THE BEST. APPLICANTS AND, UH BUILD THE BEST DEPARTMENT THAT WE CAN HERE IN THE CITY OF MCKINNEY. COUPLE OTHER KEY CHANGES THE DURATION OF THE AGREEMENT. THE PREVIOUS AGREEMENT HAS A DURATION OF FOUR YEARS. THIS CURRENT PROPOSED AGREEMENT HAS A DURATION OF FOUR YEARS, BUT IT ALLOWS FOR AN EXTENSION OF TWO YEARS OF NEITHER PARTY SEES BENEFIT TO RENEGOTIATING. THAT WOULD CONTINUE UNTIL SEPTEMBER.

30TH 2027. ANOTHER CHANGE THAT WE'VE ADDED TO THIS, UH, PROPOSED AGREEMENT IS TO MAKE A CHANGE TO THE CLOTHING AND CELLPHONE ALLOWANCE PORTION OF THE AGREEMENT. TO ADD A CELLPHONE ALLOWANCE OF $50 PER MONTH. THIS IS SOMETHING WE OFFERED TO A LOT OF OUR EMPLOYEES WHO HAVE POSITIONS THAT REQUIRE THEM TO USE THEIR PERSONAL CELL PHONES IN THE.

CONDUCTING OF CITY BUSINESS ARE POLICE OFFICERS. DO YOU HAVE THE EQUIPMENT IN THE VEHICLES, BUT THEY'RE USING THEIR PERSONAL CELL PHONES QUITE A LOT IN ORDER TO CONDUCT BUSINESS, AND AS SUCH, WE HAD OFFERED A CELLPHONE ALLOWANCE TO THEM. UH HUH. ANOTHER KEY CHANGE IS A SICKLY PAYOUT. THE PROPOSED AGREEMENT WILL REMOVE WHAT'S CURRENTLY IN THE AGREEMENT TODAY, UM. JUST BACK UP A LITTLE BIT. SO THE EXISTING AGREEMENT. 2017 AGREEMENT. THERE'S A SET SCHEDULE FOR PAY OUT OF ACCRUED SICK LEAVE. WHEN SOMEONE.

RETIRED FROM THE CITY OF MCKINNEY POLICE DEPARTMENT. IT REQUIRES A LINK TO THE RETIREMENT THROUGH THE TEXAS MUNICIPAL RETIREMENT SYSTEM. AND IF THEY DO RETIRE THEY CAN RECEIVE UP TO A CAP AMOUNT OF THEIR SICK LEAVE PAID OUT UPON. LEAVING THE CITY. WE CAN NEGOTIATING THIS WITH THE ASSOCIATION. WE LOOKED AT SOME SCENARIOS WHERE SOMEONE MAY NOT NECESSARILY BE RETIRING FROM THE CITY, BUT THEY HAVE PUT IN WHAT I'D CALL IT. GOOD SHIFT THAT THEY'VE WORKED A NUMBER OF YEARS FOR THE CITY. SOMETIMES 20 SOMETIMES 30, PLUS YEARS WITH THE CITY AND MAYBE LEAVING FOR ANOTHER OPPORTUNITY, MAYBE A CHIEF LEVEL POSITION IN ANOTHER CITY. UNDER CURRENT POLICY, THEY WOULD ONLY RECEIVED 50% OF THE PROPOSED PAYOUT. THIS REMOVES THAT LINK, SO IF THEY MOVE FOR THOSE. OTHER REASONS FROM THE CITY MCKINNEY BUT LEAVE IN GOOD STANDING AS DETERMINED BY THE CHIEF OF POLICE, THEY COULD RECEIVE THEIR FULL PAYOUT UP TO THE CAPS. UH, IN THE AGREEMENT. THE LAST KEY CHANGES AND NOTICE TO THE ASSOCIATION WHEN AMENDING GENERAL ORDERS SO THE POLICE DEPARTMENT HAS A NUMBER OF GENERAL ORDERS. THERE ARE A FEW THAT THE ASSOCIATION FELT WERE VERY, UM, IMPORTANT TO THEM IN TERMS OF PROMOTIONAL PROCEDURES. YOUR SUPPORT PERSONNEL COMPLAINTS AND INVESTIGATION AND CORRECTIVE MEASURES. THIS IS A SIMPLE PROVISION THAT SAYS IF THE CHIEF OF POLICE PROPOSES TO CHANGE THOSE SECTIONS, HE WILL GIVE NOTICE TO THE ASSOCIATION AND THEN WE'LL MEET AND DISCUSS THOSE PROPOSED CHANGES WITH THEM. ULTIMATELY THE DECISION STILL IN THE POLICE CHIEF'S HANDS, WHETHER OR NOT TO AMEND THOSE, BUT THIS REQUIRES THAT BACK AND FORTH OR THAT DISCUSSION OF THOSE PROPOSED CHANGES BEFORE THEY'RE MADE.

SOMETHING IN PRACTICE IS ALREADY ONGOING. IN THE DEPARTMENT, THE POLICE CHIEF ALWAYS CONFERS WITH THE ASSOCIATION IN SUCH CASES, BUT THIS IS JUST TO PUT IT INTO THE AGREEMENT TO MAKE SURE THAT IT HAPPENS. MOVING FORWARD. WITH THAT. THAT'S THE LAST SLIDE I HAVE IS, STAFFS RESPECTFULLY RECOMMENDING APPROVAL OF THE AGREEMENT, AND I'M HAPPY TO ANSWER ANY QUESTIONS. I DO WANT TO NOTE THAT ATTACHED TO THE AGENDA ITEM IS THE RESOLUTION.

AND TO DO THAT IT REQUIRES THE BEST PEOPLE SO, UH, FRED CAN PROBABLY ATTEST TO THIS. BUT THESE AGREEMENTS, UM, AT THEIR CORE ALLOWS US TO DO THAT TO BE ABLE TO PROVIDE COMPETITIVE PAY AND BENEFITS. AND ATTRACT AND RETAIN THE BEST PEOPLE. AND IN TURN, PROVIDE THE BEST SERVICE.

SO AS AN ORGANIZATION, I THINK YOU KNOW, I THINK THE PROCESS HAS BEEN GOOD. I THINK THAT THE OUTCOME IS GOOD, BUT I THINK WE CAN USE THIS PROCESS AS A MODEL TO ENSURE. THAT WE'RE ATTRACTING AND RETAINING THE BEST EMPLOYEES ACROSS THE BOARD. WE TALKED ABOUT THAT

HOW TO DO THAT FOR EVERYONE, BUT I JUST THOUGHT IT WAS IMPORTANT TO BRING IT DOWN AND HIGHLIGHT THAT PROCESS AND SHOW HOW WE'RE WORKING AS AN EMPLOYER TO BE THE EMPLOYER OF CHOICE AND TO PROVIDE THE BEST SERVICE THAT WE CAN AS AN ORGANIZATION. WE ARE RANKED THE SAFEST CITY IN THE STATE OF TEXAS AS A RESULT OF THE WORK THEY DO. AND UM, ELATED TO SEE THAT WE'RE GOING TO BE ON A MUCH MORE AGGRESSIVE. PAY INCREASED SCALE SHOULDN'T BE AVERAGE. WE'RE NOT AVERAGE WELL ABOVE AVERAGE. THEY NEED TO BE EVERYTHING NEEDS TO REFLECT THAT, AND THAT'S THE DIRECTION THAT WE ARE HEADED AND VERY RIGHTFULLY SO. AND I COULDN'T BE PROUDER TO BE A MAYOR IN A CITY WITH. POLICE DEPARTMENT FIRE DEPARTMENT AS WELL FOR THAT MATTER THAT IS AS ESTEEMED AS YOU GUYS ARE. SO THANK YOU. AND JUST IN MY RUSH TO GO THROUGH THE PRESENTATION, I DID FAIL TO THANK THE ASSOCIATION LEADERSHIP. AS. HAVING THE BEST OFFICERS IS ONE OF THE HARDEST THINGS AND RECRUITING OR ATTENTION AND RETIREMENT IS THE THREE FACTORS THAT WE ALWAYS LOOK FOR IN BUILDING ANYTHING AND TO PUT THAT TOGETHER A CONTRACT. THE VOTE WILL BE REQUIRED WITH SPECIFIC WORDING OF EMOTION, WHICH IS IN FRONT OF YOU AND IT WILL. THIS INITIALLY SETS THE CEILING, WHICH IS THE TOP TAX RATE THAT WE CAN SET. UM. FOR FISCAL YEAR 22 THIS YEAR THAT PROPOSED TAX RATE CEILING IS 220.5025. AND, AS YOU KNOW, OUR CURRENT TAX RATE IS POINT, FATHER 8645. SO EVEN WITH THE CEILING, WE WOULD BE. REDUCING OUR TAX RATE THAT BEING SAID THE CITY MANAGER'S RECOMMENDED TAX RATE IN THE BUDGET WILL BE LESS THAN THE TAX RATE CEILING THAT YOU SEE BEFORE YOU TONIGHT. BUT WE DID WANT TO GIVE YOU THE OPTION OF SETTING WHAT A TAX RATE WITHIN THE 3.5% THAT IS ALLOWED BY LAW. SO THAT'S WHY WE HAVE SET THE RATE AT 502500. SO A LITTLE BIT TO TALK ABOUT TAX RATES A LITTLE BIT THE NO NEW REVENUE TAX RATE THAT I MENTIONED IS A TAX RATE THAT SAYS, CALCULATE RATE THAT WOULD PROVIDE A TAXING UNIT OR US.
