[Consider/Discuss/Act on a Resolution Authorizing the City Manager to Execute a Contract and All Necessary Change Orders with Mario Sinacola and Sons Excavating, Inc., for the Construction of the Wilmeth Road (Lake Forest Drive to Hardin Boulevard) Project]

ON A RESOLUTION AUTHORIZING THE CITY MANAGER DEXIA, THE CONTRACT AND UNNECESSARY CHANGE ORDERS.

WITH MARIO CYNICAL AND SONS EXCAVATING INC FOR THE CONSTRUCTION OF THE WILMOTH ROAD FROM LAKE FOREST DRIVE TO HARDEN BOULEVARD PROJECT. THANK YOU. MAYOR FULLER COUNCIL. NICOTINE ENGINEERING SIP MANAGER HAPPY NEW YEAR. DO YOUR PRESENTATION PULLED UP HERE. DAUGHTER BEFORE YOU THIS EVENING. WELL THE CITY IN TURN TO CONSTRUCTION CONTRACT FOR THE CONSTRUCTION OF WILMOTH ROAD BETWEEN LAKE FOREST AND HARDEN. THIS IS A MASSIVE INFRASTRUCTURE PROJECT TRANSPORTATION PROJECT FOR NORTHWEST SECTOR. OBVIOUSLY, WITH ALL THE GROWTH THAT'S OCCURRING THERE. YOU CAN SEE ON THE SCREEN HERE. THIS IS JUST A PICTURE OF THE INFAMOUS 90 DEGREE. TURN THERE AS YOU HAD WEST ON COUNTY ROAD, 9 43 UP TOWARDS IRWIN PARK. BASICALLY WILMOTH ROAD WOULD GO EAST AND WEST FROM THIS PICTURE. THE PROJECT CONSISTS OF FOUR COMPONENTS. OBVIOUSLY THE PRIMARY IS THE CONSTRUCTION OF A FOUR LINE THOROUGHFARE FOR WILMOTH ROAD. CLASSIFIED AS A FOUR LINE GREENWAY ARTERIAL BETWEEN LIKE FOREST AND HARDEN.

THE PROJECT WILL ALSO INCLUDE A SIX LANE TWIN BRIDGE STRUCTURE OVER FRANKLIN BRANCH. THE PROJECT WILL INCLUDE THREE MULTI LANE ROUNDABOUTS LAKE FOREST COUNTY ROAD, 9, 43 AND HARDEN.

YOU ALSO INCLUDE ADDITIONAL CONSTRUCTION TRAVEL LANES ON COUNTY ROAD, 1943 AND HARD TO COMPLETE THOSE INTERSECTIONS. WHEN WE TALK ABOUT THE NORTH NORTHWEST SECTOR AND MOBILITY, THIS PROJECT'S GOING TO PROVIDE A EAST WEST CONNECTION FROM US 75. THROUGH INTO THE NORTHWEST SECTOR, OBVIOUSLY SUPPORTING EXISTING AND FUTURE DEVELOPMENT . IT'S GOING TO REDUCE THE RELIANCE ON US. 3 80 IS THE EAST WEST PRIMARY THOROUGHFARE THROUGH THE CITY. AND THEN IN CONJUNCTION WITH THE ONGOING CONSTRUCTION OF RIDGE ROAD. THIS WILL DEVELOP A FULL ROUNDABOUT CORRIDOR ALONG WITH ROAD BETWEEN RIDGE ROAD AND, UM PARDON THERE. ON THE BOTTOM OF THE SCREEN. YOU CAN SEE SOME RENDERINGS OF THE THREE ROUNDABOUT WILL BE CONSTRUCTED LIKE FORREST COUNTY ROAD, 9, 43 AND HARDEN. JUST A LITTLE HISTORICAL TIMELINE. THE PROJECT WAS INCLUDED IN THE SIP BACK IN OCTOBER OF 2018. AT THAT TIME, WE HAD ONLY FUNDED TWO LINES OF CONSTRUCTION ON OCTOBER 2019 VOTERS AUTHORIZED. PROPOSITION E END OF THE 2019 BOND. AT THAT TIME, WE INCREASE THE SCOPE OF THE PROJECT CONSTRUCTION FOUR LINES. WE APPROVED THE DESIGN CONTRACT.

CAN WE HORN? IN MARCH OF 2020 COLLIN COUNTY COMMISSIONERS AWARDED THE CITY MCKINNEY $11 MILLION IN LOCAL SUPPORT FOR THIS PROJECT. SO THEY'VE BEEN A GREAT PARTNER TO WORK WITH. WE APPRECIATE THEIR PARTNERSHIP ON THIS PROJECT. DESIGN WAS COMPLETED IN OCTOBER OF LAST YEAR PROJECT IS ADVERTISED FOR BIDS, AND TODAY WE'RE ASKING FOR A CONTRACT WITH MARIO CYNICAL AND SONS. WE DID RECEIVE FIVE BIDS ON THE PROJECT, MARIO SI NICOLE AND SONS WAS THE LOWEST QUALIFIED BIDDER. AND PINNING AWARD CONSTRUCTION WOULD BEGIN THIS FEBRUARY AND IS ESTIMATED BE COMPLETED BY JANUARY OF 24. WITH THAT ALL BE HAPPY TO ANSWER ANY QUESTIONS ABOUT THIS PROJECT. QUESTIONS. ARE THESE? THESE ROUNDABOUTS THAT WE HAVE, WHICH I 100% SUPPORT. BUT HE'S

[00:10:19]

KIND OF THE FIRST BIG ROUNDABOUTS IT WILL HAVE IN MCKINNEY. YES SO ACTUALLY THE RIDGE ROAD ROUNDABOUT, JUST ONE OF THE CONSTRUCTION WILL BE THE FIRST MULTILINGUAL ROUNDABOUT IT AT RIDGEWOOD WILMOTH, AND THIS PROJECT WILL CONSTRUCT THE THREE. FALLING MULTI LINE AROUND ABILITIES WILL BE THE FIRST FOUR. MAJOR RANDOM BELTS OF THE CITY, MCKINNEY GREAT. I THINK IT'S A GREAT IDEA. THANK. CURE, OF COURSE, IGNORING THE ROUNDABOUT IN ADRIATIC TO THAT.

ONE COULD ARGUE IS NOT MAJOR BUT MULTIPLYING POPULAR. ANY OTHER QUESTIONS FOR NICK NOT ENTERTAIN A MOTION. MICHAEL MOVED TO APPROVE THIS I DON'T KNOW. COMMIT. SECOND THAT MOTION. I COULDN'T HEAR IT. PLEASE CAST YOUR VOTES. SHOULD PASSES. NEXT ITEM. 210002 A. 210021 Z THREE CONDUCTED PUBLIC HEARING TO CONSIDER AN ACT ON A PETITION TO ANNEX CASE NUMBER 210002 AND REQUEST TO ZONE CASE NUMBER 21 00210 AND CERTAINLY AND THE PROPERTY TO PD PLAN DEVELOPMENT DISTRICT LOCATED THE SOUTH SIDE OF COUNTY ROAD, 2 78, APPROXIMATELY 1800 FT. EAST OF STATE HIGHWAY FIVE AND BALANCE STREET AND RELATED ORDINANCE AND AGREEMENTS. THANK YOU, MR MAYOR.

JENNIFER ARNOLD, DIRECTOR OF PLANNING. YOU'RE GOING TO SEE ME UP AT THIS PODIUM QUITE A BIT TONIGHT, BUT FIRST ITEM BEFORE YOU IS, AS YOU STATED IT IS A REQUEST TO ANNEX AND ZONE THE SUBJECT PROPERTY INTO THE CITY. THIS IS PHASE EIGHT OF THE WILLOW WOOD DEVELOPMENT AND I WILL, UH THEY'RE LOCATED ON THE NORTHERN STRETCH OF STATE HIGHWAY FIVE ON THE EAST SIDE OF THE ROADWAY. THE APPLICANT IS REQUESTING TO ANNEX AN ADDITIONAL PORTION OF PROPERTY INTO THEIR MASTER PLANNED DEVELOPMENT AND ZONE IT CONSISTENT WITH THE DEVELOPMENT THAT YOU'RE ALREADY SEEING OUT THERE, AND WILLOW WOOD. SO WHEN ASSOCIATION WITH THAT ANNEXATION REQUEST ARE SEVERAL, UH SUPPORTING DOCUMENTS. ONE IS IN MUNICIPAL SERVICES PLAN THAT WILL JUST OUTLINE THE LEVEL OF SERVICE THAT THE CITY WOULD BE PROVIDING TO THIS NEWLY ANNEXED PROPERTY. THERE IS AN ANNEXATION DEVELOPMENT AGREEMENT THAT OUTLINES THE EXPLICIT REQUIREMENTS FOR THE DEVELOPMENT OF THE PROPERTY. THIS IS THINGS RELATED TO PERMITTING FEES, INFRASTRUCTURE REQUIREMENTS, ETCETERA. AND THEN THE ASSOCIATED ZONING, WHICH IS BASED ON THE SF FIVE ZONING DISTRICT, WITH SOME MODIFICATIONS TO THE SPACE LIMITS AGAIN, CONSISTENT WITH WHAT WE'RE SEEING OUT IN WILLOW WOOD PHASES ONE THROUGH SEVEN WITH THAT STAFF IS RECOMMENDING APPROVAL OF THE ANNEXATION AND ZONING REQUESTS. WE'VE EVALUATED AGAINST COMPREHENSIVE PLAN AND THE EXISTING DEVELOPMENT AND WE FEEL IT'S CONSISTENT WITH THE CITY'S CAN'T PLAN AND THE DEVELOPMENT THAT WE'RE SEEING THERE ALREADY, SO I'M HAPPY TO ANSWER ANY QUESTIONS THAT YOU MIGHT HAVE. AND I BELIEVE OUR APPLICANT IS HERE AS WELL.

QUESTIONS FOR JENNIFER. THE APP CAN LIKE TO COME UP AND SPEAK. GOOD EVENING. MAYOR FULLER COUNCIL. MY NAME IS FRED PHILLIPS, 50 55. KELLER SPRINGS BOULEVARD SUITE 500 ADDISON. I AM THE OWNER AND DEVELOPER OF THE WILLOW WOOD NEIGHBORHOOD. WHICH HAS BEEN VERY SUCCESSFUL AND I'M VERY PROUD OF IT. I HOPE YOU ARE AS WELL. THIS IS A ADJACENT PHASE. IT'S ACTUALLY BEING SOLD TO US. DURING THE. DURING THE ORIGINAL PHASES OF WILLOW WOOD. WE HAD AN EGG TENANT OUT THERE TO PLANT CROPS ON THE UNDEVELOPED LAND, AND HE APPROACHED US TO ACQUIRE HIS TRACK, SORT OF LATE IN THE GAME ARE BUILDERS WOULD LOVE MORE LOTS ARE DOING VERY WELL OUT THERE AND JUST WOULD APPRECIATE YOUR SPORT. QUESTIONS FOR THE APPLICANT. THANK YOU VERY MUCH.

THANK YOU. THIS IS A PUBLIC HEARING. IS THERE ANYONE THAT WOULD LIKE TO SPEAK TO THIS ITEM? SEEING NONE ENTERTAIN A MOTION. I MOVE THAT WE CALLED THE PUBLIC HEARING AND APPROVED THIS ITEM. ON SECOND. IT'S CASTRO VOTES. AND PASSES NEXT ITEM. 210012 S U P TWO DR.

[Conduct a Public Hearing to Consider/Discuss/Act on a Specific Use Permit Request for a Service Station (Strickland Brothers Oil Change), Located on the Southwest Corner of Ridge Road and McKinney Ranch Parkway, and Accompanying Ordinance]

PUBLIC HEARING TO CONSIDER AND ACT ON A SPECIFIC USE PERMIT REQUESTS FOR SERVICE STATION STRICKLAND BROTHERS OIL CHANGE LOCATED ON THE SOUTHWEST CORNER OF RIDGE ROAD, MCKINNEY RANCH

[00:15:01]

PARKWAY AND ACCOMPANYING ORDINANCE. THANK YOU, MR MAYOR. AS YOU READ. THIS IS A REQUEST FOR A SPECIFIC USE PERMIT FOR STRICKLAND. OIL STRICKLAND, BROTHER OIL CHANGE THE PROPERTY IS LOCATED ON THE SOUTH SIDE OF MCKINNEY RANCH PARKWAY AND JUST WEST OF RIDGE ROAD. IT'S ABOUT AN ACRE IN SIZE. AND THE CURRENT ZONING ON THE TRACK IS C TWO, WHICH REQUIRES CONSIDERATION OF THIS S U P TO ALLOW FOR SERVICE STATION ON THE PROPERTY. STAFF HAS EVALUATED THE REQUEST FROM THE APPLICANT AND I WILL FLIP TO THE PROPOSED SCP EXHIBIT FOR THE SERVICE STATION, WHICH WOULD INCLUDE THREE DAYS FOR QUICK SERVICE OIL CHANGES ON THE ON THE SITE. YOU KNOW THE APPLICANT TO GO INTO A LITTLE BIT MORE DETAIL ABOUT ALL OF THEIR OPERATIONS ON SITE.

UNFORTUNATELY WHEN WE LOOK AT THIS SITE, AND WE DO HAVE CONCERNS ABOUT THE INTENSITY OF ANY AUTO RELATED USE OR AUTOMOTIVE REPAIR RELATED VIEWS. ON THIS PROPERTY, GIVEN THE CONTEXT OF THE AREA AND THE LOWER INTENSITY COMMERCIAL THAT WE'RE SEEING ON THE OTHER CORNERS OF THIS INTERSECTION BACK IN 2000 AND 19. AM AUTOMOTIVE REPAIR FACILITY REQUEST CAME FORWARD FOR THIS TRACT AS WELL. IT WAS ULTIMATELY RECOMMENDED FOR DENIAL BY PLANNING AND ZONING COMMISSION AND THEN WITHDRAWN BY THE APPLICANT BEFORE BEFORE APPEARING BEFORE THE COUNCIL. ALTHOUGH THIS REQUEST FOR A SERVICE STATION IS A SLIGHTLY LOWER INTENSITY THAN WHAT WE SAW IN 2019, WE DO HAVE CONCERNS WITH THE AUTO RELATED USE, GIVEN THE VISION OF THIS AREA. FOR LOWER INTENSITY COMMERCIAL DEVELOPMENTS AT THIS INTERSECTION IN PARTICULAR, AS YOU'LL SEE IN THE AREAS THAT HAVE ALREADY DEVELOPED IN THIS INTERSECTION. MOST OF THEM ARE NON AUTO RELATED OR NON AUTO ORIENTED, UM, PULLED UP A LITTLE BIT CLOSER TO THE STREET WITH THAT NICER FRONTAGE TO HAVE THAT NEIGHBORHOOD SERVICE SCALE. UM FEEL, AND SO WHEN WE'RE LOOKING AT THIS REQUEST, THOSE ARE THE THINGS THAT WE'RE CONSIDERING.

AND AS THAT, AS WE REVIEWED THAT THAT'S THE REASON THAT WE ARE RECOMMENDING DENIAL OF THE REQUEST. I'M HAPPY TO ANSWER ANY QUESTIONS THAT YOU MIGHT HAVE. BUT I KNOW THE APPLICANT IS HERE AS WELL. ALWAYS THE PNC APOLOGIZE. THANK YOU FOR REMINDING ME. SO PLANNING AND ZONING COMMISSION DID RECOMMEND APPROVAL IN A VOTE OF FIVE TO WHAT? WHAT WOULD YOU PUT HERE? WHAT WOULD GO HERE IF THEY WEREN'T ABLE TO PUT WHAT THEY WANT? WELL I WILL. SO THE FIRE LINE THAT YOU'RE SEEING THERE. YOU POINTED OUT, I WILL GET RIGHT HERE. SO THIS FIRE LANE IS EXISTING AND THAT DOES CREATE SOME CHALLENGES, PERHAPS TO HAVE MORE FORWARD FACING BUILDING BUT A LOWER SCALE, PERHAPS OFFICE OR EVEN AN EATERY OR SHOP OF SOME SORT. IS REALLY WHAT WE WOULD LOOK FOR ON THIS PARTICULAR TRACKED GIVEN THE DEVELOPMENT FOOTPRINT THAT WE'RE SEEING IN THE AREA AND THE SEA TO ZONING ON IT, BUT IT'S REALLY NOT PRACTICAL, BECAUSE I THE LAUNCH JUST TOO SMALL. YOU'RE RIGHT. YOU YOU YOU DO THAT, AND FEEDING 11 LITTLE STORY EATERY CAN'T JUSTIFY YOU KNOW, A MILLION AND A HALF DOLLARS. BUILDING THAT'S GOING TO REQUIRE FOR THAT. AND SO THAT'S MY THOUGHT IS WHAT ELSE ARE YOU GOING TO PUT THEIR AND YOU CAN'T COME UP WITH ANYTHING THAT'S REASONABLE BECAUSE NONE OF THOSE ARE REASONABLE. AND SO I LIKE THIS.

I MEAN, I THINK IT'S UTILIZING THE. THE PROPERTY IN IN A GREAT WAY. I MEAN, LIKE, SAY, THERE'S NO OTHER, YOU KNOW, IT'S NOT LIKE YOU HAVE TO HAVE A LOT OF AUTOMOTIVE ALL AROUND IT. I MEAN, TYPICALLY ONE OF THESE TYPE OF BAYS OR THEY'RE VERY QUIET. I THINK THE OTHER ONE WAS LIKE A TIRE REPAIR SO THAT EVERYBODY IS WORRIED ABOUT THE NOISE. AND YEAH, I MEAN, THAT'S BUT THERE IS NO NOISE FROM OIL EXCHANGE. ABSOLUTELY AND ONE OF THE THINGS OR SOME OF THE BIG THINGS THAT WERE LEANING ON AS A STAFF WAS THE ORIGINAL VISION FOR THIS AREA, WHICH WE CALL THIS THE TIP OF THE BULLET. RIGHT. SO THIS WE'VE GOT A LOT OF APARTMENTS THAT ARE JUST SOUTHWEST OF THIS. UM THAT ARE BOUNDED BY RIDGE AND STACY AROUND THEM, AND WE LOOKED AT AS THE BULLET AND THE EVENT DIVISION FOR THAT AREA ORIGINALLY WAS FOR MORE WALKABLE SMALL SCALE NEIGHBORHOOD DEVELOPMENT THAT HAD A LOT OF HIGH DENSITY WITH MORE WALKABLE SHOPS. AND SO WE'RE REALLY LOOKING AT THAT. IN THE ORIGINAL INTENT OF THE ZONING THAT WAS IN PLACE PRIOR TO THE REASON THAT HAPPENED BACK IN 2000 AND 14, 2000 AND 15. AND IF IT IS THE DESIRE OF THE COUNCIL TO ALLOW FOR THIS TYPE OF USE IN THIS TRACK, THAT'S ABSOLUTELY AT YOUR DISCRETION. WE'RE JUST LOOKING AT THE POLICY DOCUMENTS THAT WE HAD IN FRONT OF US. SOME OF THE PRECEDENT THAT HAD BEEN SET WITH OTHER S UPS FOR SIMILAR TYPE USES ON THIS TRACT, AND THAT'S WHERE WE REALLY LANDED ON THE RECOMMENDATION THAT WE'RE BRINGING TODAY. JENNIFER IS THIS SITE CONSISTENT FOR LIKE A STARBUCKS OR DUNKIN DONUTS OR ANY OF THOSE SERIES, THE APPLICANT AND PERHAPS EVEN THE MAYOR WITH HIS DEVELOPMENT BACKGROUND CAN SPEAK A LITTLE

[00:20:02]

BIT TO THIS. UM SMALL SCALE RESTAURANTS, TYPICALLY OR AN ACRE TO AN ACRE AND A HALF SITE, AND THIS IS JUST OVER AN ACRE, SO IT MAY BE SMALL BUT DEPENDING ON YOUR DEVELOPMENT STYLE, I'M SURE YOU COULD FIT IT ON THERE. IT'S CHALLENGING AS SHE SAID THAT THAT FIRE LINE MHM. DO WE KNOW WHAT THE BUILDING IS GOING TO LOOK LIKE? THEY'VE GIVEN US ANY RENDERINGS WE DO, AND I BELIEVE THEY'VE GOT A PRESENTATION WITH A WALK THROUGH SOME OF THE ELEVATION. I WILL NOTE THAT NONE OF THOSE ARE ENFORCEABLE BY THE CITY. BUT IF THE AFRICANS GONE THROUGH THE EFFORT OF THEIR DEVELOPMENT. I'M SURE THAT THAT'S SOMETHING TO BE EXPECTED. THANK YOU, JENNIFER APPLICANT COULD COME UP AND SPEAK TO THE ENEMY. SO I'M BRENNAN WIDELY WITHIN THREE REAL ESTATE. I APPRECIATE YOUR TIME. I APPRECIATE STAFFS COMMENTS. CAN SEE. DO YOU KNOW IF OUR PRESENTATION IS FLOATED BY JAN. OKAY. THANK YOU. ALL GOOD POINTS. WE. THANK YOU. WE ARE A LESS INTENSE OF USE. WE HAVE REALLY WORKED HARD TO TRY AND TAKE STAFF'S RECOMMENDATIONS INTO ACCOUNT SHIELD. YOU KNOW ANY NOISE OR, YOU KNOW VISUALS THAT MAY BE UNDESIRABLE HERE, BUT I WILL JUST WORK THROUGH ME. JUST KIND OF START FROM THE BEGINNING. YOU KNOW, STRICKLAND BROTHERS IS A FAST FRIENDLY. CLEAN AND TRUSTWORTHY OIL CHANGE PROVIDER WHERE YOU STAY IN YOUR CAR FOR SERVICE, TYPICALLY IN AND OUT WITHIN 10 MINUTES. UM THESE ARE SOME SHOTS OF OTHER LOCATIONS ABOUT 1800 SQUARE FEET, USUALLY THREE BAYS. YOU ASKED A CIVICALLY ABOUT WHAT IT'S GOING TO LOOK LIKE, SO I WILL FLIP TO THAT REALLY QUICK. AND THEN I'LL COME BACK. UM THIS IS THE EXISTING ELEVATION THAT WE'RE WORKING WITH. THE ADJACENT STRIP CENTER AND SENIOR LIVING CENTER. ARE IN THIS DESIGN. THEY'RE VERY LIGHT WITH STONE AND EMPHASIS AND THIS, UM, METAL ROOF THAT HAS THE STANDING SEAM SO WE'RE TRYING TO MATCH THOSE AS MUCH AS POSSIBLE. COME. YOU KNOW, I REALIZED IF YOU KNOW IT MAY NOT BE ENFORCEABLE, BUT WE WILL COMMIT TO DOING THAT.

OBVIOUSLY WE'VE GOT TO GET THROUGH DESIGN AND PLANNING, BUT WE DON'T HAVE ANY INTENTION OF CHANGING OFF OF THIS. UM AND YOU KNOW WOULD COMMIT THAT TO YOU GUYS. THE SERVICES. I DO WANT TO ADDRESS OUR HOURS, YOU KNOW, ARE 8 TO 7 MONDAY THROUGH FRIDAY, LIMITED HOURS ON THE WEEKEND 8 TO 5 ON SATURDAY 10 TO 5 ON SUNDAY. WE DO NOT USE ANY PNEUMATIC TOOLS. WE DO NOT HAVE ANY CAR STORED OVERNIGHT. WE DO NOT HAVE ANY REPAIRS GOING ON IN THE PARKING LOT OR MATERIALS STORED OUTSIDE. EVERYTHING IS DONE WITHIN THESE BAYS. AND THEN THEY PULL OUT. UM SO IT IS PRETTY YOU KNOW, I DON'T REALLY SEE IT AS AN INTENSE USE. UM THE OTHER, YOU KNOW, USES THAT ARE WITHIN OUR ZONING CLASS, AND SOME OF THEM DON'T EVEN REQUIRE AN ISSUE P OR QUICK SERVICE RESTAURANT WITH DRIVE THROUGH TO HAVE A LOT MORE TRAFFIC NOISE. IN TRASH. UM THE ON THE RIGHT.

YOU KNOW, SOME OF THOSE SERVICES THAT MEINEKE YOU KNOW PROVIDES, YOU KNOW, OR MAYBE WERE OF CONCERN IN THE PAST, BUT WE DO NOT DO ANY OF THOSE, SO THE OPERATOR IS NOT ALLOWED TO DO THEM UNDER THEIR AGREEMENTS AND UNDER THEIR LEASES WITHIN THREE MM. THE OPERATORS AND THEY APOLOGIZED FOR NOT BEING ABLE TO BE HERE TONIGHT. THEY ACTUALLY TESTED POSITIVE FOR COVID.

UNFORTUNATELY I GUESS I JUST MADE THAT PUBLIC RECORD FOR THE WORLD. BUT THEY WANTED TO APOLOGIZE FOR NOT BEING HERE. I KNOW THEY WERE AT OUR MEETING WITH TIM ROGERS, BUT THEY ARE LOCAL EXECUTIVES AND BUSINESS. THEY LIVE IN PLANO. THEY'RE MARRIED, THEY LOOK FORWARD TO GIVING BACK TO THE COMMUNITY THROUGH THE STRICKLAND BROTHERS FOUNDATION FUND AND THE BODY BENCHES WITH THE LOCAL ELEMENTARY SCHOOLS. UM SHE SAID MOST OF THE USES ON THIS CORNER ARE COMMERCIAL. UM WE HAVE A SENIOR CARE CENTER TO OUR WEST THAT WAS OPPOSED TO MEINEKE AND WE HAVE A LETTER OF SUPPORT FROM THEM. THEY ARE. IT'S ON FILE FOR YOU. THEY DON'T SEE ANY ISSUE AND THEY'RE EXCITED ABOUT THE USE. SO AS FAR AS INTENSITY AND ABLE ABILITY, YOU KNOW, IN THREE IS A NATIONAL DEVELOPER FOR MANY RETAIL BRANDS, IT WOULD BE TOUGH TO FIT A STARBUCKS INSIDE THIS CURB IN AREA. WITH THE PARKING AND THE STACKING THAT WOULD BE REQUIRED. UM AND THEN THE ECONOMICS AS YOU MENTIONED MAY NOT SUPPORT IT. SO WHAT WE HAVE DONE IS REALLY TRIED TO GO ABOVE

[00:25:02]

AND BEYOND ON LANDSCAPING. IF YOU CAN SEE WE'RE BASICALLY LANDSCAPING, ALL THREE SIDES ABOVE REQUIREMENT. SO THAT YOU KNOW, IN THE EVENT, SOMEONE DOES NOT WANT TO SEE AN OIL CHANGE FACILITY. THEY DON'T HAVE TO. BUT WE'RE REALLY TRYING TO BLEND IN AND THEN AS FAR AS TRAFFIC BASED ON THE REQUIRED CALCULATIONS, I MEAN, WE'RE LOOKING AT ABOUT 120 TRIPS, YOU KNOW, PROJECTED EVERY DAY. THAT'S 60 CARS, 60 AND 60 OUT. YOUR QUICK SERVICE RESTAURANTS WOULD BE THINKING THE 800. IN TOTAL. PER DAY, AND YOUR GENERAL RETAIL WOULD BE 200 CARS PER DAY. SO A LOT LESS INTENSE. ANY QUESTIONS? QUESTIONS. THANK YOU VERY MUCH. THANK YOU. THIS IS A PUBLIC HEARING. I DO HAVE A CARD. I'LL READ FIRST. DO NOT FORGET TO DO SO MARK SMITH, WHICH IS TO REGISTER HIS SUPPORT FOR THIS ITEM. I DO NOT DO. KEVIN PATEL. GOOD EVENING, EVERYONE. KEVIN POTATOES 17 82, A BASEMENT THAT WOULD DRIVE WELL IN TEXAS 75013 RECORD FOR THIS PROJECT. I'M HERE TO ANSWER ANY QUESTION IF YOU HAVE ANY TECHNICAL QUESTION. I THINK WE'VE GOT THEM ANSWERED AND THANK YOU. THANK YOU. I DON'T SHOW ANYBODY ELSE. SIGNED UP TO SPEAK ON THE ITEMS. RIGHT, NOT ENTERTAIN A MOTION MOTION TO CLOSE THE PUBLIC HEARING. A SECOND. CASH FOR VOTES. DISCUSSION. SO GO AHEAD. DRIVE UP AND DOWN THE BOULEVARDS AND MCKINNEY AND I LOOK AT GREEN WISE THAT WE HAVE OUT THERE ON ELDORADO PARK WAY. AND HARDEN AND VIRGINIA RIDGE AND STONEBRIDGE. AND I REALIZED THE FORETHOUGHT THAT WENT INTO THOSE PROJECTS, YEARS AND YEARS AGO TO GIVE US A BEAUTIFUL LANDSCAPES THAT WE HAVE OUT THERE RIGHT NOW, AND THAT WAS THE WISDOM OF OUR PLANNING DEPARTMENT THAT DID THAT. AND SO BASED ON THEIR HISTORY OF PROVIDING BEAUTY TO MCKINNEY AND OUR ROADWAYS, I WOULD HAVE TO SIDE WITH STAFF ON THIS ONE AND DENY THAT THANK YOU. SO MY THOUGHT ON THIS IS BECAUSE WHEN YOU GO OUT AND YOU LOOK AT THE WHAT'S AVAILABLE. PUT ON THERE. UM IT'S A TINY LITTLE LOT. I MEAN, IT'S A VERY SMALL LOT AND HOW AND I ALWAYS YOU KNOW WHEN YOU TALK ABOUT STAFF AND THEIR WISDOM, I AM I USED TO LISTEN A LOT MORE THAN THAN I DO, BECAUSE I CAME ACROSS THE TIME WHEN A GUY WANTED TO TEAR DOWN THIS ONE. UM. CAR. CLEANING PLACES THAT'S STILL UP TODAY THAT CAR WASH MATERIAL AND THEY DIDN'T WANT IT BECAUSE THEY WOULDN'T WANT THEM TO PUT AN ENTRANCE AND THEY WANTED TO PUT A BANK THERE INSTEAD OF THIS. THIS NASTY OLD CAR WASH. AND SO THEY MOVED ON SOMEWHERE ELSE AND BUILT IT SOMEWHERE ELSE. AND WE STILL GOT THIS NASTY OLD CAR WASH. AND SO STAFF NOT ALWAYS.

RIGHT LET ME TELL YOU, UM, BECAUSE WE HAVE A NICE BUILDING THERE THAT WOULD. BE PAYING A LOT MORE IN TAXES THAN A NATIONAL CAR WASH. AND SO THAT'S THE WAY I SEE THE SAME THING. AS I SAY. THIS PICTURE IS THAT YOU HAVE NOBODY'S GOING TO BUILD ON THIS THING EXCEPT SOMETHING LIKE THIS. AND I THINK THE STRICKEN BUDGET IF YOU READ A LITTLE BIT ABOUT THEM, THEY'RE A GREAT NEIGHBOR. THEY'RE NOT SOMEBODY THAT'S GOING TO UM, DISRUPT THE NEIGHBORHOOD OR MAKE IT DOWNGRADED IN ANYWAY AND. AND THEY DID EXACTLY WHAT WHAT THIS COUNCIL GENERALLY ASKS. AND THAT IS TALK TO YOUR NEIGHBORS. GO YOU KNOW, GO, GO MAKE SURE EVERYBODY'S HAPPY WITH THE PROJECT BEFORE YOU. CODE TO GO TO THE COUNCIL, AND THAT'S EXACTLY WHAT THEY DID, UM, WHERE OTHER PEOPLE DON'T DO THAT. AND THEN YOU HAVE A GENERAL IDEA, SOMETIMES A FIGHT AND SOMETIMES WORDS ARE SAID AND BUT NOBODY IS HERE. TO SAY NO. DON'T DO THIS. THAT'S THAT'S MY THING. IS THAT SO? THEY LOOK LIKE THEY'VE DONE IT RIGHT? AND I THINK THAT THERE WOULD BE A GREAT ADDITION.

THERE. I'LL GO AHEAD AND CHAMPION. UM. I UNDERSTAND WHERE STAFF IS GOING WITH THIS

[00:30:01]

UNDERSTAND WHY THEY YOU KNOW THERE ARE RECOMMENDED DENIAL. BUT IF YOU LOOK AT THIS INTERSECTION, IT'S A STRANGE INTERSECTION. BECAUSE ALL THE ROADS DEAD END. YOU GET RIDGE ROAD. THE DEAD'S IN DEAD ENDS INTO STACY THE COLIN UM YOU GOT MCKINNEY RANGE PARKWAY THAT DID ENDS IN THE STACY SO YOU DON'T HAVE A NORMAL FLOW OF TRAFFIC. OKAY AND THEN YOU GOT TO EMPTY CORNERS RIGHT NOW. AND T AHAT'S WITH ALL THE APARTMENTS THAT HAVE COME IN, OKAY? AND ALL THE DENSITY IS ALREADY THERE IF THEY WERE GOING TO BE A STARBUCKS FOR KNOCKING DOWN NOTES OR WHATEVER, IT PROBABLY WOULD ALREADY BE THERE. OKAY? AND YOU LOOK AT WHAT'S HAPPENING ON 1 21 WITH CRAIG RANCH AND ALL THE COMMERCIAL AND ALL THE RESTAURANTS THAT ARE GOING TO BE THERE. THAT'S WHERE EVERYBODY'S GOING TO GO, AND THAT'S ALMOST WITHIN WALKING DISTANCE OF THESE APARTMENTS. SO IN MY OPINION, I THINK THAT'S A GREAT, YOU KNOW, I LIKE THE BUILDING. I LIKE THE WAY IT LOOKS THINK. YOU KNOW THAT'S REASONABLE THERE, AND I WAS NOT REALLY FOR THE MIND AND KEEP IT. THIS IS A LESS INTENSE YEARS, SO HAVING FAVORITE WITH. YOU KNOW, I WAS DRIVING UP AND DOWN ELDORADO OR RIDGE ROAD IN MY MIND WHILE YOU WERE SPEAKING . I DON'T THINK THERE ISTOMOBILL THE WAY FROM 3 80 DOWN THE STACY. THANK YOU'RE OPENING THE DOOR FOR IT. IF YOU DID THIS MY THOUGHTS. MEANS IT MAY PROBABLY THE NEIGHBORS WOULD LIKE TO HAVE SOMETHING THERE. A BIT CLOSER.

WHO KNOWS? THE COMMENTS. I'M JUST GONNA FOLLOW UP WITH CHARLIE WAS SAYING ON THE OPENING THE DOOR WE DO GET A LOT OF COMPLAINTS ARE A LOT OF, UM I WOULD SAY COMPLAINTS, BUT WE GET A LOT OF PUSHBACK FROM PRESIDENTS ABOUT ANOTHER NAIL SALON OR ANOTHER DOUGHNUT PLACE OR ANOTHER OIL CHANGE. WHERE DO YOU HEAR THAT? QUITE A BIT. IF YOU DRIVE THROUGH PLANO, AND YOU CAN'T HIT A CORNER WITHOUT HITTING IT, OIL CHANGE PLACE OR MEINEKE OR ANOTHER TYPE OF THOSE BUSINESSES AND I'M KIND OF WITH CHARLIE ON THIS. I WOULD LIKE TO SEE SOME SOMETHING JUST A LITTLE BIT BETTER. AND I'M BUT I'M LISTENING TO RICK AND YOU KNOW IF THERE COULD HAVE BEEN SOMETHING BUILT THERE, BUT I KNOW THAT AREA IS STILL DEVELOPING. SO I'M TORN BETWEEN BOTH OF THEM. BUT I DO LISTEN TO THE RESIDENTS WHEN THEY SAY WE'RE PUTTING ANOTHER OIL CHANGE PLACE OR DONUT SHOP FOR NOW, SO WE HEAR THAT QUITE OFTEN. SO ANYWAY. THIS MIGHT TWO CENTS I HAVE TO KIND OF AGREE WITH YOU ON THAT ONE. I ACTUALLY DO AGREE WITH STAFF ON THIS ONE, BECAUSE I UNDERSTAND THAT OVERALL VISION FOR THE WALK ABILITY OF THAT AREA IF YOU HAVE MULTI FAMILY THEY'RE IN. THIS JUST LOOKS LIKE A GREAT BUSINESS. I LOVE THE ELEVATIONS. IT LOOKS FANTASTIC.

I JUST DON'T THINK THAT THIS IS THE BEST LOCATION FOR THAT IF I LIVED THERE IF OUR RESIDENT THERE, I WOULDN'T RATHER SEE A LITTLE SMALL DONUT SHOP OR NAIL SALON OR SOMETHING ELSE LIKE THAT THAT I CAN UTILIZE MORE FREQUENTLY, BUT I JUST DON'T THINK THIS FITS EXACTLY FOR THAT CORNER. THERE IS A DOUGHNUT SHOP JUST NEXT DOOR. YOU GUYS SAY THAT AND IT'S LIKE, OH, THAT COULD BE 150 OR $1.5 MILLION BUILDING. ON THAT THING IS GOING TO SUPPORT A NAIL SALON, AND IT'S JUST NOT. I MEAN, IT'S JUST MAYBE NOT EXACTLY THAT, BUT I DON'T I DON'T THINK THAT THIS IS THE GREATEST FIT EITHER. SO I'D RATHER JUST WAIT FOR SOMETHING ELSE. THIS ONE. WHAT'S WHAT? YOU OPEN THE DOOR FOR THIS KIND OF OPEN ANOTHER STRING OF ANOTHER OF ANOTHER ANOTHER AND YOU'RE FABRICATING A BUILDING THAT ONLY SUPPORTS THIS TYPE OF BUSINESS. AND YOU HAVE TO THINK ABOUT IT THAT WAY, TOO. BECAUSE TO RE FAB THIS BUILDING, WHICH YOU WOULDN'T WITH BAYS AND PITS AND EVERYTHING ELSE, THAT'S ONLY GOING TO BE AN AUTOMOTIVE BUSINESS. GOING FURTHER.

EVERYONE ELSE IS GIVING THEIR OPINION ON. SPEAK UP. I THOROUGHLY RESPECT STAFF. YOU KNOW THAT. UM AND I AND I THINK THAT THEIR RECOMMENDATION WAS THE RIGHT ONE BASED ON THE INFORMATION THAT THEY HAVE AND WHAT THEY MAKE THE RECOMMENDATIONS BASED ON I DO THINK THERE ARE EXCEPTIONS AND I THINK STAFF RELIES ON COUNCIL APPEARED TO MAKE THOSE EXCEPTIONS WHEN THEY ARE WHEN THERE'S AN ARGUMENT TO BE MADE, AND I BELIEVE THAT THIS IS SOMETHING THAT I WOULD SUPPORT AS A DEVELOPER AND KNOWING THAT LAND AND LOOKING AT THAT PIECE, AND I WENT OUT THERE THIS WEEK. IT WOULD BE TREMENDOUSLY HARD TO SUPPORT ANYTHING ELSE AND THE FACT THAT THERE'S NOT ANOTHER OIL CHANGE PLACE ANYWHERE IN THE VICINITY. I LOVE THE IDEA OF A PLACE THAT YOU STAY IN YOUR CARDS QUITE A BIT DIFFERENT THAN THAN THE NORM. IT WOULD BE QUITE A CONVENIENCE IN MY MIND FOR, UM, ALL THE OTHER RESIDENTS THAT DO LIVE THERE. AND I'M NOT ONE

[00:35:03]

WHO BELIEVES THAT A NAIL SALON OR ANOTHER DOUGHNUT SHOP, ASSUMING THERE WASN'T ONE NEXT DOOR IS A BETTER AS A BETTER USE ON THE CORNER, SO I LIKE IT. I LIKE THE COMPANY. I LIKE WHAT THEY DO. I LIKE THE OUTREACH. THERE'S NOT ANOTHER, UM ANOTHER ONE IN PROXIMITY AND THIS LOT. I THINK RICK WAS VERY, VERY CORRECT WHEN HE SAID THAT THE DENSITY IS THERE IN THIS LOT WOULD HAVE DEVELOPED IF IT WASN'T FOR THE RESTRICTIONS THAT ARE THERE. I KNOW I'VE LOOKED AT THIS PROPERTY IN THE PAST, BUT MM. WHEN I SAY THAT, WITH ALL DUE RESPECT TO STAFF, AND I THINK STAFF'S RECOMMENDATION WAS EXACTLY WHAT IT SHOULD BE THERE, LOOKING AT THE COM PLAN AND WHATNOT, I JUST THINK THEY WOULD PUT THAT IN OUR HANDS. IF WE WANT TO MAKE A DIFFERENT DECISION, AND FOR ME, I DO. I RESPECT IT. I HAVEN'T SAID ANYTHING, BUT I AGREE WITH THE DIFFICULTY OF THE DEVELOPMENT OF SOCIETY. IT IS A VERY TOUGH SIDE AND IF SOMETHING IF THERE WOULD BE DEMAND FOR DIFFERENT USE. WE WOULD HAVE SEEN IT ALREADY. UM AND I THINK YOU KNOW THESE CORNERS ARE GOING TO BE TOUGH IF WE'RE NOT FLEXIBLE WITH WHAT WE HAVE THERE. SO MIRROR. I'LL MAKE A MOTION THAT WE APPROVE THIS ITEM. ALL CIRCUIT. YEAH, WE'RE VERY CLOSE TO POKER. YEAH.

PLEASE CAST YOUR VOTES. THIS. FOR MOTION PASSES. NEXT ITEM. 2100162 CONDUCTED PUBLIC UNION.

[Conduct a Public Hearing to Consider/Discuss/Act a Specific Use Permit Request to Allow for a Restaurant Including a Drive-Through Window, Located on the South Side of Virginia Parkway and Approximately 600 Feet East of Jordan Road, and Accompanying Ordinance]

CONSIDER AND ACT ON SPECIFIC USE PERMANENT QUEST TO ALLOW FOR A RESTAURANT, INCLUDING DRIVE THROUGH WINDOW LOCATED ON THE SOUTH SIDE OF VIRGINIA PARKWAY AND APPROXIMATELY 600 FT EAST OF JORDAN'S ROAD IN A COMPANY AND ORDINANCE. THANK YOU, MR MAYOR. AS YOU SAID, THIS SITE IS ALONG VIRGINIA PARKWAY, AND THE TRACT ITSELF IS ABOUT ONE ACRE IN SIZE THE UNDERLYING ZONING ON THE PROPERTY. IS C ONE, WHICH DOES REQUIRE CONSIDERATION OF AN SCP TO ALLOW FOR A RESTAURANT WITH DRIVE THROUGH ON THE SITE. AS YOU LOOK AT A QUICK LITTLE ARIEL. HERE YOU'LL NOTE THAT THE SURROUNDING PROPERTIES TO THIS SITE ARE ALL DEVELOPED AS COMMERCIAL AND TO THE SOUTH.

WHILE IT IS CURRENTLY UNDEVELOPED. THERE HAS BEEN AN APPROVED SITE PLAN TO ALLOW FOR ADDITIONAL COMMERCIAL DEVELOPMENT. SO WHEN WE LOOK AT THE SCP REQUESTS TO ALLOW FOR THE RESTAURANT WITH THE DRIVE THRU WE DO FIND THAT IT'S COMPATIBLE WITH THE AREA ACCESS AND DEVELOPMENT PROPOSAL. INCLUDED WITH THAT S U P IS CONSISTENT WITH CITIES DEVELOPMENT STANDARDS AS SUCH, WE'RE RECOMMENDING APPROVAL OF THE REQUEST. WE HAVE ALSO PRESENTED THIS TO THE PLANNING AND ZONING COMMISSION, AND THEY HAVE ALSO RECOMMENDED APPROVAL IN A VOTE OF SEVEN. OH, I'M HAPPY TO ANSWER ANY QUESTIONS THAT YOU MIGHT HAVE. QUESTIONS FOR JENNIFER. IS THE APC IN HERE. GOOD EVENING, MR MAHONE WITH CROSS ENGINEERING. THE REPRESENTATIVE FOR THE DEVELOPER OF THIS PROJECT AND HAPPILY ANSWERING QUESTIONS YOU'LL HAVE I HAVE QUESTIONS. YES. WHAT'S GOING HERE? UM WE'RE PROPOSING A DUNKIN DONUTS. IT'S NOT ONLY A DUCT AND DONUTS, THOUGHOU THERE ARE RETAILING, PERFECT TIMING. PERFECT SITTING BACK THERE AND LIKE, OH, THIS IS REALLY GOING TO GO. WELL YES, ONLY A COP WOULD ASK THAT QUESTION. THANK YOU. YEAH, ALRIGHT. ANYONE ELSE HAVE QUESTIONS FOR THE AFGHAN? IF NOT, YOU'RE GONNA SELL THROUGH. I DON'T THINK YOU'RE GOING TO HAVE ANY PROBLEM WITH THANK YOU, SIR. THIS IS A PUBLIC HEARING. I DO NOT SHOW ANYBODY SIGNED UP TO SPEAK. BUT IF YOU'VE COME MADE THE TRIP, PLEASE MAKE YOURSELF KNOWN. SEEING NONE ENTERTAIN A MOTION. I'LL MAKE A MOTION THAT WE CLOSE THE PUBLIC HEARING AND IMPROVE THIS ITEM SECOND. PLEASE CAST YOUR VOTES. SHOULD PASSES. 21

[Conduct a Public Hearing to Consider/Discuss/Act on a Request to Rezone the Subject Property from “AG” - Agricultural District to "C1" - Neighborhood Commercial District, Located on the Northwest Corner of Kickapoo Drive and Alma Road, and Accompany Ordinance]

0063 Z TO CONDUCT A PUBLIC HEARING TO CONSIDER AND ACT ON REQUEST, AGREES ON THE SUBJECT PROPERTY FROM AGRICULTURAL DISTRICT TO SEE ONE NEIGHBORHOOD COMMERCIAL DISTRICT, LOCATED ON THE NORTHWEST CORNER OF KICKAPOO DRIVE. AND ON THE ROAD. THANK YOU. THIS REQUEST IS TO RAISE ON THE SUBJECT PROPERTY FROM A G AGRICULTURAL ZONING DISTRICT TO SEE ONE COMMERCIAL ZONING DISTRICT. IT IS ON BEHALF OF FRISCO ISD, AND IT'S IN ASSOCIATION WITH THE PROPOSED DEVELOPMENT FOR A SCHOOL FOR FRISCO ICED TEA. I BELIEVE IT'S AN INTERMEDIATE SCHOOL FOR THEM.

[00:40:03]

THE ZONING ON THE PROPERTY CURRENTLY DOES NOT ALLOW FOR INSTITUTIONAL OR SCHOOL BUILDING WITHOUT THE USE OF AN SCP. THEREFORE, THEY HAVE REQUESTED TO JUST REASON THE PROPERTY TO ALLOW FOR THE DEVELOPMENT. STAFF HAS EVALUATED THE REQUEST AS AN INSTITUTIONAL USE IN A PUBLIC SERVICE USE. WE CERTAINLY HAVE NO OPPOSITION TO ITS PROPOSED LOCATION. HERE WE DO FIND THAT IT'S IN CONFORMANCE WITH THE COMPREHENSIVE PLAN AND WE'RE RECOMMENDING APPROVAL. PLANNING AND ZONING COMMISSION ALSO CONSIDERED THE REQUEST IN THEIR DECEMBER MEETING, AND THEY'RE RECOMMENDING APPROVAL IN A VOTE OF SIX. OH I WILL NOTE THAT COMMISSION MEMBER MAN'S I STEPPED DOWN FROM THAT PARTICULAR ITEM, BUT THE UNANIMOUS VOTE WAS STICKS OUT FROM PAINTING. THANK YOU, JENNIFER. QUESTION THERE WAS A LETTER OF OPPOSITION CORRECT FROM THE NEIGHBORING COMMUNITY. AND IN THAT LETTER, IT STATES THAT THE MANAGEMENT COMPANY FOR THAT NEIGHBORHOOD REACHED OUT TO FIRST GUIDE DID EXPRESS SOME OF THEIR CONCERNS. THEY HAD NOT HEARD BACK. HAVE YOU HEARD ANYTHING ELSE? SO I DO KNOW THAT WAS DISCUSSED AT PLANNING AND ZONING COMMISSION AS WELL ON COMMISSION MEMBER CERTAINLY ENCOURAGED REPRESENTATIVES FROM FRISCO SD TO REACH OUT. I'LL LET THEM SPEAK TO ANY CONVERSATIONS THAT THEY MAY HAVE HAD SINCE THAT TIME. THANK YOU. APPLICANT. STATE YOUR NAME AND JUST FOR THE RECORD. YES. ANDRE BRACKEN'S 10570 ROSE GARDEN COURT. MCKINNEY, TEXAS 75072, AND I'M, THE DIRECTOR OF THE DALLAS OFFICE OF HUCKABEE ARCHITECTS, THE ARCHITECT FOR THE APPLICANT. AND I DO WANT TO CONFIRM THAT IMMEDIATELY FOLLOWING PLANNING ZONING, I DID ENGAGE MR RASTOGI STAGGIE ABOUT A MEETING. AND FOLLOWING THE CHRISTMAS BREAK FOR THE DISTRICT. THE DISTRICT HAS I HAVE CONFIRMED THE DISTRICT HAS ENGAGED MR STAGGIE AND REPRESENTATIVES OF THE NEIGHBORHOOD AND A MEETING IS BEING PLANNED. TO DO THE PRESENTATION AND DISCUSS. SO BUT SOME OF THEIR CONCERNS WAS THE WITH THE HEIGHT OF THE BUILDING AND THINGS LIKE THIS, CORRECT? YES, OKAY. WHAT'S THE WITH THE HEIGHT OF THE BUILDING WHERE WE'RE GOING WITH THAT? WELL THIS IS BASICALLY THE EDUCATIONAL WING OF THE BUILDING IS THREE STORIES AND THAT WAS THE PORTION THAT WAS THE CONCERN. BUT FROM A DESIGN STANDPOINT, WE DID TAKE THAT UNDER CONSIDERATION. UM THAT THREE STORY PORTIONS APPROXIMATELY 52 FT, BUT IT DOES FACE THE WOODED AREA. THE TRAIL AREA AND THOSE TREETOPS ARE APPROXIMATELY 60 FT. AND THERE'S A GREAT DEAL OF SETBACK BETWEEN THAT PORTION AND THE NEIGHBORS ADJACENT. MY QUESTION IS WHY IS THIS BEFORE US BEFORE YOU MEET WITH THE COMMUNITY? WELL WE DID HAVE SOME PRESENTATIONS AND DID AGAIN. WE DIDN'T WE DIDN'T KNOW THAT THERE WAS ANY SPECIFIC OPPOSITION. BUT AS SOON AS WE HEARD THAT THEY WANTED TO REACH OUT AND MEET, WE ARE OBVIOUSLY REACHED OUT AND ENGAGED IN AND CERTAINLY WANT TO DO THE PRESENTATION. IS IT JUST ONE PERSON OR IS IT A WHOLE COMMUNITY? WELL THERE WAS MR STAGGIE WAS THE ONE PERSON WHO WAS THE REPRESENTATIVE. BUT IT'S A IT IS COMMUNITY. SO WHAT? WE'VE AGREED TO DO WHAT THE DISTRICT'S AGREED TO DO IS MEET WITH THE HOMEOWNER ASSOCIATION REPRESENTATIVES. WE DID MEET WITH MR CRAIG OF CRAIG'S RANCH HE REVIEWED AND WAS REALLY EXCITED ABOUT THE MATERIALS CHOSEN. EXCUSE ME, AND REALLY THE ASPECT OF HOW IT WOULD REALLY BE AN ASSET TO THE COMMUNITY. SO I HAVE A QUESTION FROM OUR ATTORNEY. UM SO WHEN I ASKED DICK COMES BEFORE CITY COUNCIL TO SAY, HEY, WE'D LIKE TO PUT A BUILDING HERE. WHAT RIGHT DOES THE CITY HAVE TO SAY? NO, YOU CANNOT PUT A BUILDING HERE. BECAUSE I THOUGHT THE. SOE PROPERTY NOW? YES, YES. YES, FOR MORE THAN A DECADE OR SO, ACTUALLY PRIOR TO MANY OF THE HOMES AND DEVELOPMENTS THERE.

THAT'S WHAT YOU KNOW. I MEAN, IF THEY BUY HOMES KNOWING THAT THE SCHOOL IS GOING TO BE BUILT THERE, YES. I MEAN, IT'S HARD TO SAY WILL YOU? IT'S HARD TO GRIPE ABOUT THE SCHOOL BEING BUILT THERE, RIGHT? I DON'T THINK THAT WAS THE GROUP. I THINK THE CONCERN WAS THAT IT WAS MAYBE SUPPOSED TO BE AN ELEMENTARY SCHOOL TWO LEVELS, NOTHING WITH THE THIRD LEVEL. SO THAT'S THE CHANGE THAT. I THINK THAT WAS A CONCERN. CORRECT ME IF I'M WRONG TO THE COMMUNITY, YOU'RE I THINK YOU'RE ABSOLUTELY CORRECT. I WANTED TO NOTE SOMETHING FOR THE RECORD. SO WITH THE REZONING REQUEST TO SEE ONE SEE. ONE HAS A MAXIMUM BUILDING HEIGHT OF 35 FT. WHICH YOU HEARD HIM SPEAK ABOUT 53 FT. FOR THE TWO FT. I WILL NOTE IN THE CITY'S ZONING ORDINANCE. TODAY THERE IS A

[00:45:08]

DEFINITION OF BUILDING HEIGHT, AND THERE'S ALSO WHAT WE CALL SPECIAL EXCEPTIONS TO CALCULATIONS OF BUILDING HEIGHTS. SO BY RIGHT ANY BUILDING OR I'LL BE BACK UP BACK UP A LITTLE BIT. THERE IS AN ALLOWANCE IN OUR EXISTING CODE TO ALLOW FOR CERTAIN FEATURES AND CERTAIN TYPES OF BUILDINGS, INCLUDING THE SCHOOL BUILDING TO GO HIGHER THAN THAT BUILDING.

HIDE THAT YOU SEE IN THE ZONING ORDINANCE OF 35 FT. PROVIDED THAT AN ADDITIONAL FOOT OF SETBACK IS PROVIDED FOR EACH ADDITIONAL FOOT IN HEIGHT, SO IF THE MAXIMUM BUILDING HEIGHT FOR THAT C ONE IS 35 FT, AND HE WANTED TO GO TO 50 52 FT, HE'D HAVE TO INCREASE HIS SETBACKS FOR EVERY FOOT AND INCREASE IN HEIGHT THAT HE'S PROPOSING. AND SO I BELIEVE SOME OF THE CONCERNS THAT THEY'VE HEARD FROM THE RESIDENTS HAVE LESS TO DO WITH THE USE. AND AGAIN, AS YOU SAID, MORE TO DO WITH THAT BUILDING HEIGHT, BUT AGAIN, THAT'S THAT'S AN ALLOWANCE THAT'S BUILT INTO OUR CODE RIGHT NOW, UM, FOR CERTAIN TYPES OF ARCHITECTURAL FEATURES, AS WELL AS A SPECIFICALLY FOR SCHOOL BUILDINGS. SO AND THEY'RE MEETING THAT, ARE THEY NOT? I'M SORRY, AND THEY'RE MEETING THAT THEY WOULD MEET THAT. YEAH AND THEN THE OTHER THING I WOULD SAY, JUST TO BE FAIR WHEN AS MAYOR PRO, TEM SAID. IT'S BEEN ZONED FOR SCHOOL. UM NOBODY WAS ON BICYCLE. SORRY WELL HONED BY SCHOOL, SO ANTICIPATED SCHOOL BE BUILT. NO ONE WAS IF THEY IF THEY KNEW THAT THEY KNOW THAT THE IF THEY TOOK TIME TO FIND OUT THERE'S ONLY THEY WOULD KNOW THESE EXCEPTIONS EXIST IN THE ABILITY FOR THEM TO BUILD. THIS PARTICULAR SECTION WOULD BE 35 FT. SO I THINK HIS COMMUNIST CORRECT THAT IT'S BEEN OWNED BY THE SCHOOL ANTICIPATED TO BE A SCHOOL AND HAS THE ABILITY TO HAVE THAT HEIGHT FEATURE IN THE WAY THAT THEY'RE DOING IT THAT'S CORRECT. AND I KNOW THAT THEY DID REACH OUT TO THE COMMUNITY AND SPEAK TO THE COMMUNITY. AND IT WAS JUST A THE LAST THOUGHT, BUT OR IN THE FOURTH QUARTER. THEY BROUGHT IN THE SPECIFIC HEIGHT THING, AND SO IS TRYING TO WORK THAT IN AS FAST AS THEY CAN, BUT SPEND THE HOLIDAYS. I UNDERSTAND THAT, BUT AND FOR ME, IT'S BEEN ZONE THAT THIS OWNING COMES WITH THAT ABILITY, AND IT'S I DON'T HAVE AN ISSUE WITH THAT. AND IF I MAKE IT ELABORATE , YOU KNOW, WITH THE THREE STORY HEIGHT AGAIN, IT IS ADJACENT. IT'S IN THE BACK AGAINST THE TREES, TREES AND THEN THE PORTION OF THE BUILDING THAT IS FACING DIRECTLY ACROSS THE STREET. FROM KICKAPOO. THAT PORTION IS REGULAR SCHOOL. HIDE, IT SAY SO. THE ENTIRE SCHOOL IS NOT THREE STORIES. IT'S JUST THE EDUCATIONAL WING, WHICH IS APPROXIMATELY 35% OF THE BUILDING. FOOTPRINT SO THE REST YOU KNOW, FACING THE HOMES ACROSS THE STREET. THAT IS TWO STORY THAT IS JUST, YOU KNOW, NORMAL STANDPOINT. YES, SIR. THE OTHER QUESTIONS WE HAVE. THIS IS A PUBLIC HEARING ANYONE THAT LIKE TO SPEAK TO THIS ITEM? SEEING NONE ENTERTAIN A MOTION COMMOTION CLOSE THE PUBLIC PERIOD. A SECOND. CASTRO VOTES. DISCUSSION. WHAT HAS FURTHER DISCUSSION ON THE ITEM. IN MY OPINION, THERE'S NOT REALLY AN ISSUE. BECAUSE HE'S MET THE SETBACK REQUIREMENTS AS FAR AS THE HIGH AND I DON'T THINK ANYBODY'S UPSET ABOUT THE USE OF SCHOOL THERE. SO I'M OKAY WITH IT. I'LL MAKE A MOTION TO APPROVE THIS ITEM, THEN. I'LL SECOND IS CAST REMOTES. MOTION PASSES WELL, THEN 210121 Z TWO. THANKS, SIR. THANK YOU. YOU MEAN TO RUSSIA FROM THERE? SORRY.

[Conduct a Public Hearing to Consider/Discuss/Act on a Request to Rezone the Subject Property from “PD” - Planned Development District to "C2" - Local Commercial District, Located Approximately 250 Feet East of Coit Road and Approximately 250 Feet North of Virginia Parkway, and Accompanying Ordinance]

210121 Z TO CONDUCT PUBLIC HEARING TO CONSIDER AND ACT ON REQUEST TO RESCIND SUBJECT PROPERTY FROM PD PLAN DEVELOPMENT DISTRICT TO SEE TO LOCAL COMMERCIAL DISTRICT LOCATED APPROXIMATELY 250 FT. EAST OF RODENT PRICE WITH 250 FT NORTH OF VIRGINIA PARKWAY.

COMPANY AN ORDINANCE. THANK YOU, MR MAYOR. UM SO THIS ITEM AND THE ONE FOLLOWING IT ARE SORT OF A BUNDLED ITEMS. SO THAT WHAT YOU HAVE BEFORE YOU RIGHT NOW IS THE REZONING REQUEST. AND PENDING THE OUTCOME OF THAT REZONING REQUEST IF IT IS APPROVED, THE AFRICAN IS ALSO REQUESTING A SPECIFIC USE PERMIT TO ALLOW FROM ANYWHERE HOUSES SO I'LL START FIRST WITH THE REZONING REQUEST. AS YOU READ IT IS TO RAISE ON THE SUBJECT PROPERTY FROM A PLAN DEVELOPMENT

[00:50:02]

DISTRICT TO SEE TO THE TRAFFIC SELF IS ABOUT 2.7 ACRES IN SIZE. IN THE AFRICAN IS REQUESTING THAT C TWO ZONING TO ALLOW FOR MORE MODERN COMMERCIAL ARE MORE MODERN ZONING DISTRICT TO ALLOW FOR COMMERCIAL USES. YOU'LL NOTE IN THE NEXT ITEM THAT THE SPECIFIC COMMERCIAL USE THEY'RE PROPOSING IS A MINI WAREHOUSE, BUT THEIR ZONING BEFORE YOU RIGHT NOW IS JUST TO ALLOW FOR THAT. C TWO ZONING, WHICH IS A WIDE RANGE OF COMMERCIAL AND NON RESIDENTIAL USES. STAFF HAS EVALUATED THE REASONING REQUEST AND WE FEEL IT ALIGNS WITH THE CITY'S COMPREHENSIVE PLAN AND WE ARE RECOMMENDING APPROVAL. PLANNING AND ZONING ALSO CONSIDERED THE ITEM AND RECOMMENDED APPROVAL. IN A VOTE OF 70. I'M HAPPY TO ANSWER ANY QUESTIONS. QUESTIONS FOR JENNIFER. THE APC IN HERE. OH, YOU. ROEDER 1700 RED BUG SUITE 300 MCKINNEY. MR MAYOR, PROTEIN.

ON BEHALF OF THE APPLICANT, AS HAS BEEN SAID. ARNOLD SAID. THIS IS JUST STRAIGHT ZONING CASE. AT THIS POINT, WE'LL PROBABLY HAVE MORE DISCUSSION ON THE NEXT ITEM . BUT THIS THIS C TWO IS IN KEEPING WITH ALL OF THE OTHER COMMERCIAL IN FRONT. REQUEST YOUR FAVORABLE APPROVAL AND I'LL BE HAPPY TO ANSWERING THE QUESTIONS. QUESTIONS FOR BOB. THIS IS A PUBLIC HEARING. IF I HAD SOMEBODY QUEUED UP, SEE, NO IS ANYONE HERE LIKE TO SPEAK TO THE ITEMS? SEEING NONE. MOTION.

I'LL MAKE A MOTION. WE CLOSE THE PUBLIC HEARING AND IMPROVED ASYLUM. SEX STAFF RECOMMENDATION. MM HMM. MOTION PASSES ITEM NUMBER 2100112 CONDUCT A PUBLIC HEARING TO

[Conduct a Public Hearing to Consider/Discuss/Act on a Specific Use Permit Request to Allow for a Mini-Warehouse Facility (Advantage Storage), Located Approximately 250 Feet East of Coit Road and on Approximately 250 Feet North of Virginia Parkway, and Accompanying Ordinance]

CONSIDER DISCUSS ACT ON A SPECIFIC USE PERMIT REQUEST TO ALLOW FOR MANY WAREHOUSE FACILITY ADVANTAGE STORAGE LOCATED APPROXIMATELY 150 FT. EAST ROAD. AND 250 FT. NORTH OF VIRGINIA PARKWAY AND ACCOMPANYING ORDINANCE WONDERFUL . SO WITH THE APPROVAL OF THAT C TWO ZONING FOR THIS SAME TRACKED , THE APPLICANT IS NOW ALSO REQUESTING FOR THE APPROVAL OF A SPECIFIC USE PERMIT TO ALLOW FOR THOSE MANY WAREHOUSES. AGAIN IT'S A 2.7 ACRE TRACT AND THAT NEW C TWO ZONING ON THE PROPERTY DOES REQUIRE CONSIDERATION OF A SPECIFIC USE PERMIT FOR THE TRACT. LET'S SEE. SO AS YOU SAW IN THE PREVIOUS ITEM, IT IS THERE AT THE HARD CORNER OR NOT THE HARD CORNER BUT THERE AT THE CORNER OF VIRGINIA AND KUWAIT, AND WE DO NOTE AS A STAFF THAT IT IS A MAJOR INTERSECTION. BUT WHEN WE LOOK AT THE REQUEST FOR MANY WAREHOUSES, WE NOTE THAT IT IS TUCKED ON THE BACKSIDE OF THAT COMMERCIAL CENTER ABOUT 250 FT. OFF OF THAT COMMERCIAL FRONTAGE. AND STILL ALLOWS FOR DEVELOPMENT OF POTENTIAL COMMERCIAL SITES THERE ALONG THOSE KEY FRONTAGE IS AT THE INTERSECTION. THE APPLICANTS PROPOSED REQUEST DOES ALIGN WITH THE CITY'S DEVELOPMENT STANDARDS , AND WE DO FEEL AS THOUGH IT'S IN A GOOD LOCATION, AND IT'S COMPATIBLE WITH THE AREA AROUND IT AS SUCH FOR RECOMMENDING APPROVAL OF THE S U P AND THE PLANNING AND ZONING COMMISSION IS ALSO CONSIDERED THE ITEM AND HIS RECOMMENDING APPROVAL IN A SEVEN OVER. I'M HAPPY TO ANSWER ANY QUESTIONS, AND I KNOW MR ROEDER IS HERE FOR THAT AS WELL.

QUESTIONS FOR JENNIFER. THANK YOU, JENNIFER. COULD SHOOT EMAIL THOSE TO CAITLIN HAD DEER.

PAEANS A. I DON'T SEE THEM IN HERE. I CAN. I CAN WORK OFF OF THIS. MR MAYOR, BOB ROEDER, 1700 RED BUD SUITE 300 MCKINNEY ON BEHALF OF THE APP BECAUSE UM THIS IS ADVANTAGE. SELF STORAGES OF IS A BUILDER OPERATOR. SELF STORAGE WAREHOUSES THROUGHOUT THIS STATE, ACTUALLY THROUGHOUT THE SOUTHWEST, HAVE CONSTRUCTED A NUMBER OF FACILITIES IN MCKINNEY. THEY THEY'RE VERY, VERY GOOD OPERATOR, AND THEY DO THINGS IN WITH THE NEIGHBORHOOD IN MIND, SO I JUST WANT TO POINT OUT A COUPLE OF THINGS TO YOU IN THIS PLAN, AND IN THE IN IN THE THAT WERE MADE UP CONDITION OF THE ISSUE. P THAT FIGURE OUT HOW TO WORK THIS BUTTON HERE. HERE WE GO. AH, THE WESTWOOD COMMUNITY IS SITUATED RIGHT OVER HERE. THERE'S A ROAD RIGHT HERE THAT SEPARATES THE RESIDENTIAL LOTS. AND THERE'S AN ALLEYWAY HERE THAT SEPARATES THE RESIDENTIAL LOTS. COUPLE THINGS THAT YOU'LL NOTICE FROM THE SITE PLAN. THERE ARE NO ENTRY POINTS , EITHER PEDESTRIAN OR VEHICULAR OFF OF THIS OFF OF THE EAST SIDE OF THIS FROM THE RESIDENTIAL INTO INTO THIS FACILITY.

SECONDLY, THE. THE BUILDING HERE IN THE BUILDING. HERE ARE BOTH SINGLE STORY BUILDINGS. THIS IS

[00:55:05]

A TWO STORY BUILDING. SO IN KEEPING WITH THE CHARACTER OF THE NEIGHBORHOOD MY CLIENT HAS CREATED I SINGLE STORY HERE A SINGLE STORY THERE AND ADJACENT . THIS IS A PITCHED ROOF AND THE EASTERN PART OF THIS BUILDING IS A PITCHED ROOF. ALSO IN KEEPING WITH THE RESIDENTIAL CHARACTER OF THE NEIGHBORHOOD. WE'VE GOT A SIX FT MASONRY WALL. UH, THAT HAS NO OPENINGS IN IT. I THINK THE PICTURES I SAW EVEN INDICATE THAT THERE ARE PILOT ASTERS ALONG THE OUTSIDE OF THE WALL, GIVING A LITTLE BIT MORE CHARACTER. AND OF COURSE, IT'S HEAVILY LANDSCAPED. UM MY CLIENT HAS WALKED THE NEIGHBORHOOD WITH THEIR ELEVATIONS AND WITH THIS SITE PLAN VISITED WITH THE NEIGHBORS THAT WE'RE HOME AND WE'RE WILLING TO SPEAK. AND WE HAD NOBODY SHOW UP AT THE PLANNING COMMISSION WITH ANY CONCERNS ABOUT IT. THIS IS A GREAT NEWS FOR THIS. I'M GOING TO CALL IT A BACKLOG LOCATION, AS YOU ALL KNOW, BECAUSE YOU'VE HEARD THIS MANY TIMES SITTING ON THE DIOCESE. VERY LOW TRAFFIC WITH MANY WAREHOUSE STORAGE. NO NOISE. NO, NOTHING. WE HAVE NO LIGHTS ORIENTED TO THE EAST. SO I THINK THIS IS A ABOUT AS GOOD A COMMERCIAL NEIGHBOR AS YOU CAN GET ADJACENT TO THE RESIDENTIAL NEIGHBORHOOD. LET ME STOP. THERE MAY HAVE TO ANSWER ANY QUESTIONS. I REQUEST YOUR APPROVAL. ANY QUESTIONS FOR ABOUT NICE JOB ON THE SITE PLAN.

THIS IS A PUBLIC HEARING. IS THERE ANYONE THAT WOULD LIKE TO SPEAK TO THIS ITEM? SEEING NONE ENTERTAIN A MOTION. MOTION. WE CLOSED PUBLIC HEARING AND APPROVED THE ATOM AS PRESENTED A SECOND. CAST YOUR VOTES. EXCITED. 2101 60 TO CONDUCT A PUBLIC HEARING TO CONSIDER AND

AT 3755 SOUTH LAKE FORCE DRIVING ACCOMPANYING ORDINANCE, JENNIFER YOU ARE WORKING HARD TODAY, HE TOLD HER CARD EVERY DAY. YEAH DEFINITELY GETTING MY STEPS IN FROM THE CHAIR TO THIS PODIUM, SO UM, THIS IS A PRETTY STRAIGHTFORWARD REQUEST, THE APPLICANT IS REQUESTING TO REZONE THE SUBJECT. PROPERTY FROM PD PLAN DEVELOPMENT DISTRICT TO SEE ONE NEIGHBORHOOD COMMERCIAL DISTRICT, ALTHOUGH THE EXISTING PD ON THE PROPERTY DOES ALLOW FOR COMMERCIAL DEVELOPMENT, THE APPLICANT IS REQUESTING TO RESIGN THE MORE MODERN ZONING DISTRICT IN PARTICULAR, THEY HAVE LET US KNOW THAT THEIR PRIMARY DESIRE FOR THE SITE IS TO ALLOW FOR DEVELOPMENT OF THINGS LIKE A FITNESS CENTER, A DANCE STUDIO. AN ANIMAL BOARDING. I DO WANT TO NOTE THAT ANIMAL BOARDING WOULD NOT ALLOW OUTDOOR RUNS WOULD ALL BE INTERNAL TO THE BUILDING. GIVEN THE LOCATION OF THE TRACTOR, AND THE PROPOSED COMMERCIAL ZONING DISTRICT STAFF HAS EVALUATED IT AGAINST COMPREHENSIVE PLAN AND FEEL THAT IT'S APPROPRIATE WITH THE AREA AND COMPATIBLE WITH THE COMPREHENSIVE PLAN. PLANNING AND ZONING COMMISSION ALSO CONSIDERED THE ITEM THEIR DECEMBER MEETING AND AS RECOMMENDING APPROVAL, UM AND A VOTE OF 70. I'M HAPPY TO ANSWER ANY QUESTIONS THAT YOU MIGHT HAVE, AND I BELIEVE OUR APPLICANT IS HERE AS WELL.

QUESTIONS FOR JENNIFER. THANK YOU, JENNIFER, WITH THE APPLICANT LIKE TO COME UP. MY NAME IS KELLY GOMEZ AND WITH KORG CIVIL ENGINEERS. WE'RE LOCATED AT 21 50 SOUTH CENTRAL EXPRESSWAY SUITE 200. THAT'S 707 TO MCKINNEY. UM, CERTAIN EXISTING BUILDING ON THIS SITE.

YOU KNOW THE EXISTING ZONING, NEIGHBORHOOD CONVENIENCE. THIS BUILDING WAS BUILT A COUPLE OF YEARS AGO IF I RECALL AND IT'S NOT FULLY LEASED OUT. AND THE OWNER IS WANTING TO CHANGE THE ZONING TO SEE 12. ALLOW FOR DIFFERENT TYPES OF TENANTS. SO MM MM. YOU HAVE ANY QUESTIONS? I'D BE HAPPY TO TRY TO ANSWER. HEARING TO CONSIDER AN ACT ON QUEST TO REZONE SUBJECT PROPERTY FROM PD PLAN DEVELOPMENT DISTRICT AND CC QUARTER COMMERCIAL OVER THE DISTRICT. TO SEE THREE REGIONAL COMMERCIAL DISTRICT AND CC CORRIDOR COMMERCIAL OVER THE DISTRICT. LOCATED ON THE NORTHEAST CORNER , STATE HIGHWAY, 1, 21 AND TINA DRIVE AND ACCOMPANIED ORDINANCE. THANK YOU, MR MAYOR. MHM. OKAY SO THE REQUEST BEFORE YOU IS FOR A 22 ACRE PIECE OF PROPERTY THERE ON THE NORTH SIDE OF STATE HIGHWAY, 1, 21 AND EAST TINA DRIVE THIS. THE WESTERN PORTION OF THIS PROPERTY WAS ACTUALLY BEFORE THE COUNCIL. I GUESS LATE 2021 FOR A SIMILAR REZONING REQUEST TO SEE THREE REGIONAL COMMERCIAL ZONING. GIVEN THE SITES POSITION ALONG STATE HIGHWAY 1 21 AND THE REGIONAL COMMERCIAL VISION OF THIS CORRIDOR. WE DO FEEL THAT THE C THREE REZONING REQUEST IS APPROPRIATE AND COMPATIBLE WITH A COMPREHENSIVE PLAN. UM AND WE ARE RECOMMENDING APPROVAL OF THE REZONING REQUEST. I WILL NOTE THE EXISTING ZONING ON THE PROPERTY IS PLANNED CENTER, WHICH IS ONE OF OUR LEGACY ZONING DISTRICTS, BUT IT WAS THE MOST INTENSE COMMERCIAL ZONING DISTRICT THAT WE HAD BACK WHEN THAT WAS A PREVALENT DISTRICT. SO REALLY, THE APPLICANT IS HERE TO MODERNIZE THE ZONING TO THE MORE MODERN C THREE. ZONING FOR COMMERCIAL REGIONAL USES PLANNING AND ZONING COMMISSION, CONSIDERED THE ITEM AT THEIR DECEMBER MEETING IS ALSO RECOMMENDING APPROVAL AND A SEVEN OH VOTE. I'M HAPPY TO ANSWER ANY QUESTIONS. AND I BELIEVE MR ROEDER IS THE APPLICANT ON THIS ONE AS WELL. ANY QUESTIONS FOR JENNIFER? SO THE PD THAT'S ADJACENT TO THIS IS THAT PLAN CENTER, TOO, IS A BASIS ONLY. I THINK IT IS. IT'S COMMERCIAL. IT'S A MIX OF COMMERCIAL. YES THAT'S CORRECT. THE END UP THERE ARE SOME INDUSTRIAL USES ALLOWED, BUT THAT'S ON THE NORTHERN PORTION OF THE PROPERTY, OKAY. THANK YOU, JENNIFER. BARBARA. YOU THE APPLICANT? YES. BOB BRODER. 1700 RED BED SUITE 300 MCKINNEY. UM I CAN'T REALLY ADD ANYTHING TO WHAT JENNIFER SAID. YOU'VE HEARD MY SPEECH ABOUT THE SEAPLANE CENTER OF THE OLD LEGACY, I GUESS. LEGACY ZONING THAT REQUIRES YOU BASICALLY THE MASTER PLAN THE ENTIRE TRACK BEFORE YOU CAN BUILD ANYTHING ON IT. THAT'S NOT THE WAY THIS IS GOING TO DEVELOP. SO WE WANTED TO GO WITH THE C THREE. WE HAVE THE ANSWER ANY QUESTIONS? ANY QUESTIONS FOR ABOUT THANKS, SIR . THIS IS A PUBLIC HEARING. IS THERE ANYONE THAT WOULD LIKE TO SPEAK TO THIS ITEM? HAVE YOU COME UP AND STATE YOUR NAME AND ADDRESS YOU HAVE THREE MINUTES TO IT COULD PUBLIC COMMENT. GOOD EVENING. MY NAME IS DOUG URBAN. ADDRESS IS 46 13 WIMBLEY COURT.

UM MY WIFE AND I. THE LARGEST. PIECE OF PROPERTY THAT FACING THE LOT IN QUESTION. THERE'S JUST A FEW PIECES OF PROPERTY THAT ARE ON THE NORTH SIDE OF. COLLIN MCKINNEY, I THINK IS THE ROAD BEHIND US. BUT MM. WE HAVE 50% OF THE LINEAR FOOTAGE THAT FACES THIS PROPERTY WHEN WE MOVED IN. 18 YEARS AGO. WE DID OUR DUE DILIGENCE, LIKE MR ROGERS SAID. WE LOOKED AT WHAT WAS BEHIND US AND BACK THEN IT WAS OWNED PD. I BELIEVE THE WAY THERE ARE DETAILS. AGENTS IN BOUGHT A PIECE OF PROPERTY THAT WE FELT. BEHIND US, WE'D BE SAFE WHATEVER IS GOING TO BE BEHIND US. MY WIFE AND I, ALONG WITH THE NEIGHBORS ARE OPPOSED TO CHANGING THIS TO SEE THREE OUT OF ALL THE ZONING THAT COULD BE DONE. THIS IS LIKE THIRD TO THE WORST THING THAT COULD POSSIBLY BE END UP BEHIND US. OUR PROPERTY ACTUALLY IS ELEVATED. AND SO WHEN YOU STAND IN OUR BACKYARD AT THE BACK OF OUR HOUSE SINCE ELEVATED, SO YOU SEE THIS PIECE OF PROPERTY AND OUR PROPERTY, OUR HOUSES 151 170 FT AWAY FROM THIS LOT, SO WE HAVE GRAVE CONCERNS ABOUT CHANGING IT TO C THREE AND WHAT CAN END UP BEHIND US? SO JUST WANTED TO SPEAK MY MIND? A AND LET YOU KNOW THAT WE'RE OPPOSED TO ALONG WITH OTHER PEOPLE THAT ARE FACING THIS PROPERTY. THANK YOU.

THANK YOU, SIR. JENNIFER, COULD YOU SPEAK TO A COUPLE OF THINGS? TWO. BACK 18 YEARS AGO, ALTHOUGH

[01:05:09]

TIME THINGS DO CHANGE, BUT 18 YEARS AGO SCHOOL I WISH NO, IT'S GOTTA BE RIGHT. MAYBE CLOSE, BUT NOT NOT RIGHT ON THE COLLEGE SO 18 YEARS AGO WHEN YOU WERE GALLIVANTING AROUND, MCKINNEY, UM THIS ZONING THAT WASN'T WELL. WOULD THAT HAVE BEEN EVEN THAT PD BACK THEN WITHOUT HAVE BEEN AGRICULTURAL BACK THEN, SO THE EXISTING ZONING ON THE PROPERTY HAS BEEN IN PLACE SINCE 2000.

WHICH WOULD HAVE BEEN THAT C PLANNED CENTER, SO THE HIGH INTENSITY COMMERCIAL ZONING ON THE PROPERTY HAS BEEN IN PLACE FOR QUITE SOME TIME. AND MY UNDERSTANDING OF THE SIGNIFICANT DIFFERENCE IS NOT WHAT'S NECESSARILY ALLOWED. IT'S THAT YOU DON'T HAVE TO PLAN THE ENTIRE SITE. AT ONE TIME THAT YOU'RE ABLE TO DEVELOP AS USES AND OPPORTUNITIES ARISE. THAT'S CORRECT, SO THE USES ARE NOT REALLY CHANGING. THAT THAT'S GENERALLY CORRECT. I THINK THAT'S IMPORTANT ENOUGH TO MR URBAN IS THAT NOTHING THAT NOTHING THAT WILL BE BUILT.

THERE CAN'T BE BUILT RIGHT NOW. WITH THE CURRENT ZONING IS WHAT SHE'S EXPLAINING WHAT IT ALLOWS TO HAPPEN IS AS THE MARKET DICTATES OF SOMEONE COMES IN THE RIGHT USER ON THE FRONT AND OFFICE BUILDING, FOR EXAMPLE, THEY CAN DO THAT WITHOUT HAVING TO DEVELOPMENT PLAN THE ENTIRE SITE AT ONE TIME, THAT'S CORRECT , AND QUITE FRANKLY, WHAT WE SEE HAPPENING A LOT OF TIMES IS THEY'LL DO THE BIG MASTER PLAN AND THEN THEY'LL COME IN AND CHANGE IT AS THEY ARE DEVELOPING EACH TRACK, SO THE END RESULT OFTEN ENDS UP THE SAME. IT'S JUST I DON'T WANT TO JUST DIMINISH IT TO SAY IT'S PAPERWORK, BUT IT'S ADDITIONAL PROCESS THAT THEY HAVE TO GO THROUGH TO REVISE THOSE GENERAL DEVELOPMENT PLANS ALONG THE WAY. OTHER QUESTIONS FOR JENNIFER. NO I THINK THAT WAS IMPORTANT TO ADDRESS MR URBAN'S CONCERNS BECAUSE THAT WAS WHAT MY RESEARCH SHOWED IS THAT NOTHING THAT CAN'T BE BUILT. WITH EITHER ONE. I MEAN, NOTHING IS REALLY GOING TO CHANGE WHAT CAN BE BUILT. IT JUST DEPENDS ON HOUSING. AT WHAT TIMES IT CAN BE BUILT. I GUESS WHERE THE PROCEDURE THEY HAVE TO GO THROUGH TO DO IT. ANY OTHER QUESTIONS. NOT ENTERTAIN A MOTION. OCEAN THAT WE CLOSED PUBLIC HEARING AND IMPROVE THE AUTOMATIC PRESENTED FOR A SECOND. I'LL SECOND THAT WE DON'T HAVE A BUTTON. YOU GUYS HAVE IT? AND CAST YOUR VOTES, PLEASE. MOTION PASSES. NEXT ITEM. 21015 62 CONDUCTED PUBLIC

HEARING TO CONSIDER AND ACT ON A REQUEST TO REASON. THE SUBJECT PROPERTY FROM PLANNED DEVELOPMENT DISTRICT AND REGIONAL EMPLOYMENT CENTER OVERLAY. DISTRICT PD PLAN DEVELOPMENT DISTRICT GENERALLY TO ALLOW FOR OFFICE USES. AND MODIFY THE DEVELOPMENT STANDARDS LOCATED IN THE NORTHEAST NORTH NORTHEAST CORNER OF COLLIN MCKINNEY PARKWAY AND PIPER GLEN ROAD AND COMPANY ORDINANCE. THANK YOU, MR MAYOR. THIS IS A 4.8 ACRE TRACTS THAT MAY LOOK VERY FAMILIAR TO SOME OF YOU. FOR THOSE THAT ARE WANTING TO GO DOWN MEMORY LANE. THIS WAS THE POTENTIAL SITE FOR THE CRAVE DELIVERY. UM VIRTUAL KITCHEN THAT WAS BEING CONSIDERED LAST YEAR. UM AFTER THE CRAVE DELIVERY FOLKS FOUND AN ALTERNATE SITE, A NEW OWNER HAS COME IN AND IS REQUESTING TO REZONE THIS SUBJECT PROPERTY TO ALLOW FOR OFFICE USES. OTHER IT'S A 4.8 ACRE TRACT REQUESTS BEFORE YOU WOULD SORT OF DIVVYING UP THAT TRACK INTO TWO DIFFERENT SUBPARTS PARCEL A, WHICH IS ABOUT 1.7 ACRES, AND I BELIEVE WE'VE GOT THE EXHIBIT HERE. THEY'RE GOING PERSONALLY, WHICH IS 1.7 ACRES AND PERSONAL B, WHICH IS ABOUT THREE ACRES IN SIZE. BOTH WOULD ALLOW FOR THE SAME SWATH OF OFFICE USES ON THE TRACK. HOWEVER THE BUILDING HEIGHTS WOULD BE MODIFIED FOR EACH TRACT, SO FOR ATTRACT A THE BUILDING HEIGHT WOULD NOT BE ALLOWED TO EXCEED 55 FT. AND FOR A TRACK TO BE THE BUILDING HEIGHT WOULD BE LIMITED TO ONE STORY OR 25. FT IN HEIGHT, UM, WITH THE REQUEST BEFORE HIS STAFF HAS LOOKED AT IT. WE CERTAINLY FEEL IT'S APPROPRIATE FOR THE AREA. WE DO FEEL IT'S COMPATIBLE WITH THE COMPREHENSIVE PLAN AND MORE RECOMMENDING APPROVAL. UM, THE PLANNING AND ZONING COMMISSION ALSO CONSIDERED THE ITEM AND RECOMMENDED APPROVAL IN A SEVEN OH, VOTE. I'M HAPPY TO ANSWER ANY QUESTIONS, AND I BELIEVE OUR APPLICANT IS HERE AS WELL. QUESTIONS FOR JENNIFER. THERE'S A HAPPY ENDING STORY, I BELIEVE WILL BE THINK MANY PEOPLE FEEL THAT WAY. HAS ANYBODY GOTTEN AHOLD OF CRANE? BECAUSE HASN'T COME BEFORE US AND I WANT THEM. I WANT THAT THING BUILT. I BELIEVE SO THAT WHERE THEY'RE AT NOW. THEY MAY NOT NEED TO BE BEFORE YOU THEY SHOULD BE ABLE

ISSUE AWAY AND THIS IS WHAT WE'RE REPLACING IT WITH. WE HAVE TO ANSWER ANY QUESTIONS. REQUEST YOUR FAVORABLE APPROVED THANK YOU, BOB. THIS IS A PUBLIC HEARING. IS THERE ANYONE HERE? THEY WOULD LIKE TO SPEAK TO THIS ITEM. RIGHT, ENTERTAINING MOTION. COMMOTION THAT WOULD CAUSE A PUBLIC HEARING APPROVED THIS ITEM. SECOND IS CASTRO VOTES. MOTION PASSES. LAST ITEM IN PUBLIC HEARING, 210165 Z TO CONDUCT A PUBLIC HEARING TO

[Conduct a Public Hearing to Consider/Discuss/Act on a Request to Rezone the Subject Property from “PD” - Planned Development District to “PD” - Planned Development District to Modify the Development Standards and to Allow for Supportive Housing for Displaced Single Mothers and Office Uses, Located on the East Side of State Highway 5 (McDonald Street) and Approximately 175 Feet North of Cypress Hill Drive, and Accompanying Ordinance]

CONSIDER AND ACT ON A REQUEST TERESA ON THE SUBJECT. PROPERTY FROM PD PLAN DEVELOPMENT DISTRICT PLAN DEVELOPMENT DISTRICT. TO MODIFY THE DEVELOPMENT STANDARDS AND TO ALLOW FOR SUPPORTIVE HOUSING FOR DISPLACED SINGLE MOTHERS IN OFFICE USES LOCATED ON THE EAST SIDE OF STATE HIGHWAY FIVE MCDONALDS STREET AND APPROXIMATELY 75 FT. NORTH OF CYPRUS HILL DRIVING ACCOMPANYING ORDINANCE, JEFF YOU, MR MAYOR, SINCE THE LAST TIME YOU'LL SEE ME TONIGHT. UM SO AS YOU READ THIS REQUEST IS TO REASON THE SUBJECT PROPERTY TO PD PLAYING DEVELOPMENT DISTRICT. THE TRACT ITSELF HAS FOUR ACRES IN SIZE AND THE REQUEST BEFORE YOU IS SPECIFICALLY TO ALLOW FOR THE DEVELOPMENT OF A SHILOH'S PLACE , WHICH IS SUPPORTIVE HOUSING FOR DISPLACED MOTHERS. THAT'S REALLY IT'S SUPPORTIVE HOUSING FOR DISPLACEMENT, OTHERS AND WOULD ALSO ALLOW FOR SOME ANCILLARY OFFICE USES ON THE SITE. WITH THE REQUEST, THE APPLICANT IS PROPOSING TO FOLLOW MANY OF THE SITES STANDARDS FOR A MULTI FAMILIES OWNING DISTRICT BECAUSE THE DEVELOPMENT FORM WILL BE RELATIVELY SIMILAR TO THAT. THEY ARE ALSO ASKING FOR SOME MODIFICATIONS TO THINGS LIKE PARKING AND LANDSCAPING, ALL OF WHICH ARE OUTLINED AND THAT STAFF REPORT FOR YOU. STAFF HAS EVALUATED THE REZONING REQUEST AND WE ARE RECOMMENDING APPROVAL OF IT. PLANNING AND ZONING COMMISSION ALSO CONSIDERED THE ITEM AND RECOMMENDED APPROVAL. I DO WANT TO NOTE ONE CHANGE FROM WHAT WAS PRESENTED AT PNC TO WHAT YOU SEE BEFORE YOU TONIGHT. I'M GOING TO PULL IT UP. JUST SO I DON'T UM, MESS UP THE SPECIFIC CHANGE HERE. SO UM, STAFFS ORIGINAL RECOMMENDATION FOR APPROVAL WAS PURSUANT TO CERTAIN PROGRAM REQUIREMENTS FOR SHILOH'S PLACE , UM, SPECIFICALLY RELATED TO HOME CHECKS. AND AS PART OF ITS HOME TEXT AND THE DISPLACED SINGLE MOTHERS AND THE LANGUAGE , THEIR FIRST SINGLE MOTHER WITH THE MOTION BY PLANNING AND ZONING COMMISSION, THEY DID RECOMMEND REMOVING THE WORD SINGLE FROM MOTHER TO ALLOW FOR JUST A WIDER RANGE OF CHILD PLACE NEEDED IT IN THE FUTURE, AND THEY ALSO REQUESTED TO OUR MOTION TO REMOVE SOME OF THOSE PROGRAM REQUIREMENTS.

SPECIFICALLY THOSE HOME CHECKS FROM THE PD REGULATIONS. SO THE ATTACHED REGULATIONS THAT YOU HAVE IN YOUR PACKET TONIGHT REFLECTS THOSE CHANGES. STAFF DOESN'T HAVE ANY OBJECTION TO THOSE. BUT I DID WANT TO NOTE IT FOR THE RECORD THAT WHAT WAS ORIGINALLY PRESENTED TO PNC FROM STAFF'S RECOMMENDATION VERSUS WHAT YOU'RE SEEING TONIGHT. HAS THAT CHANGE FROM THE PNC MOTION? AND WITH THAT, I'M HAPPY TO ANSWER YOUR QUESTIONS. AND I KNOW OUR APPLICANT AND MANY OTHERS ARE HERE TO SPEAK. ANY QUESTIONS FOR JENNIFER STICKING AROUND. GIVE US YOUR OPINION ON WHICH ONE OF US SHOULD BE ON THE 911 CALLS ON THE YOU CAN BET 1000. I MEAN, I CAN STICK AROUND. NOT NECESSARY. WITH THE APPLICANT, PLEASE COME UP. MAYOR FULLER. COUNCILMAN COUNCILWOMAN , AND THEN YOU GET YOUR NAME AND ADDRESS. I'M SORRY. I APOLOGIZE. JAMES CRAIG 68 50 TPC DRIVE SUITE. 104 MCKINNEY, TEXAS 75070. MM MAYOR FULLER COUNCILMAN. COUNCILWOMAN MRS ARNOLD. MRS DRAIN, MR HAUSER. UM, FIRST AND FOREMOST, THANK YOU FOR ALLOWING ME TO SPEAK ON BEHALF OF SUCH A SPECIAL ORGANIZATION IN SUCH A SPECIAL CAUSE. MM SHILOH PLACE IS A FAITH BASED MINISTRY FOR SINGLE MOTHERS. THAT ARE DISPLACED OR AT RISK OF BEING DISPLACED. THE

[01:15:08]

PROGRAM ALLOWS FOR UP TO 24 MONTHS THE AVERAGE CLIENT IS THERE FROM ANYWHERE FROM SIX MONTHS TO A YEAR. UM WHAT UM WHAT HAS CAUSED ME TO BECOME SO PASSIONATE ABOUT THIS PROJECT IS THE COUNTLESS NUMBERS NUMBER OF LIVES THAT ARE IMPACTED, NOT JUST THE CLIENT. UM THEMSELVES, BUT THEIR CHILDREN THERE. FAMILY AND REALLY THE COMMUNITY AS A WHOLE. MM THE REASON WHY I'M SO PASSIONATE ABOUT IT IS BECAUSE UM THERE'S FEW PROGRAMS NOWADAYS THAT ARE WILLING TO GIVE A HAND.

HAND UP, NOT A HANDOUT. AND SO, WHICH I WILL PLACE IS ALL ABOUT IS, UM TAKING THESE MOTHERS IN A TIME OF NEED, AND, UM HELPING THEM BECOME SELF SUSTAINABLE. THEY OFFER FULL TIME CHILDCARE, WHICH DOESN'T HAPPEN AT THE FACILITY. UM, BUT THEY PROVIDE FOR THAT, UM, THE MOTHERS HAVE TO BE ENROLLED IN SCHOOL FULL TIME AND WORKING PART TIME. UM, THERE ARE ALCOHOL AND DRUG CHECKS. THERE'S NO MAN. NO VISITORS ALLOWED PERIOD, WHICH IS WHY WE ASKED FOR THE PARKING VARIATION, BUT, UM. LONG STORY SHORT. I THINK WE CAN ALL AGREE THAT IT'S A WONDERFUL CAUSE. UM REALLY? WHAT I WANTED TO SPEAK TO YOU IS FROM PLANNING. FROM A PLANNING AND ZONING IN THE USE STANDPOINT, I THINK IT'S A PERFECT EXAMPLE OF A BUFFER USE YOU HAVE ABOUT 800,000 SQUARE FEET OF INDUSTRIAL DIRECTLY ON THE OTHER SIDE OF HIGHWAY FIVE ON THE WEST SIDE, HIGHWAY FIVE, UM AND WITH TRAINING HEIGHTS SUBDIVISION BACKING UP TO THIS PROJECT ON THE EAST SIDE, I THINK UM, A LITTLE HIGHER DENSITY RESIDENTIAL UNITS AND OFFICE IS, YOU KNOW, PERFECT BUFFER USE BETWEEN TWO USES THAT ARE REALLY POLAR OPPOSITES. UM FROM A FROM A FUTURE LAND USE DEVELOPMENT STANDPOINT, I REALLY FEEL LIKE IT'S THE HIGHEST AND BEST USE, BUT TO CONSIDER WHAT WOULD BE BUILT HERE. IF SHALLOW PLACE. THIS WASN'T THEIR ULTIMATE, UM, FUTURE LOCATION.

YOU'VE GOT 4.5 ACRES THAT BACKS UP TO THE CREEK TO THE TO THE NORTH. THAT CREEK IS PROBABLE JURISDICTIONAL WATERS, SO CAN'T TOUCH IT WITHOUT. UM BECOMING PRETTY MUCH ECONOMICALLY UNFEASIBLE TO DEVELOP AND WITH THE TOPOGRAPHY OF THE LAND, IT REALLY MAKES IT FOR THE WHOLE ACRE AND A HALF TO THE NORTH IS PRETTY MUCH UNUSABLE. IN THE BEST CASE SCENARIO, LET'S SAY A DEVELOPER SINCE IT'S CURRENTLY ON THE FLIP AS SUBURBAN LIVING, LET'S SAY DEVELOPER IN THE FUTURE, BOUGHT THE 1.23 ACRES ADJACENT TO THE SOUTH. THEY'D BE LEFT WITH ABOUT 3.5 USABLE ACRES IF YOU TAKE THE DENSITY OF TRENDY HEIGHTS SUBDIVISION AT FIVE ACRES TO THE UNIT, YOU'RE LOOKING AT BEST, MAYBE 18 TO 20 RESIDENTIAL UNITS. IT'S JUST NOT ECONOMICALLY FEASIBLE. THERE IS NO SINGLE FAMILY DEVELOPER THAT'S GOING TO COME UM IN DEVELOP 18 HOUSES. SO WHEN YOU TAKE THAT INTO CONSIDERATION, I REALLY THINK THAT THE FUTURE USE OF ITS NOT SHALLOW PLACES EITHER GOING TO BE, UM SOMEONE'S GONNA COME ALONG ONE DAY AND MAKE A GREAT CASE FOR WHY LIGHT INDUSTRIAL WORKS RIGHT THERE OR WHAT'S MORE PROBABLE. IF SOMEONE MAKES THE CASE WIDE, MULTI FAMILY WOULD WORK PERFECTLY RIGHT THERE, WHICH I DON'T THINK EITHER OF THOSE OPTIONS ARE IN THE BEST INTERESTS OF THE TRENDY HEIGHTS SUBDIVISION. WE'VE DONE AN EXTENSIVE COMMUNITY OUTREACH AND ENGAGEMENT. WE WALKED THE ENTIRE NEIGHBORHOOD MULTIPLE TIMES, KNOCKED ON ALL 169 DOORS LEFT. LETTERS COLLATERAL MATERIAL HAD SCHEDULED MEETINGS , UM BOTH IN PERSON AND VIA ZOOM , AND WE'VE HAD SEVERAL SEVERAL UM. RESIDENTS WHO WANTED TO COME TOUR THE FACILITY. THERE'S NOT A SINGLE RESIDENT WHO ACTUALLY TOOK THE TIME TO COME AND SEE A WHAT WE SHALL PLACE IS REALLY ALL ABOUT THAT LEFT UNSUPPORTED. TIME AND SO, WITH ALL THAT BEING SAID, I TRULY FEEL LIKE SHALLOW PLACES. THE HIGHEST INVEST USE. UM NOT TO MENTION WHAT A GREAT CAUSE THEY ARE IN. AND WHAT A SERVICE THEY PROVIDE TO THE CITY OF MCKINNEY. THANK YOU VERY MUCH . AND IF YOU HAVE ANY QUESTIONS, I'D BE HAPPY TO ANSWER. JAMES. THANK YOU AND THANK YOU FOR THE I KNOW. FAMILIAR WITH THE AVERAGE YOU GUYS DID. THANKS FOR THAT. AND LOVE YOUR PASSION FOR THIS PROJECT. YOU PERSONALLY PASSION FOR THIS PROJECT AND APPRECIATE IT BIG FAN OF WHAT CHILDHOOD PLACE DOES SO? THREATS

[01:20:03]

PAUL WOODS IS IN SUPPORT OF THIS ITEM. AND EPI. I CAN'T READ THE LAST NAME. THAT GONNA TRY IS IN SUPPORT OF THIS ITEM. AND I JUST WANT TO THANK YOU FOR ALL NOT COMING UP AND TAKING THREE MINUTES TO TELL US HOW MUCH SHE'S IS THERE ANYBODY HERE THAT WOULD LIKE TO SPEAK TO THIS ITEM? CHARGED IN MY FORM. SO RAINY. I COULD SPARE YOU WANT MINT SUPPORTED THIS THIS ITEM BEING WITH ALL THE OTHER PEOPLE SUPPORTING IT? MAYBE I SHOULD. BUT, UM I'M A RESIDENT OF TRINITY HEIGHTS. CAROL WILSON 6 17 CYPRESS HILL DRIVE. UM AND I'M GOING TO SHORTEN IT FOR YOU.

UM AFTER ALL THE RESEARCH, I DID KNIGHTED ALL THE RESEARCH BECAUSE I WAS CONCERNED IT WAS ANOTHER. SHELTERS SUCH AN AID SUBSIDIZED HOUSING WORKFORCE HOUSING THAT SEEMS TO DISPROPORTIONATELY BE DROPPED IN DISTRICT ONE. YOU KNOW, MY NEIGHBORS AND I WERE CONCERNED AND ALSO WITH HOUSING VALUES. BUT HE DID ALL THE RESEARCH. UM, THEY ARE AMAZING PROGRAM. I DON'T THINK THAT'S IN QUESTION. UM THE IMPACT ON TRINITY HEIGHTS AS AS BEST I CAN TELL IS NOTHING NEGATIVE. THEY HAVE. BUSHES AND TREES PROPOSED FOR BUMPERS MASONRY WALL BECAUSE THEIR CHILDREN ARE NEVER UNSUPERVISED. I DON'T ANTICIPATING NOISE PROBLEMS THAT THERE ARE PRIVATE FACILITY AND NO AND AFTERWARDS PEOPLE COME AND GO. NO SECURITY PROBLEMS IN A TALK TO SEVERAL REAL ESTATE EXPERTS, THAT ASSURED MEANS THAT IT WOULD NOT HAPPENING NEGATIVE IMPACT ON OUR HOME VALUES. SO AS THE PRESIDENT OF ETERNITY HEIGHTS I'M HERE TO TELL YOU THAT I THINK THEY'D BE TOPPLE AND CONSIDERATE NEIGHBORS . AND I THINK THIS IS A GREAT OPTION IS, MR CRAIG SAID. THE ALTERNATIVES. THAT I AM VISION WOULD BE APARTMENT OR LIKE INDUSTRIAL NEITHER WOULD JUST DESIRABLE SO I HOPE HARD TO GIVE MY SUPPORT. THAT WAS THE READER STEIN JUST FOR GREAT. THAT WAS PERFECT. THANK YOU VERY MUCH. HOUSE SHAKING. UM I'M A GRADUATE OF SHILOH PLACE FIVE YEARS AGO, ME AND MY TWO LITTLE BOYS WERE LEFT HOMELESS AND NOT BY ANY BAD CHOICES THAT I MADE, BUT ACTUALLY, BY A VERY BRAVE AND COURAGEOUS CHOICE THAT I MADE TO ESCAPE FROM A BAD SITUATION. UM SHALLOW PLACE HAS COMPLETELY CHANGED THE TRAJECTORY AND THE LEGACY OF ME AND MY CHILDREN. UM IT'S NOT LIKE LIKE MR CRAIG WAS SAYING. IT IS NOT A HANDOUT. IT IS. IT IS A VERY CHALLENGING PROGRAM. THEY HAVE HIGH EXPECTATIONS. HIGH STANDARDS OF US AND I AM EXTREMELY EXTREMELY BLESSED TO HAVE BEEN A PART OF THIS PROGRAM. AND DURING THE COURSE OF THE PROGRAM. I ALSO RECOGNIZE THAT I WAS JUST ONE OF PROBABLY MANY, MANY, MANY, MANY APPLICANTS AND CALLING COUNTY AND I WAS VERY BLESSED AND IT WAS ALL GOD. THAT GOT US THERE, AND THERE'S SO MANY WOMEN OUT THERE LIKE MYSELF THAT NEED THIS

[01:25:04]

OPPORTUNITY. UM WHO KNOWS WHERE ME AND THE BOYS WOULD BE? I'M NOW IN A POSITION YOU KNOW, I'M CATAPULTED ME RIGHT BACK INTO SOCIETY AND WITH A THRIVING AN ENTREPRENEUR WITH A THRIVING, SUCCEEDING ROOFING COMPANY HERE IN MCKINNEY, AND IT'S ALLOWING ME AND MY FAMILY TO NOW GIVE BACK TO THE COMMUNITY, A COMMUNITY THAT HAS GIVEN SO MUCH TO US. AND NOW WE HAVE THE OPPORTUNITY TO GIVE BACK SO I DIDN'T FILL OUT THE CARD. I'M OBVIOUSLY IN SUPPORT OF IT. I WILL DO CART WHEELS UP AND DOWN THIS BUILDING. WHATEVER IT IS YOU I AM SUPPORTIVE IT MY LOVE.

THANK YOU SO MUCH TO SHILOH PLACE. AND THANK YOU GUYS FOR LISTENING. I HAVE A QUESTION FOR YOU IF I COULD. FIRST OF ALL, THANK YOU FOR SPEAKING AND I THINK THAT WAS EVERY TIME NO.

WAS VERY MOVING TO HEAR YOUR TESTIMONY. WHAT HIS NAME OF YOUR ROOFING COMPANY THAT'S ROOFING ON TOP ON TOP. OKAY THANK YOU TO BE KNOWN MATCH. GET YOUR PLUG IN . YEAH OUR OFFICES DOWNTOWN BECAUSE WE'RE EVERYTHING. MCKINNEY WHEN WE SUPPORT YOU GO BORN AND RAISED MAKENI, WHERE EVERYTHING AND I'LL TELL YOU AND I'VE GOT TO ADD THIS PART TOO, BECAUSE I WAS BORN AND RAISED HERE IN MCKINNEY WHEN I DID GET INTO SHILOH PLACE, AND I'LL NEVER FORGET I FIRST GOT IN AND THEY ASKED ME, YOU KNOW, CAN WE POST YOU AND YOUR BOYS IN A IN A BROCHURE HOLIDAY BROCHURE? I WAS SO ASHAMED BECAUSE PEOPLE IN THE COMMUNITY KNEW ME. AND WHEN PEOPLE THINK HOMELESS, THEY THINK YOU KNOW SOMEBODY WHO'S DEGENERATE SOMEBODY WHO'S LIVING UNDER A BRIDGE AND PUSHING AROUND A SHOPPING CAR. AND THAT WAS IT. THAT'S NOT WHAT IT LOOKS LIKE. IT LOOKS LIKE THIS. THIS IS WHY WE SHOWED UP EVERY SINGLE DAY JUST LIKE THIS, AND NOBODY KNEW WHAT I WAS GOING THROUGH.

THERE WAS A LOT OF SHAME AND GUILT THERE. IN SHILOH PLACE, WHICH IS EXACTLY WHAT SHILOH MEANS, WHICH IS A PLACE OF REST IN PEACE, AND THAT'S EXACTLY WHAT IT DID FOR ME AND MY CHILDREN. THAT'S AWESOME AND ROOF ON TOP ON TOP ON TOP. THANK YOU. THANK YOU. IS THERE ANYBODY ELSE AND YOU'RE NOT GOING TO TOP THAT SO I WOULD STAND DOWN. SURE YOU WANT TO COME UP IF YOU'D LIKE TO? I'M JUST KIDDING. SURE COME ON. YEAH I WOULDN'T WANT TO FOLLOW THAT. BUT THAT'S A TOUGH ACT DID TO CART WHEELS. YES I HAVE TO OUTBID THE CART WHEELS. MY NAME IS TED LIND WALL OR HUBERT LINDVALL. LEGALLY I DIDN'T HEAR MY NAME MENTIONED IN THE LETTERS. YEAH I DIDN'T. I DON'T HAVE A CORD IT MADE. OKAY WELL, I SENT A LETTER RECOMMENDING IT. I LIVE IMMEDIATELY BEHIND WHERE THE HOUSEHOLD OR WHERE THEY DEVELOPMENT. AND I'M VERY MUCH IN FAVOR. VERY PLEASED TO HEAR THE POSITIVE NOTES ABOUT THAT. AND I THINK WE'LL ALL BE BLESSED BY THAT. THE ALTERNATIVE IS TO HAVE COMMERCIAL PLACE WITH THE PARKING AND ALL THE PROBLEMS THAT GO WITH PUBLIC PARKING. SO I THINK WE WILL BE BLESSED FOR MANY REASONS. THANK YOU, SIR.

THANK YOU. THANK YOU. ANYBODY ELSE? SEEING NONE. MAKE A LOTION . I'D LIKE TO MAKE A MOTION THAT WOULD CLOSE THE PUBLIC HEARING AND APPROVED THIS ITEM LIKE TO SECOND THAT PLEASE CAST YOUR VOTES. TO MARRY A MAN MAKE COMMENTS. CORRECT. YOU COME UP TO THE PODIUM. THE SWEAT. HE SORT OF HE SWEATING ENOUGH, CHARLIE. HE'S SO COMFORTABLE UP THERE, MR PHILLIPS, ON BEHALF OF ALL THE LIVES THAT YOU CHANGED THAT DON'T EVEN LIVE HERE YET. THE MOTHERS AND THE SMALL CHILDREN THAT YOU MADE A DIFFERENCE IN THEIR LIVES WELL INTO THE FUTURE. I WANTED TO SAY THANK YOU. THANK YOU VERY MUCH. SO IT HAS BEEN AN HONOR AND A PRIVILEGE AND I ALMOST FEEL GUILTY. UM TO BE PRAISED FOR IT, BECAUSE THERE'S NEVER BEEN ANYTHING THEY'RE REWARDING. THEN WORKING WITH SHILOH PLACE. THEY'RE AMAZING GROUP OF PEOPLE AND THEY ATTRACT AN AMAZING GROUP OF PEOPLE AROUND THEM. AND THEY'RE RIGHT HERE IN AN AMAZING CITY, SO I THINK IT'S THE RIGHT SPOT FORM. SO I ALSO JUST WANT TO SAY THAT. I MEAN, YOU AND YOUR FATHER ARE A GREAT ADDITION TO THIS COMMUNITY. YOU YOU TRULY MEAN Y'ALL HAVE DONE WONDERS FROM MCKINNEY AND BUILDING IT THE RIGHT WAY AND YOUR VISION. UM HAS BEEN FANTASTIC. SO THANK YOU AND YOUR FATHER FOR ALL OF THE THINGS THAT YOU DO, THANK YOU ALL OVER A BLESSING TO THE GEORGE MCKINNEY. I APPRECIATE IT. I'M GOING TO SAY SOMETHING, JAMES, BECAUSE I WATCHING THIS AND WATCH IT. MR. GARCIA YOU

[01:30:02]

DIDN'T DO A CARTWHEEL BACK JUST SAYING NO, BUT WATCH IT. HEARING STORIES LIKE THAT. AND AS A POLICE OFFICER, KNOWING THAT WHEN WE COME IN CONTACT WITH A SINGLE MOM AND THE KIDS. WE DON'T HAVE A PLACE TO PUT. WE DO. LOOK AT SHILOH PLAYS AS A PLACEMENT FOR THEM BECAUSE THERE'S NOT MANY OPTIONS OUT THERE. I KNOW THAT FOLKS THINK THAT THERE'S A TON OF OPTIONS.

THERE'S NOT, UH, THERE'S PLACES LIKE THE DALLAS LIFE FOUNDATION AND SUCH AS THAT WORK, WHICH ARE JUST WRECKING HOMES FOR FAMILIES , AND THEN YOU LOOK AT THE SHILOH PLACE THAT'S BUILDING CHARACTER BUILDING PROMISE. IN SHOWING HOPE AND ACTUALLY BRINGING A SKILL OUT THAT MANY DIDN'T EVEN KNOW THEY HAD. AND SO THANK YOU FOR LOOKING AT THIS OPTION VERSUS JUST LOOKING AT A PIECE OF PROPERTY THAT WAS SITTING THERE TO PUT MULTI FAMILY ON AND MAKING TONS OF MONEY ON IT. AND GOING THE EXTRA MILE AND THEN BRINGING ALL THE RESIDENTS IN HERE THAT ARE JUST REWARDING YOU FOR DOING IT. SO THANK YOU FOR DOING THIS. THANK YOU, JAMES. YOU GUYS STEPPED OUT IN QUITE A BIT OF FAITH. BECAUSE TIMING ON EVERYTHING YOU HAD TO. IF YOU DIDN'T CLOSE, YOU WENT HARD ON MONEY FOR THAT PROPERTY PRIOR TO KNOWING WHETHER YOU WOULD GET THAT ZONING OR NOT SET CORRECTLY. WE CLOSED BEFORE THE END OF THE YEAR. I KNOW YOU HAD TO DO THAT, AND YOU STEPPED OUT IN FAITH AND TWICE SWEATING. TRUE STAGE WHEN? WHEN. WHEN YOU'RE PASSIONATE ABOUT SOMETHING, AND YOU BELIEVE IN IT, THAT'S WHAT YOU DO, AND SO AGAIN WHAT? EVERYONE SAID. I FEEL THE SAM YOU KNOW THAT AND SO THANK YOU AND THANK YOU FOR COMING UP AND SPEAKING. THAT WAS REALLY VERY MOVING. I WAS GREAT MOVIE. UM I WAS. I RESPECT EVERY SINGLE PERSON SITTING HERE BEFORE ME AND SO COMING FROM Y'ALL, I GREATLY APPRECIATE IT. BUT ALL THE ALL THE GLORY GOES TO WHOEVER YOUR HIGHER POWER WHOEVER YOU CHOOSE TO CALL YOUR HIGHER POWER AND, MOST IMPORTANTLY TO SHILOH PLACE. THANK YOU, JAMES. THANK YOU. ALL RIGHT. WE WILL NOW MOVE ON. NOT YOU, JENNIFER. HE CAN SIT DOWN. 2211177 CONSIDERING ACT ON A RESOLUTION APPOINTING A MEMBER

[CITIZEN COMMENTS ON MATTERS NOT ON THE AGENDA]

SEND COMMENTS ON MATTERS NOT ON THE AGENDA. I KNOW THAT. SEE IF YOU HAVE. THERE WAS NO CARDS OUT THERE. I KNOW THAT YOU HAD A COMMENT AND BEYOND THAT, DO WE HAVE ANY OTHERS THAT HAVE SIGNED UP ONE OTHER, OKAY? STEVE SPAIN, OUR 18 36 VIRGINIA AVENUE BEGINNING TEXAS JUST WANTED TO SAY HAPPY NEW YEAR LIKE MY OCCASIONAL APPEARANCE. THERE'S AN AUTUMN OWN YOUR EXECUTIVE SOCIAL THAT YOU CAN'T SPEAK TO PUBLICLY, BUT I WANTED TO MENTION THE FACT THAT PROGRAMS OR CITY MANAGERS. I THINK IN MY CITIZENS VIEW HAS DONE A GREAT JOB. I'VE EXPRESSED THAT TO HIM PRIVATELY. I WANTED TO DO SO PUBLICLY LIVED HERE. MCKINNEY ABOUT 22 YEARS I'VE SEEN A LOT OF CITY MANAGERS AND CITY COUNCILS COME AND GO. BUT I THINK THE SYNERGY THAT PAUL BRINGS TO OUR CITY COUNCIL IN BRIEFING ALL OF Y'ALL. THERE'S NO EASY TASK. I KNOW. UM IS VERY MUCH APPRECIATED FROM THIS CITIZENS POINT OF VIEW. I CAME IN ONE DAY, AND I SAW A BIG GROUP OF FOLKS HERE IN THE CITY COUNCIL MEETING IN IT WAS A STAFF MEETING AND PAUL WASN'T SITTING UP FRONT LEADING THE MEETING. HE WAS SITTING ON THE BACK ROW, AND WHEN HE SPEAKS, EVERYBODY TURNS AROUND AND LISTENS TO HIM. I'VE WORKED FOR 23 AND FOUR STAR GENERALS IN THE ARMY. AND I WOULD QUIT HIS LEADERSHIP TO SOME OF THE BEST LEADERS I'VE SEEN IN THE

[01:35:04]

MILITARY, AND THAT DOESN'T MEAN HE LEADS WITH AN AUTHORITARIAN ROLE, BUT IT EMPOWERS OTHER PEOPLE GET THINGS DONE. SO WHATEVER WE CAN DO FINANCIALLY TO REWARD HIM AND KEEP HIM ON BOARD. I'M ALL BEHIND THAT. AND PAUL. THANK YOU VERY MUCH FOR COMING TO MCKINNEY APPRECIATE YOUR SERVICE. THANK YOU. MY COMMENTS. THANK YOU. THANKS, STEVEN. I DO. YOU DON'T HAVE IT.

WITH HIM. DANIEL PORZIO. HAPPY NEW YEAR, SIR. YOU ALSO AND EVERYBODY. DAN PORZIO 5500 MCKINNEY PLACE DRIVE. UM. I WASN'T GOING TO SPEAK OR HAVE ANY PREPARED REMARKS, BUT I HAD A COUPLE OF INCIDENTS HAPPENED TO ME OVER. THE CHRISTMAS HOLIDAY. AND THAT WAS MEETING WITH SOME YOUTH IN THE CHURCH. AND SPEAKING TO THEM AND TEACHING THEM. PRINCIPLES OF LEADERSHIP. AND HOW DO YOU HOW DO YOU LEAD? AND THEY WERE ASKING ME ABOUT HOW DOES THE GOVERNMENT WORK? WELL THAT'S A LOADED QUESTION. YOU KNOW ANY OF YOU UP THERE COULD GO ON FOR HOURS. THIS IS WHAT WE DO, AND THIS IS THE PROCEDURES AND ALL THAT. BUT I TOLD THEM THE BIGGEST THING IS I HAVE A COUPLE OF AXIOMS. THAT. I DEVOTED MY LIFE TO AFTER MY LIFE CHANGED MANY YEARS AGO. AND ONE OF THEM IS. WILL YOU FORGET THE SCRIPTURE? MICAH MICAH SIX, VERSE EIGHT. AND IT SAYS, WHAT DOES THE LORD YOUR GOD ASK OF YOU? HE HAS SHOWN YOU, O GOD, WHAT IS WHAT IS GOOD, AND HE ASKED YOU TO ACT JUSTLY SHOW MERCY AND WALK HUMBLY. AND I ENCOURAGE YOU ALL. AND EVERYONEE PRINCIPLES WHETHER WE'RE PARENTS. COUNCIL. MEMBERS.

SCHOOL TEACHERS. ANY WORKERS. THAT PRINCIPLE WILL SUSTAIN. UNITY. AND SENSE OF PURPOSE. AND I WAS READING. ONE OF THE KIDS ASKED ME WELL. YOU KNOW WHAT DIT UNITY? AND I SAID THERE WAS A COUPLE OF THINGS THAT JESUS SPOKE ABOUT THAT WERE REALLY, REALLY IMPORTANT. AND IF YOU GO TO THE BOOK OF JOHN CHAPTER, 17. ALMOST THE ENTIRE THING IS A PRAYER. AND WHAT DID THE LORD PRAY FOR? UNITY. AND I THINK IN THE SPIRIT OF THAT I MEAN, I STAND BEFORE YOU DEDICATED TO DO WHATEVER I CAN. FOR THIS CITY IN WHATEVER CAPACITY THAT IS. AND. WITH ALL THAT'S GOING ON OUT THERE. IT'S EASY FOR US TO BECOME DISCOURAGED AND APATHETIC AND ANGRY AND FURIOUS. SO IT'S IMPERATIVE THAT WE FOCUS ON UNITY AND RESPECT. SO YOU ALL HAVE DEMONSTRATED THAT ON MANY OCCASIONS I WANT TO ACKNOWLEDGE CITY MANAGER GRIMES. I GOT A LETTER FROM A FRIEND OF MINE.

WHO HE WAS WHINING AND FUSSING ABOUT A CITY MANAGER THAT WE DEALT WITH A LONG TIME AGO. AND I SAID, WELL, WE'VE GOT ONE HERE THAT EVERY TIME I HEAR HIM SPEAK I LIKE HIM. SO THANK YOU ALL FOR WHAT YOU DO. THANK YOU, DAN. THANK YOU, DAN. ALL RIGHT. THOSE ARE ALL THE CITIZEN COMMENTS. WE HAVE ON THE. REQUESTED COUNSEL AND MANAGER COMMENTS. START DOWN THERE. IF YOU HAVE ANY CUSTOMER
