GONNA LET OUT GOOD EVENING AT 605. 65 PM WELCOME TO THE CITY OF MCKINNEY'S PLANNING HIS ONLY COMMISSION MEETING OF TUESDAY, FEBRUARY THE 8TH 2022. THAT COULD MYSTERIES THAT YOU SEE SEATED BEFORE YOU HAVE BEEN APPOINTED BY THE CITY COUNCIL, AND WE SERVE AT THE PLEASURE OF THAT SAME CITY COUNCIL. SOME OF THE ITEMS TONIGHT WILL HAVE A PUBLIC HEARING. UM AS PART OF THE PACKET IF YOU HEARD TO SPEAK ON AN ITEM THAT HAS A PUBLIC HEARING WHEN YOU COME TO THE PODIUM, POLICE HAND THE YELLOW CARD. TO ONE OF OUR STAFF MEMBERS, SO WE'LL HEAD FOR THE NAME AND ADDRESS. YOU'LL HAVE THREE MINUTES TO SHARE YOUR THOUGHTS. YOUR CONCERNS. ABOUT THAT PARTICULAR ITEM. WHEN YOU COME TO THE PODIUM, GIVE YOUR NAME AND ADDRESS AS WELL SO THAT PEOPLE WATCHING AT HOME CAN KNOW WHO'S TALKING TO THEM. A COUPLE OF THINGS. WE APPRECIATE YOU BEING HERE. IT IS IMPORTANT THAT THE CITIZENS BE INVOLVED IN THE PROCESS. THAT DOESN'T MEAN WE ALL AGREE, BUT AT LEAST WE HAVE AN OPPORTUNITY TO SHARE OUR THOUGHTS AND CONCERNS. IF YOU ARE HERE TONIGHT TO SPEAK ON AN ITEM THAT DOES NOT HAVE A PUBLIC HEARING, THERE WILL BE AN OPPORTUNITY ON THE FRONT END OF THIS MEETING. FOR YOU TO SHARE YOUR THOUGHTS AS WELL AGAIN WHEN YOU COME TO THE PODIUM AND YOUR YELLOW CAR TO ONE OF OUR STAFF MEMBERS. AND YOU'LL HAVE THREE MINUTES TO SHARE YOUR THOUGHTS AND YOUR CONCERNS. LET'S TREAT EACH OTHER WITH RESPECT AND

[PUBLIC COMMENTS ON AGENDA ITEMS (For Non-Public Hearing Agenda Items)]

FOCUSED ON THE ISSUES, AND WE WOULD APPRECIATE THAT THE FIRST ITEM. ON OUR MEETING TONIGHT WILL BE AN OPPORTUNITY FOR YOU TO SPEAK ON AN ITEM THAT IS NOT HAVE A PUBLIC HEARING ATTACHED.

THAT WOULD BE AND ITEMS SUCH AS THE MINUTES FROM OUR LAST MEETING. CONCEPT PLAN FOR A RESTAURANT OR ONE OF THE PLANT CONSIDERATIONS. WE HAVE 1 TO 2 PLATT CONSIDERATIONS TONIGHT. SO IF YOU'VE COME TO NINE AND WOULD LIKE TO SPEAK ON AN ITEM THAT DOES NOT HAVE A PUBLIC HEARING ATTACHED, PLEASE COME TO THE PODIUM. IT WOULD BE A PLANT FOR ANY. I'LL NEED AGENDA TONIGHT.

WE HAVE TWO PLANTS BEING CONSIDERED. YES, MA'AM. MY NAME IS JOANNE KELLY GRAHAM. AND I LIVE AT 1373 COUNTY ROAD, 2 78. AND I'D LIKE TO SPEAK WITH YOU BRIEFLY ABOUT JENN PLATT.

CONSIDERATION FIVE, WHICH IS A PRELIMINARY FINAL. PLATT FOR WILLOW WOULD FACE EIGHT HIGH.

LIVED DIRECTLY ACROSS THE STREET FROM THIS PROPOSED CHANGE. I LIVE ON COUNTY ROAD, 2 78. WHILE I UNDERSTAND COMPLETELY THAT I DON'T OWN THAT PROPERTY, AND I CAN'T CONTROL WHAT HAPPENS TO IT . UM I'VE KNOWN THAT THIS HAS BEEN AN ISSUE FOR QUITE SOME TIME AND HAVE ACTUALLY SPOKEN WITH DEVELOPERS ABOUT WHAT IS BEING DONE. I HAVE TWO CONCERNS , ONE OF WHICH I SHARED WITH OR 31, OF WHICH I SHARED WITH STAFF EARLIER AND TO WHICH I'D LIKE TO SHARE WITH YOU. UM ONE WAS I WAS NOT NOTICED. OF THE SECOND HEARING ON THIS WHEN IT CAME UP FOR THE ZONING CHANGE. THE FIRST ONE WAS TABLED. WE WERE TOLD WE'D BE NOTICED ON THE SECOND AND WE WERE NOT THE SECOND ITEM FOR THE SECOND CONCERN OF MINE IS WHAT THE TIMING IS GOING TO BE TO IMPROVE COUNTY ROAD, 2 78 AND SHANNON WROTE, BOTH OF WHICH ARE DIRECTLY IMPACTED BY THE DEVELOPMENT AND WILLOW WOOD. AND HAVE BECOME SIGNIFICANTLY BUSIER , AND FANNIN WROTE HIS INDEED NOW QUITE DANGEROUS AS A RESULT OF THE GREATLY INCREASED TRAFFIC , SCHOOL BUSSES AND THE HIGH RATES OF SPEED THAT ARE ON THAT ROAD. I KNOW IT WILL BE DONE. NEEDS TO BE DONE SOONER RATHER THAN LATER. AND SECONDLY, IT'S A VERY PERSONAL ITEM FOR ME. UM WE HAVE SPRINKLERS ON OUR PROPERTY AUTOMATIC SPRINKLERS AND GO ALL THE WAY OUT TO THE PAVEMENT ALL THE WAY OUT TO THE EAST. THE DEVELOPER HAS TOLD ME THAT THEY WILL MOVE THOSE AND REPAIR THOSE WHEN THEY WIDENED THE ROAD. I JUST WANTED TO GO ON THE RECORD AS SAYING HE PROMISED ME THAT. AND I WANT TO MAKE SURE THAT HE DOES THAT BECAUSE I DON'T WANT MY SPRINKLER SYSTEM TAKEN OUT. IN THE MIDDLE OF THE SOUTH. SO I CAN'T DO ANYTHING ABOUT CHANGING THE PLAT. I KNOW THAT. BUT I HOPE THAT YOU WILL CONSIDER THE PEOPLE THAT ARE LOSING THEIR COUNTRY. THEIR COUNTRY LIFE TO WILLOW. THANK THANK YOU, MISS GRAHAM. BILL DANIEL, I LITTLE BIT 410 FANTA ROAD. OR EFFORTS DON'T HAVE THE NUMBERS NOMINAL REFERENCE THE SAME PROPERTIES.

AS MENTIONED. MY PROPERTY PART OF MY PROPERTY. THE FENCE LINE UP AGAINST THE PROPERTY SHE JUST TALKED ABOUT THAT WAS BEING DEVELOPED IN THE LAST HEARING. I GUESS YOU GUYS HAVE I DID NOT GET NOTIFICATION. HEARING FOR EITHER. SO THAT THERE WERE SIGNT A NOTIFICATION FOR TONIGHT. MY

[00:05:11]

CONCERN IS THAT ROAD IS WIDE. THAT TREES DOWN THE FULL LENGTH OF THE SCHOOL DOWN TO SAN AND ROAD. BEEN THERE. I'VE HAD THAT PROPERTY PROBABLY 38 39 YEARS NOW. HUGE TREES DOWN. ELSE BY PROPERTY LINE. AND IF YOU TURN LEFT THERE AND HAD NORTH ALONG FUNDING ROAD THE FULL LENGTH OF FRIEND AND RODE UP TO. I THINK IT'S 339. MY PROPERTY RUNS UP TO THERE. AT THE SAME ISSUE. I'VE GOT WHOLE WORLD TREES ALONG THERE. FOR 38 39 YEARS. TRAFFIC THAT SHE MENTIONED. UM EXPONENTIALLY. INCREASED. 8 10 12 BUSSES, PROBABLY 152 100 CARS. EVERY MORNING EVER AFTER THAT. HUH? OUT OF MIND. SOMETIMES I GOT TO WAIT. JUST TO GET OUT OF THE DRIVEWAY OF THE HOUSE. THERE IS A STOP SIGN THERE, BUT A LOT OF PEOPLE DON'T PAY ANY ATTENTION TO THE STOP SIGN. TRAFFIC IS A CONCERN. THE INCREASED TRAFFIC IS A CONCERN. WIDENING OF THE ROAD IN TERMS OF THE IMPACT ON MY PROPERTY. AND HAVING WHATEVER IS GOING TO BE RIGHT ACROSS THE FENCE LINE. YOU SIDE THE WEST SIDE OF MY PROPERTY LINE. IT RUNS ACROSS. RUNNING SOUTH ALONG THE PROPERTY LINE. HE TALKED ABOUT ALL THAT. THANK YOU, MR DANIEL. ANYONE ELSE HERE TO SPEAK TONIGHT ON A AGENDA ITEM THAT DOES NOT HAVE A PUBLIC HEARING. ANYONE ELSE? OR A GOOD WE'LL MOVE TO OUR UM.

[CONSENT ITEMS]

CONSENT AGENDA. WE HAVE ITEM 22-0118. MINUTES OF THE PLANNING HIS OWN COMMISSION, A REGULAR MEETING OF JANUARY 21ST 2022, AN ITEM 21-003 C. CONCEPTUAL PLAN FOR GOLDEN CHICK 15 45 NORTH COAST, A ROAD MEMBERS, QUESTIONS OR EMOTIONS ON THE CONSENT AGENDA. MAKE A MOTION TO APPROVE THE CONSENT AGENDA. MOTION MEMORIES TO MILLIONS. I TO APPROVE THE CONSENT AGENDA. 2ND 2ND BY MR WOODRUFF IS REALLY DISCUSSION. PLEASE CAST YOUR VOTE. BUT I. OKAY THE CONSENT URGENT IS APPROVED BY ABOUT SEVEN IN FAVOR. ZERO AGAINST THE NEXT ITEM WILL TAKE OUR PLANTS.

[Consider/Discuss/Act on a Conveyance Plat for HEB at Coit Addition, Lots 1 and 2, Block A, Located on the Southeast Corner of Coit Road and Highway 380]

SEPARATELY THE FIRST PLANT WILL BE 22 DAYS. 004 CVP. CONSIDER CONVENIENCE PLANT FOR HB AT COURT. IN ADDITION, LOTS ONE AND TWO BLOCKADE. THIS IS THE SOUTHEAST CORNER OF COURT ROAD AND HIGHWAY THREE AGED I THINK. LISTENERS LEXI, TRADER PLANNER ONE. THIS IS A CONVENIENCE PLATFORMER TO LOTS LOCATED THE SOUTHEAST CORNER OF QUITE ROAD AND HIGHWAY, 3 80. STAFF IS RECOMMENDING. ADDITION. MEMBERS. QUESTIONS OF LEXI. UM, THIS QUITE CONSIDERATION ANYONE. VERY GOOD MOTION. MOVE TO APPROVE THE PLAN CONSIDERATION WITH THE RECOMMENDED CONDITIONS ON THE STAFF REPORT. SECOND MARK. MR MAN'S IN HIS SECOND, MY MR WALLET PROOF. THE CONVENIENCE PLANT, INCLUDING THE CONDITIONS , AS MENTIONED IN THE STAFF REPORT. AND YOU DISCUSSION.

[Consider/Discuss/Act on a Preliminary-Final Plat for Willow Wood Phase 8, Located on the South Side of County Road 278 and Approximately 1,800 Feet East of State Highway 5 (McDonald Street)]

. THAT PLAN HAS BEEN APPROVED. THE NEXT PLAN WILL BE 22-0005 PF. CONSIDER PRELIMINARY FINAL PLANT FOR WILLOW WOULD FACE EIGHT SOUTH SIDE OF COUNTY ROAD. 2 78 1800 FT EAST OF STATE HIGHWAY FIVE MCDONALDS STREET. GOOD EVENING COMMISSIONERS. SOFIA SYRUP UNDER ONE. THIS IS A PRELIMINARY FINAL PLATFORM, WILLOW WOULD FACE EIGHT. THE APPLICANT IS PROPOSING TO SUBDIVIDE APPROXIMATELY 20.57 ACRES. INTO 88, RESIDENTIAL LOTS AND THREE COMMON AREAS. STAFF RECOMMENDS APPROVAL WITH CONDITIONS AND I STAND FOR ANY QUESTIONS. MEMBERS QUESTIONS.

[00:10:01]

DIDN'T HAVE QUESTION SLASH COMMENT, AND IT MAY BE FOR KAITLYN OR SOFIA. UM THERE ARE TREES IN THE AREA AND THEN ALSO, UM POTENTIALLY TRAFFIC. WELL PROPERTY OWNERS IN THE AREA HAVE AN OPPORTUNITY TO LEARN WHAT'S GOING ON AND TALK TO CITY STAFF AT SOME POINT ABOUT THIS DEVELOPMENT PROCESS. I BELIEVE SO. OKAY LITTLE BIT MORE. WE WILL BE WORKING WITH OUR ENGINEERING DEPARTMENT. I'VE ALREADY SENT AN EMAIL TO, UM, TALK ABOUT THE TRAFFIC IMPACT AS WELL AS THE TREE CONSIDERATION THAT MR DANIELS BROUGHT UP, OKAY? IS SOME OF THIS AREA WHERE THE CITY LIMITS BLEND WITH THE COUNTY AS FAR AS THE TJ ON WHO HANDLES THE ROADS THAT'S CORRECT. THAT KIND OF LEADS ME TO A QUESTION. OKAY SO HOW DOES THAT TIME IS THE CITY TREE ORDINANCE INVOLVED IN THIS AT ALL OR IN THE DJ. WE DO NOT HAVE THE TREAT ORDINANCE AND EFFECT SO IT WILL ONLY BE ON THE PROPERTIES THAT HAVE BEEN ANNEXED INSIDE OF THE CITY LIMITS. WHICH LEADS TO ANOTHER QUESTION. AS THIS PROPERTY BEEN ANNEXED INTO THE CITY OF MCKINNEY, WILLOW WOOD HAS BEEN ANNEXED IN YES. SO ANY ANY. TREE ABATEMENT WOULD BE SUBJECT TO THE TREE ORDINANCE CORRECT ON THE WILLOW WOOD PROPERTY ON THE WILLOW WOOD PROPERTY IN ANY TRAFFIC. CONSIDERATION WOULD BE SUBJECT TO A TRAFFIC IMPACT ANALYSIS. THEY WILL HAVE TO ADHERE TO ALL OF THE TRAFFIC, UH, IMPACT ITEMS THAT NEED TO BE ADDRESSED BY OUR ENGINEERING DEPARTMENT. ANYONE ELSE? MOTIONS. LIKE A MOTION. WE APPROVED THE BLACK CONSIDERATION WITH THE, UM I BELIEVE THERE WAS SOME SPECIAL CONDITIONS ALSO ATTACHED. SEE THIS PLUG. SEX.

ARNOLD WATCH ME CLEAN THIS UP, CLEAN IT UP. MR MANZO. YOU SICK OF THAT? YES MR DOUBT TO APPROVE THE ANIMUS FOR STAFF RECOMMENDATION, INCLUDING THE SPECIAL PROVISIONS INCLUDED IN THIS KIT CONTAINING THE STAFF REPORT. ESTERMANN'S I SECOND. THE MOTION IN THE DISCUSSION.

PLEASE CAST YOUR VOTE. OKAY THIS MOTION CARRIES SEVEN IN FAVOR AND ZERO AGAINST SO WE'LL MOVE TO REGULAR AGENDA. THESE WOULD BE THE ITEMS THAT HAD A PUBLIC HEARING ATTACHED IN THE FIRST

[Conduct a Public Hearing to Consider/Discuss/Act on a Variance to a Site Plan for a Car Wash (Clear Water Car Wash) Located at 5271 West University Drive]

ITEM IS TO ONE DAY 0071 SP. PUBLIC HEARING REQUEST. HAD TO DISCUSS A VARIANCE TO A SITE PLAN FOR A CAR WASH CLEARWATER CARWASH. THIS IS AT 5 TO 71 WEST UNIVERSITY DRIVE. EVEN IN COMMISSIONERS, UM ME AGAIN. UM. TOKYO COULD YOU PULL THE MIC DOWN A LITTLE BIT, TOO? THANK YOU. IT'S YEAH, THANK YOU. THIS IS CLEAR WATER CARWASH. IT'S BEEN PROPOSED AT 5 TO 71 WEST UNIVERSITY DRIVE. FOR THE SONY, WHICH IS B G GENERAL BUSINESS DISTRICT. CAR WATCHES ARE PERMITTED BY RIGHT TYPICALLY, SITE PLANS ARE APPROVED. AT THE STAFF LEVEL. HOWEVER THE APPLICANT IS ASKING FOR A VARIANCE, WHICH SHALL BE CONSIDERED BY THE PLANNING AND ZONING COMMISSION TONIGHT. THE APPLICANT IS PROPOSING TO CONSTRUCT 4450 SEATS. SQUARE FOOD CARWASH ON 1.53 ACRES LOCATED ON THE SOUTH SIDE OF U S HIGHWAY 3 80, APPROXIMATELY 1000 FT WEST OF NORTH LAKE FOREST DRIVE. THE APPLICANT IS REQUESTING A VERY INS FOR SECTION ONE. FORCES SLAP DASH ONE THROUGH 3 TO 3 G, WHICH IS FENCES, WALL AND SCREENING REQUIREMENTS. THIS SECTION OF THE ORDINANCE REQUIRES THAT ALL THE DOORS ARE RENTED AWAY FROM THE STREET CHRONIC. THE APPLICANT HAS PROPOSED TO ARRANGE AN OVERHEAD DOOR AT THE END OF THE CAR WASH. TOWARDS THE U. S HIGHWAY 3 80. THAT OVERHEAD DOOR IS PROPOSED TO BE APPROXIMATELY 107 FT AWAY FROM THE STREET AND WILL BE SCREENED USING LEAVING LANDSCAPE COMPOSED OF WHAT'S MYRTLE AND GLOSSY, A BILIOUS DROPS THREE FEEDING HIGH AT THE TIME OF PLANNING AND SPACE TO RUFINO CENTER. STAFF IS OF THE OPINION THAT THE PROPOSED LANDSCAPING ALONG THE END OF THE TUNNEL, AS WELL AS I REQUIRE TREES PLANTED ALONG THE STREET OF U. S HIGHWAY, 3 80 SHOULD PROVIDE A LEVEL OF SCREENING THAT MEETS THE INTENT OF THE ORDINANCE FOR SCREENING THAT

[00:15:04]

OVERHEAD DOOR. FROM VIEW FROM THE RIGHT OF WAY. EVEN THIS FACTORS. STAFF IS RECOMMENDING APPROVAL OF THE VARIANTS AND OVER HERE IS THE SITE PLAN. UM. AND THAT BADIR IS FACING 3 80.

AND THEN THE APPLICANT IS PROVIDING SUFFICIENT SCREENING OVER HERE. THE SHRUBS AND TREES TO SCREEN THE OVERHEAD DOOR. AND I STAND FOR ANY QUESTIONS. QUESTIONS REGARDING THIS PROPOSED SITE PLAN. WHAT. SOFIA THANK YOU VERY MUCH. IS OUR APPLICANT HERE TONIGHT? YES.

[Conduct a Public Hearing to Consider/Discuss/Act a Specific Use Permit Request to Allow for an Indoor Gun Range, Located at 2100 North McDonald Street]

BEEN APPROVED. THE NEXT ITEM IS 21-0017 ISSUE. P PUBLIC HEARING REQUEST. TO CONSIDER SPECIFIC USE PERMIT TO ALLOW FOR AN INDOOR GUN RANGE. THIS IS AT 2100 NORTH MCDONALDS STREET.

STRA BENNETT. IT'S GOOD EVENING COMMISSIONERS JAKE BENNETT PLANTER ONE WITH THE CITY MCKINNEY. THIS PROJECT MAY LOOK A LITTLE BIT FAMILIAR TO YOU. AND I PULL IT UP HERE. UM SO THE COMMISSION. HAD A FAVORABLE RECOMMENDATION FOR THE REZONING , AND THAT REASON WAS APPROVED AT COUNCIL LAST WEEK. AND THIS IS THE S U P TO ACCOMPANY THAT ZONING. THIS IS GPS WERE PROPOSED INDOOR GUN RANGE. THE SITE IS LOCATED ON THE EAST SIDE OF STATE HIGHWAY FIVE AND JUST SOUTH OF MCINTYRE ROAD. THIS AREA ALONG HIGHWAY FIVE IS DESIGNATED AS EMPLOYMENT MIX AND THE ONE MCKINNEY 2040 COMPREHENSIVE PLAN. IN THIS DEVELOPMENT SHOULD CONTINUE TO DEVELOP THIS PORTION OF MCKINNEY WITH A SIZABLE EMPLOYER AND INDUSTRIAL USES. AS YOU CAN SEE IN THE SCP EXHIBIT. THE INDOOR GUN RANGE IS NOT THE SOLE ASPECT OF THIS BUSINESS. IN FACT, THE GUN RANGE WILL NOT BE OPEN FOR PUBLIC USE. THE BUSINESS THAT WILL OCCUPY THIS SPACE IS A FIREARMS MANUFACTURER THAT IS LOOKING TO MOVE ITS HEADQUARTERS TO MCKINNEY. THE PRIMARY USES ON THE SITE WILL BE MANUFACTURING WAREHOUSING IN OFFICE. THE INDOOR GUN RANGE WILL BE USED.

WILL ONLY BE USED BY EMPLOYEES IN THE TESTING OF THEIR PRODUCTS BEING MANUFACTURED. THE INDOOR GUN RANGE WILL BE DESIGNED AND BUILT IN COOPERATION WITH THE RANGE CONSULTANT. IN THE RANGE WILL BE OUTFITTED WITH A NUMBER OF NOISE AND SAFETY MEDICATIONS. THANK YOU, MR BENNETT. OTHER QUESTIONS OF STAFF ANYONE? THANK YOU IS OUR APPLICANT HERE TONIGHT? HI GOOD EVENING, STEPHANIE TAT WITH KIM LEE HORN.

WHERE THE CIVIL ENGINEER ON THE PROJECT. UM WE ARE RESPECTFULLY REQUESTING APPROVAL OF THE S U P AND I STAND FOR ANY QUESTIONS YOU ALL MAY HAVE. QUESTIONS OF THE APPLICANT. [00:20:01]

. 2ND 2ND BY MR WOODRUFF. IS THERE ANY DISCUSSION? PLEASE CAST YOUR VOTE. THIS MOTION IS APPROVED BY VOTERS SEVEN IN FAVOR ZERO AGAINST DESIGN AND WILL BE SENT TO THE CITY COUNCIL. WITH A FAVORABLE RECOMMENDATION FOR FINAL ACTION AT THE MARCH 15 2022 MEETING.

[Conduct a Public Hearing to Consider/Discuss/Act on a Request to Zone the Subject Property to “PD” - Planned Development District to Allow for Commercial and Multi-Family Residential Uses, Located on the East Side of State Highway 5 (McDonald Street) and Approximately 600 Feet North of the Intersection of County Road 278 and Fannin Road]

THE NEXT ITEM IS TO ONE DAY 0038 Z PUBLIC HEARING REQUEST. HIS OWN SUBJECT. PROPERTY FROM PD PLAN DEVELOPMENT DISTRICT TO ALLOW FOR COMMERCIAL AND MULTI FAMILY USES. THIS IS ON THE EAST SIDE OF STATE HIGHWAY FIVE MCDONALDS STREET 600 FT. NORTH OF THE INTERSECTION OF COUNTY ROAD, 2, 78 AND FANNIN ROAD. STRICKLAND. THANK YOU, CHAIRMAN. LIKE YOU HAVE PREVIOUSLY STATED THIS MULTI FAMILY COMMERCIAL REQUEST LOG HIGHWAY FIVE. ABOUT 600 FT. NORTH OF THE INTERSECTION OF COUNTY ROAD. TO 78 FANNIN ROAD. THE APPLICANT IS REQUESTING THE ZONE, APPROXIMATELY 39.9 ACRES. GENERALLY FROM MULTI FAMILY AND COMMERCIAL USES, JUST SO THAT THE PLANNING AND ZONING COMMISSIONERS AWARE AND ASSOCIATED VOLUNTARY ANNEXATION REQUEST HAS BEEN SUBMITTED FOR THIS TRACK. AND IT WILL BE CONSIDERED BY CITY COUNCIL AT THE MARCH 1ST 2022 MEETING COMING UP, BUT FOR PLANNING AND ZONING, IT'LL ONLY BE THE ZONING CONSIDERATION THAT WE ARE TALKING ABOUT TONIGHT. THE APPLICANT IS PROPOSING TO ZONE APPROXIMATELY 19.9 ACRES FOR 19.89 ACRES. FOR ATTRACT ONE TRACKED ONE IS GOING TO BE HERE ALONG THE FRONT PORTION. OF HIGHWAY FIVE WITH THE DIRECT FRONTAGE. AS C TWO, WHICH IS OUR LOCAL COMMERCIAL ZONING DISTRICT WITH THE ADDITIONAL ALLOWANCES FOR 10 FT SIDEWALKS ALONG ALL PUBLIC STREETS AND TO OBSERVE A MINIMUM OF A 45 FT BUILDING SET BACK ALONG THE PUBLIC STREET. HD GREEN WAS NOT A VERY GOOD GREEN. TRACK TWO IS BEING PROPOSED TO BE ZONED IN COMMERCIAL AND MULTI FAMILY USES. THE COMMERCIAL USES WOULD BE R C TWO NEIGHBORHOOD COMMERCIAL WITH INDEPENDENT LIVING AND NURSING HOMES SPECIFICALLY PROHIBITED AS ALLOWABLE USES, IF DEVELOPED IN MULTI FAMILY RESIDENTIAL USES, THE TRACK TWO WILL BE DEVELOPED WITH OUR MF THREE STANDARDS, WHICH IS OUR MULTI FAMILY RESIDENTIAL MEDIUM HIGH DENSITY DISTRICT. WITH THE EXCEPTIONS THAT THE MAXIMUM ALLOWED DENSITY SHALL BE 25 UNITS PER ACRE. THE MAXIMUM ALLOWED BUILDING HEIGHT WILL BE 45 FT, WHICH WOULD BE THREE STORIES. THE NO LESS THAN 30% OF THE UNITS WILL HAVE ENCLOSED PARKING AND NO LESS THAN 50% THE UNITS WILL HAVE ENCLOSED OR COVERED PARKING AND THAT AN ADDITIONAL THREE AMENITIES WILL BE REQUIRED FOR WHATEVER IS ON THIS SITE UPON DETAILED REVIEW OF THE PROPOSED DEVELOPMENT REGULATIONS AND THE SITE SAT STAFF HAS FOUND TO BE SUPPORTIVE OF THE PROPOSED REZONING REQUEST TO ALLOW FOR BOTH COMMERCIAL AND MULTI FAMILY USES ON THIS SITE. WITH THE EXTENSION OF COUNTY ROAD THREE NIGHTS 3 39, WHICH WILL BE RIGHT HERE, AND IT'LL GO ALL THE WAY TO HIGHWAY FIVE. AND THE COMMERCIAL OPPORTUNITY THAT IT CAN BRING THE POTENTIALITY OF WORD OF 39.9 ACRES ACTUALLY DEVELOPING ENTIRELY AS COMMERCIAL IS VERY LOW, SO WE ARE FINDING THAT THE 50 50 SPLIT IS QUITE AGREEABLE, ESPECIALLY WITH THE 50% THAT IS BUDDING RIGHT AGAINST THE HIGHWAY FIVE. SO GIVEN THAT THE SIGNIFICANT PORTION OF THE TRACK ALONG WITH THE HIGHWAY COMMERCIAL FRONTAGE IS BEING PRESERVED FOR.

COMMERCIAL USES AND THE FACT THAT THE DEVELOPMENT STANDARDS BEING PROPOSED FOR THE MULTI FAMILY USES ARE IN LINE WITH REQUESTS THAT WE HAVE BEEN SEEING RECENTLY. STAFF IS RECOMMENDING APPROVAL AND I WILL STAND FOR ANY QUESTIONS. THANK YOU, CAITLIN. QUESTIONS OF STAFF. THANK YOU VERY MUCH. SORRY, BRIAN. I'M SORRY. TO THE CITIZENS IN THIS AREA OF IRISH SHOWED CONCERNS FOR THE TRAFFIC ALONG THE WAY. THIS IS ALL IN THE DJ NOW AND CAN'T IS NOT SUBJECTED TO CITY STANDARDS WITHIN THE ROADS AND CONSTRUCTION. AS IT SITS BY THE ANNEXATION IN THEIR ZONING, THEN THEY WOULD BE BROUGHT UP TO BE REQUIREMENTS WITHIN THE CITY'S FOR AS UM EGRESS, INGRESS AND ROAD CONDITIONS AS FAR AS ACCESS THAT WOULD BE CORRECT, THEY WOULD BE REQUIRED TO FALL ALL THIS ALL OF OUR CITY STANDARDS AS WELL AS FOLLOW THE PD REQUIREMENTS THAT ARE SET FORTH BY THESE DEVELOPMENT REGULATIONS. OTHER QUESTIONS OF STAFF. THANK YOU. KATE IS OUR APPLICANT HERE TONIGHT? JAX ANGER TO 949 PARK WOULD BE LORD

[00:25:13]

FRISCO, TEXAS. I'M TRIANGLE ENGINEERING, AND I'M THE APPLICANT AND I'M HERE TO ANSWER ANY QUESTIONS. QUESTIONS OF THE OF THE APPLICANT. WE'VE HEARD A COUPLE OF COMMENTS ABOUT TRAFFIC AND ROADS. SHARE ANY THOUGHTS ON FROM YOUR SEAT. SO THIS SITE WILL BE DEVELOPED IN THE FUTURE , MAYBE 2 TO 4 YEARS. THERE WILL BE RIGHT AWAY DEDICATION AND CONTRIBUTION TO THE IMPROVEMENTS ALONG FANNING ROAD. UM THERE'LL BE RIGHT AWAY DEDICATION 100 AND 20 FT FOR THE EXTENSION OF COUNTY ROAD 339 THROUGH THE PROPERTY. UM THE MULTI FAMILY PORTION WILL HAVE YOUR STANDARD.

MCKENNEY SAID. BUFFERING WITH 20 FT BUILDING, SETBACKS AND LANDSCAPE BUFFERING AROUND THE ENTIRE PERIMETER. WHEN YOU TALK ABOUT THAT LANDSCAPING THERE, YOU'RE DEDICATING 30% OF THE ENTIRE PROJECT TO A LIVING LANDSCAPING. CAN YOU DESCRIBE THAT? WH THAT THAT WOULD DISPUTE ANY OPEN SPACE WILL HAVE LIVING LANDSCAPING. SO WE'LL HAVE AT LEAST 30% OF THE ENTIRE SITE WILL HAVE LIVING LANDSCAPING IN ALL AREAS THAT THAT'S IN THAT THAT'S CONSIDERED ANYTHING. YOU KNOW? MM ANY TYPE OF OPEN GRASSY AREA WOULD BE LIVING LANDSCAPING FOR 30. ANYONE ELSE? THANK YOU. WE APPRECIATE YOU BEING HERE. THIS IS A PUBLIC HEARING. ADAM, IF YOU'RE HERE TO SPEAK ON THIS PROPOSED ZONING, PLEASE COME TO THE PODIUM. ONCE AGAIN I'M JOANNE KELLY GRAHAM AND I LIVE AT 1373 COUNTY ROAD, 2 78. SINCE I'M HERE TWICE. YOU CAN TELL.

I'M BOXED IN NOW. MY PROPERTY IU HAVE SURE HOW SHE CAN DRAW IT ON THE SCREEN. RAMPING OVERHEAD. MY COLOR. THIS IS MY PROPERTY RIGHT HERE. DOWN HERE IS COUNTY ROAD, 2 78 AND DIRECTLY ACROSS THE STREET AS WELL. A WOOD WHICH HAS NOW BECOME PART OF THE CITY. MY STREET TO 78 IS THE CITY LIMIT.

WE ARE NOT IN THE CITY. WE ARE NOT IN MELISSA. WE ARE IN THE COUNTY. YOU'RE GOING TO TAKE THAT. I'M. IN NO BANDS LAND WHAT HAPPENS TO US? THAT'S MY FIRST QUESTION. NOW I MOVED TO MCKINNEY FIRST IN 1983. I LIVED IN THE HISTORIC DISTRICT BECAUSE THAT IS THE ONLY PLACE THERE WAS TO LIVE. THERE WASN'T ANYWHERE ELSE. IT WASN'T CONSIDERED HISTORIC. UM SO I'M NOT A NEWBIE TO THIS PARTY AND I UNDERSTAND DEVELOPMENT AND I'VE SEEN THE CITY MOVED FROM 215,000. I KNOW I DON'T OWN THAT PROPERTY AND I CAN'T STOP THIS. BUT I DO HAVE SOME CONSIDERATIONS. I'D LIKE YOU TO TAKE INTO YOUR AGENDA. FIRST OF ALL OUR PROPERTY OF FIVE ACRES HAS ANIMALS ON IT. WE LEASE OUT THE BACK FOR ACRES AND WE HAVE DONE OVER $10,000 OF IMPROVEMENTS IN THE LAST TWO YEARS TO HELP WITH THAT LEASE. WE HAVE AN EXEMPTION ON THAT LAND AND WE HAVE VERY VALUABLE COLLECTIBLE SHEEP THAT THE LEASE E KEEPS ON THAT PROPERTY. PROBABLY 40 OR 50 LAMBS AND USED UM, THOSE SHEEP OBVIOUSLY ARE NOT GOING TO BE VERY HAPPY WHEN WE'VE GOT A THREE STORY APARTMENT BUILDING AND A BUNCH OF STORES DIRECTLY BEHIND US. I WOULD LIKE TO ASK FIRST OF ALL THAT A THAT THE DEVELOPERS BE REQUIRED TO ERECT A LARGE WALL SEPARATING YOU KNOW, I DON'T WANT THE BUFFERING ZONE TO JUST BE LANDSCAPE AND TREES BECAUSE THAT'S NOT MUCH OF A BUFFER. IT DOESN'T STOP. STOP THE NOISE, AND IT DOESN'T STOP THE LIGHTS. I WOULD LIKE TO ASK THAT THE LIGHTS BE ONES THAT FOCUS DOWN AND NOT ACROSS SO THAT WE DON'T UPSET THE ANIMALS. I KNOW THAT SOUNDS CRAZY FOR YOU THAT LIVE IN THE CITY. BUT IT IS IMPORTANT THAT WE DON'T UPSET THE ANIMALS.

UM. I SO I'D LIKE TO ASK ABOUT A WALL SEPARATING THEM IF THIS IS NOT DONE CAREFULLY, AND IT IMPACTS THE ABILITY TO CONTINUE TO LEASE TO ANIMAL USE WE HAVE FACED THE POSSIBILITY OF LOSING OUR EXEMPTION. AND IF YOU HAVE PROPERTY I KNOW BILL DOES THAT YOU WANT TO KEEP AN EXEMPTION ON

[00:30:06]

YOU WANT TO KEEP AN EXEMPTION ON THAT PROPERTY? IT MAKES A LOT OF DIFFERENCE IN YOUR MONEY. MY SECOND CONCERN IS PRIVACY. YOU CAN SEE WHERE OUR PROPERTY IS. YOU CAN SEE WHERE THE APARTMENTS ARE GOING TO BE. THREE MINUTES GOES BY REALLY QUICK WHEN YOU GET TRYING TO FIGURE OUT THE MACHINE. I GUESS MY OTHER QUESTION IS WHERE WHAT'S GOING TO HAPPEN TO ME? I'M GOING TO BE IN THE MIDDLE OF NOWHERE IS LAND. I'M GOING TO BE SURROUNDED BY CITY LIMITS, BUT NOT IN THE CITY. THANK YOU, BUT WE'RE GOING TO HAVE THE APPLICANT COME BACK UP WHEN WE CLOSE THE PUBLIC HEARING AND ADDRESS, UM SOME OF THESE CONCERNS ANYONE ELSE? YES, SIR. DRAWING WITH YOUR FINGER HERE. YES SIR. THERE'S A BUTTON CALLED ANNOTATIONS SECTION DOWN HERE. I GOT 10 ACRES ACROSS THERE. ALL OF THIS. IS MINE RUNS FROM HERE. TO HEAR. I HAVE. HOW THEY TALKED ABOUT THE HEIGHT OF THE BUILDINGS AND DISTANCE FROM THE ROAD. I'M LIKE TO KNOW MORE ABOUT THE EGRESS AND, WELL, THE INTERESTS OF THE EXCESS. TO GET THE COMMON LANGUAGE. WHAT'S GOING TO BE ON FANNIN ROAD IN TERMS OF THOSE DEPARTMENTS. I WOULD SAY THAT IF WE WERE TALKING SINGLE FAMILY DEVELOPMENT, I WOULDN'T BE HERE TALKING TO YOU TODAY. MULTI FAMILY DEVELOPMENT. UNARGUABLE SIDES OF THE COIN, BUT I THINK IT'S PRETTY WELL KNOWN THAT THEY HAVE NO SKIN IN THE GAME. THEY COME AND GO. LIKE TO KNOW WHAT THAT MAKE SURE THAT WE CONSIDERATIONS ARE FOR RESTRICTIONS OF LIKE MOBILE HOMES OR OUR MOTORHOMES. I MEAN, CARS THAT MAY NOT RUN. THE GROUND MAINTENANCE. I HAVE THE SAME EXEMPTION CONCERNS THAT CATTLE CONCERNS. I'VE GOT ANIMALS AS WELL. ON ALL OF THAT PROPERTY. IF I LOSE THE EXEMPTION, I PROBABLY LOSE THE PROPERTY. HOME. SO I WOULD LIKE THE WALLS KIND OF THING TO DEAL WITH THE LIGHTS. JOANNE MENTIONED I JUST DID ALL THE THINGS THAT, SHE SAID IN TERMS OF IMPACT ON QUALITY OF LIFE STYLE OF LIFE. UM I KNOW I DON'T AUDIT. I KNOW I CAN'T CONTROL IT, AND I CAN'T PROBABLY CAN'T STOP IT. ANY MORE THAN IF I DECIDED TO DO UP IT ON MINE. WHATEVER THAT MIGHT BE. I GUESS I WOULD HAVE THE SAME RIGHT AS THEY. JUST LIKE TO SOME REASONABLE. LISTEN IT I DON'T KNOW IF THE SINGLE FAMILY THING IS AN OPTION FOR THEIR THEIR USE OF THE LAND. BUT JUST ONE THING I WOULD ASK. ABSOLUTELY CHANGING. UH HUH. I LIKE TO BE SURE THAT I CAN MAINTAIN IT AS MUCH OF MY PRIVACY AND QUALITY OF STYLE OF LIFE AS POSSIBLE. I'M GONNA GET ON BOTH SIDES. 10 ACRES. THE DEVELOPMENT BY THE SCHOOL THAT PROPERTY IS GOING TO BE IMPACTED. THERE'S ALSO A QUESTION ON THAT PROPERTY OF WHAT THEY BUILD. OVER THERE. I WAS APPROACHED ABOUT THE COVENANTS ON THERE'S MULTIPLE 10 ACRE TRACTS THAT RUNS SOUTH ON THAT. AND THE COVENANTS RESTRICT THE TYPE OF BUILDING. SINGLE FAMILY DWELLINGS LINE. THERE IS MY UNDERSTANDING THAT NOT ALL THE PROPERTY OWNERS SIGNED. THAT AGREEMENT ON. LTD WHAT THE DEVELOPER WAS INITIALLY TRYING TO DO. I THINK THEY WANTED TO GIVE SOMETHING I GET IT RESTRICTS ANYTHING LESS THAN 2000 SQUARE FOOT. SINGLE FAMILY HOUSES. THEY WANTED TO TAKE THAT OUT OF THE COVENANTS. I'D BE CURIOUS ON WHAT THAT IS. AND IS THAT STILL A PART OF THE GAME PLAN BECAUSE I COULD BE IMPACTED ALL THE WAY AROUND ON MY 45 ACRES THAT I HAVE OVER THERE. I MOVED OUT THERE THAT WAS A DIRT ROAD. WHY NOT HOLDING AREA YOU'RE TALKING ABOUT WAS A CORNER FELL. NOTHING OUT THERE.

I HAVE SUCH SIGNIFICANT. TIME EFFORT AND DOLLARS IN THE DEVELOPMENT. WHERE I AM.

UNDERSTAND GROWTH DON'T HAVE A PROBLEM WITH THAT IS THE TYPE OF GROWTH THAT I'VE GOT A PROBLEM WITH THANK YOU. THANK YOU, MR DANIEL. GOOD EVENING. MY NAME IS JUDY FOR LONG, AND I'M A LIFELONG RESIDENT. I WAS BORN AND RAISED IN MCKINNEY, TEXAS, MOVED TO THIS AREA ABOUT 20 YEARS AGO. OUR PROPERTY GOES ALONG. THIS LINE HERE. SO THIS LINE RIGHT HERE WOULD BE WHAT I WOULD BE CONCERNED WITH. AND AGREE WITH THE OTHERS ABOUT A BRICK FENCE. BECAUSE WE'LL BE UP AGAINST THE COMMERCIAL WITH THE TRASH OF THE COMMERCIAL AND IN AND OUT AND CARS HAVE COMMERCIAL. AND I JUST THINK THG WAY. MASSAGES, PLANTING TREES. AND TRUMP IS THERE. AND. ANOTHER

[00:35:11]

QUESTION I HAVE IS SINCE I LIVE RIGHT THERE, AND I HAVE FURNITURE ON HIGHWAY FIVE.

MCDONALD WROTE. WE DON'T HAVE. CITY SEWER. WHERE IS THE SEWER AND EVERYTHING COMING FROM FOUR COMMERCIAL AND MULTI FAMILY. UMY MAY BE FOR THIS AREA BECAUSE WE DON'T HAVE IT, SO I'M MY QUESTION IS, WHERE IS THE SUE WE'RE COMING FROM IS IF IT'S IN AN ACCIDENT TO THE CITY OF MCKINNEY. THANK YOU SO MUCH. THANK YOU, MR FOR LONG. ANYONE ELSE WISH TO SPEAK TONIGHT ON THIS PROPOSED ZONING. ANYONE ELSE? THE COMMOTION. WE CLOSE THE PUBLIC HEARING. MOTION DAMAGE TO MILLIONS AND CLOSED THE PUBLIC HEARING A 2ND 2ND MAN, MR DOAK, IS THERE ANY DISCUSSION? PLEASE CAST YOUR VOTE. HIS PHOTOS TO ONLY CLOSE THE PUBLIC HEARING. MOTION CARRIES SEVEN IN FAVOR. ZERO AGAINST THE PUBLIC HEARING HAS BEEN CLOSED. OKAY, MEMBERS, QUESTIONS OF STAFF FOR THE APPLICANT. HALF, PLEASE. MISS STRICKLAND. THANK YOU. SO AT THE ANNEXATION IF THIS WAS ANNEXED INTO THE CITY AND ZONED THIS THEN THEY WOULD BE, UH, BUILDING TO OUR CODES. AND WHAT DOES PD HAS? SO CURRENTLY WHAT IS OUR SCREENING BETWEEN REQUIREMENTS BETWEEN MULTI FAMILY, RESIDENTIAL AND COMMERCIAL AND RESIDENTIAL REQUIRED TO HAVE THE SIX FT MASONRY WALL? AND THAT DOESN'T MATTER IF THEY'RE IN THE E. T J AND NOT THE CITY THAT IS STILL REQUIRED AS BECAUSE IT'S WHERE OUR LAND SNAIL WITHIN THE CITY LIMITS. THAT'S CORRECT. IT WOULD BE AGAINST RESIDENTIAL USES, AND THEY WOULD ALSO BE UNDER OUR CODE AS FAR AS LIGHTING AND LIKE POLLUTION AND BE REQUIRED, CORRECT, THEY WOULD HAVE TO FOLLOW OUR BUILDING BUILDING CODE FOR OUR LIGHTING STANDARDS. AND THIS IS CURRENTLY A ZONING AND WE DON'T HAVE A SITE PLAN AND AS THE APPLICANT MENTIONED 2 TO 4 YEARS, OFFERED DEVELOPMENT, SO WE DON'T HAVE ACTUAL EGRESS AND ACCESS LATER, ONLY LOOKING AT THE ZONING TONIGHT THERE HASN'T BEEN A SITE PLAN ASSOCIATED WITH THIS. THERE IS NO CONCEPT PLAN. THIS IS JUST FOR THE USE OF THE SITE. THE GENERALLY IS WHEN A PROPERTY IS ANNEXED INTO THE CITY AND ZONE FOR THE CITY. THE STANDARDS ARE INCREASED TO WHICH THEY HAVE TO DEVELOP ACCORDINGLY, COMPARED TO THE T J. CORRECT THEY WOULD HAVE TO MEET CITY STANDARDS AS WELL AS THE PD STANDARDS THAT ARE SET FORTH. OTHER QUESTIONS. YEAH I'D LIKE TO EXPLORE THAT A LITTLE BIT MORE. CAN YOU TELL ME WHAT STEPS THAT THE CITY TAKES? BECAUSE THIS IS GOING TO BE BUTTING UP RIGHT NEXT TO PRESIDENTIAL. CAN YOU TELL ME WHAT ADDITIONAL STEPS THAT YOU TAKE TO PRESERVE AND PROTECT THE PRIVACY OF THE RESIDENTIAL ARE THE RESIDENTS THAT ARE PUTTING UP RIGHT THERE. IT WOULD FOLLOW OUR STANDARD CITY PROCESSES FOR HAVING THAT MASONRY WALL AND THE ADDITIONAL UM, BUFFERS THAT ARE REQUIRED PER OUR CITY STANDARDS , SO ANY AS IF IT WAS COMING INTO THE CITY. BY ITSELF FOR A NORMAL STANDARD PROJECT. WE WOULD BE FOLLOWING THOSE SAME KINDS OF RULES. THAT GETS THE NEXT QUESTION WOULD BE TO KIND OF ANSWER TO GET AN ANSWER FOR HIM. CAN YOU EXPLAIN HOW THE SEWER LINE IS GOING TO WORK SINCE THEY'RE NOW ANNEXED OR THEY WILL BE ANNEXED? YES THEY WOULD BE ENTERING INTO A DEVELOPMENT AGREEMENT WITH THE CITY TO EXTEND THE WATER AND WASTEWATER LINE. I DO WANT TO QUALIFY THAT COMMENT ABOUT THE DEVELOPMENT AGREEMENT. THAT WOULD BE A STANDARD PRE ANNEXATION DEVELOPMENT AGREEMENT THAT REQUIRES THE DEVELOPER TO EXTEND THAT WATER AND SEWER IN ANY OTHER NECESSARY INFRASTRUCTURE. SO I THINK TO ANSWER THE GENTLEMAN'S QUESTION, OR I THINK MAYBE THAT LADY'S QUESTION ABOUT THE PROVISION OF SEWER. THAT WOULD BE THE RESPONSIBILITY OF THE DEVELOPER TO REQUIRE ANY NECESSARY EASEMENTS TO EXTEND THAT SEWER AND WATER TO THE PROPERTY AS OUR SUBDIVISION ORDINANCE REQUIRES THE EXTENSION OF UTILITIES TO AND THROUGH THE PROPERTY TO PROVIDE FOR ANY INFRASTRUCTURE THAT MAY BE NECESSARY. WHO WOULD CITIZENS REACH OUT TO WITHIN THE CITY. CONSIDERING THE BEARER FEELINGS OF BEING THE CITY IS NOW ABOVE US TO THE NORTH AND BELOW US TO THE SOUTH. ABOUT WHETHER THEY WOULD EVER WANT TO BE ANNEXED IN WHAT THAT PROCESS WOULD BE OR IF THEY PREFER NOT TO BE. WHO WOULD DISCUSS IT WITH HAVE GOT MY CARD HERE. THEY CAN CERTAINLY GIVE ME A CALL, AND WE CAN VISIT ABOUT THE CITY'S CONFERENCE OF PLAN. FUTURE LAND USE PLAN. WHAT WHAT YOU MAY EXPECT TO SEE IN THE FUTURE AND

[00:40:01]

THE OUT HERE AND WHAT YOUR OPTIONS ARE FIRST THING IN THE CITY LIMITS OR ANNEXING IN OR WHATEVER QUESTIONS YOU MIGHT HAVE ABOUT THAT. WE'RE HAPPY TO HELP HER IN THE PLANNING DEPARTMENT. YOU MENTIONED COUNTY ROAD, 3 39 COULD BE EXTENDED AND THAT'S GOING TO GO FROM CURRENTLY A FAN AND GO ALL OVER THE HIGHWAY FIVE. IS THERE A TIME FRAME WHEN THAT'S GOING TO HAPPEN? I DON'T BELIEVE THAT THERE IS AN EXACT TIME FRAME FOR THAT EXTENSION. IT'S JUST ON THE COMPREHENSIVE TRANSPORTATION PLAN. ANYONE ELSE? KAITLYN WOULD IT BE SAFE TO SAY THAT FOLLOWING UP ON MR WOOD'S QUESTION THAT IMPROVEMENT OF. 3 38 ALL ROADS IN 3 39 IN THAT AREA. WOULDN'T FOLLOW ALONG WITH THE DEVELOPMENT PLANS FOR THE PROPERTY. CORRECT SO AS WE'VE HEARD 2 TO 4 YEARS, IS THERE ANY CHANCE THAT THOSE ROADS ARE IMPROVED PRIOR TO THAT DEVELOPMENT COMING IN. I WOULD HAVE TO GET WITH OUR ENGINEERING DEPARTMENT. BUT I DON'T BELIEVE THAT IT IS ONE OF OUR 2 TO 4 YEAR ROADS. IT MIGHT BE A LITTLE BIT FARTHER OUT, BUT I'D HAVE TO CHECK WITH THEM. DID YOU HAVE ANYTHING OBVIOUSLY CAN SAY IT'S DEFINITELY NOT ON THE CITY'S RADAR, AND TYPICALLY, THE CITY DOES NOT PROACTIVELY CONSTRUCT ROADWAYS. TYPICALLY THAT IS SOMETHING THAT IS BORN BY DEVELOPMENT COMMUNITY SO UM, WHEN THIS DEVELOPMENT OCCURS, THE EXTENSION OF THAT ROADWAY WOULD NEED TO BE SHOWN ON A PLOT AND IT WOULD BE AT THE COST OF THE DEVELOPER TO INSTALL THAT PER THE CITY'S MASTER THOROUGHFARE PLAN, SO UM IT'S PRETTY ATYPICAL FOR THE CITY TO GO OUT IN ADVANCE AND CONSTRUCT THOSE ROADWAYS. TYPICALLY IT'S AS DEVELOPMENT OCCURS, THAT IS A RESPONSIBILITY BORNE BY THEM BECAUSE OF THE DEVELOPMENT THAT THEY'RE PUTTING ON THE GROUND. VERY GOOD. THANK YOU. OTHER QUESTIONS, COMMENTS THANK YOU. I FULLY UNDERSTAND THE CITIZENS CONCERNS OUT THERE WITH THE PACE OF GROWTH IN DEVELOPMENT COMING OUT APPROACHING. WITH HIM. WHAT IS 10 ACRE TRACTS IN A COUNTRY SETTING OVERALL, AND I KNOW THERE'S CONCERNS ABOUT CONTINUED GROWING TRAFFIC. IN THE AREA I COULD SEE. THAT BEING WITHIN THE CITY AND THEN SAYING ANNEXATION , AND I THINK WITH OUR STANDARDS AS FAR AS BUILDS AND WITH OUR SETBACKS AND SCREENING. THAT WHY DEVELOPMENTS GOING TO COME? I THINK THE CITY STANDARDS HELP IMPROVE THAT DEVELOPMENT AROUND THE CITIZENS THERE. THAT WOULD BE A FOR THE ITEM. BE HOT. IT'S SO I'LL SAY I MEAN, I SHARE THE CITIZENS CONCERNS TO MAKE SURE THAT THAT THERE PROBABLY PRIVATE PROPERTY RIGHTS WERE PROTECTED. UM AS MY COLLEAGUE MENTIONED BECAUSE OF THE STANDARDS OF THE CITY BRINGS WITH THAT A LOT OF THE LIGHT CHALLENGES AND THE SOUND CHALLENGES. THEY'RE GOING TO BE SUBJECTED TO WHAT WE CURRENTLY HAVE. IN OUR ORDINANCE , WHICH SHOULD BE ABLE TO PROTECT AND THERE ARE WAYS TO REMEDY IF THAT EFFORT IS EVER BREACHED OR AN ISSUE. SO WHILE I SEE THE CONCERNS, I THINK PROBABLY BEING SUPPORTIVE. VERY GOOD ANYONE ELSE? YOU KNOW, I'LL SAY THE SAME THING. YOU KNOW, I CAN TOTALLY UNDERSTAND YOUR CONCERN. YOU GUYS HAVE BEEN THERE VERY LONG TIME. WHILE THINGS WILL CHANGE. IT WON'T BE THE SAME AS COUNTRY LIVING AS THEY GO NORTH AND SOUTH OF YOU. I THINK YOU YOU CAN REST ASSURED THAT WHAT IS ON OUR BOOKS FOR THE CITY IS AN ORDINANCES. CITY STAFF IS GOING TO MAKE SURE THAT IT GETS DONE THAT WAY. IT WILL NEVER BE WHAT IT IS TODAY. YOU KNOW, ONCE THEY START THE DEVELOPMENT, YEAH, IT'S GOING TO CHANGE AND SADLY, UM, IT WON'T FEEL TOTALLY. LIKE COUNTRY AS IT DOES TODAY FOR YOU, BUT I DON'T THINK YOU HAVE TO WORRY ABOUT THE FACT THAT THE ROADS WILL GET IMPROVED THAT THEY WILL HOLD THE DEVELOPER TO THE LIGHT ORDINANCES. THE WALL EVERYTHING THAT TIES TO THE ORDINANCE THAT'S CURRENTLY INSIDE THE CITY WILL ALSO BE PUT IN PLACE BECAUSE IT WILL BE INSIDE THE CITY WHILE YOU'RE STILL THE E. T. J DOESN'T TAKE AWAY THE RESPONSIBILITY THAT DEVELOPER NORTH AND SOUTH OF YOU. TO ABIDE BY OUR RULES, SO I'M IN SUPPORT OF IT. UM, I THINK IT'S A GOOD PROJECT. ANYONE ELSE? WELL, THE SAME IN SUPPORT. JUST LISTENING TONIGHT. I'M ALWAYS LOOKING FOR THE WIN WIN. THINK IT'S A GOOD PROJECT. I WISH THERE WOULD BEEN MORE CONVERSATION. BETWEEN THE DEVELOPER AND THIS. RESIDENTS DIDN'T SEEM LIKE IT WOULD HAVE TAKEN THAT LONG BECAUSE IT'S

[00:45:02]

ONLY THREE OR FOUR HOUSES IN THERE. I AM IN SUPPORT OF THE PROJECT. I DON'T KNOW IF THERE'S ANY WAY BUT AS THIS AS THIS BEGINS TO DEVELOP, IS THERE A WAY TO ENSURE THAT THAT COMMUNICATION IS HAPPENING BETWEEN. THAT WAS COMING INTO THE TOP AND THE RESIDENTS THAT CURRENTLY OF PROPERTY THERE SO THAT. THESE CONVERSATIONS ARE HAPPENING SO ALL OF OUR STANDARD NOTIFICATION PRACTICES ARE GOING TO BE FOR ZONING AND FOR, UM ANY KIND OF VARIANCE PROCESSES. SO ONCE IT'S BROUGHT INTO THE CITY, KIND OF LIKE WITH THE CAR WASH THAT WE SAW EARLIER. THE SITE PLAN NORMALLY WOULDN'T COME BEFORE Y'ALL DUE TO THE FACT THAT IT'S APPROVED ADMINISTRATIVELY BY STAFF ONLY IF THERE WERE ANY KIND OF VARIANTS CONSIDERATIONS WOULD WE BE SENDING OUT? ANY KIND OF PUBLIC NOTICE, AND I KIND OF WANT TO OWN A TAG ON A LITTLE BIT, TOO. WHAT KATE WAS SAYING, UM THERE'S REALLY NOT A WAY FOR US AS A STAFF TO REQUIRE THE COORDINATION, BUT WHAT WE CAN DO IS WE ARE OBVIOUSLY HAVE RESIDENTS HERE WHO SHARED SOME CONCERNS AND A DESIRE TO COORDINATE AND WE CAN PROVIDE THEM WITH OUR CONTACT INFORMATION SO THAT AS PROGRESS HAPPENS ON THIS SITE OR QUESTIONS, MAYOR ARISE. UM WE HAVE COMMUNICATION WITH YOU ALL AS RESIDENTS. THAT'S PART OF OUR ROLE IS TO BE HERE AS A CONDUIT FOR YOU AS WELL. OBVIOUSLY, IT WE HAVE TO STOP SHORT OF REQUIRING IT. THAT'S JUST NOT SOMETHING THAT WE'RE ABLE TO DO, BUT WE CAN BE HERE AND HELP PEOPLE STAY IN THE LOOP. WE'VE GOT A LOT OF ONLINE TOOLS AND RESOURCES AS WELL THAT PUT IT AT YOUR FINGERTIPS. WHEN YOU WANT TO LOOK FORWARD AS WELL, SO WE CAN DEFINITELY COMMUNICATE AND COORDINATE WITH THEM SO THAT THEY HAVE THOSE RESOURCES AVAILABLE AND CAN FEEL COMFORTABLE THAT THEY KNOW WHAT'S GOING ON WITH THE PROJECT. THANK YOU, KATE. THANK YOU, JENNIFER. VERY MUCH. OTHER QUESTIONS, COMMENTS. THERE WAS A TIME WHEN MCKINNEY WAS A SMALL TOWN. 1982. IT WAS A SMALL TOWN.

AND THIS IS 2022. UNFORTUNATELY OR FORTUNATELY, IT'S A CITY NOW. AND GROWTH IS HERE. IT'S NOT SLOWING DOWN AND. WAYS OF LIFE THAT WE HAD ARE GOING TO CHANGE . UH GOOD OR BAD, RIGHT OR WRONG. IT IS WHAT IT IS. UM. NO ONE WILL TAKE YOUR EXEMPTION AWAY. NO ONE WILL TAKE YOUR TENANT AWAY. YOUR $10,000. YOU'RE IN GOOD HANDS, YOU'LL BE SAFE INVESTING THAT WHERE YOUR NEIGHBOR LOOK LIKE IT'S HARD TO SAY AT THIS MOMENT, WILL IT BE DIFFERENT IN 2 TO 4? YEARS? PROBABLY SO. THAT'S NOT A CALL THAT WE'RE THAT WE'RE ABLE TO MAKE. BUT ALONG WITH CITIES GROWING UP, WE HAVE THINGS LIKE THIS, AND IT'S DIFFICULT. TO VOTE ONE WAY AND KNOWING HOW MCKINNEY USED TO BE BACK IN THE DAY. BUT IT'S A DIFFERENT DAY NOW. OTHER COMMENTS, QUESTIONS MOTIONS. I'LL MAKE A MOTION TO APPROVE THE ITEM PER STAFF RECOMMENDATION WITH THE SPECIAL ORDINANCE PROVISIONS. MOTION MANAGED TO MAN'S IDEA TO APPROVE THE ITEM.
