IF THE FOLLOWING YOUNG PEOPLE ARE PRESENT HERE TONIGHT, IF YOU WOULD PLEASE COME UP FRONT. UH STAND NEXT TO THIS BLACK TABLE AND LINE UP ALONG THIS WALL. YOU'RE ALSO WELCOME TO STOP AT THE PODIUM AND CORRECT ME IF I SHOULD MISPRONOUNCED YOUR NAME. RYAN FONG. AND IN BLACK. ANDREW LEONARD. I DIDN'T MODEL IS SCA'O WELL, BECAUSE HARRIS CORRECT TAIWAN. TYSON. BRODY MCCLURE. EMMA GAUTREAUX, MISSY BROWN ANDERSON. JOLIE DUMPTY. THAT'S EXACTLY RIGHT. COACH THOSE ARE THE THOSE ARE THE YOUNG PEOPLE WHO WERE BEHIND THE SCENE SACRIFICED AND WAS AT EVERY PRACTICE AND MADE SURE YOU AND ALL OF YOUR PLAYERS. HAD EXACTLY WHAT YOU NEEDED WHEN YOU NEEDED IT, AND I DON'T THINK ANYBODY SACRIFICE MORE FOR THIS SEASON. THEN THOSE YOUNG PEOPLE DID. AND I WANTED TO MAKE SURE THAT THEY WERE RECOGNIZED FOR THEIR EFFORTS IN GETTING YOUR TEAM WHERE THEY GOT YOU, TOO. AND SO THANKS TO EACH AND ALL OF THEM, I'M SORRY THAT THEY COULD NOT BE HERE TO BE FORMALLY RECOGNIZED.

BUT I CERTAINLY APPRECIATE THE EFFORT THEY PUT IN TO MAKE YOU GUYS WHAT? WHAT YOU WERE THIS SEASON. THANK YOU, MR VERY GOOD. ALL WE LIVE IN. WE LIVE IN DIFFICULTFF TIMES, RIGHT? VERY CONTENTIOUS TIMES A LOT OF DIVISION BUT EVERY ONCE IN A WHILE SOMETHING COMES ALONG IN A COMMUNITY THAT BRINGS THE COMMUNITY TOGETHER AND GETS EVERYONE TO RALLY TOGETHER AND CHEER TOGETHER, AND THAT'S SOMETHING THAT YOU GUYS DID WITH YOUR SEASON. IT WAS TREMENDOUS TO WATCH. IT WAS SO EXCITING TO SEE ALL THE WHOLE SEASON, OF COURSE, BUT THEN COMING DOWN FRIDAY AND SATURDAY, UM YOU MADE MCKINNEY SO TREMENDOUSLY PROUD AND AGAIN AT AT A TIME. THAT THAT WE ALL SO DESPERATELY NEED A AN OPPORTUNITY TO BE DISTRACTED FROM OTHER THINGS AND COME TOGETHER IN A COMMON PURPOSE AND A COMMON GOAL AND A COMMON DESIRE. AND THAT WAS TO SEE, UH OUR MCKINNEY TEAM DOWN THERE PLAYING THE STATE CHAMPIONSHIP GAME, AND THAT WAS INCREDIBLE. IT WAS AWESOME. AND YOU HAD AN ENTIRE CITY JUST BESIDE THEMSELVES, WATCHING WHAT YOU DID AND WHAT YOU ACCOMPLISHED SO ANYONE ELSE WANT TO ADD TO THAT? I'LL SAY

[00:05:03]

SOMETHING. I GREW UP IN MCKINNEY HERE. I'VE WAS PART OF I DIDN'T WELL, I UHH. AH WENT WENT OR WAS PRACTICE WITH THE TEAM WHO WENT TO ST I GOT BEAT UP WITH HIM ON THE FOOTBALL FIELD THAT THE STATE AND SO THAT WAS KIND OF THE LAST TIME THAT WE REALLY HAD A STATE CHAMPIONSHIP. AS FAR AS YOU KNOW, A MAJOR SPORT HERE AND SO IT WAS. GREAT TO SEE THIS BASKETBALL TEAM. IT WAS FUN TO WATCH WE YOU HAD YOU BROUGHT A LOT OF PEOPLE TOGETHER, AND THAT WAS A GREAT THING TO WATCH. A LOT OF THE OLD GUARD FROM MCKINNEY, OUR CITY SECRETARY. SHE LEFT EARLY ON FRIDAY SO SHE COULD DRIVE DOWN THERE WITH HER KIDS, AND, UH, AND GO TO SAN ANTONIO AND WATCH ALL AND SUPPORT YOU AND MY WIFE OUT. THERE IS ONE OF YOUR BIGGEST SUPPORTERS AND SHE TRIED TO GO TO EVERY GAME POSSIBLE AND BUT IT WAS. IT WAS A GREAT GREAT SEASON AND THE. THE REALLY GOOD PART ABOUT IT IS A BUNCH OF GOOD KIDS. IT'S A BUNCH OF GOOD KIDS , IF YOU IF YOU'VE BEEN, UH, SPEND ANY TIME AROUND THEM IF YOU'VE NO THEM, YOU TALK TO THE COACH. HE JUST HE CAN'T SAY ENOUGH GOOD THINGS. ABOUT THE KIDS ON THIS TEAM, NOT JUST THEIR TALENT, BUT THE CHARACTER THAT THEY THEY HAVE, AND THAT TO ME, IS A GREAT SIGN OF PARENTS WHO WHO TAUGHT THEIR KIDS GOOD THINGS. AND SO WE APPRECIATE YOU BEING PART OF MCKINNEY AND WELL DONE. I WANT TO SAY THAT YOU KNOW, I WENT AND TALKED TO SOME OF Y'ALL EARLIER. ALL THREE OF MY DAUGHTERS WENT TO MCKINNEY HIGH SCHOOL, AND YOU KNOW, THAT'S WHO WE ARE AS A FAMILY AND YOU LIVED THROUGH THIS, WHICH IS A UNIQUE BLESSING FOR YOU, BUT IT'S A BLESSING FOR GUYS LIKE ME AND A LOT OF OTHER PEOPLE IN THE COMMUNITY TO FEEL THE PRIDE AND WATCH YOU GUYS DO WHAT YOU DID. SO THANK YOU. AND I HOPE YOU KNOW, 40 YEARS FROM NOW, WHEN YOU'RE MY AGE, YOU HAVE THAT BLESSING TO SEE PEOPLE DO WHAT YOU DID AND HAVE THAT SENSE OF PRIDE. SO THANK YOU. THE AMOUNT OF TIME COMMITMENT, DEDICATION THE AMOUNT OF WORK THAT IT TAKES TO GET TO THE LEVELS THAT YOU ALL REACHED IS SOMETHING THAT SHOULD BE ADMIRED AND APPRECIATED FROM THIS COMMUNITY. I HOPE YOU'RE VERY PROUD OF YOURSELVES. BECAUSE TO BE ABLE TO ACCOMPLISH WHAT YOU DID THIS SEASON WAS JUST REMARKABLE. AND IT'S SOMETHING THAT YOU SHOULD TAKE PRIDE IN FOR THE REST OF YOUR LIFE. I WOULD LIKE TO RECOGNIZE IF POSSIBLE. IF YOU'RE A PARENT OF ANY OF THESE KIDS SITTING IN THE AUDIENCE, COULD YOU PLEASE STAND AND THEY DECIDED. I HAVE FOLLOWED ALONG WITH A FEW OF YOU. THANK YOU FOR TAKING US ON THE JOURNEY WITH YOU BECAUSE SOME OF YOU BEEN POSTING ON FACEBOOK WHEN WE'RE HERE ON TUESDAY NIGHTS, YOUR PLAN AND UNFORTUNATELY YOU KNOW, WE DON'T GET TO GO TO A LOT OF THE GAMES, BUT I DO APPRECIATE YOU ALL SUPPORTING THESE KIDS, GIVING THEM THE PHYSICAL SUPPORT THE EMOTIONAL SUPPORT THAT THEY NEEDED TO ENDURE THIS SEASON BECAUSE WE KNOW IT WAS VERY TOUGH AT TIMES, SO JUST WANT TO THANK YOU ALL AND THANK YOU FOR ALLOWING US TO SHARE THAT STORY WITH YOU. I WANT TO SAY SOMETHING ABOUT THE MCKINNEY FANS BECAUSE AFTER THE CHAMPIONSHIP GAME WAS OVER, I BELIEVE ABOUT 90% OF THEM REMAINED IN THE GRANDSTANDS. CHEERED FOR DUNCANVILLE AFTER THEY WON THE GAME AND STAYED THERE UNTIL YOU GUYS COULD HAVE YOUR PICTURE MADE WITH ALL THE FANS STANDING BEHIND YOU, AND I THINK THAT SAYS A LOT ABOUT THE FOLKS FROM MCKINNEY. AND THE LOVE THAT THEY HAVE FOR YOU ATHLETES AND I WAS TREMENDOUSLY PROUD OF THE FANS FROM MCKINNEY BECAUSE THEY SUPPORTED YOU AND HONORED YOU UNTIL YOU LEFT THE FLOOR OF THAT ARENA. AND THAT SAYS A LOT ABOUT MCKINNEY AND A LOT ABOUT YOU. THANK YOU VERY MUCH. ALRIGHT. WELL, WE REALLY, REALLY APPRECIATE YOU GUYS BEING HERE. I WANT TO RECOGNIZE OUR FORMER COUNCILMAN FREDERICK FRAZIER, WHO IS HERE WITH US TONIGHT. A BIG BIG FAN OF MCKINNEY. SPORTS MCKINNEY BASKETBALL MCKINNEY LIONS. AND THE COACH AND THE COACH AND COACH. AND SO THANKS FOR BEING HERE, FREDERICK, I PROMISED THE TEAM PICTURES. YOU KNOW WE'RE GOING TO WE'RE GOING TO PICTURES. WE ALSO HAVE SOME CITY PINS AND YOU KNOW THEY THE LAST THING I'LL SAY IT'S BEEN NEARLY 100 YEARS, RIGHT? AND OF COURSE , AS ELECTED OFFICIALS SAY, THAT'S BEEN NEARLY 100. YEARS OF COUNCIL SERVED SENDING US TEAM

[00:10:03]

TO THE STATE. CAN WE TAKE CREDIT FOR THIS? ALL IS THAT I MEAN, NO, NOTHING, I GUESS NOT. BUT WE GOT NOTHING. WE GOT NOTHING. YOU GUYS MADE US SO PROUD AS A WHOLE CITY IF YOU WOULD COME UP THAT GREAT. HANG ON A SECOND. HOLD ON. COACH WATSON, WOULD YOU COME UP AND INTRODUCE THE GUYS SO EVERYBODY KNOWS YOUR NAME IS THERE WALKING FORWARD FOR US? PLEASE. MOMENT AND A MOMENT OF HONESTY, I GUESS PURE VULNERABILITY. I WANT TO APOLOGIZE IT. THAT'S PROBABLY ONE MOST EMBARRASSING THINGS I'VE EVER DONE. MR. ARE BOBBY ASKED FOR OUR LIST AND I HAVE THE SUPPORT. SCREAMING IT OUT. I WANT TO OWN THIS. I HAVE BEEN REALLY BUSY SINCE WE GOT MAGIC TEXTED THESE GUYS BUT DIDN'T TEXT THEY REALLY IMPORTANT PEOPLE ON THE OTHER LIST, AND THAT'S UP. THAT'S ME, DROPPING BUNKERS LIKE YOU, SAID COUNCILMAN PHILLIPS. THAT GROUP DOES A LOT FOR US BEHIND THE SCENES EVERY DAY, AND WE ARE INDEBTED TO THEM. SO I DROPPED THE BALL BIG TIME THERE SO. LET ME INTRODUCE YOU. I WOULDN'T DO IT NUMERICALLY MIGHT BE THE EASIEST WAY TO ZERO BRENNAN. SIMON GO AND BRING THEM BACK UP TO YOUR BRAIN. YEAH. JACKSON STEEL. ARRANGE TOBY CAMPS. OR JACOBY WALTER. LUNCH BUILDING. ALL RIGHT, JUST JUST REAL QUICK. JUST A FEW WORDS ABOUT THESE GUYS, AND I'LL KEEP IT KIND OF SHORT BECAUSE I COULD GO ON FOREVER AND EVER ABOUT THESE GUYS. THEY'VE BEEN VERY SPECIAL TO ME. TO MY COACHES, AND AS I TOLD HIM DURING THE SEASON AS WE GET GOING THROUGH THIS, YOU'RE GOING TO FIND OUT JUST HOW MUCH THIS COMMUNITY WILL GET BEHIND YOU.

MCKINNEY HIGH SCHOOLS, THE ORIGINAL SCHOOL HERE. AND I KNOW HOW MUCH I KNOW HOW IMPORTANT IT IS TO A LOT OF PEOPLE IN MCKINNEY AND SOME PEOPLE THAT AREN'T IN MCKINNEY ANYMORE. UH BUT ONCE WE GOT GOING, I KNEW WE'D HAVE SOME BIG CROWDS AND, UH AND I THOUGHT WE HAD THE BEST CROWD IN SAN ANTONIO BY A LONG SHOT. I'M JUST SO PROUD OF THESE GUYS. I CREATED MOMENTS FOR US FOR OUR FAMILIES. THERE WERE SO MANY THINGS THAT HAPPENED AND THE ONLY REASON IT HAPPENED WAS BECAUSE OF WHAT THESE GUYS DID. I HAD AN 06 GRADUATE FORMER PLAYER TEXTED ME TODAY AND HE WAS TALKING ABOUT HOW AWESOME IT WAS TO SEE SOME PEOPLE HE HADN'T SEEN IN YEARS. AND I CAN SAY THE SAME THING. I HAD SOME HIGH SCHOOL FRIENDS. IT CAME IN THE WEEKEND BEFORE LAST AND I HADN'T SEEN SOME OF THOSE GUYS IN OVER 20 YEARS. THEY BROUGHT A LOT OF PEOPLE TOGETHER AND BROUGHT A LOT OF PRIDE TO THIS AWESOME COMMUNITY. I LOVE THIS PLACE. I'VE TOLD PEOPLE OVER AND OVER IS A GREAT PLACE AND I KNOW IT'S NOT PERFECT. BUT YOU KNOW, I BELIEVE HERE FOR 22 YEARS I MET MY WIFE HERE. MY KIDS GO TO SCHOOL HERE AND THIS IS SPECIAL. WE WANTED TO BRING THE WHOLE THING HOME TO MCKINNEY. UH BUT I'M REALLY, REALLY PROUD OF THE EFFORT OF THESE YOUNG MEN THAT THEY WILL I WILL FOREVER BE INDEBTED TO THEM. THIS IS THE GREATEST BASKETBALL TEAM THIS CITY HAS EVER SEEN ANYONE.

THANK YOU GUYS GRATEFUL THAT YOU ALL MADE IT. SINCE WE HAVE RETURNED. GIVE THEM A SECOND.

FIRST THING THEY DON'T HAVE THAT. DIDN'T THERE LAST WEEK. ALL RIGHT. NEXT ITEM IS PUBLIC

[Consider/Discuss/Act on Adoption of a Resolution Determining a Public Necessity to Acquire Certain Property for Public Use by Eminent Domain for Right-of-Way (in Fee Simple Associated with the Green & Andrews Infrastructure Improvements Project which Property is Located at the Intersection of Green and Murray Streets Commonly Known as 208 South Murray Street and Authorizing the City Manager to Establish Procedures for Acquiring the Right-of-Way (in Fee Simple) on Said Property, and Take All Steps Necessary to Acquire the Needed Property Rights in Compliance with all Applicable Laws and Resolutions]

ITEMS REQUIRING INDIVIDUAL CONSIDERATION BY THE COUNCIL AND 2 TO 0 TO 43 CONSIDER DISCUSS ACT ON ADOPTION OF A RESOLUTION DETERMINING PUBLIC NECESSITY TO ACQUIRE CERTAIN PROPERTY FOR PUBLIC USE BY EMINENT DOMAIN FOR RIGHT OF WAY AND FEES SIMPLE ASSOCIATED WITH THE GREEN AND ANDREW'S INFRASTRUCTURE IMPROVEMENTS PROJECT. WHICH PROPERTY IS LOCATED. THE INTERSECTION OF GREEN AND MURRAY STREETS COMMONLY KNOWN AS TWO OH, EIGHT SOUTH MURRAY STREET AND AUTHORIZING THE CITY MANAGER TO ESTABLISH PROCEDURES FOR ACQUIRING THE RIGHT AWAY IN FEES. SIMPLE ON SAID PROPERTY AND TAKE ALL STEPS NECESSARY TO ACQUIRE THE NEEDED PROPERTY RIGHTS AND THE COMPLIANCE WITH ALL APPLICABLE LAWS AND RESOLUTIONS. GOOD EVENING MAYOR CITY COUNCIL. GARY GRAHAM, DIRECTOR OF ENGINEERING, SO WE'RE HERE TO ASK FOR YOUR HELP IN ACQUIRING THE LAST PIECE OF, UH, RIGHT AWAY THAT WE NEED FOR THE GREEN AND ANDREW'S PROJECT.

THIS IS AN INFRASTRUCTURE IMPROVEMENT PROJECT THAT WE HAVE PACKAGED TOGETHER WITH THE IMPROVEMENTS ALSO ALONG THE LOUISIANA STREET. WE DID THIS PROJECT AND HAVE GONE TO CONSTRUCTION PERSON IN THE PROCESS OF GOING TO THE STRUCTURE. WE'VE ISSUED THE NOTICE PROCEEDING, THE CONTRACTORS MOBILIZING. THIS LAST LITTLE PIECE OF RIGHT AWAY IS SHOWN ON THE BODY STANFIELD TRUST TRACK AS A 72 FT SQUARE. 72 SQUARE FOOT PIECE OF PROPERTY. SO JUST BASICALLY CORNER CLIP. WE HAVE REACHED OUT TO THIS STANFIELD NUMEROUS TIMES WRITTEN PERSONAL LETTERS. MR GRIMES IS ACTUALLY EVEN WRITTEN A HANDOUT TO HER. WE'VE CALLED HER LOCAL TIMES, AND WE CANNOT GET HER TO RESPOND. TO CITY REQUEST SHE ACTUALLY DID, EXCEPT IN OUR FIRST OFFER, AND THEN FOR WHATEVER REASON HAS JUST NOT RESPONDING TO ANYTHING ELSE THAT WE HAVE DONE. WITH HER TO TRY TO NEGOTIATE AND GET THIS LITTLE PIECE OF ACTION TAKEN CARE OF IT. THIS IS GOING TO BE MUCH MORE EXPENSIVE TO GO. THIS PROCESS. UM THEN WOULD BE JUST NEGOTIATING WITH HER, BUT WE CAN'T GET HER TO WORK WITH. THIS LITTLE PIECE OF RIGHT AWAY IS NEEDED TO MAKE SURE WE HAVE 80 EIGHT'S ACCESS ACROSS MURRAY STREET AS IT CROSSES GREEN, SO THIS PUTS THE STANDARD 25 FT CURB RADIUS ON THE PROJECT AND, UM, WITH THE SIDEWALK RAN FOR 80 ACCESS SO WE FELT LIKE WE'VE DONE EVERYTHING WE CAN COME INTO YOU AS A LAST RESORT ON THIS PARTICULAR PROJECT. WE HAVE COMMISSIONED AN APPRAISAL AS SOON AS WE GET THAT WILL MAKE THE OFFICIAL INITIAL OFFER. THEY WILL MAKE THE SECONDARY OFFER FINAL OFFER WHEN IF WE'D GET NO GETTING RESPONSE AND THEN STILL DON'T GET YOUR RESPONSIBLE THEN WE WOULD ISSUE AND THE COMBINATION THROUGHOUT SO WITH THAT WE'RE ASKING FOR YOUR SUPPORT ON THIS ITEM. THIS IS A

[00:25:04]

SPECIAL RESOLUTION THAT WE NEED YOU TO READ, AND THERE WILL BE A ROLL CALL VOTE. AND HAPPY ANSWERING QUESTIONS THAT IS LESS THAN 75 SQUARE FEET OF PROPERTY , CORRECT? YES, SIR. JUST SAY TINY LITTLE SLIVER TO MAKE THE CURVE IN THOSE CHAIRS. EXACTLY. SO WE MADE A GENEROUS OFFER. WHO ARE, YOU KNOW, PROBABLY END UP RECEIVING LESS THROUGH THE MINUTE DOMAIN PROCESS. THEN SHE WOULD HAVE WHAT WE'VE OFFERED. SO YEAH. AND ALL JUST GIVING ABBREVIATED VERSION NOT TO REPEAT MYSELF, BUT NOW THE GOVERNMENT IS NOT TAKING ANY PROPERTY FROM ANYBODY. WE HAVE TO PUT THE MONEY UP FROM THE APPRAISAL. WHAT WE BELIEVE THE FAIR MARKET VALUE TO BE, AND ULTIMATELY THEY WILL RECEIVE. AH FAIR MARKET VALUE FOR THAT PROPERTY, AND SO WE'RE ACTUALLY PURCHASING IT, BUT WE'RE URGING THEM TO SELL TO US BY USING EMINENT DOMAIN AND THAT WILL BE OUR LAST OPTION IF WE CAN'T GET THEIR ATTENTION TO BUY IT FROM THEM OUTRIGHT. SO THERE'S NOTHING ELSE, MR MAYOR. LISTEN. MOVE THAT CITY OF MCKINNEY, TEXAS. SORRY I HAVE A QUESTION.

IS THAT OKAY? YES WELL, UM IT'S HIS MEETING. THIS IS ME. HE'S OKAY. OKAY UM, I DROVE BY THE PROPERTY. IT'S YOU KNOW, GOT A LOT OF ISSUES WITH IT. THE DETACHMENT THAT I HAVE IS THAT I LIVE IN A HOME THAT WAS BUILT IN 1994 IN WEST MCKINNEY. THIS IS WHAT I CONSIDER TO BE THE CITY EASEMENT THAT WE'RE DEALING WITH. BUT YET WE'RE DEALING WITH THIS WOULD SEEM TO ME THE CITY WOULDN'T NEED PERMISSION TO COME AND DEAL WITH THE CORNER OF THE PROPERTY. I'M PRETTY SURE IN MY NEIGHBORHOOD THAT THE CITY WOULD NOT REQUIRE ANY PERMISSION. CAN YOU COMMENT ON THAT? PLEASE? SO IN THE NEWER NEIGHBORHOODS. WE HAVEN'T MUCH MORE GENEROUS RIGHT AWAY THAT WAS ESTABLISHED WHEN THOSE HOUSES WERE PLANTED AND CONSTRUCTED. IN THE OLDER PART OF THE NEIGHBORHOOD. WE HAVE VERY NARROW RIDE A WAYS THAT IS ESTABLISHED, AND SO THIS IS PROBABLY LESS THAN 40 FT WIDE, MAYBE 35. I DON'T KNOW THE EXACT DIMENSIONS. I'VE TALKED MY HEAD, BUT IT'S A VERY NARROW RIGHT AWAY. AND SO WE HAVE GONE OUT PHYSICALLY SURVEYED IT TO MATTER TO MAKE SURE WE HAVE OUR WORKING WITHIN THE PROPERTY THAT WE HAVE ACCESS TO WORK IN IN THIS WAY IS OUTSIDE OF THAT. THAT PROPERTY AND SO WE HAVE TO ACQUIRE LEGALLY. OKAY SO THEORETICALLY IF THIS WERE IN MY NEIGHBORHOOD NEIGHBORHOOD WAS BUILT 30 YEARS AGO, AND YOU NEEDED 88 REQUIRED SIDEWALKS. IN MY HOUSE WAS ON THE CORNER. YOU WOULDN'T HAVE TO COME TO ME. IS THAT FAIR? THAT'S FAIR WE BUILT IN THE NECESSARY RIDE AWAY TO ACQUIRE RIGHT IN OUR RIGHT AWAY. YES SO, UH AND I AND I GUESS I DID GO BY THE PROPERTY. I CAN RECOGNIZE EVERYTHING IS AWFULLY NARROW THERE. I THINK SOME EMERGENCY VEHICLES WOULD HAVE A VERY DIFFICULT TIME THERE. UM GETTING ACCESS. AND IF THIS COUNCIL FAILS TO ACT, THEN IT SEEMS TO ME THAT YOU KNOW THAT. THEORETICALLY AN EMERGENCY VEHICLE COULD NEED ACCESS AND JUST SIMPLY NOT HAVE IT BECAUSE WE DON'T. IT'S JUST NOT WIDE ENOUGH. THERE'S NO CURBS. IT'S KIND OF A MESS. THERE WERE TRYING TO IMPROVE IT AS BEST WE CAN LOOK THAT LIMITED RIGHT AWAY. YES, OKAY. AND IT WAS DIFFICULT FOR ME TO ASCERTAIN.

AND I KNOW THIS ISN'T GERMANE TO THE THING 100% BUSINESS DIFFICULT FOR ME TO SEE HOW WE COULD MAKE IT ANY WORSE THAN IT IS, AT LEAST WITH RESPECT HAD DETERIORATED. THAT CORNER IS THE LEVEL OF MUD THERE AND THE MOSQUITO FARM. THAT'S PROBABLY THERE, YOU KNOW A FEW MONTHS OUT OF THE YEAR, SO I DON'T WANT TO CAUSE A BURDEN TO ANY PROPERTY OWNER. THAT'S UNDUE. I DON'T SEE THAT. THAT'S THE CASE HERE. AND I ALSO SEE THAT IN MANY NEIGHBORHOODS IN MCKINNEY, THIS WOULDN'T EVEN HAVE TO COME UP BECAUSE OF THESE EVENTS THAT WE HAVE. THANK YOU. ANY OTHER QUESTIONS. OCEAN. A MOVE THAT SYRIA MCKINNEY TEXAS CITY COUNCIL APPROVED THIS ITEM HAS WRITTEN AND ADOPT THE RESOLUTION DESCRIBED IN THIS AGENDA ITEM AND AUTHORIZE USE OF THE POWER OF EMINENT DOMAIN TO ACQUIRE FOR PUBLIC USE. ON NECESSARY RIGHT AWAY IN FEES SIMPLE FROM THE OWNERS OF THE PROPERTY DEPICTED ON DESCRIBED BY MEATS AND BALANCE ATTACHED, SAID RESOLUTION SAID DEPICTIONS AND DESCRIPTIONS BEING INCORPORATED IN THEIR ENTIRETY INTO THIS MOTION FOR ALL PURPOSES, INCLUDING THE CONSTRUCTION, ACCESS AND MAINTENANCE OF INFRASTRUCTURE IMPROVEMENTS. AT THE INTERSECTION OF GREEN AND MURRAY STREET ASSOCIATED WITH THE GREEN AND ANDREW'S INFRASTRUCTURE IMPROVEMENT PROJECT. I'LL SECOND CAST YOUR VOTES. ROLL CALL. I'M SORRY. THAT'S RIGHT. APOLOGIZE. COUNTS. HI. YES. YES. YES. YES. YES.

[Conduct a Public Hearing to Consider/Discuss/Act on a Right-of-Way Abandonment of a Portion of an Unnamed Alley located east of Sherman Street and west of Coleman Street, approximately 150 feet south of Berry Avenue, being part of the Millie Muse Addition, and Accompanying Ordinance (22-0001RW)]

THANK YOU. THE NEXT ITEM. 220001 RW CONDUCTED PUBLIC HEARING TO CONSIDER AND ACT ON A RIGHT AWAY ABANDONMENT PROPORTION OF AN UNNAMED ALI LOCATED EAST OF SHERMAN STREET AND WEST OF COLEMAN STREET, APPROXIMATELY 150 FT. SOUTH OF BARI AVENUE. BEING PART OF THE MILLIE MUSE

[00:30:01]

EDITION AND ACCOMPANYING ORDINANCE. GREAT PETE MAYOR AND COUNCIL. THIS IS A RIGHT AWAY, ABANDONED HER QUEST FOR A APPROXIMATELY 10 FT BY 280 FT ALLEY. LOCATED JUST SOUTH 3 80 BETWEEN SHERMAN AND COLEMAN STREETS. UM, WITH THIS RIGHT OF WAY ABANDONMENT, THE CITY WILL BE RETAINING A DRAINAGE EASEMENT OVER THE PROPERTY TO ACCOUNT FOR SOME SURFACE DRAINAGE THROUGH THE ALLEY. AS OF THIS TIME, WE HAVE NOT RECEIVED ANY COMMENTS FOR OREGON'S THIS RIGHT AWAY ABANDONMENT. I'M HAPPY TO ANSWER ANY QUESTIONS YOU MAY HAVE. HAVE A QUESTION A COUPLE AND SO. WE WERE JUST ABANDONED. DO THE ARE THE PROPERTY OWNERS BEHIND THAT? IT WOULD THAT BE INCLUDED IN THEIR PROPERTY OR IS THAT JUST THEY CAN USE IT. AND SO WE WILL . ONCE THE ABANDONMENT HAS ACTED ON TONIGHT, WE WILL REACH BACK OUT TO ALL THE PROPERTY OWNERS. THERE IS A PROCESS BY WHICH THEY CAN. THEY WILL EXECUTE A, UM UM PROCESS BY WHICH THEY WILL EXECUTE A DEED WITH THE CITY TO FORMALLY TAKE OKAY? SO HOW DO WE EVER THINK ABOUT SELLINGOPERTY T GIVEN IT TO HIM? ON THE ON THESE ALLEYS ON THE EAST SIDE OF TOWN. I DON'T BELIEVE AS LONG AS I'VE BEEN INVOLVED IN THE PROCESS OF SELLING. IT HAS EVER BEEN, UM, SOMETHING WE'VE THOUGHT ABOUT. THAT'S ALL I HAD. WHAT'S THE IMPETUS FOR THIS? I MEAN, WHO WANTS THIS TO HAPPEN? WHO CAME TO US TO ASK FOR THIS ABANDONMENT? SO IN THIS SPECIFIC CASE, THE PROPERTY LARGE PROPERTY ON THE NORTH SIDE OF THE ROADWAY THAT IS OWNED BY BURNSIDE, HEATING AND AIR CONDITIONING. THEY ARE LOOKING TO BUILD A NEW FACILITY THERE AND IN ORDER TO HELP THEM MEET SOME OF THEIR REQUIREMENTS FOR SETBACKS AND LANDSCAPE BUFFERS. THEY WERE LOOKING TO GET THAT COUPLE FEET OF EXTRA PROPERTY TO HELP MAKE EVERYTHING WORK. DOES THAT MEET WITH THE EXISTING ZONING REQUIREMENTS? WHAT THEY'RE DOING? IS THAT NOT IF THEY GET THE ABANDONED PROPERTY , I BELIEVE IT WILL MEET ALL OF OUR ORDINANCES. OKAY? IN SO IF IT'S A 10 FT WIDE ALLEY, MY GUESS IS THEY GET FIVE FT. OF IT AND THE PEOPLE TO THE SOUTH. GET FIVE FT OF IT AS LONG AS LONG AS THAT THING GOES AND OKAY, THANK YOU. IF THIS PROPERTY DID HAVE A RECENT REASON I BELIEVE THAT CAME BEFORE THE COUNCIL, PROBABLY ABOUT THREE MONTHS AGO, THREE OR FOUR MONTHS. MAYBE OUR PLANNING FOLKS KNOW SHE'S SHAKING HER HEAD. YES, YES, YES. SORRY THAT'S THE PRIOR ADMINISTRATION TO MIND. YOU HAD SOMETHING. ADDRESS THE QUESTION ABOUT WHY WE DON'T SELL THESE CALI IS DEDICATED. IT'S AN EASEMENT. WE DON'T HAVE CLEAR TITLE AND SO WE HAVEN'T RIGHTS TO USE TO THE PUBLIC. THE PUBLIC CAN USE AS WELL. BUT ONCE IT'S ABANDONED UM, WHAT'S ESSENTIALLY INDEED, WITHOUT WARRANTY TO THE REPUBLIC CLAIM DEED TO THE LAND OWNERS, WHICH IS WHY WE DON'T SELL BECAUSE I DON'T REALLY HAVE A GOOD TITLE. OKAY. OKAY. INTERESTING. THANK YOU. WELL THAT'S WHAT I THOUGHT. I THOUGHT, ESPECIALLY FOR COMMERCIAL GUN PERSON WANTED IT . THEY COULD BUY IT ALL AND WE COULD MAKE A LITTLE MONEY VERSUS JUST GIVEN IT UP. BUT THAT ANSWERS THAT QUESTION. BY ROAD, RIGHT IN PLACE, WHICH WE WOULD GO THROUGH THAT PROCESS OF SELLING IF WE HAD ACTUALLY HAD PAID FOR TITLES. TO A PARTICULAR ROAD. TYPICALLY NOT WHAT WE DO, OKAY? GOOD ENOUGH. ANY OTHER QUESTIONS. THIS IS A PUBLIC HEARING. IS THERE ANYONE HERE THAT LIKE TO SPEAK TO THE ATOM? I'M SEEING THAT CLOSED PUBLIC HEARING AND APPROVE THIS ITEM SECOND. CAST YOUR VOTES.

[Conduct on a Public Hearing to Consider/Discuss/Act a Specific Use Permit Request to Allow for an Indoor Gun Range, Located at 2100 North McDonald Street (REQUEST TO BE WITHDRAWN)]

EXCITED TO 10017 TO CONDUCT A PUBLIC HEARING TO CONSIDER AN ACT ON SPECIFIC USE PERMIT REQUEST TO ALLOW FOR AN INDOOR GUN RANGE LOCATED 21 NORTH MCDONALD STREET. THIS HAS BEEN WITHDRAWN. HOWEVER, IT IS WAS NOTICED AS A PUBLIC HEARING. SO IF THERE'S ANYONE THAT DID MAKE A TRIP AND WANT TO COME DOWN AND SPEAK TO IT, YOU'RE WELCOME TO DO SO. I JUST ANYTHING YOU WOULD LIKE TO SAY, BUT I JUST KNOW THEY WITHDRAWN. THERE'S THEY'RE GOING TO DIFFERENT DIRECTION.

THAT'S CORRECT RECIPE APPLICATION. AND SEEING NOBODY HERE TO SPEAK TO THE ITEM. I GUESS IT'S BEEN REQUESTED TO BE TABLED RISK CLOSE THE PUBLIC HEARING. MARK AND MOVE ON THE ITEM TABLE THEN. WELL, ACTUALLY DID NOT TABLE RIGHT THERE, WITHDRAWN IT. SO HE'S PROBABLY STILL OKAY? MOTION. TO THAT WE CLOSE A COUPLE HEARING AND TABLE INDEFINITELY. WHILE CIRCUIT CAST YOUR VOTES. ITEM 2 TO 0 TO 44 CONSIDER AND ACT ON AMENDMENT TO CHAPTER 98 TAXATION IN THE CITY

[Consider/Discuss/Act on an Amendment to Chapter 98 (Taxation) of the City of McKinney, Texas, Code of Ordinances Modifying the Program Requirements and Annual Aggregate Cap for the Historic Neighborhood Improvement Zone Incentive Program and Relocating the Program Requirements for the Neighborhood Empowerment Zone; and Accompanying Ordinance]

OF MCKINNEY, TEXAS, CODE OF ORDINANCES MODIFYING THE PROGRAM REQUIREMENTS. AND ANNUAL AGGREGATE CAP FOR THE HISTORIC NEIGHBORHOOD IMPROVEMENT ZONE INCENTIVE PROGRAM AND RELOCATING THE PROGRAM REQUIREMENTS FOR THE NEIGHBORHOOD EMPOWERMENT ZONE. AND ACCOMPANYING ORDINANCE. GOOD

[00:35:06]

EVENING MAYOR COUNCIL MEMBERS AND CITY MANAGER GRIMES POLLEN ASTA PLANNING MANAGER PLANNING DEPARTMENT. TONIGHT WE ARE HERE KIND OF BRINGING THE CULMINATION OF MANY PREVIOUS MEETINGS THAT WE'VE HAD BOTH WITH COUNCIL HERE AND HP, ABE. TO BRING SOME AMENDMENTS TO THE HISTORIC NEIGHBORHOOD IMPROVEMENT ZONE PROGRAM. THAT CURRENT PROGRAM IS KIND OF SUMMARIZED UP HERE ON THIS SLIDE, BUT ESSENTIALLY, WE'VE HAD THREE LEVELS THREE PROGRAM LEVELS FOR YEARS. UM IT'S THE OTHER LEVELS. EXCUSE ME. LEVEL ONE HAS A SEVEN YEAR DURATION IS 100% EXEMPTION ON HOUSES THAT HAVE A MARKER. ASSOCIATED WITH THOSE LEVEL TWO AND LEVEL THREES RECEIVE A SMALLER INVESTMENT AND HAVE A 15 YEAR DURATION INTO THE CURRENT SYSTEM AND GO TO BUILDINGS AND STANDARDS FOR REVIEW. WE ARE MAKING CHANGE, PROPOSING CHANGES TO THAT WITH THESE AMENDMENTS THAT YOU HAVEN'T THE AMENDMENT HAVE IN FRONT OF YOU THE WE'LL STILL HAVE THREE LEVELS WILL HAVE THE MARKER INCENTIVE LEVEL, WHICH IS SIMILAR TO WHAT WE HAD FOR LEVEL ONE BEFORE. IT WILL REQUIRE A HISTORIC MARKER JUST LIKE THE EXISTING LEVEL ONE AND A MINIMUM INVESTMENT OF $10,000 . THAT'S A CHANGE. IT WILL STILL NEED TO BE A 50 YEAR OLD BUILDING WORK. TOWARDS THE INVESTMENT WILL HAVE TO BE DONE WITHIN THREE YEARS. IT WILL STILL BE 100% 1 TIME ONLY DID EXEMPTION IN THIS CASE OF THE LAST FOR 10 YEARS. AND IT WILL STILL BE APPROVED BY THE HISTORIC PRESERVATION ADVISORY BOARD. THE OTHER TWO ARE. THERE ARE A FEW MORE CHANGES INVOLVED WITH THOSE THE REHABILITATION INCENTIVE WILL STILL REQUIRE ELIGIBLE WORK. THIS IS KIND OF COMPATIBLE WITH WHAT WE HAD FOR LEVEL TWO. WE'VE INTRODUCED AN AGE MINIMUM OF 40 YEARS SO THAT WE HAVE PROPERTIES THAT ARE OLDER PROPERTIES, BUT NOT QUITE AT THAT 50 YEAR LEVEL $10,000 INVESTMENT THAT'S MAINTAINING THE SAME LEVEL OF INVESTMENT WE HAD BEFORE. STILL A 50% EXEMPTION, TAKING IT DOWN TO A 10 YEAR DURATION AND GIVING THE APPROVAL TO THE HISTORIC PRESERVATION ADVISORY BOARD. AND THEN THE NEW LEVEL THREE IS THE PRESERVATION INCENTIVE AGAIN.

ELIGIBLE WORK. 40 YEARS OLD, A SMALLER INVESTMENT HERE ONLY $5000. COMPLETED WITHIN 12 YEARS AND 30. EXEMPTION. BOTH THE TWO AND THE REHABILITATION IN THE PRESERVATION INCENTIVE ARE BOTH REPEATABLE. SO ONCE YOU'VE, YOU KNOW, KIND OF USED UP ONE YEAR 10 YEARS HAS PASSED, WE COULD COME BACK AND GET A SECOND ONE. THEY BOTH LAST 10 YEARS. THE OTHER CHANGE THAT WE'RE ASKING FOR IN. THIS IS THE CHANGE THE INCREASE TO THE AGGREGATE CAP FROM THE EXISTING 250,000 THAT WERE AT 2 500,000. IT'S BEEN INCREASED EVERY THREE OR FOUR YEARS SINCE THE PROGRAM STARTED BACK IN 2000 AND EIGHT AND SO WE THINK 500,000 WILL GET US THROUGH THE NEXT 3 TO 5 YEARS.

WE HOPE ALL DEPENDING ON HOW PROPERTY VALUES INCREASE. SOME OTHER CHANGES. WE, UM HAVE MOVED THE REVIEWS AND APPROVALS ALL TO THE HPV, SO THEY'RE ALL UNDER ONE BOARD WITH THIS. IF YOU GET A NEW INCENTIVE, IT WILL REPLACE WHATEVER INCENTIVE YOU HAD BEFORE, RATHER THAN HAVING KIND OF CONFLICTING DATES WHEN NEW ONES COME ABOUT. WE'VE ALSO ADDED A CLAUSE THAT IF THE PROPERTY IS PARTIALLY OR TOTALLY DESTROYED, THE STRUCTURES WOULD LOSE THEIR EXEMPTION. ONE PERSON COMMENTS THAT WERE MADE AT COUNCIL BEFORE WE HAVE ALSO EXPANDED THE ELIGIBILITY REQUIREMENTS SO THAT THEY PROPERTY HAS TO BE OWNER OCCUPIED. UM AND THEN WE HAVE CHANGED THE DURATION TO 10 YEARS AND KIND OF IMPROVED WITH THE ELIGIBLE, UH, IMPROVEMENTS ARE TO BE A LITTLE BIT CLEARER ON THE MAINTENANCE AND UPKEEP THAT YOU CAN DO AN ASSOCIATE. WITH THIS CHANGE. TALKING ABOUT THE PROGRAM ELIGIBILITY I MENTIONED THE OWNER OCCUPIED WILL ALSO BE REQUIRING THE VERIFIED ELIGIBLE IMPROVEMENTS FOR ALL THREE. IN THE PAST, THERE WAS A LITTLE BIT LESS OF A VERIFICATION INVOLVED WITH THE LEVEL ONES. WE ARE ALSO GOING TO BE REQUIRING THAT THE PROPERTY HAS ALL OF ITS PERMITS AND APPROVALS AND APPROVED CERTIFICATES OF APPROPRIATENESS IN PLACE FOR ANY CHANGES THAT HAVE BEEN MADE TO THE PROPERTY THAT IT'S MAINTAINING GOOD CONDITION. IT HAS NO PENDING CODE VIOLATIONS. AND IT HAS PAID ALL OF ITS CITY ADVIL, OR, UM, TAXES UP TO THE DATE OF THE APPLICATION. SO. THAT'S KIND OF A SUMMARY OF THE CHANGES IF YOU WANTED TO SEE WHAT THE ELIGIBLE IMPROVEMENTS WOULD BE. THIS IS KIND OF OUR THIS IS OUR LIST OF WHAT THEY WOULD INCLUDE. YOU CAN SEE THERE'S EXTERIOR IMPROVEMENTS. THAT COULD BE APPLIED AS WELL AS INTERIOR IMPROVEMENTS. THERE ARE THESE ARE A LOT OF OLDER HOMES BETWEEN 40 AND 50 YEARS OLD, SO THERE'S OFTEN INTERIOR IMPROVEMENTS THAT HAVE TO BE DONE AS WELL LIKE SANITARY SYSTEMS. HEATING AND VENTILATION. FIRE PROTECTION THOSE KIND OF THINGS SO THOSE WOULD ALL BE INCLUDED IN THIS AS WELL. UM AND THEN THIS IS JUST A KIND OF AN OVERVIEW. WE HOPE TO

[00:40:09]

BE ABLE TO OPEN APPLICATIONS ONCE THIS IS DONE USING YOU SEE THAT SAYS, FEBRUARY WE WERE GOING TO BRING THIS TO YOU BACK IN FEBRUARY, BUT THEN WE HAD A SNOW DAY. ITSELF WE PUT IT OFF TILL MARCH SO WE CAN GO TO THE HBP BOARD. WE DID TAKE IT TO THE HPV BOARD EARLIER THIS MONTH, AND THEY WERE IN FAVOR OF THE CHANGES. AND SO WE ARE. HERE TODAY TO PRESENT IT TO YOU AND I STAND FOR ANY QUESTIONS. QUESTIONS. OVERALL IT'S JUST THE PROGRAM IS DESIGNED, ENHANCE AND IMPROVE THE HISTORIC DISTRICT AS WELL AS MAINTAIN THE INTEGRITY OF THE HISTORIC DISTRICT, AND IT GIVES THE OWNERS A LITTLE INCENTIVE TO DO SO. ABSOLUTELY ALL GOOD FOR MCKINNEY. THANK YOU. THANK YOU. THE QUESTIONS WE'VE YOU'VE. BEEN HERE SEVERAL TIMES ON THIS ISSUE, SO I THINK EVERYONE IS VERY, VERY WELL FIRST. YES. THERE BE ANY QUESTIONS SO THANK YOU SO MUCH.

IS THERE A MOTION? MAKE A MOTION THAT WE APPROVED THIS ITEM, I'LL SECOND THIS CAST YOUR VOTES.

[Consider/Discuss/Act on Appointing a Member to the Parks, Recreation & Open Space (PROS) Advisory Board]

ASYLUM 2 TO 0 TO 45 CONSIDERED ACT ON APPOINTING MEMBERS TO THE PARK RECREATION AND OPEN SPACE ADVISORY BOARD. I KNOW THAT. CURRENTLY WE'VE GOT THE ALTERNATE ON THAT BOARD. IS.

GULLIVER WHEN YOU GALLAGHER, UH AND THEN THE. AT HAWK WOULD BE BRUCE MEET, CORRECT. WE DO HAVE A SECOND ALTERNATE, MR MAYOR, BUT MISS GALLAGHER IS THE SENIOR OF THOSE TWO ALTERNATES. THAT'S RIGHT. THANK YOU FOR PUTTING THAT UP THERE. WHY IS THAT? I BELIEVE THERE'S AN APPETITE TO MOVE WINDY UP TO A REGULAR MEMBER. HONOREE WOULD STAY AS A SENIOR NOW ALTERNATE AND WE'VE MOVED BRUCE UP TO AN ALTERNATE AS WELL. UHH YES, SIR. I DO LIAISON, THE PARKS BOARD AND I THINK GIVES ME ANY MORE VOTES THAN ANYBODY ELSE. I CERTAINLY APPRECIATE THAT. BUT I THINK MISS GALLAGHER WOULD BE A GREAT ADDITION TO THAT. AND YOU KNOW, WE AREN'T I KNOW THEY HAD HAWKING WAS DONE BEFORE I CAME ON. BUT I THINK REMOVING THAT MAKING BRUCE THE SECOND ALTERNATE WOULD BE GOOD MOVE. EVERYONE IN AGREEMENT WITH THAT. ABOUT THAT, IN THE FORM OF EMOTION. SO MOVED. OR I WILL MOVE THAT WE APPOINT WINDY GALLAGHER TO BE A REGULAR MEMBER OF THE ARTS BOARD AND MOVE BRUCE MEET UP TO BE AN ALTERNATE. ON SECOND. MM HMM. GUEST ROWBOATS.

[CITIZEN COMMENTS ON MATTERS NOT ON THE AGENDA]

CITIZEN COMMENTS ON MATTERS NOT ON THE AGENDA. I HAVE SEVERAL SPEAKERS. BILL DANIEL. MAYOR AND COUNCIL MEMBERS, AND I SEE YOU AGAIN. MY NAME IS BILL DANIEL. I ADDRESSES 410 FANNIN ROAD.

MELISSA, TEXAS. I'M HERE TO PROVIDE AN UPDATE REGARDING MINE . ANOTHER PROPERTY OWNERS, OPPOSITION TO ZONING CASE 21-0038 Z. I DON'T 45 ACRES ALONG THE FULL FRONTAGE OF FAMINE ROAD ON THE EAST SIDE OF SHANNON. AND TO THE SOUTH ALONG 278 THAT BUTTS UP TO THE WILLOW WITH DEVELOPMENT. I WANT TO REITERATE THAT NEITHER I NOR YOU KNOW THE PROPERTY OWNERS WITHIN THE 200 FT BOUNDARY. ADJACENT TO THIS PARTICULAR PROPERTY. FOR OPPOSED TO EITHER ANNEXATION OR DEVELOPMENT OF THE PROPERTY. THAT'S NOT A PROBLEM FOR US. THE SINGULAR ISLAND, WHICH WE ARE OPPOSED AS THE MULTI FAMILY COMPONENT. ON ANOTHER POINT OF THE PROPERTY IS NOT X. WE UNDERSTAND THAT ANY DEVELOPMENT THE OWNERS CHOOSE TO PURSUE. WILL BE WITHIN THE CODE REQUIRED BY THE COUNTY AS OPPOSED TO THE CITY. WE DO UNDERSTAND THAT DISTINCTION. THE POINT OF OUR COLLECTIVE FEELINGS IS FINDING CHARACTERISTICS OF THE AREA SIMPLY DO NOT ALIGN WITH A MULTI FAMILY URBAN NEIGHBORHOOD, WHICH HAS A COMPLETE LACK OF INFRASTRUCTURE. TO SUPPORT SUCH A DEVELOPMENT. SINCE THE LAST COUNCIL MEETING, AT WHICH A NUMBER OF RESIDENTS SPOKE TO THE OPPOSITION. MOST OF THE 200 FT. PROPERTY OWNERS HAVE BEEN DEVELOPING OUR COLLECTIVE SUGGESTIONS FROM PRESENTATIONS TO THE DEVELOPERS. THAT WOULD BE WORKABLE AND ACCEPTABLE TO EVERYONE IN THE 200 FT. GREAT WE HAVE REACHED OUT TO THE DEVELOPERS AND AN ATTEMPT TERRIFIED AND ACCEPTABLE MIDDLE GROUND, BUT TO THIS POINT HAVE NOT RECEIVED A RESPONSE FOR A REQUEST TO MEET WITH THEM. IN THE EVENT ANY OF YOU ARE INTERESTED. WE WOULD BE HAPPY TO

[00:45:06]

SHARE OUR THOUGHTS AND DOCUMENTS FOR YOUR REVIEW. WE HAVE PROVIDED THE COUNCILMAN. THE COLOR COPY OF THAT FOR HIS INFORMATION. WE'VE ALSO SPOKEN WITH DEVELOPERS THAT ARE ASSOCIATED WITH THE WILLOW WOOD DEVELOPMENT WHO INDICATED THAT THEY HAD AN INTEREST IN THAT PROPERTY. I KNOW THEY WE'VE HEARD THAT THEY APPROACHED THE DEVELOPERS. TRYING TO EXTEND AN OFFER, BUT THE DEVELOPERS DECLINED SAID THEY WERE GOING TO DEVELOP IT THEMSELVES. MM HMM.

AS A MATTER OF INFORMATION. I HAVE BEEN IN CONTACT WITH MICHAEL QUINN REGARDING LONGER TERM OPTIONS FOR MY 45 ACRES. MM AND THANKS TO COUNSELING BOWLER HE REFERRED TO HIM. AND I'D LIKE TO PUBLICLY THINKING COMMEND HIM FOR HIS INFORMATIVE, HELPFUL AND CANDID INPUT TO MY DUE DILIGENCE PROCESS REGARDING MY 45 ACRES. UM AND THANK YOU FOR RESPONDING TO MY REQUEST AS WELL. NOW THE KEY POINTS I'D LIKE TO LEAVE WITH YOUR ONE. WE ARE NOT OPPOSED TO THE ANNEXATION OR DEVELOPMENT OF THIS OR ANY PROPERTY WITHIN THE MCKINNEY, TJ. SECONDLY WE ARE, HOWEVER, OPPOSED TO THE MULTI FAMILIES OWNING AS PROPOSED ON THIS PROPERTY. WE THINK THERE ARE VIABLE OPTIONS, WHICH WE'RE TRYING TO WORK WITH THE DEVELOPER TO MAKE THIS AN ACCEPTABLE PROPOSITION TO THE DIRECTLY IMPACTED SURROUNDING PROPERTY OWNERS. IT CAN BE A WIN WIN. PLEASE CONSIDER THE ALMOST 900 FOLKS THAT HAVE VOICED IN OPPOSITION TO THIS TO DATE. AS OPPOSED TO THE SINGULAR LANDOWNER. THANK YOU, SIR. DANIEL PORZIO. ONCE OKAY, THROW MY PREPARED REMARKS. UM I HAD AN INCIDENT HAPPENED TO ME. THAT CONCERNED ME GREATLY A COUPLE OF DAYS AGO. I'VE MADE IT KNOWN TO MY FRIENDS AND ASSOCIATES AND PEOPLE THAT ARE HANGING OUT WITH THAT. I'M GOING TO GET INVOLVED IN EDUCATION. PITA AND SCHOOL BOARD AS YOU'RE WELL AWARE. BUT THE INCIDENT THAT OCCURRED IN LIGHT OF WHAT'S HAPPENING. AROUND THE WORLD. MM. QUITE FRANKLY, MADE ME CRY. I WAS AT A STORE. WALKING. DOWN THE DOWN THE AISLE LOOKING FOR I FORGET WHAT AND A YOUNG MAN ABOUT MAYBE SEVEN OR EIGHT. AND I WAS DRESSED COMPARATIVELY LIKE THIS.

SO I WAS, YOU KNOW, AN OLD WHITE GUY. AND THIS YOUNG KID LOOKED UP AT ME AND HE SAID ARE YOU A RACIST? AND AT FIRST I WAS IT JUST IT JUST SHOCKED ME. BUT I SAID, WELL, WHAT? WHAT MAKES YOU SAY THAT? AND HE SAID. WE TALK ABOUT THAT IN SCHOOL. I REMEMBER WHEN I WAS GROWING UP AND YOU'VE HEARD ME TALK ABOUT MY EXPERIENCE AND EDUCATION. WE TALKED ABOUT RACE ALL THE TIME.

BUT NOT FROM THE STANDPOINT OF PIGEONHOLING SOMEBODY INTO. A PLACE WHERE I DON'T WANT TO GO.

AND I'VE BEEN HEARING FROM FRIENDS ALL AROUND THE WORLD. AND PART OF WHAT'S HAPPENING. IS WE JUST THINK IT'S OKAY. TO HATE EACH OTHER. WE HATE THAT GROUP. JUST BECAUSE OF. THEY'RE DEMOCRATS, THEIR REPUBLICAN, THEIR RUSSIAN, THEIR UKRAINIAN THERE, WHATEVER. AND. I'M GOING TO DO EVERYTHING IN MY POWER. I PROMISE YOU, MR MAYOR, I WAS LIKE, GET INTO EDUCATION MORE.

I'M GOING TO TALK TO THESE KIDS. I GREW UP IN A NEIGHBORHOOD THAT HAD EVERY KIND OF RACE. IMAGINE IMAGINABLE. AN ITALIAN KID FROM THE CITY. A GERMAN GUY THAT RETIREMENT PUERTO RICAN. BLACK.

HISPANIC YOU NAME IT. WE ALL GOT A WOMAN. WE ALL PLAYED TOGETHER. AND THAT GRADUALLY OVER THE YEARS FADED AWAY. SO I WANTED TO MAKE IT PUBLIC THAT FAR AS I'M CONCERNED. THAT'S GOING TO BE.

PART OF THE FOCUS OF WHAT I DO WITH MY REMAINING YEARS. AS YOU KNOW, I JUST HAD A RUN IN WITH COVID AND PNEUMONIA. WHEN YOU ARE FLAT ON YOUR BACK AND YOU CAN'T MOVE AND YOU CAN'T BREATHE. YOU BEGIN TO SEE THINGS WITH GREATER CLARITY. SO THANK YOU. THANK YOU. TRACY THOMAS.

[00:50:08]

HELLO, LONG TIME. MY NAME IS TRACY THOMAS. I LIVE IN MCKINNEY 5124 GROVE WOULD DRIVE TWO MONTHS AGO, I CREATED A PETITION. WHICH NOW HAS NEAR 500 SIGNATURES TO HAVE THE AMBULANCE THAT WAS TAKEN AWAY FROM FIRE STATION NINE RETURNED IT WAS ONLY AFTER THE PETITION WAS STARTED THAT A PRESS RELEASE WENT OUT TO TRY TO CONVINCE THE PUBLIC. IT WAS A GOOD DECISION.

WHILE TOO MANY OF US WHO LIVE IN THEIR STATION NINE. IT SEEMED TO BE A VERY POOR JUDGMENT CALL.

UNDERSTAND WE ALL MAKE THEM AT TIMES, BUT THERE ARE GREATER EXPECTATIONS WHEN IT COMES TO SOMEONE IN AUTHORITY. SINCE THE PETITION WENT OUT, A NEIGHBOR'S LITTLE GIRL EXPERIENCED A FEVER INDUCED SEIZURE. GETTING THE NECESSARY MEDICATION TO HER WAS DELAYED AS ONLY AMBULANCES CAN CARRY THE MEDICATION THAT WAS NEEDED AS CONTROLLED SUBSTANCES HAVE TO REMAIN LOCKED UP. SINCE THAT TIME, I ALSO LEARNED THERE WAS A VOTE OF NO CONFIDENCE AGAINST CHIEF KISSNER PRIOR TO THE FIREFIGHTERS ASSOCIATION, MAKING A STATEMENT CONFIRMING WHAT I KNEW TO ALREADY BE TRUE.

LOW EMPLOYEE MORALE HAS NOT ONLY BEEN HAPPENING RECENTLY, BUT IT HAS BEEN GOING ON FOR SEVEN YEARS SINCE 2000 AND 15 UNDER CHIEF KISSNER WHEN A LETTER WAS WRITTEN TO THE MAYOR OF THE TIME , BRIAN LOFT, MILLER DISCUSSING THE POOR WORKING ENVIRONMENT. IT WAS AT THAT TIME THAT I CREATED A SECOND PETITION CALLING FOR THE RESIGNATION OF FIRE CHIEF KISSNER. WE BELIEVE THAT OUR FIRE DEPARTMENT, MEN AND WOMEN DESERVE BETTER AND SHOULD NOT HAVE TO WORK IN A TOXIC ENVIRONMENT FOR SO LONG. THEIR JOBS ARE HARD ENOUGH EVERY DAY. BEING THAT MANY EMPLOYEES HAVE NO CONFIDENCE IN THE CHIEF. I'M NOT SURE HOW ONE CAN EXPECT CITIZENS LIKE MYSELF TO HAVE CONFIDENCE IN HIM. I'M ASKING FOR COUNSEL TO SPEAK TO THE CITY ABOUT THIS AND I THANK YOU FOR YOUR TIME. AND I HOPE TO SEE SOME OF YOU NEXT WEEK AT THE TECH STOP MEETING. IF READ DAHLAN'S. GOOD EVENING. MY NAME IS RED. DAHLAN'S AT 706 WOOD DUCK LANE IN MAKENI 75072. HONORABLE COUNCIL MEMBERS AND HONORABLE MAYOR. I APPRECIATE THE OPPORTUNITY TO SPEAK TO YOU TONIGHT. WORLD EVENTS SHOW THATO SPEAK OUR MINDS THAT NOT EVERYONE HAS. SO I DO APPRECIATE IT. I'M HERE TO SPEAK ABOUT THE SAME MATTER AS MR DANIEL. THAT IS ITEM 21 0038 Z TWO THAT IS THE ANNEXATION AND ZONING OF THE PROPERTY. 40 ACRES PLUS REMIND US NEAR 3 38 FAN AND ROAD AND HIGHWAY FIVE. RIGHT? WHEN WE LAST MET. WE MADE SOME REMARKS, AND THE MAYOR HAD A FEW COMMENTS AT THE END THAT IF THE CITY DOESN'T ANNEX THAT PROPERTY THAT IT CAN BE DEVELOPED IN ANY WAY THAT THE DEVELOPER DESIRES AND THAT'S TECHNICALLY TRUE. I AGREE. BUT AS I MENTIONED LAST TIME PROFESSIONAL CIVIL ENGINEER AND I LOOKED INTO THIS MATTER A LITTLE BIT, AND I FOUND THAT IN ORDER TO SERVE 375 UNITS OF MULTI FAMILY. THEY WOULD HAVE TO DEVOTE ABOUT EIGHT ACRES OF THEIR 22 A SUBJECT. THANK AH, THAT'S NOT ECONOMICALLY FEASIBLE . I THINK WE WOULD AGREE. AND SO THE FACT OF THE MATTER IS THAT THE CITY CAN CONTROL WHAT DEVELOPS THERE. AND AS MR DANIELS SAID, I DON'T OPPOSE OUR COMMERCIAL USE ON THE HIGHWAY FIVE SIDE. I'D LIKE TO SEE A GROCERY STORE ANCHOR WITH SOME, YOU KNOW, BOUTIQUE SHOPS AND OTHER THINGS LIKE THAT AROUND IT. WE DON'T OPPOSE A SINGLE FAMILY USE ON THE EAST SIDE THAT FRONTS FAN AND ROAD. WE JUST OPPOSED THAT MULTI FAMILY IS BECAUSE IT SEEMS TO BE SHOEHORNING AND THAT USE WITH A 25% ADDITIONAL INTENSITY. WHERE IT REALLY DOESN'T BELONG AT ALL.

SO THOSE ARE MY COMMENTS. I APPRECIATE YOU HEARING ME OUT AND THANK YOU FOR YOUR TIME.

THANK YOU. RIGHT. THOSE ARE ALL THE SPEAKERS THAT HAVE REGISTERED. WE GOT ONE MORE WE DO. OKAY. COME ON. I'M SORRY. APOLOGIES MY DAY JOB RAN A LITTLE LONG. MY NAME IS JANET.

GAG NIN. I LIVE AT 1991 SUNSET TRAIL. MCKINNEY, TEXAS 75071. AND I'M SPEAKING ABOUT THE 515

[00:55:07]

BANNON ROAD PROJECT THAT OTHERS HAVE SPOKEN ON TONIGHT AS WELL. AND I JUST WANTED TO PUT FORWARD THE COMMENTS THAT THIS DEVELOPMENT IF IT IS AGREED TO BE ANNEXED, WILL BE IN THE CITY OF MCKINNEY. AND SO IT REFLECTS THE CITY OF MCKINNEY SO I WOULD URGE THIS COUNCIL TO TAKE INTO CONSIDERATION THE HIGH STANDARDS THAT IT PLACES ON ANY DEVELOPMENT. WITHIN THE CITY, REGARDLESS OF HOW IT BECOMES PART OF THE CITY AND THIS DEVELOPMENT RIGHT NOW, AS HAS BEEN STATED FROM MIXED USE, SIMPLY DOES NOT MEET THE NEIGHBORHOOD. IT DOESN'T BLEND.

IT'S NOT APPROPRIATE AND THERE ARE CERTAINLY MANY OTHER PROJECTS THAT ARE WORTHY THAT COULD BE PUT. THERE ARE CERTAIN THINGS ABOUT ATTAINABLE ITTY OF HOUSING LIKE CONDOS. OR UH, TOWNHOUSES AS LONG AS THERE ARE TWO STORIES IN KEEPING WITH THE REST OF THE NEIGHBORHOOD THAT WOULD BRING HOME OWNERS IN THAT HAVEN'T HAD THE CHANCE TO OWN HOMES PREVIOUSLY. I WOULD EVEN OFFER THAT MAYBE WE COULD HAVE IT DESIGNATED AS A 55 PLUS COMMUNITY FOR OUR SENIORS THAT NEED HOMES AND WANT TO DOWNSIZE AND FREE UP OTHER HOMES FOR PEOPLE WITH FAMILIES THAT WOULD REDUCE ACTUALLY ELIMINATE ITS IMPACT ON THE NEIGHBORING WILLOW , WOOD ELEMENTARY SCHOOL AND OTHER SCHOOLS, AND IT WOULD SUBMIT SIGNIFICANTLY REDUCED THE TRAFFIC. SINCE MANY SENIORS ARE LESS LIKELY TO DRIVE, ESPECIALLY AT NIGHT DUE TO EYESIGHT AND OTHER CONCERNS, AND THAT WOULD BE MORE IN KEEPING WITH THE NEIGHBORHOOD. AND I WOULD JUST OFFER THAT NOW IS THE TIME THAT THIS COUNCIL HAS THE MOST IMPACT ON THIS PROJECT WHILE THESE PEOPLE WANT TO BRING IT IN AND GET THE ANNEXATION, YOU'RE AT YOUR STRONGEST LATER IT WILL BE MINOR TWEAKS AROUND THE EDGES.

BUT RIGHT NOW THEY WANT SOMETHING FROM YOU. THEY WANT THE ANNEXATION AND AS WAS PREVIOUSLY DISCUSSED. YES IT'S IN THE COUNTY RIGHT NOW. SO IF THEY DIDN'T WANT TO BE PART OF THE CITY, THEY COULD NOT PAY CITY TAXES AND BUILD WHATEVER THEY WANTED, AND THEY COULD HAVE DONE THAT FOR THE LAST FIVE YEARS THAT THEY'VE OWNED THESE PROPERTIES. BUT THEY'RE COMING TO YOU BECAUSE THEY WANT SOMETHING THAT ANNEXATION. WHETHER IT'S FOR SERVICES, SEWER , WHATEVER IT IS, SO NOW'S THE TIME TO DEMAND OF THEM. A PROJECT WORTHY OF COMING INTO THE CITY OF MCKINNEY. YOU HAVE THE TIME, THEY ALREADY SAID DURING THE COMMITTEE LEVEL THAT THEY WEREN'T IN A RUSH. SO TAKE THAT TIME. MAKE SURE YOU HAVE THE BEST PROJECT FOR THIS LAND BECAUSE LAND IS A PRECIOUS RESOURCE THAT WE ALL ARE GOING TO HAVE TO LIVE WITH THE CURRENT NEIGHBORS, THE NEW PEOPLE THAT MOVE IN AND THE CITY ITSELF. SO THANK YOU. THANK YOU. THANKS.

[COUNCIL AND MANAGER COMMENTS]

NOW MOVE TO CITIZEN. EXCUSE ME. COUNSELING MANAGER COMMENTS IF ANY MARYLAND GOT TO MICHAEL MY COMMENTS AT THE BEGINNING AND THANK YOU VERY MUCH FOR THAT OPPORTUNITY. NO COMMENTS.
