THE PLANT ITEMS HAVE BEEN IMPROVED TONIGHT. HMM. WILL NOW MOVE TO OUR REGULAR AGENDA, AND

[Conduct a Public Hearing to Consider/Discuss/Act on a Specific Use Permit Request for a Convenience Store with Fuel Sales (7-Eleven), Located on the Southwest Corner of Wilmeth Road and Hardin Boulevard]

THIS IS WHERE THE PUBLIC CAN PARTICIPATE. A FEW ARE HERE TO SPEAK ON THE PUBLIC HEARING.

ADAM, THIS WOULD BE YOUR OPPORTUNITY. THE FIRST ITEM. IS TO DAY 0006 ISSUE P. THIS IS A PUBLIC HEARING REQUEST. FOR A SPECIFIC USE PERMIT. FOR CONVENIENCE STORE WITH FUEL SALES. 7 11. THIS IS ON THE SOUTHWEST CORNER OF WILMOTH ROAD IN HARDENED BOULEVARD. SHREDDER GOOD EVENING COMMISSIONERS. LEXI SCHRADER, PLANNER ONE, SO THIS IS A REQUEST FOR A SPECIFIC USE PERMIT TO PERMIT A CONVENIENT STORE WITH FUEL SALES ON THE SOUTHWEST CORNER OF WILMOTH AND HARDEN. THE PROPERTY IS CURRENTLY PART OF THE PAINTED TREE PLANNED DEVELOPMENT FROM 2021 THAT DESIGNATES THIS CORNER FOR COMMERCIAL USES TO FOLLOW THE SEA TO ZONING DISTRICT STANDARDS. C TWO ZONING AND THUS THE PD REQUIRE MOTOR VEHICLE FUEL SALES TO RECEIVE AN S U P IN ORDER TO OPERATE ON THIS SITE, PROPOSED GAS STATION SITE IS BORDERED BY A VARIETY OF ZONING, ZONING AND USES PRIMARILY EXISTING AND PROPOSED SINGLE FAMILY TO THE EAST AND THE WEST OF THIS SITE AND COMMERCIAL ZONING TO THE SOUTH AND THE NORTH EAST ON THE OTHER SIDE OF HARDEN, THE PROPOSED GAS STATION IS LOCATED ON THE HARD CORNER OF TWO ARTERIAL ROADWAYS OF WELLNESS AND HARDEN. WILL BE SURROUNDED BY MULTIPLE RESIDENTIAL NEIGHBORHOODS, NEIGHBORHOODS AS NOTED, THERE WILL BE A 10 FT LANDSCAPE BUFFER AND A MINIMUM SIX FT. SCREENING WALL TO BE INSTALLED ON THE WESTERN PORTION OF THE SITE, WHERE THERE WILL BE A SINGLE FAMILY RESIDENTIAL ADJACENCY. UM THE PUMPS AND THE PARKING ARE ORIENTED AWAY FROM THE PROPOSED SINGLE FAMILY DIRECTLY TO THE WEST, WITH THE FIRE LANE AND THE CONVENIENCE STORE TO SEPARATE THOSE USES A LITTLE BIT STAFF FEELS THAT THE PROPOSED SITE IS APPROPRIATE FOR THE USE AND WILL PROVIDE A SERVICE FOR THE EXISTING AND FUTURE NEIGHBORHOODS IN THE AREA, GIVEN THE EXISTING NEIGHBORHOODS TO THE EAST OF HARDEN AND THE PROPOSED PEDANTRY DEVELOPMENT THAT WILL BE COMING IN HERE SOON. AND AS SUCH, STAFF RECOMMENDS APPROVAL OF THE SCP AND I WILL STAND FOR ANY QUESTIONS. THANK YOU, LEXI. QUESTIONS. LEXI THE PDS TO THE EAST ON THE NORTH AND THE SOUTH IF ANOTHER GAS STATION CONVENIENCE STORE NEEDED TO GO IN THERE, THEY WOULD BE REQUIRED TO HAVE AN S U P ALSO. SO THE PROPERTY DIRECTLY TO THE NORTH IS ACTUALLY OUTSIDE OF CITY LIMITS. THAT PROPERTY IS IN OUR E. T J SO WE DO NOT REGULATE USE IN THAT AREA THAT'S DIRECTLY NORTH OF WELLNESS. THE PROPERTY IS DIRECTLY TO THE SOUTH, AND THE WEST IS ALL PART OF THE SAME PAINTED TREE PLAN DEVELOPMENT. SO THE PROPERTY DIRECTLY TO THE SOUTH IS IN THE SAME COMMERCIAL DESIGNATION AND PER THE PD. AND THAT WOULD ALSO REQUIRE AN S. U P THE PROPERTY IN THE REST OF THE PAINTED TREE DEVELOPMENT IS DESIGNATED FOR RESIDENTIAL THEY WOULD NEED TO CHANGE THE ZONING ENTIRELY TO MOVE FORWARD WITH ANOTHER COMMERCIAL USE OR GAS STATION ON THAT SITE. DO WE KNOW ABOUT THE PROPERTIES ACROSS THE INTERSECTION? YES OH, THE PLAN DEVELOPMENT DIRECTLY ACROSS HARDEN IS ALSO FOR A LESS INTENSE COMMERCIAL USE MAINLY ORIENTED TOWARDS NEIGHBORHOOD SERVICES. SO THEY WOULD ALSO NEED AN S U P FOR THAT. AS THE QUESTIONS NEW ONE. LEXI THANK YOU. UM, WE MAY HAVE QUESTIONS FROM SPEAKER. SO IF YOU'LL KIND OF TAKE NOTES IS OUR APPLICANT HERE TONIGHT? YES. YOUR TURN. MATTHEW SMITH WITH THE CARE OF ENTERS 26 27 TILLER STREET FOR TEXAS. SUICIDE MENTIONED. THIS IS A 7 11. IT'S ONE OF THE NEWER TYPES THAT THEY'RE ROLLING OUT IN DFW AND ACTUALLY ACROSS THE COUNTRY. UM, IT'S 4650 SQUARE FEET. IT INCLUDES WHAT'S CALLED A LAREDO TACO COMPANY, WHICH IS A TACO BAR CONCEPT THAT EMPLOYEES ARE DEDICATED TO THAT AREA SERVING YOU KNOW, AS YOU GO KIND OF LIKE CHIPOTLE STYLE TACO. UM THE. MASONRY WALLS SHE MENTIONED IS SITTING ON A RETAINING WALL, SO THAT WILL BE SIX FT. ON TOP OF THAT, UM, FURTHER BUFFERING. WE'RE NOT ASKING FOR ANY VARIANTS FROM THE SITE PLAN. WE WORKED WITH STAFF WHENEVER ON ALL THE REQUIREMENTS , INCLUDING THE TWO DIESEL LANES ON THE NORTH AND THE EAST SIDE OF THE PROPERTY. WE'RE AWARE THAT THE ROUNDABOUT IS GOING IN

[00:10:04]

THERE AND WORKED WITH STAFF TO CLEAN UP THE SITE PLAYING THE BEST THAT WE COULD THIS IS THE ELEVATION OF THE NEW PROTOTYPE. IT'S NOT SEEN VERY OFTEN. THERE ARE A COUPLE NEW ONES AROUND THE EVERYTHING IS A MASONRY. UM TEXTURE. SORRY MATERIAL. UM WITH DIFFERENT LOOKS, SO THAT'S A WOOD THE WOOD SIDE THERE IS ACTUALLY A CEMENT BLOCK WITH THE WOOD FINISH IT MORE DURABLE KEEPS ITS UM, YOU KNOW, APPEAL MUCH LONGER. UM. AS MENTIONED. THIS WAS A PART OF THE PAINTING, TREE PLANTINGS DEVELOPMENT AND THIS CORNER WAS ALWAYS THE DESIGNATED AS COMMERCIAL. UM HERE'S JUST AN OVERVIEW OF EVERYTHING THAT'S GOING ON IN THE GROWTH, WHICH IS WHY THIS SITE HAS BECOME VERY APPEALING FOR US. AND HERE'S SOME COMPLETED. THIS IS ONE DOWN IN SAN ANTONIO. I GOT MENTIONED. THERE'S NOT TOO MANY AROUND HERE LIKE THIS. THESE NEW STORES ARE ALSO RUN CORPORATELY, NOT BY FRANCHISEES. UM HERE IS SOME INTERIOR PICTURES. SO UPDATED LOOK INSIDE MUCH CLEANER. UM, HERE'S LAREDO TACO BAR. UM. IT SERVES FROM SIX AM TO AROUND EIGHT PM, DEPENDING ON YOU KNOW THE RUSH HOURS. IF THEY HAVE A LATER EARLIER RUSH HOUR, THEY'LL ADJUST THEIR TIMES. UM HERE'S A COFFEE BAR WITH THE NEW UPDATED COFFEE MACHINES THAT SERVE, YOU KNOW. VARIOUS. SOME TYPES OF COFFEE. AND THEN, UM, AS SHE MENTIONED THE NEIGHBORHOOD SERVICES, THAT'S REALLY WHY THIS SIDE IS APPEALING. UM THE GOAL FOR SOME EVIDENCE TO MAKE THIS A ONE STOP SHOP IN THE MORNING OR AT NIGHT. YOU CAN GET YOUR COFFEE. THE ON THE RIGHT SIDE.

THERE'S A NEW REFRIGERATED CASES. THAT SORT OF PACKAGED MEALS YOU CAN GRAB ON THE WAY TO WORK AND THEN AS WELL AS A ON THE LEFT SIDE ASSORTMENT OF NEW FRUIT OPTIONS AND UM VARIOUS, YOU KNOW, PREPACKAGED MEALS, A LARGER OFFERING. TYPICALLY THE STORIES YOU SEE RIGHT NOW ABOUT 3000 SQUARE FEET LIKE I MENTIONED THIS IS 46 POINT. UM WE DID MEET WITH HIGH POINT AND TIMBER VIEW. UM. OAS AND HAD A MEETING. WE TALKED THROUGH SOME OF THE. THERE WAS A LOT OF COMMENTS ON THE DEVELOPMENT SOME THINGS WE WOULD LIKE TO ADDRESS OR, YOU KNOW, SECURITY. EVERY SEVEN NEW 7 11 HAS THE STANDARD SECURITY SYSTEM THROUGHOUT. YOU KNOW THE COUNTRY IT'S IMPLEMENTED 24 OUR CAMERAS. UNDER THE CANOPY ON THE BUILDING REAR OF THE BUILDING, UM, THE WAY THAT THE SITE IS ORIENTED. IS TO PROMOTE SAFETY. FROM THE FUEL CANOPY, SO AS YOU CAN SEE, IT'S A STRAIGHT IN LINE, NOT STACKED. THAT'S A REMOTE THE CASHIERS TO BE ABLE TO SEE EVERY CAR FUELING FROM INSIDE. THE LIGHTING. EVERYTHING IS VERY WELL LIT, BUT CONTAINED ON THE SITE AS WELL. UM ONE COMMENT THAT WE HEARD WAS POTENTIALLY ADDING A PATIO, WHICH WOULD BE UP FOR DISCUSSION. UM WITH YOUR SEE WHAT THE THOUGHTS WERE WE HAVE WE HAVE THE ABILITY TO MANIPULATE THE SITE. UM BASED ON FEEDBACK. WOW. THAT BEING SAID, IF THERE IS ANY OTHER COMMENTS OR QUESTIONS WHEN HE PUMPS ARE YOU LOOKING TO PUT HERE? SO THAT IS SO THE LITTLE RECTANGLES UNDER THE CANOPY OR WE CALL EM PDS OR SIX MPS OR 12 FUELING SPOTS? WITH A PATIO. WHAT WOULD YOU DO ON THE NORTH SIDE OF THE BUILDING, THEN WE WOULD DO IT ON THE SOUTH SIDE OF THE BUILDING BUILDING UP THEN. WOULD YOU SLIDE? THE BUILDING UP BUILDING WOULD SAY THAT WE SLIDE THE PARKING DOWN JUST SLIGHTLY, AND YOU SEE THE KIND OF LANDSCAPE ISLAND THAT'S TO THE SOUTH. WE KIND OF JUST DRINK THAT UP A LITTLE BIT. OTHER QUESTIONS OF THE APPLICANT ADDRESSED, UM, YOU KNOW, JUST TO THE SOUTH OF THE LOT. WHAT IS IT? WHAT IS GOING IN THERE? WE DO NOT HAVE A CURRENT PLAN FOR THAT. WE ARE PURCHASING THAT AS WELL. UM WE HAVE NOT MARKETED IT AND HAVE NO FUTURE PLANS. AT THIS TIME. IT DOES MORE INTO THE SAME ZONING AS THIS. UM THE UNDERLYING ZONING IS THE SAME. SO THERE ARE QUITE A FEW OPTIONS THAT ARE ALLOWED BY RIGHT UM, BUT WE HAVE NOT. ENTERTAIN ANYTHING AT THIS POINT. THANK YOU. ANYONE ELSE? MATTHEW THANK YOU FOR BEING HERE. WE MAY HAVE QUESTIONS AFTER WE COMPLETE THE PUBLIC HEARING. ABSOLUTELY. THANK YOU.

THANK YOU. THIS IS A PUBLIC HEARING ENEMY IF YOU'RE HERE TONIGHT, AND YOU'D LIKE TO SPEAK ON THIS PROPOSED ISSUE. P. PLEASE COME TO THE PODIUM. THANK YOU. HELLO GOOD TO SEE YOU ALL.

[00:15:10]

THANK YOU FOR LETTING ME SPEAK. MY NAME IS DORIAN TRACY. UM I LIVE IN TIMBER CREEKS SUBDIVISION AT 32 1 HICKORY BEEN TRAIL IN MCKINNEY AND I AM HERE. TO PROPOSE WILL NOT PROPOSE. BUT I'M AGAINST THE 7 11 GOING IN THE CORNER OF WILMOTH AND HARDEN. AND I DON'T THINK IT'S APPROPRIATE ON ANY CORNER A LITTLE MYTH AND HARDEN. THE GAS FUMES, THE LIGHTS THE NOISE. UM THE INCREASED TRAFFIC THAT THIS WILL BRING, ESPECIALLY WITH THE GAS TRUCKS. TANKERS THAT COME THROUGH WILL IT BE? YOU KNOW, ONE DAY WEEK, THREE TIMES A WEEK? WE DON'T KNOW. UM NOT ONLY THAT, BUT WE'VE GOT THE LOCATION THAT IS DIRECTLY TO THE NORTHWEST OF THE LOCATION.

THAT'S A WORKING FARM. IT'S A CATTLE FARM, SO THEY HAVE CATTLES THEIR CATTLE THERE.

THAT'S A MEAT FARMS, SO THEY RAISES CATTLE FOR MEAT. THAT'S A CONCERN FOR THE ENVIRONMENTAL UM ALSO, THERE'S 11 GAS STATIONS THAT ARE IN TWO MILES WITHIN THE LOCATION ALREADY CURRENTLY SO, WITH THAT BEING SAID, WHY DO WE NEED ANOTHER GAS STATION AT YOU KNOW, IN THE MIDDLE OF OUR SUBDIVISION AT THE FOUR CORNERS THERE? WE ALREADY HAVE ONE HARDENED AND 3 80. WE HAVE ONE HARDEN IN VIRGINIA PARKWAY WE'VE GOT LIKE FOREST AND 1 61, WHICH IS JUST NORTH OF BAYLOR, SCOTT AND WHITE. AND THEN WE'VE GOT ONE. UM THAT'S ON THE EAST SIDE OF 75 3 80. SO WE'VE GOT FOUR ALREADY WITHIN TWO MILES. UM AND WE DID MEET. UM WE HAD A ZOOM CALL THAT WAS AT 3 30 IN THE AFTERNOON YESTERDAY WITH THE PEOPLE FROM THE ENCROACHING VENTURES, AND A LOT OF PEOPLE COULDN'T ATTEND. BECAUSE IT WASN'T A GREAT TIME FOR THEM. THEY WERE WORK. UM, PLEASE STRESS CONCERNS THAT WE DON'T WANT A 7 11 IN OUR NEIGHBORHOOD. WE ASKED FOR MAYBE ANOTHER OPTION, MAYBE A GYM OR A RESTAURANT OR SOMETHING LIKE THAT, AND THEY WEREN'T ABLE TO PROVIDE ANY ADDITIONAL UM, OPTIONS FOR US OTHER THAN IT'S JUST A GAS STATION. WE'RE GOING TO PUT IT IN, AND THAT'S ALL YOU GET. UM, WE'VE GOT A LOT OF CONCERNS ABOUT THE ROUNDABOUT WE'VE GOT. HIGH SCHOOL KIDS NEW DRIVERS THAT ARE LEARNING TO DRIVE. THEY'RE NOT USED TO ROUNDABOUT, SO THAT'S A CONCERN FOR US. AND YOU KNOW THE TRAFFIC. UM THAT THEY SAY THAT IT'S GOING TO ALLEVIATE OR IT'S GOING TO HELP SUPPORT THAT COMES THROUGH THERE. I DON'T THINK THAT'S GONNA WORK. I THINK IT'S JUST GOING TO DROP MORE TRAFFIC. IT'S GOING TO DRAW PEOPLE HANGING OUT AT CERTAIN HOURS. IT'S GOING TO DRAW RIFFRAFF TO CRIME THAT WE DON'T WANT OUR NEIGHBORHOOD. WE DON'T WANT TO SEE ANY OF THAT. THERE. UM WE'RE OPEN. OTHER SUGGESTIONS, MAYBE SOMETHING THAT THE COMMUNITY CAN USE BETTER. LIKE I SAID, UM, YOU KNOW, A GYM WOULD BE GREAT WOULD SUFFICE FOR THE COMMUNITY. WHAT YOU KNOW WE COULD WALK TO IT. UM BUT I JUST DON'T THINK IT GAS STATIONS APPROPRIATE. AND I HOPE YOU GUYS TAKE THAT INTO CONSIDERATION. UM THANK YOU.

THANK YOU, MR TRACY. ANYONE ELSE WISH TO SPEAK TONIGHT ON THIS PROPOSED ISSUE. P ANYONE ELSE? WE CLOSE THE PUBLIC HEARING MOTION MANAGED REMAINS. I CLOSED THE PUBLIC HEARING 2ND 2ND. MR. DOC IS THERE ANY DISCUSSION? PLEASE CAST YOUR VOTE. MR CHEAP , JUST SO YOU KNOW, I AM NOT ABLE TO LOG IN UNTIL THE ELECTRONICALLY. INVOLVED THE OLD FASHIONED WAY. BY RAISE YOUR HAND. THE MOTION CARRIES A PUBLIC HEARING HAS BEEN CLOSED. NOW MEMBERS TRIP QUESTIONS OF STAFF OR OF THE APPLICANT. I WOULD LIKE TO GO FIRST. MM. STAFF, PLEASE. UM. AND S UPS LOOKED AT BECAUSE OF MORE TENCENT USE TYPICALLY OR SOMEWHERE ALONG THE LINE COUNCIL. HAS DECIDED THAT THESE USES NEED TO HAVE MORE INTENSIVELY USED INSTEAD OF JUST BE GIVEN BY RIGHT OVERALL STAFF REVIEWS LIKE A C STORE. WHAT ARE THEY KEEPING IN MIND BECAUSE IT'S A SPECIAL USE PERMIT. UM AS FAR AS ITS INTENSITY TO APPROVE IT OR NOT PROVEN. SO WHAT IS THIS? BECAUSE IT'S AT A MAJOR INTERSECTION, AND WE'RE FINE WITH THE WHOLE MAJOR INTERSECTION BEING ISSUE. GAS STATIONS OVERALL, OR IS THERE CERTAIN THINGS THAT YOU'RE LOOKING FOR? WHEN YOU GO THROUGH A GAS STATION? SURE SO S UPS IN GENERAL, HAVE FOUR CRITERIA THAT WE LOOK AT. WHEN WE ARE EVALUATING WHETHER OR NOT THEY'RE APPROPRIATE. SO THE FIRST THING THAT WE LOOK AT IS COMPATIBILITY WITH THE ADJACENT NEIGHBORING LAND USES IN THE AREA, SO IT'S SOMETHING THAT WE LOOKED AT FOR THE SITE. SO, UM, SINCE THERE ARE AND THERE IS

[00:20:04]

COMMERCIAL ZONING IN PLACE FOR THE SITE AND DIRECTLY TO THE SOUTH. UM AND ON THE OTHER HARD CORNERS OF THE INTERSECTION ARE WITHIN CITY LIMITS. THAT WAS SOMETHING THAT WE TOOK INTO ACCOUNT. AND IN TERMS OF THE SINGLE FAMILY IN THE AREA. THIS IS SOMETHING THAT WE CONSIDER TO BE A SERVICE. SO THE GAS STATIONS WE WERE LOOKING AT THAT WERE IN THE AREA. THE CLOSEST ONE THAT WE SAW WAS IN ABOUT A MILE AND A HALF. THAT'S ON THE OTHER SIDE OF 75. THE OTHER CLOSEST ONE WAS COSTCO, WHICH IS MEMBERSHIP ONLY SO THE ONE THAT WOULD BE CLOSEST TO THIS NEIGHBORHOOD FOR PUBLIC SERVICE AND FOR THE NEIGHBORHOODS HERE WOULD BE ABOUT A MILE AND A HALF OR SO AWAY. SO WE THOUGHT THAT WOULD BE APPROPRIATE FOR TO SERVE THE SURROUNDING COMMUNITIES. UM THE OTHER CRITERIA THAT WE LOOK AT OUR INFRASTRUCTURE, SO ACCESS TO PUBLIC STREETS WHETHER OR NOT THERE ARE ADEQUATE ROADWAYS HERE , SO THERE THIS ISN'T THE CORNER OF TWO MAJOR ARTERIALS. AND SO WILL MISS IS CURRENTLY A SIP PROJECT THAT WE ARE UNDERTAKING . SO THE ROUNDABOUT IS PART OF A CITY PROJECT THAT WE ARE LOOKING AT, AND IT DOES HAVE ADEQUATE ACCESS. THERE WILL BE THE ROADWAYS WILL BE IMPROVED TO THE POINT THAT IT COULD MITIGATE TRAFFIC. BUT THAT IS SOMETHING THAT WE LOOK AT DURING THE SITE. PLAN REVIEW WHEN ENGINEERING TAKES A LOOK AT THE TRAFFIC IMPACT AND THE EXISTING RAILWAYS IN THE AREA. SOME OF THE OTHER ITEMS. WE LOOK AT OUR THINGS LIKE SCREENING OPEN SPACE HEIGHTS. THINGS LIKE THAT. SO IN TERMS OF SCREENING, THAT IS SOMETHING THAT WE TOOK INTO CONSIDERATION WITH THE PROPOSED SINGLE FAMILY DIRECTLY TO THE WEST, SO OUR CURRENT ZONING ORDINANCE DOES REQUIRE THERE TO BE AT LEAST A 10 FT LANDSCAPE BUFFER AND A MINIMUM SIX FT. HIGH SCREENING WALL, USUALLY MASONRY TO BE INSTALLED TO KIND OF SOFTEN THE BUFFER BETWEEN THOSE USES. UM THAT IS SOMETHING WE TAKE INTO CONSIDERATION IN TERMS OF OPEN SPACE. GO BACK HERE. IF THEY DO, THEY ARE PROVIDING THE LANDSCAPE OFFER THAT IS REQUIRED ADJACENT TO WILMOTH AND HARDEN SETS A MINIMUM OF 20 FT. THEY'RE PROVIDING A LITTLE BIT EXTRA IN THAT AREA, TOO. UM KIND OF HELP WITH THE USE, SO WE TAKE ALL OF THOSE THINGS INTO CONSIDERATION WHEN LOOKING AT THE CPS. THAT'S WHAT WE CONSIDERED, BUT THE MAIN FACTOR WAS PROVIDING A SERVICE TO THE AREA, ESPECIALLY SINCE THERE WILL BE AROUND 1300 HOMES COMING IN WITH PAINTED TREE, SO WE'RE TRYING TO THINK AHEAD OF, UM, SERVICES FOR THOSE HOMES COMING IN. I DID WANT TO MAKE A CORRECTION WHEN YOU ASKED PREVIOUSLY ABOUT THE ZONING ON ONE OF THE OTHER CORNERS, SO THE ZONING TO THE SEA. FRANK HERE, SO RIGHT ON THIS AREA IS A PLANNED DEVELOPMENT, BUT IT DOES ALLOW FOR THE BASED ZONING OF SEA PLANTS CENTER, WHICH WOULD PERMIT A GAS STATION BY RIGHT SO THEY WOULD NOT NEED TO GO THROUGH THE STP PROCESS. BUT SINCE THIS IS DOES HAVE DIFFERENT ZONING OF C TWO, WHICH IS A LESSER INTENSITY ZONING DOES REQUIRE THE S U P SO I JUST WANTED TO KNOW WAS ZONING BY RIGHT TAKEN IN CONSIDERATION WHEN YOU'RE YOU BE REVIEWING THIS ISSUE. ACROSS THE TERMS OF THE SEA PLANTS CENTER. SO UM, I WAS TAKING A LOOK AT THAT. SO WE DID LOOK AND SEE WHAT COULD BE DEVELOPED IN THIS AREA. SO THAT IS A MORE INTENSE ZONING, SO A LITTLE BIT MORE INTENSE IN TERMS OF WHAT COMMERCIAL USES CAN BE PERMITTED THERE. THERE IS SIMILAR ZONING ON THE OTHER HARD CORNER DIRECTLY TO THE NORTH AND THE OTHER SIDE OF WILMOTH. UM SO THIS WOULD BE A MAINLY A LESSER USE ON THAT CORNER. SO WHEN YOU REVIEW THE S U P E IN YOUR CONSIDERING THIS NEIGHBORHOOD SERVICE. IS THERE ANY CONSIDERATION IN THAT IN THE INTENSITY OF THE USE AS FAR AS THE HOURS OF OPERATION BEING 3 65 24 7? SO MAINLY WHAT? WE'RE LOOKING AT IT JUST TO MAKE SURE THAT IT'S APPROPRIATE FOR THE SURROUNDING SURROUNDING USES, MAKING SURE THERE IS ADEQUATE BUFFERING AND IT'S NOT TOO INTENSE. SO WE MIGHT HAVE TO DEFER TO OTHER STAFF TO SEE IF THAT'S SOMETHING THAT WE GENERALLY TAKE A LOOK AT IN TERMS OF HOURS OF OPERATION.

THINK THAT'S A QUESTION. AND AS WELL AS WE'RE LOOKING AT THIS BECAUSE THIS IS 24 HOURS.

THERE'S NOTHING LIKE THAT IS GOING TO DRAW PEOPLE AT ALL HOURS. IS THAT TAKEN IN CONSIDERATION? AERATION. AND MAKING THE RECOMMENDATION. IN TERMS OF THAT IS DEFINITELY SOMETHING THAT WE LOOK AT WITH THE INTENSITY OF THE USE. UM SO WE WOULD UM. TAKE A LOOK AND MAKE SURE THAT THERE IS ADEQUATE. SCREENING AND BUFFERING LIKE I MENTIONED, SO IT'S NOT TOO CLOSE TO RESIDENTIAL. SOMETHING TO KEEP IN MIND IS THAT WE HAVE ORDINANCES IN PLACE TO PROTECT. UM NEIGHBORS IN THE AREA FROM EXCESSIVE LIGHTING THAT WOULD BE

[00:25:07]

IMPEDING ON THEIR PROPERTIES OR NOISE. SO THAT'S DEFINITELY SOMETHING THAT CODE UM AND ARE BUILDING INSPECTIONS DEPARTMENT . TAKE A LOOK AT WHEN WE'RE LOOKING AT THESE USES THE SAME FOR LIKE LOITERING AND BEING OUT IN PARKING LOTS AT ALL HOURS. THAT KIND OF THING CORRECT, NOT MEETING. NOISE YOU STILL HAVE PEOPLE. THE ORDINANCE WOULD STILL COVER. UM REGARDLESS, SO IT WOULD STILL BE THE LIGHTING. IT WOULD STILL BE THE NOISE. POLICE COULD STILL BE CALLED OUT AT ANY TIME IF THERE WERE ANY ISSUES THAT NEEDED TO BE ADDRESSED. I THINK THERE'S TWO CONSIDERATIONS THERE WON AN OWNER THAT'S PROBABLY RESPONSIBLE AND OPERATIONS AND RESPONSIBLE BUT THE POTENTIAL FOR CUSTOMERS THAT ARE IRRESPONSIBLE AND LOUD THAT YOU'RE NOT GOING TO POLICE. THEY COME AND GO. AT ALL HOURS, SO. I THINK THE ZONING IT'S WORTH THE ORDINANCE AND WHAT THE CITY WOULD DO AS FAR AS BLEEDING LIGHTS OR ITSELF WOULD BE ONE THING BUT CONTROLLING PEOPLE COMING AND GOING TO DIFFERENT THINGS. I WOULD SAY THAT'S NOT A NUISANCE ORDINANCE THAT OUR CODE ENFORCEMENT TEAM WOULD BE OVERSEEING. THAT'S A POLICE ISSUE. IF THERE'S YOU KNOW, CRIME INCREASES OR LOITERING OR MISCHIEVOUS BEHAVIOR THAT'S GOING TO BE A POLICE ISSUE. THE PROPERTY IS HIS OWN. C TWO TODAY UNDERLYING ZONING. SO IN C TWO TODAY DRIVE THRU IS PERMITTED. SO MCDONALD'S WATER BURGER COULD GO IN THERE AND THEY CAN OPERATE 24 7 WITHOUT HAVING TO COME FORWARD VARIANCE TO US NOW. CORRECT. QUESTION FOR THE APPLICANT. SO THE LAREDO TACO OBVIOUSLY COMPONENT YOU'VE GROWN THE BUILDING 4800 SQUARE FEET.

WHAT THE 4800 SQUARE FEET. HOW MUCH IS THE RADIO TACO? I KNOW THEY COMBINE INSIDE. BUT WHAT DO THEY TYPICALLY OPERATE OUT WITH THE BACK OF HOUSE AS WELL OR JUST KIND OF THE HOW DO YOU PUT THE BUILDING THINKS PRIOR 800 SQUARE FEET WHEN YOU GET DOWN TO IT WITH UM THE PREP AREA. AND THEN THEY SPLIT THE COOLERS IN THE BACK AS WELL. YEAH, PROBABLY 800 SQUARE FEET, AND THEN THERE'S A COUPLE SEATING AREAS AS WELL. IT JUST DEPENDS ON THE FLOOR PLAN THAT THEY PROVIDE, AND IT'S MAINLY DRIVEN THAT THAT FLOOR PLAN IS DRIVEN BY THE SITE ITSELF. SO ESSENTIALLY WITH THE HIGH SCHOOL BEING CLOSE BY THEY MIGHT DO A COUPLE MORE TABLES. OR SOME LOCATIONS. DON'T HAVE ANY TABLES GRAB AND GO. PROBLEM SO THEY WILL THE FLOOR PLAN WILL DICTATE THAT BUT THE OVERALL SIZE TYPICALLY OF THE TACO BAR WITH THE BACK PAST, PROBABLY 8 800 SQUARE FEET. TO THE SEA STORE. ROUGHLY 4000. YES. THANK YOU. OTHER QUESTIONS. ANYONE. THAT YOU THANK YOU. LEXI HAD A QUESTION, AND IT MAY BE AN ENGINEERING QUESTION REGARDING THE ROUNDABOUT THAT WAS REFERENCED. SOUNDS LIKE THE INTERSECTION OF HARDEN AND WILMOTH IS UNDERGOING OR WILL BE UNDERGOING SOME MAJOR CHANGES. THIS ROUND ABOUT THAT WAS MENTIONED IS THAT THE LOCATION IN THE CENTER OF THIS INTERSECTION? YES YES, THAT IS A C I P PROJECT THAT, UM, ENGINEERING STUFF IS CURRENTLY WORKING ON AN ENGINEERING IS REVIEWING TO CONFIRM THAT THIS IS OR IS NOT A GOOD IDEA. DO YOU WANT TO CLARIFY? IT IS A CITY PROJECT. THIS IS THE ROUNDABOUT IS NOT PROPOSED BY THE APPLICANT THAT IS A CITY LED PROJECT ENGINEERING IS REVIEWING AROUND ABOUT THERE. YES THEY ARE ACTUALLY SPEARHEADING THE CHARGE FOR IT. BUT YES. OTHER QUESTIONS, COMMENTS ANYONE? THANKS, LEXI. I VOTED FOR THE 7 11 JUST SOUTH 3 80 ON HARDEN. I VOTED FOR THE ONE THAT HARDEN IN VIRGINIA. UM BUT ALSO VOTED CONSISTENTLY, I THINK AND PUTTING INTENSIVE 24 HOUR BUSINESSES TO THE BACK OF RESIDENTIAL OVERALL. AND AS FAR AS CONVENIENCE FOR GAS. THERE'S A QUICK TRIP. THERE'S 47 ELEVENS . UP AND DOWN. WE'RE NOT SHORT OF GAS STATIONS IN THIS TOWN. I DON'T THINK TOO MANY CITIZENS WOULD SAY WE'RE SHORT OF GAS STATIONS OVERALL, SO IT JUST COMES TO THE INTENSITY OF THE USE BEING 24 HOURS A DAY BEHIND RESIDENTIAL. I KNOW THE RESIDENTIAL IS NOT THERE NOW. UM BUT I DON'T THINK IT PROVIDES A QUALITY OF LIFE FOR THOSE CITIZENS FOR FUTURE CITIZENS. AS FAR AS I GOES, SO THERE'S OTHER PLACES THEY OFFER MORE BUFFERING FROM RESIDENTIAL. I FEEL LESS UPS OR MORE APPLICABLE TO, UM, CONSIDERING ACROSS THE STREETS ALREADY GOT THAT ZONING AND THE POTENTIAL OF TWO ON THIS CORNER.

[00:30:04]

WOULD ONLY HAS ME MORE CONCERNED AS FAR AS THAT SO I I'LL GO THE OPPOSITE. THINK THEE CAN RUN 24 7 HERE. FAST FOOD. WHICH IS A GAS STATION. I UNDERSTAND THERE'S A LOT BUT THEY'RE ALL THROUGH THE SOUTH OR ON 3 83 A BARRIER THE WAY I LOOK AT IN THE RETAIL WORLD. I WANT TO GO ACROSS OVER 3 80 TO GO TO ANOTHER GAS STATION ON THE OTHER SIDE OF HARDEN. NOT A LOT OF AMENITIES UP HERE ON THE NORTH SIDE OF 3 80 AS WE'VE BEEN DRIVING UP AROUND, LOOKING AT OTHER SITES MYSELF. THIS DIET. ULTIMATELY. I DON'T SEE THIS ANY DIFFERENT THAN A MCDONALD'S OR ANYTHING ELSE THAT COULD POTENTIALLY GO HERE. THERE'S MORE SERVICES NEEDED ON THE NORTH SIDE OF 3 80. BE IN FAVOR. ANYONE ELSE? I'LL SEE IT. I'M AGREEING WITH MR MAN'S EYE AND THE, UM I COULD SEE THE NEED. I JUST DON'T LIKE THE IDEA OF THAT INTENSITY. NEIGHBORHOOD AND SPECIFICALLY DRAWING AND MORE FOCUSED AT ALL HOURS. TWO. POSTED THIS. I'M GONNA GO WITH MR WOODRUFF. YOU CANNOT SEE TO HAVE 24 HOURS OF SERVICE ON THAT CORNER ALREADY CURRENTLY IN PLACE. DOES IT MATTER WHETHER IT'S A CONVENIENCE STORE OR A MCDONALD'S OR WHATEVER BURGER OR WHAT IT MAY BE THEY WERE NOT THAT MANY GAS STATIONS AND 3 80 . I THINK THIS IS AN APPROPRIATE USE OF THIS CORNER. BEFORE. WOULD AGREE WITH YOU. YES. WHEN I LOOK AT THE SATELLITE VIEW OF THE AREA. YOU KNOW THERE'S A LOT OF HOMES GOING IN THERE AND THERE AREN'T VERY MANY SERVICES NORTH OF 3 80 LEGACY. FOR THAT REASON I WOULD SUPPORT IT. I AGREE WITH THE APPLICANT, THE BUFFERING IS IN PLACE, AND THIS IS THIS IS A MAJOR INTERSECTION IN MCKINNEY. AND GIVEN THE FACT OF WHAT OTHER USES COULD BE ALLOWED HERE. I'M IN FAVOR OF THE APPLICANT REQUESTS. MEMBERS WHO HAVE EMOTION. I'LL MAKE A MOTION TO APPROVE THE PROPOSED SPECIAL USE PERMIT WITH THE SPECIAL SPECIAL ORDINANCE PROVISIONS LISTED IN THE STAFF REPORT. MR DOPE TO APPROVE THE ANIMALS PER STAFF RECOMMENDATION , INCLUDING THE SPECIAL ORDERS PROVISIONS INCLUDED IN THE STAFF REPORT. SECOND MINISTER WOODRUFF ANY DISCUSSION. EAST CASTOR ABOUT.

THIS MOTION CARRIES BY A VOTE OF FIVE IN FAVOR AND TWO AGAINST THE MOTION THE AND WILL BE SENT TO THE CITY COUNCIL WITH A FAVORABLE RECOMMENDATION FOR FINAL ACTION AT THE AUGUST 2ND 2022 MEETING. A NOTE FOR THE AUDIENCE AND THOSE WATCHING AT HOME. IF YOU DID SUBMIT A COMMENT VIA OUR OWN LINE. COMMENTS UH, SYSTEM. PLEASE KNOW THAT YOUR COMMENTS WILL BE SENT

[Conduct a Public Hearing to Consider/Discuss/Act on a Request to Rezone the Subject Property from “PD” - Planned Development District to “PD” - Planned Development District, Generally to Modify the Development Standards and to Allow for Single Family Residential Uses, Located Approximately 1,430 Feet South of Future Wilmeth Road and on the West Side of Future Taylor Burke Drive]

HEARING REQUEST. REZONED THIS SUBJECT PROPERTY FROM PD TWO PD TO MODIFY THE DEVELOPMENT STANDARDS AND TO ALLOW SINGLE FAMILY RESIDENTIAL USES. JUST 1400 FT. SOUTH OF FUTURE WILMOTH ROAD ON THE WEST SIDE OF TAYLOR BYRD DRIVE, MISS SHEFFIELD, THANK YOU APPLICANTS REQUESTING TO REZONE APPROXIMATELY 7.2 ACRES OF LAND. THESE ARE ANTICIPATED TO BE ABOUT 20.

RESIDENTIAL HOMES FOR SINGLE FAMILY USES WITHIN THE MASTER PEANUT TREE DEVELOPMENT.

CURRENTLY THE PROPERTY IS OWNED P D AS I MENTIONED TO ALLOW FOR THOSE SINGLE FAMILY USES THE APPLICANTS REQUESTING THIS REZONE TO MODIFY THE FRONT YARD SETBACK. FROM A 20 FT FRONT YARD TO A 10 FT FRONT YARD. ALL OTHER DEVELOPMENT REGULATIONS AND THE CURRENT ZONING REMAINING THE SAME. SO AGAIN, THE ONLY MODIFICATION BEING REQUESTED IS THE FRONT YARD SETBACK. THE APPLICANTS DESIGN IS TO EMPHASIZE THESE PROPOSED SHOWCASE SLOTS ON THE ANTICIPATED OUTPOST TRAIL RIGHT AWAY FROM TAYLOR BURKE TO THAT OUTPOST AMENITY CENTER TO THE WEST. STAFF DOES NOT HAVE ANY OBJECTIONS WITH THE PROPOSED FRONT YARD SETBACK REQUEST AND WE FEEL THAT THESE DEVELOPMENT REGULATIONS WILL ADD A VARIETY OF PRODUCT TYPES AND LOT SIZES INTEGRATED WITHIN THE PAINTED TREE DEVELOPMENT. AS SUCH STAFF RECOMMENDS APPROVAL OF THE PROPOSED REQUEST, AND I'LL STAND FOR ANY QUESTIONS. THANK YOU, CAITLIN. ANY QUESTIONS? CAITLYN WHEN WE GO TO 10, FT SETBACKS, UM IS IT? JUST THE A'S REGULATION OF THE CITY'S REGULATION IS FAR AS TREES TOWARDS THE FRONT YARD. SO WITH THE PAINTED TREE DEVELOPMENT, WE ACTUALLY HAD A DEVELOPMENT AGREEMENTS WHEN WE DID THE ANNEXATION OF THE PAINTED TREE NORTH THAT ENCOMPASS PAINTED TREE NORTH AND PAINTED TREATIES THAT WE HAVE HERE RIGHT NOW, WITH THAT DEVELOPMENT AGREEMENT , WE IMPLEMENTED A PARKWAY. THAT INCLUDES PARKING, AS WELL AS TREES WITHIN THE ACTUAL RIGHT AWAY ITSELF, SO THOSE TREES TYPICALLY REQUIRED FOR THOSE SINGLE FAMILY LIGHTS WILL NOW BE ALONG THE RIGHT OF WAY. AND SO THERE WILL BE A TRUE TIN FOOT SETBACK WITHIN THE SINGLE FAMILY LOT. TO THE HOME. WE'VE HAD ISSUES WITH TOWN HOMES COMING BEFORE US BEFORE. THAT HAD TREES PLANTED IN THERE THAT FOUNDATION AND SIDEWALK DAMAGE WHEN OUR SETBACKS WEREN'T DEEP ENOUGH. SO THAT'S ALL CONSIDERED HERE WHEN THAT IS CORRECT, AND THAT'S WAS PART OF THE DRIVING FACTOR FOR THE PARKWAY. TREES WITH THAT UPDATED STREET SECTION WAS TO ENSURE THAT WE DID HAVE THOSE ADEQUATE TREES WITHIN THE RIGHT OF WAY AND NO ISSUES WITH FOUNDATION. THANK YOU. THAT'S AN EXCELLENT POINT. MR MEN'S I EXCELLENT POINT. ANYONE ELSE? VERY GOOD. THANK YOU, CAITLIN. THEIR APPLICANT HERE TONIGHT. THE WILL BE MAINTAINING THE FRONT YARDS, SO THERE WILL BE NO HOMEOWNERS MAINTAINING ANY OF IT. IT WILL BE ONE CONTINUOUS KIND OF LANDSCAPE PROGRAM. HAPPY TO ANSWER ANY QUESTIONS. YOUR LAST COMMENT MAY HAVE SAVED SOME QUESTIONS. YEAH. JUST OUT OF CURIOSITY YOU DO AND MAINTAINING JUST FOR THE MAIN ROAD ARE YOU DOING THROUGHOUT THE WHOLE SUBDIVISION AND THE FRONT YARD JUST FOR THESE LOTS IN PARTICULAR JUST FOR THE SHOWCASE SLIDES. UM PERMITS FOR THESE WILL PROBABLY COME LATER THIS YEAR, BUT THEY I MEAN, THIS WHOLE PHASE OF PENETRATE AS A PRIORITY SO MM.
