ALRIGHT NOW WE'RE COOKING WITH GAS. ALRIGHT, PERFECT. ALRIGHT. SORRY ABOUT THAT GUYS. ALRIGHT SO WE ARE NEARING THE FINISH LINE OF OUR NEW CODE. MCKINNEY CODE OVERHAUL PROJECT AND AS WE GET CLOSE TO THAT ADOPTION DATE , WE WANTED TO PAUSE BOTH WITH PLANNING AND ZONING COMMISSION AND ALSO WITH THE CITY COUNCIL TO WALK THROUGH SOME OF THE KEY HIGHLIGHTS OF THE INITIATIVE IN GENERAL, AND WE WANT TO BE ABLE TO COVER WITH YOU ALL TONIGHT. UM SOME OF THE MAJOR CHANGES OR NOTEWORTHY CHANGE CHANGES WITH THE NEW CODE INITIATIVE, THE PUBLIC OUTREACH AND ENGAGEMENT THAT WE HAVE BEEN UNDERWAY WITH OVER THE LAST THREE MONTHS AND THEN JUST A REMINDER OF THE ADOPTION STRATEGY, AND WE ALSO WANT TO HIGHLIGHT A COUPLE OF THE SPECIFICS RELATED TO THAT ADOPTION STRATEGY. SO AS A REMINDER OF THIS PARTICULAR PROJECT HAS BEEN ONE THAT WE HAVE BEEN WORKING ON FOR QUITE SOME TIME. NOW. WE'RE ACTUALLY JUST ABOUT THE THREE YEAR MARK FROM START TO FINISH. WE DID WALK THROUGH THIS VERY SEQUENTIALLY. WE WERE REALLY FOCUSED INITIALLY ON UNDERSTANDING SOME OF THE IMPEDIMENTS OF OUR CURRENT CODE, DOING A LOT OF STAKEHOLDER OUTREACH AND ASSESSMENTS. AND THEN, UM, OVER THE LAST 2.5 YEARS, REALLY TRYING TO REBUILD THAT CODE AND THREE DISTINCT SECTIONS, WHICH ARE HIGHLIGHTED HERE FIRST BEING THAT ADMINISTRATION INFRA STREET PROCEDURES, ZONING DISTRICTS AND USES THEN DEVELOPMENT STANDARDS . AND THEN NOW THIS WHAT WE CALL THE CONSOLIDATED CODE, WHICH IS EVERYTHING ALL BUNDLED INTO ONE. I LIKE THIS SLIDE BECAUSE I THINK ONE OF THE THINGS THAT WE HEARD EARLY ON WITH THIS PROCESS , BOTH FROM MEMBERS OF PLANNING AND ZONING COMMISSION AND MEMBERS OF COUNCIL WAS MAKING SURE AN INITIATIVE SUCH AS THIS IS NOT SOMETHING THAT GOES UNDER

THE RADAR UNNOTICED BY PEOPLE WHO MAY BE IMPACTED BY IT. SO THIS, UH, LOOK AHEAD AND LOOK BACK SUMMARY HIGHLIGHTS THE KEY COMPONENTS OF THE INITIATIVE AND ALSO WHERE WE HAD BUILT IN WHAT I CALL CHECKPOINTS ALONG THE WAY. BOTH WITH P AND Z. R MCKINNEY DEVELOPMENT COMMITTEE, MEMBERS OF THE PUBLIC AND MEMBERS OF THE DEVELOPMENT COMMUNITY AS WELL SO YOU CAN SEE BILTON WITHIN WITHIN EACH ONE OF THOSE STEPS WHERE WE KIND OF TOOK THAT PAUSE TO GO OUT, PRESENT THE INFORMATION AND GET SOME FEEDBACK AS WELL. SO LET'S GET INTO THE MEAT OF SOME OF THE HIGHLIGHTED CHANGES WITH OUR NEW CODE INITIATIVE AS A REMINDER, THESE WERE THE MAJOR PROJECT GOALS THAT WE HAD WHEN WE STARTED THIS PROJECT THREE YEARS AGO, UM, IMPLEMENTING THE COMPREHENSIVE PLAN INTEGRATING BEST PRACTICES, ALIGNING OURSELVES WITH STATE AND FEDERAL LAWS. SIMPLIFYING THE REGULATIONS, IMPROVING USER FRIENDLINESS, PROCESSES AND PROCEDURES, FLEXIBILITY AND OBVIOUSLY ENCOURAGING HIGH QUALITY DEVELOPMENT. I WILL TELL YOU THAT THE BULK OF OUR WORK REALLY FOCUSED ON THOSE LAST FIVE BULLET POINTS, REALLY TRYING TO IMPROVE THE ADMINISTRATION AND THE COMPONENTS OF OUR CODE. I THINK THOSE FIRST THREE OR WHAT I WOULD CONSIDER SORT OF NO BRAINERS. OF COURSE, THOSE ARE THE THINGS WE WANT TO DO. BUT WE REALLY FOCUSED A LOT OF OUR EFFORTS ON MAKING SURE WE HAD A CLEAN, CONCISE AND MARKET DRIVEN CODE, SOMETHING THAT IS RESPONSIVE TO WHERE WE ARE IN TODAY'S DEVELOPMENT CLIMATES. SO WE'VE TALKED ABOUT THIS QUITE A BIT ALONG THE WAY, BUT WE ARE MOVING FROM A SERIES OF DEVELOPMENT CODES INTO WHAT I WHAT WE CALL A UNIFIED DEVELOPMENT CODE. SO RIGHT NOW AND THE MCKINNEY CODE OF ORDINANCES. THERE ARE MANY DIFFERENT CHAPTERS THAT SPEAK TO DEVELOPMENT. WE ARE PROPOSING THAT WE CONSOLIDATE ALL OF THOSE CHAPTERS INTO ONE BIG CODE. IT'S SORT OF A CODE WITHIN A CODE, AND SO WE ARE CONSOLIDATING ALL OF THOSE DEVELOPMENT REGULATIONS , SO IT'S A LITTLE BIT EASIER FOR FOLKS TO FIND WHAT THEY NEED WHEN THEY'RE DEVELOPING IN THE CITY OF MCKINNEY. HIGHLIGHT REAL QUICKLY THAT INCLUDES OUR ZONING ORDINANCE. OUR SUBDIVISION ORDINANCE ARE SIGN CODE. OUR EXTERIOR LIGHTING CODE. FENCES AND STORMWATER MANAGEMENT, AND WE'RE GOING TO TOUCH ON THOSE BRIEFLY AS WE GO THROUGH THIS PRESENTATION. AS IT RELATES TO OUR ZONING CODE AND SOME OF THE DEVELOPMENT REGULATIONS. ONE OF THE THINGS WE WANTED TO DO WAS SIMPLIFY HOW PEOPLE ACTUALLY READ AND UNDERSTAND WHAT THE REQUIREMENTS ARE FOR THEIR PROJECTS. SO SOME OF THE KEY CHANGES THAT WE UNDERTOOK IN ORDER TO HELP SIMPLIFY REGULATIONS ARE HIGHLIGHTED HERE . WE AIMED TO SIMPLIFY OUR PARKING LOT LANDSCAPE REQUIREMENTS. THAT'S THE EXAMPLE THAT YOU SEE HERE ON THE RIGHT ARE CURRENT CODE IS NOTHING BUT TEXT. IT'S REALLY WHAT I CONSIDER A LAUNDRY LIST OF REQUIREMENTS WHEN YOU'RE DEVELOPING OR FREE OR LANDSCAPING REQUIREMENTS IN A PARKING LOT. WE HAVE COMBINED NOT ONLY TEXT BUT ALSO IMAGES AND ILLUSTRATIONS. TO REALLY CALL OUT THE THINGS THAT WE'RE TALKING ABOUT. AND WHERE POSSIBLE. WE'RE ALSO WE'VE ALSO INTEGRATED. TABLES AND CHARTS. SO IT'S AN EASY QUICK REFERENCE FOR FOLKS AS OPPOSED TO HAVING TO READ THROUGH A BUNCH OF BULLETS. BUNDLE A LOT OF ITEMS UNDER ONE BROAD CODE. WE'VE ACTUALLY BROKEN THEM OUT SO THAT SERVICE BASED FOR AUTO USES, ARE NOW TREATED SEPARATELY FROM LOADING DOCKS FOR THE BACK OF A WALMART. UM SOME OF THE STANDARDS MAY BE THE SAME, BUT WE'RE REALLY TREATING THEM AS INDEPENDENT FEATURES ON A SITE AS OPPOSED TO ALL IN ONE BIG BUCKET, AND THAT WILL HELP HOPEFULLY MAKE MORE CLEAR FOR FOLKS WHAT'S REQUIRED. AND THEN WE'VE DONE A COMPLETE OVERHAUL OF THE CITY'S LIGHTING CODE, THEIR CURRENT LIGHTING CODE THAT WE HAVE IN PLACE NOW HAS BEEN AROUND FOR A LONG TIME. AND YOU HAVE TO HAVE A PHD IN MATH TO UNDERSTAND THE EQUATIONS FOR THE ILLUMINATION REQUIREMENTS. WE HAVE DONE AWAY WITH THAT, AND WE ARE MORE CONSISTENT NOW WITH OUR SISTER CITIES AND USING REALLY, UH, STANDARDIZED MEASURES FOR LIGHT. OKAY WE ALSO AIM TO IMPROVE USER FRIENDLINESS OVERALL, AND I KIND OF HIGHLIGHTED THIS A MINUTE AGO. BUT IN GENERAL, THE FORMAT HAS CHANGED COMPLETELY, RATHER THAN A TEXT HEAVY CODE WE ARE TRYING . WE HAVE AIMED TO DO A LOT OF BULLET POINTS. SIMPLIFIED LANGUAGE ILLUSTRATIONS, TABLES AND CHARGE TABLES AND CHARTS WHERE WE CAN AND CONSISTENT FORMATTING FROM ONE SECTION TO ANOTHER. IN OUR CURRENT CODE READING OUR LANDSCAPING STANDARDS LOOKS VERY DIFFERENT THAN READING OUR PARKING

STANDARDS. AND SO WE WANTED TO MAKE SURE THAT THERE WAS THE SAME SORT OF CADENCE AND RHYTHM WITHIN EACH COMPONENT OF THE CODE SO THAT IT BECOMES FAMILIAR AS YOU'RE LOOKING THROUGH IT. IN ADDITION TO THE CODE ITSELF, ONE OF THE OTHER THINGS THAT WE TOOK ON TO HELP IMPROVE USER FRIENDLINESS IS THE CREATION OF THIS DEVELOPMENT GUIDE. AND THIS IS REALLY A RESOURCE. THAT IS, UM, A SUPPLEMENT TO THE CODE. IT IS NOT THE CODE ITSELF, BUT IT IS A USER FRIENDLY GUIDE FOR SOMEBODY WHO'S DEVELOPING TO SAY, OKAY, WHAT DO I NEED TO KNOW ABOUT THE PROCESS THAT I NEED TO FOLLOW? AND SO THAT USERS ARE THAT DEVELOPMENT GUIDE IS VERY GRAPHIC. IT IS A LOT OF TABLES, UM, AND FLOW CHARTS A LOT OF COLOR COORDINATION TO THE CODE AND REFERENCES TO THE CODE, BUT IT'S INTENDED TO BE THAT LAY PERSONS, YOU KNOW, GUIDE TO THE MCKINNEY DEVELOPMENT CODE AND THE MCKINNEY DEVELOPMENT PROCESS. IN TERMS OF PROCESSES AND PROCEDURES. MOST OF WHAT MOST OF THE WAYS IN WHICH WE PROCESS PROJECTS HERE IN MCKINNEY WILL REMAIN THE SAME SITE PLANS WILL CONTINUE TO BE STAFF APPROVALS UNLESS THEY'RE SEEKING SOME SORT OF WHAT WE CALL DESIGN EXCEPTION. VERY FAMILIAR PROCESSES. AND THOSE ARE REALLY NOT CHANGING. THINK THE ONE THING THAT WE DID WANT TO HIGHLIGHT HERE? IS THAT THE PROCESSING FOR PLATZ WILL CHANGE AND WE DO THINK THAT IT IS FOR THE BETTER. SO AS YOU'LL SEE HERE, OUR CURRENT CODE, WE HAVE A NUMBER OF DIFFERENT PLATZ. UM, THE PLANTS THAT ARE LISTED IN BLUE UNDER OUR CURRENT CODE.

PRELIMINARY FINAL PLATT PRELIMINARY FINAL RE PLOT AND RECORD PLATT. THOSE ARE VERY UNIQUE TO MCKINNEY IF YOU WERE TO GO IN ANY OTHER NORTH TEXAS CITY, THEY DID NOT HAVE THOSE TYPES OF PLATTS. THOSE WERE THINGS THAT WERE CREATED IN MCKINNEY. MANY MANY YEARS AGO AND THEY'VE BEEN A GREAT TOOL. HOWEVER, THEY TEND TO CAUSE CONFUSION FOR A LOT OF FOLKS.

AND WITH THE NEW CODE, WE ARE PROPOSING TO BE MORE IN LINE WITH STATE LAW AND ARE SISTER CITIES IN TERMS OF PLANNING PROCESSES. SO INSTEAD OF HAVING A PRELIMINARY FINAL CLASS, YOU WOULD JUST HAVE A PRELIMINARY FLAT INSTEAD OF THIS THING CALLED A RECORD, PLATT, YOU JUST HAVE A FINAL PLOT. AND THAT IS VERY CONSISTENT ACROSS THE BOARD. ONE OF THE ONE OF THE BIG CHANGES THAT WE ARE PROPOSING WITH THE NEW CODE. IS CURRENTLY A PRELIMINARY FINAL. PLATT IS REQUIRED ON ALL DEVELOPMENT PROJECTS THAT ARE OVER FOUR LOTS AND REQUIRE THE EXTENSION OR DEDICATION OF PUBLIC INFRASTRUCTURE OR ROADWAYS WITH THE NEW CODE. A PRELIMINARY PLATT WILL ONLY BE REQUIRED IF YOU'RE DOING A PHASE TWO DEVELOPMENT. SO FOR THE MOST PART, WE TEND TO THINK THAT THIS WILL REALLY ONLY BE UTILIZED IN SINGLE FAMILY RESIDENTIAL SO AS ON A SMALL COMMERCIAL DEVELOPMENT PROJECT, YOU'RE POTENTIALLY LOOKING AT A ONE PLATT STEP AS OPPOSED TO RIGHT NOW WHERE WE REQUIRE IT TO PLAT STEP. SO WE'VE ALSO LOOKED AT INTRODUCING SOME ADDITIONAL FLEXIBILITY WITHIN OUR NEW CODE. SOME OF THIS WE HAVE EXISTING IN DIFFERENT FORMS, BUT WE REALLY WANTED TO CONSOLIDATE AND CLARIFY IT WITH THE NEW CODE. SO IN TERMS OF FLEXIBILITY, WHAT WE'RE PROPOSING IS THE INTRODUCTION OF THE SEA LAND USE PROVISIONS, AND WE'VE TALKED ABOUT THIS BEFORE. IN OUR CURRENT CODE USES ARE EITHER PERMITTED BY RIGHT OR THEY ARE PERMITTED BY WHAT WE CALL THAT S U P PROCESSOR. SPECIFIC USE PERMIT THAT REQUIRES A PUBLIC HEARING THROUGH PLANNING AND ZONING COMMISSION AND THE CITY COUNCIL. THERE IS NO IN BETWEEN AND WHAT WE ARE PROPOSING WITH THE NEW CODE IS AN IN BETWEEN THIS SEA BY CRITERIA. I WOULD SAY THAT CERTAIN USES ARE PERMITTED BY RIGHT SO LONG AS THEY NEED A CERTAIN CRITERIA, AND I WILL GIVE AN EXAMPLE OF A GAS STATION, A GAS STATION MAY OTHERWISE REQUIRE AN S U P BUT UNDER THE NEW CODE IF THEY MEET CERTAIN CRITERIA, IT'S LESS THAN EIGHT PUMPS. IT'S NOT ORIENTED TOWARDS UM RESIDENTIAL IT MAY BE PERMITTED JUST BY RIGHT AS LONG AS IT MEETS THAT THRESHOLD CRITERIA AND SO THIS REALLY ALLOWS FOR SOME ADDITIONAL FLEXIBILITY AND USE WITHOUT THAT EXTRA WHAT WE WOULD CONSIDER BUREAUCRATIC STEP BECAUSE A LOT OF TIMES WE FIND THAT SOME OF THESE USES ARE GETTING AN S U P AND IT'S THE SAME KIND OF REQUEST EVERY SINGLE TIME THAT'S GETTING THE SAME KIND OF APPROVALS EVERY SINGLE TIME. SO THAT CRITERIA IS ESTABLISHED BASED ON PREVIOUS APPROVALS AND THINGS THAT WE KNOW ABOUT DEVELOPMENT HERE IN MCKINNEY, BASED ON WHAT WE'VE SEEN OVER TIME. TREE PRESERVATION HAS ALWAYS BEEN ONE OF THOSE HOT TOPICS HERE IN MCKINNEY, SPECIFICALLY, THE TREE PRESERVATION PLAN AND THE TREE SURVEY, AND THAT WAS DEFINITELY SOMETHING THAT WE GOT A LOT OF FEEDBACK ON EARLY. AND THE IDEA IS THAT A TREE SURVEY CAN REQUIRE A LOT OF TIME COMMITMENT . A LOT OF COST COMMITMENT VERY EARLY ON IN A DEVELOPMENT PROCESS, AND SO WE WERE ASKED TO

LOOK AT WAYS TO IMPROVE THAT. WITH THE NEW CODE. WE ARE PROPOSING A NEW AERIAL EXHIBIT, UM, WITH IN LIEU OF A TREE SURVEY. IF YOU MEET CERTAIN CRITERIA THAT ARIEL EXHIBIT IN LIEU OF A TREE SURVEY WILL COME AT A COST, BUT WE DO THINK THAT THAT COST WOULD OUTWEIGH. UM YOU KNOW IF THERE WAS A DEVELOPER OR DEVELOPMENT PROJECT THAT MAY OTHERWISE FEEL HAMSTRUNG BY HAVING TO DO THE TRADITIONAL TREE SURVEY THIS WAS SOMETHING THAT WE SPENT A LOT OF TIME TALKING ABOUT AS A STAFF BECAUSE WE REALLY HAD TO UNPACK WHAT WE WERE LOOKING FOR WITH THE TREE SURVEY. WHAT WAS THE BENEFIT OF A TREE SURVEY? UM AND THEN MCKINNEY. TYPICALLY EVERYBODY IS REQUIRED TO DO A TREE SURVEY. IF THERE IS A TREE ON YOUR DEVELOPMENT SITE, HOWEVER, THERE ARE A NUMBER OF EXEMPTIONS TO TREES THAT CAN GET REMOVED AS PART OF THE DEVELOPMENT SITE. SO FOR EXAMPLE, IF I HAVE A SITE THAT HAS, YOU KNOW, 100 TREES ON IT. ALL 100 OF THOSE TREES ARE WITHIN MY BUILDING FOOTPRINT. I CAN CUT DOWN THOSE TREES WITH NO PENALTY. I DON'T HAVE TO MAKE ANY PAYMENTS FOR THAT, AND THAT IS ALLOWED BY RIGHT UNDER OUR CURRENT CODE. AND WE'VE GOTTEN A LOT OF FEEDBACK FROM THE DEVELOPMENT COMMUNITY, SAYING I'M HAVING TO SURVEY ALL OF THESE TREES THAT I'M ALLOWED TO CUT DOWN BY RIGHT AND IT'S EATING A LOT OF TIME AND A LOT OF COST TO MY PROJECT. HOW CAN WE MEET IN THE MIDDLE? WILL THIS AERIAL EXHIBIT ALLOWS US TO GET A SCAN OF THE TREES THAT ARE ON THE SITE? AND WE ARE ABLE TO IDENTIFY. UM NOT IDENTIFIED BUT AT A COST TO THE DEVELOPER TO SAY, LOOK, WE WILL ASSUME THAT THAT YOU HAVE A CERTAIN NUMBER OF SPECIMEN TREES ON YOUR SITE, AND, UM, YOU CAN PAY A FEE IN LIEU OF ACTUALLY DOING THAT TREE SURVEY. IF YOU DO THIS AERIAL SURVEY AND MAKE THAT ASSUMPTION THAT YOU'VE GOT HERITAGE TREES OR SPECIMEN TREES ON YOUR SITE. AND SO WE DO FEEL LIKE THAT'S A GOOD MEET IN THE MIDDLE FOR SOMEBODY WHO MAY OR MAY NOT WANT TO DO THAT TREE SURVEY. WE'RE ALSO INTRODUCING ALTERNATE COMPLIANCE, UM, FOR THINGS LIKE ROOFTOP SCREENING AND MULTI FAMILY PARKING REDUCTIONS. THESE ARE THINGS THAT ARE VERY SIMILAR TO WHAT WE'RE LOOKING USED TO LOOKING AT NOW, UM AND THEY WILL BE FOLDED IN AS BY RIGHT COMPLIANCE OPTIONS. UPDATES ON THE WEBSITE PRESENTATIONS TO THE PLANNING AND ZONING COMMISSION AND CITY COUNCIL AND OUR MCKINNEY DEVELOPMENT, COMMUNITY OR COMMITTEE TO MAKE SURE THAT THEY KNEW THAT THAT CODE WAS AVAILABLE FOR REVIEW. UM AND THEN WE ALSO HAD THAT FEEDBACK LOOP OF A PUBLIC SURVEY AND A TECHNICAL COMMITTEE REVIEW, WHICH I'LL TALK ABOUT HERE IN JUST A MINUTE. ONCE THAT NEW CODE WAS RELEASED IN JUNE. WE SPENT QUITE A BIT OF TIME ACTUALLY DOING PROACTIVE OUTREACH WITH MEMBERS OF THE DEVELOPMENT, COMMUNITY AND PROPERTY OWNERS, SO WE WERE SENDING OUT ROUTINE EMAILS. UM WE WERE PROVIDING SOCIAL MEDIA POSTS AND AN ONGOING EFFORT AND WE WERE ALSO HOSTING WHAT WE CALL DROP IN MEETINGS. WE HOSTED SIX STRAPPING MEETINGS OVER THE COURSE OF TWO WEEKS. AND ALSO SMALL GROUP MEETINGS WHERE WE ACTUALLY REACHED OUT TO PROPERTY OWNERS WHO OWN A LOT OF PROPERTY OR WHO HAVE PERHAPS A MAJOR DEVELOPMENT UNDERWAY. FOR EXAMPLE, PAINTED TREE WAS ONE OF THOSE DEVELOPERS THAT WE ACTUALLY REACHED OUT TO PROACTIVELY RAYTHEON AND ENCORE , FOLKS THAT WE KNOW HAVE HAD ACTIVE DEVELOPMENT PROJECTS OR FUTURE DEVELOPMENT PLANS. WE ACTUALLY REACHED OUT TO THEM AND MET WITH THEM INDIVIDUALLY. TO MAKE SURE THAT THEY UNDERSTOOD WHAT THE POTENTIAL CHANGES TO THE CODE MIGHT MEAN FOR THEM. AND THEN NOW WE'RE HERE AT THIS FINAL STEP, WHICH IS WHAT I CALL THE LEGAL STUFF AND THAT IS REALLY PREPPING OURSELVES FOR THE POTENTIAL ADOPTION OF THE NEW CODE PRESENT INFORMATION TO PLANNING AND ZONING COMMISSION AND THE CITY COUNCIL FOR ADOPTION, AND I WILL TALK A LITTLE BIT ABOUT WHAT THOSE SPECIFIC STEPS ARE HERE IN JUST A FEW MINUTES, BUT BEFORE I DO THAT, I WANNA TOUCH BACK ON WHAT I CONSIDER THE FEEDBACK LOOP ON THESE OUTREACH EFFORTS THAT WE'VE HAD UNDERWAY SINCE JUNE. SO FROM THE PUBLIC SIDE OF THINGS WE HOSTED AN ONLINE SURVEY AND THOSE INFORMATIONAL SESSIONS BETWEEN JUNE AND THE END OF AUGUST. WHAT WE HEARD DURING THOSE FEEDBACK SESSIONS WERE SUGGESTIONS FOR A HANDBOOK OR GUIDEBOOK. THAT DEVELOPMENT GUIDE. UM OBVIOUSLY A LOT OF CONCERNS FROM GENERAL PUBLIC ABOUT MAKING SURE THAT WE HAD RESIDENTIAL PROTECTIONS AND ENGAGEMENT OPPORTUNITIES AS PART OF THE DEVELOPMENT CYCLE. HOUSING AND DIVERSITY AND AFFORDABILITY. UM BEING A CONTINUED, UM. POINT OF INTEREST FOR RESIDENTS AND THEN SUSTAINABLE BUILDING PRACTICES AND DEVELOPMENT PRACTICES. SO THAT WAS THE MAIN THOSE WERE THE MAIN PIECES OF FEEDBACK THAT WE HEARD FROM THE GENERAL PUBLIC. ON OUR TARGETED FEEDBACK SIDE THROUGH THE MDC STAFF REVIEW IN THE SMALL GROUP MEETINGS. WE HEARD A NUMBER OF THINGS, MOST OF IT FOR PRETTY PRETTY POSITIVE , BUT WE DID GET SOME SPECIFIC COMMENTS BACK ON THAT TECHNICAL REVIEW. ONE WAS SPECIFIC TO THAT HOUSING, DIVERSITY AND AFFORDABILITY QUESTION, MAKING SURE THAT UM, THE RESIDENTIAL ZONING DISTRICTS AND RESIDENTIAL ZONING STANDARDS WEREN'T OVERPRICING THE DEVELOPMENT COSTS AT THE RISK OF AFFORDABILITY AND THEN SOME VERY SPECIFIC COMMENTS ABOUT THE WAY IN WHICH SIDE YARDS AND ENCROACHMENTS WORK IN SINGLE FAMILY, RESIDENTIAL ZONING DISTRICTS. SO WE ACTUALLY TOOK ALL OF THAT, AND WE WERE ABLE TO INJECT SOME SLIGHT TWEAKS TO THE CODE BASED ON THAT FEEDBACK, SO THE THINGS THAT WE HEARD BOTH FROM THE PUBLIC AND FROM OUR TECHNICAL REVIEW ACTUALLY WENT BACK TO THE TABLE WENT OUT AND GOT INJECTED INTO THAT CODE. AND THAT KIND OF DISCOVERED THAT SO MAKING SURE THAT WE CLEAN THINGS CLEAN UP ANY TYPOS MISSPELLINGS AND YOU KNOW QUICK CHANGES THAT WE NEEDED TO MAKE UPDATING THOSE ENCROACHMENTS AND EXCEPTIONS CONTINUING TO DEVELOP THAT DEVELOPMENT GUIDE AND HIGHLIGHTING FOR RESIDENTS THAT THERE IS THAT NEW RESIDENTIAL ADJACENCY. UM PROVISIONS WITHIN THAT NEW CODE. LET'S TALK A LITTLE BIT ABOUT IMPLEMENTATION. SO THAT'S A REMINDER AND WE TALKED ABOUT THIS AT A PREVIOUS WORK SESSION. WE WANT TO MAKE SURE THAT YOU STILL HAVE THAT OPTION TO DO THAT GAS STATION UNDER THE CURRENT CODE, IF YOU ARE REALLY PURSUING THAT AS A DEVELOPMENT PROJECT AND SO THAT'S ONE OF THE MAIN REASONS WHY WE'RE REALLY ONLY LOOKING AT THAT DUAL CODE OPTION FOR THE ZONING ORDINANCE, SUBDIVISION AND PLANNING REQUIREMENTS CAN BE BECOME EFFECTIVE IMMEDIATELY WITH LITTLE TO NO IMPACT ON, UM A DEVELOPERS PROCESS OR TIMELINES. SAME THING FOR SIGNAGE, LIGHTING STORM WATER.

UM WITH THAT DUAL CODE, THERE'S NO MIXING AND MATCHING YOU DON'T GET TO SAY I WANT THE USER ENTITLEMENTS OF THE CURRENT CODE , BUT THE DEVELOPMENT STANDARDS OF THE NEW CODE. IF YOU ARE COMMITTED TO THE CURRENT CODE, YOU WOULD BE LOCKED IN ON THAT CURRENT CODE. UM OR LOCKED IN ON THAT NEW CODE. IT WILL BE AN APPLICANT'S CHOICE AT THE TIME THEY SUBMIT THEIR PROJECT AND THEY ABSOLUTELY HAVE THE ABILITY TO SAY, HEY, I WANT TO TRY AND DEVELOP UNDER THE CURRENT CODE.

AND THEN REALIZE THAT YOU KNOW WHAT? THIS IS NOT WORKING FOR ME. I THINK I WANT TO DEVELOP UNDER THE NEW CODE ABSOLUTELY HAVE THE OPPORTUNITY TO DECIDE WHETHER OR NOT THEY WANT TO SHIFT FROM ONE CODE TO THE OTHER. WE WILL ASK THAT IF SOMEBODY WANTS TO DO THAT, THEY WILL HAVE TO PROVIDE US WITH A NEW SUBMITTAL TO SHIFT. YOU CAN'T START WITH START UNDER ONE CODE UNDER ONE SUBMITTAL AND THEN TRY AND CHANGE TO A DIFFERENT CODE. HALFWAY THROUGH THAT REVIEW, IT WILL REQUIRE A NEW SUBMITTAL FOR US TO RE INITIATE THAT PROCESS, AND THAT REALLY IS TO MAKE SURE THAT FOLKS AREN'T MIXING AND MATCHING OR AREN'T TRYING TO GO IN BETWEEN TWO CODES TO SEE WHAT'S BETTER AND WHAT'S WORTH WORSE FOR THEM.
