CHAPTER 1 30 ARTICLE FOR STORM WATER STORMWATER MANAGEMENT ORDINANCE RELOCATING THE FOREGOING DEVELOPMENT REGULATIONS INTO A UNIFIED DEVELOPMENT CODE IN ACCOMPANYING ORDINANCE, JENNIFER THANK YOU, MR MAYOR. I'M NOT GOING TO DO A LOT OF TALKING. I'M ACTUALLY GOING TO LET MATT GLOBAL R CONSULTANT WITH CLARIION ASSOCIATES AND AARON BLOCKS IN DO A LOT OF THE PRESENTATION THIS EVENING. BUT AS YOU WELL KNOW, THIS IS A PROJECT WE HAVE BEEN WORKING ON FOR ALMOST THREE YEARS NOW AND TONIGHT IS THE CULMINATION OF THESE EFFORTS AND WE'RE VERY EXCITED TO PRESENT TO YOU THIS FINAL CODE. IF YOU WERE JUST INDULGE US FOR A FEW MORE MOMENTS WITH THIS ITEM TO WALK THROUGH SOME OF THE HIGHLIGHTS OF THE PROPOSED UDC RECOMMENDATIONS ON THE ADOPTION STRATEGY, AND THEN JUST ANY QUESTIONS OR COMMENTS THAT YOU ALL HAVE SO WITH THAT I'M ACTUALLY GOING TO TURN IT OVER TO MATH. IT'S BEEN A LONG HAUL, SO WE'RE EXCITED TO BE HERE. THIS IS THE NEXT IMPORTANT OPPORTUNITY FOR MCKINNEY. WE HAVE A VERY BRIEF PRESENTATION FOR YOU JUST TO HIT SOME OF THE HIGHLIGHTS AND WHERE WE'VE BEEN. WE'RE GOING TO TALK A LITTLE BIT ABOUT JUST THE SOME OF THE ORIGINAL GOALS THAT WE HAVE FOR THE PROJECT. SOME OF THE HIGHLIGHTS OF THE CONSOLIDATED CODE, WE'RE GONNA TALK ABOUT SOME OF THE HIGHLIGHTS OF THE PUBLIC OUTREACH STRATEGY THAT WE'VE BEEN THROUGH WITH. WITH HER STAFF OVER THE PAST FEW YEARS AND THEN FINALLY WILL CONCLUDE BY TALKING ABOUT NEXT STEPS FOR ADOPTION TONIGHT.

HOPEFULLY UM, JUST A LITTLE BIT VERY BRIEFLY, JUST TO REMIND YOU WHO WE ARE. CLEARING ASSOCIATES WAS PART OF THE TEAM THAT WORKED WITH YOUR STAFF. THIS WAS VERY MUCH A STAFF DRIVEN EFFORT, BUT WE WERE HAPPY TO ASSIST THEM. WE'VE GOT A LOT OF EXPERIENCE WITH CODES IN TEXAS AND AROUND THE COUNTRY WERE VERY EXCITED TO ADD MCKINNEY TO THIS LIST. I THINK IT'S GOING TO REALLY BE A UNIQUE EXAMPLE AND REALLY STRONG EXAMPLE OF MODERN TEXAS CODE ONE OF THE THINGS THAT'S REALLY IMPORTANT TO US AS A FIRM IS THAT WE ALWAYS WORK WITH THE COMMUNITIES TO IMPLEMENT THEIR ADOPTED PLANS. THESE ARE JUST EXAMPLES FROM OTHER COMMUNITIES LIKE DENTON. YOU SEE THERE ON THE BOTTOM OF THE SLIDE, BUT THEN HAS THE DEBT AND PLAN 2030 TURNED THAT INTO THE DEVELOPMENT CODE THAT WE WORKED ON WITH THEM. AND THEN THAT TURNED INTO CHANGES ON THE ZONING MAP AND ACTUALLY CHANGES IN THE BUILT ENVIRONMENT. YOU'VE GOT THE OUTSTANDING ONE MCKINNEY 2040 PLAN, WHICH WAS OUR GUIDING PRINCIPLES FOR THIS PROJECT, AND WE'RE GOING TO TALK A LOT MORE ABOUT SOME OF THE PRINCIPLES FROM THAT PLAN THAT WERE IMPLEMENTED HERE. ONE OF THE REASONS I THINK THAT WE WERE ASKED TO COME TO THE TABLE IS THAT WE DO HAVE A LOT OF CODE EXPERIENCE FROM AROUND THE COUNTRY. THINKING THROUGH THINGS LIKE FORM BASED ZONING AND REGULATION OF AESTHETICS. AND SO WE TRIED TO BRING A LOT OF THAT NATIONAL KNOWLEDGE TO THE MCKINNEY STAFF SO THEY CAN THINK THROUGH WHICH LESSONS WERE MOST APPROPRIATE FOR MCKINNEY. WE HAD A VERY ROBUST PUBLIC ENGAGEMENT STRATEGY. THIS IS IMPORTANT FOR ALL OF OUR PROJECTS, AND I THINK WE REALLY TRIED TO TAILOR THIS STRATEGY TO MCKINNEY THROUGHOUT THIS PROJECT. I THINK, FOR EXAMPLE, REGULAR MEETINGS WITH THE MCKINNEY DEVELOPMENT COMMITTEE WERE REALLY IMPORTANT AND INTRODUCING A LOT OF THESE IDEAS, SO THAT NOW WHEN WE GET TO THE ADOPTION STAGE, THE COMMUNITY IS FAMILIAR WITH A LOT OF THE IDEAS THAT HAVE BEEN PROPOSED. I THINK THE PUBLIC ENGAGEMENT STRATEGY THAT THE STAFF HAS ROLLED OUT HAS BEEN REALLY SUCCESSFUL. UM ANOTHER THING VERY IMPORTANT FOR ALL OF OUR CODE PROJECTS IS A FOCUS ON USER FRIENDLINESS, SUMMARY

TABLES AND GRAPHICS AND PLAIN ENGLISH AND CLEAR ILLUSTRATIONS . I THINK ALL OF THESE THINGS ARE VERY IMPORTANT TO US IN PRACTICE, AND I THINK YOU'LL SEE A LOT OF THOSE EXAMPLES IN THE CODE THAT AARON TALKS ABOUT WHEN HE WALKS YOU THROUGH SOME OF THE HIGHLIGHTS. OF THE NEW MCKINNEY CODE AGAIN, PICTURE CAN CAN CAN TELL 1000 WORDS. AND I THINK A LOT OF THE ILLUSTRATIONS THAT WERE BROUGHT TO THE TABLE WILL BE VERY HELPFUL AND HELPING MCKINNEY STAKEHOLDERS UNDERSTAND WHAT'S BEEN, UM WHAT'S BEEN PROPOSED IN TERMS OF NEW REGULATIONS. UM SO THOSE ARE GENERAL PRINCIPLES INVOLVED IN ALL OF OUR PROJECTS. WE HAD A VERY SPECIFIC TAILORED APPROACH FOR MCKINNEY THAT WE WALKED THROUGH OVER THE PAST SEVERAL YEARS AGAIN, AS JENNIFER SAID WE STARTED THREE YEARS AGO. END OF 2019. WE TALKED WITH A LOT OF STAKEHOLDERS IN MCKINNEY ABOUT THE REGULATIONS THAT YOU HAVE CURRENTLY AND WHAT THE STRENGTHS ARE AND WHERE THE OPPORTUNITIES WERE FOR IMPROVEMENT, WHERE SOME OF THE WEAKNESSES WERE SUMMARIZED ALL THAT AND A CODE ASSESSMENT REPORT. A LOT OF GOOD FEEDBACK ON THAT FROM YOU, ALL FROM THE MCKINNEY DEVELOPMENT COMMITTEE. UM WE FOCUS ON INITIALLY ON SOME SHORT TERM CODE AMENDMENTS, SOME KIND OF LOW HANGING FRUIT, AND THEN WE MOVED INTO THE FULL ON DRAFTING OF THE CODE. WHICH PRETTY MUCH OCCURRED OVER THE COURSE OF THE PANDEMIC, STARTING IN 2020 THROUGH 2022. WE ROLLED THAT OUT AND INSTALLMENTS. EACH OF THOSE INSTALLMENTS WERE CAREFULLY INTRODUCED TO THE COMMUNITY. SO THERE'S A LOT OF OPPORTUNITIES FOR PEOPLE TO UNDERSTAND WHAT WAS BEING PROPOSED IN TERMS OF CHANGES FOR THE REGULATION. A LOT OF EDITS WERE MADE BASED ON ALL THAT FEEDBACK. AND THEN THE DOCUMENT WAS CONSOLIDATED. AND THEN A LOT MORE EDITS WERE MADE BASED ON ADDITIONAL FEEDBACK.

AND SO THE PUBLIC HAS HAD MANY BITES AT THE APPLE THROUGH THIS VERY, UH, METICULOUS PROCESS THAT WE'VE GONE THROUGH IN TERMS OF DRAFTING. SO NOW WE'RE AT THE GREEN BOX ON THE FINAL PART OF THE SLIDE AND WE HAVE A DEVELOPMENT CODE THAT IS READY FOR HOPEFULLY ADOPTION THAT REFLECTS A LOT OF COMMUNITY INPUT. IT REFLECTS A LOT OF THAT FEEDBACK THAT THE STAFF HAS HEARD FROM THE MCKINNEY COMMUNITY. SO WITH THAT, THAT'S REALLY ALL I HAVE. I WANT TO PASS IT OVER TO AARON, AND HE'S GOING TO WALK YOU THROUGH SOME OF THE HIGHLIGHTS OF THE SUBSTANCE OF THE NEW CODE. THANK YOU. GOOD EVENING COUNCIL COMMISSIONERS. INTRODUCING FLEXIBLE TOOLS, MAKING SURE PROCEDURES AND PROCESSES ARE THE BEST THEY CAN BE AND THEN ENCOURAGING HIGH QUALITY DEVELOPMENT. AND SO WHAT? UM REALLY SIMPLIFYING THE REGULATIONS ARE REGULATIONS ARE FOUND THROUGHOUT OUR CODE, AND SO WHAT WE WANTED TO DO WAS BRING THEM INTO ONE DOCUMENT, WHICH WE'RE CALLING THE UNIFIED DEVELOPMENT CODE, SO IT'S EASIER FOR PEOPLE TO LOCATE THE INFORMATION THEY'RE LOOKING FOR, AND THAT'S THAT'S A KEY PART OF WHAT WE'VE DONE IMPROVING USER FRIENDLINESS. UM YOU KNOW, WE'VE WE'VE MENTIONED WE ADDED A NEW FORMAT. WE'VE DONE TABLES. WE'VE DONE GRAPHIC ILLUSTRATIONS TO HELP THEM BECOME MORE USER FRIENDLY. BEYOND THAT, WE'VE ALSO USED CLARIFYING LANGUAGE, SIMPLE LANGUAGE TO HELP PEOPLE UNDERSTAND WHAT'S BEING REQUESTED OF THEM. WE'VE MADE CONSISTENT DEFINITIONS THROUGHOUT THE DOCUMENT. THAT'S WHERE WE FOCUSED MOST OF OUR EFFORTS AS WE'VE GONE THROUGH HERE AND JUST KIND OF RUN THROUGH THESE REAL QUICK, BUT YOU KNOW, WE FOCUSED ON INTRODUCING NEW ZONING DISTRICTS IN FROM WHAT WE'VE HAD BEFORE. WE HAVE UPDATED OUR SPACE LIMITS AND FOR BOTH RESIDENTIAL AND NON RESIDENTIAL USES. AS PART OF THAT WE'VE ALSO GONE IN AND LOOKED AT OUR ACCESSORY DWELLING UNITS AND MADE SOME UPDATES TO UH, THIS THIS STANDARDS FOR THOSE STRUCTURES AS WELL IN TERMS OF USES, WE'VE ADDED USES, WE CONSOLIDATED USES TO MAKE IT SIMPLE AND EASY FOR PEOPLE TO UNDERSTAND WHAT TYPE OF LAND USE THEY HAVE. AND WE'VE ALSO CREATED A NEW CATEGORY WHICH IS

TO HELP WALK PEOPLE THROUGH AND GIVE THEM A DIFFERENT KIND OF OFF RAMP IF YOU WILL, TO OUR DEVELOPMENT REGULATION SO THAT THEY CAN CONTINUE TO MOVE THROUGH THE PROCESS AND PROPOSE SOMETHING DIFFERENT THAN WHAT WE HAVE. WE'VE ALSO ESTABLISHED THAT ARIEL TREE EXHIBIT OPTION FOR OUR TREE PRESERVATION ORDINANCE . UM THAT'S SOMETHING THAT PEOPLE HAVE BEEN KIND OF ASKING FOR A WHILE. SO WE HAVE THAT HERE AND THEN LAST, BUT NOT LEAST WE HAVE ESTABLISHED RESIDENTIAL ADJACENCY STANDARDS IN OUR ORDINANCE TO HELP KIND OF PROTECT THE RESIDENTS IF YOU WILL, ADDING SOME ADDITIONAL REGULATIONS THERE. UH IN THE SUBDIVISION ORDINANCE, YOU KNOW, JUST KIND OF WALK THROUGH MODIFYING SOME OF THE PLATTE PROCEDURES IS WHAT WE'VE DONE.

THERE'S OTHER MINOR CHANGES THAT HAVE HAPPENED WITHIN THEIR AS WELL. JUST CLEANING STUFF UP SIGN ORDINANCE. THERE'S NOT REALLY ANY CHANGES THERE. YOU SHOULDN'T SEE A WHOLE LOT.

THERE'S SOME CLEANUP THAT WOULD HAPPEN THERE. BUT WE DID A SHORT TERM PRIORITY AMENDMENT EARLIER , I THINK WAS ACTUALLY IN 2021 ACTUALLY ARE REVAMPED THIS WHOLE SIGN ORDINANCE TO BE IN LINE WITH THE NEW STATE AND FEDERAL LAWS. FOR SCIENCE. THE LIGHTING ORDINANCES SELF WE'VE GONE THROUGH AND HELPED UPDATE CALCULATING OF LUMINANT SO YOU NO LONGER HAVE TO HAVE AN ENGINEERING DEGREE TO WALK THROUGH THAT, BUT, UH, MADE A LITTLE BIT EASIER. WE ALSO UPDATED THE FORMAT AND LAYOUT TO BE CONSISTENT WITH THE REST OF THAT. FENCES THERE HAS BEEN SOME MINOR AMENDMENTS IN THERE. MOSTLY JUST CLARIFICATION. UM THAT YOU'LL SEE AS WE GO THROUGH THAT AND THEN STORMWATER MANAGEMENT. THERE'S NO CHANGES IN THAT. WE JUST INCLUDED THIS AS PART OF THE DOCUMENT. WITH ALL OF THAT, AND MATT KIND OF MENTIONED IT BEFORE. YOU KNOW, THROUGHOUT THIS WHOLE PROCESS, WE'VE BEEN VERY ENGAGED WITH THE PUBLIC. WE WERE ENGAGED WITH YOU . CITY COUNCIL ARE PLANNING AND ZONING COMMISSION TO MAKE SURE THAT YOU KNOW, EVERYTHING THAT WE'RE PROPOSING HAS BEEN OUT THERE HAS BEEN VETTED AND FOR THE MOST PART, PEOPLE ARE HAPPY WITH IT, RIGHT. THAT'S THAT'S THAT'S OUR HOPE. AND SO WE WANTED TO MAKE SURE THAT DURING THIS WHOLE THING THAT YOU REMINDED OF ALL THE WORK THAT WE'VE DONE TOGETHER AND WITH THAT, UH, JUST GONNA WALK THROUGH STAFF'S PROPOSAL. THIS IS A TEXT AMENDMENT. SO THAT IS WHAT STAFF IS PROPOSING IS JUST A TEXT AMENDMENT CHANGES WITH EVERYTHING THAT YOU SEE BEFORE YOU AND ALSO AS PART OF THE TRANSITION STRATEGY STAFF IS PROPOSING TO DO A DUAL CODE FOR SIX MONTHS FOR JUST THE ZONING ORDINANCE. ALL OTHER ORDINANCES , AND ALL OF THE REGULATIONS WOULD BE IN EFFECT IMMEDIATELY. BUT THE ZONING ZONING AUDITS, YOU'D HAVE A SIX MONTH WINDOW TO BE ABLE TO DO THAT. WITH THAT STAFF RECOMMENDS. APPROVAL OF THE PROPOSED ITEM, AND I WILL BE HAPPY TO ANSWER ANY QUESTIONS THAT YOU MAY HAVE. YOU WOULDN'T HEAR HAVE A PRINTED COPY OF CHAPTER 1 50. I DO HAVE MY DESK. UM EVEN MEMBERS OF THE CITY MANAGER'S OFFICE HAVE SAT IN ON SOME OF WHAT WE CALL OUR WAR ROOM SESSIONS AS PART OF THAT DEBATE AND MY MISSING ANYBODY. THEY GOT AROUND A WOMAN. UM OUR STRATEGIC SERVICES TEAM ACTUALLY HAS HELPED QUITE A BIT AS WELL. A LOT OF THEM GREW UP IN THE PLANNING DEPARTMENT. SO THEY'VE BEEN SITTING IN ON THIS.
