[Conduct a Public Hearing to Consider/Discuss/Act on Design Exceptions for a Site Plan for a Brewpub (Union Bear), Located at 308 W Virginia Street]

HEARING. TO CONSIDER DESIGN EXCEPTIONS FOR SITE PLAN FOR A GROUP OF UNION BEAR. THIS IS AT 308 WEST VIRGINIA STREET, MISS STRICKLAND. THANK YOU. I KNOW I DON'T NORMALLY GET TO TALK WITH YOU. ALSO I'M VERY EXCITED TO BE UP HERE. IT'S NOT ON. THAT'S WHY IT'S NOT WORKING. ALL RIGHT, PERFECT. SO. THE APPLICANT IS PROPOSING TO CONSTRUCT A BREWPUB AND RESTAURANT AK UNION BEAR ON APPROXIMATELY 0.551 ACRES. IT IS LOCATED HERE ON CHURCH, VIRGINIA BENCH JUST TO GIVE YOU AN IDEA

[00:10:03]

RIGHT ACROSS FROM MITCHELL PARK. UM SITE PLANS WITHIN THE MTC, WHICH IS OUR MCKINNEY TOWN CENTER ZONING DISTRICT CAN BE APPROVED ADMINISTRATIVELY. HOWEVER THE APPLICANT IS REQUESTING A NUMBER OF DESIGN EXCEPTIONS FOR THIS SITE FOR THE REDEVELOPMENT EFFORTS OF THE EXISTING HISTORIC BUILDING. THAT'S OUT THERE IS ACTUALLY IT'S THE OLD HERITAGE HARDWARE STORE. IT USED TO BE A GROCERY STORE, AND SO THEY ARE HOPING TO REDEVELOP THE SITE. FOR THIS BREWPUB AND RESTAURANT. THE PROPOSED SITE PLAN INCORPORATES REDEVELOPMENT EFFORTS ON THE SITE, WHICH INCLUDE REMODELING THE EXISTING STRUCTURE AS SEEN ON THE SITE PLAN. IT IS NOTED THAT THIS IS THE EXISTING STRUCTURE HERE IN PINK, THE ADDITIONS THAT THEY ARE ADDING IN BLUE WILL BE HERE FOR A WALK IN COOLER EDITION AS WELL AS THIS ENHANCED PATIO AND OUTDOOR LANDSCAPING THAT THEY WILL BE HAVING. UM WHICH WILL CREATE OUTDOOR SEATING FOR THAT PROPOSED BREWPUB AND RESTAURANT. IN REVIEWING ANY SITE PLAN APPLICATIONS OR DESIGN EXCEPTION . REQUEST THE PLANNING AND ZONING COMMISSION SHALL USE THE FOLLOWING CRITERIA. THE GOALS, INTENT AND VISION OF THE ADOPTED MCKINNEY TOWN CENTER, MTC. THE EXTENT TO WHICH THE PROPOSAL FITS THE ADJOINING DESIGN CONTEXT BY PROVIDING APPROPRIATE BUILDING SCALE AND USE TRANSITIONS. THE EXTENT TO WHICH THE PROPOSAL PROVIDES PUBLIC BENEFITS, SUCH AS USABLE CIVIC AND OPEN SPACES, LIVABLE STREETS , STRUCTURED AND OR SHARED PARKING AND LINKAGES TO TRANSIT.

THE EXTENT TO WHICH THE PROPOSAL HINDERS FUTURE OPPORTUNITIES FOR HIGHER INTENSITY, TOWN CENTER DEVELOPMENT AND CONSIDERATIONS OF HEALTH AND WELFARE FOR THE GENERAL PUBLIC. THE APPLICANT PROPOSES TO RESTORE ONE OF THE LAST COMMERCIAL CORNERS OF THE WESTERNMOST PORTION OF THE MTC, WHILE MAINTAINING THE INTEGRITY OF THE EXISTING HISTORIC BUILDING. YOU CAN SEE THAT HERE ON THEIR PROPOSED ELEVATIONS. ARE THERE FACADE PLAN THAT THEY HAVE SUBMITTED AND ELEVATIONS? AH THOSE SEVERAL DIVIDE DESIGN EXCEPTIONS HAVE BEEN REQUESTED, AND THEY HAVE ALL BEEN NOTED WITHIN THE STAFF REPORT. THAT'S IN FRONT OF YOU. REQUIRING THE DIFFERENT DESIGNER EXCEPTIONS ARE REQUESTED THAT ARE REQUIRING THE BUILDING FORM SITE AND DESIGN STANDARDS, WHICH WOULD PROHIBIT THE REDEVELOPMENT AND REMODELING OF THE EXISTING BUILDING AND FOR THE CONCEPT THAT THE UNION BEARER RESTAURANT AND PUBLISHED TRYING TO ACHIEVE , GIVEN ITS LOCATION AND THE FACT THAT THE EXISTING BUILDING IS LISTED AS A HIGH PRIORITY BUILDING. ON THE CITY'S HISTORIC RESOURCE RESOURCES SURVEY STAFF FEELS THAT THE PROPOSED REDEVELOPMENT PLAN ALLOWS FOR REDEVELOPMENT OF THE BUILDING LARGELY WITHIN THE EXISTING FOOTPRINT THAT IS ALREADY STANDING AS WELL AS ENERGIZING MCKINNEY'S DOWNTOWN AND MAINTAINING MUCH OF THE HISTORIC CONTEXT. AND CHARACTER OF THAT AREA. AS SUCH, I STAFF RECOMMENDS APPROVAL AND I WILL STAND FOR ANY QUESTIONS. THANK YOU, CAITLIN. QUESTIONS. WHEN THE I THINK. CORRECT THAT THIS CAME BEFORE ONE OF OUR HISTORICAL PRESERVATION BOARDS RECENTLY. THAT IS CORRECT. IT WENT BEFORE THE H P A B AND RECEIVED APPROVAL OF THE C O A. SO THE APPROVAL SO THAT IS GENERALLY MEANING THAT THAT BOARD UH, IS OKAY WITH THE CHANGES TO THE BUILDING ITSELF.

CORRECT SO THE HP, A HISTORICAL PRESERVATION ADVISORY BOARD, THEY TOOK ACTION ON THIS LAST WEEK, AND THEY HAVE RECOMMENDED APPROVAL AND HAVE STATED THAT THIS BUILDING AND THIS UPDATE IS APPROPRIATE FOR THIS AREA. THIS IS NOT ADDING PARKING TO THE AREAS FOR THAT PARKING LOT EXISTING NOW ADDING PARKING THAT IS LINED YOU PARKING THAT THERE IS THERE CURRENTLY IS A LITTLE HAPHAZARD. THIS IS GOING TO BE A LITTLE BIT MORE UNIFORMED FORMED PARKING, WHICH YOU CAN SEE PARKING HERE, HERE, HERE DOWN HERE, AND THEN THERE'S SOME STREET PARKING RIGHT THERE. BUT THEY ALSO HAVE ACCESS TO THE CITY PARKING LOT, WHICH IS RIGHT HERE IN THIS PINK BOX. SO ANY OF THE PARKING THAT THEY ARE PROVIDING WILL BE FOR THE UNION BEAR SITES SO THEY WILL NOT BE IMPACTING TOO GREATLY THE EXISTING CITY PARKING OUT IN THAT AREA. PARKING EXISTS. IT'S JUST NOT ORGANIZED AT THIS TIME. IT'S YES, IT'S NOT QUITE AS ORGANIZED AND THIS GROUP HAS OWNERSHIP OR RUNS OTHER OPERATIONS IN DOWNTOWN, THE HISTORICAL DISTRICT. NOW THE OWNER CURRENTLY OWNS AND OPERATES CADILLAC PIZZA AS WELL. HAS THERE BEEN. HAS THERE BEEN A DINAR? WELL, WELL OF OUR NOISE, ORDINANCES AND THINGS LIKE THAT RELATED TO BANDS AND MUSIC AT NIGHT. THEY ARE WELL AWARE OF OUR DIFFERENT NOISE STANDARDS THAT ARE THE CITY OF MCKINNEY HOLDS ALL COMMERCIAL AND RESIDENTIAL PROPERTIES TO ANY ISSUES WITH THE CITY THAT THE CITY WANTS TO NOTE AS FAR AS THEM NOT COMPLYING WITH THAT, OR REGULAR ISSUES WITH THAT FOR

[00:15:06]

CADILLAC PIZZA. UH I HAVEN'T HEARD ANYTHING FOR ANY OF THE EXISTING BUILDINGS, AND THIS SITE HAS REMAINED VACANT FOR A WHILE, SO I HAVEN'T HEARD ANYTHING FROM THE SITE EITHER.

GOOD. ANYONE ELSE? YEAH ARE THERE ANY COMMENTS? UM UH, FROM THE RESIDENTS TO THE JUST TO THE NORTH OF THIS, YES. THEY DID HAVE COMMENTS DIRECTLY TO THE NORTH IN REGARDS TO NOISE AS WELL AS THE SCREENING. THEY ARE GOING TO BE PROVIDING A SCREENING WALL AND SCREENING BUFFER HERE. AGAINST THE RESIDENTIAL PROPERTY, SO THERE WILL BE A FENCE AS WELL AS EVERGREEN SHRUBS THERE AND AT H P A. B. THEY SPOKE ABOUT MAKING SURE TO PROTECT THE EXISTING.

THERE'S A GINORMOUS TREE RIGHT HERE THAT THEY'RE GOING TO BE WORKING WITH THAT PROPERTY OWNER TO MAKE SURE TO PROTECT CURRENTLY THERE'S ONLY A CHAIN LINK FENCE BETWEEN THE TWO PROPERTIES ARE BROKEN. OTHER QUESTIONS. THANK YOU. IS THERE APPLICANT HERE TONIGHT? GOOD EVENING. MY NAME IS PRESTON LANCASTER. I'M THE OWNER OF THE PROPERTY AND THE PROPOSED OPERATOR OF THE RESTAURANT UNION BEAR AND THIS IS LIZ JOHNSON. SHE'S THE ARCHITECT AND DESIGNER . THIS IS ALICIA TOMLIN. SHE'S THE WITH GOVERNMENT. FOX, OUR GENERAL CONTRACTOR. THANK YOU FOR THE WONDERFUL INTRODUCTION. THAT WAS THAT WAS REALLY NICE. WE'RE REALLY EXCITED TO HOPEFULLY BE A PART OF DOWNTOWN MCKINNEY. UM AS SHE WAS EXPLAINING, WE OWN THE YARD DOWN THE STREET, AND WE ALSO OWN CADILLAC PIZZA PUB. WE'VE ACTUALLY OWNED THIS BUILDING FOR TWO YEARS AND WE'VE BEEN TRYING TO REDEVELOP, UM. THIS PROPERTY IN THE WAY WE SEE BEST FIT NOT ONLY FOR OUR BUSINESS, BUT FOR THE CITY AND THE COMMUNITY AS WELL. UM IT'S OUR INTENTION TO CREATE A PROPERTY OR A BUSINESS THAT REALLY ATTRACTS AND POLLS FROM. AH THE EASTERN PART OF THE SQUARE. UM, WE FEEL LIKE THIS IS SOMEWHAT OF A DEAD AREA. UM AND I THINK THAT THIS WILL BE A NICE AMENITY TO DOWNTOWN MCKINNEY AND I WISH WE HAD SOME OF THE RENDERINGS OF OR SOME OF THE PHOTOGRAPHS OF IT CURRENTLY BECAUSE IT DOESN'T REALLY LOOK TOO GOOD RIGHT NOW. BUT THE PROPOSED RENDERINGS UM OH, YEAH . THANK YOU. WE ACTUALLY HAVE SOME LIVE. MORE COLORFUL RENDERINGS THAT I DON'T KNOW IF YOU CAN. DO ANYTHING, BUT THE RENDERINGS WERE PART OF THE PACKET, SO YOU SHOULD ALL BE ABLE TO HAVE COPIES OF THOSE. THANK YOU. THANK YOU. UM BUT, YEAH, WE THINK IT'S A REALLY, REALLY NICE LOOK THAT I'M NOT AN ARCHITECT, BUT WE DO FEEL LIKE THAT. IT COMPLEMENTS THE DOWNTOWN AESTHETIC. UM WE'VE WE'VE WORKED PRETTY HARD ON THIS DESIGN AND PUT A LOT OF INTENTION INTO IT. WE'VE ALSO, UM, TRYING TO BE HIS COGNIZANT AS POSSIBLE TO OUR NEIGHBORS TO THE NORTH, AND WE RECOGNIZE THAT THIS IS A NEIGHBORHOOD AS WELL AS A COMMERCIAL ZONE. WE THINK WE'VE BEEN PRETTY GOOD AT THE YARD AND A CADILLAC PIZZA. BEING GOOD NEIGHBORS AND ESPECIALLY BEING GOOD PARTNERS WITH THE CITY OF MCKINNEY DOWNTOWN AREA.

SO UM, WE'RE I'M HERE TO ANSWER ANY QUESTIONS, BUT I'LL JUST TELL YOU A LITTLE BIT OF THE HISTORY REAL QUICK, YOU KNOW? PRESTON HIRED ME ALMOST TWO YEARS AGO AND WE'VE GONE THROUGH THIS IS THE THIRD ITERATION OF THIS OF THIS PLAN AND THIS DESIGN AND YOU KNOW, AS EVERYBODY KNOWS, CONSTRUCTION PRICES JUST COVID JUST WREAKED HAVOC AND INFLATION WENT CRAZY, SO WE ORIGINALLY HAD SOME PLANS THAT THE CITY IN THE CITY STAFF WAS MORE AGREEABLE TO BECAUSE IT BUILT TO THE BILL TO ZONES AND ALL THE EXCEPTIONS WERE ASKING FOR THAT. WE CAN'T BUILD THE BUILD TWO ZONES. OR BECAUSE WE HAD TO DOWNSIZE THIS FOR FINANCIAL REASONS. WE JUST CANNOT BUILD. ALL THE WAY TO THESE BUILD TWO ZONES. IT'S JUST FINANCIALLY IS NOT POSSIBLE TO MAKE THIS BUSINESS WORK. SO INSTEAD, YOU KNOW, LIKE AT THE YARD. I MEAN PRESTON AND RESTAURANT 33 GROUP IS VERY GOOD AT CREATING THESE LIKE OUTDOOR SPACES WITH A LOT OF GREENERY, AND THESE VERY EXPANSIVE KIND OF NICE LANDSCAPED AREAS. THEY PUT A LOT OF MAINTENANCE INTO THE YARD AND EVERYTHING THAT THEY DO. THEY'RE ON THE SITE. THAT'S THE WAY WE'VE GONE WITH THIS JUST BECAUSE WE CANNOT BUILD ADDITIONAL BUILDING JUST FINANCIALLY WILL NOT WORK WITH THEIR BUSINESS MODEL WITH HOW PRICES HAVE GONE OVER THE PAST THREE YEARS. UM SO UNFORTUNATELY , WE CAN'T MEET ALL OF THE REQUIREMENTS, BUT WE DID WANT TO TAKE INTO CONSIDERATION AND

[00:20:03]

REALLY PUT FRONT AND PRIORITY KIND OF RESTORING AND PRESERVING THIS HISTORIC STRUCTURE AS FAR AS THE MASONRY HAVING THE BRICK MASONRY AND KEEPING SOME OF THESE ELEMENTS THAT ALL OF THE DOWNTOWN MCKINNEY HAS. SO FROM A DESIGN PERSPECTIVE, WE FEEL LIKE WE'VE TRIED TO BE AS RESPECTFUL AS POSSIBLE, WHILE STILL GETTING ENOUGH. UM FUNCTION OUT OF THE BUILDING AND LAST LAST WEEK WHEN WE TALKED TO THE STORE CONDITION, WHICH THEY APPROVED THIS CORNER ENTRY MOMENT WAS REALLY THIS THIS ENTRY MOMENT TO ATTRACT DOWNTOWN AND TO REALLY HAVE A MORE DIRECT CONNECTION.

THE PEDESTRIAN CONNECTION IS REALLY, REALLY IMPORTANT TO US, BECAUSE WE KNOW THE PEOPLE WILL BE WALKING FROM OTHER RESTAURANTS DOWNTOWN, SO WE'RE PUTTING FORTH A LOT OF EFFORT.

TO CREATE THAT PEDESTRIAN ACCESS AND CREATE THIS KIND OF TOWER MOMENT WHERE IT'S NOT ONLY ACCESSED FROM THE SIDE FACING THE PARK, BUT ALSO FROM THE SIDE FACING DOWNTOWN. UM SO WE HAVE KIND OF A DOUBLE ENTRY MOMENT. THERE. UM. AS FAR AS THE OTHER EXCEPTIONS, I THINK 99% OF THEM HAVE TO DO WITH THE BILL TO ZONE AND NOT BEING ABLE TO COMPLETE THAT. BUT IF YOU HAVE ANY OTHER SPECIFIC REQUESTS ON THOSE, WE CAN ANSWER THEM, AND I THINK THE ONLY OTHER THING WAS THAT WAS THE FRONT SETBACK REQUIREMENT. BUT THE BUILDING IS EXISTING, SO RIGHT, UNFORTUNATELY, CAN'T PICK IT UP AND PUSH IT BACK. UM AND AS FAR AS BEING COGNIZANT OF THE NEIGHBORS, THE SITE PLAN WAS CAREFULLY THOUGHT OUT. TO CONSIDER THE NEIGHBORS BECAUSE PRESTON HAS THE YARD AND THANKFULLY WE'VE MET THEM AND TALK TO THEM. BUT WE DESIGN THE BACK TO HAVE A SCREEN WALL THAT HAS GREENERY THAT WILL HELP ABSORB ANY SOUND. THERE ARE NO EXITS ON THE REAR OF THE BUILDING FACING THAT PROPERLY, WE PURPOSELY PLACED IT ON THE SIDE ON BENCH STREET. WE PURPOSELY PLACED THE DUMPSTER AS FAR AWAY FROM THE HOUSE AS WE COULD ON INDUSTRY. WE UNDERSTAND THAT THERE IS THE RED OAK THERE AND THAT FROM OUR FIRST SIDEWALK THAT WAS ONE OF THE THINGS THAT WE SAID WE HAVE TO SAVE THIS TREE. UNFORTUNATELY I HAVE HAD A LOT OF EXPERIENCE IN SAVING AND TRANSPLANTING AND DOING EVERYTHING IN TERMS OF TREE PRESERVATION. I JUST FINISHED A HUGE PROJECT OUT FOR OUT IN ALLIANCE FOR HILLWOOD. WHERE WERE YOU SUCCESSFULLY SAVED AND REPLANTED OVER 36 HERITAGE TREES. AND WE WON'T HAVE TO REPLANT. WE WON'T HAVE TO MAKE PLANT BUT I'M JUST SAYING WE'RE WE'RE COGNIZANT, COGNIZANT OF IT, AND WE ARE DEFINITELY VERY SKILLED. PRESERVE THOSE TREES, HIRE AN ARBORIST TO COME OUT AND JUST CHECK ON THE HEALTH OF THE TREE IS SOMETHING THAT'S VERY EASY TO DO. I HAD TO DO IT AT A SORORITY HOUSE I BUILT IN THAT S M U CAMPUS AT A GIGANTIC TREE FOUR FT FROM THE GREAT BEAM OF THE FOUNDATION AND THE ARBORIST WAS ABLE TO SAVE IT THERE, TOO, AND WE'RE HAPPY TO UNDERTAKE THAT HISTORY IS IMPORTANT TO US AS WELL. SO BUT WE'RE HERE TO ANSWER ANY QUESTIONS ON THE DESIGN EXCEPTIONS, AND YOU KNOW ANYTHING THAT YOU MIGHT WANT US TO GO INTO COURSE. CAN YOU SPEAK TO THE NET CHANGE IN PARKING SPACES? OR IS THERE A NET CHANGE OUR ORIGINAL ITERATION OF THIS BUILDING WHEN WE WERE, I GUESS, HAD THE APPROPRIATE BUILD, TOO, BECAUSE WE'RE GOING ALL THE WAY OUT TO CHURCH STREET. IT PRETTY MUCH GOT RID OF ALL THE PARKING EXCEPT FOR THE PARKING ON THE WEST SIDE OF THE STRUCTURE. SO ONE OF THE BENEFITS OF REDUCING THE SIZE OF THIS, UM, RESTAURANT AND JUST HAVING THE LITTLE PATIO MOMENT THERE THAT YOU CAN SEE ON THE EAST SIDE WAS THAT IT PRESERVED A LOT OF OUR PARKING SO THAT WAS IMPORTANT TO US IF WE COULD PRESERVE AS MUCH PARKING AS POSSIBLE. UM SO, YEAH, WE TRIED OUR BEST TO. AND I WON'T DIVE TOO MUCH INTO THIS. BUT WITH THE RESTAURANT YOU KNOW, THERE'S A MINIMUM AMOUNT OF SQUARE FOOTAGE WE NEED TO ALLOCATE TOWARDS THE KITCHEN.

AND THEN THERE'S A MINIMUM ALLOCATION OF SEATS THAT WE NEED IN THE HOUSE, SO THE PATIO WAS UNNECESSARY. UM THING TO JUT OUT OF THE SIDE OF THE RESTAURANT, WHICH WE, UM HAVE BEEN APPROVED FOR THAT PATIO WE'VE ALREADY SUBMITTED. I DON'T KNOW THE EXACT LANGUAGE SITE PLAN APPROVAL FOR THE FOR THE PATIO ITSELF, BUT YEAH, THE PARKING LOT STRUCTURE ITSELF. I DON'T KNOW HOW MANY PARKS WE HONESTY. IT HASN'T REALLY REDUCED. THE PARKS ARE SO HARD TO CALCULATE ON THE EXISTING SIDE BECAUSE THERE ARE NO THEY'RE ON THEIR LINES. BUT WITH THE SITE REQUIREMENTS THAT WE HAVE TO HAVE, LIKE TWO OR THREE FT. STEP BACK FROM THE SIDE PROPERTY LINE ON UM ON CHURCH STREET AND ALL OF THE DIFFERENT THINGS THAT YOU CAN'T GET ANOTHER ROAD PARKING.

EVEN IF YOU TRIED BECAUSE YOU CAN'T GET ANOTHER 24 INCH DRIVE , I'LL SO LIKE, IF 24 FT, SO IF YOU CAN'T REAL REAL DIMENSIONS FOR DR ISLES. RIGHT NOW. IT'S JUST A HAPHAZARD, OPEN PARKING LOT. CURRENT PART IS NON COMPLIANT WITH THE CITY OF MCKINNEY'S BUILDING STANDARDS, AND THE CURRENT PARKING LOT ALSO HAS TO 10 FT DRIVE PHASE IN IT FOR ROLL UP DOORS, WHICH THEREFORE REDUCE THE OVER AMOUNT OVERALL AMOUNT OF PARKS AND THEREFORE IT'S PROBABLY A NET

[00:25:02]

NET WASH ON THE NUMBER OF PARKS, CONSIDERING WHAT'S CURRENTLY THERE IS NOT STRIPED IN NONCOMPLIANCE, BUT THERE'S NO WAY FOR US TO VERIFY EXACTLY ALL RIGHT. THANK YOU. ANYONE ELSE? I KNOW THAT YOU HAVE NEARLY R. STEVENS, HOLLY'S ALL ACROSS THE BACK, AND THEY'LL START OUT LIKE SIX FT HIGH. WHAT KIND OF FENCING AGAIN WAS GOING IN THERE ? WE WERE GOING TO BE DOING A BLACK WROUGHT IRON FENCE IN BETWEEN MASONRY COLUMNS TO TRY TO GET THAT MORE KIND OF RESIDENTIAL FEEL AND HIGH END FEEL AND THEN THE GREEN WITH GREEN WALL ON THE SIX FT HYDRATE FOOT HEIGHT, OR I THINK WE HAD SIX FT. HIGH FOR THE MASONRY AND THAT AND THEN THE HOLLIES CAN GROW TO WHATEVER HEIGHT THEY GROW, TOO. HOLLY'S WOULD BE IN BETWEEN THE MASONRY YES. AND WE'RE OPEN TO DISCUSSION. BUT THAT WAS THE DIRECTION THAT THE CITY AND WE DISCUSSED AND THAT THEY WERE HAPPY WITH. ON YOUR PATIO AREA. ARE YOU GOING TO HAVE ANY TYPE OF SPEAKERS OR ANYTHING? OKAY WE'RE PLANNING ON HAVING SPEAKERS. WE ARE NOT PLANNING ON HAVING ANY LIVE MUSIC, SO THERE WILL BE SPEAKERS ON THE PATIO. BUT WE PLAN TO ORIENT THOSE TO WHERE THEY'RE NOT FACING TOWARDS, UH TOWARDS THE NEIGHBORS TO THE NORTH OF US. JUST EAST OF THE PATIO AREA . IT LOOKS LIKE YOU HAVE ANOTHER AREA THAT SECTIONED OFF FOR AND THERE'S A LITTLE SEATING AREA JUST EAST, UM, PLAYING NORTH. THERE'S A LITTLE SEATING AREA WITH TWO LITTLE FIRE PITS, BUT JUST, YOU KNOW, CHAIRS AROUND THEM. BUT BUT THAT WOULD BE PLANNED NORTH, NOT EAST. YOU MEAN ADJACENT TO THE PROPERTY ON THE IT'S YEAH, IT'S GOING TO BE ADJACENT TO THE PROPERTY TO THE NORTH. DO YOU WANT TO PULL UP THAT DON'T WORK THIS YEAH. SO THE ACTUAL BUILT IN PATIO STOPS ? YEAH, RIGHT WHERE SHE'S POINTING THAT LINE. THAT'S THE ACTUAL WHERE THE PERGOLA STOPS THE STRUCTURE THAT WOULD BE A SHADE STRUCTURE AND THEN UP ABOVE THERE, IT'S JUST GONNA BE A LANDSCAPED AREA WITH MAYBE SOME BEANBAGS AND SOME FIRE PITS . UM BUT AGAIN, LIKE THE HOURS WILL BE COGNIZANT OF NEIGHBORS AND THEY RUN THE YARD, WHICH HAS TWO RESIDENTIAL ADJACENT TENANTS THAT THAT ARE ALWAYS HAPPY WITH THEIR HOURS OF THE YARD, AND IT WILL BE A VERY SIMILAR RUN BUSINESS FROM AN HOUR'S PERSPECTIVE, AND THEY ALWAYS WORKED WITH THE NEIGHBORS ON THOSE KIND OF THINGS. ARE YOUR PLANNED OPERATING HOURS? AH, THAT WOULD BE I WOULD IMAGINE SIMILAR TO THE YARD, WHICH LATER WE OPENED UP THE YARD. WEEKNIGHTS. YEAH. THAT WOULD BE THAT WOULD BE WHAT WE'VE I WOULD PROPOSE. WE'RE DEFINITELY NOT UM , YOU KNOW, TYPE OF PLACE. IT'S GOING TO STAY OPEN, YOU KNOW, MIDNIGHT OR LATER. MCKINNEY DOESN'T YAHOO! E. THERE ARE A COUPLE OF PLACES. OTHER QUESTIONS. ANYONE. THANK YOU. WE APPRECIATE YOU BEING HERE. THANK YOU GUYS. WE MAY HAVE QUESTIONS AFTER THE PUBLIC HEARING. THIS IS A PUBLIC HEARING. OTTOMAN IF YOU HAVE COME IN, WOULD LIKE TO, UH AWAY IN ON THIS PROPOSED THIS PROPOSED, UM, EXCEPTIONS TO A SITE PLAN. YOU MAY COME TO THE PODIUM NOW. HELLO, BOARD. MY NAME IS STEVE BEN LANDING HAM.

MY WIFE IS CYNTHIA ELLIOT, MAN LANDING HAM AND WE LIVE. IN THE VICTORIAN HOUSE JUST TO THE NORTH OF THIS PROPERTY AT 205 NORTH CHURCH STREET. I'M A RETIRED ARCHITECT. AND MY WIFE HAS A BUSINESS ON THE SQUARE. CALLED CYNTHIA ELLIOTT. I KNOW MY TIME IS SHORT. AND I SENT MY COMMENTS BRIEFLY HAD A REVIEW OF THE INFORMATION THAT WAS PRESENTED TO THE SORT PRESERVATION ADVISORY BOARD. AND I AM BASICALLY, UH, SINCE I HAVE AN ARCHITECTURAL BACKGROUND, UM, PLEASED TO SEE THAT THE STRUCTURE ITSELF, AND BASICALLY THE INTEGRITY IS KEPT THE SAME SHAPE THE SIZE. IT'S PAINTED BRICK. NOW IT'S GOING TO BE PAINTED BRICK, UM, GOING FORWARD. THEY ARE REPLACING WINDOWS, WHICH I THINK WAS A STICKING POINT. BUT I THINK THE WINDOWS THAT ARE BEING REPLACED OR IN KEEPING WITH THE AESTHETICS OF THEIR NEIGHBORHOOD. SO GET MOVED ON THAT THERE'S AN AWNING ON THE FRONT. WHICH THERE ISN'T CURRENTLY AND THERE'S AN AWNING THAT THEY'RE PUTTING GOT A COVED OUTDOOR PATIO SPACE. BUT UM I WAS CONCERNED ABOUT HOURS OF OPERATION. AND, UM. WHICH CAN BE PROBLEMATIC FOR US. SINCE THEY

[00:30:07]

ARE LITERALLY NEXT DOOR. TO US, BUT IT SOUNDS LIKE THEY ARE YOU WANT TO HAVE REASONABLE HOURS AND NOT BE OPEN TILL TWO IN THE MORNING. OUR CONCERN WAS THE PATIO. I KNOW AT THE PUB. THEY HAVE A GAME ROOM IN THE BACK. AND THAT GAME ROOM IS OPEN TILL TWO. AT LEAST TWO IN THE NIGHT.

INTEREST ME MORE PEOPLE DRINK THE LADDER THEY GET, SO I HEAR ALL THE GAMES AND ALL THE COMMOTION THAT GOES ON OUT OF THAT GAME ROOM AREA BECAUSE THEIR PAPER, THEN METAL WALLS, ANYWAY. GLAD THAT YOU'RE NOT GOING TO BE DOING THAT. I APPRECIATE IT. THE FENCE WOULD LIKE TO HAVE A LITTLE MORE INFORMATION ON THE FENCE, BECAUSE, UM IT LOOKS GREAT IN THE RENDERINGS. I JUST NEED MORE ABOUT THE MATERIALS IN THE HEIGHT. I APPRECIATE THAT, UM AND LET'S SEE. THE TRASH. THE RENDERINGS ■DIDN'T REALLY GET INTO THE SPECIFICS OF THE ENCLOSURE. AND THE TYPES OF OKAY, GOOD. I DO HAVE CONCERNS BECAUSE I'M GETTING SURROUNDED BY RESTAURANTS NOW. SO I KNOW IT'S A HOT SPOT. YOU KNOW ALL ROADS LEAD TO MCKINNEY. BUT I WILL NEED TO KNOW YOUR STRATEGY FOR RAPID. STEVE. COULD YOU FACE US? WE CAN'T HEAR YOU WHEN THE MICROPHONE IS, IS THIS WAY, THANK YOU CONTROL, SO I NEED TO NOTE THAT YOU HAVE A PLAN OF ACTION FOR THAT. HAVE BEEN CONCEPT WILL DO, UM. STEVE HOLD ON STATE. SO WHAT WE'LL DO.

WE'LL HAVE THE PUBLIC HEARING AND THEN IF WE HAVE SOME QUESTIONS OF THE STAFF FOR THE APPLICANT WILL BRING YOU GUYS BACK UP THOSE THERE'S NO REASON TO HIT EVERY SINGLE ITEM RIGHT NOW, STEVE, DID YOU HAVE SOME MORE THOUGHTS? NO I AM DEFINITELY IN SUPPORT OF THE PROJECT. GOD I THINK IT'S YOU'VE DONE A REALLY GOOD JOB. AND I THINK IT'S GOING TO BE AN ASSET.

I'VE ALREADY ASKED THE QUESTION. YOU KNOW? IS IT GOING TO BE AN IMPROVEMENT TO THE BUILDING THE STRUCTURE AND THE INTEGRITY IN HIS OF THE NEIGHBORHOOD AND MCKINNEY AS A WHOLE, AND I WOULD AGREE THAT IT WILL BE SO. YEAH I'M EXCITED. WE JUST HAVE TO WORK THROUGH THE DETAILS. THANK YOU VERY MUCH. THANK YOU VERY MUCH. ANYONE ELSE HERE TO SPEAK ON THIS ITEM TONIGHT? ANYONE ELSE WISH TO SPEAK TONIGHT? MAKE A MOTION WILL CLOSE THE PUBLIC HEARING. SECOND THE MOTION BY MR MAN'S AREN'T CLOSED THE PUBLIC HEARING IN A SECOND MAN, MR WATT LASER, WE NEED DISCUSSION. ALL RIGHT. PLEASE CAST YOUR VOTE. THE MOTION CARRIES THE PUBLIC HEARING HAS BEEN CLOSED. WHAT THAT MEANS IS WE'LL HAVE QUESTIONS. UM AND CONVERSATION WITH THE APPLICANT AND ALSO THE CITY STAFF AND ONE OTHER NOTE. IF YOU HAVE SUBMITTED A LETTER RELATED TO THIS APPLICATION, PLEASE KNOW THAT IS IN OUR FILE AND PART OF THE RECORD. UH WE WON'T READ THE LETTER. BUT WE DO HAVE AH, YOUR LETTER HERE AS PART OF THE ITEM. OKAY. DO WE HAVE QUESTIONS? OF APPLICANT OR STAFF. HAVE A QUESTION FOR STAFF. CAN YOU REMIND ME WHAT THE LIGHT BOARD MENSES FOR THE CITY BECAUSE THERE IS SOME QUESTIONS ABOUT THE BRIGHTNESS OF THE SIGN THAT'S GOING TO BE FACING THE SQUARE. SURE SO THIS SITE LIKE ALL COMMERCIAL SITES WITHIN THE CITY OF MCKINNEY ARE REQUIRED TO FOLLOW THAT LIGHTING ORDINANCE SO THAT THEY ARE NOT GOING TO BE ESSENTIALLY SHINING ACROSS THEIR PROPERTY LINES. SO THEY NORMALLY DOWNWARD FACING LIGHTING. I BELIEVE THAT NEW LIGHTING ORDINANCE ACTUALLY YOU NO LONGER HAVE TO HAVE A PHYSICS DEGREE TO ACTUALLY UNDERSTAND IT ANYMORE, WHICH IS EXCITING WITH THE NEW CODE. UM BUT IT SHALL NOT SHINE LIGHT ON YOUR NEIGHBOR ESSENTIALLY. THANK YOU. THIS IS ALREADY THE ZONING EXISTS FOR A RESTAURANT TO BE ALLOWED IN THIS BUILDING. THAT IS CORRECT AT THIS INFRASTRUCTURE DOESN'T EXIST LOUD. SO IT'S A NON CHANGING ZONING. WE'RE LOOKING AT A SITE PLAN BASED ON VARIANCES, CORRECT THESE VARIANCES COMING TO OCCURRENCE BECAUSE THEY'RE ACTUALLY KEEPING THE ORIGINAL FOOTPRINT OF THE EXISTING HISTORICAL BUILDING. THAT IS CORRECT, SO WE'RE LOOKING AT THE DESIGN EXCEPTIONS DUE TO THE FACT THAT THEY ARE KEEPING THAT EXISTING BUILDING AS YOU NOTED, UH, THERE'S JUST THERE'S NOT A POSSIBLE WAY WITHOUT PHYSICALLY MOVING THE BUILDING TO GET THAT BUILD TO BUILD TWO ZONE LINE REQUIREMENT AS WELL AS, UM, THE DIFFERENT GROUND FOR FLOOR ELEVATIONS LIKE THEY WOULD HAVE TO PUMP THE BUILDING UP TO HIT SOME OF THE REQUIREMENTS SO DUE TO THEM WANTING TO KEEP THE INTEGRITY OF THE BUILDING. THAT IS WHY THERE ARE THE NUMBER OF DESIGN

[00:35:02]

EXCEPTIONS IN FRONT OF YOU. ANYONE ELSE? CAITLYN WHILE YOU'RE HERE, WERE YOU WALK US THROUGH THE TYPE OF SCREENING BETWEEN THE TWO PROPERTIES THE SUBJECT PROPERTY IN THE PROPERTIES TO THE NORTH. OF COURSE, THE SEPARATION GOING TO BE SO YOU CAN'T SEE IT RIGHT HERE, BUT THEY ARE GOING TO HAVE THAT LANDSCAPE BUFFER BETWEEN THEM, AND IT'S GOING TO HAVE THE EVERGREEN SHRUBS AS WELL AS THE, UM, IRON WROUGHT FENCE WITH THE MASONRY COLUMNS EVERY SO OFTEN LIKE IT'S, UM, A DIFFERENT AT SET INTERVALS. AND SO THEY WILL HAVE THOSE REQUIREMENTS SET FORTH BEFORE THEM AS WELL AS THE OTHER ENHANCED LANDSCAPING THAT THEY HAVE, ADDITIONALLY ON THE SITE. OKAY VERY GOOD. LAST QUESTION. THERE'S THE CITY OF MCKINNEY HAVE A NOISE ORDINANCE THAT. THIS OPERATOR WOULDN'T NEED TO ADHERE TO YES, THEY WOULD HAVE TO ADHERE TO THE CITY'S NOISE ORDINANCE AND SO THEY WOULD NOT BE ABLE TO. THAT IS JUST ACROSS THE CITY AS A WHOLE, SO THEY ARE REQUIRED TO FOLLOW THAT NOISE ORDINANCE, REGARDLESS OF BEING INSIDE THE MTC OR NOT. OKAY? ANYONE ELSE? UH YEAH, MAN BROUGHT UP RODENT CONTROL. I MEAN, THAT'S KIND OF HARD MCKINNEY ANYWAY, BUT WHAT CAN THEY DO? BEING A DUMPSTER RIGHT ON THE BORDER? THE PROPERTY? DEFINITELY LET THEM SPEAK TO ANY RODENT CONTROL. BUT WITH OUR SOLID WASTE TEAM, THEY LIKE TO MAKE SURE THAT THEY'RE ENSURING THAT THE TRASH IS BEING PICKED UP. ON A REGULAR BASIS, SO THEY WILL BE REQUIRED TO HAVE THAT CONTRACT WITH ART SOLID WASTE PROVIDER. BUT I WAS LET THEM SPEAK TO ANY KIND OF TRUE CONTROL THAT THEY HAVE FOR THE RESTAURANT COMPONENT. THANK YOU, MHM. DID YOU WANT THE AFRICAN TO? YES, PLEASE. YEAH. I GUESS I'M ALONE ON THIS ONE. AH, OKAY.

NO IT'S FINE. IT'S FINE. WE CURRENTLY USE ECOLAB PEST CONTROL AT ALL OF OUR RESTAURANTS AND THE TWO IN DOWNTOWN MCKINNEY. BUT THEY DO A GREAT JOB. WE HAVE THEM OUT OFTEN, UM I KNOW. I WANT TO SAY TWICE A MONTH THAT THEY'RE COMING OUT TO YEAH. SO WE'RE ALL OVER IT, ESPECIALLY THE YARD. WE HAVE AN OUTDOOR PROPERTY, SO IT'S VERY IMPORTANT FOR US TO PROTECT. YOU KNOW THAT OLD HOUSE, UM SHE CAN SPEAK TO IT TO ANY EXTENT, MORE THAN THAT, AS FAR AS CONSTRUCTION ABILITY GOES IN TERMS OF RODENT AND PEST ELIMINATION, WE DO A GOOD JOB WITH 33 RESTAURANT GROUP OF CONSISTENTLY GO INTO THEIR PROPERTIES AND MAKING SURE THAT ANY HOLES ARE FILLED AND FILLED WITH THE ROAD AND FILM AND THAT THERE ARE NO GAPS. THERE'S NO SUNLIGHT. THAT ANY POSSIBLE POINT OF INJURY IS ELIMINATED AND TAKING CARE OF FROM THAT FROM A CONSTRUCT ABILITY OF PERSPECTIVE, AND THEY ARE WHAT ONE OF THE CLEANEST RESTAURANT GROUPS I HAD EVER BUILT FOR. UM WHAT ARE CONSISTENTLY GO BACK IN THEIR OPERATIONS ARE IMMACULATE , AND THEY'RE ALWAYS REALLY TAKING CARE, GOOD CARE OF THEIR STUFF AND HANDLING PREVENTATIVE MAINTENANCE AND RODENT PEST CONTROL. OBVIOUSLY THAT'S GOES WITHOUT SAYING THAT'S VERY IMPORTANT TO US. THANK YOU. SURE. ANYONE ELSE? OTHER QUESTIONS? ALL RIGHT. DO WE HAVE EMOTION? I. LIKE THE PROJECT. I'M GLAD THAT IT WENT THROUGH THE HISTORICAL BOARD PREVIOUSLY WORKED WITH THE NEIGHBORS AND STAFF. THE FOOTPRINTS THE SAME. IT WILL DEFINITELY IMPROVE A BUILDING THAT'S BEEN NEGLECTED FOR A NUMBER OF YEARS IN DOWNTOWN SO MAKE A MOTION TO APPROVE. BASED ON STAFF'S RECOMMENDATION WITH THE VARIANCES REQUESTED. ONE SECONDE MOTION IS TO PROVE THE ITEM S FIRST DRAFT RECOMMENDATION, INCLUDING AUSTIN. ITEMS LISTED IN THE STAFF REPORT. ANY DISCUSSION. CAST YOUR ABOUT. THAT MOTION CARRIES THE REQUESTS HAVE BEEN APPROVED. THANK YOU. THE NEXT ITEM ON OUR AGENDA IS TO DASH 0085. S P TWO PUBLIC

[Conduct a Public Hearing to Consider/Discuss/Act on a Site Plan for McDonald Street Multifamily, Located at 3352 North McDonald Street]

HEARING. TO ACT ON A SITE PLAN FOR MCDONALDS STREET MULTI FAMILY THIS IS A 3352. NORTH MCDONALDS STREET, MR BENNETT. IT'S THANK YOU AGAIN, MR CHAIRMAN. THIS IS THE PROPOSED SITE PLAN FOR THE MCDONALDS MCDONALDS STREET MULTI FAMILY PROJECT. HOLD THAT UP. OKAY? THE SUBJECT. PROPERTY IS LOCATED ON THE EAST SIDE OF HIGHWAY FIVE AND JUST NORTH OF WOMAN THROWED.

THE DEVELOPMENT IS ALLOWED WITHIN THE CURRENT ZONING OF THE PROPERTY, HOWEVER, AS PART OF THE APPLICATION, A SCREENING VARIANCE IS BEING REQUESTED FOR THE CITY ORDINANCES. SIX FT TALL

[00:40:04]

MASONRY SCREENING DEVICE IS REQUIRED ALONG ALL SIDE AND REAR PROPERTY LINES. THE VARIANCE IS BEING REQUESTED FOR THIS SUBJECT PROPERTY TO NOT PROVIDE THE SIX FT. TOM MASONRY SCREENING DEVICE ALONG THE EASTERN PORTION OF THE PROPERTY WHICH WILL DRAW IN HERE. UM ALONG THE EASTERN BOUNDARY OF THE SITE. THERE IS A CREEK FLOODPLAIN AND HEAVILY WOODED AREA BECAUSE OF THE PROPERTY LINE WITHIN THE CREEK. IT CREATES AN IRREGULAR BOUNDARY THAT IS SUBSTANTIALLY DIFFERENT COMPARED TO TYPICAL SITES. THE PROPERTY ON THE OTHER SIDE OF THE CREEK IS CURRENTLY UNDEVELOPED AND ZONED FOR LIGHT INDUSTRIAL AND OFFICE USES. THE EASTERN PROPERTY LINE OF THE SITE IS THE ONLY AREA NOT TO BE SCREENED ACCORDING TO CODE ALL OTHER REQUIRED SCREENING IS PROVIDED ON SITE. SECTION 1 46 1 32. THE SECTION THAT COVERS FENCES, WALLS AND SCREENING REQUIREMENTS ALLOWS APPLICANTS TO REQUEST VARIANCES. PNG CAN GRANT VARIANCES BASED ON ONE OF FOUR CRITERIA, WHICH ARE OUTLINED IN THE STAFF REPORT. AS YOU CAN SEE THE REQUESTED VARIANTS MEETS ALL FOUR CRITERIA INSTEAD OF JUST ONE. IN THE NEW UDC, THE APPLICANT WOULD NOT BE REQUIRED TO PROVIDE THE MASONRY WALL ADJACENT TO THE WOODED AREA AND THE FLOODPLAIN. IT IS STEPS OPINION THAT THE VARIANTS WILL NOT WILL HAVE NO ADVERSE IMPACT ON THE ADJACENT PROPERTIES DUE TO THE EXISTING CONDITIONS OF THE SITE. AS SUCH STAFF RECOMMENDS APPROVAL OF THE PROPOSED VARIANTS. BUT ALSO LIKE TO REITERATE THAT MULTI FAMILY USE IS ALLOWED ON THE SUBJECT PROPERTY AND THE ONLY REASON FOR THE PUBLIC HEARING IS FOR THE SCREENING VARIANTS REQUESTED ALONG THE EASTERN BOUNDARY ALL STAND FOR ANY QUESTIONS. JAMES RYAN, UM TO THE NORTH BETWEEN THE APARTMENTS AND THE HOUSES IS GOING TO BE A SIX FT. MASON ERI. THAT THE ONLY BREAK IS IN THE ACCESS TO THE NORTH AND THAT ACCESSES EMERGENCY ACCESS THAT'S GATE CONTROL. THAT'S CORRECT.

THAT'S GATE CONTROL. IT'S GOING TO HAVE A KNOX BOX ON IT FOR EMERGENCY ACCESS. SO NO TRAFFIC CARS. THIS IS FOR FIRE ACCESS. ONLY THE PRIMARY ENTRANCE IS GOING TO BE ON THE WESTERN SIDE . UH, RIGHT HERE. ALONG MCDONALD. AND YOU MENTIONED IN THE NEW CODE THAT IS NOT REQUIRED THAT THEY HAVEN'T MISSIONARY THAT THEY'RE BUILDING UNDER THE OLD CODE, AND THAT'S WHY WE'RE HERE. THAT'S CORRECT. THEY'RE DEVELOPING UNDER THE OLD CODE, UM, WHICH WAS BEFORE NOVEMBER 15TH UNDER THE NEW CODE IF THEY WERE TO DEVELOP UNDER THE NEW U. D. C E, IT WOULD BE APPROVED THE VARIANTS OF THE STAFF LEVEL. BECAUSE OF BOTH THE WOODED AREA AND THE FLOODPLAIN, AND THEY ONLY HAVE TO MEET ONE OF THOSE. THEY HAVE BOTH. AS FAR AS THIS IS ALREADY CURRENTLY ZONED MULTI FAMILY, SO THERE'S THIS IS NOT A ZONING. THIS IS JUST A SITE PLAN AS YOU MENTIONED A COUPLE OF TIMES. THERE IS NO OTHER BEARING IS REQUESTED FOR SETBACKS, PARKING OR ANYTHING OF THAT ISSUE. NO, SIR. IT'S JUST THE VARIANTS FOR THE SCREENING ALONG THE EASTERN BOUNDARY, SO THAT'S THE ONLY REASON FOR THE PUBLIC HEARING THIS EVENING. OTHER QUESTIONS OF STAFF. WHAT. JAKE. THANK YOU IS OUR AFRICAN HERE TONIGHT? GOOD EVENING, JONATHAN. HEY QUIT ACROSS ENGINEERING ENGINEERING. 17 20, WEST VIRGINIA. JAKE DID A GOOD JOB ON THE ON THE PRESENTATIONS. I DON'T HAVE MUCH TO ADD JUST TO REITERATE THAT RARE ENTRY IS EMERGENCY. ONLY ALL RESIDENT ACCESS WILL BE, UM FROM THE FRONT OFF OF MCDONALD. WE DON'T ANTICIPATE IT OR WE WON'T HAVE ANY TRAFFIC TO THE REAR. EXCEPT FOR FIRE EMERGENCY THINGS LIKE THAT. AND I'M HERE TO ANSWER YOUR QUESTION THAT YOU MAY HAVE THIS SIX FT. MASONRY FENCE PICKS UP ON THE OTHER SIDE OF THE FIRE ACCESS ALSO AND CONTINUES. IT'S HARD TO SEE ON THAT PLAN, BUT SHE CAN WORD.

WHICH BUTTON DO I PUSH HERE? CULTURAL ON THERE, BUT. PICKS UP JUST RIGHT HERE BEHIND THESE GARAGES. A LITTLE BIT. YEAH. SO IT COVERS ALL THE IMPROVEMENTS. AND THEN ONCE WE GET BEYOND THAT, THAT'S WHAT WE'RE ASKING THE PARENTS FOR. OTHER QUESTIONS . YEAH THE DESCRIPTION OF THE SCREENING TO THE EAST. I'VE READ, IT SAYS SAYS ORNAMENTAL METAL FENCING. YEAH, WELL, WE'RE GATED COMMUNITY, SO WE WILL HAVE AN ARM AND OFFENSIVE GOES ON THE WHOLE PROPERTY, SO IT'S NOT GOING TO GO. ALL THE WAY TO THE PROPERTY LINE, BUT JUST ON THE EDGE OF THE IMPROVEMENTS BEHIND BEHIND THE PARKING BEHIND THOSE BUILDINGS WHEREVER NOR MENTAL FENCE JUST TO SECURE THE PROPERTY. BUT WE DON'T HAVE ANYTHING PROPOSED IN THE FLOODPLAIN OR IN THE WOODED

[00:45:01]

AREA. ESSENTIALLY IN BETWEEN THE , UH THE WALLS TO THE NORTH AND THE SOUTH. NO SO ON THE ON THE NORTHERN MEASURING SCREEN WALL WILL BE WILL BE THE FENCE AND THEN ON THE EAST WILL HAVE THE ORNAMENTAL AND THEN ON THE SOUTH. I DON'T REMEMBER NOW FIST . IT'S UM I BELIEVE IT'S A MATRON WALL IN THE SOUTH AS WELL AND THEN WE HAVE ORNAMENTAL IN THE FRONT. SO IT CONTINUES. JUST RIGHT HERE IS WORTHY. ORNAMENTAL FENCE IS GOING TO BE THE REST OF IT'S GOING TO BE THE MASONRY ON THE NORTH AND THE SOUTH. YEAH. THANK YOU. THANK YOU. I GOT IT. THANK YOU. ANYONE ELSE? OTHER QUESTIONS? THANK YOU APPRECIATE BEING YOUR THIS IS A PUBLIC HEARING AUTUMN. I WILL NOW MOVE THROUGH THOSE THAT WOULD LIKE TO SPEAK. WE HAVE RECEIVED UM, CARDS. I'LL READ THE NAME. AND IF YOU HAVE A POSITION WERE READ THAT THAT AS WELL. UM AND THEN, INTRICATE THROUGH THESE. YOU'RE CERTAINLY WELCOME TO COME TO THE PODIUM. FIRST NAME IS MATTHEW, PEPPY IN WE'RE JUST SPEAK IN OPPOSITION. HI MATTHEW PAPILLON 408 TWIN OLD DR. UM, UH, PART OF THE IMPACTED AREA THAT WAS SHOWN, UH. MY ISSUE WAS NOT SO MUCH ABOUT THAT SIDE OF THE PROPERTY. MY MAIN CONCERNS WHAT I WROTE ON THE ROAD WE'RE IN. WE'RE IN REGARDS CITY TO THE OVERALL TRAFFIC IMPACT OF HAVING ALL OF THOSE NEW HOMES AND WHETHER OR NOT, YOU KNOW, FOR EXAMPLE, UM, IS THE ONLY ACCESS IN AND THE WAY TO ACCESS AND COME ONTO THAT PROPERTY THROUGH MCDONALD SHREVE, FOR EXAMPLE, BECAUSE TRAFFIC IS JUST ALREADY VERY ROUGH IN THAT AREA. TRYING TO LEAVE OUR COMMUNITY, SO THERE'S TWO ACCESS WAYS ALL OF OUR COMMUNITY. IT'S REALLY HEIGHTS.

THERE IS CYPRESS HILL, AND THERE'S TWIN OLD DR TRYING TO GET OUT OF OUR COMMUNITIES ALWAYS ALREADY QUITE HARD AT CERTAIN TIMES OF DAY, ESPECIALLY IN THE MORNINGS DURING PEAK TRAFFIC TIMES. UM SO YOU KNOW, THAT IS A CONCERN THAT I WANTED TO EXPRESS. IN ADDITION TO THAT, YOU KNOW, I WOULD LIKE TO KNOW IF THERE ARE ANY CONSIDERATIONS FOR HOW TO MITIGATE TRAFFIC IN THAT AREA, BECAUSE WHEN YOU WHEN YOU'RE COMING UP AND WE HAVE TRAFFIC COMING OFF THE FIVE OR 160 HOMES AND ALL THE CARS ASSOCIATED WITH OUR COMMUNITY COMING OUT ONTO ONTO MCDONALD STREET AS WELL, THERE'S ONE LIGHT ON WILMOTH RIGHT DOWN THE WAY AS YOU ALREADY PASSED.

WHAT'S ALREADY EXISTS AS ENTIRE DEPARTMENT COMPLEX. WE HAD THIS NEW COMMUNITY, AND THERE'S A LOT OF CONCERN HERE IN TERMS OF WHAT IT'S GOING TO DO TRAFFIC RIGHT THERE ON MCDONALD STREET AND JUST THE ABILITY FOR THE COMMUNITY JUST TO GET OUT. YOU KNOW OF OUR OWN HOMES AND ON OFF THE WORK AND EVERYTHING EVERY DAY, SO THAT THAT'S ONE OF THE BIG THINGS I WANTED TO BRING UP AND THAT I HAVE CONCERN FOR, UM I THINK SOME OF IT WAS ANSWERED AS FAR AS THE DIVIDING WALLS AROUND THE COMMUNITY. THEY JUST LAY THAT OUT. ONE OTHER CONCERN I HAD WAS THAT ROAD THAT IS THE ACCESS ROAD. I GUESS WHEN I'M TRYING TO UNDERSTAND IT IS REALLY A FENCE AROUND OUR COMMUNITY IN THAT AREA. AND AS I UNDERSTAND IT, UM, WHEN I WHEN I HEARD THIS TODAY, THERE WILL BE A GATE. UM, IF THAT'S THE CASE MY UNDERSTANDING WOULD BE THEY WOULD HAVE TO BE A ROAD BUILT IN THAT GATE WOULD BE LOCKED OR OR WOULD IT NOT BE LOCKED AS ONE QUESTION IN TERMS OF CONTROLLING ACCESS IN AND OUT OF OUR NEIGHBORHOOD? UM AND SO YOU KNOW , BECAUSE, FOR EXAMPLE, IF THERE'S AN EMERGENCY WHO HAS ACCESS TO THAT LOCKE DO W. AS A FIRE DEPARTMENT, FOR EXAMPLE, JUST CUT THE LOCK OR IS THE IDEA THAT THERE IS A GATE THAT JUST CAN'T BE OPENED BY ANYONE? AND THAT IS ANOTHER CONCERN FOR THE COMMUNITY. BECAUSE RIGHT NOW THERE IS NO ROAD THAT LEADS BACK THERE. SO YOU KNOW, THERE'S A LOT OF JUST NO ONE SEEMS TO UNDERSTAND WHAT THE PLAN THERE IS AND WHAT THAT IMPACT WOULD BE, BECAUSE THE ADDITIONAL FOOT TRAFFIC AND EVERYTHING THROUGH OUR COMMUNITY, THE ADDITIONAL TRAFFIC OR IF ANYONE IF WE SAY THAT THERE'S A GATE AND THERE'S A LOCK ON THE GATE, THAT'S ONE THING, BUT IF THERE'S A LOT AND THEY GET, I DON'T KNOW HOW HOW EMERGENCY VEHICLES GET IN AND OUT WHENEVER THEY NEED TO IN EMERGENCY WITHOUT HAVING TO CUT THE LOCK, SO IT WOULD JUST BE INTERESTED TO HEAR. YOU KNOW WHAT THAT PLAN MAY OR MAY NOT BE, IF IN FACT IS SECURED IN THAT WAY, SO FOR COMMUNITY SECURITY WOULD BE ANOTHER THING.

UM. THAT'S ALL THE TIME I HAVE. THANK YOU. WE'LL GET AN ANSWER TO YOUR QUESTION, MR POPPY IN TONIGHT. THANK YOU. THANK YOU FOR BEING HERE. THE NEXT CARD. KIER PETERSON. I DO NOT WISH TO SPEAK. I'M IN OPPOSITION, MR PETERSON. IS THAT STILL THE CASE? VERY GOOD NEXT CARD.

ANDREW AND RUTH INGRAM. I DO NOT WISH TO SPEAK. IN OPPOSITION. JUST STILL THE CASE. THANK YOU

[00:50:06]

ANYONE ELSE? THAT WOULD LIKE TO COME TO THE PODIUM. YES, MA'AM. GOOD EVENING. MY NAME IS KATIE POTTER. MY HUSBAND AND I MOVED INTO A HOME ON TWIN NOEL 6 20 TWIN OLD DRIVE. THIS PAST SUMMER . IT'S OUR FIRST HOME AND ONE OF THE THINGS THAT WE LOVE MOST IS THE NATURE THAT WE GET TO EXPERIENCE RIGHT OUT OUR BACKDOOR. ABOUT A MONTH AFTER MOVING IN, WE HEARD AN OWL HOOT IN THE GREEN BELT, AND FOR THE FIRST TIME WE FELT AT HOME. I'VE BEEN PREPARING TO RE ESTABLISH NATIVE GRASSES IN MY OWN BACKYARD, SO WE DO A LOT OF SOIL STUDIES, AND I FEEL THAT IT'S IMPORTANT FOR THE PLANNING AND ZONING COMMISSION TO BE AWARE THAT THE PROPERTY IN QUESTION SITS ON HOUSTON, BLACK CLAY AND THE LEWISVILLE SERIES, WHICH ARE TWO UNIQUE TYPES OF SOIL THAT SUPPORT CRITICALLY THREATENED BLACK LAND PRAIRIE. WHEN THE PROPOSED DEPARTMENTS ARE BUILT, IT WILL RESULT IN THE LOSS OF NATIVE GRASSES, WILDFLOWERS AND THE ANIMALS, WHICH DEPEND ON THEM FOR SURVIVAL. THIS BRINGS ME TO THE VARIANCE UP FOR DISCUSSION. I FEEL STRONGLY THAT PHYSICAL SCREENING SHOULD BE PROVIDED ON THE EASTERN SIDE OF THE PROPERTY, NOT ONLY TO PROTECT THE TRINITY HEIGHTS NEIGHBORHOOD FROM DISTURBANCE, BUT TO SHIELD THE REMAINING GREEN BELT AND THE ANIMALS THAT LIVE IN IT. THE GREEN BELT SURROUNDING THIS PROPERTY CONTAINS A WIDE VARIETY OF NATIVE TREES AND UNDERGROWTH. PLANTS THAT CREATE A CORRIDOR FOR WILDLIFE TO NAVIGATE ARE RAPIDLY DEVELOPING CITY PERSON PERSONALLY SEEN OR FOUND SIGNS OF ANIMALS LIKE DEER, BEAVERS, COYOTES AND ARMADILLOS. THIS NARROW STRIP OF FOREST SHELTERS MANY SPECIES OF BIRDS, INCLUDING PROTECTED RAPTORS, LIKE RED SHOULDERED HAWKS, MISSISSIPPI KITES, RED TAILED HAWKS, TURKEY VULTURES AND BARRED OWLS. THE HABITAT IS ALSO A BREEDING GROUND FOR NATIVE POLLINATORS LIKE MASON AND LEAF CUTTER BEES, WHICH ARE CURRENTLY AT RISK DUE TO HABITAT LOSS IN ORDER TO PRESERVE OUR NEIGHBORHOODS, NATURAL BEAUTY AND BIODIVERSITY . WE MUST CONSIDER HOW TRASH CHEMICAL RUNOFF, PHYSICAL BARRIERS AND GENERAL COMMOTION INTRODUCED BY AN ENTIRE APARTMENT COMPLEX WILL AFFECT WILDLIFE. PROVIDING SCREENING ON THE EASTERN SIDE OF THE PROPERTY WOULD REDUCE THE EFFECTS OF LIGHT NOISE AND WASTE POLLUTION IN THE GREEN BELT SO THAT THE WILDLIFE ALREADY LIVING HERE FEEL SECURE ENOUGH TO STAY. UM AS LONG AS I HAVE SOME TIME WITH YOU GUYS, I WOULD JUST LIKE TO STATE FLAT OUT THAT I DON'T SUPPORT THE BUILDING OF THIS PROJECT. I'M REALLY CONCERNED ABOUT THE HABITAT. IT'S ALREADY THERE. UM SO YEAH, THANK YOU FOR YOUR TIME AND YOUR EFFORTS TO KEEP MCKINNEY UNIQUE BY NATURE.

YEAH THANK YOU, MR POTTER. FOR BEING HERE. ANYONE ELSE WISH TO SPEAK TONIGHT ON THIS ITEM? YES.

THANK YOU. GOOD EVENING. I LIVE JUST A COUPLE OF HOUSES DOWN FROM MISS POTTER AT 608 TWIN HOLD DRIVE, SO OUR BACKYARD IS DIRECTLY BEHIND, BUT WE CONSIDER A GREEN BELT AND I SECOND EVERYTHING, SHE SAID FROM THE OWLS EVEN LAST NIGHT, SITTING OUTSIDE LISTENING TO THEM A POSSUM COMING ACROSS OUR BACKYARD AND MY FOUR YEAR OLD DAUGHTER JUST IN AWE. WE HAVE VISITS OF RACCOONS AND OTHER BIRDS THAT ARE JUST NATURAL AND THAT I THINK THAT MAKES IT VERY UNIQUE FOR OUR SUBDIVISION WHERE THE BLUE LINE IS DRAWN, UM, IS RIGHT WHERE THE CREEK AND EVERYTHING STARTS AND I UNDERSTAND WITH THE, UM THE IRON GATE, BUT I WOULD BE MORE, UM I GUESS THAT PIECE IF IT WAS A LARGER MASONRY THAT WOULD ACTUALLY KEEP INDIVIDUALS FROM GOING BACK THERE OR DISTURBING OUR NEIGHBORHOOD. WE ALREADY HAVE ISSUES WITH THE APARTMENT COMPLEX THAT IS CURRENTLY THERE TO THE SOUTH OF US WITH INDIVIDUALS GOING THROUGH THEIR FENCE AND THEN ACTUALLY COMING THROUGH OUR FENCES, WHICH WE ARE CURRENTLY IN THE PROCESS OF PUTTING BACK TOGETHER THAT HAS BEEN DAMAGED FROM INDIVIDUALS THAT SHOULD NOT BE ON THE PROPERTY TO BEGIN WITH. AND THEN THE QUESTION OF THAT INLET DRIVE WHERE IT STOPS. I KNOW IT WAS SUPPOSED TO BE PHASE THREE OF OUR SUBDIVISION. THAT WAS ACTUALLY, UM, THE CITY SAID NO AND STOP THAT PLANNING AND THEN TURN IT INTO A MULTI PURPOSE INSTEAD OF LETTING US GO INTO OUR FACE THREE AND I WORRY ALSO WITH MISS POTTER, THAT THIS LAND IS VERY NARROW AND VERY SMALL, AND TO PUT THAT AMOUNT OF FAMILIES AND APARTMENTS INTO IT . I FEEL LIKE I WOULD JUST BE A SQUEEZE VERSUS ACTUALLY DEVELOPING AND POURING INTO THAT LAND THAT WE HAVE INTO A PARK, MUCH LIKE AVIATOR PARK THAT'S OVER THERE BY PRESS ELEMENTARY, AND MAYBE EVEN TURNING IT INTO MORE OF A NATURE WITH TRAILS WHERE PEOPLE COULD ACTUALLY SEE THOSE NATURAL ANIMALS AND HABITATS AND BEING ABLE TO KEEP IT. I FEEL THAT HAVING THOSE APARTMENTS RIGHT NEXT TO ARE COMMUNITY. ALL THOSE SELFISH TO SAY WOULD JUST BE REALLY IT WOULD JUST BE INTRUSIVE TO WHAT THAT GREEN BELT HAS RIGHT NOW WHERE WE COULD ACTUALLY POUR INTO IT AND MAKE IT MORE UNIQUE BY NATURE AND KEEPING THAT AND MAKING IT MORE OF A NATURAL SPACE VERSUS INTRUDING AND

[00:55:03]

PUTTING IT MORE COMMERCIAL ACROSS THE STREET FROM US. WE ALREADY HAVE A LOT OF COMMERCIAL BUILDINGS THAT ARE GOING UP. AS MR PAPUAN ALWAYS TALKED ABOUT THAT WITH LARGE TRUCKS AND A LOT OF COMMOTION ACROSS THE STREET. THAT'S ADDING A LOT OF STRESS INTO THAT CORRIDOR AREA OF WELLNESS AND MCDONALDS STREET AND I FEEL LIKE EVEN THE EXPANSION OF THAT MAY NOT BE ABLE TO SUSTAIN OR BE ABLE TO TAKE WHAT'S GOING TO BE MOVING IN AS THOSE BUILDINGS COMMERCIAL BUILDINGS WITH WORKERS AND THEN SEMI TRUCKS ALREADY ON THAT PROPERTY. MY HUSBAND CURRENTLY WORKS FOR TEXT DOT SO I KNOW ADDING A LIGHT HAS BEEN IN TALKS BEFORE AND THEN SHOT DOWN BY TEXT DOT DUE TO THE LIGHTS THAT ARE ALREADY THERE'S NOT ENOUGH SPACE, AND THERE'S NOT ENOUGH FOOTAGE TO HAVE ANOTHER LIGHT ADDED BECAUSE OF WHERE THOSE TWO LIGHTS ARE ALREADY LOCATED. BUT I THINK THE MOST IMPORTANT THING WOULD JUST BE KEEPING THAT GREENBELT WHAT IT IS WITH THOSE ANIMALS THAT CURRENTLY LIVE THERE THAT ARE JUST HARD TO COME BY, ESPECIALLY WITH THE OWLS.

BUT I HOPE THAT YOU GUYS JUST HEAR OUR HEARTS IN THE SENSE OF WHAT WE'RE TRYING TO KEEP UNIQUE AND NATURE VERSUS TRYING TO JUST SHOVE ANOTHER MULTIPURPOSE INTO A VERY SMALL SPACE. THANK YOU FOR YOUR TIME. I APPRECIATE YOU ALL. THANK YOU, MISS MEADOWS. IS THERE ANYONE ELSE THAT WOULD LIKE TO SPEAK TONIGHT? ANYONE ELSE LIKE TO SPEAK IN THE PUBLIC HEARING? MOTION TO CLOSE THE PUBLIC HEARING. EMOTIONAL DEMANDS I TO CLOSE THE PUBLIC HEARING 2ND 2ND BY MR TAYLOR. IS THERE ANY DISCUSSION? CAST YOUR VOTE. THE MOTION CARRIES THE PUBLIC HEARING HAS BEEN CLOSE TO HAVE QUESTIONS OF STAFF WITH THE APPLICANT STAFF. JAKE DO YOU WANT TO DESCRIBE THE FIRE ACCESS TO US FROM THE ROAD? I KNOW WE HAVE A NUMBER OF THESE IN THE CITY AND DIFFERENT SUBDIVISIONS.

UM, RELATED TO HOW THEY'RE ACCESSED AND EVERYTHING. YEAH WE SEE THEM WITH MANY, PROBABLY OVER HALF OF OUR MULTI FAMILY PROJECTS THAT COME IN WHERE IT'S NOT COMMUNITY ACCESS. IT IS STRICTLY FOR EMERGENCY VEHICLES . AMBULANCE FIRE POLICE. UM, SO THIS IS PROBABLY NOT GOING TO BE USED UNLESS THERE IS A BLOCKAGE OF THE FRONT ENTRANCE. THAT'S OFF OF MCDONALD AND THEY HAVE TO GET IN THROUGH TWIN KNOLL, BUT THERE'S NOT GONNA BE ANY PASSENGER VEHICLE TRAFFIC THROUGH THIS GATE. GATES ARE LOCKED. IT HASN'T KNOCKS BOX ON IT, SO IT SETS OFF AN ALARM IF THE CABLE'S BROKEN MORE OF ITS REMAINING OPEN FOR, UM LONGER AMOUNT OF TIME, SO. SO TO CLARIFY AND KNOCKS BOX IS WHAT UH, SO IT'S MORE OF ONE OF OUR FIRE REQUIREMENTS, BUT IT'S A PIECE OF MACHINERY THAT THEY HAVE ON THE GATE, UM, WHERE THEY CAN GAIN ACCESS THROUGH THAT GATE THROUGH A PIECE OF TECHNOLOGY THAT THEY HAVE AS WELL. SO NOT EVERYONE IS GOING TO BE ABLE TO GET THROUGH HERE, AND THEY ONLY HAVE THE KEY TO THE KNOX BOX. THAT'S CORRECT.

YEAH. BEING THE FOREIGN DEPARTMENT EMERGENCY PERSONNEL, RIGHT? AND AGAIN, THIS ENTRANCE WOULD ONLY BE USED IF THE MAYNARD TO SOFTEN HIGHWAY FIVE IS BLOCKED AND ACTUALLY HAVE TO HAVE TWO ENTRANCES OFF HIGHWAY FIVE. YEAH, I THINK ACTUALLY, ONE SIDE IS JUST FOR ENTRY ONE SITES FOR EXIT AND THEN IT'S GOING TO HAVE THAT MEDIAN. SO IT'S GOING TO BE A PRETTY LARGE ENTRYWAY THERE. SO HAVE A QUESTION. I'M JUST INTRIGUED MAN . YOU SAID IT WAS GONNA SET OFF AN ALARM. AT THE FIRE DEPARTMENT . AND WHAT IS THAT NOBODY GAVE ITSELF IS GOING TO HAVE SO OKAY.

YEAH, THANK YOU. I HAD A QUESTION. UM SO, FOR INSTANCE, THE VARIANTS THAT THEY'RE ASKING FOR ON THE ORNAMENTAL FENCE VERSUS UM A SOLID MASONRY FENCE. THE WAY I SEE IT THERE BEING VERY CONSERVATIVE IN THEIR PLACEMENT OF THE ORNAMENTAL TO PRESERVE A GREEN AREA. THAT'S CORRECT. BUT IF I WANTED TO PUT IN A MASONRY FENCE, THEY COULD ENCLOSED PART OF THAT GREEN AREA TO IF THEY WANTED TO GET SOME GREENERY INSIDE THE MASONRY FENCE. IS THAT CORRECT? THEY HAVE THE OPPORTUNITY TO IF THEY WANTED TO DO A MASONRY WALL AROUND THIS ENTIRE PROPERTY RIGHT UP TO THE CREEK COULD ACTUALLY TAKE IT. YEAH, IT WOULD. THEY WOULD BE IMPACTING MANY OF THE TREES IN THAT AREA. THE FLOODPLAIN, UM PROBABLY WATER QUALITY AS WELL. SO HAVING THIS FENCE PULLED OFF THAT FLOODPLAIN PRESERVING ALL OF THESE TREES BACK HERE BY THE CREEK. UM THIS IS PROBABLY MORE BENEFICIAL. SUBSTITUTE AND THIS IS FOR US REAL QUICK. IT'S ACTUALLY ALREADY DRAWN ON HERE. SO THIS IS THE AREA FOR THE FENCE IS GOING TO GET THE

[01:00:01]

ORNAMENTAL PROPERTY LINE EXTENDS ALL THE WAY OUT. SO THE PROPERTY LINE IS ALL OF THIS OVER HERE.

SO AND THEN IT CONTINUES DOWN FURTHER. AND THAT'S BECAUSE THE PROPERTY LINE IS THE CREEK ITSELF WILL CLEAR THAT UP. BUT. YOU CAN SEE IT AS A PRETTY WILD BOUNDARY THERE. THAT'S AT REGULAR THANK YOU. AND JAKE AND OUR NEW CODE. THIS IS SOMETHING THAT WE HAVE DECIDED THAT IS STAFF LEVEL APPROVAL BECAUSE WE'VE DONE IT ON A NUMBER OF PROPERTIES, WHICH OVERLOOKED GREEN SPACE AND THINGS TO GET RID OF BRICK WALLS AND MAKE MORE GREENERY AND A GREENER FOR APPEAL. WITH THIS BEING FLOODPLAIN, AND THEY'RE BEING THIS IS HEAVILY WOODED BACK HERE. IT WOULD BE IMPACTING A LOT OF THOSE MATURE TREES AND PROBABLY HAVING TO KNOCK THEM DOWN IN ORDER TO PUT THE FOOTINGS IN FOR THOSE WALLS, SO. SO YEAH. ONE MORE QUESTION, JAKE. THE FENCING ON ALL SIDES ON THREE SIDES. THAT'S GONNA PREVENT CORRECT ME IF I'M WRONG.

AUSTRIAN TRAFFIC OF ANY KIND. EVEN THE HORN ORNAMENTAL FENCE IS THAT IS THAT CORRECT? YEAH I DON'T THINK THAT THERE IS A GATE ON THE EASTERN SIDE OF THE PROPERTY THROUGH THE ORNAMENTAL FENCE. NO. NO GATE SO THANK YOU QUESTION. OKAY. THANK YOU. THANK YOU. COULD YOU ADDRESS? UH, AH TRAFFIC FLOW AND TRAFFIC COUNTS AND STOPLIGHTS AND TRAFFIC CONTROL ON HOW WE FIVE, OF COURSE SO WITH EVERY SITE PLAN AND RESIDENTIAL PLATT PLANTS ANY OTHER PLAN OR PERMIT THAT COMES THROUGH, UM, OUR DEPARTMENT GETS REVIEWED BY OUR ENGINEERING DEPARTMENT AS WELL. UM SO THE DRIVEWAY SPACING ALONG HIGHWAY FIVE. THE DRIVEWAY SPACING BETWEEN THE PROPOSED DRIVE AND TWIN ALS TO THE NORTH DOESN'T MEET OUR REQUIREMENT. IT DOESN'T MEET TECH STOCKS ARE TECH STOCKS REQUIREMENT AS FOR LIGHT THERE, UM I HAVEN'T BEEN IN TALKS WITH ANYTHING AS FAR AS THAT GOES, SO I'M NOT SURE WHETHER THERE WOULD BE A LIGHT AT ONE OF THOSE AREAS ARE NOT IN THE FUTURE. UM IT'S UNLIKELY BECAUSE OF THE NUMBER OF LIGHTS THAT ARE ALREADY ALONG THIS ROAD. THIS BEING A STATE HIGHWAY IS A LIGHT BEING PLACED THEIR DECISION THAT SOMEONE ELSE MAKES THAT'S TEXT DOT IT'S NOT GONNA BE THE CITY OF MCKINNEY, OKAY? NO ONE ELSE. ANYONE WANT TO TALK TO THE APPLICANT AGAIN? VERY GOOD, JAKE. THANKS. WE HAVE A MOTION. I UNDERSTAND THE, UM CITIZENS AND THEIR CONCERNS. UM AS FAR AS RELATION TO THE ENVIRONMENT IN THE AREA OF THE TRAFFIC IN THE AREA. THE FIRE ACCESS AND MANY OF THOSE CONCERNS COME BACK TO JUST NOT WANTING MULTI FAMILY AND THE IMPACT THAT WILL HAVE THERE. BUT THAT'S NOT WHAT'S BEFORE US TONIGHT BECAUSE IT IS ALREADY ZONED FOR THAT. THE ONLY QUESTION BEFORE US TONIGHT IS THE EASTERN BOUNDARY AND THE WROUGHT IRON IS LESS IMPACTFUL FOR THAT. I HOPE THAT THEY YOU DID GET SOME ANSWERS RELATED TO SOME OF THE QUESTIONS AS FAR AS THAT ACCESS AND WHAT IT WILL LOOK LIKE THEY'RE BUT ROD IRON TO THE EAST IS WITHIN OUR NEW COAL CODE. AND BECAUSE IT IS THERE BECAUSE IT JUST MAKES SENSE OVERALL FROM THE IMPACT TO THE VISIBILITY AND VISUALLY RELATED TO THESE DEVELOPMENTS, SO I'M IN FAVOR OF GRANTING THE SITE PLAN WITH THE EXCEPTION. ANYONE ELSE? COMMENTS, MOTIONS.

I WILL MOVE TO APPROVE SECOND MOTION AND MR MEN'S AND APPROVED THE ANIMALS FOR THIS ONE IS ACTUALLY GOING TO BE VERY SIMILAR TO A ZONING. OR S U P REQUEST DUE TO THE ZONING ON THE PROPERTY. Y'ALL ARE ACTUALLY GOING TO BE DOING VERY SIMILAR TO HIS OWNING WHERE IT'S MORE OF A RECOMMENDATION THAT IT IS A ACTION, IT'S GOING TO GO TO THE CITY COUNCIL MEETING. OKAY SO YOU'RE AWARE CLEAR? YES JUST SO WE'RE COMPLETELY CLEAR THAT Y'ALL ARE MAKING THAT RECOMMENDATION SAYING IS THAT I RECOMMEND THAT THEY SHOULD BUILD THIS ORNAMENTAL FENCE TO THE EAST OF THIS FACILITY. WE'RE MAKING A RECOMMENDATION TO CITY COUNCIL THAT THEY APPROVED THAT IS PLACED AT THE END OF THIS PROPERTY. THAT'S IT. THAT'S CORRECT. THANK YOU. THAT'S THE MOTION CORRECT. THE MOTION BY MR MAN'S EYES. SECOND BY MR LEBOW. WAS THERE ANY DISCUSSION? THE ITEM WILL GO TO CITY COUNCIL. WITH OUR RECOMMENDATION. FEBRUARY 7 2023 CITY COUNCIL MEETING. PLEASE CAST YOUR VOTES. THE MOTION CARRIES BY A VOTE OF SEVEN IN FAVOR AND ZERO AGAINST
