HMM. SUNDOWN. NEXT YEAR. PUBLIC COMMENTS ON AGENDA ITEMS FOR NONPUBLIC

[PUBLIC COMMENTS ON AGENDA ITEMS (for Non-Public Hearing Items)]

CURING ITEMS AND WE ALSO HAVE SOME NON AGENDA ITEMS AND WE WILL GO AHEAD AND HEAR THOSE AT THIS TIME AS WELL. UM FIRST, THOUGH, THERE IS ONE THAT IS A DOES NOT WISH TO SPEAK, BUT WILL BE ENTERED INTO THE RECORDS FROM RICKY BANK REGARDING MCINTYRE ROAD. AND THAT WILL BE ENTERED INTO THE RECORD. UM FIRST JULIE LUTON. I DON'T KNOW WHERE THE TIMER IS. THERE IT IS. HELLO COUNCIL. THANK YOU FOR YOUR TIME TODAY. MY NAME IS JULIE LUTON 22 YEAR RESIDENT OF MAKENI. I'M HERE TODAY TO TALK ABOUT BOARDS AND COMMISSIONS, APPOINTMENTS AND HOPES FOR MORE DIVERSITY AND OPENNESS IN THIS PROCESS. I KNOW THAT THIS COUNCIL CAN ONLY APPOINT THOSE TO THE BOARDS AND COMMISSIONS IF THEY APPLY. I ALSO KNOW THAT THIS COUNCIL CAN AND DOES SEEK OUT APPLICANTS THEY BELIEVE ARE QUALIFIED. BUT PEOPLE ALSO ONLY APPLY IF THEY FEEL THEY HAVE A CHANCE TO BE APPOINTED, AND IF THEY FEEL THAT THEIR APPLICATION WILL BE WELCOMED. WHO ARE WE GIVING THE OPPORTUNITY TO BE SEEN AS LEADERS IN THIS PROCESS ARE BOARDS AND COMMISSIONS HAVE ONLY 36% WOMEN SERVING ON THIS. THOSE AND WOMEN ARE ALMOST NON EXISTENT ON PLANNING AND ZONING AND ON THE MCKINNEY ECONOMIC DEVELOPMENT COUNCIL, THE TWO MOST INFLUENTIAL BOARDS ADVISE THIS COUNCIL. I THINK THERE'S ONLY ONE ACTUALLY ONE WOMAN A COMMENT MADE AT THE LAST MEETING ABOUT A POTENTIAL WOMAN CANDIDATE WAS THE COUNCIL MEMBERS DIDN'T KNOW THAT CANDIDATE AND ALTHOUGH I THINK IT HAD MORE TO DO WITH HER LONGEVITY IN THE CITY, AND THAT'S CERTAINLY RELEVANT. THE ACTUAL TRUTH IS, AND IT REMAINS THAT ARE BOARDS AND COMMISSIONS CYCLE THROUGH THE SAME PEOPLE. HOW WILL OTHERS ACHIEVE TRUE LEADERSHIP IN THIS CITY IF THEY RARELY HAVE THE OPPORTUNITY TO BE SEEN AS VITAL TO OUR COMMUNITY SUCCESS? BY NOMINATING THE SAME OLD, SAME OLD. WE DO HAVE THE BENEFIT OF EXPERIENCE, WHICH IS VERY IMPORTANT, BUT THAT EXPERIENCE DOESN'T GET US DIVERSITY OF THOUGHT. DIFFERENT PERSPECTIVES AND SOME INNOVATION THAT'S OUT THERE AS WELL. ONE COUNCIL MEMBER LAST MEETING SAID THAT THE CANDIDATE WHO WAS ULTIMATELY APPROVED, OFFERED A MISSING PIECE OF THE PUZZLE. I'VE HEARD THAT SAYING BEFORE, IN MANY PLACES AND FROM THIS COUNCIL BEFORE, BUT THE TRUTH IS THAT THE PIECE OF PUZZLE WE ARE MISSING IS NOT ACTUALLY ONE PERSON NO MATTER WHO IT IS. WE ARE MISSING AN ENTIRE POOL OF LEADERS WHO COULD MAKE A STRONGER, MORE COMPETITIVE AND MORE INNOVATIVE. KENNY IS 50% WOMEN. 12% OF MCKINNEY IS BLACK. 17% IS LATINO, AND ALMOST 11% IS ASIAN. LOOK AT OUR BOARDS AND COMMISSIONS AND TELL ME WHETHER THOSE SERVING OUR REPRESENTATIVE REPRESENTATIVE I'M ASKING FOR THE CITY COUNCIL TO NOMINATE AND SELECT QUALIFIED MEMBERS WHO SERVE ON THESE BOARDS AND

[00:10:03]

COMMISSIONS, BUT ALSO PLACE IMPORTANCE ON GENDER AND DIVERSITY. THIS ISN'T JUST A GOVERNANCE ISSUE. ONCE WE HAVE WOMEN AND PEOPLE OF COLOR AND LEADERSHIP POSITIONS, THE ECONOMIC PLAYING FIELD WILL ALSO START TO LEVEL, ACCORDING TO RECENT CHAMBER OF COMMERCE DATA . MCKENNEY WOMEN MAKE $41,000 LESS IN MEDIAN PAY THAN MEN. WE ARE JUST SLIGHTLY BETTER THAN OUR NEIGHBOR FRISCO, WHO LEADS THE NATION IN THEIR PICKUP, WE CAN DO BETTER, MUCH BETTER. AND WHEN THESE ECONOMIC DISPARITIES ARE ADDRESSED, IMAGINE OUR ECONOMIC ONE FALL WHEN THE CITY RECEIVES MORE IN TAXES, MORE DISPOSABLE INCOME FOR FAMILIES, MORE FAMILY SAVINGS AND FEWER PEOPLE NEEDING ASSISTANCE. MCKENNEY NEEDS MORE DIVERSITY AND REPRESENTATION IN MANY WAYS, DIVERSITY OF THOUGHT DIVERSITY OF GENDER DIVERSITY OF ETHNICITY. YOU CAN DO THIS HARD WORK AND YOU CAN MAKE THINGS BETTER. I ASK YOU TO DRY. THANK YOU. GOOD JOB TOO MUCH. JULIA WOULD JUST SAY THAT THE TWO MONEY BOARDS WE HAVE SIX WOMEN, SIX WOMEN BETWEEN THE TWO BOARDS. UM SO. UM NIKKI, I THINK IT'S NICKY. NICKY. WELL, UM THAT'S CONDA. COME ON.

CAN WE BEGIN? OKAY THANK YOU. MY NAME IS DOC SINGLE, AND I LIVE 350 AT BANKHEAD PLACE. I'VE BEEN A RESIDENT OF MCKINNEY FOR AROUND FIVE YEARS. UM MY NAME IS TO KILL BETTER CONDUCT. I AM NOT A RESIDENT OF MCKINNEY, BUT I DO ATTEND. IMAGINE INTERNATIONAL ACADEMY, WHICH IS IN MCKINNEY.

SO ON THAT NOTE, THE ITEM THAT WE ARE CONCERNED ABOUT IS THE TRAFFIC IN FRONT OF OUR SCHOOL.

IMAGINE AND WE BELIEVE AS A CATERER'S TAUGHT SCHOOL THAT THE INTERSECTION, ESPECIALLY JORDAN, AND VIRGINIA, IS UNSAFE AND HAS THREE CLEAR ISSUES WITH ITS PRESENTATION, ESPECIALLY BETWEEN 7 TO 7:30 A.M. AND 3. 45. PM BETWEEN 7 TO 7:30 A.M. IS, UM, WHEN THE KINDERGARTNERS TO SECOND GRADERS ARE ENTERING THE SCHOOL, AND THIS IS ALSO THE TIME WHEN THE STUDENT DRIVERS OF THE SCHOOL TYPICALLY INTEND TO 12TH GRADE, ALSO ENTERED THE SCHOOL AND BECAUSE OF THE EXISTENCE OF THIS ONE LANE, IT MAKES IT VERY DIFFICULT FOR THESE DRIVERS TO ENTER THE SCHOOL. UM IT REQUIRES THE DRIVERS TO GO THROUGH THE NEIGHBORHOOD OR ANOTHER. AH DIFFICULT WAYS. IN ORDER TO, UM MAKE ILLEGAL RIGHT TURN INTO THE SCHOOL. YES AND ON THAT NOTE, WE ALSO BELIEVE IT'S A SAFETY HAZARD FOR THE STUDENT WALKERS TO ONLY HAVE ONE BACKWARD LANE IN THREE FORWARDS LINE ON JORDAN'S BECAUSE IT INCENTIVIZES THE DRIVERS TO TAKE THOSE ILLEGAL LEFT TERMS, WHICH IS VERY DANGEROUS FOR THE STUDENTS THAT WALKED FROM THE COMMUNITY TO THE SCHOOL. THERE'S ALSO THE ISSUE OF SAFETY AS WELL, CONSIDERING HOW ESPECIALLY ONE OF OUR CLOSE FRIENDS HAS RECENTLY GOT INTO A CAR ACCIDENT IN THAT AREA. THREE PEOPLE WERE LEFT HOSPITALIZED AND WE FEEL THAT THIS IS BECAUSE OF THE INEFFICIENCY OF HAVING THIS ONE LANE. IT HAS CAUSED THE AREA TO BE MORE CONGESTED AND HAS CAUSED AN OBSTRUCTED VIEW FOR DRIVERS IN THAT AREA SO OVER THE PAST FEW MONTHS, NICOLE AND I HAVE CREATED A TRAFFIC MODEL, WHICH I WAS UNABLE TO BRING TODAY. HOWEVER IT IS SHOWN THAT CURRENTLY AS JORDAN'S STANDS, JORDAN AND VIRGINIA, IT TAKES ROUGHLY 100 FIFTY'S 50 SECONDS FOR A CAR TO ESSENTIALLY ENTER AND LEAVE THE INTERSECTION. HOWEVER WITH THE IMPLEMENTATION OF A NEW BACKWARDS LAYING IT, ACTUALLY, THE MODEL SHOWED THAT IT ONLY TOOK 100 AND 13 SECONDS AND THIS SOLUTION WAS ALSO SUPPORTED BY OUR SCHOOLS. TRAFFIC DIRECTOR MS DODDS YES, AND THIS IS BECAUSE THAT THERE WOULD BE LESS ILLEGAL LEFT TURNS BECAUSE IN ORDER TO TAKE A TURN DIRECTLY INTO THE SCHOOL, YOU WOULD HAVE TO TAKE AN ILLEGAL LEFT TURN AND ALSO BECAUSE THIS WOULD CAUSE PEOPLE TO JUST IN GENERAL. MAKE ILLEGAL RIGHT TURN INTO THE SCHOOL OR LOVE TURN INTO SCHOOL. SO I MEAN, WE'RE BOTH SENIORS WERE 17 YEARS OLD. WE'RE ABOUT TO HEAD OFF TO COLLEGE, SO THIS WOULDN'T DIRECTLY AFFECT US. BUT AS A CATERS 12 SCHOOL, WE ARE DIRECTLY RESPONSIBLE AND AFFECTED. BY THE SAFETY OF OUR YOUNGER CLASSMAN. AND SO WE HOPE THAT THE COUNCIL TAKES THIS MORNING TO STUDY IN FUTURE MEETING AGENDAS. AND IF NOT, FOR OUR SAKE FOR THE SAKE OF THE CHILDREN IN THAT AREA. IT'S IMPORTANT THAT WE INVESTIGATE THIS FURTHER AND WE BELIEVE THIS WOULD NOT ONLY AFFECT US BUT ALSO THE PRESCHOOL IN THAT SAME AREA AND AS WELL AS THE NUMBER OF HOUSES IN THE NEIGHBORHOOD. IN THAT AREA. THANK YOU. YES THANK YOU FOR TAKING THE TIME,

[00:15:06]

RIGHT? COME ON. THERE WAS A WELL PRESENTED ARGUMENT. THANK YOU. SO ARE YOU GOING TO EMAIL US? WHAT? YOU COME UP WITH IT TO US ? ALL OF US SENT ALL OF US. I BET YOU THAT THERE WILL BE A VOTE ON COUNCIL TO BRING THIS STUDY FORWARD AND HAVE STAFF. LOOK AT IT. THAT'S THE WAY TO DO IT. CAN'T YOU TO AFFECTING CHANGE? UM, AMBER BLOCK. HELLO GOOD EVENING. I'M HERE REPRESENTING THE FAMILIES AND RESIDENCES, BUSINESSES, COMMUNITY RESOURCES THAT LIVE ALONG RENT. SEE WE HAVE BEEN GIVEN ONE MORE WEEK TO PRESENT OUR DILEMMA. AND, UM. I GUESS WE'RE ALL JUST FEELING A LITTLE BIT FRUSTRATED WHEN YOU SEND AN EMAIL TO TEXT DOT THE RESPONSE YOU GET IS YOUR COMMENTS WILL BE ADDED TO THE PUBLIC HEARING SUMMARY. SO WHEN WE'VE BEEN AT THE HEARINGS AND THINGS UM, WE HAVE TRIED TO ASK OUR QUESTIONS . WE HAVE TRIED TO ASK POINT OUT DISCREPANCIES IN THEIR MAPPING. UM YOU KNOW, I POINTED OUT OUR HOUSE, AND THEY DIDN'T EVEN KNOW THAT WAS A COMMUNITY RIDING ARENA WASN'T FACTORED INTO THEIR UM DEMOGRAPHIC. MY OTHER NEIGHBOR WAS LIKE THAT'S MY HOUSE, AND THEY'RE LIKE, OH, THAT'S A HOUSE AND WE'RE LIKE THAT'S A HOUSE, SO I THINK WHAT WE'RE REALLY FEELING FRUSTRATED WITH IS JUST THE LACK OF COMMUNICATION THAT WE GET WITH TEXT DOT SO I THANK YOU THAT WE DO GET THREE MINUTES TO TALK TO YOU FACE TO FACE AND WE HAVE TRIED TO FOLLOW THE PROCESS AS CLOSELY AS WE CAN. WHAT WE'VE COME UP WITH IS YOU KNOW THEY WERE TELLING US IT WAS GOING TO BE ROUTE DE, WHICH MAKES SO MUCH MORE SENSE. AND I KNOW THAT YOU YOU HAVE HEARD THE, UM YOU KNOW THE STATISTICS AND EVERYTHING, BUT I WILL JUST REMIND US ONCE AGAIN THAT IF THEY CHOOSE WROTE, SEE IT SEVERELY DAMAGES ONE OF THE LARGEST REMAINING FORESTS IN CENTRAL COLLIN COUNTY. IT DESTROYS 71% MORE ACRES OF FOREST AND WOODLANDS AND 141% MORE ACRES OF GRASSLANDS AND PRAIRIE. IT DISTURBS THE WETLAND THAT SERVED AS A REFUGE FOR WILDLIFE, INCLUDING BEAVERS, RIVER OTTERS, TURTLES, MIGRATORY AND NON MIGRATORY WATER AND FOREST BIRDS, FROGS, ETCETERA. IT ELIMINATES A LARGE AREA OF SUITABLE HABITAT TAT FOR ENDANGERED AND THREATENED SPECIES. C IS ACTUALLY STRONGLY OPPOSED BY TEXAS PARKS AND WILDLIFE. THEY PREFER SEGMENT DEED, CFX AND DISPLACES 383% MORE HOMES. 29 HOMES VERSUS SIX HOMES ON ROAD D 300% MORE BUSINESSES. 16 VERSUS FOUR AND MORE COMMUNITY RESOURCES, INCLUDING MY COMMUNITY RIDING ARENA. SEE ALSO IMPACTS NEWLY BUILT SEWER LINES, WHICH THE TEXT STOP PEOPLE HAD NO IDEA ABOUT, AND HE DEVISED RESIDENTIAL AND COMMUNITY FARMING RANCHES AND COMMUNITIES . A NUMBER OF MY NEIGHBORS, THEIR RANCHES WILL BE EFFECTIVELY SPLIT. THEY WON'T HAVE THEY'LL HAVE AN EIGHT LANE BYPASS. DIVIDING THEIR RANCH, AND I DON'T KNOW HOW FAMILIAR YOU ARE WITH CATTLE AND FARMING.

BUT THAT JUST DOESN'T WORK VERY WELL. SO YOU KNOW, WE GET TO SPEAK TO YOU, AND SO WE'RE REALLY PLEADING OUR CASE AND HOPING THAT YOU WILL TAKE UP OUR MENTAL AND AT LEAST BRING OUR CONCERNS TO TEXT DOT FOR US. THANK YOU. THANK YOU. ELIZABETH MICHELLE. GOOD EVENING, MR MAYOR AND CITY COUNCIL. ELIZABETH MICHELLE 62. OH, FIVE EQUAL STONE DRIVE. I WOULD LIKE TO THANK YOU, MR MAYOR FOR RECOGNIZING OUR GIRL SCOUTS TONIGHT. I HAD NO IDEA THAT LEADING THE PLEDGE OF THE CITY COUNCIL MEETING AND RECEIVING A PROCLAMATION OR SOMETHING THAT THEY WOULD ENJOY, BUT THEY WANTED TO DO IT. SO HERE WE ARE. I WANTED TO SPEAK TODAY ON AN ARTICLE PRINTED IN THE DALLAS MORNING NEWS, LIKE JULIE SAID REGARDING GENDER PAY DISPARITY.

WELL FIRST GO AND MCKINNEY HAD THE DUBIOUS HONOR OF BEING IN THE TOP FIVE CITIES FOR THE LARGEST DISPARITY IN PAY. WHEN IT COMES TO GENDER, IT'S WONDERFUL THAT THIS COUNCIL WILL RECOGNIZE THE ACCOMPLISHMENTS AND CONTRIBUTIONS OF YOUNG GIRLS DOING AMAZING WORK. IN OUR COMMUNITY LIKE YOU DID TONIGHT. BUT I ASK YOU TO THINK ABOUT WHAT MESSAGE THIS GENDER PAY GAP SENDS TO THESE YOUNG GIRLS. I HAD TO EXPLAIN TO MY OWN GIRLS WHAT THE TERM GENDER PAY GAP WAS , AND EVEN MY EIGHT YEAR OLD CAN FIGURE OUT. IT'S WRONG TO PAY MEN MORE THAN WOMEN FOR DOING THE EXACT SAME JOB. I KNOW THAT SOME OF THIS IS BEYOND THE SCOPE OF THE CITY COUNCIL, BUT I WOULD

[00:20:06]

ASK THAT YOU KEEP THIS IN MIND WHEN IT COMES TO THINGS THAT ARE WITHIN YOUR SCOPE. FOR EXAMPLE, I ASK YOU TO CONSIDER THE EXAMPLE YOU ARE SETTING WHEN APPOINTING MEMBERS, TWO BOARDS AND COMMISSIONS. CURRENTLY WOMEN MAKE UP ONLY 36% OF POSITIONS HELD ON BUILT BOARDS AND COMMISSIONS IN THIS CITY AND PEOPLE OF COLOR HOLD EVEN LESS. PLEASE CONSIDER BEING INTENTIONAL ABOUT THE DIVERSITY AND GENDER, ETHNICITY AND RESIDENCY WHEN IT COMES TO MCKINNEY'S BOARDS AND COMMISSIONS, BEING APPOINTED AND TRULY REPRESENTATIVE OF OUR DIVERSITY. WHY. BECAUSE YOUNG GIRLS ARE WATCHING AND LEARNING THEIR PLACE IN THIS WORLD, AND WE OWE IT TO THEM TO SET A GOOD EXAMPLE TO FOLLOW. THANK YOU. THANK YOU. ALL RIGHT. THAT'S ALL

[CONSENT AGENDA]

THE PUBLIC COMMENTS THAT I HAVE , AND WE'LL MOVE TO CONSENT AGENDA ITEMS. THESE ITEMS CONSISTENT NONCONTROVERSIAL OR HOUSEKEEPING ITEMS REQUIRED BY LAW MAY BE CONSIDERED INDIVIDUALLY BY ANY COUNCIL MEMBER MAKING SUCH REQUEST PRIOR TO EMOTIONAL VOTE ON THE CONSENT ITEMS. MR MAYOR MOVED THAT WE APPROVED THE CONSUMER ITEMS AS PRESENTED BY STAFF IN THE AGENDA. I'LL SECOND ALL IN FAVOR POST. MOTION PASSES MOVE NOW TO REGULAR GENERAL PUBLIC HEARING

[Consider/Discuss/Act on Adoption of a Resolution Determining a Public Necessity to Acquire Property Easement Rights for Public Use by Eminent Domain for a Water Line and Sanitary Sewer Easement associated with the SH 5 Utility Relocation Project (WA1633 & WW1633) which Property is Located on S. Chestnut Street at its intersection with State Highway 5 and Authorizing the City Manager to Establish Procedures for Acquiring the Easement on Said Property, and Take All Steps Necessary to Acquire the Needed Property Rights in Compliance with all Applicable Laws and Resolutions]

ITEMS, THIS PORTION CONSISTS OF SUPPORTING INDIVIDUAL CONSIDERATION BY THE COUNCIL.

FIRST ITEM IS 23 234 CONSIDER AND ACT ON ADOPTION OF A RESOLUTION DETERMINING THE PUBLIC NECESSITY TO ACQUIRE PROPERTY EASEMENT RIGHTS REPUBLIC USE BY EMINENT DOMAIN FOR WATERLINE AND SANITARY SORT EASEMENT ASSOCIATED WITH FIVE UTILITY RELOCATION PROJECT 16 33 AND W. W 16 33, WHICH PROPERTY IS LOCATED ON SOUTH CHESTNUT STREET INTERSECTION WITH STATE HIGHWAY FIVE AND AUTHORIZING THE CITY MANAGER TO ESTABLISH PROCEDURES FOR REQUIRING THE EASEMENT AND SET PROPERLY AND TAKE ALL STEPS NECESSARY TO ACQUIRE THE NEEDED PROPERTY RIGHTS IN COMPLIANCE WITH ALL APPLICABLE LAWS AND RESOLUTIONS. THANK YOU. MAYOR COUNCIL. GARY GRAHAM, DIRECTOR OF ENGINEERING. WE'RE HERE TO ASK FOR YOUR SUPPORT ON AN IMMINENT DOMAIN REQUEST. AS YOU KNOW, TEXTILE IS POINTING TO RECONSTRUCT HIGHWAY FIVE FROM JUST NORTH OF 3 80 ALL THE WAY SOUTH TO THREE PER 3 99. THEY'RE REQUIRING THE CITY REMOVE ALL IRAQ UTILITIES FROM THERE RIGHT AWAY AS PART OF THAT PROJECT, SO WE HAVE A PROJECT UNDERWAY TO DESIGN UTILITY RELOCATIONS FOR THE ENTIRE CORRIDOR. UM TO MOVE OUR UTILITY LINES OUTSIDE THERE RIGHT AWAY INTO A PRIVATE IN THIS MIDDLE OWNED BY THE CITY. FOR THIS PARTICULAR PROJECT. YOU CAN SEE IT ON THE MAP THERE. THIS IS AT CHESTNUT AND DORSEY WHERE THEY COME TOGETHER, RIGHT HIGHWAY FRY RIGHT ACROSS FROM NEW HOMES. DOLLAR GENERAL IS ON THE SOUTH SIDE OF DORSEY ON THE WEST SIDE OF THE STREET THERE. WE ARE ASKING FOR AN EASEMENT 446 SQUARE FEET. WE HAVE MADE INITIAL AND FINAL OFFERS FOR THE PROPERTY OWNER BUT NOT RECEIVING ANY RESPONSE FROM THE PROPERTY OWNER. UM TEXT DOT HAS REQUESTED THAT UTILITIES BE RELOCATED BY JUNE OF 2024. SO THIS IS A VERY AGGRESSIVE TIME SCHEDULE AND SO FORTH AND ORDER US TO MEET THE SCHEDULE. WE NEED TO MOVE FORWARD WITH THE ACQUISITION PROCESS. WITH ALL ACQUISITIONS AND EMINENT DOMAIN CASES, THE CITY HAS AN APPRAISAL PERFORMED FOR EACH PROPERTY TO DETERMINE WHAT THE FAIR MARKET VALUE OF EITHER A RIGHT AWAY ACQUISITION OR, IN THIS CASE WITH THE FAIR WORKER VALUE OF AN EASEMENT ON THE PROPERTY IS THE CITY USES THAT INFORMATION TO MAKE OUR INITIAL OFFER THE PROPERTY INTERVIEWED THEN CAROL, UM, THAT OFFER OR THEY CAN ACCEPT. THEY COULD ALSO GET AN APPRAISAL OF THEIR OWN IF THEY DON'T FEEL THE CITY'S APPRAISAL WAS VALID TO GIVE US SOME JUSTIFICATION OF.

WHY ARE NUMBERS NOT RIGHT? THE CITY EVALUATES THAT AND WILL ALL THAT INFORMATION AND THEN WE MAKE A FINAL OFFER. IF NO AGREEMENT IS MADE, WE DO HAVE THE AUTHORITY TO USE EMINENT DOMAIN. DURING THE IMMINENT DOMAIN PROCESS. COLLIN COUNTY COMMISSIONERS APPOINT A SPECIAL COMMISSIONERS COURT, WHICH CONSISTS OF THREE PEOPLE, THE CITY AND THE PROPER UNIT WITHIN MAKE THEIR CASE IS FOR WHATEVER VALUE THAT YOU KNOW EACH ONE IS ASKING FOR TO THOSE THREE SPECIAL COMMISSIONERS. THOSE THREE COMMISSIONERS THEN DECIDE ON WHAT THE ACTUAL VALUE IS. AND THEN WHAT'S THE VALUE IS DETERMINED. THE CITY COMPENSATES THE PROPERTY OWNER THAT VALUE AND WE OBTAIN THE USE OF THE EASEMENT OR RIGHT AWAY IF IT IF IT WAS RIGHT AWAY. SO UM, YOU KNOW, THIS IS NOT A TAPE LAND TAKING THIS IS A DETERMINATION OF FAIR MARKET VALUE AND THEN COMPENSATION OF THE PROPERTY OWNER OF THAT FAIR MARKET VALUE AS DETERMINED THROUGH THE SPECIAL COMMISSIONERS COURT. SO WITH THAT WE REQUEST SUPPORT OF THIS REQUEST, AND, UM I'M HAPPY TO ANSWER ANY QUESTIONS. THE 400 SQUARE FEET. DIDN'T ENCUMBER THE BUILDING. NO IT IS JUST IN THE

[00:25:09]

FRONT PORTION CORRECT AS FAR AS STEP BACKS OR LANDSCAPE OFFERS OR THINGS LIKE THAT. THIS IS A UTILITY EASEMENT, SO THAT'S STILL HAVE THE ACCESS TO THAT. CORRECT YEAH, THIS IS AN EXISTING PROPERTY. SO THE SETBACKS THAT YOU SEE ON A LOT OF THE PLANNING CASES AND NEW DEVELOPMENT ZONE APPLY ON EXISTING PROPERTY LIKE THIS. WE ARE JUST GOING INTO THAT FRONT PORTION OF THE PROPERTY. AND REQUIRING THE USE OF THAT NOW THERE MAY BE SOME LANDSCAPING IN THE FRONT THAT GETS REMOVED BECAUSE OF OUR EASEMENT. WE DON'T UM HAVE TREES AND SUCH PLANTED ON TOP OF OUR UTILITY LINES BECAUSE THEY COULD DAMAGE THEM, RIGHT. BUT, UM, YEAH. ANY OTHER QUESTIONS. OH, MAN. A MOVE THAT CITY MCKINNEY TEXAS CITY COUNCIL APPROVED. THIS ITEM IS WRITTEN IN ADOPTED RESOLUTION DESCRIBING THIS AGENDA ITEM AND AUTHORIZE THE USE OF THE POWER OF EMINENT DOMAIN TO ACQUIRE FOR PUBLIC USE. I'M ALL NECESSARY PROPERTY INTEREST FROM FSG LLC.

IDENTIFIED AS OWNER OF RECORD BY THE COUNCIL APPRAISAL DISTRICT IN ANY OTHER PERSON THROUGH ENTITIES CLAIMING INTEREST TO THE PROPERTY DEPICTED ON DESCRIBED BY MEET SOME BALANCE ATTACHED TO SEVEN RESOLUTION, PICTURES AND DESCRIPTIONS BEING INCORPORATED IN THEIR ENTIRETY.

AND THIS MOTION FOR ALL PURPOSES , INCLUDING THIS OBSTRUCTION, ACCESS AND MAINTENANCE OF INFRASTRUCTURE IMPROVEMENTS NEAR THE SOUTHWEST CORNER OF STATE HIGHWAY FIVE. AND SOUTH CHESTNUT STREET ASSOCIATED WITH STATE HIGHWAY FIVE UTILITY RELOCATION PROJECT W. A 1633 AND W W 1633.

THIS WILL BE A SECOND ROLL CALL VOTE SECOND. JASMINE. BILLY. YES. HERE, FULLER? YES. YES.

COUNCIL MEMBER STATUS. YES FRIGHTENING. YES. MEMBER PHILLIPS. YES, YES. MOTION PASSES. 220086 SP TWO CONDUCTED POKORNY CONSIDERING DISCUSS ACT ON A VARIANCE TO A SITE PLAN FOR

[Conduct a Public Hearing to Consider/Discuss/Act on a Variance to a Site Plan for a Multi-Family Development (Modera McKinney), Located on the East Side of Future Hardin Boulevard and Approximately 1,500 feet North of Bloomdale Road]

MULTI FAMILY DEVELOPMENT. MCKINNEY LOCATED EAST SIDE OF FUTURE PARDON BOULEVARD, APPROXIMATELY 1500 FT. NORTH OF BLOOMINGDALE ROUTE, YOU, MR MAYOR, JENNIFER ARNOLD, DIRECTOR OF PLANNING AS YOU READ. THIS IS A REQUEST TO CONSIDER APPROVAL OF A PROPOSED SITE PLAN FOR A MULTI FAMILY DEVELOPMENT, LOCATED GENERALLY AT BLOOM, DALE AND COMMUNITY THE SITE ITSELF IS ABOUT 20 ACRES IN SIZE, AND THE PROPOSED SITE PLAN WOULD ALLOW FOR CONSTRUCTION OF 381 MULTI FAMILY UNITS. I DO WANT TO NOTE THAT THE REASON THIS ITEM IS BEFORE YOU, IT'S BECAUSE THE UNDERLYING ZONING ON THE PROPERTY REQUIRES CONSIDERATION ACTION BY THE PLATING AND ZONING COMMISSION AND CITY COUNCIL, AND THEY ARE ALSO ASKING FOR A VARIANCE TO REDUCE THE REQUIRED AND CLOSED PARKING. FOR THE MULTI FAMILY DEVELOPMENT FROM THE TYPICALLY REQUIRED 50% TO 30% IN CLOSED STAFF IS RECOMMENDING APPROVAL OF THE REQUEST AGAIN. THE MULTI FAMILY USES ARE PERMITTED ON THE SITE AND THE REQUEST FOR THE REDUCTION IN, UH COVERED PARKING OR ENCLOSED. PARKING IS CONSISTENT WITH THE NEW NEWLY ADOPTED MCKINNEY UNIFIED DEVELOPMENT CODE. THE 50% REQUIREMENT IS A CARRYOVER FROM OUR OLD CODE. SO THE 30% THAT THEY'RE REQUESTING WITH THIS VARIANCE IS CONSISTENT WITH MANY OF THE NEW MULTI FAMILY PROJECTS WE'VE SEEN IN MCKINNEY IN THE LAST 3 TO 5 YEARS, AND IT'S ALSO BEEN CODIFIED WITH THAT NEW CODE PLANNING AND ZONING COMMISSION CONSIDERED THE REQUEST AND IS RECOMMENDING APPROVAL AS WELL.

AND I'M HAPPY TO ANSWER ANY QUESTIONS. ANY QUESTIONS? IS THE APPLICANT HERE.

MEMBERS OF THE CITY COUNCIL BOB ROEDER, 1700 RED BEDS SUITE 300 IN MCKINNEY ON BEHALF OF THE APPLICANT. THERE'S NOT REALLY MUCH I CAN ADD TO WHAT MRS ARNOLD SAID. TRYING TO KEEP MY TIME TO A MINIMUM WILL BE HAPPY TO ANSWER ANY QUESTIONS AND REQUEST YOUR FAVORABLE APPROVAL.

ANY QUESTIONS? SO WHY? WHY WHY DO THEY FEEL LIKE THEY NEED TO HAVE LESS PARKING COVERED PARKING THIS IS THE TYPE OF DEVELOPMENT THIS IS MR ROGERS IS A WHAT WE COMMONLY CALL TO BUILD TO RENT, SO IT'S MORE STRUCTURED LIKE SINGLE FAMILY HAVE A SIGNIFICANT NUMBER OF UNITS THAT HAVE GARAGES. BUT JUST IN TERMS OF THE LAYOUT THAT FELT LIKE CARPORTS FOR SOME OF THE UNITS WORK BETTER. SO LITTLE BIT MORE EFFICIENT LAYOUT OF THE LAND. NEW CODE, AS MISS ARNOLD POINTED

[00:30:02]

OUT. UM REQUIRES ONLY 30% ENCLOSED PARKING. WE ARE PROVIDING 20% IN ADDITION THAT'S COVERED SO YOU'LL HAVE 50% OF THE PARKING SPACES WILL BE WILL BE COVERED FROM THE OUTLETS. 30% WILL BE FULLY ENCLOSED. THAT'S CORRECT CURRENT CODE RIGHT, RIGHT, RIGHT. ANY OTHER QUESTIONS. ALL RIGHT. THIS IS A PUBLIC HEARING. IS THERE ANYONE THAT WOULD LIKE TO SPEAK TO THE SIGNING? SEEING NONE ENTERTAIN A MOTION. I'LL MAKE A MOTION. WE CLOSE THE PUBLIC HEARING AND APPROVE THIS ITEM FOR STAFF RECOMMENDATION. SECOND. ALL IN FAVOR. ALRIGHT NO POST HIGH.

[Conduct a Public Hearing to Consider/Discuss/Act on a Specific Use Permit Request to Allow for Automobile Sales, Repair or Storage (Pat Lobb Toyota), Located at 3350 South Central Expressway, and Accompanying Ordinance]

MOTION PASSES ITEM. 220020 S U P THREE CONDUCTED PUBLIC HEARING TO CONSIDER AN ACT A SPECIFIC USE PERMIT REQUEST TO ALLOW FOR AUTOMOBILE SALES REPAIRS, STORAGE. TOYOTA LOCATED 33 50 SOUTH CENTRAL EXPRESSWAY AND ACCOMPANYING ORDINANCE. JENNIFER MR MARRY JENNIFER ARNOLD AGAIN, AS YOU READ. THIS IS A REQUEST FOR SPECIFIC USE PERMIT FOR AUTOMOBILE SALES, REPAIR AND STORAGE. THIS IS THE EXISTING PAT LOBE TOYOTA, LOCATED AT CRAIG DRIVE AND US 75. THE UNDERLYING ZONING ON THE PROPERTY DOES REQUIRE CONSIDERATION OF AN S U P TO OPERATE THE DESIRED USE ON THE PROPERTY. THE REASON IT'S BEFORE YOU IS BECAUSE THEY WERE LOOKING TO DO A BUILDING EXPANSION OR ADDITION OF ABOUT 24,000 SQUARE FEET ON THE NORTH SIDE. THIS IS ORIENTED SIDEWAYS. BUT ON THE NORTH SIDE OF THE EXISTING SITE THEY ARE LOOKING TO CONSTRUCT AN ADDITIONAL 24,000 SQUARE FEET TO FACILITATE REPAIR. MAKE READY, UM, AND WORK ON THE VEHICLES THEY SELL ON SITE. IN ADDITION TO THE SCP REQUEST, THEY HAVE INCLUDED A VARIANCE TO ALLOW THE ORIENTATION OF BAIT DOORS ALONG EXISTING ROADWAYS. THERE IS ONE HERE. AND HERE FOR A CAR WASH.

AND THEN ONE RIGHT HERE. IF YOU WERE TO GO OUT TO THAT SITE TODAY, YOU'LL NOTICE THAT THERE ARE A NUMBER OF DOORS THAT ARE ORIENTED IN VARIOUS DIFFERENT DIRECTIONS, MANY OF WHICH ALSO FACE ROADWAY. SO IN REVIEWING THE REQUEST DOESN'T HAVE ANY OPPOSITION TO THE EXPANSION OR THE PROPOSED LOCATION OF THE BAY DOORS. THERE IS SOME WROUGHT IRON FENCING AND LANDSCAPING ALONG THE PROPERTY LINES WHERE THE BAY DOORS WOULD BE ORIENTED , AND IT IS CONSISTENT WITH THE EXISTING DEVELOPMENT FOOTPRINT OF THIS SITE. PLANNING AND ZONING COMMISSIONS CONSIDERED THE ITEM AND THEY'VE ALSO RECOMMENDED APPROVAL OF THE U. P AND I'M HAPPY TO ANSWER ANY QUESTIONS. JENNIFER, THEY'RE NO. OF COURSE, THEY'RE JUST ADDING A STRUCTURE THAT WILL THEN HAVE TO HAVE ALARM VALUE AND THEY'LL PAY TAXES ON AND DO REPAIR WORK, WHICH THEY ALSO COLLECT SALES TAX ON SO YES, SIR. REALLY. PROVING THE SITE FROM A FROM A FISCAL UM, CONTRIBUTION TO THE CITY. I COULD SAY AS WELL. YES, SIR. OTHER QUESTIONS IS THE APPLICANT HERE. RICK FOR OR AGAINST OUR ARCHITECTS REPRESENTING PAT LOVE TOYOTA. MY ADDRESS IS 5005. GREENVILLE AVENUE, DALLAS, TEXAS 75 2. OH, SIX. I THINK THIS CASE HAS BEEN PRESENTED WELL, AND I'LL SIMPLY BE HAPPY TO ANSWER ANY QUESTIONS. QUESTIONS. THANK YOU, SIR. THERE'S A PUBLIC HEARING IS THERE ANYONE HERE WOULD LIKE TO SPEAK TO THIS ITEM? SEEING NONE ENTERTAIN A MOTION. MR MARY MOVED THAT WE CLOSED PUBLIC HEARING AND WE APPROVED. THIS ITEM IS PRESENTED BY STAFF SECOND. ALL IN FAVOR. I OPPOSED THANK YOU. THAT IS THE END OF OUR ARDUOUS AGENDA. AND I HAVE NO CITIZEN COMMENTS BECAUSE WE TOOK THOSE AT THE BEGINNING. IS THERE ANY COUNCIL MANAGER

[COUNCIL AND MANAGER COMMENTS]

COMMENTS? IT MIGHT BE MAKING HAVE A RECORD. THE MAJOR'S GONNA BLOW IT HAVE A NEW RECORD HERE IT HOLD OFFER. YES WAS SPOKE ABOUT RUNNING A 10.81 EARLY IN THE TRACK SEASON AND FEBRUARY IS NOW POSTED A 10.66 IS CURRENTLY RANKED IN THE TOP FOREIGN STATE OF TEXAS. AS WELL AS HIS FOUR BY 200 RELAY TEAM HAS RANKED IN THE TOP FOUR AND ON THE LADY'S SIDE OUT AT MCKINNEY HAS SCHOOL. YEAH BONNER ODONKOR. IS RANKED IN THE TOP FOUR IN THE 102 104 100 M STATEWIDE, SO WE'VE GOT SOME GREAT TRACK GOING ON SOME YOUNG PEOPLE. YOU CAN TRULY BE PROUD OF MCKINNEY HIGH SCHOOL. THANK YOU, MR MAYOR, DR FELTUS. SO I GOT A CHANCE TO SPEAK TO THE MCKINNEY CHAMBERS WOMEN'S

[00:35:06]

ALLIANCE OF MCKINNEY ON THURSDAY THEY HAD A LUNCH AND LEARN EVENT OUT AT TRINITY FALLS, THEY HAVE A FANTASTIC NEW BUILDING OUT AT TRINITY FALLS THAT WE WERE, UM, ABLE TO SEE AND HAVE A NICE LUNCH AND THEN BUT JUST WANTED TO THANK THE CHAMBER FOR EXTENDING THAT INVITATION AND THANK YOU TO ALL OF THE LADIES THAT WERE PRESENT THERE. WENT ALSO JUST SAY HAPPY. HAPPY NATIONAL DOWN'S SYNDROME DATE 3 21, SO I JUST WANTED TO TAKE A SHOUTOUT SUPPOSED TO WEAR CRAZY SOCKS ON DOWN SYNDROME DAY. I JUST HAVE BOOTS ON THERE TOO HIGH TO SEE BUT CRAZY SOCKS UNDERNEATH. I HAVE JUST KIND OF A REBUTTAL OF US WHAT WAS SAID ON THE ON THE DAIS AND THE PUBLIC COMMENTS. IT WAS SAID THAT THAT PEOPLE ONLY APPLY IF THEY FEEL THAT THEY HAVE A CHANCE. UM AND I THINK THAT'S AN INTERESTING STATEMENT BECAUSE WE HAVE WELL OVER 200 PEOPLE THAT WILL APPLY FOR 30 OPENINGS. AND SO IT'S NOT SO MATTER OF. I MEAN, WE HAVE WONDERFUL PEOPLE.

WE INTERVIEWED TONS OF PEOPLE. THAT WOULD LOVE TO SERVE AND IT IS HEART WRENCHING DUE TO SEE THAT WE HAVE SO MANY PEOPLE THAT WE CAN'T EMPLOYEE IN SOME MANNER . AND SO IT'S SO WHEN WE WERE GOING TO BE COMING UP HERE SHORTLY TO THE BOARDS AND COMMISSIONS, APPOINTMENTS AND STUFF LIKE THAT.
