YOU WILL HAVE AN OPPORTUNITY TO PARTICIPATE IN BOTH OF THOSE DIFFERENT AGENDA TYPE ITEMS. UM, WE'LL CALL YOU UP. WHEN IT'S YOUR TIME TO SPEAK. IF YOU DO COME TO THE PODIUM, COUPLE THINGS ONE. NOW I'M GOING TO BE REALLY CONCISE HERE. I DON'T WANT TO BE APPEAR TO BE ABRUPT, BUT WE HAVE THIS TIME LIMITATION. SO I'M GOING TO GET RIGHT TO THE POINT. DUE TO THE APPARENT NON COMPLIANCE AND OTHER IRREGULARITIES OF THE PROPOSED PRELIMINARY PLAN. I REQUEST THAT THE P N Z DENY THE PROPOSED PRELIMINARY PLATT UNLESS AND UNTIL IT MEETS ALL THE DEVELOPMENT REGULATIONS AGREED TO WITH THE CITY AND NEIGHBORING RESIDENTS IN ORDER FOR THE PROPERTY OWNER TO INDUCE THE CITY TO GRANT A PROPERTY REZONING IN 2019 IN THE FIRST PLACE. THIS IS AN INFIELD DEVELOPMENT. IT'S CRITICALLY IMPORTANT. BECAUSE THIS ISN'T I MEAN, THIS IS A 50 YEAR OPPORTUNITY FOR SOMETHING TO HAPPEN HERE. THINGS LIKE DRAINAGE AND ALL THE REST OF THAT NEED TO BE VERY CAREFULLY ENGINEERED AND THOUGHT ABOUT AND NOTED IN THE PLANT. SO UM. REZONING TO S F FIVE WAS SOUGHT BY THE PROPERTY OWNER. IN MID 2019 AND WAS PROPOSED AS UTILIZING A SINGLE ENTRY EXIT POINT RURAL ROAD WHICH WOULD SERVE OVER 90 NEW HOMES. VIA HIS FORMER DRIVEWAY. THIS WAS NEARLY UNIVERSALLY OPPOSED BY THE PROPERTY ON US IN OUR AREA. AND UH, WELL, LONG STORY SHORT. UH FIRST QUESTION HERE IS, DOES THIS PERSON OR COMPANY HAVE STANDING TO EVEN FILE THIS PLAN ? THERE'S NO PUBLIC RECORD THAT THEY OWN AN INTEREST IN THE PROPERTY THAT THE OWNER HAS EVEN AGREED. TO THEM ACTING ON HIS BEHALF, APPARENTLY SO. THAT'S JUST A QUESTION. I DON'T HAVE AN ANSWER TO THAT. YOU CAN AMEND YOU CAN IMAGINE HOW THE DENSITY OF THAT ALONE WOULD RAISE A LOT OF QUESTIONS WITH ALL THE SURROUNDING COMMUNITIES AROUND IT. NEEDLESS TO SAY, IT WAS SUCH A CONCERN THAT THE CITY COUNCIL AT THEIR SUGGESTION PUT THE TWO PARTIES TOGETHER TO WORK OUT THEIR DIFFERENCES. OH I'M HAPPY TO SAY THAT AFTER SEVERAL MEETINGS SUCH DIFFERENCES. WE CAME TO SOME AGREEMENTS. SOME OF THOSE AGREEMENTS. OR NOT DETAILED IN THIS PLAN, WHICH IS WHY I, TOO AM CONCERNED ABOUT LACK OF INFORMATION. ONE OF THE ITEMS ON THERE SHOULD HAVE BEEN FIRE SPRINKLERS AT EVERY HOME ARE REQUIRED WHEN A DEVELOPMENT HAS ONLY ONE POINT OF ENTRY. AND THERE'S NOTHING LIKE THAT NOTED ON HERE NOW I DID TALK TO YOUR PLANNING. MANAGER. MR STRICKLAND , AND SHE NOTED THAT AND SHE HAS INFORMED ME THAT GOING FORWARD THAT WILL BE AN ITEM THAT WILL BE DEFINITELY STATED ON THE PLAN ITSELF. THE OTHER THINGS THAT WE DISCUSSED THAT WERE AGREED TO WITH THE PROPERTY OWNER. OR SOMETHING LIKE A BERM. ON THE EDGE OF THE PROPERTY, ESPECIALLY ON MY SIDE. I'M IN SOMETHING CALLED HARDENED LIKE COMMUNITIES AND ON THE SOUTH SIDE OF THAT DEVELOPMENT THEY WERE DISCUSSING AND WE'RE WILLING TO PUT UP A BERM TO GIVE US SOME PRIVACY, BOTH VISUAL LIGHTING AND NOISE THAT TOO. I DON'T SEE LISTED OR HAVE DETAILS OF IT ANYWHERE. AND THE BIGGEST CONCERN I HAD WAS THAT THEIR LISTING 94 PROPERTIES 94 LOTS ON THIS PLAN. WE ONLY AGREED TO 92 AND THEIR LAWYER FOR THEIR OWN PROPERTY, SENT OUT A LETTER TO THE CITY MCKINNEY DECEMBER 13TH 2019 STATING THAT THAT WAS THE AGREEMENT TO HAVE 92 PROPERTIES ON THEIR PROPERTY MAXIMUM FOR THE REASON OF DENSITY. BECAUSE THE DENSITY ALREADY WAS TOO MUCH AS IT IS, WE FIGURED IF WE COULD REDUCE IT ANY AT ALL, IT WOULD MAKE A BIG DIFFERENCE. THERE WAS ALSO MENTIONED SOME OTHER ITEMS, AND I'M NOT GOING TO GO INTO ALL OF THEM. BUT THERE WAS A GAZEBO FOR 400 SQUARE FOOT IS EVIL. THAT IS NOT ANYWHERE ON THERE TO BE FOUND. THERE WAS ALSO A HIKING AND BIKING TRAIL ON THERE, THAT I COULDN'T FIND ANYWHERE. SO BY ALL MEANS THINK THAT THERE'S A LOT OF DETAIL MISSING. MCKINNEY TEXAS HAPPILY, I LIVED THERE. UM I'M NOT OPPOSED TO THE DEVELOPMENT ON THE RAG STEEL EDITION TO A DEVELOPMENT ON THE RAG STILL EDITION. I AM, HOWEVER STRINGENT LIKE THE PRIOR SPEAKERS THAT THERE WAS. LEGAL AGREEMENT. A BINDING AGREEMENT BETWEEN THAT WAS BOUND TO THE LAND. BOUND TO THE LAND BY THE LAND OWNER AND HIS REPRESENTATION. 2 92 HOMES. WE REPEATEDLY TRIED TO DISCUSS THIS IN OUR MINUSCULE THREE MINUTES WE HAD BEFORE CITY COUNCIL. AND IT WAS NOT HEARD THEY COULD, FOR WHATEVER REASON. UH, THE 92 94. THEY DIDN'T IT WASN'T A BIG DEAL TO THEM TO ME. I WAS THERE ON AUGUST 8TH LAST SUMMER. AND AH THERE WAS A FIRE ON THAT LAND, AND THERE WERE EIGHT FIRE ENGINES FROM ANNA FROM ALLEN FROM MCKINNEY FROM FRISCO, TRYING TO PUT OUT THAT FIRE WITH ONE ENTRANCE FOR THOSE ENGINES TO GET UP AND DOWN ON IT WAS A PROBLEM. THOSE FIREMEN WORKED THEIR TAILS OFF TO SAVE THE NEIGHBORING HOMES. SO THIS SINGLE ENTRANCE, THOUGH THE CITY APPROVED IT AS AN ORDINANCE THAT IS ALLOWED I THINK EVERY COUNT OF A HOME IS TWO OR MORE PEOPLE THAT WILL NOT BE TRYING TO GET OUT THAT BOTTLENECK OF A SINGLE ENTRY. IN CASE OF AN EMERGENCY LIKE THE FIRE LAST SUMMER. BUT TONIGHT'S ACTION OR RECOMMEND RECOMMENDATION WOULD BE THAT CONDITION OF APPROVAL. THAT APPROVAL CAN BE GAINED FULLY ONCE THOSE CONDITIONS ARE MET. AND THEN, OF COURSE, THERE IS THE OPTION OF DOING A DISAPPROVAL AND A DISAPPROVAL FROM A STAFF. PERSPECTIVE IS ONLY GOING TO BE RECOMMENDED. IF THE COMMENTS THAT ARE OUTSTANDING OUR SITE ALTERING MEANING THE LOT CONFIGURATION HAS A PROBLEM. THE STREET LAYOUT DOESN'T MEET THIS STREET DESIGN MANUAL. UM FLOODPLAIN IS SHOWING DEVELOPMENT THAT SHOULDN'T OTHERWISE BE SHOWN THINGS THAT COULD MEANINGFULLY ALTER THAT LAYOUT. SO WITH THE PLAQUE THAT YOU HAVE BEFORE YOU TONIGHT, STAFF IS RECOMMENDING A CONDITIONAL APPROVAL BECAUSE THE ITEMS THAT ARE OUTSTANDING REFLECT ITEMS THAT CAN BE ADDRESSED ON THE PLATTE WITHOUT NECESSARILY IMPACTING ITS LAYOUT. SO I DIDN'T WANT TO TALK A LITTLE BIT ABOUT THAT PLATZ AS A REGULAR MATTER OF BUSINESS ARE NOT PUBLIC HEARING ITEMS, WHICH IS WHY THE PUBLIC COMMENTS IS HAPPENING BEFORE THE AGENDA ITEM IS THERE. THIS IS PUBLIC COMMENTS ON NON AGENDA ITEMS. UM THAT'S THE PART OF THE AGENDA THAT WE'RE ON. NOW YOU'LL NOTE IN THE HEADING FOR THESE ITEMS THAT THERE ARE NO PUBLIC HEARINGS. WHAT WOULD THEN HAPPEN TO THE PLAN, THEY WOULD NOT BE ABLE TO MOVE FORWARD IN THE PROCESS. UM SO IT'S A TWO STEP PROCESS AND MCKINNEY YOU HAVE A PRELIMINARY PLATT THAT SHOWS THE PRELIMINARY LAYOUT AND THEN THAT PRELIMINARY PLATT CAN GET AN APPROVAL OR A CONDITIONAL APPROVAL, AND AFTER THAT PRELIMINARY PLATT IS CONSIDERED THEN THEY WOULD HAVE TO COME BACK IN WITH WHAT WE CALL A FINAL PLATT. AND THAT FINAL PLAN IS THE PLAN THAT WOULD GET FILED WITH THE COUNTY AND PUT THE LOTS ON RECORD FOR SALE. SO IF THEY DON'T MEET THE CONDITIONS OF APPROVAL, EITHER AT THIS STAGE OR AT THE FINAL, PLATT STAGE THAT PLATT WOULD NOT BE FILED, THEY WOULD NOT BE ABLE TO ACTUALLY RECORD LOTS FOR RECORD AND SELL THEM FOR DEVELOPMENT. IN THE FINAL PLAQUE DOES COME BACK FOR APPROVAL. THE FINAL, PLATT WILL COME BACK FOR APPROVAL. THAT'S CORRECT. YOU FEEL THAT PLAQUE CURRENTLY MEETS WHAT WAS APPROVED BY CITY COUNCIL AS FAR AS THE ZONING WE THINK THAT THE LAYOUT DOES. OF COURSE THERE ARE NOTATIONS. I BELIEVE THERE'S A SETBACK EXHIBIT THAT WE STILL NEED TO OBTAIN FROM THEM. UM BUT WE DO THINK THAT THOSE ARE ITEMS THAT CAN BE ADDRESSED WITHOUT ALTERING THE LAYOUT OF THE PLATT. I JUST WANTED TO CLARIFY THAT FIRE APPROVAL WOULD PUT NOTATION FOR SPRINKLERS REQUIRED ON ALL THESE HOMES.
