I'M THE PRESIDING JUDGE FOR A COURT. I'M HERE JUST TO GIVE YOU A INFORMATIONAL UPDATE. SORT OF STATE OF THE UNION OF WHERE THERE ARE COURTS ARE AT. UM I AM VERY GLAD TO BE HERE TODAY BECAUSE I DON'T FEEL LIKE I AM ONE OF THE DEPARTMENTS THAT GETS TO COME OVER TO COURTS VERY OFTEN. SO IT'S NICE TO SEE FACES AND INTERACT AND I AM GOING TO GIVE YOU AN UPDATE. I COULD PROBABLY TALK ABOUT THIS STUFF FOR AN HOUR. SO I'M GONNA GLOSS THROUGH SOME THINGS. MOST OF YOU ARE PROBABLY AWARE THERE ARE A NUMBER OF STATE COURTS IN AND BROKEN DOWN IN DIFFERENT WAYS IN THE STATE OF TEXAS, JUST IN CASE YOU WEREN'T SURE THIS GRAPHIC TELLS YOU THIS IS THE STATE OF TEXAS. AND WE HAVE, UM 945 MUNICIPAL COURTS IN THE STATE OF TEXAS, WHICH IS YOU CAN SEE IS BY FAR THE LARGEST NUMBER OF COURTS. BY CATEGORY. JUSTICE COURTS WHICH WE DO HAVE JP COURTS, WHICH WE DO HAVE SOME CONCURRENT JURISDICTION WITH IF THEY ARE IN THE CITY LIMITS. UM THEIR COUNTY COUNTY COURTS. OF COURSE, THERE ARE 822 OF THOSE IN THE STATE. THERE ARE 522 COUNTY COURTS AT LAW, WHICH WOULD, UM GO OVER YOUR HIGHER LEVEL MISDEMEANOR CASES, DISTRICT COURTS WHICH WOULD BE OVER THE FELONY LEVEL, HIGHER, HIGHER CRIMINAL OFFENSES, AND THEN, OF COURSE, 14 COURTS OF APPEAL. ONE TEXAS SUPREME COURT FOR CIVIL CASES AND ONE TEXAS COURT OF CRIMINAL APPEALS. SO WHAT'S REALLY COOL ABOUT MUNICIPAL COURT AS WE INTERACT WITH CITIZENRY? PROBABLY MORE THAN ANY OTHER, UM, TYPE OF COURT IN THE STATE. AND, OF COURSE, IF YOU'RE IN COUNTY QUARTER DISTRICT COURT, OUR APPEAL'S COURT, YOU'RE REPRESENTED BY AN ATTORNEY. THAT IS NOT THE CASE IN MUNICIPAL COURT. WE SEE CITIZENS DIRECTLY ONE ON ONE IT'S PART OF WHAT I REALLY LOVE ABOUT. MY JOB IS THAT I ACTUALLY GET TO INTERACT WITH CITIZENS. UM AND OFTENTIMES WE ARE THE POINT AT WHICH CITIZENS ARE FAMILIAR WITH THE COURT SYSTEM BECAUSE MOST OF US DO GET TRAFFIC TICKETS FROM TIME TO TIME. OR OTHER LOWER LEVEL, CLASSY OFFENSES. SO WE DO GET A LARGE PORTION OF THOSE PEOPLE FACE TO FACE. SO WHAT DO WE DO? WE ARE A COURT OF RECORD WHICH THOSE OF YOU WHO ARE ON COUNCIL BACK IN 2019. WE DID GO TO COURT OF RECORD. IN THAT YEAR, THE CITY PASSED AN ORDINANCE MAKING US A COURT OF RECORD. WHAT DOES THAT MEAN? KEEP A RECORD. THAT'S THE FIRST THING WHICH IS IMPORTANT BECAUSE NON COURTS OF RECORD DON'T IT JUST THEY I WON'T SAY THEY'RE LOOSER, BUT A LITTLE BIT BECAUSE THEY DON'T HAVE TO SEND ANYTHING UP TO HIGHER LEVEL COURT IF THEY'RE SCRUTINIZED AFTER TRIALS, BUT WE DO KEEP A RECORD NOW AND WE HAVE JURISDICTION JURISDICTION OVER CRIMINAL CASES. FINALLY MISDEMEANORS WHAT THAT MEANS IS NOBODY COMES OUT OF OUR COURT GOING TO JAIL. PEOPLE DO GET ARRESTED ON CLASSY TRAFFIC OFFENSES OR CERTAIN OTHER CLASSY PENAL CODE VIOLATIONS. BUT THAT'S NOT A PUNISHMENT, SO THEY COME TO OUR COURT AFTER ARREST, AND THAT'S BEEN SOMETHING WE COULD CONSIDER AS PART OF COVERING THEIR FINAL TALK ABOUT THAT A LITTLE BIT LATER, BUT FINALLY MISDEMEANORS, AND I THINK PEOPLE DO FORGET HOW IMPORTANT REGULATION ENFORCEMENT OF CLASS C MISDEMEANORS. FINALLY OFFENSES IS IF YOU THINK ABOUT, YOU KNOW, KIND OF THE TYPES OF OFFENSES WE SEE. OF COURSE, TRAFFIC SAFETY IS HUGELY IMPORTANT. THAT HAS TO BE ENFORCED THAT IS A PUBLIC SAFETY ISSUE. HAVE SOME EXPANDED JURISDICTION . SO NOW WE CAN HEAR CERTAIN CASES THAT WE POSSIBLY DID NOT HAVE JURISDICTION OVER BEFORE. THE BIG POINT ON THIS IS THE APPEALS PROCESS IS SELF LIMITING. SO IN A NON COURT OF RECORD, PEOPLE CAN JUST DECIDE THEY DON'T WANT TO BE IN OUR COURT AND THEY WILL APPEAL IT UP. THEY JUST SEND US A LETTER SAYING WE'D LIKE TO EXERCISE OUR RIGHT TO APPEAL THIS AND THEY GO DEAL WITH IT IN A HIGHER LEVEL COURT. THAT HAPPENED A LOT BEFORE WE BECAME COURT OF RECORD. WE HAD MANY THOUSANDS OF THOSE ALL THE TIME. AND OF COURSE WE LOSE OUT ON SOME OF THE BENEFITS THAT WOULD COME WITH HAVING OUR CASES CONTAINED IN HOUSE. UM AND THEN WHEN WE WENT TO COURT OF RECORD IT SHUT THAT PROCESS DOWN ALMOST ENTIRELY BECAUSE ONCE YOU HAVE TO KEEP A RECORD, THEN YOU HAVE TO GO THROUGH THE WHOLE PROCESS LEGALLY FILED MOTIONS FOR A NEW TRIAL WITH OUR COURT. UM AND WE HAVE TO GRANT IT OR DENY IT. AND THEN THERE'S A RECORD. YOU GOTTA ORDER AND A BRIEF YOU GOTTA RIGHT AND IT GOES UP SO OUR APPEALS HAVE REALLY GONE DOWN VERY SIGNIFICANTLY. IT'S BEEN A HANDFUL THAT HAVE EVEN BROACHED THE SUBJECT OF APPEAL SINCE WE WENT TO THAT TO THAT COURT OF RECORD JUDGE IN A COURT OF RECORD MUST BE LICENSED ATTORNEY IN BOTH JUDGE CARLSON AND I ARE LICENSED ATTORNEYS. INTERESTING FACT. THERE ARE ONLY 183 QUARTS OF RECORD OUT OF THAT 945 MUNICIPAL COURTS IN TEXAS. ONLY 183 ARE COURTS OF RECORD AND IN COLLIN COUNTY. ONLY PLANO RICHARDSON IN MCKINNEY OR THE COURTS OF RECORD, SO I HOPE THAT WAS JUST A COOL PERFECT. AND IF I START SAYING THINGS THAT JUST DON'T MAKE SENSE, LIKE LEGAL TERMS OR ANYTHING THAT PEOPLE JUST HAVE QUESTIONS ABOUT.

I RECOGNIZE THAT THERE IS REVENUE ASSOCIATED WITH THE FINES AND COURT COSTS THAT COME IN, BUT ALSO MAKING SURE THAT WE ARE LOOKING AT THE CASES FOR WHAT THEY ARE. BUT AS FAR AS THE APPEAL PROCESS GOES, THAT WAS A SIGNIFICANT CHANGE FROM THAT. FROM THAT CHANGE THAT HAPPENED IN 2019. SO JUST SO YOU ALL ARE AWARE FOR THE CURRENT FISCAL YEAR, WHICH WE DON'T HAVE THE FULL YEAR STATS UP HERE BECAUSE WE PULLED THESE END OF JULY. OF COURSE WE'VE GOT ANOTHER MONTH. UM OR TO ACTUALLY THE STAGE LEFT. BUT FROM OCTOBER OF LAST YEAR THROUGH END OF JULY OF THIS YEAR 10,769 CASES, NEW CASES WERE FILED. 12,578 CASES WERE DISPOSED AND WE CLEARED 791. WARRANTS CURRENTLY, WE HAVE 3558 OUTSTANDING WARRANTS. WHAT THAT MEANS IS ACTIVE WARRANTS CASES THAT HAVE NOT RESOLVED FOR WHATEVER REASON PEOPLE HAVE NOT COME IN TO HANDLE THEIR CASES. AND I'M COMPARING THAT WITH OUR NUMBERS FROM 2018, WHICH WERE 14,833 OUTSTANDING WARRANTS. UM AT THAT TIME PERIOD AND THE REASON I'M PICKING 2018 IS BECAUSE IN 2019, THERE WERE SOME SOME LAW CHANGES. THAT TOOK PLACE THAT CHANGED HOW WE HAVE TO, UM GRANT LAWRENCE OR ORDER WARRANTS. I'M SORRY. I'VE HAD A LOT OF CONGESTION AND ALLERGY STUFF LATELY, SO I'M I FEEL LIKE MY VOICE IS WATER. OKAY? WE HAVE PURGED 1001 OLD CASES. AND THAT IS SIGNIFICANT BECAUSE , UM, THERE WAS A LARGE BACKLOG OF CASES THAT ENDED BACK TO THE 19 EIGHTIES. SOME OF THEM UM, DEPENDING ON THE BOOKS, AND JUST, YOU KNOW, THEY TOOK MARTIAL TIME TRYING TO HUNT PEOPLE DOWN. FROM A JUSTICE STANDPOINT, I REALLY DOUBT THERE ARE GREAT. UM EVIDENTIARY. UH, FINDING SOMEONE BEYOND A REASONABLE DOUBT GUILTY ON A CASE THAT PENS BACK THAT LATE IS PRETTY DIFFICULT. SO FROM A JUSTICE STANDPOINT, THAT'S GREAT . AND FROM THE TIME THAT GETS PUT INTO THIS OLD CASES THAT REALLY DON'T GET YOU ANY VALUE. FROM A MARTIAL PERSPECTIVE AND A CLERK PERSPECTIVE. THOSE ARE GONE AND OUT OF OUR SYSTEM. SO WHAT WE DO. RECENTLY RELATIVELY RECENTLY, I REFERRED TO SOME OF THE LAW CHANGES THAT HAPPENED IN 2019. THERE HAS BEEN AN INCREASING EVOLUTION OF THE LAW TOWARDS UM GREATER CONSIDERATION OF INDIGENOUS INDIGENCY REALLY PROTECTING A LOT OF DEFENDANT

RIGHTS. AND SO THE LAWS HAVE EVOLVED 2017. THERE WERE SOME CHANGES 2019. THERE WERE SOME CHANGES THIS LEGISLATIVE SESSION. THERE HAVE BEEN SOME CHANGES AS WELL. THANK YOU SO MUCH THAT HAVE BEEN INCREASING THE COURT'S RESPONSIBILITY TO PROVIDE CERTAIN NOTICE REQUIREMENTS. SO ORDINARILY WHEN YOU GET A CITATION YOU GET YOUR CITATION AND ON THE CITATION, IT SAYS YOU MUST APPEAR IN COURT AT A CERTAIN DATE. IT'S USUALLY 20 DAYS WITHIN 20 DAYS OF GETTING THAT CITATION IF THEY DIDN'T SHOW UP FOR THEIR HEARING AT THAT DATE OR RESOLVE THEIR CASE BY THAT DATE, THEN YOU COULD ISSUE A WARNING. THE LAW HAS CHANGED ON THAT POINT, AND NOW WE HAVE TO, IN ADDITION TO THAT ONCE THEY MISSED THAT 1ST 20 DAY DATE, SEND THEM NOTIFICATION THAT THEY ARE BEING SET FOR A HEARING 30 DAYS OUT, SO THERE'S ANOTHER 30 DAYS TACKED ONTO THAT AND ALL THOSE HEARINGS ARE SET 30 DAYS OUT. AND WHEN THEY DON'T SHOW UP FOR THAT HEARING, IF THEY DON'T SHOW UP FOR THAT HEARING AND THAT STAGE THEN WE HAVE OUR BAILIFFS RUN. WHAT'S CALLED A BAILIFF ABIT DAVID TO ENSURE THAT THEY'VE BEEN OUT IN THE HALL. THEY'VE CONFIRMED THAT THIS PERSON IS NOT APPEARED. FOR THEIR HEARING, AND THEN IT CAN GO THROUGH THE WARRANT PROCESS THAT THEY HAVE NOT SHOWED UP FOR THEIR HEARING. HAVE BEEN ARRESTED ON A CLASSY TICKET TAKEN INTO JAIL AND THEN THEY'RE PLEADING GUILTY TO THEIR CASE, AND THEY WOULD LIKE JAIL CREDIT FOR THAT CASE. AND SO IN FACT, THE LAW HAS SAID IN THE PAST, WE HAVE TO GRANT $100 TOWARDS THAT NOW, IT SAYS, YOU HAVE TO GRANT $150. FOR EACH 12 HOUR SEGMENT OR 24 HOURS, STARTING IT EXCUSE ME, STARTING AT 12 HOURS FOR EVERY 12 24 HOURS, $150, AND WE'VE GOT SOME DISCRETION TO GO UP FROM THERE, TOO. SO THAT IS MANDATORY. WE DON'T HAVE ANY OPTION ABOUT THAT. THE LAW SAYS WE MUST MAKE THESE CONSIDERATIONS AND GRANT THESE WAVERS OR CREDITS, UM AS DEEMED APPROPRIATE. UM SO WARRANTS AS WELL LIKE I TALKED ABOUT. WE'RE GOING TO HAVE TO CREATE A PROGRAM TO DIVERT JUVENILE ANYBODY WHO'S GOT A CLASS C FINALLY CHARGE OTHER THAN A TRAFFIC OFFENSE. TRAFFIC OFFENSE WILL STILL STILL SEE THEM IN COURT. BUT ANY OTHER TYPE OF CHARGE IF THEY ARE UNDER THE AGE OF 17 MUST BE DIVERTED. IT'S AN ABSOLUTE MANDATORY. THE STATE DOES HAVE VETO POWER OVER THAT, BUT THE STATE DOESN'T GET TO DECIDE. IT'S NOT IMPLYING ANY KIND OF TAX INCREASE TAX RATES INCREASE MAINTAINING OF THE CURRENT RATE THAT WE CURRENTLY ENJOY. SO. IN 2019, THE VOTERS PASSED FIVE SEPARATE PROPOSITIONS GETTING US TO $350 MILLION FOR THE GENERAL USES THAT YOU SEE ON THE SCREEN THERE TODAY. WE'RE RIGHT AROUND $140 MILLION AS WE DISCUSSED IN THE AUGUST MEETING FOR THE WORK SESSION REGARDING THE BUDGET. WE WANTED TO LET THE COUNCIL NO, WE'RE PROBABLY GOING TO DRAW DOWN A GOOD CHUNK OF THAT, OVER THE COURSE OF FISCAL YEAR, 24.

UM AN EXACT NUMBER I DON'T HAVE IN FRONT OF ME, BUT ROUGHLY, YOU KNOW, 25 TO 30% WILL BE REMAINING AT THE END OF THE YEAR AND WE DON'T WANT TO GET TO LEAN WITH THAT NUMBER, ESPECIALLY AS IT RELATES TO STREETS AND TRANSPORTATION AND INFRASTRUCTURE KIND OF THOSE HORIZONTAL INITIATIVES THAT WE DO ON A PRETTY FREQUENT BASIS.
