[County Bond Update Presented by Former McKinney City Mayor Brian Loughmiller]

ITEM 230792 COUNTY BOND UPDATE PRESENTED BY FORMER MCKINNEY CITY MAYOR BRIAN LOCK MILLER. IF YOU PUT TWO MINUTES ON THE CLOCK, PLEASE, RIGHT. NO PRESSURE ON EVERYBODY ELSE THAT'S COMING HERE. BUT YOU KNOW THERE YOU GO. CHECKING POCKETS. SEE IF I CAN DRIVE THIS THING.

THERE YOU GO. ALRIGHT. WELL, FIRST OF ALL, I APPRECIATE GIVING ME THE TIME TO DO THIS ON BEHALF OF COLLIN COUNTY. I KNOW YOU ALL ARE VERY FAMILIAR WITH BOND ELECTIONS AND ASSESS CITY OF AND ELECTIONS AND THIS IS REALLY MORE INFORMATIONAL JUST FOR THE PUBLIC THAT HOPEFULLY GOING TO BE VOTING ON NOVEMBER, THE SEVENTH BUT WE HAVE A LOT OF SLIDES. I'LL GO THROUGH THEM RATHER QUICKLY, BECAUSE I KNOW YOU HAVE A LOT OF BUSINESS TONIGHT. BUT OBVIOUSLY ONE OF THE THINGS THAT WE ALL KNOW IS THAT COLLIN COUNTY AND MCKINNEY HAS GROWN EXPONENTIALLY OVER THE LAST 20 OR 30 YEARS AND STATISTICALLY, WE HAVE ABOUT 112 NEW RESIDENTS MOVING IN EVERY DAY. AND SO AS YOU LOOK AT THE POPULATION MIX MOVING FORWARD FROM 1970 TO PRESENT THAT'S A THAT'S A BIG NUMBER. BUT WHEN YOU TAKE THAT FURTHER AND YOU LOOK AT AND THIS IS A HEAT MAP, SO THE MAP ON THE LEFT IS BASED ON THE 2000 CENSUS EACH DOT REPRESENTS 10 PEOPLE. IF YOU THINK ABOUT THAT, AND THEN LOOK AT 2020. THE CHANGES THAT WE'VE HAD IN THE AREA. BUT ANYWAY AS WE GET TO THE POPULATION NUMBER AND THE EXPECTATION HERE'S WHERE WE'RE AT, IF YOU LOOK AT GOING OUT TO 2060 COLLIN COUNTY IS ANTICIPATED BE ALMOST AS BIG AS DALLAS COUNTY. AT THAT POINT, YOU KNOW, CLOSE TO 2.5 MILLION PEOPLE. AND SO JUST LIKE CITIES. ULTIMATELY THE COUNTY HAS TO HAVE A BOND ELECTIONS IN ORDER TO MEET THE NEEDS OF THE COMMUNITY, AND THERE ARE FIVE PROPOSITIONS ARE GOING TO BE ON THIS MOST THIS NEXT ELECTION. THE FIRST ONE, AND THESE ARE THE GENERAL CATEGORIES. JUSTICE ANIMAL SHELTER, HEALTH PARKS AND ROADS SO WITH REGARD TO THE JUSTICE FACILITIES WE'RE REALLY TALKING ABOUT HERE ARE THE COURT FACILITIES ON BLOOMINGDALE ROAD.

AND THE DETENTION FACILITIES. AND AS MR PHILLIPS NOTES, SINCE WE BOTH ARE AT THAT COURTHOUSE QUITE OFTEN, OBVIOUSLY, ONE OF THE MOST IMPORTANT THINGS THAT YOU THAT THE COUNTY DOES IS TO PROVIDE COURTS FOR THE COMMUNITY COMMUNITY AND IT'S NOT JUST CRIMINAL COURTS, CIVIL COURTS AND IF YOU THINK ABOUT FROM AN ECONOMIC IMPACT STANDPOINT. IF YOU OWN A BUSINESS AND YOU'RE IN A SITUATION WHERE YOU'RE IN LITIGATION OVER A CONTRACT OR SOMETHING. SOME DISPUTE THAT MAYBE WORTH MILLIONS. IF NOT BILLIONS OF DOLLARS. YOU WANT ACCESS TO COURTS AS QUICKLY AS POSSIBLE. THE STATE LEGISLATURE'S ALREADY APPROVED TWO NEW CORDS FOR COLLIN COUNTY GOING INTO THIS NEXT TWO YEARS, ONE FOR THIS YEAR THAT ACTUALLY HAS ALREADY BEEN FILLED. AND ONE FOR NEXT YEAR, SO THERE'S GOING TO BE EXPANSION AND OBVIOUSLY THAT'S GOING TO LEAD TO NEW CONSTRUCTION. SO THE JUSTICE FACILITIES. PROPER PROJECT IS ALL CAPITAL IMPROVEMENTS. IT'S NOT OPERATIONAL. AND ITS EXPANSION. THAT PART OF THE BOND IS $261 MILLION. FOR THOSE OF YOU THAT AREN'T FAMILIAR WITH THE FACILITY BECAUSE YOU'VE BEEN LUCKY ENOUGH NOT TO HAVE TO GO OUT THERE. IF YOU GO OUT GLENDALE ROAD, THE COUNTY WAS SMART ENOUGH TO PURCHASE ALL OF THAT LAND OUT THERE FOR FUTURE GROWTH SO THAT THEY COULD GROW THEIR COMPLEX ALL WITHIN THE SAME AREA WITHOUT HAVING TO GO AND ACQUIRE ADDITIONAL LANGUAGE WOULD HAVE CAUSED US TO COSTS A LOT MORE MONEY. THE NEXT ITEM IS THE ANIMAL SHELTER. ANYBODY THAT'S ADOPTED A DOG FROM SCOTLAND COUNTY OR A CAT. THAT'S BEEN OUT THERE. IT'S A GREAT FACILITY, BUT IT AGAIN ONCE BECAUSE OF GROWTH. IT'S ALSO BEYOND CAPACITY FACILITIES BUILT IN 2006. THERE'S BEEN NO EXPANSION SINCE THAT TIME. SO THEY'RE PLANNING ON EXPANDING THE ANIMAL SHELTER. ADDITIONAL

[00:20:01]

60 CANDLES FOR THE CANDLES FOR ADOPTABLE DOGS, 40 FOR CATS. AND THAT IS $5.7 MILLION. ANOTHER IMPORTANT FACTOR HERE IS THAT YOU KNOW, AS YOU ALL KNOW THE CITY. MCKINNEY DOES NOT HAVE ITS OWN ANIMAL SHELTER. PLANO DOES NOT HAVE ITS OWN ANIMAL SHELTER. FRISCO DOES NOT HAVE ITS OWN ANIMAL SHELTER, SO WE HAVE PARTNERSHIPS WITH ALL THE CITIES THAT SHARE IT IN THE OPERATIONAL EXPENSE OF THIS AND ACTUALLY SAVES MONEY ON BOTH SIDES. NEXT ITEM IS PUBLIC HEALTH. SO HERE'S ANOTHER ONE MEDICAL EXAMINER FACILITY. AH BUILT IN 1988 AND HAS NOT BEEN EXPANDED ITS OVERCAPACITY AND UNFORTUNATELY, WE HAVE TO HAVE MEDICAL EXAMINER THEY HAVE TO INVESTIGATE. THEY HAVE TO DO AUTOPSIES. THEY HAVE A LOT OF THINGS THAT THEY HAVE TO DO. AND IF YOU THINK, AND ACTUALLY WHEN I WAS DOING THIS PRESENTATION CITY, VANNA THE OTHER NIGHT. I SAID, YOU KNOW, FROM MY PERSPECTIVE LOOKING AT MCKINNEY I MOVED TO MCKINNEY IN 1989 WHEN MCKINNEY WAS ABOUT 17,000 PEOPLE. AND SO THIS PLACE WAS ALREADY IN. BUSINESS. HAS 17,000. NOW WE'RE WHAT 210,000 AND THERE'S BEEN NO EXPANSION, SO THIS AGAIN IS AN ABSOLUTE NECESSITY TO MEET THE NEEDS OF THE COMMUNITY. ALSO, IT'S IMPORTANT POINT OUT THAT THAT FOR THOSE THAT MAY BELIEVE THAT FEDERAL DOLLARS ARE AVAILABLE FOR THIS. THERE'S LIMITATIONS ON THAT AS WELL. SO THAT'S 13.3 MILLION. PARKS AND OPEN SPACE. THE NEXT TO AUDIENCE ARE PROBABLY GENERALLY SPEAKING THE EASIEST I DON'T THINK YOU KNOW, WRAP YOUR ARMS AROUND BECAUSE IT'S SOMETHING THAT EVERYBODY ULTIMATELY DOES. PARKS AND OPEN SPACE IS NOT ONLY RENOVATION OF MYERS PARK AND THE EVENT CENTER AND SPECIFIC PROPERTIES THAT THE COUNTY HAS, BUT ALSO, AS YOU ALL KNOW, IT INCLUDES THE ABILITY TO BY ADDITIONAL OPEN OPEN SPACE AND PARKS AND AGAIN AS THE COUNTY AND THE CITIES WORK TOGETHER. OFTENTIMES THERE'S A SHARED PARTNERSHIP AS IT RELATES TO COUNTY FACILITIES WITH THE CITIES. SO THAT IS 22.4 MILLION. ROADS. ROADS ARE. YOU KNOW, I MEAN ANYBODY THAT RIDES ON 75.

HALLWAY, 1 21 OR ANY OF THE ROADS WE HAVE AROUND HERE. THEY KNOW THAT GROWTH IS BRINGING NEW ROAD CONSTRUCTION AS WELL AS MAINTENANCE OF EXISTING ROADS INTO PLAY. AND SO THE NEEDS AND WHAT THEY'RE LOOKING AT HERE IS STRUCTURAL IMPROVEMENTS TO COUNTY ROADS, NEW REGIONAL THOROUGHFARES. AND PARTNERSHIPS. $300 MILLION AND AGAIN, AS YOU KNOW, $300 MILLION FOR ROAD PROJECTS IS REALLY NOT. UH THAT MUCH AND AGAIN FOR THE COMMUNITY TO PUT THAT IN PERSPECTIVE WHEN THE EXCHANGE WAS BUILT AT 1, 21 75 JUST THAT LITTLE SPOOLIE THERE. JUST THAT PART ALONE, I BELIEVE WAS NORTH OF $250 MILLION JUST FOR THAT AT THE TIME. AND. WAS WHAT ELSE IS IMPORTANT TO THIS ITEM HERE IS THAT ULTIMATELY WHEN YOU HAVE ROAD CONSTRUCTION, WHETHER IT'S THROUGH THE CITY, THE COUNTY OR OR THE REGION THOSE PROJECTS ARE THEY'RE BUILT ON PARTNERSHIPS WITH REGIONAL TRANSPORTATION COMMISSION. THE STATE TEXT IN T T A AND SO THIS IS THE ABILITY TO LEVERAGE THEM. THE COUNTY'S DOLLARS WITH WITH OTHER DOLLARS JUST LIKE THE CITY WOULD LEVERAGE THEIR DAUGHTER DOLLARS BECAUSE ULTIMATELY IN ORDER TO GET MONEY. YOU HAVE TO GIVE MONEY. AND MOST OF THESE AGENCIES ARE A DOLLAR FOR DOLLAR MATCH OR SOMETHING SIMILAR TO THAT. SO THOSE ARE THE PROPOSITIONS. IT'S A BIG BOND ELECTION. $683 MILLION.05 PROPOSITIONS. EACH PROPOSITION WILL BE VOTED ON INDIVIDUALLY OR INDEPENDENTLY OF THE OTHERS. SO PEOPLE CAN YOU KNOW WE WOULD CERTAINLY HOPE THAT PEOPLE WOULD SUPPORT ALL OF THEM. BUT CERTAINLY THEY CAN SUPPORT THE ONES THAT THEY WANT. QUESTIONS THAT COME UP ON EVERY BOND ELECTION. I KNOW WHAT THE CITY HAS ANOTHER BOND ELECTION AT SOME POINT IN THE FUTURE. THAT QUESTION OF WHAT HAPPENS TO THE TAX RATE ALWAYS COMES UP. THE COUNTY HAS A GENERAL POLICY JUST LIKE THE CITY MCKINNEY'S POLICY THAT THEY WILL EFFECTIVELY ISSUED DEBT IN A MANNER IN WHICH IT WILL NOT IMPACT THE TAX RATE BY REQUIRING A HIGHER TAX RATE. AND IF YOU LOOK AT THE HISTORIC HISTORY OF BOND ELECTIONS IN COLLIN COUNTY, JUST LIKE IN THE CITY OF MCKINNEY, GOING BACK SEVERAL YEARS. THERE HAVE BEEN BOND ELECTIONS ON SIMILAR ITEMS OVER THE YEARS, AND YET THE TAX RATE HAS CONSISTENTLY GONE DOWN FROM 2020 TO 2024. AND CONTINUES TO DO THAT. AND SO THE COUNTY COUNTY COMMISSIONERS ARE SAYING THAT ULTIMATELY, IF THIS BOND ELECTION PASSES, IT WILL PASS.

WITHOUT THE NECESSITY OF TAX RATE AND I THINK THE MOST IMPORTANT THING I CAN SAY ABOUT THIS SLIDE, AND AGAIN I KNOW THE JOB THAT YOU GUYS HAVE TO DO AND SELLING, NOT SELLING, BUT EDUCATING PEOPLE ON BOND ELECTIONS. WHEN YOU GO TO VOTE. ANYBODY GOES TO VOTE ON ELECTION. THE AGENDA ITEM OR THE FINGER. THE BALLOT ITEM THAT YOU'RE VOTING ON, WILL SAY TO

[00:25:04]

LEVY A TAX FOR CONSTRUCTION OF. AND THE FIRST THING PEOPLE THINK IS OH, MY GOD, IF I VOTE FOR THIS, MY TAXES ARE GOING UP. THAT IS NOT WHAT THAT NECESSARILY MEANS. THAT IS STATUTORY LANGUAGE THAT IS REQUIRED BY LAW. THAT IS IN EVERY SINGLE BOND ELECTION, NO MATTER WHETHER IT'S CITY COUNTY STATE, WHATEVER IT IS BUT THEN IT'S UP TO THE LOCAL ELECTED OFFICIALS TO DETERMINE HOW THEY MANAGE THEIR TAX POLICY TO IMPACT THAT AND SO THE COUNTY WELL, NOT RAISE TAXES. THEY HAVE INDICATED THAT JUST LIKE I KNOW THE CITY, MCKINNEY HAS HAD A NUMBER OF ELECTIONS WHERE THEY'VE DONE NOT DONE THAT AS WELL. ELECTION DAY IS NOVEMBER 7TH. EARLY BURNINGS. OCTOBER 2013 NOVEMBER, 3RD. APPALLING LOCATIONS OR COLLIN COUNTY, TEXAS. HER TX DOT GOV. WE HAVE A , UH, A GMAIL ACCOUNT THROUGH THE COMMITTEE THEM. I'M WORKING WITH THAT CC 2023 BOND PROGRAM AT GMAIL .COM. IF ANYBODY WATCHING THIS HAS ANY SPECIFIC QUESTIONS, THEY CAN EMAIL THAT SIDE AND THEY SHOULD BE ABLE TO GET AN ANSWER. AND SO THAT'S IT, AND I APPRECIATE THE TIME THAT YOU GIVE ME AN ANSWER ANY QUESTIONS IF YOU HAVE ANY BUT I DO APPRECIATE EVERYTHING THAT YOU DO FOR THE CITY MCKINNEY AND THAT YOU'VE DONE IN THE PAST.

THEY WANNA HAVE QUESTIONS FOR BRIAN. THANK YOU FOR TAKING THE TIME. THANK YOU. THANKS, BRIAN.

MY NAME IS COLIN KIMBALL. 21 YEAR RESIDENT OF MCKINNEY AND A LONGTIME MEMBER OF THE CITY ARMED SERVICES MEMORIAL BOARD. ITS CURRENT CHAIRMAN. RONNIE RD. FOSTER AND I SHARED A COMMON BOND. HAVE NOT WANTING TO FORGET OUR FRIENDS WHO SACRIFICED THEIR LIVES DEFENDING LIBERTY. IN THE SERVICE TO OUR NATION. VIETNAM WAS AN UNPOPULAR WAR. BUT OUR D ANSWERED THE CALL TO SERVE HIS NATION AS A MARINE. HE WAS A VOLUNTEER. HE LOST SEVEN FRIENDS . ONE OF THEM WAS HIS BEST FRIEND, CORPORAL CHARLES BILL BRIAN IN THAT WAR. IT HAUNTED HIM. SOME 30. YEARS LATER, HE ATTENDED A HIGH SCHOOL REUNION. AND WAS ASKED BY A CLASSMATE. WHERE'S BILL? RD REMINDED HIM THAT HE WAS KILLED IN VIETNAM. TO WHICH THE CLASSMATE UTTERED TWO WORDS THAT EVERY VETERAN AND

[00:30:01]

LOVED ONE ABHORS. I FORGOT. ALREADY TOOK THIS ANGER, AND HE PUT IT TO USE IN AN UNCONVENTIONAL AND ADMIRABLE WAY.T TO THE LIBRARY. JUST RIGHT OVER HERE AND IDENTIFIED 365 NAMES OF MEN AND ONE WOMAN WHO DIED SERVING OUR NATION GOING BACK TO THE GREAT WAR. HE THEN MOBILIZED THE COMMUNITY. AND RAISE THE FUNDS FOR A MEMORIAL THAT CONTAINS THEIR NAMES. THAT IS THE PRIDE OF EVERY VETERAN IN COLLIN COUNTY. AND HE HELPED RESTORE A SENSE OF PRIDE AND BROUGHT SOME WELL NEEDED COMFORT. TO THE GOLD STAR FAMILIES THAT REMAINED BEHIND THROUGH THE EFFORTS OF THE CITY IN SPONSORING A BOARD TO HONOR OUR ARMED SERVICES.

THAT MEMORIAL NOW CONTAINS THE NAMES OF 435 FALLEN WARRIORS. FROM COLLIN COUNTY, WHO HAVE DEFENDED LIBERTY. I SERVED IN THE POST VIETNAM AIR FORCE. AND WHEN I COMPLETED MY ENLISTMENT AND ATTENDED COLLEGE, BEING A VETERAN WAS NOT POPULAR RD ENDURED AND EVEN MORE SEVERE FORM OF OUR SOCIETY'S REJECTION OF VETERANS. AND BECAME CRITICIZED BY HIS PROFESSORS AND THEN OSTRACIZED BY HIS CLASSMATES THAT ATTENDED COLLEGE WITH HIM. BUT HE OVERCAME THESE CHALLENGES. ANY CHANGED THE HEARTS AND MINDS OF THE COMMUNITY AND COLLIN COUNTY. AND INSPIRED A MEMORIAL THAT BRINGS PRIDE AND HONOR TO THOSE WHO HAVE SACRIFICED AND THOSE WHO HAVE SERVED IT IS ONLY FITTING THAT THE MEMORIAL. AND IT PLANS SMALL MONUMENT, REFLECTING HIS ACCOMPLISHMENT TO FUTURE GENERATIONS. BE NAMED IN HIS HONOR. THANK YOU. THANK YOU.

I'LL READ. HONORABLE MAYOR AND OTHER MEMBERS OF CITY COUNCIL IN MCKINNEY. UM MY NAME IS PAUL REED. I'M A NATIVE TEXAN. UM. MOVED TO COLLIN COUNTY IN ABOUT 2005 AND MCKINNEY AND 2012. I'M ALSO A VIETNAM VETERAN. I SERVED A YEAR THERE. 300 DAYS IN THE JUNGLE. I WAS WOUNDED IN AUGUST OF 2000 AND SORRY, AUGUST OF 1968. JUST VERY BRIEFLY FOUGHT BESIDE MEN LIKE OR THE FOSTER FOUGHT SHOULDER TO SHOULDER BESIDES MEN LIKE RD FOSTER. AND I'M PROUD TO SAY I KNEW HIM.

WOW. WHAT AND I'M PROUD TO SAY I'M AMERICAN. I'M PROUD TO SAY I WOULD DO IT AGAIN FOR PEOPLE.

AMERICANS. NOT JUST THIS COUNTY. WHAT THE WHOLE NATION THEREFORE, I SUPPORT. THE NAME CHANGE FOR THE BIDDERS MEMORIAL CRAIG RANCH. THANK YOU. THANK YOU, SIR. NINA DOWELL RINGLEY.

FIRST THINGS FIRST. MAYOR FULLER AND COUNCIL MEMBERS. I'M HERE TONIGHT TO THIS IS A REAL HAPPY NIGHT. ALL KINDS OF GOOD THINGS HAPPENING. BUT I WOULD LIKE TO SUPPORT THE RENAMING OF THE MEMORIAL PARK TO RD FOSTER'S NAME. UM, I'D LIKE TO SHARE A DEBATE IN WHICH ANGLE TO TALK TO YOU ABOUT I WANTED TO SHARE FIRST OF ALL. YOU KNOW, R D WAS RAISED HERE IN MCKINNEY. HE WENT TO SOUTH WARD SCHOOL, AND HE WENT TO MCKINNEY HIGH SCHOOL. GRADUATED IN 1966. HE LIVED IN WHAT WE CALL THE MILLBROOK BLOCK. UM HE WAS EVEN VOTED MCKINNEY. KING MCKINNEY HIGH SCHOOL KING. UM BUT WE THINK THAT'S KIND OF FUNNY, BUT HE HE WAS SUCH A GREAT, GREAT MAN. YOU KNOW, HE WENT AND SERVED IN VIETNAM, AND THAT'S WHERE I WANT TO TALK A BIT BECAUSE WE DID EXHIBIT AT THE MCKINNEY AT THE COLLIN COUNTY HISTORY MUSEUM. THIS WAS IN 2015 FOR SEVERAL YEARS AND RD AND SEVERAL OTHER VETERANS HERE TODAY THEY TAUGHT THE PUBLIC THE COMMUNITY SO MUCH ABOUT THE VIETNAM WAR THAT MANY DID NOT KNOW. UM WE CALL THAT WE TITLED THIS EXHIBIT THE VIETNAM SYNDROME. LATER I WROTE SOMETHING TO OUR D N A PART OF IT WAS THIS BECAUSE WE WORKED TOGETHER LONG HOURS ON THE PROPS . AND SO I WROTE HIM THIS WE DID THE PROPS. I LEARNED A LOT OF

[00:35:02]

TIMES I WOULD NOT WANT YOU TAUGHT ME? WELL. I FELT A HELL OF A WAR. I KNEW NOT SO THAT WAS PART OF OUR WHAT I WROTE TO HIM LATER WHEN I WAS TELLING HIM ALL THE THINGS HE DID FOR ME. I WANTED TO LET YOU KNOW THAT ARE D. WAS MY HERO. IN MANY WAYS, I CIRINCIONE REALLY RESPECTED HIM.

HIS WORDS OF WISDOM, HIS SERVICE TO OUR COUNTRY, HIS DEDICATION TO OUR HISTORY, HIS LOVE OF FINE MUSIC, HIS KIND DEMEANOR. HIS DEDICATION TO HIS FAMILY, HIS LOVE OF PETS. HIS FUNNY FRIENDSHIPS. HIS PERSEVERANCE ATTITUDE. AND ESPECIALLY HIS LOVE OF LIFE ARE D WAS A HUMBLE KIND AND GENEROUS MCKINNEY HEIGHT. THANK YOU FOR YOUR CONSIDERATION TONIGHT AND RENAMING THE PARK IN HIS HONOR. APPRECIATE IT, AND HERE IS HIS FAVORITE QUOTE. IT IS BETTER TO LIVE ONE DAY AS A LION THAN 4000 YEARS AS A SHEEP. TIBETAN PROVERB, AND IT'S IN RDS 2007 BOOKS ONE DAY AS A LION. THANK YOU. THANK YOU VERY MUCH. BILL FOSTER. HMM I'M GOING TO ASSUME THAT YOU REGISTER YOUR SUPPORT. YES, SIR. UM. RD WAS SUCH A GREAT MAN. I HAD THE HONOR OF KNOWING HIM AND WORKING WITH HIM. FOR THE TIME I'VE BEEN MAYOR ALSO SHARED SOME MUSIC.

GUITAR FROM LOTTERY WITH RD AS WELL, UM I'M SO SORRY FOR THAT FOR THAT LOSS, YOUR LOSS AND GUARDIA? CERTAINLY SOMEONE THAT HAS. DONE SOMETHING THAT WILL WILL FOREVER. BE ADMIRED AND APPRECIATED. GENERATIONS TO COME. AND THERE'S NOT MANY PEOPLE THAT THAT ARE ABLE TO SAY THAT THAT THEY DEDICATE THEMSELVES SO SELFLESSLY TO SOMETHING SO PROFOUND THE IMPORTANT TO FAMILIES AND FAMILY MEMBERS THAT IN THIS CASE VETERANS SO GREAT MAN. GREAT LOSS, BUT WE CERTAINLY HONOR HIM AND I'M GOING TO CALL A MATTER OF FACT, THIS ITEM OUT OF ORDER

[Consider/Discuss/Act on Modifying the Name of Veterans Memorial Park to Corporal RD Foster Veterans Memorial Park]

BEFORE WE EVEN TALK ABOUT CONSENT ITEMS. I'M GONNA CALL ITEM 230741 CONSIDERING AN ACT ON MODIFYING THE NAME OF VETERANS MEMORIAL PARK TO CORPORAL RD FOSTER VETERANS MEMORIAL PARK. I KNOW THAT RYAN YOU WERE GOING TO PRESENT BUT I'M GONNA I'M GONNA TAKE A WILD GUESS THAT WE DON'T NEED TO HAVE A PRESENTATION. I'M GONNA I'M GOING TO MAKE THE MOTION FOR MY FRIEND. IF YOU LIKE TO SAY I DON'T WANT TO KEEP YOU FROM SPEAKING. BUT. WHY DON'T YOU COME UP AND SAY I SHOULDN'T DO THAT TO YOU? I MEAN, YOU'RE ALL DRESSED UP IN TIE AND SUIT YOU ARE YOU KNOW, UM MM. TROUBLE SPEAKING. BUT I WANTED TO GET THIS OUT.

I WANTED TO DO THIS FOR R D. THIS IS FROM HIS BOOK. AND THESE ARE HIS WORDS. IN 2004. I RAN ACROSS AN OLD FRIEND AND SEEN SINCE HIGH SCHOOL. WE GOT TO TALKING, HE SAID. IF I REMEMBER CORRECTLY, YOU AND BILL BRIAN JOINED THE MARINES RIGHT OUT OF HIGH SCHOOL. I TOLD HIM WE HAD WELL, WHATEVER HAPPENED TO BILLY ASKED THAT WAS KILLED IN VIETNAM, I REPLIED. OH, YEAH, HE SAID, I FORGOT. THIS IS FROM OUR TEAM. AT THAT MOMENT, I REALIZED THAT IF I DIDN'T DO SOMETHING, EVENTUALLY HE WOULDN'T BE FORGOTTEN. I GUESS IT WAS JUST TAKEN TAKEN FOR GRANTED THAT SINCE BILL WAS A TRUE MCKINNEY HERO, HAVING BEEN AWARDED THE NAVY CROSS FOR HEROISM IN THE FIGHT WHERE HE WAS KILLED, HE WOULD ALWAYS BE REMEMBERED IN HIS HOMETOWN. I WAS WRONG. BUT I WASN'T ABOUT TO LET THAT HAPPEN. WELL BRIAN WASN'T THE ONLY MCKINNEY BOY TO DIE IN THAT WAR, AND I DECIDED THAT EVEN THOUGH THE WAR FOR ME IT ENDED OVER 35 YEARS AGO, I STILL HAD ONE MORE MISSION TO ACCOMPLISH. AND THAT WAS TO TELL THEIR STORIES. SO THEY WOULD NOT BE FORGOTTEN. 19 YEARS AGO RD FOSTER EMISSION IN THE DAY 435 OF THOSE NAMES. THOSE PATRIOTS ARE MEMORIALIZED ON THAT WALL. AND FOR THIS, WE BE HUMBLY REQUEST THAT YOU RENAMED THE PARK TO CORPORAL RD FOSTER MEMORIAL PARK. TO MEMORIALIZE A MAN. DID NOT FORGET THOSE THAT GAVE ALL ABSOLUTELY. I WANT TO ACTUALLY. IT IS MEMORIAL. I SPOKE AT HIS MEMORIAL. AND ONE OF THE THINGS I SAID, I WANT TO SAY HERE TONIGHT BECAUSE IT'S ABOUT HIM AND SOMETHING THAT HE DID IN HIS

[00:40:03]

LAST DAYS. THAT I JUST FEEL SO STRONGLY SPEAK TO WHO HE WHO HE WAS AS A MAN. SO IN IN MY COMMENTS THAT DAY, I SAID ALREADY CALLED ME A WEEK AGO. HE TOLD ME THAT HE HAD BEGUN HOSPICE CARE AND KNEW HE WOULD BE LEAVING US VERY SOON. AS I STUMBLED, SEARCHING FOR COMFORTING WORDS. HE BEGAN TO APOLOGIZE TO ME FOR NOT BEING ABLE TO CONTINUE HIS WORK WITH THE VETERANS MEMORIAL BOARD, THE PARK AND THE WALL OF HONOR. AND THAT TIME OF MORTAL REFLECTION.

HE WAS THINKING ONLY ABOUT THE STORIES HONORING OTHERS THAT HE HAD NOT YET DISCOVERED AND TOLD THE NAMES HE HAD NOT YET IDENTIFIED TO BE ON THE WALL SO THAT THEY WOULD NOT BE FORGOTTEN. AND THAT DELICATE, SOUL REVEALING MOMENT, ARDIS HEART WAS PREOCCUPIED WITH THE LEGACY OF OTHERS, HE FELT HIM MIGHT BE LEAVING INCOMPLETE. HOW DO YOU QUANTIFY THE DEPTH OF COMPASSION AND COMMITMENT TO OTHERS IN A MAN HOW WE RECONCILE SUCH A LOSS IN OUR COMMUNITY? I'LL NEVER FORGET THE DAY I DIE. THAT CALL I GOT FROM OUR D AT THAT MOMENT AND WHAT HIS CONCERN WAS, AND IT WAS JUST SPOKE VOLUMES TO WHO HE WAS SO I'M GOING TO MAKE THE MOTION THAT WE CHANGE, MODIFY THE NAME OF VETERANS MEMORIAL PARK TO COPE ALREADY? FOSTER VETERANS MEMORIAL PARK. MR PERRY, DO YOU MIND IF I MAKE ONE COMMENTS FOR LET ME SECOND THAT, BUT I'M GONNA MAKE ONE COMMENT. I MET RD THROUGH MY CAMPAIGN FOR CITY COUNCIL INITIALLY, UM I ALWAYS ADMIRED HIM GREATLY. MY FATHER DID TWO TOURS IN VIETNAM. I LOST MY DAD 30 YEARS AGO. BUT I'VE ALWAYS THOUGHT OF ALREADY. YOU KNOW, WE LOOK AT LIFE. THEIR OWN FILTER IS A RENAISSANCE MAN.

ALWAYS. I DON'T KNOW A RENAISSANCE MAN BETTER THAN OUR D. SO I DECIDED I'M GOING TO LOOK THIS UP TO SEE IF HE WAS A RENAISSANCE MAN, AND I LOOKED IT UP INSTEAD OF RENAISSANCE MAN EXCELLED IN A VARIETY OF AREAS. HE WAS WELL EDUCATED. HE WAS CHARMING, WITTY. ABLE TO DANCE.

I DON'T KNOW ABOUT THAT ONE. WRITE POETRY. YEP. I SING? YEP PLAY MUSIC? YEP. WRESTLE. RIDE HORSES AND FIGHT AS A SWORDSMAN, BUT HE CERTAINLY WAS. YOU HAD A GUN R D WAS A RENAISSANCE MAN.

UH, ONE OF THE GREATEST THRILLS OF BEING ON THIS COUNCIL WAS ME BEING ABLE TO MEET OUR D. SO THANK YOU. I SECOND YOUR MOTION, MR MAYOR. UM PLEASE CAST YOUR VOTES.

NOW FOR THOSE WHO ARE HERE FOR THAT ITEM, AND WE'RE ARE WONDERING, WHAT WOULD IT LOOK LIKE IF I GOT UP AND I LEFT NOW THAT THAT'S OVER, OR SHOULD I STAY FOR THE REST OF THIS MEETING WITH A LOT OF PUBLIC HEARINGS? I'M GOING TO TELL YOU THAT WE'RE ABOUT TO TALK ABOUT CONSENT ITEMS WHICH WILL BE VERY QUICK AND CONTROVERSIAL AND A GREAT OPPORTUNITY FOR YOU TO LEAVE. IF YOU SO CHOOSE, AND NO ONE WILL THINK. THEY LOVE IT. OR YOU CAN STAY HERE FOR THE NEXT

[CONSENT AGENDA]

SEVEN HOURS WITH US SO WE WILL MOVE TO CONSENT. WHAT I WAS JUST KIDDING. DON'T LEAVE AGENDA.

THESE ITEMS CONSIST OF NON CONTROVERSIAL HOUSEKEEPING ITEMS REQUIRED BY LAW, AND THIS MAY BE CONSIDERED INDIVIDUALLY BY ANY COUNCIL MEMBER MAKING SUCH REQUEST PRIOR TO A MOTION AND VOTE ON THE CONSENT ITEMS. IS THERE EMOTION MAKING MOTION? WE APPROVE THE CONSENT AGENDA.

[00:45:01]

CHAPTER 1 50 ENTITLED UNIFIED DEVELOPMENT CODE AND THE CODE OF ORDINANCES REGARDING THE REQUIRED DOCUMENT AND PROCESS TO RECEIVE A DETERMINATION OF ON CERTAIN DEVELOPMENT APPLICATIONS TO BRING SUCH PROVISIONS INTO CONFORMITY WITH NEW STATE LAW ADOPTED BY AND THROUGH HOSPITAL 36 99. THANK YOU, MR MAYOR. AS I PROMISED, WE WERE GOING TO TALK A LITTLE BIT MORE ABOUT PLANNING IN THE CITY OF MCKINNEY WITH THIS ITEM. SO, AS YOU ALL KNOW THE RECENT LEGISLATIVE SESSION JUST CLOSED OR THE REGULAR SESSION DID ANYHOW. AND WITH THAT WE HAVE A HANDFUL OF NEW STATE LAWS THAT WE NEED TO APPROPRIATELY INCORPORATE INTO OUR RULES AND REGULATIONS FOR THE CITY, ONE OF WHICH IS HOUSEHOLD 36 99, WHICH RELATES TO THE PROCESSING OF PLATTS.

WITHIN ANY TEXAS CITY. SO THIS IS SOMETHING WE'VE KIND OF TALKED A LITTLE BIT ABOUT OVER THE LAST COUPLE OF WEEKS. BUT I DO WANT TO WALK THROUGH SOME OF THE PROVISIONS OF THAT NEW STATE LAW AND HOW WE INTEND TO INCORPORATE THOSE INTO OUR SUBDIVISION ORDINANCE FOR THE PROCESSING OF PLOTS TO HIGHLIGHT SOME OF THE KEY ELEMENTS OF HOSPITAL 36 99, WHICH WAS APPROVED THE NEW HOUSE BUILD NOW ALLOWS THE MUNICIPAL AUTHORITY THAT IS THE CITY COUNCIL. TO DELEGATE APPROVAL AUTHORITY TO STAFF FOR ALL TYPES OF PLATTS. PREVIOUSLY THERE WERE CERTAIN PLANTS THAT HAD TO GO BEFORE PLANNING AND ZONING COMMISSION OR YOU ALL AS A COUNCIL STAFF HAS THE FULL AUTHORITY TO APPROVE, DISAPPROVE OR APPROVED WITH CONDITIONS THAT APPROVED WITH CONDITIONS PLANTS THAT COME AT THE STAFF LEVEL. I DO WANT TO TALK A LITTLE BIT ABOUT HOW THAT WORKS. SO AS YOU ALL LIKELY NOTE BY THIS POINT PLANTS ARE NOT A SUBJECTIVE MATTER FOR THE CITY PER STATE LAW. WE HAVE AN OBLIGATION TO APPROVE A FLAT THAT MEETS OUR SUBDIVISION REGULATIONS OR DISAPPROVE A PLANT THAT DOES NOT SO BY AUTHORIZING STAFF TO DELEGATE THAT APPROVAL AUTHORITY. IT DOES HELP TO STREAMLINE THAT PROCESS A BIT FOR THE FOLKS THAT WE ARE WORKING WITH ON THOSE PLOT APPROVALS, AS OPPOSED TO PUTTING THEM IN FRONT OF A P AND Z OR CITY COUNCIL. I PROMISED YOU IN A PREVIOUS MEETING THAT WE'RE NOT GOING TO SEE FLATS ANYMORE, AND THAT WAS A LIE. THE ONE THING I DO WANT TO HIGHLIGHT IS PLANTS THAT ARE REQUESTING VARIANCES SUCH AS THE ONE THAT YOU JUST CONSIDERED. THEY WILL STILL REQUIRE CITY COUNCIL APPROVAL BECAUSE VARIANCES TO OUR SUBDIVISION ORDINANCES, NOT SOMETHING THAT WE HAVE THE ABILITY TO APPROVE AT THE STAFF LEVEL. SO FROM TIME TO TIME, YOU WILL STILL SEEK FLATS. BUT BY AND LARGE PLANNING AND ZONING COMMISSION IN THE CITY COUNCIL WILL SEEM MUCH LESS OF THEM. IF YOU APPROVE THE CHANGES TO THE SUBDIVISION ORDINANCE FOR THAT APPROVAL AUTHORITY. SIMILAR TO THE WAY STATE LAW HAS ALREADY READ. IF A PLAN IS DISAPPROVED, AN APPLICANT OBVIOUSLY HAS THE ABILITY TO SUBMIT REVISIONS TO COME INTO COMPLIANCE AND ULTIMATELY GAIN THAT APPROVAL.

SO WE USE THAT TERMINOLOGY OF DISAPPROVAL, NOT DENIAL BECAUSE OF DISAPPROVAL. THEY HAVE THE OPPORTUNITY TO RESUBMIT IN TERMS OF THE SUBMITTAL PROCESS OR THE REVIEW PROCESS. THERE ARE SOME NEW REQUIREMENTS WHEN THE STATE WITHIN THE STATE LAW THAT REQUIRES CITIES TO EXPLICITLY OUTLINE WHAT IS REQUIRED. TO ACCEPT A PLAT FOR REVIEW AND ACTION. SO WE HAVE INCLUDED THAT INTO OUR SUBDIVISION ORDINANCE, AND IT ALSO, UM REQUIRES US TO SPECIFY SOME NEW ADOPTION REQUIREMENTS FOR OUR ENGINEERING DESIGN MANUAL. SO ALL OF THAT HAS BEEN APPROPRIATELY INCORPORATED INTO OUR SUBDIVISION ORDINANCE, WHICH IS HIGHLIGHTED AGAIN HERE AND I'M HAPPY TO ANSWER ANY QUESTIONS THAT YOU ALL HAVE. BUT IF NOT, WE WOULD ASK FOR YOUR FAVORABLE RECOMMENDATION. ACTION ANY QUESTIONS FOR JENNIFER BEFORE WE PUBLIC HEARING. SEEN? NONE. IS THERE ANYONE LIKE TO SPEAK TO THIS ITEM? SEEING, THEN ENTERTAIN A MOTION. MR MCBRIDE MAKE A MOTION THAT WE APPROVED THE ITEM HAS PRESENTED BUS STAFF CLOSE THE PUBLIC HEARING. THANK YOU. SECOND THIS CASTRO VOTES. MOTION PASSES. [Conduct a Public Hearing to Consider/Discuss/Act on a Request to Rezone the Subject Property from “PD” - Planned Development District to “PD” - Planned Development District, Generally to Modify the Development Standards and to Allow for Commercial Uses, Located at 6201 North McDonald Street, and Accompanying Ordinance]

TO CONSIDER AND ACT ON REQUEST TO REZONE SUBJECT PROPERTY FROM PD PLAN DEVELOPMENT DISTRICT TO PLAN DEVELOPMENT DISTRICT GENERALLY TO MODIFY DEVELOPMENT STANDARDS AND TO ALLOW FOR COMMERCIAL USE IS LOCATED AT 62 01 NORTH MCDONALD STREET. THE COMPANIES ORDINANCE. HELLO, JENNIFER. THANK YOU, MR MAYOR. I'M GOING TO BE UP HERE QUITE A BIT TONIGHT. UM SO THIS IS THE FIRST OF OUR SEVERAL REZONING REQUESTS. AS YOU NOTED, THIS IS A REQUEST TO REZONE THE SUBJECT.

PROPERTY FROM PD PLAN DEVELOPMENT DISTRICT TO PD PLAN DEVELOPMENT DISTRICT. THE CORE OF THAT REQUEST IS TO MODIFY THE ALLOWANCE OF VERY SPECIFIC USE. SO WITHIN THE CURRENT PLAN DEVELOPMENT DISTRICT, IT DOES FOLLOW THE CITY'S C THREE COMMERCIAL ZONING WITH THE ALLOWANCE FOR HEAVY EQUIPMENT SALES AND MACHINERY SALES WITH THE REQUEST TONIGHT THE APPLICANT IS PROPOSING TO MODIFY . MODIFY THE USED ALLOWANCES TO REMOVE THE HEAVY EQUIPMENT SALES

[00:50:01]

AND INSTEAD REPLACE THAT WITH WAREHOUSE USES. SO THIS SITE IS ON THE NORTHERN STRETCH OF STATE HIGHWAY FIVE AND AN AREA THAT IS LARGELY AN INCORPORATED BY THE CITY AND UNDEVELOPED WHEN STAFF WAS REVIEWING THE REQUEST. WE NOTE, OF COURSE, THAT CEASED REZONING DISTRICT IS COMMERCIAL, WHICH WOULD ALIGN WITH THE CITY'S COMPREHENSIVE PLAN DESIGNATION FOR THIS AREA OF COMMERCIAL USES. HOWEVER THAT ADDED USE OF WAREHOUSE IS CONSIDERED AN INDUSTRIAL USE.

AND WE DO HAVE CONCERNS THAT THAT DOES NOT ALIGN WITH THE COMPREHENSIVE PLAN, ESPECIALLY IN AN AREA THAT IS LARGELY UNDEVELOPED. SO WITH THAT WE ARE NOT ABLE TO OFFER OUR SUPPORT ON THIS ITEM. HOWEVER, DO YOU WANT TO NOTE THAT PLANNING AND ZONING CONSIDERED THIS ITEM? I'M AT THE LAST MEETING, AND THEY ARE RECOMMENDING APPROVAL WITH THE SEVEN VOTE. I'M HAPPY TO ANSWER ANY QUESTIONS, AND I KNOW OUR APPLICANT IS HERE AS WELL. QUESTIONS FOR JENNIFER. WITH THE APPLICANT COME UP. AND I WILL JUST MAKE NOTE. WHAT YOU'RE ON YOUR WAY UP THAT COUNCILMAN FRANKLIN HAS RECUSED HIMSELF JUST BASED ON A CONNECTION TO THIS PROPERTY. WE'RE FAMILY.

GOOD EVENING MAYOR COUNCIL MATT MOORE, CLAYMORE ENGINEERING 301 SOUTH COLEMAN PROSPER, TEXAS. I THINK JENNIFER DID A PRETTY GOOD JOB OF SUMMARIZING WE ARE SIMPLY TRYING TO ADD A OFFICE WAREHOUSE USE TO THE EXISTING ZONING THAT THEIR TODAY UM. BASICALLY LOOKING AT TRYING TO SERVE CONTRACTORS SERVICE PROVIDERS THAT NEED SMALL AMOUNTS OF OFFICE, WHICH WAS WELL SOME WAREHOUSE USE. EQUIPMENT SUPPLY COMPANY TO THE SOUTH OF US WE FEEL LIKE THE USES STILL APPLICABLE IN THIS AREA OF TOWN AND WE'RE RISK. REQUEST YOUR APPROVAL OF THAT ZONING. I'LL BE HAPPY TO ANSWER ANY QUESTIONS YOU GUYS MIGHT HAVE. QUESTIONS. I REMEMBER RIGHT THAT ON WHAT IS THE NORTH SIDE OF THIS PIECE OF PROPERTY? THERE IS SOME USE THE WORD FLOODPLAIN BUT SOME VERY CHALLENGING PART OF THE LAND OVER THERE FOR DEVELOPMENT. THAT'S CORRECT. WE DO HAVE SOME HEAVILY TREED AREA IN FLOODPLAIN THAT IS BASICALLY TAKING UP A COUPLE OF ACRES OF OUR NORTHERN PIECE. WHICH KIND OF LIMITS OUR ABILITY TO DEVELOP IN THAT AREA AS WELL. AND NONE OF THAT WILL BE DISTURBED. OBVIOUSLY NO, NO, WE'RE NOT WORTH CONCEPT PLAN CONTEMPLATES EVERYTHING SOUTH OF THERE. ANY OTHER QUESTIONS. THANK YOU, SIR. THERE'S A PUBLIC HEARING. IS THERE ANYONE THAT WOULD LIKE TO SPEAK TO THIS ITEM? SURE. SAME FRANKLIN 16 50, WEST VIRGINIA PARKWAY, SUITE 1 10 MCKINNEY, TEXAS, UM, I ACTUALLY REPRESENT THE OWNER OF THE PROPERTY IS KIRBY SMITH MACHINERY. WE WORK WITH THEM ON THEIR OPERATIONS THROUGH TEXAS REAL ESTATE OPERATIONS THROUGH TEXAS. I JUST WANT TO GET UP HERE AND PROVIDE YOU GUYS SOME CONTEXT AND HISTORY ON HOW WE GOT HERE FROM FROM OUR PERSPECTIVE. SO ORIGINALLY IN 2021 THEY HAD THEY HAD STARTED DEVELOPMENT IN THE COUNTY. UM IT GOT SHUT DOWN BECAUSE OF SOME OF THE ANNEXATION ISSUES THAT WERE GOING ON AT THE TIME. THE CITY MCKINNEY SO WE GOT BROUGHT IN AT THAT POINT TO HELP RIGHT? THE SHIP. WE ACTUALLY WORKED WITH SANCHEZ AND ASSOCIATES, WHO WAS THE ORIGINAL ENGINEER TO ANALYZE IT WITH KIRBY SMITH TO FIGURE OUT WHAT'S THE BEST PATH FORWARD . WE DID THAT WE DECIDED. HEY.

HEARING THEIR CONCERNS THAT THEY JUST NEEDED A FOOTPRINT IMMEDIATELY TO SERVICE THEIR NORTH TEXAS SECTOR BECAUSE THEY DON'T HAVE ANYTHING NORTH OF DALLAS DETERMINED. OKAY, LET'S ANNEX INTO THE CITY'S OWN IT AND JUST GET YOUR FOOTPRINT AS QUICK AS POSSIBLE. THE CITY WORKED WITH US VERY WELL, HONESTLY, AND IT HELPED EXPEDITE SOME OF THOSE APPROVALS IN ORDER TO MAKE A LOT OF THAT HAPPENED. UM SO WE ZONE IN ANNEX WE'VE GOT IN NOW, LET'S TOUCH ON THE ZONING THAT WE HAD AT THE TIME WE HAD STAFF SUPPORT ON THE PD. WITH US THE SAME EXACT BASES OWNING. IT'S A C THREE BASE AT THE TIME. WE DID NOT HAVE A HEIGHT RESTRICTION OF 30 FT. SO WE WERE AT 45 FT. WE HAVE REDUCED IT TO 30 IN THE NEW WITH THE NEW APPLICANT. UM BUT WE ALSO CAME FORWARD WITH KIRBY SMITH'S USE, WHICH WAS A HEAVY EQUIPMENT AND STORAGE USE RIGHT NOW. KIRBY SMITH SERVICES, THE OIL, MINING AND EXCAVATION SECTORS. THAT IS THE HEAVIEST EQUIPMENT THAT YOU CAN YOU CAN HAVE IN THOSE SECTORS. THEY HAVE IT. SO FOR THIS SITE, IT WOULD HAVE BEEN 25,000 SQUARE FOOT METAL BUILDING. WITH ALL 77 ACRE CRUSHED GRANITE YARD AND WE WOULD HAVE HAD TRUCKLOADS COMING IN AND OUT, DROPPING UP AND PICKING OFF AND FOUR SERVICE ALL THOSE HEAVY EQUIPMENT. SO WHEN IT COMES TO CURB APPEAL, LET'S JUST TALK ABOUT CURB APPEAL. KIRBY SMITH MACHINERY 25,000 SQUARE FOOT BUILDING, WE WOULD HAVE BEEN IT THE NEW APPLICANTS PROPOSAL TO US WHAT IS A MUCH MORE HAS A LOT MORE CURB APPEAL THAN, SAY, KIRBY SMITH. I LOVE MY CLIENT. THEY'RE GREAT.

THEY'RE GREAT OPERATOR. BUT WHEN IT COMES TO ALL THESE CRANES, EXCAVATORS, DOZERS, IT'S HARD TO SHIELD AND PROVIDE SCREENING TO ALLOW THAT STUFF. SO FROM CURB APPEAL, I THINK THE NEW

[00:55:02]

APPLICANTS PROPOSAL IS A MUCH MORE APPEALING THAN THE CURRENT USE. AND AGAIN KIRBY SMITH TO US AND IN THE HALLS ORDINANCE THAT IS AN INDUSTRIAL USE. SO WE'RE PROPOSING, TAKING IT LESS INTENSE. INDUSTRIAL USE PLUG IN YOUR WORK. KIRBY SMITH WAS GOING TO GO AND AGAIN. WE GOT ALL THE WAY TO POOLS. FULL SITE PLAN APPROVAL. WE'RE ABOUT TO PULL PERMITS AND INTERNALLY WE JUST SAID HEY, WE NEED LARGER SITES FOR KIRBY SMITH. WE'RE GONNA PUT MINING EQUIPMENT ON THIS SITE TO SERVICE THE CHICO AND BRIDGE BOARD OPERATIONS. IT JUST WASN'T BIG ENOUGH. SO ULTIMATELY, WE'RE PROPOSING CHANGING THAT. UM TO THE WAREHOUSE USE AGAIN IS SET EXACT SAME BASED ZONING C THREE WITH THE WAREHOUSE USED INSTEAD OF THE HEAVY EQUIPMENT USE, WE DID HAVE STAFF SUPPORT ON THE ORIGINAL ZONING AGAIN IS VERY, VERY SIMILAR. UM AND THEN AS IT COMES TO TRAFFIC, I DON'T KNOW WHAT THE APPLICANTS USES WILL BE. BUT I WOULD. IN MY OPINION, IT IS VERY HARD TO FIND ANOTHER USER THAT HAS THE SAME TRAFFIC IMPACT AS A KIRBY SMITH MACHINERY. FACILITY YOU HAVE A VERY LARGE TRUCKS COMING IN CONSTANTLY 8 TO 5. PICKING UP AND DROPPING OFF SOME OF THE LARGEST EQUIPMENT THAT YOU CAN IMAGINE SO UM, AGAIN. WE JUST THINK THIS IS A MUCH LESS INTENSIVE INDUSTRIAL USE THAN WHAT WE ARE ABOUT TO PULL PERMITS ON AND WE JUST WE FEEL THE APPLICANT HAS A BETTER USE AND WHEN IT COMES TO COMMERCIAL VIABILITY IN THE SITE AGAIN, WE'RE SEPARATED LIKE COUNCIL, INCLUDING NOTED FROM FLOODPLAIN LARGE CREEK AND WE'RE SURROUNDED ALL SIDES BY STORAGE. SO THAT'S ALL I GOT. I HAVE APPRECIATED WORKING WITH STAFF. THEY'VE BEEN GREAT. HONESTLY, I UNDERSTAND THEIR CONCERNS WITH THE COM PLANTS. SO UM, THAT'S THAT'S ALL I GOT. THANK YOU FOR HEARING ME OUT IN YOUR CONSIDERATION. RIGHT? I DON'T HAVE ANYONE ELSE SIGNED UP TO SPEAK. SO ENTERTAIN A MOTION. AND MAKE A MOTION THAT WE CLOSE THE PUBLIC HEARING AND APPROVED THE ITEM AS PRESENTED. SECOND THIS CAST YOUR VOTES. MOTION PASSES. ITEM 230054 Z

[Conduct a Public Hearing to Consider/Discuss/Act on a Request to Rezone the Subject Property from “PD” - Planned Development District to “PD” - Planned Development District, Generally to Modify the Development Standards and to Allow for Multi-Family Residential Uses, Located on the Southwest Corner of McKinney Ranch Parkway and Collin McKinney Parkway, and Accompanying Ordinance]

FIVE CONNECTED PUBLIC AREA TO CONSIDER AND ACT ON REQUEST TO REZONE SUBJECT PROPERTY FROM PLANNED DEVELOPMENT DISTRICT PLAN DEVELOPMENT DISTRICT GENERAL TO MODIFY DEVELOPMENT STANDARDS TO ALLOW FOR MULTI FAMILY RESIDENTIAL USE IS LOCATED ON THE SOUTHWEST CORNER, MCKINNEY RANCH PARKWAY AND COLLIN MCKINNEY PARKWAY. JENNIFER THANK YOU, MR MAYOR. AS YOU READ. THIS IS A REQUEST TO REASON THE SUBJECT PROPERTY TO ALLOW FOR MULTI FAMILY USES. THE TRACT ITSELF IS ABOUT 18.22 ACRES IN SIZE. YOU KNOW, IT'S JUST NORTH OF 1, 21 AND EAST OF THE EXISTING SD STADIUM, SO THE PROPERTY IS CURRENTLY ZONED PD PLAN DEVELOPMENT DISTRICT, BUT IT HAS A BASE ZONING FOR AGRICULTURAL, UM, USES AND SO WITH THE REQUEST, THE APPLICANT IS PROPOSING TO ALLOW FOR THE DEVELOPMENT OF A MULTI FAMILY. UM PROJECT AND THEY ARE HAD ORIGINALLY REQUESTED FOR A NUMBER OF MODIFICATIONS TO OUR STANDARD MULTI FAMILY REQUIREMENTS WITHIN YOUR PACKET. WE DO HAVE THAT ORIGINAL STAFF REPORT FROM THE FIRST PLANNING AND ZONING COMMISSION MEETING THAT AND THIS WAS CONSIDERED AT IN ADDITION TO THE ABUSES, OF COURSE, SOME OF THE MODIFICATIONS THAT THEY WERE REQUESTING WHAT THEIR ZONING HAD TO DO WITH MODIFICATIONS TO THE TYPICAL SCREENING REQUIREMENTS ON THE PROPERTY INCREASES IN DENSITY AND REDUCTIONS IN TYPICAL PARKING STANDARDS. DURING THAT PLANNING AND ZONING COMMISSION MEETING, THERE WAS A LOT OF DISCUSSION ABOUT SOME OF THOSE CHANGES. THEY TABLED THE ITEM, THE APPLICANT CAME BACK AND HAS HAD A MODIFIED REQUEST THAT WAS ULTIMATELY GIVEN A FAVORABLE RECOMMENDATION BY THE PLANNING AND ZONING COMMISSION. SO A LITTLE BIT OF HISTORY ON HOW WE GOT TO THE REQUEST. THAT'S BEFORE YOU TODAY, BUT I DO WANT TO OUTLINE THAT WHAT THEY'RE SEEKING TONIGHT THE PREDOMINANT CHANGE THAT THEY ARE LOOKING FOR WILL BE BACK UP.

WHAT THEY'RE ASKING FOR IS SHE WILL LAUGH FOR MULTI FAMILY, UM, USES TO BE PERMITTED ON THE PROPERTY. THEY ARE NOW PROPOSING TO MEET THE TYPICAL SCREENING REQUIREMENTS. THEY'RE ACTUALLY PROPOSING SOME ENHANCED SCREENING ALONG THE EASTERN STRUCTURE OF THE PROPERTY. AND THEY ARE PROPOSING TO INCLUDE A MAXIMUM UNIT COUNT ACROSS THE ENTIRETY OF THE PROPERTY OF 385 UNITS, AND THEY ARE STILL REQUESTING THE PARKING RATIO TO BE MODIFIED SO THAT PARKING RATIO FOR MULTI FAMILY UNITS UNITS WOULD TYPICALLY BE TWO SPACES PER DWELLING UNITS. THEY ARE PROPOSING 1.6 SPACES PER DWELLING UNIT ON THE PROPERTY, AND THE APPLICANT HAS A FULL PRESENTATION. THEY CAN WALK YOU THROUGH SOME OF THE SPECIFICS OF THE PROJECT, BUT THOSE THROUGH THE KEY ELEMENTS THAT WE WERE LOOKING AT AS A STAFF ONE EVALUATING THE REQUEST. SO WHEN WE DO LOOK AT THE REQUEST THEY ARE PROPOSING MULTI FAMILY USES. WE NOTE THAT THE COMPREHENSIVE

[01:00:01]

PLAN FOR THIS AREA IS FOR ENTERTAINMENT CENTER USES, WHICH COULD ALLOW FOR RESIDENTIAL USES, BUT BY AND LARGEST AIMED AT CAPTURING COMMERCIAL OPPORTUNITIES. WE NOTED THAT THERE WAS ALREADY A LOT OF MULTI FAMILY USES IN AND AROUND THIS AREA. AND FOR THAT REASON WE WERE DID NOT FEEL THAT IT WAS IN COMPLIANCE OR CONFORMANCE WITH THAT PLACE TYPE DESIGNATION. AND THEN OF COURSE, WE DO HAVE CONCERNS WITH THE PROPOSED PARKING BEING PROVIDED BY THE APPLICANT KNOWING THAT THE PARKING STANDARD THAT WE HAVE IN MCKINNEY IS RELATIVELY NEW WITH THE NEW UDC. SO WITH THAT, AS A STAFF, WE WERE NOT ABLE TO OFFER A FAVORABLE RECOMMENDATION.

HOWEVER PLANNING AND ZONING DID AND A 61 VOTE. UM THINK I COVERED EVERYTHING I WANT TO MAKE SURE I DIDN'T MISS ANYTHING. UM WITH THAT I'M HAPPY TO ANSWER ANY QUESTIONS THAT YOU ALL HAVE. AND AGAIN, THE APPLICANT IS HERE AS WELL. SO GENERAL, LET ME ASK YOU A FEW QUESTIONS THERE IS THAT DROVE THE SITE. OVER THE WEEKEND. THERE'S NOT ACCESS OR WILL THERE BE ACCESS FROM 1 21? IT DIDN'T APPEAR THAT THERE COULD BE ACCESS. DON'T SO I DON'T KNOW WHAT THE THERE COULD BE. I DON'T KNOW WHAT THE ACCESS POINTS ARE. IF YOU'LL RECALL, WE HAVE REZONING JUST A FEW MONTHS AGO FOR THIS TRACK HERE. AND SO I THINK SOME OF THE ACCESS WILL DEPEND ON HOW MANY ACCESS POINTS THEY HAVE ON THIS PROJECT COMING OFF OF 1 21, BUT I WILL NOTE THAT COLLIN MCKINNEY IS GOING TO COME UP THIS WAY. THERE WILL OBVIOUSLY BE THAT CONNECTION THROUGH THERE. IS THAT STORAGE IN ITSELF? LET'S DOWN THERE ON THE SOUTH. THAT IS THE ENCORE SUBSTATION SUBSTATION SUBSTATION . THERE'S THE WATER OR THE TANKS TO THE NORTH OF IT. SO THIS ENTIRE THING IS ACTUALLY ENCORE, AND THERE'S THIS SUBSTATION ITSELF. SO THIS IS OWNED BY ENCORE THIS PORTION HERE JUST TO THE WEST OF IT, BUT IT IS ZONED FOR COMMERCIAL USES. UM WE DON'T KNOW WHAT WILL ULTIMATELY HAPPEN WITH THAT TRACK THERE. RIGHT THE APPLICANT HERE LIKE TO COME UP.

MR MAYOR COUNCIL. MY NAME'S BILL DOLLS FROM 23 23. ROSS 71. I'M HERE REPRESENTING ADAM HARRISON COMPANY. I APPRECIATE THE OPPORTUNITY TO COME SPEAK FOR YOU TONIGHT. THIS IS AN INTERESTING SIGHT. IT IS SEPARATED. PHYSICALLY BY A LOT OF DIFFERENT ROADS, DRAINAGE WAYS. IT DOES NOT REALLY RELATE TO THE ENTERTAINMENT CENTER. WITH THAT CONTEMPLATED UNDER THE COMPREHENSIVE PLAN, BUT AS JENNIFER SAID, SHE TOOK A LOT OF MY PRESENTATION. INCIDENTALLY THE ENTERTAINMENT CENTER DOES SUPPORT THE PRESIDENTIAL. I THINK THIS IS A VERY TELLING GRAPHIC. UH MCKINNEY PARKWAY IS TO THE NORTH. THE COLLIN MCKINNEY EXTENSION IS THE ORANGE STRIPE GOING RIGHT THROUGH THE MIDDLE OF THIS PROPERTY, AND YOU CAN SEE THE BLUE BULBS SLOAN CREEK GOING NORTHWEST TO SOUTHEAST. THERE'S NO WAY WE COULD ACCESS 1 21. IT'S GOING TO BE VERY, VERY DIFFICULT. AND I THINK WHAT ELSE IS TELLING US ON THE WEST SIDE? WE DO HAVE THE ENCORE PROPERTY. THE ENCORE SUBSTATION AT THE SOUTH. WE'VE GOT AN ODD CORE MAJOR TRANSMISSION LINE CORRIDOR ON THE EASTERN SIDE AND THAT THE WATER TANKS TO THE NORTH, SO THIS REALLY DOESN'T RELATE AS MUCH TO 1 21 AND THE ENTERTAINMENT CENTER AS IT DOES TO WHAT'S HAPPENING IN THE AREA AND THE GENERAL LAND USE PATTERN IN THE AREA IS RESIDENTIAL, MULTI FAMILY. WE THINK FROM A LAND USE PERSPECTIVE, THIS MAKES ALL THE SENSE IN THE WORLD TO COME IN WITH A LAND USE A MULTI FAMILY APPLICATION. I ALSO WANTED TO. IT'S GOING TO EMPHASIZE THE NUMBER OF YEARS AND THERE WAS SOME CONFUSION AT THE COMMISSION. WE DID. ACTUALLY TAKE A STEP BACK FROM OUR FIRST COMMISSION HEARING MADE SOME MODIFICATIONS CLARIFIED SOMETHING AS WELL. WE WERE PROPOSING 385 MINUTES FROM DAY ONE. BUT BECAUSE OF THE WAY WE CALCULATE DENSITY IF YOU DO IT ON A UNIT PER ACRE IT. IT WAS BECAUSE WE'RE PUTTING EVERYTHING ON THE NORTH SIDE WE HAD TO DO ARE USED BREAKER ON THE NORTH SIDE. WHAT WE'RE PROPOSING RIGHT NOW IS AGAIN JUST CAPPING IT AT 385 UNITS FOR THE ENTIRE 18.2 ACRES, SO THERE WILL BE NO MORE MULTI FAMILY. KEVIN KUNZ WITH HELEN HARRISON IS HERE ALSO WOULD LIKE TO SAY A FEW WORDS, BUT AGAIN REALLY APPRECIATE THE OPPORTUNITY TO COME AND SPEAK. BEFORE YOU. THANKS BILL. GOOD EVENING. MY NAME IS KEVIN KUNZ HERE, REPRESENTING ALAN HARRISON COMPANY OR THE OWNER, DEVELOPER AND GENERAL CONTRACTOR. FOR THIS PROJECT SO BETWEEN JENNIFER AND BILL, THEY DID A LOT OF WHAT I

[01:05:02]

WAS GONNA SPEAK TO YOU GUYS ABOUT TONIGHT, BUT UM, BUT I DO WANT TO KIND OF EMPHASIZE IS YOU KNOW THIS SLIDE HERE KIND OF OUTLINES THE VARIANCES THAT WE'RE LOOKING FOR AS PART OF THIS P D. WE UNDERSTAND THERE'S A PRIORITY IN THE CITY TO ADHERE TO THAT MF 30 BASE OWNING AS CLOSELY AS POSSIBLE, SO WE REALLY TRIED TO KEEP THAT IN MIND AND KEEP THIS PD AS CLOSE AS POSSIBLE TO THAT MF 30 BASE OWNING SO REALLY THE VARIANCES THAT WE'RE REQUESTING HERE ARE ON THE DENSITY, WHICH IS DRIVEN AGAIN BY KIND OF THE PLANTING OF EARTH. THE BUILDING OF COLIN MCKINNEY ROAD AND THE SUBSEQUENT PLANNING OF THE PROPERTY AND THEN THE PARKING AGAIN, YOU KNOW? WE SAW THE SITE CONSTRAINTS ON THE PREVIOUS SLIDE. YOU KNOW, 1.6 IS WHAT WE'VE SEEN WORK AT OUR PROJECTS AROUND TEXAS. YOU KNOW IT. LIMITS RESIDENT COMPLAINTS PROVIDES AN APPROPRIATE AMOUNT OF CONVENIENCE, BUT IT ALSO GIVES US SOME FLEXIBILITY TO WORK AROUND THOSE SEIKEN STRAINS AND ULTIMATELY, YOU KNOW, DESIGN A SITE PLAN THAT THAT MAXIMIZES AMENITIES FOR RESIDENTS IN LIMITS THAT INCONVENIENCE SO UM. JENNIFER TOUCHED ON IT. BUT YOU KNOW, WE DID REMOVE THE PERIMETER, FENCING AND MEDIAN REQUIRE HER VARIANCES THAT WE HAVE BEEN REQUESTING AND THEN ADDED THIS ENHANCED SCREENING ALONG COLLIN MCKINNEY PARKWAY, SO YOU KNOW WHAT? WHAT WE'VE SHOWN HERE. THIS IS A KIND OF DEPICTION OF WHAT THAT SCREENING ZONING REQUIREMENT IS, BUT I THINK MORE IMPORTANTLY, WE PULLED THIS PICTURE FROM ANOTHER PROJECT DESIGNED BY OUR LANDSCAPE ARCHITECT. BUT WE THINK IT DOES A PRETTY GOOD JOB.

IT'S PRETTY CLOSE TO WHAT THESE ZONING STANDARDS ARE GOING TO LOOK LIKE ONCE THEY'RE BUILT, SO YOU'LL SEE THAT YOU KNOW, WITH THE TREES AND THE FENCING AND THE ADDITIONAL SHRUBS AND LANDSCAPING THERE THAT YOU'RE REALLY NOT GETTING MUCH VISIBILITY INTO THE SITE FROM THE STREET. YOU'RE REALLY LIMITING. KIND OF THE VISIBILITY OF THE PARKING THE BUILDINGS, YOU KNOW, IN COMBINATION WITH THE MASONRY WALL ON THE WEST SIDE, AND THE BUILDINGS PUSHED UP ALONG MCKINNEY RANCH PARKWAY. YOU'RE REALLY KIND OF INSULATING , AND, UH, YOU KNOW, HELPING TO SHIELD THE VIEW THERE. UM. THE OTHER THING YOU KNOW, I WAS GOING TO TOUCH ON IS, UH, YOU KNOW, I KNOW STAFF HAS INDICATED THEIR PREFERENCE AND WE UNDERSTAND THEIR PREFERENCE FOR COMMERCIAL DEVELOPMENT. BUT YOU KNOW, WE'VE REALLY SEEN SOME OF THE NEW RETAIL IN THE AREA STRUGGLING. THERE'S A ABOUT 23,000 SQUARE FEET OF RETAIL SPACE ON THE CORNER THERE OF MCKINNEY RANCH AND HARDEN. UM THEY'VE BEEN TRYING TO LEASE IT FOR THE PAST THREE YEARS, AND, UM, IT'S STILL LARGELY BACON TO THIS TO THIS TO THIS DAY IN IN THE FEEDBACK IS GENERALLY BEEN THAT YOU KNOW, THERE'S JUST NOT ENOUGH TRAFFIC IN THIS AREA TO SUPPORT COMMERCIAL AND SO YOU KNOW, WE DUG IN A LITTLE DEEPER. WE LOOKED AT SOME OF THE SURROUNDING PARCELS AND FOUND THAT YOU KNOW, THERE'S ALREADY OVER 70 ACRES OF VACANT LAND WITH EXISTING COMMERCIAL ZONING IN PLACE AND ARE THOUGHT IS THAT YOU KNOW, BY PROVIDING THESE ADDITIONAL RESIDENTIAL USES IN THIS AREA, WE CAN HELP TO INCREASE THE TRAFFIC AND HOPEFULLY SUPPORT THE DEVELOPMENT FOR THE FUTURE DEVELOPMENT OF THESE COMMERCIAL. PARCELS. IN THE FUTURE, SO.

LASTLY, JUST BEFORE I WRAP UP. YOU KNOW, OUR SITE PLAN DOESN'T REALLY GIVE ANY CONTEXT ON QUALITY OR DESIGN. AND SO I JUST WANTED TO QUICKLY HIGHLIGHT SOME OF THE AMENITIES THAT WE'RE PROPOSING. AS PART OF THIS PROJECT WON'T LIST THESE INDIVIDUALLY, BUT. THESE ARE SOME IMAGES FROM OUR PAST PROJECTS THAT DO A GOOD JOB OF HIGHLIGHTING THE LEVEL OF QUALITY IN KIND OF ILLUSTRATE THAT THIS IS GOING TO BE A TRULY LUXURY DEVELOPMENT THAT THAT STANDS OUT FROM WHAT'S CURRENTLY AVAILABLE IN THE AREA. YOU KNOW, WE'RE WE'RE ULTIMATELY GOING TO BUILD SOMETHING THAT TIES INTO THE CHARACTER OF THE NEIGHBORHOOD. UM YOU KNOW, BUT BUT REALLY STANDS APART IN TERMS OF THE AMENITIES IN QUALITY OF WHAT'S CURRENTLY AVAILABLE, SO AH, THAT'S ALL. I'VE GOT LOVE TO ANSWER ANY QUESTIONS THAT YOU WILL HAVE HOW MANY OF THESE UNITS OR DEDICATED TO THE MCKINNEY AFFORDABLE HOUSING INITIATIVE. AH NONE OF THE UNITS HAS THIS. THANK YOU. QUESTION ABOUT. YOU KNOW WHAT? WE'RE COLLIN MCKINNEY PARKWAY GALS UP AND HITS MCKINNEY RANCH PARK WIDE, BUT IT'S OFF YOUR PROPERTY, CORRECT. WHOSE WHOSE PROPERTY IS THAT AND ARE THEY RESPONSIBLE FOR PUTTING IN THAT PORTION OF NO THAT IS ACTUALLY OWNED BY THE SANCHEZ GROUP, THE GROUP THAT REZONED THAT PROPERTY ALONG THE FRONTAGE THE RIGHT OF WAY, IS ALREADY DEDICATED ON THAT ON THAT PIECE, AND THAT WILL BE DEVELOPED BY US AS PART OF THIS DEVELOPMENT. QUESTIONS. THANK YOU. PUBLIC HEARING. I WOULD LIKE TO SPEAK TO THIS. MR

[01:10:10]

MAYOR REMEMBERS THE COUNCIL MARTIN SANCHEZ TO 10 ADRIATIC PARKWAY SUITE 200. THAT'S THE FIRST TIME WHEN WE WILL BE ABLE TO SAY THAT SO THANK YOU VERY MUCH. I WAS HERE FOR SOMETHING ELSE BUT TO SOME HERE CAN I SEE THE AERIAL JUST THE STAFF'S AREA JUST TO CLARIFY A COUPLE OF ITEMS. AH MR CASTLE AND FRANKLIN. THANK YOU. ASKED A FANTASTIC QUESTION RELATIVE TO WHAT'S GOING ON IN THE AREA WITH COMIC A PARKWAY. IF YOU RECALL, UH, WILSHIRE AND I SET THE ALIGNMENT FOR CMP A LONG TIME AGO, AND WE'VE BEEN BUILDING IT IN PIECES AND SOME PLACES WE GOT IT ABSOLUTELY DEAD ON RIGHT IN SOME PLACES. WELL WE CAN ALWAYS DO BETTER RIGHT AND THAT'S ONE OF THE AREAS WHEN WE DEVELOPED THIS, AND HERE WE HAD THE HIGH POWER LINES THAT RAN THROUGH HERE THAT REALLY NOBODY HAD EVER THOUGHT ABOUT WHAT WAS GOING TO HAPPEN, SO WE ENDED UP DEDICATING THE RIGHT OF WAY FOR FUTURE CMP, EVEN THOUGH WE DIDN'T HAVE ANY OBLIGATION EIGHT TO DO SO OR BE TO BUILD IT, BUT WE WENT AHEAD AND DID IT BECAUSE THE POWER LINES CREATE THIS KENYAN EFFECT. IN FACT, UH, YOUR APPLICANT TODAY AS APPROACHED US A WHILE BACK, AND WE TALKED A LITTLE BIT ABOUT IT. THERE ARE SOME NO MAN'S LAND TRIANGLES THERE AND HERE AS WELL THAT WE DIDN'T EVEN REALIZE THAT WE OWNED BUT APPARENTLY WE DO SO WE'VE BEEN WORKING WITH THEM TO SAY, HEY, LET'S CLEAN UP ALL THESE LITTLE BITTY TRIANGLES. MR HAUSER. WE DID NOT DO IT ON PURPOSE. THEY ARE THERE, BUT WE ARE CLEANING IT UP AND I THINK ULTIMATELY, WHAT THEY WANT TO DO IS A GOOD IDEA. INTAKE CMP AND KIND OF BEND IT A LITTLE FURTHER DOWN FROM THAT PERSPECTIVE, WHICH MAKES THAT PARTIAL A LITTLE MORE USABLE. AH IN THAT, REALLY, SO FROM OUR PERSPECTIVE.

WE ARE ABSOLUTELY 100% SUPPORTED . I MEAN, THIS MAKES SENSE. IT'S A TOUGH CORNER. IT'S A TOUGH SIDE. RICHARD FAGAN OWNS THE PROPERTIES OVER HERE AND THOSE WHO ARE COMMERCIAL AND QUESTIONED THE VIABILITY OF THOSE WHETHER THEY'LL EVER BE COMMERCIAL. CMP JUST DOESN'T CARRY THAT KIND OF TRAFFIC. ETCETERA IT'S TOUGH TO FIND WHAT LAND USE WILL ACTUALLY WORK. BUT SINCE YOU ASKED THE QUESTION, I THOUGHT I DIDN'T WOULD ANSWER FOR YOU. SO THANK YOU. YES, SIR.

YES THE APPLICANT QUESTION AGAIN VALUE OF THIS PROJECT. I MEAN, 185 UNITS. HOW MUCH A KEY IT'S VALUED AROUND ABOUT $90 MILLION IS KIND OF THE FINAL PRICE. UM AROUND 260,000 PER PER UNIT.

WHAT WE'RE LOOKING AT WHAT IS YOUR MIX IN TERMS OF 123 BEDROOM STUDIO? WHAT'S YOUR MIX? WE'RE LOOKING AT AROUND, YOU KNOW 60% ONES 35% TWOS AND 5% 3 BEDROOMS. THANK YOU. THANKS, SIR. HMM. SO.

EMOTIONAL CLOSE TO PUBLIC HEARING A COMMOTION WE CLOSE THE PUBLIC HEARING. CASTRO. IT'S.

I DON'T WANT TO CAUSE A PUBLIC HEARING. I DON'T KNOW. TOO CLOSE TO THE ALRIGHT OKAY. ALRIGHT KEEP IT OPEN C. YOU HAD A QUESTION, BUT I CAN WE CAN TALK WE CAN GET PAST WAS JUST A QUESTION. IT LOOKS LIKE THEY WERE WATER TOWER LIKE WATER. UM, INNOVATIVE, SO LIKE MY GUESS IS ON MY EVENT TO THE WEST OF THAT THERE WAS AN OPEN AREA IS THAT DUMB COMMERCIAL TOURS THAT MULTIPLY THAT ZONE RESIDENTIAL COMMERCIAL SOUND BY ENCORE BETWEEN THEM AND THE STADIUM? YOU'RE TALKING ABOUT THAT LITTLE STRIP FOR NO THERE NORTH OF THERE. THERE IS PEOPLE THEM UP BACK TO BACK ON NORTH. YOU HAVE THE WATER. A G READ WHAT YOU'RE ASKING, AND SO TO THE WEST OF THAT THE HOUSE IS TO THE NORTH. SO IS IT RESIDENTIAL SOUTH OF THAT ALSO YOU'RE TALKING ABOUT.

I JUST WANNA MAKE SURE. YEAH RIGHT. YEAH I BELIEVE THAT THAT IT'S PD. I BELIEVE THAT THAT IS ZONED COMMERCIAL. UM, ALSO USES YES. THAT'S THE BORING RESIDENTS . I APOLOGIZE FOR ITS SPEEDY BUT ALLOWS FOR A SINGLE FAMILY. THE ONE NEXT TO IT TO THE WORLD. THE NEXT OR THE ONE IS, I BELIEVE IS

[01:15:01]

MULTI FAMILY FAMILY WAS JUST RECENTLY APPROVED. MULTI FAMILY THERE ALREADY, RIGHT? MULTI FAMILY. YEP. IMPRESS HER TO NUTRIAS. WE HAVEN'T WE ACTUALLY INCLUDED IN EXHIBIT AS AN ATTACHMENT OF THE EXISTING AND APPROVED MULTI FAMILY WITHIN A HALF MILE AND MILE OF HERE. IT SHOULD BE RIGHT THERE IN THE RIGHT THERE. THAT'S THE VERY LAST THING SEEMS LIKE A LOT.

YEAH. IT'S ALL RIGHT. DO YOU REMEMBER HOW MANY UNITS WE APPROVED FOR THIS ONE? NUMBER SIX NUMBER SIX DENSITY THERE. THERE YES, 328 UNITS. AND THE. ONE FOR NUMBER EIGHT. NUMBER EIGHT IS WE ONLY HAVE ENTITLEMENTS FOR A NUMBER A LET ME SEE WHERE THAT ONE IS.

REMEMBER YES, LARGE IT IS. I DON'T KNOW THAT WE HAVE. YEAH WE DON'T HAVE A NUMBER OF UNITS.

THERE'S NO CAPS ON THAT, MARTIN. YOU REMEMBER WHAT THE DENSITY WAS? MARTIN, GO. SIX STORIES.

STORIES. YEAH. I WANT TO LIKE. HOW MANY YEARS HOW MANY 60? THIS IS WHY I HAVE THEM HERE TONIGHT.

60 UNITS TO THE ACRE ON THAT ONE. AND HOW MANY ACRES DO WE KNOW THE TOTAL THE TOY JUST TWO SECONDS TO PULL UP MY CALCULATE WHAT? WHAT ARE THE NUMBER OF NEW UNITS THAT WERE BRINGING RIGHT TO THAT CORNER? SO UM, WE DON'T HAVE MY PHONE. I DON'T HAVE MY PHONE. I CAN CALCULATE IT REAL QUICK. LET'S SEE. OH, NO, WE HAVE 4 50. ARE YOU WANTING? DOCTOR FELT WANTING TO KNOW NEWLY ENTITLED THAT WERE EXPECTED. SO WHAT'S AT 3 28 PLUS 1 20 SO 4 50 PLUS WHAT MAY HAPPEN ON NUMBER EIGHT. WHICH HOW MANY UNITS WOULD YOU EXPECT ON THAT ONE? CASEY. I'M SURE I HAVE TO GO UNCHECKED. YEAH NO ONE'S TOUGH BECAUSE WE'VE ONLY GOT ZONING IN PLACE, SO THERE'S NOT BEEN ANY LEVEL OF SITE PLANNING DONE TO GET AN ESTIMATION AND I WOULD BE HESITANT TO JUST DO A PURE CALCULATION BECAUSE IT DOESN'T TAKE INTO ACCOUNT CERTAIN EFFICIENCIES FOR THINGS LIKE PARKING AND LANDSCAPING BUFFERS, SO I THINK WOULD BE HIGH IF WE JUST RAN A CALCULATION. I FULLY UNDERSTAND THAT THIS IS A CHALLENGING PIECE OF REAL ESTATE . IT WAS CHALLENGING THE DAY YOU BOUGHT IT IN. MY STRONG GUESTS IS NOT KNOWN YOU FELLAS ANY BETTER THAN I DO THAT YOU BEAT THE SELLER DOWN OR WHOEVER BEAT THE SELLER DOWN BECAUSE OF ALL THE CHALLENGES ON IT. I GET IT. IT'S TOUGH. UM BUT WE HAVE A TON OF MULTI FAMILY THERE ALREADY.

THE. I WOULD RATHER WAIT TO SEE WHAT COMMERCIAL CAN COME. I DON'T SEE ANYTHING SPECIAL ABOUT A SURFACE PARKING FOUR STORIES STICK APARTMENT BUILDING. THE THING THAT REALLY BUGS ME, THOUGH, IS THE PARKING VARIANTS TO 1.6. UH IN THE LAST YEAR, SO WE, SOME NEW APARTMENTS OPENED UP CALLED THE TERRACE AND THERE IT WILSON CREEK AND ROCK HILL. LET'S ALL IMAGINE THAT THAT'S ON THE EAST SIDE OF 75. KIND OF THE CORNERS THERE ON THE SOUTH WEST CORNER. WE'VE GOT HONDA CARS IN MCKINNEY NORTHWEST CORNER. WE HAVE WHAT I BELIEVE IS A BEST WESTERN. ON THE NORTHEAST CORNER . WE HAVE SOME LEGACY APARTMENTS AND THEN THIS USED TO BE LIKE A THICK, WOODED AREA. YOU HAVE CARS PARKED ALL OVER THE STREET THERE. NO, I DON'T KNOW WHAT THE RATIO FOR PARKING WAS. BUT WHAT I DO KNOW IS THAT I HAVE NO APPETITE TO REALLY APPROVE ANY MORE MULTI FAMILY HERE, BUT CERTAINLY NOT WITH ANY KIND OF PARKING VARIANTS. IT'S GOING TO POTENTIALLY DISTURB THE STREETS LIKE THAT ONE DOES. WE'RE TALKING ABOUT 60% BEING ONE BEDROOM. YOU HAVE A DECENT SHOT OF HAVING ONE CARD. ONE BEDROOM, TWO BEDROOMS. I THINK YOU'VE GOT A VERY POOR SHOT OF HAVING ONE CAR. THREE BEDROOMS. NONE THEN YOU'VE GOT GUESTS AND STUFF LIKE THAT. I SEE NOTHING BUT A PROBLEM HERE IF WE'RE GOING TO LOOK AT INCORPORATING MORE MULTIFAMILY AND HERE, THE THING THAT RESONATES WITH THE ONE THAT MR SANCHEZ APPLIED FOR WAS THAT WAS A REAL WONKY PIECE OF REAL ESTATE, STRUCTURED PARKING GOING IN THERE THAT WAS GOING TO BLOCK THE VIEW OF THE SURFACE PARKING FOR THE STUFF THAT'S OVER THERE BEHIND IT. UM I WOULD LOVE TO SEE SOME KIND OF RESIDENTIAL HERE THAT IS FOR OWNER NOT MULTI FAMILY FOR RENT, NOT A STICK APARTMENT, BUILDING THE SURFACE

[01:20:02]

PARKING, SO I'M GOING TO BE A NO. HOW. KIND OF JUMP IN HERE. AND I'M VERY FAMILIAR WITH THIS AREA. I SOLD TWO TRACKS RIGHT ACROSS THE STREET, WHICH ARE NOW STILL VACANT. RIGHT THERE. THE TWO CORNERS THAT ARE COLUMN MAKE ANY PARKWAY AND MCKINNEY RANCH PARKWAY. ALSO SO THE PROPERTY DOWN THE STREET, WHICH WAS 4.5 ACRES STILL VACANT. UM THIS IS JUST A PIECE THAT I DON'T KNOW WHAT YOU DO WITH IT RETAILS, NOT THE ANSWER. IT'S ALMOST MID BLOCK RETAIL AND I KNOW WHAT THE SITUATION IS. YOU'VE GOT A ROAD DUMPING INTO 1 21. WE CAN GO ONLY GOING ONE DIRECTION. SO THE ACCESS IN AND OUT OR IS REALLY TOUGH. UM SO I DON'T KNOW WHAT YOU DO WITH IT. IF YOU DON'T DO MULTIFAMILY, I WOULDN'T WANT TO LIVE IN A HOUSE WHEN I'M BACKING UP TO A ELECTRIC TRANSPORT STATION ACROSS THE STREET FROM TWO STORAGE TANKS NEXT TO THE FOOTBALL STADIUM WITH LIGHTS.

AND NEXT TO HOW MUCH OF OTHER MULTI FAMILY SO I DON'T KNOW WHAT YOU DO WITH IT, SO I'M IN FAVOR OF THE PROJECT. UM. I'M PROBABLY IN LINE WITH WHAT RICK'S TALKING ABOUT. I DON'T THINK IT'S GOING TO BE VIABLE AS A COMMERCIAL SITE. AND SO THAT LEAVES ME LOOKING AT SOME SORT OF RESIDENTIAL AND YOU ALL KNOW THAT I'VE DENSITY DOESN'T SCARE ME. I AGREE WITH WHAT PATRICK IS SAYING. IN THAT I WOULD LOVE IF WE COULD FIND MORE WAYS TO GET FOUR OWNERSHIP RESIDENTIAL BUT WHETHER WE TRY TO INCENTIVIZE THAT THROUGH. AND WE BRING JENNIFER BACK UP HERE AND TALK ABOUT WAYS THAT WE CAN IMPROVE OUR DENSE RESIDENTIAL OWNERSHIP. ZONING ALLOWANCES THAT WE CAN FIND WAYS TO INCENTIVIZE. PROPERTY OWNERS TO DO MORE OF THAT, BECAUSE I THINK WE NEED MORE OF IT. UM OR IF WE CARRY A STICK AND SAY WE'RE NOT GOING TO ZONE THIS IS MULTI FAMILY AND WE'RE GOING TO HOLD OUT FOR SOME SORT OF FOUR OWNERSHIP RESIDENTIAL. BUT I THINK IF WE HOLD OUT, WE'RE JUST LEAVING AN EMPTY CORNER HERE. AND THE CONSEQUENCE OF THAT FOR ME IS THAT COLLIN MCKINNEY PARKWAY DOESN'T GET FINISHED FOR A LONG, LONG PERIOD OF TIME, AND I AGREE WITH WHAT RICK SAYING. AND I REGRET SOME VOTES HAVE MADE IN THE PAST WHERE MAYBE WE COULD HAVE RESTRICTED PEOPLE, UM OR PROPERTIES FROM, UM, BECOMING MULTI FAMILY THAT WE COULD HAVE GOT SOME OWNERSHIP. BUT I THINK THIS LOCATION IS PRIME FOR MULTI FAMILY RENTAL PRODUCT. UM I WOULD LIKE TO SEE A BETTER PARKING RATIO. I AGREE WITH PATRICK ON THAT, UM I THINK THE UNIT MIXES IS NOT IDEAL. I THINK WE NEED TO FIND WAYS TO GET MORE TWO AND THREE. BEDROOM UNITS IN THIS CITY BECAUSE WE'RE GOING TO END UP WITH A LOT OF ONE BEDROOM ALONG THIS CORRIDOR. AND, UM SO I WOULD LIKE TO FIND BETTER WAYS TO DO THAT, AND I DON'T WANT TO GIVE ON PARKING RATIO BECAUSE WE'RE GOING TO GET A BUNCH OF ONE BEDROOM, BUT I'M FINE WITH THE I GUESS I MAYBE I SHOULD QUALIFY THAT AS SAYING. I WOULD PREFER NOT TO GIVE THE PARKING RATIO VARIANTS. AND MAYBE THAT.

MAYBE THAT ENDS UP BEING THAT WE STILL GET THE BUNCH OF ONE BEDROOMS IN THE UNIT MIX, BUT LIKE TO SEE A LITTLE BIT BETTER UNIT MIXING THAT, BUT I'M NOT GOING TO GIVE UP A PARKING RATIO TO GET THAT, BUT I'M FINE WITH THE REQUEST. UM EXACTLY WHERE YOU ARE. I MEAN, IT'S SOUNDS GREAT TO SAY THAT COMMERCIAL AND PART OF THE ENTERTAINMENT DISTRICT BUT AS STATED, IT'S NEXT TO A SUBSTATION, A FOOTBALL STADIUM WATER TANKS. UM NO REAL ACCESS. UH FOR THE TYPE OF USE THAT WE WOULD HOPE FOR. UM AS PART OF THE QUOTE ENTERTAINMENT DISTRICT I LOVE $90 MILLION ABOUT LAUREN VALUE ON 10 ACRES. WE'RE NOT GOING TO SEE THAT WITH VIRTUALLY ANYTHING ELSE. BUT I THE PARKING LIKE I CAN'T GET PAST THE PARKING VARIANTS. I SUPPORT THE I WOULD BE SUPPORTING IT. UM BASED ON RESTRICTIVE USES AND VALUE THAT WILL PUT THERE IN THE COMPLETION OF THE COLLIN MCKINNEY PARKWAY. BUT I DON'T 1.6 VARIANTS ON PARKING IS SOMETHING THAT I CAN'T LIVE WITH. ALRIGHT CAN'T AGREE WITH YOU MORE ON THE PARKING SITUATION. I THINK I JUST LOOK AT THIS ENTIRE CORRIDOR AND IT LOOKS LIKE A LITTLE APARTMENT CITY THAT'S DEVELOPING RIGHT THERE. MY CONCERN, TOO, IS NOT JUST THE. VERY, VERY DENSE DEVELOPMENT.

THAT'S GOING TO HAPPEN AT NUMBER EIGHT. UM BUT ALSO. YOU KNOW THE APPROVAL OF THIS THIS, UM I ITEM

[01:25:02]

. WOULD EVENTUALLY LEAD TO EVERYTHING NORTH OF THAT. ALSO BEING MULTI FAMILY. SO YOU KNOW, I'M LOOKING AT THIS, AND SO IF WE DO APPROVE THAT NOTHING ELSE FITS FOR ANYTHING OVER THERE.

BUT MULTI FAMILY AND I AM CONCERNED ABOUT THE AMOUNT OF DENSITY THAT IS JUST VERY FOCAL IN THIS AREA. UM YOU KNOW, I. I DON'T LOVE THE IDEA OF 60% 1 BEDROOM EITHER. I WOULD LOVE TO WAIT TO SEE IF WE CAN PUT HIGHER DENSITY FOR SALE PRODUCT THERE INSTEAD OF DOING APARTMENTS FOR SALE. I MEAN, I'D RATHER WAIT AND SEE AND SEE IF WE CAN WORK ON INCENTIVIZING DEVELOPMENTS WHERE WE CAN HAVE MORE FOR PRODUCT. UM HOUSING. SO I'M NOT I'M NOT A REALLY REAL FAN OF THIS ONE. I DON'T FEEL THAT I DON'T WANT TO BE IN A RUSH TO DEVELOP IT AND IMPROVE IT FOR MULTI FAMILY WOULD RATHER WAIT TO SEE IF WE CAN GET. IS THERE A MOTION OR MOVE THAT WE DENIED THIS REQUEST? SECOND PLEASE CAST YOUR VOTES.

MOTION PASSES. UM. ITEM 230057 Z THREE CONDUCTED PUBLIC HEARING TO CONSIDER AND ACT ON REQUEST

[Conduct a Public Hearing to Consider/Discuss/Act on a Request to Rezone the Subject Property from “C2” - Local Commercial District to “C3” - Regional Commercial District, Located at 2151 North Hardin Boulevard, and Accompanying Ordinance]

RESULT SUBJECT PROPERTY FROM SEA TO LOCAL COMMERCIAL DISTRICT TO SEE THREE REGIONAL COMMERCIAL DISTRICT. LOCATED AT 21 51 NORTH HARNEY BOULEVARD. JENNIFER GETTING TIRED. I PROMISED THE REST OF THEM GET A LITTLE EASIER. AS YOU SAID THIS WAS REQUESTED TO REZONE THE SUBJECT PROPERTY FROM SEA TO COMMERCIAL ZONING TO SEE THREE COMMERCIAL ZONING TRACTORS LOCATED AT 21 51 NORTH HARNEY BOULEVARD, AND IT'S APPROXIMATELY FOUR ACRES IN SIZE . THE REQUEST TO MODIFY THE ZONING FROM C TWO TO C THREE IS ALMOST ENTIRELY TO MODIFY THE ALLOWED BUILDING HEIGHTS. UNDER THE SEA TO ZONING DISTRICT. THERE IS A MAXIMUM BUILDING HEIGHT. UM I BELIEVE IT'S UH 35 FT AND WITH THE C THREE I WRITE. I'M SORRY. LET ME CHECK THAT REAL QUICK. I APOLOGIZE. I HAD TOO MANY ON MY LIST TODAY. YEAH THERE WE GO. OKAY SO I WAS WRONG, SO IT IS REQUEST TO RESIGN FROM C TWO TO C THREE TO INCREASE THE BUILDING HEIGHT ALLOWANCES FROM 45 FT. 2 55 FT.

IF YOU WERE TO LOOK AT THE ALLOWED USES BETWEEN C TWO AND C THREE AND OUR CURRENT ZONING ORDINANCE, A MANY OF THE USES ARE PERMITTED IN BOTH SO AGAIN. THE REQUEST FOR THIS REZONING IS TO ALLOW FOR AN INCREASE IN BUILDING HEIGHT. THE APPLICANT HAS INDICATED TO US THAT THEY DO HAVE A HOTEL DEVELOPER INTO THAT HIS NECESSITATING THE REQUEST WHEN STOPPED, LOOKED AT THE REQUEST. WE OBVIOUSLY HAVE NO CONCERNS WITH THE COMMERCIAL USES ON THIS TRACK. WE'RE ALSO COMFORTABLE WITH THE INCREASE IN BUILDING HEIGHTS. WE DO HAVE RESIDENTIAL ADJACENCY STANDARDS IN PLACE NOW, WITH THE NEW ZONING CODE THAT WILL ENSURE PROPER SETBACKS. AND STEP BACK FROM ADJACENT RESIDENTIAL. WE ALSO NOTE THAT THERE IS A STREET THAT IS SEPARATING THIS COMMERCIAL TRACKED FROM THE RESIDENTIAL TO THE NORTH, GIVEN ITS LOCATION NEAR HARDEN AND US 3 80 THE GROWING COMMERCIAL FOOTPRINT OF THIS AREA. WE'RE OFFERING OUR FAVORABLE RECOMMENDATION PLANNING AND ZONING COMMISSION IS ALSO RECOMMENDING APPROVAL, AND I'M HAPPY TO ANSWER ANY QUESTIONS. QUESTIONS FOR JENNIFER. OKAY? IS THE APPLICANT HERE. MR MAYOR COUNCIL, ROBERT LOUIS, 2600 NORTH CENTRAL EXPRESSWAY. RICHARDSON, TEXAS. I DON'T HAVE ANYTHING TO OFFER GIVEN THE FAVORABLE RECOMMENDATION BUT HAPPY TO ANSWER ANY QUESTIONS.

QUESTIONS FOR THE APPLICANT. THANK YOU, SIR. THIS PUBLIC HEARING. IS THERE ANYONE THAT WOULD LIKE TO SPEAK TO THIS ITEM? SEEING NONE ENTERTAINING MOTION. PROMOTION. WE CLOSED THE PUBLIC HEARING. CONCERN ACT ON OUR REQUEST TO RESIGN SUBJECT PROPERTY FROM PD PLAN DEVELOPMENT DISTRICT TO SEE

[01:30:04]

TO LOCAL COMMERCIAL DISTRICT. LOCATED AT 40 50. WEST UNIVERSITY. DR. JENNIFER THANK YOU, MR MAYOR. THIS IS TRACKED JUST NEXT TO THE ONE YOU RECENTLY C, THE APPLICANT IS REQUESTING TO REZONE THE SUBJECT PROPERTY TO SEE TO LOCAL COMMERCIAL ZONING DISTRICT. CURRENTLY THE PROPERTY IS OWNED PD PLAN DEVELOPMENT DISTRICT AND ALLOWS FOR MULTI FAMILY USES ON THE BACK PORTION OF THE PROPERTY. THE DEVELOPMENT PLANS HAVE CHANGED FOR THE OWNER AND MASTER DEVELOPER, AND THEY NOW HAVE A COMMERCIAL USERS THAT ARE LOOKING TO DEVELOP THIS SITE , WHICH IS THE, UH WHAT'S NECESSITATING THE CHANGE IN ZONING AS A STRAIGHT ZONING DISTRICT TO SEE TWO FOR COMMERCIAL USES AT A MAJOR INTERSECTION WITH THAT ALREADY DEVELOPING FOR COMMERCIAL USES. STAFF IS OFF, OBVIOUSLY RECOMMENDING APPROVAL. PLANNING AND ZONING COMMISSIONS ALSO CONSIDERED THE ITEM AND IS RECOMMENDING APPROVAL. AND I'M HAPPY TO ANSWER ANY QUESTIONS THAT YOU HAVE MOVING FROM MULTI FAMILY TO COMMERCIAL. YES, SIR.

THANK YOU. LIKE THAT IS THEIR QUESTIONS FOR JENNIFER, NOT WITH THE APPLICANT LIKE TO SAY A FEW WORDS. MR MAYOR AGAIN? NOT SURE THAT I HAVE ANYTHING TO OFFER. UM BUT HAPPY TO ANSWER ANY QUESTIONS YOU HAVE. QUESTION FOR THE APPLICANT. THANK YOU, SIR. THIS IS PUBLIC HERE. INDUSTRY ANYONE THAT WOULD LIKE TO SPEAK TO THE ATOM? SEEING NONE ENTERTAIN A MOTION. SHOULD WE CLOSE? THE PUBLIC HEARING IMPROVED THIS ITEM. SECOND CAST YOUR VOTES. VERSE IF YOU COULD PLEASE MEMORIALIZED THIS EVENING . WE JUST HAD A REQUEST TO GO FOR MULTIFAMILY COMMERCIAL.

[Conduct a Public Hearing to Consider/Discuss/Act on a Request to Rezone the Subject Property from “PD” - Planned Development District and “REC” - Regional Employment Center Overlay District to “PD” - Planned Development District, Generally to Modify the Development Standards and to Allow for Multi-Family Residential Uses, Located on the East Side of Custer Road and Approximately 1,400 Feet North of Silverado Trail, and Accompanying Ordinance]

230061 Z THREE CONDUCTED PUBLIC HEARING TO CONSIDER AND ACT ON REQUEST TO REZONE SUBJECT PROPERTY FROM PD PLAN DEVELOPMENT DISTRICT AND RICK REGIONAL EMPLOYMENT CENTER OVERLAY DISTRICT TO PD PLAN DEVELOPING DISTRICT MODIFIED DEVELOPMENT CENTERS TO ALLOW FOR MULTI FAMILY RESIDENTIAL USES. LOOKING ON THE EAST SIDE OF CUSTOM ROAD, APPROXIMATELY 1400 FT NORTH OF SILVERADO TRAIL. THANK YOU, MR MAYOR. THIS IS A REQUEST TO REASON ON THE SUBJECT PROPERTY AS YOU SAID FROM PD PLAY DEVELOPMENT TO PD PLAN DEVELOPMENT DISTRICT. THE TRACT ITSELF IS ABOUT 10.87 ACRES IN SIZE, AND YOU MAY NOTICE THAT IT IS JUST SOUTH OF THE STORYBOOK PROPERTY THERE EAST OF CUSTER. SO THIS ONE IS AN INTERESTING ONE. THE PROPERTY IS ACTUALLY UNDERDEVELOPMENT OR PORTIONS OF THE PROPERTY ARE ALREADY UNDER DEVELOPMENT FOR MULTI FAMILY USES. HOWEVER THAT DEVELOPMENT STARTED PRIOR TO SOME CHANGES IN OUR ORDINANCES, SO THEREFORE THOSE MULTI FAMILY USES THAT WERE APPROVED AND PERMITTED ARE NOW CONSIDERED NONCONFORMING USES PER THE LETTER OF OUR ZONING ORDINANCE. SO THE APPLICANT AS PART OF THEIR FINANCIAL PLANNING, AND, UM, YOU KNOW PERFORMANCE FOR THE PROJECT THEY ARE REQUESTING TO REZONE THE TRACKED TO ALLOW FOR MULTI FAMILY USES BY RIGHT TO HELP UNLOCK SOME OF THE DIFFICULTIES THAT THEY MAY OR MAY NOT HAVE WITH GETTING FINANCING TO COMPLETE THE PROJECT. SO THESE NOTING THAT YOU SEE BEFORE YOU IN THAT PD IS ESSENTIALLY A COPY OF THE STANDARDS THAT ARE IN PLACE FOR THE SITE PLAN THAT HAS BEEN APPROVED SO STAFF IS OFFERING A FAVORABLE RECOMMENDATION ON THIS AS THIS PLANNING AND ZONING COMMISSION. I'M HAPPY TO ANSWER ANY QUESTIONS THAT YOU HAVE, AND I BELIEVE THE APPLICANT IS BEHIND ME AS WELL. QUESTIONS FOR JENNIFER. THE APPLICANT PLEASE COME UP. GOOD EVENING, MAYOR AND COUNCIL MEMBERS. JARED PACE WITH THE LAW FIRM OF ABERNATHY ROTOR BOYD AND HOLD IT, MCKINNEY. UM I JUST WANTED TO POINT OUT AGAIN THAT THIS IS AND JENNIFER DID A VERY GOOD JOB. BUT THIS IS NOT A REQUEST FOR NEW MULTI FAMILY. IT'S NOT A REQUEST FOR EXPANDING MULTI FAMILY. IT'S MERELY A REQUEST TO ALLOW ALRIGHT AND ALREADY APPROVED MULTI FAMILY DEVELOPMENT TO BE CONFORMING RATHER THAN NON CONFORMING. SO THE PROPERTY OWNERS AND DEVELOPERS IN A UNIQUE POSITION OF HAVING ALREADY STARTED CONSTRUCTION AND HAVING DONE MUCH OF THE HORIZONTAL IMPROVEMENTS. AND THEN NOW BEING IN THE SITUATION WHERE ONE OF ITS LENDERS HAS I NOTICED THAT IT'S NOW NONCONFORMING. AND SO IT WOULD BE COST PROHIBITIVE AT THIS POINT TO CHANGE THAT TO SOME OTHER KIND OF USE, WHETHER IT BE OFFICE OR RETAIL. LET ALONE THE SITE CHARACTERISTICS FOR IT. DO NOT IT'S NOT A GOOD PLACE FOR RETAIL BECAUSE OF THE RETAIL BUILDINGS THAT ALREADY

[01:35:05]

CONSTRUCTED THERE SO CLOSE TO CUSTER AND IN HIGH ENOUGH THAT YOU CAN'T EVEN SEE BACK THERE.

AND YOU KNOW, THERE'S NOT AS MUCH OF THE DEMAND FOR OFFICE USES NOW, SO IT WOULD BE IT'S JUST NOT A GOOD LOCATION. FOR ANYTHING ELSE, SO I'M HAPPY TO ANSWER ANY OTHER QUESTIONS YOU MIGHT HAVE. THE DEVELOPERS ALSO HERE AS WELL. YOU WON'T HAVE QUESTIONS. ANYTHING CHANGED ABOUT YOUR PLANS ON THIS DEVELOPMENT OTHER THAN. SOMETHING THAT CHANGED IN THE ZONING. NO, THIS IS MERELY. TO HAVE THE ALREADY APPROVED SITE PLAN BECOME CONFORMING. RATHER THAN BEING NONCONFORMING BECAUSE OF THE CITY, HAVING CHANGED THE ZONING ORDINANCE AFTER THAT SITE PLAN WAS APPROVED. THE ONE I DON'T GET IS IT SOUNDS KIND OF EXPOSED FACTO TO ME, AND I WAS GONNA ASK MR HAUSER IF HE COULD EXPLAIN HOW THAT OCCURRED. IF YOU CAN. MY RECOLLECTION IS JENNIFER CORRECT ME IF I'M WRONG, BUT BECAUSE I WAS AT THE PNC MEETING WITH THIS IS THAT THEY HAVE THE RIGHT TO BUILD THIS. BUT LET'S SAY TWO YEARS FROM NOW THERE'S A FIRE TORNADO THAT KNOCKS IT DOWN. THEY'VE GOT INSURANCE ON IT, BUT BUT THEY MAY NOT BE ABLE TO REBUILD IT AND THE INSURANCE COMPANY OR THE MORTGAGE COMPANY SAYING WOLF, WE CAN'T REBUILD IT. THEN YOU KNOW WE'RE IN TROUBLE ON THE FINANCING, SO THIS GIVES THEM THE RIGHT TO REBUILD IT IN CASE OF CATASTROPHE. WHERE AM I WRONG ON THAT YOU'RE NOT WRONG. WHEN IT COMES DOWN TO A LENDER ISSUE, AND IN FACT, WE RAN INTO THIS ISSUE A COUPLE BACK IN 2018 2019 ON A COUPLE OF SINGLE FAMILY HOMES AS WELL. SO IN THE OLD DAYS ARE OLD OWNING DISTRICTS ALLOWED FOR RESIDENTIAL USES IN SOME OF OUR COMMERCIALS ARE IN DISTRICTS. THIS IS ONE OF THE TRACKS THAT ALLOWED FOR MULTI FAMILY USES WITHIN SOMETHING THAT WAS ZONED COMMERCIALLY, UM, AND IN 2018. THE ORDINANCE CHANGED AND WE ACTUALLY REMOVED THOSE RESIDENTIAL USE ALLOWANCES FROM THOSE COMMERCIAL DISTRICTS.

THEREBY RENDERING CERTAIN PROPERTIES TO BE NONCONFORMING. SO THIS PROPERTY WAS ONE WHO HAD ALREADY GONE THROUGH THE PLANNING AND SITE PLANNING PROCESS TO DEVELOP MULTI FAMILY UNDER THAT OLD USE ALLOWANCE IN THE ORDINANCE CHANGED. WE HAD SOME SINGLE FAMILY HOMES THAT WERE BUILT UNDER SOME OF THOSE COMMERCIAL ZONING DISTRICTS, AND THEY'VE RUN INTO INSURANCE COVERAGE AND LENDING CHALLENGES ON THE FINANCING SIDE, BECAUSE WHEN LENDERS ARE LOOKING AT THAT FINANCING, AND THEY SEE THAT IT'S A NONCONFORMING USE RED FLAG ON THEIR ON THEIR TALLY SHEET THERE. AND SO IN 2018 WE ACTUALLY TO MODIFY THE ORDINANCE FOR SOME OF THOSE SINGLE FAMILY, ZONING OR PROPERTIES, UM, TO HELP OUT WITH THOSE ISSUES AND THEN NOW WITH THIS ONE BECAUSE IT WAS UNDER DEVELOPMENT IN BETWEEN THAT TIME, AND NOW THEY'RE RUNNING INTO THAT LENDING CHALLENGE. YEAH. THANK YOU, JENNIFER. AND I'M GONNA APPROVE YOUR REQUEST. JUST STILL BAFFLED THAT. HOW YOU CAN GET IT APPROVED AND WE HAD REMEMBER THEY WERE GRANDFATHER. THOSE WHO HAD SUBMITTED A SITE PLAN WITHIN SO MANY I THINK IT WAS A 60 DAY OR SIX MONTH PERIOD PEOPLE THAT HAD ALREADY SUBMITTED THEY WERE GRANDFATHERED IN IF YOU WOULD I PREFER THEM BLAME THE LENDERS CAPSULES. I'LL GO WITH THAT. THANK YOU. ALL RIGHT. THIS IS A PUBLIC CURIOUS OR ANYONE LIKE TO SPEAK TO THIS ITEM. SEEING NONE ENTERTAIN A MOTION. MY COMMOTION THAT WERE CLOSED PUBLIC HEARING AND IMPROVED THE REQUEST. SECOND CAST YOUR VOTES. HE'S GOT YOU EVERY TIME. YEAH. DISTRICT.

PRO TEM ON NEXT ITEM 23006 Z FOUR CONDUCTED PUBLIC HEARINGS. CONSIDER AN ACT REQUEST TO REZONE SUBJECT PROPERTY FROM AGRICULTURE DISTRICT TO SEE THREE REGIONAL COMMERCIAL DISTRICT LOCATED APPROXIMATELY 1750 FT. AM EVERY NIGHT AND EVERY DAY RATHER TONIGHT TONIGHT FOR SURE, GARY STILL HAVE TO FOLLOW ME UP. YES YOU DID GET OFF LAST MINUTE. I DID. AND I WILL BE ON THE NEXT ONE, TOO. SO WE COULD, UM SO WE'RE TRAVELING BACK NEAR

[01:40:04]

THE INTERSECTION OF HARDEN AND 3 80 THIS PARTICULAR TRACTORS JUST WEST OF MCKINNEY TRADE DAY SITE.

THE PROPERTY IS CURRENTLY ZONED AGRICULTURAL DISTRICTS, AND THE AFRICAN IS PROPOSING TO REZONE IT TO SEE THREE COMMERCIAL ZONING DISTRICT. AS I KIND OF NOTED IN THAT PREVIOUS ITEM. THE MAJOR DIFFERENCES BETWEEN C TWO AND C THREE WITH THE EXCEPTION OF A FEW MINOR USES IS REALLY THAT BUILDING HEIGHT ALLOWANCE AND SO GIVEN THAT THIS IS ON A MAJOR ROADWAY FRONTAGE IN AN AREA THAT IS ALREADY LARGELY DEVELOPING FOR COMMERCIAL USES, STAFF IS COMFORTABLE WITH THE REQUEST TO REZONE TO C THREE. IT IS IN ALIGNMENT WITH THE CITY'S COMPREHENSIVE PLAN, AND WE ARE OFFERING A FAVORABLE RECOMMENDATION. PLANNING AND ZONING IS ALSO RECOMMENDING APPROVAL, AND I'M HAPPY TO ANSWER ANY QUESTIONS. QUESTIONS FOR JENNIFER. THE APPLICANT HERE. BYE. GOOD EVENING MAYOR COUNCIL. MATT MOORE. CLAYMORE ENGINEERING. JENNIFER DID IT PRETTY JOB OF SUMMARIZING REQUEST? BE HAPPY TO ANY QUESTIONS. YOU GUYS HAVE ANY QUESTIONS? THANKS SIR. THIS IS A PUBLIC HEARING ANYONE THAT WOULD LIKE TO SPEAK TO THIS ITEM? SEEING NONE ENTERTAIN A MOTION WOULD LIKE TO MAKE A MOTION WE CLOSED. FOUR CONDUCTED PUBLIC HEARING TO CONSIDER ACT ON A REQUEST TO REZONE SUBJECT PROPERTY FROM SEA PLANTS CENTER DISTRICT TO LIGHT INDUSTRIAL DISTRICT, LOCATED AT 3200 NORTH CENTRAL EXPRESSWAY THAT HAS BEEN THERE'S A REQUEST TO TABLE IT. BUT I THINK THEY'RE GONNA THEY WANT INTO THEIR WANTING TO TABLE INTO DECEMBER IS THAT CORRECT TABLE INTO DECEMBER STAFF'S RECOMMENDATION IS THAT WE TABLE THE ITEM INDEFINITELY. WE DO HAVE ENOUGH TIME TO RE NOTICE BEFORE THAT DECEMBER MEETING. THERE ARE SOME PRIVATE CONTRACTUAL DISCUSSIONS HAPPENING ON THE POTENTIAL SALE AND PURCHASE. SIR. YOU WOULD LIKE A MOTION TO TABLE INDEFINITELY. MR MARY MOVED THAT WE CONTINUE ANY PUBLIC HEARING AND DELAY THIS INDEFINITELY. SECOND HIS CASH FOR VOTES.

[Conduct a Public Hearing to Consider/Discuss/Act on a Request to Rezone the Subject Property from “PD” - Planned Development District to “PD” - Planned Development District, Generally to Allow for Single Family Residential Uses and to Modify the Development Standards, Located on the Northwest Corner of Alma Road and Hewitt Drive, and Accompanying Ordinance]

RIGHT NEXT ITEM. 230074 Z TWO IN DR PUBLIC HEARING TO CONSIDER ACT ON THE REQUEST OF HIS OWN SUBJECT. PROPERTY FROM PD PLAN DEVELOPMENT DISTRICT. TO PLAN DEVELOPMENT DISTRICT GENERAL TO ALLOW FOR SINGLE FAMILY RESIDENTIAL USERS IN THE MODIFIED DEVELOPMENT STANDARDS LOCATED ON THE NORTHWEST CORNER OF AMMA ROAD IN HEWITT DRIVE AND ACCOMPANYING ORDINANCE, JENNIFER THANK YOU, MR MAYOR. THIS IS MY LAST ONE FOR TONIGHT. SO THIS IS KNOWN AS THE PINNACLE FACE TO DOWN OVER AT ALMA AND HEWITT. SOME OF YOU MAY RECALL THIS ZONING AND DEVELOPMENT PLAN, BUT JUST SORT OF SOUTHEAST OF HERE. THERE ARE ALLOWANCES FOR MULTI FAMILY AND THE CONCEPT HERE IS TO DEVELOP SORT OF A REALLY DENSE, MIXED USE ENVIRONMENT. THE CURRENT ZONING ON THE PROPERTY IS PD PLAN DEVELOPMENT DISTRICT, AND IT WOULD ALLOW FOR THE DEVELOPMENT OF SINGLE FAMILY DETACHED UNITS. THE APPLICANT IS ACTUALLY REQUESTING TO REZONE TO ALLOW FOR THE DEVELOPMENT OF NOW I'M SECOND GUESSING MYSELF ON THE SWITCH. SORRY IT WOULD ALLOW FOR TOWN HOMES ON THIS TRACK THE APPLICANT IS REQUESTING TO REZONE TO ALLOW FOR SINGLE FAMILY DETACHED ON THE TRACKS.

I'M SORRY I GET IT REVERSED. SO THE CONCEPT FOR THE SINGLE FAMILY DETACHED HERE WOULD MIRROR WHAT'S ALREADY BEEN DEVELOPED OUT IN THIS AREA STAFF HAS NO CONCERNS AS IT IS STILL A SINGLE FAMILY PRODUCT AND THE FOOTPRINT OF THE STREET NETWORK AND THE DEVELOPMENT PATTERNS ALREADY IN THIS AREA WOULD SUPPORT SINGLE FAMILY HERE SO WE ARE RECOMMENDING APPROVAL.

PLANNING AND ZONING COMMISSION IS ALSO RECOMMENDED APPROVAL, AND I'M HAPPY TO ANSWER ANY QUESTIONS. ANY QUESTIONS? THE APPLICANT. HERE THEY ARE. ALRIGHT. SEE YOU NONE. LISTEN LIKE KIDS. MHM. MARTIN SANCHEZ TO 10 ADRIATIC PARKWAY SUITE. 200 MCKINNEY, TEXAS. 750 17, MR MAYOR COUNCIL. THANK YOU FOR ALLOWING ME TO SPEAK FOR A SECOND COUNCILMAN PHILLIPS. I WOULD SAY IT'S NOT THE LENDER. IT'S THE LENDERS, ATTORNEYS JUST SAYING, BUT THAT'S A DIFFERENT ISSUE, SIR. IF YOU RECALL COUNCIL IF YOU RECALL THIS IS A SUBJECT ABOUT THREE YEARS AGO, WE BROUGHT IN TRYING TO CLEAN UP A LOT OF BANKRUPTCY IN BAD ZONING THAT WAS LAYERS OF CONFUSION IN THE NEIGHBORS WERE ALL UP IN ARMS REALLY UPSET, RIGHTFULLY SO. BUT HAVING WORKED WITH THE NEIGHBORS FOR THE BETTER PART OF ABOUT 18 MONTHS, MISS ARNOLD AND I WERE ABLE TO

[01:45:03]

WORK THROUGH WITH THE NEIGHBORS TO COMPROMISE THAT GOT EVERYBODY HAPPY. IN THE END AT THE TIME, I TOLD THE NEIGHBORS TO THE NORTH THAT THIS PIECE WE ZONED AS TOWN HOMES THAT THREE YEARS AGO, BUT WHEN IT CAME TIME TO DEVELOP THIS PROPERTY, WE WOULD RE EVALUATED TO SEE IF TOWN HOMES WERE STILL THE APPROPRIATE LAND USE OR IF WE COULD FALL BACK TO SOMETHING LESS DENSE LIKE THE URBAN LIVING RESIDENTIAL PRODUCT . IN THAT TIME, THE URBAN LIVING PRODUCT THAT WE DID BASICALLY ON COLLIN MCKINNEY PARKWAY THAT WE DEVELOPED DREAMS WAS OUR BUILDING PARTNER FOR THAT HAS BEEN WILDLY SUCCESSFUL. IT IS TURNED OUT TO BE MUCH BETTER THAN WE COULD HAVE EVER DREAMED OF. SO WHEN WE RE EVALUATED THIS TOWN HOME SITE, THERE WAS NO NEED TO HAVE THAT COMMONWEALTH CONSTRUCTION TOWN HOME WHERE IT MAKES SENSE. IT MAKES SENSE AND SOMETIMES YOU HAVE TO LOOK AT LAND USES FROM THAT PERSPECTIVE, AND WHEN DOES IT MAKE SENSE? UM WE DO THAT ALL THE TIME. I MEAN, NO, NO SITE IS JUST HOMOGENEOUS AND STATIC. SO IN THIS TIME, WE WERE ABLE TO CONVERT IT FROM A TOWN HOME PRODUCT AND URBAN LIVERY PRODUCT, WHICH IS A SINGLE, FAMILY DETACHED PRODUCT BECAUSE IT MAKES SENSE. SO WITH THAT, ANSWER ANY QUESTIONS AND. SHE DO THAT SCHOOL? IT'S JUST TO THE NORTH OF THAT. YES, SIR. ACTUALLY, IT'S TWO BLOCKS. IT'S A IT'S A FULL BLOCK TO THE NORTH OF IT ATTENDED THAT GRAND OPENING FOR THAT ONE. IT'S JUST A GREAT PROJECT. CONGRATULATIONS ON THAT ONE. SO WE'RE REAL EXCITED ABOUT THIS ONE, TOO, IS JUST LIKE I SAID, THIS URBAN LIVING PRODUCT IS DOING REALLY WELL. IT'S A HOMEOWNERSHIP PRODUCT. IT'S A THREE STORY PRODUCT WITH AN ELEVATOR SHAFT IN IT, BUT THE ELEVATORS EXTRA HMM. I LOVE IT. BUILD THE CHEF FOR YOU, THE ONE THAT BROUGHT ALL THE NEIGHBORS DOWN TO SEE US . YES, SIR. YEAH, THE FIRST TIME THEY WANTED TO. THEY WERE NOT VERY HAPPY WITH THIS, SIR. CONSPICUOUSLY MISSING TONIGHT.

SOMETIMES WE GET THE LAND USE RIGHT? THANK YOU. YES, SIR. CAN WE PLEASE MEMORIALIZE THIS EVENT AS WELL? PUT IT IN THE CALENDAR MARKET FOR FUTURE GENERATIONS. LOOK BACK ON, AND WE EXPECT MORE GOOD NEWS FROM ADRIATIC, MARTIN OR IS THIS JUST KIND OF EPISODIC ? WE MAY GO BACK TO HIGHWAY FIVE. MARTIN YOU KNOW, ADRIANA HAS NOT YET ACCEPTED HIM WERE TO CALL HIM ADRIATIC MARTIN IN A BAD MOOD, BUT THERE'S A B AN ANNUAL MEETING IN A FEW WEEKS WILL DECIDE RIGHT NOW. HE'S JUST SQUATTING. YAHOO THAT'S RIGHT. I'M A RENTER. THANKS, MARTIN. ALL RIGHT. IT SAYS A PUBLIC HEARING. ANYONE LIKE TO SPEAK TO THIS ITEM. SAYING NONE ENTERTAIN A MOTION. MR BARRON MOVED THAT WE CLOSE THE PUBLIC HEARING AND APPROVED. THIS ITEM IS SUBMITTED BY STAFF. I'LL CIRCUIT IS CASH FOR VOTES. PASSES ITEM. 230865 CONSIDER ACT ON ADOPTION OF RESOLUTION

THESE MEN ASSOCIATED WITH THE FIVE UTILITY RELOCATION PROJECT, WHICH PROPERTY IS LOCATED AT THE NORTHWEST CORNER OF NORTH MCDONALD STREET IN EAST VIRGINIA STREET AND AUTHORIZED IN CITY MANAGER TO ESTABLISH PROCEDURES.

FOR REQUIREMENTS ON SAID PROPERTY AND TAKE ALL STEPS NECESSARY TO ACQUIRE THAT NEEDED PROPERTY RIGHTS AND COMPLIANCE WITH ALL APPLICABLE LAWS AND RESOLUTIONS. MR GRAHAM THANK YOU, MAYOR, UM, COUNCIL GARY GRAHAM, DIRECTOR OF ENGINEERING. THE NEXT FOUR ITEMS ARE ALL RELATED THEIR INDIVIDUAL ITEMS FOR CONSIDERATION, BUT THEY'RE ALL RELATED TO THE UTILITY PROJECT WE'RE DOING ALONG HIGHWAY FIVE. CITY CONTROL EASEMENTS OUTSIDE THE RIGHT AWAY. UM. IN ALL IMMINENT DOMAIN AND ACQUISITION CASES.

THE CITY FOLLOWS A SIMILAR PROCESS. WE GO OUT AND WE AFTER WE DO THE DESIGN, WE DO A APPRAISAL OF THE PROPERTY TO DETERMINE THE FAIR MARKET VALUE OF WHAT THE ACQUISITION IS. WE MAKE AN OFFER BASED ON THAT, UM APPRAISAL OF THE PROPERTY OWNER HAS THE OPPORTUNITY TO MAKE A COUNTER OFFER. THEY CAN DO THEIR OWN APPRAISAL. WE CAN NEGOTIATE BACK AND FORTH AT A CERTAIN TIME

[01:50:02]

, THE CITY WILL MAKE A FINAL OFFER AGAIN. WE CAN MAKE, UH, NEGOTIATIONS BUT IF WE CANNOT COME TO AGREEMENT AND WE NEED WE NEED THE PROPERTY FOR PUBLIC GOOD. WE WILL ASK FOR YOUR PERMISSION TO, UM MOVE FORWARD WITH EMINENT DOMAIN. UM, IN ALL CASES OF EMINENT DOMAIN, UM AND RIGHT AWAY ACQUISITIONS FOR EASEMENT OR RIGHT AWAY. WE GO TO THE SPECIAL COMMISSIONERS COURT WHO IS APPOINTED BY THE COLLIN COUNTY COMMISSIONERS. THIS IS USUALLY A GROUP OF THREE INDIVIDUALS FROM FROM COLLIN COUNTY, BOTH THE CITY AND THE PROPERTY INTEREST MAKE THEIR CASES AT THE SPECIAL COMMISSIONERS COURT. A SPECIAL COMMISSIONERS WILL THEN DETERMINE WHAT THE AH COMPENSATION WILL BE FOR THE ACQUISITION. THIS IS NOT A TAKING OF PROPERTY. THIS IS A PROCESS DETERMINE THE VALUE FOR THE COMPENSATION FOR THE PROPERTY OWNER. SO WITH THAT, I WON'T TELL THAT DO THAT SPILL. EACH ONE WILL GO INTO EACH ITEM.

THESE WILL ALL REQUIRE A RECORD VOTE THE FIRST TIME. THE FIRST ONE HERE IS AT VIRGINIA AND HIGHWAY FIVE. THIS IS THE BEST PRICE AUTO RIGHT ADJACENT TO THE CITY'S PARKING GARAGE. AS THE MAYOR SAID, IT'S A 15 FT SANITARY SEWER EASEMENT WITH A 15 FT TEMPORARY CONSTRUCTION EASEMENT ADJACENT TO IT. WE REACHED A POINT WHERE WE COULD NOT NEGOTIATE WITH THE PROPERTY OWNER AND YOU MOVE FORWARD WITH YOU. VERY AND EACH OF THE FOUR HENCE THERE BEEN COMMUNICATION, AT LEAST BETWEEN. THE PROPERTY OWNER AND THE CITY REPRESENTATIVES. UM WE HAVE RATIONS, WE MIGHT NOT HAVE RECEIVED RESPONSES FROM EACH APPLICANT OR EACH INDIVIDUAL PROPERTY OWNER YET? YES THERE HAS BEEN AN INITIAL OPERA AND FINAL OFFER MADE FOR EACH OF THE DIFFERENT PROPERTIES AND MY QUESTION WAS HAVE ALL OF THEM RESPONDED TO YOURS. IT JUST BEEN SILENCE ON THERE, AND I KNOW I'M GETTING AHEAD OF THE GAME BECAUSE WE HAVE TO FORMALLY DO THIS FOR EACH OF THE FOUR. ON THE LAST ITEM. I DON'T BELIEVE WE'VE HAD RESPONSE ON ANY OF THE , UM AH, INITIAL OFFER OF FINAL OFFER ONLY NOTIFICATION THAT WE HAVE FROM THE APPLICANT OR THE PROPERTY, AND THEY HAVE HIRED DOMAIN ATTORNEY OKAY? [CITIZEN COMMENTS on Matters not on the Agenda]

SIGNED UP. YES I'M SORRY. THERE ARE THREE PEOPLE AND BEING TOLD I JUST OPENED THE SCREEN. YES, THREE PEOPLE FOR PUBLIC COMMENTS. ON ITEMS MATTERS NOT ON THE AGENDA FIRST, PAUL BALLESTEROS. PAUL BALLESTEROS, 65 08 MARVIN GARDENS, MCKINNEY, TEXAS, MR MAYOR AND MEMBERS OF THE COUNCIL. THANK YOU FOR YOUR TIME AND ATTENTION, AND NOW YOU'VE GOT A LOT ON YOUR PLATE, SO I REALLY DO APPRECIATE IT. NOT SURPRISINGLY, I'M HERE TO TALK TO ADDRESS HOMELESSNESS IN OUR COMMUNITY. IN ADDITION TO BEING A MCKINNEY RESIDENT RESIDENT SIX YEARS AGO, I FOUNDED A NONPROFIT AND MANUAL LABOR. OUR MISSION IS MODELING THE LEVEL JESUS CHRIST ADDRESSED THE NEEDS OF ANYONE AFFECTED BY HOMELESSNESS AND POVERTY, AND THAT MEANS WE EXIST TO SERVE ALL OF OUR NEIGHBORS BECAUSE WE'RE ALL AFFECTED BY IT, REFLECTING ON THE WORK SESSION FROM TWO WEEKS AGO, AND WHILE I CAN APPRECIATE AND SUPPORT THE DESIRE TO HOLD PEOPLE ACCOUNTABLE FOR THEIR PUBLIC BEHAVIOR. I DON'T RECALL ANYONE BRINGING A COMPLAINT BEING UPSET THAT ANYONE WAS ACTUALLY HOMELESS. HOURS WERE SPENT ADDRESSING BEHAVIOR IS BELIEVED TO BE ASSOCIATED WITH PEOPLE EXPERIENCING HOMELESSNESS . BUT I DON'T RECALL MUCH TIME BEING SPENT ADDRESSING WHAT IT'S LIKE FOR A PERSON TO EXPERIENCE ALMOST THIS I KNOW MANY PEOPLE HAVE ADOPTED THE IDEA. THEY CHOSE THIS. I'VE BEEN ENGAGED WITH ADDRESSING HOMELESSNESS FOR OVER A DECADE, BEGINNING IN NEW YORK CITY, AND WHILE I HAVE MET THOUSANDS UPON THOUSANDS THAT HAVE SAID THEY BELIEVED THEY HAD NO OTHER CHOICE. I'VE ONLY MET TWO PEOPLE THAT ACTUALLY SAID THAT IT WAS THEIR CHOICE. IT'S SO RARE. I CAN REMEMBER WHO THEY ARE. MEREDITH BELIEVES SHE COULDN'T GET HIRED FOR THE JOB SHE TRAINED FOR UNLESS SHE GOT DENTAL CARE THAT SHE COULDN'T AFFORD. SHE CONCLUDED THAT IF SHE WAS HOMELESS LONG ENOUGH, THE DENTAL CARE WILL BE PROVIDED FOR SHORTLY AFTER I STARTED A MANUAL LABOR, I FOUND OUT MEREDITH DIED BECAUSE SHE WAS BEATEN TO DEATH. I CURRENTLY SERVE THE OTHER PERSON SO OUT OF RESPECT, I WILL NOT SHARE THEIR NAME. IT SHOULD BE CLARIFIED THAT HOMELESSNESS IS A SITUATION AND NOT A PERSONALITY TRAIT, BUT IT IS A DANGEROUS AND HIGHLY VULNERABLE SITUATION. THE MOMENT A PERSON BECOMES HOMELESSNESS BECOMES HOMELESS. THEIR LIFE EXPECTANCY DRAFTS 20 YEARS IN THEIR MORTALITY RATE TRIPLES.

EVERYONE WHO IS CURRENTLY HOMELESS MAY NOT BE ABLE TO ARTICULATE THEMSELVES WELL, BUT THEY ALL KNOW THE STRESS AND THE UNCERTAINTY AND THAT VULNERABILITY NOT EVERYONE EXPERIENCING HOMELESSNESS IS MENTALLY ILL OR ADDICTED, ADDICTED, BUT EVERYONE IS MENTALLY TRAUMATIZED. IN ADDITION TO 2020 STUDIES SHOWED 75% OF PEOPLE EXPERIENCING HOMELESSNESS ARE SLEEP DEPRIVED. PERSONALLY, I THINK IT'S HIGHER. THE FAA WON'T LET A PILOT FLY A PLANE WITHOUT EIGHT HOURS OF CONTINUOUS SLEEP FOR WHICH I AM GRATEFUL FOR, BUT WE ARE OFTEN HEAVY HANDED WITH PEOPLE THAT ARE SIMPLY NOT LIVING WELL AND TRAUMATIZED. THEREFORE POOR DECISION MAKING IS THIS FACTOR AND OFTEN WHITE PERSON REMAINS HOMELESS, BUT BECAUSE DUE TO THEIR CIRCUMSTANCES, THEIR ABILITY TO MAKE DECISIONS IS COMPROMISED. LASTLY IF WE ESTIMATE MCKINNEY TO BE ABOUT 200,000 PEOPLE ARE UNDER SHELTERED HOMELESS POPULATION TO BE ABOUT 500. THAT MEANS ONLY 0.25% OF THE POPULATION ARE HOMELESS. THIS IS A 401 RATIO.

WHILE I'M BLESSED TO HAVE INCREDIBLE VOLUNTEERS AND SUPPORT AN INCREDIBLY GRATEFUL FOR MANY OTHER NONPROFITS AND CHURCHES IN OUR TOWN OF MY 200,000 FELLOW NEIGHBORS, I DON'T KNOW ANYONE ELSE WHO HAS COMMITTED TO WORKING YEAR ROUND AND FULL TIME WITH STREET ENGAGEMENT. I'M HONORED BY THE RECOGNITION. THIS COUNCIL GAVE ME BACK IN MAY, BUT ONE FULL TIME OUTREACH WORKER TRYING TO ASSIST 500 FULL TIME UNSHELTERED PEOPLE EXPERIENCING HOMELESSNESS IS MY JOY BUT CAN ALSO BE OVERWHELMING. IMAGINE WHAT WE WOULD HAPPEN IF WE COULD CONSISTENTLY GET FIVE PEOPLE TO COMMIT WITH HELPING ONE PERSON. WELL, I DON'T BELIEVE CONTINUE.

[02:05:03]

WHILE I DON'T BELIEVE IT IS THE COUNCIL'S RESPONSIBILITY, ABILITY TO DO ANYTHING BEYOND UMPIRE WATCHING A LOT OF BASEBALL. I'M SHARING THIS TO INVITE EVERYONE TO GET MORE INVOLVED. PEOPLE EXPERIENCING HOMELESSNESS MAY BE AFRAID TO ASK, BUT YOUR NEIGHBORS NEED YOU. SO HERE'S AN OPPORTUNITY JUST OVER A MONTH FROM NOW TODAY FROM TODAY WE WILL BE HOSTING THANKSGIVING DINNER ON THANKSGIVING DAY AT FIRST MCKINNEY BAPTIST CHURCH. YOU CAN WATCH THE COWBOYS PLAY ON THE GIANT SCREEN, EAT SOME DELICIOUS FOOD AND GET TO KNOW SOME OF YOUR NEIGHBORS EXPERIENCING HOMELESSNESS IN A FAMILY FRIENDLY ENVIRONMENT. MATTHEW 25 WAS READ EARLIER TONIGHT, REFERRING TO JESUS SAYING, WHATEVER YOU DID, FOR THE LEAST OF THESE YOU DID FOR ME AND THE LIST JESUS GAVE. I BELIEVE THE MOST OVERLOOKED THIS. I WAS A STRANGER, AND YOU WELCOMED ME. IF WE TRULY WANT TO KNOW WHY OUR NEIGHBORS ARE EXPERIENCING HOMELESSNESS, WE NEED TO KNOW OUR NEIGHBORS EXPERIENCING HOMELESSNESS TOGETHER, WE CAN MAKE SURE THEY ARE NO LONGER STRANGERS AND RADICALLY CHANGED THE LANDSCAPE OF HOMELESSNESS IN OUR COMMUNITY AND INSPIRE OTHER COMMUNITIES ACROSS THE NATION TO DO THE SAME. THANK YOU. THANK YOU. MEDICA, SHAY MARIA. DID YOU BRING US BRACELETS? DID YOU BRING US BRACELETS? NO, NOT THIS TIME. OKAY GOOD EVENING, AND MOSTLY HONORABLE MAYOR FULLER, RESPECTED COUNCIL MEMBERS AND ALL MY FELLOW MCKINNEY RESIDENTS . SHE WAS THE FIFTH OF 14 KIDS. 10 GIRLS, FIVE BOYS, APPARENTLY BORN WITH THE SMART MOUTH AND A GREAT NEGOTIATING SKILLS, SO SHE MANAGED TO TALK HER WAY OUT OF BEING THE ONE OF THE 14, WHO DID NOT HAVE TO WORK THE FARM THAT HER PARENTS OWN. UM SHE WAS EDUCATED UP TO THE EIGHTH GRADE, WHICH IS THE MAXIMUM WHICH THAT THAT THEY HAD FOR AFRICAN AMERICAN STUDENTS AT THAT TIME. BUT HER PARENTS SAW FIT TO EDUCATE THEIR CHILDREN, SO SHE WAS FORTUNATE ENOUGH TO GO AHEAD AND GO ON TO HIGH SCHOOL, AND SHE FINISHED AT THE TOP OF HER CLASS. BUT STILL FACE A NUMBER OF OBSTACLES ALONG THE WAY. UM SHE ENDED UP ACTUALLY GRADUATING FROM COLLEGE AND GETTING HER MASTER'S DEGREE IN EDUCATION. BUT I ASKED HER ABOUT SOME OF THE OPTICAL OBSTACLE SAID SHE FACED AND WHAT SHE THOUGHT SHE MIGHT HAVE DONE IF THOSE OBSTACLES WEREN'T THERE. AND SHE SAID, I PROBABLY WOULD HAVE BEEN YOU. AND I CANNOT TELL YOU THE SHOULDERS AND I STAND ON BECAUSE OF HER. I AM WHO I AM BECAUSE OF HER. SHE WAS A WONDERFUL WOMAN WHO SPENT HER LIFE SERVING GOD AND SERVING THE PEOPLE OF HER COMMUNITY AND SERVING THE PEOPLE OF GOD. SHE HAD A REMARKABLE LIFE.
