[Conduct a Public Hearing to Consider/Discuss/Act on Design Exceptions to a Site Plan for Commercial Entertainment, Outdoor (McKinney Flour Mill), Located at 601 East Louisiana Street]
[00:00:11]
WHEN THEY EVEN KNOW THAT THIS IS GOING ON. THEY WOULD KNOW BY THE PUBLIC NOTICES THAT WE HAD IN WHEN WE WERE THE SITE PLAN. YES, SIR. SO THEY WOULD THERE WOULD BE AWARE THAT WE HAVEN'T GONE AND ASKED ANYONE AROUND US. THANK YOU. MY QUESTION HAS TO DO WITH THE STAGE YOU MENTIONED.
THIS IS AN OUTDOOR VENUE. SO WOULD YOU BE HAVING BANDS PERFORMING YES, THERE WILL BE MUSIC AND WE'RE ABIDING BY THE RULES THAT WE HAVE ON THE PROPERTY CURRENTLY. WHERE I DON'T REMEMBER THE EXACT TIMES, BUT THERE'S CERTAIN TIMES WHERE WE NEED TO SHUT DOWN THE MUSIC ALL WEEKENDS AND WEEKDAYS. SO WE WOULD ADHERE TO THAT. QUESTIONS ANYONE? THANK YOU, JAMES. WE MAY CALL YOU BACK UP IN A MINUTE. THIS IS A PUBLIC HEARING ON ME COMING TO NINE AND WOULD LIKE TO ADDRESS PLANNING AND ZONING REGARDING AND THIS PROPOSED DESIGN EXCEPTION. PLEASE COME TO THE PODIUM. I'LL MAKE A MOTION THAT WE CLOSED THE PUBLIC HEARING MOTION MINISTER HEGSTROM TO CLOSE THE PUBLIC HEARING. SECOND. SECOND ONE, MISTER WATLEY. ANY DISCUSSION. PLEASE CAST YOUR VOTE.
ALRIGHT THAT MOTION CARRIES A PUBLIC HEARING HAS BEEN CLOSED NOW. DOES ANYONE HAVE QUESTIONS OF STAFF OR OF THE APPLICANT? JAKE CAN YOU CLARIFY ONE THING FOR ME? IS STAFFS CONCERNED THE MATERIAL OR THE HEIGHT OR BOTH? BOTH, OKAY. AND FOLLOW UP QUESTION FOR THE APPLICANT AT 2 TO 4. FT IS THAT JUST DESTROY THE PRIVACY THAT YOU'RE TRYING TO ACHIEVE? AND THAT'S WHY YOU'RE TRYING TO GO FOR THE 6 FT. THAT'S CORRECT AND THE MATERIALS THAT THEY'RE SUGGESTING WHY ARE THOSE BEING CONSIDERED? WHY THE WOOD FENCE VERSUS SOMETHING THAT'S MASONRY OR TWO BIDDERS DEAL WITH THE EVERGREEN BUSHES OR WHATEVER MIGHT BE FILLED IN THERE, YOU CAN SEE RIGHT THROUGH IT, UM, THE MASONRY. IT'S MORE EXPENSIVE THAN CEDAR FENCE THAT WE'RE PROPOSING AND SO WE JUST DIDN'T WANT TO GO OVER BUDGET ON OUR PROJECT AND WOULD STEP BE MORE SUPPORTIVE OF A MASONRY WALL. OR IS THAT STILL A CONCERN AT THAT HEIGHT THAT 6 FT. UM I WOULD SAY IT'S STILL A LITTLE BIT OF A CONCERN AT THAT HIGH, REALLY THE 2 TO 4 FT REQUIREMENT. WHAT THAT'S DOING IS ESSENTIALLY REPLACING A STOREFRONT. SO YOU WALK DOWN DOWNTOWN. YOU LOOK INTO PROPERTIES, AND IT'S ESSENTIALLY A STOREFRONT. THIS IS ESSENTIALLY REPLACING THAT BECAUSE THE BUILDING'S NOT MEETING THE BILL TO ZONE REQUIREMENTS. SO THAT'S THE REASON FOR THAT REQUIREMENT. THANK YOU. YES I HAVE COMMENTS ON YOU KNOW, I'M STRUGGLING A LITTLE BIT WITH UNDERSTANDING THE DOWNSIDE OF CONSTRUCTING A 6 FT. WOODEN FENCE THAT'S APPEALING IN NATURE. SO UM IS THERE. IS THE CITY TURNING THIS DOWN? JUST BECAUSE IT DOES. IT DOESN'T MEET 2 TO 4 FT. SPECIFICATION AND THE MASONRY SPECIFICATION IS THAT IT DOESN'T NECESSARILY MEET THE INTENT OF THE MCKINNEY TOWN CENTER, UM, ZONING DISTRICT, AND THAT'S WHY STAFF IS RECOMMENDING TO BATTLE YOU'RE DOING GREAT. I WANTED TO TALK A LITTLE BIT ABOUT SORT OF JUST MAKING THE DISTINCTION BETWEEN OFFENSE AND A SCREENING DEVICE. SO AS WE'RE LOOKING AT, OBVIOUSLY WOULD FENCES IN AND AROUND MCKINNEY ARE PERMITTED. PRETTY MUCH EVERYWHERE. BUT WHAT WE'RE EVALUATING IT AS AS A STREET SCREENING DEVICE. OUR CODE MAKES THIS DISTINCTION THAT IT'S A SCREENING DEVICE, AND THAT'S WHERE OUR CONCERN WITH THE WOOD COMES IN, WHEN IT'S JUST A TRADITIONAL WOOD FENCE. RIGHT IT'S EVEN WITH THIS IMAGE HERE THAT WOULD HAS FLIPPED HORIZONTALLY TO CREATE SOME ARCHITECTURAL INTEREST, BUT IN THE MCKINNEY CODE IN THE MTC, AS WELL AS THE MASTER CODE WOULD WOULD. IT'S NOT A PERMITTED MATERIALS TO SATISFY A SCREENING DEVICE REQUIREMENT. AM NOT FAMILIAR WITH ANY MODERN PROJECT THAT HAS ALLOWED THAT NOW WITHIN THE MTC. WE RECOGNIZE THAT DESIGN AND URBAN SCALES ARE VERY DIFFERENT. BUT WHEN WE LOOKED AT THE PROPOSED HEIGHT OF 6 FT, PLUS JUST A TRADITIONAL CEDAR FENCE WITH UM, YOU KNOW, AS PROPOSED TO SERVE THAT ST SCREENING DEVICE REQUIREMENT, WE AS A STAFF HAD CONCERNS WITH
[00:05:02]
BEING ABLE TO RECOMMEND APPROVAL OF THAT, UM, KNOWING THAT THE CODE REQUIRES 2 TO 4 PLUS A DIFFERENT TYPE OF MATERIAL. THANK YOU. THANKS. CAN YOU GO BACK TO THE SITE PLAN? WOULD THERE BE AN OPPORTUNITY TO LOCATE THAT? TO THE NORTHEAST. OF THE VENUE. KIND OF IN THE OPEN SPACE TO THE NORTH ON THE PLAN AND NOT HAVE IT UP ON THE STREET FRONT AND BE PROVIDE SOME SEMBLANCE OF LIVING SCREEN AND SCREEN THE WOOD FENCE TO KIND OF BE A MEET IN THE MIDDLE BETWEEN ARE YOU SUGGESTING THAT TALLER FENCE HIDE AROUND THE SIDE? IS THAT WHAT YOU'RE SAYING? THE OTHERA IN THE SOUTHEAST OF THE PLANE PUSHING NORTH A LITTLE BIT, UM AND STILL PROVIDING BEING ABLE TO PROVIDE SOME TYPE OF ST SCREENING. IF THAT'S THE CONCERN IF THE APPLICANT WERE TO MOVE, THE OUTDOOR PATIO SHIFTED SLIGHTLY ON THE SITE PLAN AND BE ABLE TO PRIVATE SOME LEVEL OF SCREENING OR LIVING SCREEN FROM THE STREET . SURE PRIVACY SCREENING THEY'RE LOOKING FOR. I GUESS IF WE'RE TALKING ABOUT SHIFTING THE PATIO AROUND LIKE THE LOCATION OF THE OUTDOOR STUFF, OBVIOUSLY, WE DEFER TO THE APPLICANT, ONE OF THE THINGS THAT WE DID TALK ABOUT AT THE STAFF LEVEL WHEN WE WERE REVIEWING THIS, AND I WISH I COULD ZOOM IN A LITTLE BIT, BUT UM WAS, YOU KNOW, WE RECOGNIZE THAT THERE IS A DESIRE TO HAVE SOME REAL SCREENING ALONG THAT CORNER AND UP THE NORTH SIDE OR THE EAST SIDE OF THE PROPERTY. UM. YEAH THAT'S RIGHT. BETTER, UM, UP THROUGH HERE. AND ALONG THIS SIDE, WE HAVE LESS CONCERNED ABOUT THE 6 FT. KIND OF SURROUNDING THROUGH HERE KNOWING THAT, UM, WHAT IS THAT THROCKMORTON THAT'S GOING UP ON THE EAST SIDE OF IT IS RELATIVELY UNDEVELOPED. RIGHT NOW WE KNOW THAT THEY'RE TRYING TO CREATE THAT SORT OF ENCLOSED SPACE. ONE OF OUR BIGGER CONCERNS WAS THROUGH THIS AREA.ESPECIALLY KNOWING THAT RIGHT THROUGH HERE IS ALREADY THAT SORT OF OPEN. YOU HAVE THAT OPEN VIEW IN BETWEEN AND TO CREATE A 6 FT FENCE ALL THE WAY AROUND. IT'S SERVING THE PURPOSE THAT MR BRUSH NAHAN IS TRYING TO ACHIEVE RIGHT THAT IN CLOSED SPACE, BUT GIVEN THE CODE REQUIREMENTS WHAT JAKE TALKED ABOUT WITH THE CREATING OF THE STOREFRONT AND THE VISIBILITY OF THE OUTDOOR SPACE TO THE WEST. WE HAD CONCERNS THAT THIS WOULD START TO LOOK VERY ENCLOSED, ESPECIALLY WITH THE MATERIAL THAT'S NOT OTHERWISE PERMITTED. SO. TALLER SCREENING DEVICE HERE WE WOULD BE COMFORTABLE WITH, UM WE STILL HAVE THE SAME CONCERNS ABOUT THE MATERIAL OF WOOD, BUT STAFFS PREFERENCE WOULD BE TO SEE THIS AREA HERE. I WISH I USED A DIFFERENT COLOR. UM MEET THE 2 TO 4. BUT HYPE TO CREATE THAT THAT VISUAL SCAPE IN BETWEEN. OTHER QUESTIONS ANYONE? AT MR PRESIDENT. HAN, COULD YOU COME UP, PLEASE? IN YOUR PRESENTATION. THERE ARE TWO DIFFERENT VERSIONS OF WOOD FENCE ONES VERTICAL AND ONE HORIZONTAL. THE LAST SLIDE IN YOUR PRESENTATION SHOWS. THAT THAT'S DIFFERENT THAN UH, SAD BESIDES HEATER PLAYING SO WHICH WHICH IS IT? WHAT ARE YOU PROPOSING? THAT ONE, OKAY? SO CAN WE DISREGARD THE LAST SLIDE IN YOUR PRESENTATION? YEAH THAT WAS AN ATTEMPT IS TO SHOW WHAT IT MIGHT KIND OF WHAT IT WOULD BE LIKE TO BE INSIDE THE VENUE AND SITTING DOWN AND HAVING AN ENCLOSED AREA. OKAY SPECIFICALLY , THAT'S WHAT THE DEFENSE WOULDN'T LOOK LIKE THAT. OKAY. I DID HAVE UH, IF I CAN UM, I HAVE A COMMENT. THAT IF. IF THE SOUTHERN. EXPOSURE TO THE LOUISIANA IF THAT WERE TO BE ME MET. THE 2 TO 4 FENCE TO THE 4 FT FENCE. OR IN A CAR. WOULD YOU CALL IT? IT'S REALLY ST SCREENING DEVICE. THEN MAYBE I COULD I COULD I WOULD BE WILLING TO ADJUST THE PLAN TO IF I COULD HAVE US. THE FENCE THAT I'M PROPOSING ON THE THROCKMORTON SIDE OF THE STREET SIMILAR TO WHAT JENNIFER JUST SPOKE ABOUT. SHE WASN'T SPEAKING FOR ME, BUT THE WAY SHE KIND OF LAID IT OUT IS MAYBE, UH, A COMPROMISE. MISS STRICKLAND. WHAT DO YOU THINK ABOUT THAT? UM I THINK THAT IT'S DEFINITELY SOMETHING FOR US TO CONSIDER. IF WE WERE GOING TO DO THAT, WE MIGHT WANT TO TABLE THIS ITEM AND COME BACK SO THAT YOU CAN WORK WITH STAFF TO COME UP WITH A NEW PLAN BECAUSE I THINK IT MIGHT TAKE A LITTLE BIT OF WORK TO DETERMINE, UM THE DIFFERENT SCREENING MATERIALS THAT YOU WOULD HAVE ON BOTH SECTIONS. THE QUESTION BEFORE US IS NOT WHAT YOU JUST PROPOSED.
[00:10:05]
THAT'S A GOOD QUESTION, BUT IT'S A DIFFERENT QUESTION THAT WE HAVE BEFORE SO THAT'S PROBABLY GOOD ADVICE TO TABLE THE ITEM. SO WE DON'T LEGISLATE FROM OUR SEATS. AND THEN MISS ARNOLD GETS FRUSTRATED BECAUSE WE DIDN'T DO IT EXACTLY LIKE SHE WANTS IT. BLESS HIS SELF. OH SO COMFORTABLE WITH TABLING AND WORKING WITH STAFF TO GET THIS SOMETHING WHERE WE CAN BOTH AGREE AND BE HAPPY WITH LET ME TAKE A CRACK AT EMOTION HERE. I'LL MAKE A MOTION THAT WE TABLE THIS ITEM INDEFINITELY. AND SCHEDULE IT AT A LATER MEETING. TRY TO PIN DOWN A DATE. I BELIEVE. BE ABLE TO SORT THAT OUT BY THE NAME. OKAY? TABLED INDEFINITELY UNTIL THE NOVEMBER 14TH MEETING OR TABLED UNTIL THE NOVEMBER 14TH MEETING. CONTINUE. THE PUBLIC HEARING, CONTINUE THE PUBLIC HEARING AND TABLE IT UNTIL THE NOVEMBER 14TH PUBLICANS OWNING SECOND. ALRIGHT EMOTIONAL MISSION, MR HAGSTROM TO TABLE. THE ITEM CONTINUE THE PUBLIC HEARING UNTIL THE NEXT BACK UP. HAVE EMOTION TO CONTINUE THE PUBLIC HEARING TABLE LEON HIM UNTIL THE NEXT PLAYING IN ZONING COMMISSION MEETING, WHICH IS TUESDAY, NOVEMBER THE 14TH RIGHT? VERY GOOD WITH THAT. THANKS. CONTINUE THE PUBLIC. NO, WE DID WE DID. WE CLOSED THE PUBLIC HEARING, SO WE CAN REOPEN NOW OR DO IT ON THE 14TH. THREE. OPEN IT NOW. OKAY? SO WE NEED TO SEPARATE MOTION EXTRA DUDE IN THIS MOTION , SO YOU NEED TO MODIFY YOUR MOTION. LET ME ADJUST MY MOTION.LET'S REOPEN THE PUBLIC HEARING. AND THEN LET'S CONTINUE IT INDEFINITELY. AND THEN TABLE IT.
CONTINUE THE PUBLIC HEARING TABLE IT UNTIL THE NOVEMBER 14TH PLANNING ITS OWN COMMISSION MEETING. NOW IT'S MY TURN. SO WE HAVE EMOTIONAL MR HAGSTROM TO REOPEN THE PUBLIC HEARING.
CONTINUE THAT PUBLIC HEARING IN TABLE THE AUTUMN UNTIL THE NOVEMBER 14TH 2023 PLANNING HIS OWN COMMISSION MEETING, COMMISSIONER. THANK YOU. 2ND 2ND 1. MISTER WATLEY AFFIRM SECOND.
