ON THE AGENDA IS TWO THREE DASH 0 0 9 1 SP UH, PUBLIC HEARING TO DISCUSS DESIGN EXCEPTIONS TO A SITE PLAN FOR COMMERCIAL ENTERTAINMENT OUTDOOR VENUE MCKINNEY FLOWER MILL.THIS IS AT 6 0 1 EAST LOUISIANA STREET.

UH, THIS IS A SITE PLAN WITH DESIGN EXCEPTIONS REQUESTED BY MCKINNEY FLOWER MILL.
UH, TYPICALLY SITE PLANS ARE APPROVED AT THE STAFF LEVEL.
HOWEVER, WHEN DESIGN EXCEPTIONS SUCH AS THESE ARE REQUESTED, THEY'RE BROUGHT IN FRONT OF THE COMMISSION FOR ACTION.
THE APPLICANT IS PROPOSING AN APPROXIMATELY 3,500 SQUARE FOOT OUTDOOR COMMERCIAL ENTERTAINMENT VENUE.
THE FIRST THREE VARIANCES INCLUDED IN THE STAFF REPORT ARE RE REGARDING BILL TWO ZONE REQUIREMENTS WITHIN THE MTC MCKINNEY TOWN CENTER DISTRICT STAFF HAS NO OBJECTIONS TO THESE DESIGN EXCEPTIONS DUE TO THE FACT THAT THEY, THAT THE EXISTING AND HISTORICAL BUILDINGS ON SITE ARE NOT BEING CHANGED.
AS PART OF THIS PROPOSAL, THE APPLICANT IS ALSO REQUESTING TWO DESIGN EXCEPTIONS TO EXCEED THE REQUIRED HEIGHT OF AND TO UTILIZE AN ALTERNATIVE MATERIAL FOR THE STREET SCREENING DEVICE.
AS REQUIRED, THE STREET SCREENING DEVICE MUST BE BETWEEN TWO AND FOUR FEET IN HEIGHT AND CONSISTS OF A MASONRY WALL OR WROUGHT IRON FENCE WITH LIVING LANDSCAPING.
THE MTC ENCOURAGES A PEDESTRIAN FRIENDLY ENVIRONMENT AND THE REQUIRED STREET SCREENING OF A WALL BETWEEN TWO AND FOUR FEET AND HEIGHT IS INTENDED TO CREATE AN INVITING, WALKABLE ENVIRONMENT WITH BUILDINGS AND FEATURES THAT FRAME THE STREET.
AND WHEN A BUILDING IS NOT PROVIDED WITHIN THE BILL TWO ZONE.
CURRENTLY THE APPLICANT IS PROPOSING TO CONSTRUCT A FULLY OPAQUE SIX FOOT TALL WOODEN FENCE ALONG THE PROPERTY LINES IN THE SOUTHEASTERN CORNER OF THE SITE.
WHILE STAFF DOES, DOES NOT HAVE OBJECTIONS TO THE FIRST THREE VARIANCES BEING REQUESTED, WE CANNOT OFFER A FAVORABLE RECOMMENDATION BASED ON THE LAST TWO VARIS VARIANCES REGARDING THE STREET SCREENING DEVICE.
AS SUCH, STAFF IS RECOMMENDING DENIAL OF THE PROPOSED SITE PLAN AND I'LL STAND FOR ANY QUESTIONS.

AND THEN NOW WE'RE IN THE SITE PLAN, UM, STAGE HERE.
AND, UM, THERE ARE DESIGN EXCEPTIONS BEING REQUESTED AS PART OF THIS, UM, SITE PLAN.
BUT I KIND OF OUTLINED THERE MAYBE A LITTLE BIT HARD TO SEE, BUT JUST IN THE SOUTHEAST CORNER OF THAT SIDE IS WHERE THAT'S I SEE IT.
IS THE SIDEWALK AND THE WOODEN FENCE ON ROCK MORTON OR LOUISIANA? UM, I DON'T BELIEVE THERE IS AN EXISTING SIDEWALK.
IF SO, IT MAY BE ON, UH, EAST LOUISIANA STREET RIGHT THERE.
UM, BUT I'M NOT SURE, UM, IF THERE'S ACTUALLY ONE BEING PROPOSED AS PART OF THIS.
I DON'T THINK THAT IT IS EXISTING EITHER.
SO THE WOODEN FENCE THAT THAT, UM, SIX FEET VERSUS TWO FEET, FOUR INCHES, YEAH.

AND THIS IS OUR FIRST OUTDOOR, UH, WEDDING VENUE THAT PEOPLE CAN HAVE REHEARSAL DINNERS AND UH, BIRTHDAY PARTIES, UH, THAT NATURE.
BUT WE WANT IT TO BE PRIVATE, NOT WHERE PEOPLE CAN LOOK IN AND SEE THAT THERE'S ANOTHER EVENT GOING ON.
UH, 'CAUSE WE WANNA HAVE MULTIPLE EVENTS ON THE PROPERTY AT THE SAME TIME.
SO WE'RE TRYING TO SECTION OFF DIFFERENT AREAS AND THAT'S WHY I'M HERE TODAY.
UM, THIS IS THE VIEW FROM THE PROPERTY, OUR PROPERTY DIRECTLY EAST, AND YOU CAN SEE THAT THE TREE IS FALLEN OVER THERE ON THE CORNER AND THEN ALSO THE BIG BUILDING.
SO IT'S NOT A VERY ATTRACTIVE SITE FROM THE PRIVATE VENUE THAT WE'RE TRYING TO CREATE.
LOOKING EAST, THIS IS LOOKING SOUTH ACROSS THE LOUISIANA STREET AND IT'S NOT AS ATTRACTIVE AS WE WOULD LIKE IT TO BE.
AND THAT IS LOOKING SOUTHEAST CORNER.
THERE'S A, A BUILDING AND A BUSINESS ON THAT CORNER.
SO IT, WHAT WE'RE TRYING TO DO IS, THIS IS A BIRD'S EYE VIEW OF THE SPACE AND THERE IS A, WE WANT TO BUILD A SECURITY FENCE OR A PRIVACY FENCE AROUND THE PERIMETER OF THE SPACE SO THAT THERE'S A SENSE OF PRIVACY IN THERE.
AND THIS IS WHAT THE, UH, IF YOU'RE STANDING ON THROCKMORTON STREET RIGHT NOW, LOOKING TOWARDS THE, THE BUILD THE, UH, SPACE THAT WE WANT TO CREATE, THIS IS WHAT YOU WOULD SEE IF WE WERE ALLOWED TO BUILD THE SIX FOOT WOOD FENCE IF YOU WERE STANDING ON THE STREET.

AND WOULD STAFF BE MORE SUPPORTIVE OF A MASONRY WALL OR IS THAT STILL A CONCERN AT THAT HEIGHT? THAT'S SIX FOOT.
UM, I WOULD SAY IT'S, IT'S STILL A LITTLE BIT OF A CONCERN AT THAT HEIGHT, REALLY, THE TWO TO FOUR FOOT REQUIREMENT, UM, WHAT THAT'S DOING IS ESSENTIALLY REPLACING A STOREFRONT.
SO YOU WALK DOWN DOWNTOWN, YOU LOOK INTO PROPERTIES AND IT'S ESSENTIALLY A STOREFRONT.
THIS IS ESSENTIALLY, UM, REPLACING THAT BECAUSE THE BUILDING'S NOT MEETING THE BILL TWO ZONE REQUIREMENTS, SO.
THAT'S THE REASON FOR THAT REQUIREMENT.
I, YOU KNOW, I'M, I'M STRUGGLING A LITTLE BIT WITH UNDERSTANDING THE DOWNSIDE OF CONSTRUCTING A A SIX FOOT WOODEN FENCE THAT'S APPEALING IN NATURE.
UH, SO, UM, YOU KNOW, IS, IS THERE, IS THE CITY TURNING THIS DOWN JUST, JUST BECAUSE IT DOES, IT DOESN'T MEET THE TWO TO FOUR FOOT SPECIFICATION AND THE MASONRY SPECIFICATION? IS THAT IT? UH, YEAH.
IT DOESN'T NECESSARILY MEET THE INTENT OF THE MCKINNEY TOWN CENTER, UM, ZONING DISTRICT AND THAT'S WHY STAFF IS RECOMMENDING DENIAL.
I, I WANTED TO TALK A LITTLE BIT ABOUT, UM, SORT OF JUST MAKING THE DISTINCTION BETWEEN A FENCE AND A SCREENING DEVICE.
SO AS WE'RE LOOKING, I MEAN OBVIOUSLY WOOD FENCES IN AND AROUND MCKINNEY ARE PERMITTED, UM, PRETTY MUCH EVERYWHERE.
UM, BUT WHAT WE'RE, WHAT WE'RE EVALUATING IT AS AS A STREET SCREENING DEVICE? SO OUR CODE MAKES THIS DISTINCTION THAT IT'S A SCREENING DEVICE AND THAT'S WHERE OUR CONCERN WITH THE WOOD COMES IN, UM, WITH WHEN IT'S, UH, JUST A TRADITIONAL WOOD FENCE.
RIGHT? IT'S, IT'S, YOU KNOW, EVEN WITH THIS IMAGE HERE, UM, THE WOOD IS FLIPPED, UM, HORIZONTALLY TO CREATE SOME ARCHITECTURAL INTEREST, BUT, UM, IN THE MCKINNEY CODE, IN THE MTC AS WELL AS THE MASTER CODE WOOD WOULD, IS NOT A PERMITTED, UM, MATERIAL TO SATISFY A SCREENING DEVICE REQUIREMENT.
UM, I'M NOT FAMILIAR WITH ANY MODERN PROJECT THAT HAS ALLOWED THAT.
NOW WITHIN THE MTC, WE RECOGNIZE THAT DESIGN AND URBAN SCALES ARE VERY DIFFERENT.
UM, BUT WHEN WE LOOKED AT THE PROPOSED HEIGHT OF SIX FEET PLUS JUST A TRADITIONAL CEDAR FENCE WITH, UM, YOU KNOW, AS PROPOSED TO SERVE THAT STREET SCREENING DEVICE REQUIREMENT, WE AS A STAFF HAD CONCERNS WITH BEING ABLE TO RECOMMEND APPROVAL OF THAT.
UM, KNOWING THAT THE CODE REQUIRES TWO TO FOUR PLUS A DIFFERENT TYPE OF MATERIAL, CAN YOU GO BACK TO THE SITE PLAN? WOULD THERE BE AN OPPORTUNITY TO LOCATE THAT TO THE NORTHEAST OF THE VENUE, KIND OF IN THE OPEN SPACE TO THE NORTH ON THE PLAN AND I'LL SAY NOT HAVE IT UP ON THE STREET FRONT AND BE, PROVIDE SOME SEMBLANCE OF LIVING SCREEN AND SCREEN THE WOOD FENCE TO KIND OF BE A MEET IN THE MIDDLE BETWEEN, ARE YOU SUGGESTING THE TALLER FENCE HIDE AROUND THE SIDE? IS THAT WHAT YOU'RE SAYING? YEAH, JUST THE, THE, THE OUTDOOR PATIO AREA ON THE SOUTHEAST OF THE PLAN.

AND STILL PROVIDING, BEING ABLE TO PROVIDE SOME TYPE OF STREET SCREENING, IF THAT'S THE CONCERN.
