CLOSED LANES CLOSED ROADWAYS. UM. THERE WE GO RIGHT DIRECTION. THERE WE GO. UM OVER THE LAST YEAR. YOU KNOW, WE'VE HAD SEVERAL INSTANCES WHERE THERE'S BEEN SOME MAJOR. UH ROAD AND LANE CLOSURES THAT HAVE HAD SOME SIGNIFICANT IMPACTS ON THE PUBLIC. UM WE'VE HAD THAT LANE CLOSED ON VIRGINIA PARKWAY NEAR MALLARD LAKES DRIVE FOR THE BETTER PART OF SIX MONTHS. COUNTY ROAD 317 WHERE THE ROCK CRUSHER OPERATION IS GOING IN, JUST RECENTLY OPENED BACK UP AFTER BEING CLOSED DOWN FOR ABOUT 2.5 MONTHS. COUCH DRIVE IN THE SAME AREA RIGHT OFF OF 546 WAS CLOSED DOWN FOR SEVERAL MONTHS. MCINTYRE ROAD UP OFF A HIGHWAY FIVE. ANOTHER EXAMPLE. UM AS WELL AS A COUPLE OTHERS THAT ARE STILL UPCOMING BLOOMINGDALE ROAD COUNTY ROAD, 123 BY THE HIGHLAND LAKES DEVELOPMENT. UM ANOTHER SECTION OF BLOOMINGDALE ROAD BY THE RIDGELINE DEVELOPMENT. AH ENCORE WIRE IS GOING TO BE LOOKING AT SOME WORK IN THE NEXT YEAR. THAT'S GOT TO GO ACROSS AIRPORT DRIVE. UM AS WELL AS JUST THE VARIOUS, UM UM, UM, LEFT AND RIGHT TURN LANES THAT GOING AROUND TOWN THAT WE TRY TO KEEP THOSE TWO JUST OFF PEAK CLOSURES , WHICH WE CONSIDER 9 A.M. TO 4 P.M. DURING THE MIDDLE OF THE DAY. BUT SOMETIMES THEY FOR VARIOUS REASONS. THEY NEED TO GO OUTSIDE THAT. SO WE'VE BEEN LOOKING AT SOME OF WHAT'S HAPPENED IN THE LAST YEAR. SOME OF WHAT'S COMING UP. UM STARTED TRYING TO FIGURE OUT HOW WE CAN BETTER MANAGE THIS. UM AND WE'RE TALKING ABOUT THIS AS A FEE FOR LANE CLOSURES AS A FEE FOR RIGHT AWAY USE. START OUT, SAYING THAT ARE ARE ARE START OUT BY SAYING THAT OUR DESIRED OUTCOME FOR THIS IS NOT TO COLLECT A ADDITIONAL FEE IF WE CAN HELP IT. UM YOU KNOW, WE, UM, UM, TALK ABOUT TALK ABOUT RIPPING THE BAND AID IF YOU WILL, WHERE IS THE IS, UM IS THE PAIN OF HAVING THE WHOLE ROAD CLOSED FOR TWO OR THREE MONTHS? IS THAT BETTER THAN THE PAIN OF SWAPPING TRAFFIC BACK AND FORTH FOR SIX MONTHS TRYING TO TRY AND TRY TO KEEP IT MOVING? SO AS WE STARTED LOOKING THROUGH THIS ALL OF OUR NORMAL PEER CITIES HERE IN THE NORTH TEXAS AREA, FRISCO, PLANO ALLEN UM, NO ONE'S REALLY DOING ANYTHING LIKE THIS. THERE ARE SEVERAL OF THE LARGER CITIES ACROSS THE STATE THAT DO HAVE, UM HAVE A SIMILAR FEE FOR EITHER USE OF THE RIGHT AWAY LANE CLOSURES. UM FORT WORTH AND AUSTIN SPECIFICALLY, WERE VERY WILLING. THEY HAD STAFF MEMBERS WHO ARE VERY WILLING TO TALK TO US ABOUT THE PROGRAMS THAT THEY HAVE SOME OF THE THINGS THAT THEY'RE DOING. I HAVE AN EXAMPLE OF THEIR OF THE FEE THAT BOTH FORT WORTH AND AUSTIN CHARGE. UM

WE ARE LOOKING RECOMMENDING TO YOU TO ADOPT SOMETHING SIMILAR. HERE IN MCKINNEY, MOVING FORWARD. ASK A QUESTION? YES. YES, SIR. ON YOUR FEET PER SQUARE FOOT. IS THAT JUST THE SQUARE FOOTAGE OF THE WORK THAT THEY'RE DOING? BECAUSE YOU NOTICE YOU HAVE TURNED LENGTH CONSTRUCTION BEING $144 PER DAY, AND MY CONCERN COMES THAT HOW LONG VIRGINIA. WE DON'T WANT TO CHARGE THEM A FEE IF THEY CAN KEEP THE WORK TO THAT 9 A.M. TO 4 P.M. GET THE LANE OPENED BACK UP. WE DON'T WANT TO CHARGE THEM A FEE. WE WANT TO LET THEM DO THAT. UM BUT IF THEY'RE DOING SOMETHING THAT NEEDS A LANE CLOSURE UM, WE'RE RECOMMENDING KIND OF BETWEEN WHAT AUSTIN AND FORT WORTH WE'RE DOING AND LOOKING AT THAT TYPICAL RIGHT TURN LANE CONSTRUCTIONS, THE MOST TYPICAL THING THAT WE SEE. UM LOOKING AT A $300 PER DAY PER LANE CLOSED E AGAIN, THAT'S SIMPLIFYING JUST TO ARGUE, PLACED. ARE YOU CLOSING THE LANE OR NOT NOT LOOKING AT SQUARE FOOTAGE OF CONSTRUCTION OF CLOSURE AREA JUST ARE YOU CLOSING THE LANE OR NOT? UM AS WELL AS IF YOU'RE DOING A FULL ROAD CLOSURE $100 PER DAY PER MILE OF THE DETOUR, AND I'LL GET A LITTLE MORE HAVE A COUPLE EXAMPLES. TALK A LITTLE MORE ABOUT WHY WHY WE'RE THINKING SOME OF THIS HOW IT CAN KIND OF, UM UM. IT BECOMES A LITTLE MORE OF A. IT'S GOING TO MAKE THEM STOP AND THINK ABOUT WHAT THEY'RE DOING A LITTLE BIT. UM. THOSE FEES JUST PAYING PER DAY. MIGHT NOT NECESSARILY BE A BIG DISTANCE SCENTED SO WHAT WE'RE PROPOSING IS AN UPFRONT DEPOSIT NEGOTIATION BETWEEN THE DEVELOPER AND STAFF. LET'S SAY IT'S GOING TO TAKE 60 DAYS TO DO THIS ROADWAY CONSTRUCTION. UM PAY A DEPOSIT UPFRONT, PROPOSING A 50% OF WHATEVER THAT CALCULATED FEE WOULD BE. AND IF YOU MEET THAT DEADLINE I'LL GIVE YOU THAT MONEY BACK. INCENTIVE TENDS TO WORK A LITTLE BETTER THAN DISINCENTIVE IS WHAT WE'VE SEEN IN SITUATIONS LIKE THIS.

OTHERWISE IF YOU CAN'T FINISH THE WORK WITHIN THE AGREED DURATION, THE REMAINING 50% IS DUE AND THE DAILY CHARGES BEGIN TO ACCRUE AFTER THAT. UM AND WE ARE PROPOSING A ESCALATION WITH THAT AS WELL. THAT IF IT GOES BEYOND 30 DAYS HE ESCALATES 25% EVERY 30 DAYS CONTINUES TO ESCALATE UNTIL UNTIL THE WORK WOULD BE DONE. SO WE'RE LOOKING TO DO. THIS WOULD BE AN AMENDMENT TO CHAPTER 90, WHICH IS STREETS AND SIDEWALKS OF THE CODE OF ORDINANCES. THAT'S WHERE , AMONG OTHER THINGS, FRANCHISE UTILITIES ARE IN THERE. THE GENERAL USE OF THE RIGHT AWAY.

BE LOOKING TO ADD THAT IN THERE UM ALL ALL LANE AND ROAD CLOSURES SUBJECT TO APPROVAL BY THE DIRECTOR OF ENGINEERING BEING CLEAR THAT THERE IS NO OBLIGATION. TO CLOSE A ROADWAY.

THAT'S A LITTLE BIT OF A CHALLENGE THAT WE HAVE SOMETIMES RIGHT NOW IS SOMEONE WANTS TO GO OUT THERE AND DO THAT WORK AND WE WANT TO SAY NO. WHERE DO WE HAVE THE AUTHORITY TO SAY? NO AND, SURPRISINGLY, THAT'S THAT'S A HARD ONE. DEFINED IN OUR CURRENT ORDINANCES. UM. WITHIN STAFF WERE GONNA PULL TOGETHER A I AM COMMITTEE WITHIN ALL THE RELEVANT ENGINEERING. GROUPS DEVELOPMENT CAPITAL PROJECTS, TRAFFIC AS WELL AS PUBLIC WORKS SO WE CAN COORDINATE WITH OTHER WORK THAT MIGHT BE GOING ON IN THE SAME AREA TRYING TO TIME THESE THINGS. UM SO WE'RE NOT HAVING COMPETING WORK IN THE SAME AREA. UM THE REFUNDS AND OUR SCHEDULES, AND I'LL TOUCH ON

THIS IN THE EXAMPLES A LITTLE BIT AGAIN. SOMETIMES THERE'S GOING TO BE THERE'S JUST THINGS THAT COME UP THINGS THAT CAN'T BE CONTROLLED, WHETHER WHATEVER WHERE IT MAKES SENSE TO MAYBE EXTEND A SCHEDULE A LITTLE BIT. UM BEING SURE THAT'S ENSHRINED IN THIS ORDINANCE THAT WE CAN BE TIED BACK TO THE OTHER WORK THAT MIGHT BE HAPPENING. SO WE TALKED ABOUT MALLARD LAKES FOR OUR EXCUSE ME. I'M VIRGINIA PARKWAY AT MALLARD LEGS IS ONE OF THOSE EXAMPLES. UM, THEY HAD ONE LANE OF THE THREE LANE EASTBOUND DIRECTION CLOSED FOR THE BETTER PART OF SIX MONTHS. UM THIS WAS A LITTLE BIT OF. THERE THERE. THERE WERE MULTIPLE ISSUES THAT PILED UP TO HAVE THIS ONE HAPPENED. WHAT HAPPENED? THEIR INITIAL PLAN WAS TO JUST BUILD A TURN. LANE AND ONLY CLOSED THE ROAD DURING THE OFF PEAK PERIOD. THE CONTRACTOR GOT SLOPPY. THEY GOT OUT THERE AND MESSED UP. PAVEMENT WITHIN ONE OF THE THROUGH LANES. AND IT WAS, IT WAS DAMAGED FAR ENOUGH THAT IT HAD TO BE CLOSED UNTIL IT COULD BE REPAIRED. UM AND THEN THEY RAN INTO SOME DELAYS WITH A T AND T AS WELL. AND THEN WHILE WHILE ALL THAT WAS HAPPENING, THE ORIGINAL CONTRACTOR ACTUALLY LEFT JOB. UM. SO WHAT I HAVE UP HERE IS AN EXAMPLE OF WHAT THIS FEE COULD THEORETICALLY HAVE BEEN IN A SITUATION LIKE THIS. UM THEY COULD HAVE THEORETICALLY REPAIRED THE DAMAGE PAYMENT IN 30 DAYS, BUT THEY ENDED UP TAKING 180. UM POTENTIALLY A $76,000 FEE THAT IF THEY JUST OPENED THAT BACK UP IN A MUTUALLY AGREED 30 DAYS, THE $4500 DEPOSIT WOULD HAVE ASKED THEM TO PAY THAT WE HAVE REFUNDED THAT TO THEM AND WE ALL COULD HAVE GONE ON WITHOUT THAT HEADACHE FOR SIX MONTHS. MAY I ASK? YES SIR. DEPOSIT COMING FROM THE CONTRACTOR OR THE OWNER? I WOULD PREFER TO PUT THE ONUS ON THE OWNER TO GET HIS CONTRACTOR TO COMPLY RATHER THAN PUT IT ON THE CITY STAFF. UM, COMMENT. YOU KNOW, A YOU KNOW, WOULD HAVE BEEN ROUGHLY $60,000 FEE FOR THE TWO OR SO MONTHS. THEY'VE BEEN CLOSED. UM PROBABLY COULD HAVE BEEN COMPLETED IN ABOUT 45 DAYS. THAT WOULD HAVE BEEN THE $22,000 DEPOSIT. THAT WOULD HAVE BEEN INCENTIVE TO GET IT DONE ON TIME , AND WE'LL REFUND THE $22,000 IF YOU'LL IF YOU GET IT DONE, I DIE. SO AGAIN, IT'S THAT INCENTIVE THERE THAT YOU KNOW. IS REALLY GOING TO MAKE A DIFFERENCE. WE THINK WITH A LOT OF DEVELOPERS CONTRACTORS TO TRY TO GET THAT DONE. GET THAT MONEY BACK. DEPENDING ON THE CIRCUMSTANCES ARE NEGOTIATED AT THE END, SO YOU KNOW, AND ONE OF THE OUTCOMES ON THIS, YOU KNOW, WE WOULD HAVE MADE. MAYBE IF RPM X DIDN'T WANT TO. I DIDN'T WANT TO. PAY THAT MAYBE THEY WOULD HAVE CONSIDERED, YOU KNOW, MAYBE TRYING TO GET SOME TEMPORARY PAVEMENT OUT THERE TO TRY TO MAINTAIN TRAFFIC OR SOMETHING. SAY SOMETHING OUT OF CHARACTER, BUT I CERTAINLY WANT US TO BE DEVELOPMENT FRIENDLY, WITH THE EXCEPTION OF MULTI FAMILY, UM AND I COULD SEE GIVING THEM 30 DAYS OF LANE CLOSURE TO COMPLETE THE PROJECT BUT INCLUDING 100% DEPOSIT AND A FINE OF AT LEAST $500 A DAY TO MAKE IT AN IMPRESSION ON THEM. TO DO THEIR SCHEDULING CORRECTLY. I AM CERTAINLY NOT SYMPATHETIC TO 18 AND T CAUSING VIRGINIA PARKWAY TO BE CLOSED FOR AS LONG AS IT WAS, AND I THINK HAD THAT BEEN SCHEDULED CORRECTLY AND HAD THEY HAD THE INCENTIVE WITH 100% DEPOSIT. FOR THE SIX MONTHS OF CLOSURE THAT THEY HAD THAT THEY WOULD HAVE SCHEDULED IT ACCORDINGLY AND HAD IT DONE APPROPRIATELY. SO I DO THINK THERE'S AN AVENUE WHERE WE COULD GIVE THEM A SPECIFIC PERIOD OF TIME BUT STILL REQUIRE THE DEPOSIT. AND THEN START IMPOSING THAT FINE PER DAY IMMEDIATELY ONCE THAT PERIOD HAS EXPIRED.

THIS IS FOR WASTE CONNECTIONS FOR THE PERIOD OF JANUARY 1 2024 THROUGH OCTOBER 1 2024 WHEN OUR NEW CONTRACT WITH FRONTIER WASTE SOLUTIONS WILL BEGIN ONLY ABOUT FOUR SLIDES FOR YOU TODAY. VERY FAST AGENDA. VERY BRIEF OVERVIEW. DISCUSSION OF THE RATES AND VERY SPECIFICALLY, THE CONVERSATION TODAY WILL CENTER AROUND THE CONSUMER PRICE INDEX INCREASE THAT CONTRACTUALLY THE CITY IS OBLIGATED TO PAY TO WASTE CONNECTIONS. WE WANT TO MAKE SURE THAT THE COUNCIL CONCURS WITH THE STAFF RECOMMENDATION TO PASS THAT ALONG, AS WE HAVE DONE FOR THE LAST SEVERAL YEARS. SO VERY BRIEF, UM, KIND OF CURRENT FORM THAT RELATIONSHIP WITH WITH WASTE CONNECTIONS AND ITS PREDECESSOR COMPANIES GOES BACK TO 1996. BUT IN ITS CURRENT FORMAT, THIS AGREEMENT EXECUTED IN 2008 THE AMENDMENTS UP THERE AND REALLY THIS 2021 AMENDMENT FOR THOSE WHO ARE ON THE COUNCIL AT THAT POINT IN TIME, WE SIGNED BASICALLY A THREE YEAR REVISED VERSION OF OUR AGREEMENT WITH THEM THAT PUT SOME MORE MONEY PUT SOME MORE DOLLARS IN THEIR POCKET. AND GOT US THROUGH THE LIFE OF THE EXISTING AGREEMENT, WHICH IS SEPTEMBER OF 2024. THERE'S REALLY 22 PRIMARY COMPONENTS TO THAT ONE ON THE COMMERCIAL SIDE OF IT, WHICH WAS A 25% INCREASE OVER THE COURSE OF THREE YEARS. 10% 10% 10% THAT IS NOW DONE GOT DONE. LAST YEAR, THERE WAS A DOLLAR SIX ORIGINALLY IN 2021 INCREASE ON THE RESIDENTIAL SIDE OF IT. BUT ONE OF THE THINGS THAT THE COUNCIL ALSO AGREED TO WAS FOR EACH OF THE RESPECTIVE YEARS ON JANUARY 1 TO ALLOW THE CITY TO PAY FOR THE C P I INCREASE, ASSUMING THERE WAS ONE FROM THE PREVIOUS YEAR. WHAT WE HAVE DONE EACH OF THOSE PREVIOUS YEARS HAS PASSED THAT, ALONG TO THE NEXT SLIDE WILL SHOW WHY STAFF WILL RECOMMEND DOING THAT AGAIN THIS YEAR, BUT CERTAINLY WOULD STAFF DID NOT WANT TO BE PRESUMPTUOUS ABOUT THAT. SO IF YOU LOOK AT THE TOP LEFT CORNER OF THIS SLIDE, OUR CURRENT RATE IN MCKINNEY IS 1790. 1792 MONTH, EVEN WITH THIS RATE INCREASE, WHICH ABOUT MIDWAY THROUGH LOWER PART WOULD BE TAKE US TO A MONTHLY FEE OF 1861 WILL BE THE SECOND LOWEST FROM OUR IMMEDIATE SISTER CITIES. ALLEN IS EXPECTED TO GO BUY ANOTHER DOLLAR LATER THIS YEAR AS WELL. SO WE ARE CERTAINLY AH, WELL IN IF NOT BELOW THE AVERAGE FOR OUR SISTER CITIES. THE CITY HAS ALREADY MADE THE OBLIGATION THAT WE WILL BE PAYING WASTE CONNECTIONS THOSE ADDITIONAL DOLLARS SO THIS WOULD BE THE PASS ALONG STARTING JANUARY 1 TO THE RESIDENTS. AND THEN KIND OF TEEING UP FOR A FUTURE CONVERSATION AROUND THE MARCH TIMEFRAME. I'LL BE BACK BEFORE YOU WITH REALLY A MORE COMPREHENSIVE DISCUSSION AROUND WHAT HAPPENS DURING THE OCTOBER TIMEFRAME.
