MY NAME IS MIRANDA VAN DER HEIDEN. I LIVE IN MCKINNEY, I AM A SOCIAL WORK GRADUATE STUDENT AT TEXAS A&M UNIVERSITY. I'M HERE TODAY TO PETITION FOR INCREASED SUPPORT FOR HOUSING FIRST INITIATIVES. COLLIN COUNTY IS ONE OF THE FASTEST GROWING COUNTIES IN THE UNITED STATES, AND HAS ONE OF THE MOST EXPENSIVE HOUSING MARKETS IN TEXAS. DESPITE THE CONTINUAL GROWTH OF THE POPULATION, THERE IS NOT A SHELTER FOR THOSE THAT ARE EXPERIENCING A LACK OF AFFORDABLE HOUSING IN COLLIN COUNTY, THE ANNUAL POINT IN TIME REPORT FOUND THAT THERE WERE 3718 PEOPLE THAT WERE UNHOUSED DURING THE NIGHT. THE SURVEY WAS TAKEN IN JANUARY. HOUSING FIRST IS AN APPROACH TO COMBATING HOMELESSNESS THAT IS BUILT ON THE BELIEF THAT HUMANS NEED NECESSITIES SUCH AS FOOD AND SHELTER, BEFORE THEY HAVE THE CAPACITY TO ATTEND TO ANYTHING THAT IS NOT AS CRITICAL, INCLUDING FINDING A JOB OR GETTING TREATMENT FOR SUBSTANCE ABUSE. THIS APPROACH TO HOUSING DOES NOT REQUIRE ALL PRESENTING ISSUES TO BE ADDRESSED AT THE BEGINNING OF THE PROCESS, BUT THAT ONCE AN INDIVIDUAL IS SHELTERED, THEY CAN BEGIN TO ATTEND TO THE OTHER CIRCUMSTANCES OF THEIR LIVES. RESEARCH SHOWS THAT HOUSING FIRST IS AN EFFECTIVE TOOL TO COMBAT HOMELESSNESS AND PROVIDE A STABLE SHELTER. STUDIES HAVE SHOWN THAT THE HOUSING FIRST APPROACH CAN SAVE UP TO $23,000 PER CONSUMER PER YEAR THAN A SHELTER PROGRAM. FOR EVERY DOLLAR INVESTED IN HOUSING FIRST PROGRAMS, THE AVERAGE AMOUNT SAVED ON EMERGENCY HOUSING, HEALTH CARE, JUDICIAL SERVICES AND WELFARE COSTS. 144 $1.44. I'M A DRAINAGE ENGINEER WITH THE CITY. AND THIS ITEM IS AN APPEAL OF A DECISION BY CITY STAFF NOT TO ADDRESS EROSION THAT'S OCCURRING ON THE PROVINCE. HOA PROPERTY. SO WE'VE GOT A SHORT PRESENTATION, AND THEN I CAN TAKE QUESTIONS WHEN I'M DONE. LAURA WALLACE WITH THE PROVINCE HOA IS ALSO HERE, AND SHE'LL OFFER SOME ADDITIONAL INFO AND TAKE QUESTIONS IF YOU'D LIKE. SO REAL QUICK. THIS IS JUST AN OVERVIEW OF THE ISSUE. THE PROPERTY ON THE LEFT WHERE IT SAYS STONEBRIDGE RANCH COMMUNITY ASSOCIATION, IS OWNED BY THE STONEBRIDGE HOA. IT'S A RETENTION POND THAT WAS BUILT IN 2005, AND WE'LL GET INTO HISTORY IN A FUTURE SLIDE. THE GREEN AREA IN THE MIDDLE IS PROVINCE HOA PROPERTY. THERE IS A. OBVIOUSLY, YOU CAN SEE THE EROSION OCCURRING THERE ON THE KIND OF THE LEFT SIDE. JUST FOR REFERENCE, THE GREEN LINES ARE CITY STORM SEWER LINES. THE PURPLE LINES ARE CITY STORM DRAIN LINES. THAT STREET THERE IS RAPHAEL COURT JUST FOR REFERENCE. THIS IS KIND OF NEAR THE APEX CENTER NEAR ALMA AND EL DORADO. A BRIEF HISTORY. IN 2005, THAT POND WAS BUILT BY THE STONEBRIDGE HOA WITH GROUTED ROCK RIPRAP FOR SLOPE PROTECTION, THE PHASE ONE OF THE PROVINCE TOWNHOMES WAS PLATTED IN 2016, AND THE PROVINCE TOWNHOMES IS 8% OF THIS PARTICULAR WATERSHED. AND YOU'LL SEE A MAP ON THAT IN A SECOND. TWO GROUTED ROCK RIPRAP WAS SEEN IN A PICTURE THAT HAD ALREADY BEGUN TO FAIL BY 2017. IN 2021, THE EROSION BEGAN TO CUT UPSTREAM ONTO THE PROVINCE PROPERTY. 2024 THE PROVINCE HOA AND THE STONEBRIDGE HOA ASKED THE CITY FOR ASSISTANCE WITH THIS EROSION ISSUE, AND OUR RESPONSE WAS THAT EROSION IS A NATURAL PHENOMENON. IT'S UP TO PRIVATE PROPERTY OWNERS TO ADDRESS EROSION ON THEIR PROPERTY, HOW THEY SEE FIT, AND OUR POLICY HAS CERTAIN SITUATIONS WHERE WE WOULD STEP IN WITH CITY TAX DOLLARS TO ADDRESS IT. AND JUST IN SUMMARY, ONLY IF PUBLIC INFRASTRUCTURE IS THREATENED, WHICH IS NOT THE CASE HERE OR IF PERMITTED, PRIVATE STRUCTURES ARE THREATENED AND ALSO NOT THE CASE HERE. THIS IS A BRIEF SUMMARY OF THE APPEAL, WHICH LAURA COULD [00:05:04] EXPAND ON. BUT THERE'S TWO POINTS TO IT THE SAFETY RISK AND THE ECONOMIC IMPACT. AND I THINK THE IMPACT ONE, YOU CAN SEE THE NUMBERS THERE. THEY GOT A QUOTE FROM POND MEDICS TO FIX THE ISSUE. AND BY SPLITTING IT WITH THE STONEBRIDGE HOA, THE PROVINCE SHARE WAS GOING TO BE ROUGHLY 60 GRAND, WHICH WAS GOING TO BE QUITE A BIT OF MONEY FOR EACH OF THE HOMEOWNERS IN THE PROVINCE NEIGHBORHOOD. THE 2016 PROVINCE PLAT ALSO HAS A NOTE ABOUT, THE HOA IS SOLELY RESPONSIBLE FOR COMMON AREA MAINTENANCE, AND I'LL SHOW YOU THAT IN A MINUTE. TWO HERE'S AN OVERVIEW OF THE AREA. ALL THE RAIN THAT FALLS IN THAT BLUE SHAPE EVENTUALLY MAKES ITS WAY DOWN TO THE PINK DOT, AND THE WHITE SHAPE KIND OF ON THE LOWER SIDE OF THE PICTURE IS THE PROVINCE TOWNHOME. HOA WHICH IS, LIKE I SAID A MINUTE AGO, 8% OF THE WATERSHED, THOSE PURPLE LINES ARE STORM DRAIN LINES. THAT APEX CENTER IS KIND OF OFF TO THE RIGHT. THE GREEN SHADED AREA IS A DIFFERENT WATERSHED. IT'S EVERYTHING IN THE BLUE SHAPE COMES DOWN TO THIS PARTICULAR SPOT. THAT'S WHAT IT LOOKED LIKE IN 2006. THE STONEBRIDGE POND WAS BUILT IN 2005. PROVINCE ON THE RIGHT WAS NOT YET BUILT, AND THAT GROUTED ROCK RIPRAP IN THE MIDDLE. THERE WAS WHAT WAS PUT IN WITH THE POND TO PROTECT AGAINST EROSION. AND IN 2006, IT LOOKED IT LOOKED GREAT, BUT BY 2017 IT HAD ALREADY BEGUN TO FAIL. THERE'S NOT SUPPOSED TO BE PUDDLES OF WATER THERE. THE ROCK HAD BEGUN TO BREAK UP. THERE PROBABLY SHOULDN'T BE TREES THERE EITHER. SO THAT WAS JUST A PROOF THAT IT'S NOT FUNCTIONING PROPERLY. 2020 THAT'S AN AERIAL SHOT. YOU CAN SEE ON THE LEFT SIDE CLOSE TO THE WATER'S EDGE. THERE'S THOSE TWO AT LEAST TWO POOLS WHERE THE RIPRAP HAD BEEN FAILING. JANUARY OF THIS YEAR. WE WENT OUT THERE WITH THE STONEBRIDGE HOA AND PROVINCE HOA AND THIS IS JUST ONE OF THE PHOTOS WHERE THE EROSION HAD STARTED TO CUT BEYOND ALL THE RIPRAP INTO THAT OPEN GRASSY AREA AND THAT OPEN GRASSY AREA, KIND OF LOOKING INTO THE PICTURE IS PROVINCE HOA PROPERTY, KIND OF TO THE LEFT OF THE TREES IS THE STONEBRIDGE PROPERTY. THERE WAS SOME BIG STORMS IN MAY AND JUNE. THIS ONE EVEN BROUGHT OUT A SKIMBOARDER WHO WAS ENJOYING THE WATER WHILE IT WAS FLOWING HIGH. I GUESS THIS IS A PICTURE DURING I THINK, THE JUNE 2ND STORM FROM ONE OF THE HOMES THERE. AS YOU CAN SEE, ALL THE WATER FLOWING THROUGH THAT GRASSY AREA. THE JUNE 2ND STORM WAS PARTICULARLY A BIG STORM. AND I WILL SAY THOUGH, THAT EVEN DURING THAT STORM, THAT'S WHERE THE WATER IS KIND OF SUPPOSED TO GO. IT DIDN'T GET OUTSIDE OF THE DRAINAGE EASEMENT FOR THAT COMMON AREA AND DIDN'T FLOOD ANY HOUSES OR ANY STREETS THAT I'M AWARE OF. THIS IS A PICTURE RIGHT AFTER THAT STORM, PROBABLY THAT EVENING, KIND OF THE AFTERMATH. AND YOU CAN JUST SEE KIND OF THE WATER CASCADING OVER THE LITTLE WATERFALL THERE. AND THAT'S THAT'S GOING TO CONTINUE. THAT'S THE AERIAL SHOT. THE MOST RECENT AERIAL SHOT WE HAVE. AND THE EROSION WILL LIKELY CONTINUE IF NOTHING'S DONE THROUGH THAT GRASSY AREA. NOW THAT IT'S KIND OF PAST THE RIPRAP, IT WILL PROBABLY KEEP GOING TO THE NORT, YOU KNOW, OFF THE PAGE, I GUESS. BUT THAT'S HOW THE WATER FLOWS WHERE THOSE BLUE ARROWS ARE, AND THE EROSION IS JUST GOING TO KEEP CUTTING UPSTREAM. THIS IS OUR MOST RECENT PHOTO FROM JUST TWO WEEKS AGO, AND IT WAS EVEN WORSE THAN IN JUNE. SO IT CONTINUES WITH ALL THE BIG STORMS NOW THAT WE'RE IN JULY, ALMOST AUGUST, I THINK IT'S SORT OF SLOWED, BUT PROBABLY IN SEPTEMBER WHEN IT STARTS RAINING AGAIN, IT'S GOING TO PICK UP AGAIN. THIS IS THE NOTE ON THE 2016 PROVINCE PHASE ONE PLAT THAT SEEMS PRETTY CLEAR ABOUT MAINTENANCE RESPONSIBILITY FOR THIS PROPERTY. NUMBER SIX COMMON AREAS ARE TO BE OWNED AND MAINTAINED BY THE HOA. NUMBER EIGHT, THE OWNERS OF BLOCK A LOT, ONE OF THIS PLAT SHALL BE SOLELY RESPONSIBLE FOR THE MAINTENANCE OF THE CREEK, INCLUDING ALL EROSION CONTROL, TRAVERSING SAID LOT. THE OWNER SHALL FURTHER HOLD THE CITY OF MCKINNEY HARMLESS FROM ANY DAMAGES, AND IT GOES ON. SO THAT'S ONE OF THE NOTES ON THE 2016 PLAT. LAURA COULD PROBABLY SPEAK TO THAT MORE, BUT I THINK THEY WERE ROUGHLY SPLITTING IT. SO THE 60,000 APPROXIMATE NUMBER WAS THE PROVINCE SHARE, WHICH IS WHY IT'S DISPROPORTIONATE, BECAUSE THEY ONLY HAVE 8% OF THAT. I THINK THEY WERE JUST SPLITTING IT 5050 BECAUSE IT WAS THE TWO PROPERTIES. BUT THERE'S NO CITY PROPERTY THERE. YEAH. SO THE POND AND THE GRASSY AREA ARE BOTH TWO DIFFERENT HOA PROPERTIES. THE STREET IS THE ONLY CITY PROPERTY THAT'S NEARBY. WHAT IS THE REQUEST TO THE CITY FOR THEM TO PICK UP A MAJORITY OF IT, OR TO SOMEHOW DO A SPLIT OR. AND IN OUR RESEARCH OF THE CITY DRAINAGE POLICY, IT CAME TO OUR ATTENTION ON THE SUMMARY PAGE, WHICH WE HAVE UP HERE, THAT THERE ARE SOME CIRCUMSTANCES, APPARENTLY, IN WHICH THE CITY WILL CONSIDER ADDRESSING DRAINAGE CONCERNS ON PRIVATE PROPERTY. IF THE ANSWER IS YES TO ANY OF THESE QUESTIONS. SO WE LOOKED AT THIS FROM A HOMEOWNER PERSPECTIVE AND A RESIDENT OF MCKINNEY PERSPECTIVE. SO IN OUR ASSESSMENT WE FEEL THAT THERE'S A HIGH RISK OKAY. WE GET A LOT OF PEOPLE FROM OUTSIDE OF OUR COMMUNITY AND YOU SAW AN EXAMPLE OF OUR WAKEBOARDER, WHICH IS NOT THE ONLY EXAMPLE THAT WE HAVE SEEN OVER THE YEARS OF PEOPLE COMING INTO OUR COMMUNITY AND KIND OF TREATING THAT AREA AS A PUBLIC PARK, AND IN SOME CASES, A WATER PARK, AS YOU SAW, SO THIS IS A BIG CONCERN TO US BECAUSE BECAUSE OF THE SIZE OF THAT SCOUR HOLE, THERE IS ALWAYS, ALMOST ALWAYS STANDING WATER PRESENT THERE, WHICH POSES POTENTIALLY A DROWNING RISK, ESPECIALLY TO SMALL CHILDREN. AND WE DO GET CHILDREN FROM OTHER NEIGHBORHOODS THAT COME OVER THERE TO FISH AND WHATNOT. AND THEY DISREGARD ANY TYPE OF SIGNING WE HAVE. WE CURRENTLY HAVE CAUTION FENCING AROUND THE AREA TO TRY AND DISCOURAGE PEOPLE, BUT WE ARE CONSTANTLY CHASING PEOPLE OUT OF THE AREA. CALLING THE MCKINNEY POLICE, ETC, SO FROM OUR PERSPECTIVE, WE BELIEVE IT. IT PRESENTS A SIGNIFICANT LIFE SAFETY RISK, FLOOD RISK, WHICH THIS WAS SOMETHING ACTUALLY FLOOD RISK AND EROSION RISK ARE TWO THINGS THAT WE ACTUALLY WENT BACK AND LOOKED AT AFTER THE STORMS IN MAY AND JUNE, BECAUSE WHAT WE SAW WAS SIGNIFICANTLY MORE WATER GOING THROUGH THAT AREA AND ENCROACHING MORE AND MORE UPON, THE RESIDENCES, NOT NO FLOODING. DANNY'S CORRECT. THERE WAS NOT ANY FLOODING, BUT COMING VERY CLOSE TO THE SIDEWALK AND THE ROAD. AND ON ONE SIDE TO A RESIDENTIAL BUILDING, SO THAT CONCERNED US, SO, YOU KNOW, HERE THE QUESTION IS, ARE RESIDENTIAL DWELLINGS AND OR ROADS CURRENTLY AT AN INCREASED RISK OF FLOODING FROM STORMS UP TO AND INCLUDING THE 100 YEAR STORM AND OUR RESPONSE IS POSSIBLY, I DON'T KNOW WHAT 100 YEAR STORM IS, BUT [00:15:08] I DON'T THINK THAT WE HAD ONE IN MAY AND JUNE, SO I DON'T KNOW WHAT THAT WOULD LOOK LIKE IF WE WERE PRESENTED WITH A 100 YEAR STORM, EROSION RISK, OUR EROSION PROTECTED STRUCTURES AT RISK OF DAMAGE BY EROSION FROM STORMS UP TO AND INCLUDING THE 100 YEAR STORM. AGAIN, I DON'T KNOW, WE SAY IT'S LIKELY, AND ACTUALLY, IN OUR DISCUSSION WITH THE CITY, LAST WEEK, THERE WAS ACTUALLY A COMMENT THAT EROSION HAS CUT UPSTREAM APPROXIMATELY 30FT IN THREE YEARS. IT COULD BE 3 TO 5 YEARS BEFORE PUBLIC INFRASTRUCTURE IS THREATENED BY THIS EROSION. SO THERE CERTAINLY APPEARS TO BE A POSSIBILITY OF THAT, AND OUR QUESTION IS, WHY WOULD WE WAIT FOR THAT TO HAPPEN? YOU KNOW, THINGS SELDOM GET BETTER OR LESS EXPENSIVE TO ADDRESS THE LONGER YOU WAIT TO ADDRESS THEM, ECONOMIC IMPACT. SO WOULD IMPROVEMENTS LIKELY ENHANCE PROPERTY VALUES AND OR PROVIDE ECONOMIC BENEFIT TO THE CITY? SLIGHT BENEFIT. RIGHT. BUT ANY TIME THAT YOU HAVE INCREASED VALUE, YOU KNOW, A PROPERTY'S OBVIOUSLY, YOU KNOW, THAT'S A BENEFIT TO MCKINNEY, NOW FROM OUR PERSPECTIVE, IT'S A SIGNIFICANT ECONOMIC IMPACT. WE ARE A COMMUNITY OF ONLY 67 HOMES. WE WERE ORIGINALLY THERE'S A LONG BACK STORY ABOUT PROVENCE AND MAYBE SOME OF YOU KNOW IT AND SOME OF YOU DON'T, BUT IT WAS ORIGINALLY PLANNED TO BE AN EXCLUSIVELY TOWNHOME COMMUNITY WITH 80 TOWNHOMES. LONG STORY SHORT, IT IS NOW 67 HOMES. WE HAVE 29 TOWNHOMES AND 38 PATIO HOMES, THE BUILDER DID GO BANKRUPT AND LEFT US WITH SOME OTHER ISSUES THAT WE ARE ALSO TRYING TO ADDRESS, FINANCIALLY. SO THIS IS THE BOTTOM LINE. THIS IS THE LOWEST AMOUNT. THAT WE WOULD ANTICIPATE. NOW WE HAVE, AGAIN, 67 HOMEOWNERS, I BELIEVE STONEBRIDGE HAS SEVERAL THOUSAND. SO THE IMPACT TO INDIVIDUAL HOMEOWNERS IS VERY DISPARATE. EVEN THOUGH THE AMOUNT OF PROPERTY IS NOT. SO, AND THEN THE OTHER THING OBVIOUSLY IS THERE IS, 150 ACRES OF WATERSHED COMING THROUGH THAT LITTLE CORNER OF OUR PROPERTY, OF WHICH WE CONTRIBUTE 8. BUT WE'RE GOING TO GET 100% OF THE BILL FOR IT, ACCESSIBLE TO THE PUBLIC. WE'VE ALREADY TALKED ABOUT THIS. THERE IS FULL PUBLIC ACCESS.
