THIS IS OUR CITY COUNCIL REGULAR MEETING, WE WILL BEGIN WITH AN INVOCATION AND PLEDGE OF ALLEGIANCE. THE INVOCATION WILL BE GIVEN BY BILL MILLER FROM CHRIST FELLOWSHIP CHURCH. IT SHOULD BE BRUCE. ALL RIGHT, THEN, WE WILL GO WITH IN A DIFFERENT DIRECTION. I WILL GIVE THE INVOCATION. BRACE YOURSELF. LORD, WE THANK YOU FOR EVERYONE THAT'S HERE TODAY.

BEING ENGAGED IN OUR COMMUNITY, CARING ABOUT OUR COMMUNITY. WE THANK YOU FOR THAT SPIRIT AND THAT THAT POPULATION HERE IN OUR IN OUR GREAT CITY OF MCKINNEY, TEXAS, WE ASK THAT YOU GUIDE US TONIGHT AS WE GO THROUGH THE BUSINESS AT HAND. GIVE US WISDOM. LET US HEAR FROM OUR CONSTITUENTS AND MAKE THE BEST DECISIONS THAT WE CAN, JUST GUIDE US TONIGHT IN JESUS NAME I PRAY. AMEN. AMEN PLEDGE ALLEGIANCE TO THE FLAG OF THE UNITED STATES OF AMERICA. AND TO THE REPUBLIC FOR WHICH IT STANDS. ONE NATION UNDER GOD, INDIVISIBLE, WITH LIBERTY AND JUSTICE FOR ALL, ALL. JOHN. YEAH DEBORAH, I WANT TO APOLOGIZE FOR THAT INVOCATION. COMPLETELY OFF GUARD. DEBORAH BRADFORD, YOU'RE HERE. WHERE ARE YOU? OH, WELL, HOW DID YOU LEAVE ME HANGING LIKE THAT? YOU'RE RIGHT THERE IN THE BACK ROW. YOU SHOULD HAVE STOOD UP. YEAH YES. ALL RIGHT.

WE'LL HAVE A DISCUSSION AFTERWARDS. ROB TEMPLE, YOU TO LOOK AT ALL OF YOU BEING ALL OF YOU DEACONS AND PASTORS. JUST QUIET OUT THERE, ALL RIGHT, NEXT ORDER OF BUSINESS, PUBLIC

[PUBLIC COMMENTS ON AGENDA ITEMS (for Non-Public Hearing Items)]

COMMENTS ON AGENDA ITEMS. WE WILL GO AHEAD. SINCE THERE'S ONLY TWO ON NON-AGENDA ITEMS THAT WE WILL HEAR ALL COMMENTS AT THE FRONT OF THE MEETING. SO YOU DON'T HAVE TO WAIT, YOU'LL HAVE TWO MINUTES WHEN YOU COME UP. PLEASE STATE YOUR NAME AND ADDRESS. FOR THE RECORD, THERE WILL BE A TIMER TO YOUR LEFT AND RIGHT. IF YOU'RE NOT FAMILIAR WITH THE PROCESS, THAT WILL SHOW YOU THE TIME THAT YOU HAVE REMAINING. IT WILL TURN YELLOW AT 30S AND READ THE LAST FIVE SECONDS. PLEASE ADHERE TO THE TIME SO EVERYONE CAN SPEAK AND HAVE AN EQUITABLE TIME AT THE PODIUM. FIRST IS SHEKHAR NAYYAR. HI. GOOD EVENING EVERYBODY, THANK YOU FOR GIVING ME AN OPPORTUNITY TO SPEAK. I'M A RESIDENT OF MCKINNEY, BEEN THERE FOR FOUR YEARS, AND IT INDEED IS A GREAT CITY. BUT I'M HERE TODAY TO OPPOSE, THE REZONING OF THAT FOUR STORY HOTEL, ON, CLOSE, CLOSE TO OUR, HARDING VILLAGE, COMMUNITY. I'M CURRENTLY A GENERAL MANAGER OF OUR LUXURY HOTEL IN DALLAS, AND I'VE BEEN RUNNING HOTELS FOR THE LAST 40 YEARS. I HAVE RUN SMALL HOTELS, LARGE HOTELS IN VARIOUS CITIES, ALL ACROSS THE US. FOR MOST PEOPLE, THEY JUST THINK HOTEL IS A POOL. A LARGE TV AND HAVE FUN. BUT THERE IS A LOT MORE INVOLVED WITH THE HOTEL. HOTEL CREATES A LOT OF TRAFFIC AND IT IS TOO CLOSE TO A RESIDENTIAL AREA. I GET IT, WE HAVE TO INCREASE THE TAX BASE FOR MCKINNEY, BUT I THINK THERE IS PLENTY OF OTHER LAND ACROSS THREE, 80 AND OTHER PLACES WHERE IT WILL BE MORE APPROPRIATE. HOTELS CAUSE A LOT OF TRAFFIC. HOTELS CAUSED A LOT OF ISSUES WITH FREQUENCY OF THE DELIVERY TRUCKS, FOOD, LAUNDRY AND THEN CERTAINLY THERE IS CERTAIN CRIME ELEMENT WHICH COMES WITH EVERY HOTEL LUXURY OR NON LUXURY HOTEL. THERE'S HUMAN TRAFFICKING INVOLVED. THERE'S CAR BREAK-INS INVOLVED. SO I'M HERE TO OPPOSE REZONING AND BUILDING OF THE HOTEL. SO CLOSE TO THE RESIDENTIAL AREA, ESPECIALLY THAT ROAD WHICH BORDERS THE HOTEL AND THE RESIDENTS IS SO SMALL. AND THE TRAFFIC IT WILL BE TOTALLY BE INAPPROPRIATE. AND I WOULD CONTINUE TO ENJOY GREAT CITY OF MCKINNEY. THANK YOU FOR THE CONSIDERATION. THANK YOU. THANK YOU SIR. CHRIS FAULK. HI, MY NAME IS CHRIS VOKE. I'M AT 1613 CANADIAN LANE IN MCKINNEY. JUST ACROSS THE STREET FROM WHERE THE PROPOSED HOTEL IS TO THE PROPOSED REZONING REQUEST. AND I UNDERSTAND THERE'S A MOTION TO OR MAYBE A MOTION TO TABLE. AND

[00:05:05]

I WOULD JUST SAY I SUPPORT THAT. THE WRITTEN PROTEST PROCESS, WHICH WE WERE SO, SO CLOSE IN, IN ACHIEVING THOUGHT THAT WE WERE THAT WE WEREN'T A LITTLE CONFUSING SO WOULD APPRECIATE, YOU KNOW, KIND OF OPPORTUNITY TO GO WITH THAT, KNOWING WHAT WE KNOW NOW ABOUT WHAT THE WHAT THE STANDARDS ARE. AND LIKE SEAN SAID, JUST YEAH, OPPOSE FOR THE SAME REASONS. AND IT'S SO CLOSE TO COCKRELL MIDDLE SCHOOL. SO YEAH, JUST WOULD SUPPORT THE TABLING FOR THAT. THANK YOU.

THANK YOU CHRIS. IT JUST AS YOU WERE TALKING CHRIS. NO, I'M DONE AS, AS YOU WERE SPEAKING, I WAS REMINDED THAT THE HOTEL IS A PUBLIC HEARING ITEM. NOW, WE ARE GOING TO TABLE THAT ITEM FOR A FEW DIFFERENT REASONS THAT WERE DISCUSSED EARLIER TODAY, BUT THE TIME TO SPEAK ON THAT ITEM ACTUALLY WILL BE WHEN I CALL IT, EVEN THOUGH WE'RE GOING TO TABLE IT. SO IF YOU ARE, WHEN I CALL YOUR NAME, ACTUALLY, I'LL KNOW BY THE NUMBER THAT YOU'VE PUT ON YOUR CARD. IF YOU HAVE PUT ON THAT ITEM. 240043Z2, YOU'LL HAVE TO WAIT TILL WE GET TO THAT ITEM. IF YOU'D LIKE TO SPEAK TO IT. SINCE IT'S A PUBLIC HEARING ITEM, KNOW, HOWEVER, THAT WHEN WE GET TO THAT ITEM, I'M GOING TO TABLE IT. YOU'LL STILL BE WELCOME TO COME UP AND SPEAK IF YOU LIKE. OR YOU COULD LET ME KNOW THAT YOU JUST WANT TO REGISTER YOUR YOUR COMMENTS FOR THE RECORD AND NOT STICK AROUND.

AND YOU'RE WELCOME TO DO THAT AS WELL. MATTER OF FACT, WHAT I WILL DO IS QUICKLY CALL THE NAMES OF ALL THOSE THAT ARE PLANNED ON SPEAKING. YOU CAN MAKE THE DECISION NOW AND LET ME KNOW THAT YOU'RE GOING TO SPEAK WHEN I CALL THE ITEM, KNOWING WE'RE GOING TO TABLE IT, OR YOU CAN TELL ME THAT JUST REGISTER IT IN OPPOSITION AND YOU MIGHT WANT TO COME BACK IN PERSON WHEN THE ITEM IS HEARD BY THE COUNCIL, YASSIR RAHMAN, ARE YOU GOING TO WANT TO. WILL YOU WANT TO SPEAK AT THE ITEM OR REGISTER YOUR OPPOSITION? REGISTER OPPOSITION? OKAY NANCY LEE.

HELLO. YES. WOULD YOU LIKE TO SPEAK WHEN I CALL THE ITEM LATER, OR WOULD YOU LIKE TO REGISTER YOUR OPPOSITION TO SPEAK? OKAY OKAY. THAT WAS THE REMAINDER, I WILL ASK, THOUGH, BECAUSE YOU'LL. CHRIS, IF YOU WOULD LIKE TO JUST REGISTER YOUR OPPOSITION OR WOULD YOU LIKE TO SPEAK AGAIN BECAUSE AGAIN, BEING A PUBLIC ITEM, I FEEL OBLIGATED TO CALL YOU AT YOUR NAME AGAIN.

I'LL REGISTER MY OPPOSITION AND DEBBIE. SAME. YES. THANK YOU. YEAH. THE COMMENTS ALL THE COMMENTS THAT HAVE BEEN REGISTERED IN OPPOSITION WILL BE IN THE IN THE COMMENTS ON RECORD FOR THAT ITEM. SO WE WILL NOW MOVE TO I'VE GOT SHE'S GOING TO WANT TO SPEAK, PAUL BALLESTEROS.

GOOD EVENING. PAUL BALLESTEROS 6508 MARVIN GARDENS, MCKINNEY, TEXAS. AND I AM NOT JUST A RESIDENT. I'M ALSO THE FOUNDER OF A MANUAL LABOR. AND OUR ORGANIZATION IS ADDRESSING HOMELESSNESS IN OUR COMMUNITY AND BEYOND. BUT WE HAVE A PASSION FOR SERVING RIGHT HERE.

I DON'T KNOW, MY CLOCK IS NOT. OH, IT'S ALREADY GOING ALL RIGHT. PNEUMONIA, EPILEPSY, COP, DIABETES, BLOOD CLOTS, BLINDNESS, STROKE, CONGESTIVE HEART FAILURE, CANCER, SEVERE FRACTURES FROM A MOTOR VEHICLE ACCIDENT. NOW IMAGINE EXPERIENCING THESE THINGS WHILE HOMELESS. THAT IS THE REALITY OF SOME OF OUR NEIGHBORS RIGHT NOW THAT ARE IN THE HOSPITAL, UNINSURED AND UNSURE OF WHAT'S GOING TO HAPPEN NEXT, HOW THEY'RE GOING TO BE ABLE TO RECOVER. ALL OF OUR NEIGHBORS EXPERIENCING HOMELESSNESS ARE SLEEP DEPRIVED, AND WE'RE PUTTING PRESSURE ON THEM TO MAKE LIFE CHANGING DECISIONS. I WILL TELL YOU THAT NO ONE GETS OUT OF HOMELESSNESS ALONE, AND NO ONE CAN ADDRESS EVERY ASPECT ALONE. NO AGENCY, NO, NO, NO CITIZEN.

WE NEED EVERYBODY. AND I WOULD NOT ASK YOU TO DO ANYTHING I WOULDN'T BE WILLING TO DO. BUT I WILL ASK FOR HELP WITH WHAT I CAN'T DO. AND I CAN'T DO IT ALONE. I ALSO KNOW THAT THERE ARE SOME THINGS THAT I FEEL WE CAN ADDRESS AS A COMMUNITY THAT WOULD LITERALLY SAVE LIVES AND GIVE PEOPLE AN OPPORTUNITY TO BE IN A BETTER SITUATION. I THINK THE THING THAT MOST OF US VALUE MORE THAN ANYTHING IS OUR TIME AND OUR MONEY, AND WE WANT TO MAKE SURE THAT WE REDUCE THE AMOUNT OF TIME IT TAKES TO GET HELP AND THE AMOUNT OF MONEY WE'RE SPENDING ON IT, AND TO DO IT WISELY. I'VE PRESENTED THIS BEFORE, I THINK, IN MCKINNEY CITY ID WOULD BE INCREDIBLY HELPFUL. I NEED TO KNOW IT NEEDS TO BE ANALYZED AND SCRUTINIZED AND GO THROUGH ALL OF THAT. BUT I KNOW FIRSTHAND OF SOME PEOPLE THAT WOULD BE ALIVE TODAY HAD THEY HAD AN ID THAT THEY COULDN'T GET THE STATE ID BECAUSE OF THE EXTRA OBSTACLES, THEY'D BE EMPLOYED AND WE WOULD HAVE LESS AMBULANCE CALLS. POLICE CALLS AND OTHER THINGS ASSOCIATED THAT MOTOR VEHICLE ACCIDENT WAS CONNECTED TO SOMEBODY THAT WAS HOMELESS, THAT GOT HIT, AND THEY DON'T KNOW

[00:10:03]

WHAT'S GOING TO HAPPEN NEXT. SO I'M NOT USED TO TWO MINUTES. SORRY, BUT THANK YOU. I REALLY APPRECIATE IT. AND THERE ARE SOME GREAT THINGS HAPPENING IN THE CITY TOO. AND I WAS SUPER EXCITED ABOUT SOMETHING THAT CAME UP TODAY. AND I RAN AROUND TO THREE DIFFERENT DEPARTMENTS AND EVERYBODY WAS LIKE, WE CAN MAKE THIS WORK. SO I WANT TO MAKE SURE IT GOES OUT ON A POSITIVE NOTE. SO THANK YOU, THANK YOU, THANK YOU PAUL I'M DEBBIE LINDSTROM. GOOD EVENING, MR. MAYOR, AND MEMBERS OF CITY COUNCIL. MY NAME IS DEBBIE LINDSTROM. I LIVE ON REDWOOD CIRCLE IN MCKINNEY, I SERVE AS THE ELECTION DIVISION LEAD FOR CITIZENS DEFENDING FREEDOM. I STAND BEFORE YOU TODAY TO VOICE OUR STRONG OPPOSITION TO THE PROPOSED ELECTION. TO AMEND THE CITY CHARTER TO EXTEND TERM LIMITS IN MCKINNEY. OUR ORGANIZATION HAS BEEN INUNDATED WITH COMMENTS FROM CONCERNED MCKINNEY RESIDENTS WHO ARE DEEPLY TROUBLED BY THIS POTENTIAL AMENDMENT. WHAT'S PARTICULARLY ALARMING IS THAT THIS AMENDMENT WAS NOT INITIATED BY CITIZENS OF MCKINNEY. INSTEAD, IT ORIGINATED FROM WITHIN THIS VERY COUNCIL. THIS THIS FACT ALONE RAISES SERIOUS QUESTIONS ABOUT THE TRUE MOTIVES BEHIND THIS PROPOSAL. MANY OF OUR CITIZENS ARE RIGHTFULLY CONCERNED THAT THIS AMENDMENT MAY NOT BE IN THEIR BEST INTEREST, BUT RATHER IN THE INTEREST OF THE INDIVIDUAL MEMBERS OF THIS BODY. IT IS A SENTIMENT THAT WE AT CITIZENS DEFENDING FREEDOMS SHARE AND FEEL COMPELLED TO BRING TO YOUR ATTENTION. LET ME REMIND YOU THAT ALL OF THIS FUNDAMENTAL PRINCIPLE YOU ARE PUBLIC SERVANTS. YOUR PRIMARY DUTY IS TO ACT IN THE BEST INTERESTS OF THE PUBLIC, THE VERY PEOPLE WHO ELECTED YOU TO THESE POSITIONS OF TRUST AND RESPONSIBILITY. THIS PROPOSED AMENDMENT, HOWEVER, SEEMS TO PRIORITIZE THE INTERESTS OF THOSE IN POWER OVER THOSE OF THE GENERAL PUBLIC.

TERM LIMITS EXIST FOR GOOD REASONS. THEY ENSURE A REGULAR INFLUX OF FRESH IDEAS, PREVENT THE ENTRENCHMENT OF POWER, AND MAINTAIN A HEALTHY DEMOCRATIC PROCESS. BY SEEKING TO EXTEND THESE LIMITS, YOU RISK UNDERMINING THESE CRUCIAL ASPECTS OF LOCAL GOVERNANCE.

MOREOVER, BY VOTING TO PROCEED WITH THIS ELECTION, YOU ARE CHOOSING TO WASTE VALUABLE TIME, MONEY AND RESOURCES ON SOMETHING THE VOTERS DID NOT ASK FOR. THIS IS NOT ONLY FISCALLY IRRESPONSIBLE, BUT ALSO DISRESPECTFUL TO THE CITIZENS YOU SERVE. I URGE YOU TO RECONSIDER THIS AMENDMENT. LISTEN TO THE VOICES OF MCKINNEY CITIZENS WHO HAVE REACHED OUT TO US IN OPPOSITION. REMEMBER YOUR ROLE AS PUBLIC SERVANTS AND PRIORITIZE THE LONG TERM HEALTH OF OUR REPRESENTATIVE GOVERNMENT OVER ANY SHORT TERM, PERSONAL OR POLITICAL GAINS. THANK YOU FOR YOUR TIME AND ATTENTION TO THIS CRITICAL MATTER. THANK YOU. AJ MICHIELETTO. HI, I'M AJ MICHIELETTO MCKINNEY, RESIDENT, HYDE PARK, I JUST I'M HERE TO SAY THANK YOU AS YOU GUYS KNOW, SCHOOL STARTS THIS WEEK, AND, WITH THE LOVELY FOUNDATION WE WERE ABLE TO DISTRIBUTE OVER 300 BACKPACKS TO MISD STUDENTS BOTH IN MIDDLE SCHOOL AND HIGH SCHOOL. AND I WANT TO SAY THANK YOU TO EACH AND EVERY ONE OF YOU BECAUSE EACH AND EVERY ONE OF YOU ON THIS COUNCIL DONATED TO OUR BACKPACK DRIVE. NOT ONLY DID YOU GUYS DONATE, BUT MOST OF YOU DONATED AN ENTIRE MONTH'S WORTH OF COUNCIL PAY OR MORE. NOT ONLY THAT, BUT EMPRESS AND HER THREE AMAZING BOYS CAME OUT AND STUFFED BACKPACKS FOR OUR DRIVE. AND IT'S LEADERSHIP LIKE HERE TONIGHT THAT REALLY GIVES THAT GIVING HEART TO OUR COMMUNITY. AND WE DON'T SAY THANK YOU ENOUGH. SO THANK YOU FOR GIVING TO THOSE THAT DO NOT HAVE AND MAKING SURE THAT EACH ONE OF OUR STUDENTS IN MISD STARTS OUT THE SCHOOL WITH THE THINGS THAT THEY NEED. THANK YOU. AWESOME THANK YOU. AND I WANT TO. YEAH, I SAW EMPRESS IN HER KIDS BECAUSE WE HOSTED THE BACKPACK, BUNDLING, IF YOU WILL, AT, AT MY OFFICE, OVER IN ADRIATICA AND HER EMPRESS AND HER BOYS WERE THERE MULTIPLE TIMES, ALONG WITH, BY THE WAY, YOURSELF, RJ AND DAVID RICH AND MANY OTHERS. MAY LEE OF COURSE, MANY OTHERS. BUT EMPRESS AND HER BOYS REALLY, REALLY WERE GREAT AND DID IT WITH A GREAT ATTITUDE. AND YOU COULD TELL THEY, THEY ENJOYED WHAT THEY WERE DOING, KNOWING WHAT THE END RESULT WAS. SO WE THANK HER AND HER THREE BOYS, THAT IS ALL THE PUBLIC COMMENTS THAT I HAVE. AS I SAID, WE'LL GET TO A PUBLIC HEARING ITEM THAT WILL BE TABLED, BUT I WILL READ JUST THE NAMES OF THOSE WHO REGISTERED

[CONSENT AGENDA]

OPPOSITION. I KNOW, NANCY, YOU'LL STILL YOU'LL SPEAK. SO CONSENT AGENDA. THESE ITEMS CONSIST OF NON-CONTROVERSIAL HOUSEKEEPING ITEMS REQUIRED BY LAW. ITEMS MAY BE CONSIDERED INDIVIDUALLY BY ANY COUNCIL MEMBER, BY BEING ASKED TO PULL DOWN THAT PRIOR TO A MOTION AND VOTE ON THE CONSENT ITEMS. IS THERE ANY ITEM THAT COUNCIL LIKE TO PULL DOWN, AND IF NOT, IS THERE A MOTION? I'LL MAKE A MOTION. WE APPROVE THE CONSENT AGENDA ITEMS. I'LL SECOND.

PLEASE CAST YOUR VOTES. MOTION PASSES. FIRST ITEM REGULAR AGENDA AND PUBLIC HEARING ITEMS

[Consider/Discuss/Act on an Appeal of a City Staff Decision Not to Use City Resources to Address Erosion Occurring on Common Area Property at the Provence Townhomes]

TWO FOUR. I'M SORRY. I'M GOING TO GO TO 241838 FIRST, WHICH IS CONSIDER DISCUSS ACT ON APPEAL

[00:15:02]

OF CITY STAFF DECISION NOT TO USE CITY RESOURCES TO ADDRESS EROSION OCCURRING ON COMMON AREA PROPERTY AT PROVIDENCE TOWNHOMES. THANK YOU. MAYOR GARY GRAHAM, DIRECTOR OF ENGINEERING, THIS IS THE APPEAL THAT WAS PRESENTED AT THE JULY 16TH COUNCIL WORK SESSION, ABOUT STAFF'S DECISION NOT TO PARTICIPATE IN THE FIX OF THE DRAINAGE CONCERNS BY THAT PROVIDENCE SUBDIVISION. SO, STAFF IS HERE TO ANSWER ANY QUESTIONS THAT YOU MAY HAVE.

QUESTIONS ALL RIGHT. WITH THAT, ENTERTAIN A MOTION. YES. OKAY. AFTER CONSIDERATION OF THE APPEAL BY THE PROPERTY OWNER, THE FACTS AND THE EVIDENCE PRESENTED AND THE GOVERNING REGULATIONS, I MOVE TO DENY THE APPEAL BEFORE US. SECOND MOTION, SECOND. PLEASE CAST YOUR VOTES.

[Consider/Discuss/Act on Fiscal Year 2024-25 Proposed Tax Rate, Take Record Vote and Set Public Hearing and Adoption Date]

MOTION PASSES. ITEM 241835. CONSIDER AN ACT ON FISCAL YEAR 20 2425. PROPOSED TAX RATE. TAKE RECORD VOTE AND SET A PUBLIC HEARING AND ADOPTION DATE. AND I AM CERTAIN MR. HOLLOWAY, THAT YOU WILL EXPLAIN THAT THIS IS NOT SETTING THE RATE, BUT IT IS IN FACT SETTING THE CEILING, AS WE DO EVERY SINGLE YEAR AT THE CAP RATE. WELL, YOU KNOW WHAT? I STEAL YOUR THUNDER. THANK YOU, MR. MAYOR. I GAVE AWAY THE END OF THE MOVIE. YES, YOU DID, CHIEF FINANCIAL OFFICER FOR THE CITY. AND YOU HAVE SAID IT BETTER THAN I COULD ACTUALLY SAY IT OR MUMBLE IT FOR A FEW MINUTES, TONIGHT THERE IS A RECORD VOTE ON THE TAX RATE THAT IS NOT SETTING THE TAX RATE. IT IS SETTING THE TAX RATE CEILING, AND WE'LL TALK A LITTLE BIT ABOUT THAT. YOU CAN SEE THAT THE VOTE TONIGHT WILL BE REQUIRED WITH THE SPECIFIC WORDING OF MOTION THAT YOU HAVE IN FRONT OF YOU. IT DOES SET THE CEILING FOR 25. IT IS REQUIRED FOR PROPOSING A TAX RATE FOR FISCAL YEAR 25.

THIS YEAR, THE PROPOSED TAX RATE CEILING IS 0.416922, JUST TO BE CLEAR, THE CURRENT TAX RATE IS 0.427513. SO THAT WOULD BE A $0.01 RE RATE JUST AT THE CEILING. AND I CAN TELL YOU THAT THAT THE PROPOSED BUDGET THAT WE WILL BE TALKING ABOUT ON FRIDAY, THE PROPOSED TAX RATE THEN WILL BE A LITTLE BIT LOWER THAN THIS CEILING THAT WE HAVE TONIGHT. I DO WANT TO JUST JUST FOR EDUCATIONAL PURPOSES, TALK A LITTLE BIT ABOUT THE NO NEW REVENUE AND THE VOTER APPROVAL RATES THAT YOU'LL HEAR US MENTION AS WE GO THROUGH THE BUDGET PROCESS AND THE TAX RATE CYCLE. THIS YEAR, THE NO NEW REVENUE RATE IS A RATE THAT WE USE TO GENERATE THE SAME AMOUNT OF REVENUE IN BOTH YEARS ON PROPERTIES IN BOTH YEARS. SO IF PROPERTY VALUES GO UP, THE TAX RATE WOULD GO DOWN TO GENERATE THAT SAME AMOUNT OF REVENUE, THE VOTER APPROVAL RATE IS 3.5% ABOVE THE NO NEW REVENUE RATE, SO ANYTIME THAT IS BREACHED, THAT WOULD REQUIRE AN ELECTION. IF IT IS EXCEEDED. THAT ALL BEING SAID, OF COURSE YOU HAVE, SOME, SOME DOLLARS UNDERNEATH THE NO NEW REVENUE RATE THAT YOU HAVE BANKED OVER THE LAST FEW YEARS THAT YOU WOULD ACTUALLY BE ABLE TO GO ABOVE THAT 3.5%. THAT'S A KIND OF TECHNICAL. AND WE'RE NOT EVEN PROPOSING THAT AT THIS POINT. AND I CAN GIVE THOSE RATES TO YOU IF YOU WANT. BUT THESE ARE COMPARISON OF THE RATES FROM THIS YEAR TO LAST YEAR. YOU CAN SEE THE TAX RATE CEILING WAS JUST, $0.43. JUST A LITTLE OVER $0.43 LAST YEAR. AND WE ADOPTED A RATE OF 42.7. SO THE NO NEW REVENUE RATE THIS YEAR IS 0.402. THE DEBT RATE, WHICH IS USED TO IS PRETTY MUCH SETS ITSELF EACH YEAR BECAUSE IT'S THE AMOUNT OF DEBT SERVICE WE SET IT AT, THE AMOUNT OF DEBT SERVICE THAT YOU ACTUALLY HAVE, IS GOING TO GO DOWN BY ABOUT 4/10 OF A PENNY, I'VE TRIED TO MAINTAIN THAT AS LEVEL AS I CAN, BUT BECAUSE OF, OF WE, WE SELL DEBT EARLIER IN THE YEAR AND WE GET OUR ACTUAL VALUES A LITTLE BIT LATER IN THE YEAR, WE, WE SEE A LITTLE BIT OF LEAKAGE THERE, WHICH IS FINE BECAUSE WE ARE A GROWING CITY. SO THE NO CEILING THEN RATE WAS A CALCULATED RATE THAT WE WOULD HAVE AT ABOUT JUST OVER $0.28, HERE'S A LITTLE HISTORY OF OUR TAXABLE VALUES. OUR CERTIFIED TAXABLE VALUE. THIS YEAR. WE'LL BE TALKING A LITTLE BIT ABOUT THE MAKEUP OF THOSE VALUES AT OUR BUDGET WORKSHOP ON FRIDAY IS JUST UNDER $40 MILLION, AT 39.69 BILLION. THIS YEAR. THAT'S UP FROM 35.91 BILLION LAST YEAR. THAT MEANS OUR TAXABLE VALUES ARE UP 10.5% OVERALL, WHEN YOU

[00:20:01]

BACK OUT THE NEW VALUES, WE HAD, GROWTH OF EXISTING PROPERTIES OF ABOUT 5.8%. SO, YOU KNOW, I STARTED I WENT BACK AND LOOKED AT SOME OF OUR OLD TAX ROLLS. WE GREW AT 15%, YEAR TO YEAR, 23 TO 24. AND 18% FROM 22 TO 23. SO WHILE THIS IS STILL A SIGNIFICANT JUMP, WE ARE STARTING TO SEE A LITTLE BIT OF COOLING ON THE OVERALL GROWTH OF THE TAX ROLL. WHILE THE NUMBERS ARE STILL FAIRLY ROBUST, I HAVE TALKED A LITTLE BIT ABOUT THE TAX RATE HAS TWO PARTS. I MENTIONED THE INS OR DEBT SERVICE RATE KIND OF SETS ITSELF TO MATCH THE DEBT SERVICE THAT WE HAVE ON THE BOOKS FOR A GIVEN YEAR, AND THEN THE NO TAX RATE. THIS IS OUR GENERAL FUND OPERATIONAL SALARIES, EXPENSES, SUPPLIES, AND IT IS SUBJECT TO BOTH OF THOSE CALCULATIONS THAT I TALKED ABOUT. THE NO NEW REVENUE AND VOTER APPROVAL RATE HERE IS A KIND OF A BAR CHART WE LIKE TO SHOW. WE'LL SHOW IT AGAIN DURING THE BUDGET WORKSHOP, BUT WE'LL ACTUALLY PUT IN WHAT THE PROPOSED RATE WILL BE AT THAT TIME. LIKE I SAID, IT'S A LITTLE BIT LESS THAN THIS 4169 NUMBER. BUT YOU CAN SEE OUR TAX RATE IN FISCAL YEAR 16 WAS ON JUST UNDER $0.60 AT 0.5830, WITH THIS YEAR BEING 0.4275. AND THE CEILING BEING 0.4169 FOR FISCAL YEAR 25. PROPOSED CEILING. BECAUSE THERE HAS NOT BEEN ANY, I HAVE MENTIONED THE BUDGET WORK SESSION ON AUGUST 9TH. WE WILL HAVE A PUBLIC INPUT HEARING ON THE 20TH, ON SEPTEMBER THE THIRD OF THE OFFICIAL PUBLIC HEARING ON THE BUDGET, A PUBLIC HEARING ON THE TAX RATE AND ALSO OUR FEE CHANGE AND RATE IS ALL THE KNIGHTS WILL BE ADOPTING THE BUDGET ON SEPTEMBER THE 3RD. IT'S A LITTLE BIT EARLY THIS YEAR. IT SEEMS LIKE IT GETS A LITTLE EARLIER EVERY YEAR BECAUSE WE HAVE SOME DATES THAT WE HAVE TO MEET, THAT'S WHY WE HAVE THIS BEFORE YOU ACTUALLY SEE THE PROPOSED BUDGET ON ON AUGUST NINTH, JUST BECAUSE OF THE WAY THE STATE STATUTE WORKS, BECAUSE FRANKLY, WE GET THE CERTIFIED TAX ROLLS ON THE 25TH OF JULY, AND THEN WE'RE IN HERE ON AUGUST THE 3RD DOING THIS AND THEN HAVING PUTTING A BUDGET TOGETHER AND HAVING A WORK SESSION ON AUGUST 9TH. SO IT MOVES PRETTY QUICK. BUT AND THEN TO HAVE THE BUDGET ADOPTED ON SEPTEMBER THE 3RD.

SO, WITH THAT, I'LL BE HAPPY TO TAKE ANY QUESTIONS, OR COMMENTS, ANY QUESTIONS FOR MARK? WELL, I ONLY TAKE EXCEPTION THAT YOU ADDED THREE WORDS WHEN YOU SAID THIS, WHERE WE HAVE OUR CEILING AND THEN WE'LL BE DISCUSSING, AT BUDGET, BUT THE PROPOSED RATE WILL BE. AND YOU SAID IT'LL BE A LITTLE BIT LOWER. YOU JUST COULD HAVE SAID IT WOULD HAVE BEEN IT WILL BE LOWER THAN THE CEILING, FRANKLY. YOU ADDED SOME ADJECTIVE AND PREPOSITION WE DON'T NEED AT THESE MARGINS.

WE'RE TALKING LESS THAN A, YOU KNOW, A PENNY OR AROUND A PENNY BETWEEN THE, NO NEW REVENUE AND TAX RATE CEILING. IT'S, THERE'S A THERE'S VERY FINE MARGINS WHEN WE'RE TALKING ABOUT THE TAX RATE, ESPECIALLY WHEN YOU WERE AT $0.60 LESS THAN TEN YEARS AGO. SO WHEN I SAY A LITTLE BIT, I GUESS I'M REFERRING BACK TO $0.60. WE'RE ALSO, OF COURSE, DEALING WITH SOME TREMENDOUSLY CHALLENGING TIMES. AND ABSOLUTELY PERIOD OF INFLATION AND WHATNOT. ALL RIGHT. THIS WILL RECORD A RECORD, REQUIRE A RECORD VOTE. IS THERE A MOTION? THERE'S A MOTION, A MOTION LANGUAGE ON THE BACK PAGE THAT MUST BE READ. OKAY, I MOVE THAT THE CITY OF MCKINNEY PROPOSE TO ADOPT A FISCAL YEAR 2025 TOTAL TAX RATE OF 0.416922, WHICH IS HIGHER THAN THE FISCAL YEAR 2025. NO NEW REVENUE TAX RATE OF 0.402339 AND CALL FOR A PUBLIC HEARING. THE PUBLIC HEARING TO BE HELD ON SEPTEMBER 3RD, 2024 AT 6 P.M. FURTHER, A RECORD VOTE ON THE TAX RATE ADOPTION WILL BE HELD ON SEPTEMBER 3RD, 2024 AT 6 P.M. ALL MEETINGS WILL BE HELD IN THE MCKINNEY CITY HALL COUNCIL CHAMBERS AT 222 NORTH TENNESSEE STREET, MCKINNEY, TEXAS. 75069. I'LL SECOND. DO WE HAVE A VOTE? AND SECOND WILL BE A ROLL CALL VOTE. I WILL STATE AGAIN, THOUGH, THAT ALTHOUGH THE LANGUAGE THAT HAD TO BE READ STATES THAT WE ADOPT A FISCAL YEAR TOTAL TAX RATE OF 0.416922, THAT IS IN FACT THE CEILING RATE AND NOT THE ACTUAL RATE WILL BE DETERMINED AND VOTED ON NEXT MONTH. YES YES, YES YES YES YES. ITEM 241836. CONSIDER ACT ON AN ORDINANCE CALLING THE NOVEMBER

[Consider/Discuss/Act on an Ordinance Calling a November 5, 2024 Charter Amendment Election]

5TH, 2024 CHARTER AMENDMENT ELECTION. MR. MAYOR, COUNCIL MARK HAUSER, CITY ATTORNEY. I'M

[00:25:03]

HERE, IN FACT FOR MR. MINYARD, WHO I WILL GIVE HIM EXTREME CREDIT FOR THE WORK THAT HE HAS DONE, ALONG WITH THE COMMITTEE, WHICH WAS APPOINTED BACK IN MAY TO STUDY WHETHER THE CHARTER, WOULD STUDY VARIOUS ASPECTS OF THE CHARTER AT YOUR, RECOMMENDATION, TONIGHT I'M GOING TO HAVE, TO NITROUS, PUT UP THE FOUR PROPOSITIONS THAT THE COUNCIL WENT OVER IN WORK SESSION EXTENSIVELY, THE TWO OF THEM ARE SUBSTANTIVE. TWO OF THEM ARE NON SUBSTANTIVE THAT WE PUT ON ALL CHARTER ELECTIONS, WHICH ALLOWS THE STAFF TO CORRECT ANY ERRORS, CHANGES IN STATE LAW. SO IF YOU LOOK AT PROPOSITION A AND B THOSE ARE THE TWO SUBSTANTIVE PROPOSITIONS THAT DEAL WITH TWO AREAS OF THE CHARTER. SECTION NINE DEALING WITH TERMS AND NUMBERS OF TERMS AND LENGTH OF TERM. CURRENT LENGTH OF TERM IS ALREADY FOUR YEARS. THE PROPOSITION IS A QUESTION TO THE VOTERS ABOUT THREE CONSECUTIVE TERMS. THE SECOND ITEM, PROPOSITION B, WHICH DEALS WITH COMPENSATION IN SECTION 16 OF THE CHARTER, IS A CHANGE FROM A PER MEETING BASIS.

PAYMENTS TO TWO COUNCIL MEMBERS FOR THEIR SERVICE, TO A MONTHLY BASIS. AND I WANT TO MAKE CLEAR THAT THIS, PROPOSITION, IF PASSED, WOULD ONLY AFFECT NEW, NEWLY ELECTED MEMBERS, SITTING COUNCIL MEMBERS WOULD NOT RECEIVE ANY CHANGE IN THEIR COMPENSATION UNLESS THEY WERE IN A SUBSEQUENT ELECTION. SO I WANTED THAT TO BE CLEAR. AND SO THE OTHER TWO PROPOSITIONS, C AND D, ARE THOSE RELATING TO THOSE NON-SUBSTANTIVE ISSUES, WHICH, IT'S JUST OVER TIME, LAWS CHANGE AND WE HAVE CERTAIN THINGS IN THE CHARTER THAT WE NO LONGER EMPLOY. SO THIS WILL BE, IF PASSED, YOU HAVE AN ORDINANCE IN FRONT OF YOU. THE ORDINANCE WILL BE AVAILABLE FOR THE PUBLIC LATER THIS EVENING. AND IF PASSED, IN NOVEMBER, IT WILL BE AT THE NOVEMBER 5TH ELECTION.

I'M HAPPY TO ANSWER ANY QUESTIONS. ANY QUESTIONS? IS THERE A MOTION? I'LL MAKE A MOTION. WE APPROVE THIS ITEM. I'LL SECOND. PLEASE CAST YOUR VOTES. MOTION PASSES. ITEM

[Conduct a Public Hearing to Consider/Discuss/Act on a Resolution Approving the 2024-2025 Annual Action Plan and the Substantial Amendment to the 2020-2024 Consolidated Plan]

241837. CONDUCT A PUBLIC HEARING TO CONSIDER AN ACT ON A RESOLUTION APPROVING 2024 2025 ANNUAL ACTION PLAN AND SUBSTANTIAL AMENDMENT TO THE 2020 2024 CONSOLIDATED PLAN.

GOOD EVENING. I AM SHALITA BEST COMMUNITY SERVICES ADMINISTRATOR, HOUSING COMMUNITY DEVELOPMENT DEPARTMENT FOR THE CITY OF MCKINNEY. I WOULD LIKE TO BE ABLE TO TALK TO YOU TODAY ABOUT OUR ANNUAL ACTION PLAN, WHICH INCLUDES OUR COMMUNITY DEVELOPMENT BLOCK GRANT, WHICH IS KNOWN AS CDBG. I WILL ALSO SHARE WITH YOU SOME EXCITING NEWS ABOUT ADDITIONAL FUNDING AND ALSO COMMENTS THAT WE HAVE HAD DURING THIS PROCESS. FOR THE LAST 20 YEARS, WE HAVE RECEIVED CDBG FUNDING EACH YEAR AS OUR CITY CONTINUES TO GROW AND WE ANTICIPATE AN ALLOCATION OF $912,415 THAT WILL BEGIN OCTOBER 1ST. BECAUSE OF OUR PERFORMANCE, OUR NEED ASSESSMENTS AND OUR PARTICIPATION WITHIN THE CITY, WE ARE NOW ALSO ELIGIBLE TO BE A HUD PARTICIPATING JURISDICTION THAT WILL PROVIDE US WITH ADDITIONAL FUNDING KNOWN AS HOME GRANT FUNDS. THIS WILL PROVIDE US WITH ADDITIONAL ACCESS FOR AFFORDABLE HOUSING, WHICH WE WILL BE ABLE TO UTILIZE FOR A VARIETY OF DIFFERENT NEEDS. AND THAT FUNDING IS EXACTLY $346,342.18. I DO NEED TO STATE THAT FOR THE RECORD, BY REQUIREMENTS OF REGULATION, WE ARE REQUIRED TO HAVE A MATCH. WE HAVE GRACIOUSLY RECEIVED A MATCH FOR POINT OF RECORD FROM THE TEXAS DEPARTMENT OF HOUSING AND COMMUNITY AFFAIRS, KNOWN AS TDHCA, FOR $154,591. THE COMMUNITY GRANTS ADVISORY COMMISSION HAS AN OPPORTUNITY WHERE THEY PROVIDE FUNDING RECOMMENDATIONS TO THE COMMISSION. REVIEW SO THAT THEY CAN PROVIDE FUNDING RECOMMENDATIONS TO YOU FOR CONSIDERATION. THEY STARTED THAT GRANT APPLICATION PROCESS IN FEBRUARY OF THIS YEAR, KNOWN AS THE CONSOLIDATED GRANTS APPLICATION PROCESS. AND IN ADDITION TO THAT, THAT ALSO INCLUDES OUR CITY ADMINISTERED FUNDS. ALTHOUGH ALL OF OUR FUNDING IS NOT APPROVED UNTIL THE ENTIRE BUDGET IS APPROVED, WE DO GO THROUGH A PROCESS THAT IS REQUIRED BY REGULATION FOR

[00:30:01]

HUD, WHICH IS THIS PUBLIC HEARING AT THIS TIME, WE HAVE HAD ONE INFORMATION SESSION, THREE PUBLIC HEARINGS, INCLUDING THIS ONE, TWO PUBLIC MEETINGS FOR PUBLIC INPUT. AND WE ARE ALSO UNDER A 30 DAY PUBLIC COMMENT PERIOD THAT WILL END ON AUGUST THE 14TH. AT THIS TIME, WE HAVE HAD, AN INQUIRY FOR FINANCIAL SUPPORT AND WE JUST WANT TO STATE FOR THE RECORD THAT ALL OF OUR GRANTS ARE MONITORED, WE ARE FISCALLY SOUND AND THAT ALL OF OUR AGENCIES ARE REVIEWED NOT ONLY FOR AUDITS, BUT ALSO FOR THEIR SUBMISSIONS TO TAX RECORDS AND OTHER RESOURCES. WE HAD A THANK YOU FROM AN APPLICANT WHO, ALTHOUGH THEY DID NOT RECEIVE FUNDING, WAS VERY APPRECIATIVE OF COUNCIL FOR APPROVING TAX BREAKS FOR DAYCARES AND THAT WOULD LEND OPPORTUNITY FOR EXPANDED ECONOMIC DEVELOPMENT. AND FINALLY, WE DO HAVE ONE CHANGE FROM TIME TO TIME. WE DO HAVE AN AGENCY THAT ALTHOUGH THEY HAVE FUNDING RECOMMENDATIONS, THEY ARE NOT REQUIRED TO RECEIVE OR ACCEPT THOSE GRANTS. WITH THE RECOMMENDATION THAT WE HAVE AT THIS TIME FROM THE COMMUNITY GRANTS ADVISORY COMMISSION. THE AGENCY FAMILY GATEWAY IS OFFICIALLY WITHDRAWING THEIR PROPOSED RECOMMENDATION, WHICH IS TO, EXCUSE ME, $22,312.50.

WHAT THIS MEANS IS THAT THIS APPLICATION SUBMISSION WILL BE, DECLINED BY THEIR REQUEST. WE DO NOT LOSE THAT FUNDING. WE WILL GO TO ANOTHER 30 DAY APPLICATION PROCESS IN WHICH THE COMMISSIONERS WILL MEET, AND WE WILL MAKE A DETERMINATION WHETHER THERE WILL BE AN EXTENSION, WHETHER WE WILL GO THROUGH ANOTHER APPLICATION PROCESS OR WHETHER WE WILL HAVE A CITY ADMINISTERED PROGRAM. SO MY STATEMENT IS JUST FOR MATTER OF RECORD. AND THE APPLICANT FAMILY GATEWAY IS ELIGIBLE TO APPLY AT ANY TIME THAT THEY WISH TO CHOOSE. AND WE THANK THEM FOR THEIR SUPPORT IN THE PROCESS. AND AT THIS TIME, I'LL STAND FOR ANY QUESTIONS. ANY QUESTIONS.

THIS IS A PUBLIC HEARING ITEM. I DO NOT SHOW THAT ANYONE HAS SIGNED UP TO SPEAK TO IT, BUT IF YOU HAVE COME DOWN HERE TO SPEAK TO IT, PLEASE MAKE YOURSELF KNOWN. SEEING NOBODY ENTERTAIN A MOTION. I'LL MAKE A MOTION. WE CLOSE THE PUBLIC HEARING AND APPROVE THIS ITEM. SECOND IS CAST YOUR VOTES. ON BEHALF OF THE COMMISSIONERS. THANK YOU. THANK YOU VERY MUCH. THANK YOU.

[Conduct a Public Hearing to Consider/Discuss/Act on a Request to Rezone the Subject Property from “C2” - Local Commercial District to “C3” - Regional Commercial District, Located at 1565 North Hardin Boulevard, and Accompanying Ordinance]

CONDUCT A PUBLIC HEARING TO CONSIDER AN ACT ON A REQUEST TO REZONE SUBJECT PROPERTY FROM C2 LOCAL COMMERCIAL DISTRICT C3 TO C3 REGIONAL COMMERCIAL DISTRICT LOCATED AT 1565 NORTH HARDIN BOULEVARD AND ACCOMPANYING ORDINANCE. THIS IS A PUBLIC HEARING, BUT AS DISCUSSED EARLIER, I'M GOING TO MAKE A MOTION THAT WE TABLE THIS ISSUE.

AND, AND THEN I HAVE A NUMBER OF CARDS JUST TO READ, PEOPLE THAT WANT TO REGISTER THEIR POSITION ALONG WITH ONE THAT WOULD LIKE TO SPEAK DURING THE, PUBLIC COMMENTS. WELL, BEING THAT WOULD TABLE IT, MARK, I GUESS I GUESS I'LL STILL OPEN THE PUBLIC HEARING AND THEN WE'LL CONTINUE THE PUBLIC HEARING OR CLOSE IT. OKAY SEPTEMBER 3RD. ALL RIGHT. KELLY RUEDIGER IS IN OPPOSITION, JILL OR IS IT JILL LUDEN IS IN OPPOSITION. JANA LUDEN IS IN OPPOSITION. BINDU. PRIYA EMBODY A VERY NICE HANDWRITING, BY THE WAY. IS IN OPPOSITION. NAVEEN RAHMAN IS IN OPPOSITION, MARTIN BANDA IS IN

OPPOSITION. JENNIFER WHALEN IS IN OPPOSITION. TEHO KUMAR MANJU IS IN OPPOSITION. XINHUA. ZANG IS IN OPPOSITION. TIFFANY TESCH IS IN OPPOSITION. MARLA WOOD IS IN OPPOSITION. JOSHUA MUKES IS IN OPPOSITION. ERICA HANSLEY IS IN OPPOSITION, AND RODERICK HENSLEY IS IN OPPOSITION. SO IF I MISPRONOUNCE NAMES, WHICH I'M SURE I DID AT SOME POINT, I APOLOGIZE. SO THOSE WILL BE PUT IN THE RECORD. AND AGAIN, THIS WILL BE NOTICED AGAIN AND YOU'LL BE WELCOME TO COME DOWN AND SPEAK TO THE ITEM IF YOU'D LIKE TO AT THAT POINT AS WELL. SO, ENTERTAIN A MOTION TO CLOSE THE PUBLIC HEARING AND TABLE THE ITEM MOTION TO CLOSE THE PUBLIC HEARING HELD ON. JENNIFER, YOU HAVE SOMETHING. I JUST WANTED TO MAKE SURE IT WAS CLEAR THAT WHEN WE TALK ABOUT NOTICE FOR THE PUBLIC THAT IT'S A LEGAL NOTICE, NOT PROPERTY OWNER. YES, A LEGAL NOTICE. NO MORE POSTCARDS, JUST LEGAL. NOT A PAPER. YEP A MOTION THAT WE CLOSE THE PUBLIC HEARING AND, TABLE THIS ITEM FOR, NEXT, SEPTEMBER 3RD, COUNCIL MEETING. I'LL SECOND, PLEASE CAST YOUR VOTES.

MOTION PASSES. I'M GOING TO HAVE TO STEP DOWN. OKAY. CONDUCT A PUBLIC HEARING TO CONSIDER ACT.

YOU KNOW WHAT? LET ME. I'M GOING TO JUMP TO THE NEXT ITEM BECAUSE I DON'T WANT TO KEEP NANCY

[Conduct a Public Hearing to Consider/Discuss/Act on a Request to Rezone the Subject Property from “PD” - Planned Development District to “C1” - Neighborhood Commercial District, Located at 5353 Virginia Parkway (REQUEST TO BE WITHDRAWN)]

WAITING SINCE I ALREADY HAD HER COME UP AND THEN GO BACK DOWN. SO, RICK, SIT BACK DOWN, 2400482 CONDUCT A PUBLIC HEARING TO CONSIDER AN ACT ON A REQUEST TO REZONE SUBJECT PROPERTY FROM PLANNED DEVELOPMENT DISTRICT TO C1 NEIGHBORHOOD COMMERCIAL DISTRICT LOCATED AT 5353 VIRGINIA PARKWAY, THIS ITEM HAS BEEN REQUESTED TO BE WITHDRAWN. SO, YOU KNOW, BUT IT IS STILL A PUBLIC HEARING. AND, NANCY, I KNOW YOU CAME DOWN, SO IF YOU'D LIKE TO SPEAK TO IT, NOW WOULD BE THE TIME. HELLO AGAIN. HELLO AGAIN. AGAIN NANCY, EXCUSE MY, VOICE. DUE TO THE WEATHER AND ALLERGIES, I AM IN OPPOSITION TO THIS REZONING REQUEST. AND YOU'VE ALREADY STATED WHERE IT IS LOCATED. CONSTANT ACTIVITY AND NOISE REMOVES THE CALM, QUIET LANDSCAPE OF MY AREA AND ALL OF THE SURROUNDING NEIGHBORHOODS. OUR ONLY TWO ENTRANCES AND EXITS WILL BE JAMMED WITH TRAFFIC DELAYS, AND SCHOOL BUSSES WILL HAVE DIFFICULTIES COLLECTING AND DROPPING OFF SCHOOL CHILDREN. I DO NOT WANT MY RESIDENTIAL STREETS, WHICH ARE NARROW TO BEGIN WITH, TO BE CONSTANTLY OCCUPIED BY PARKED CARS AND OVERRUN WITH TRAFFIC. FIRE TRUCKS AND EMS UNITS WILL HAVE GREAT DIFFICULTY GETTING TO THIS HOMES. I KNOW THIS BECAUSE I'VE ALREADY EXPERIENCED THIS WHEN A HOME ONLY FOUR DOORS DOWN WAS ON FIRE AND TWO FIRE TRUCKS, PLUS AN EMS UNIT HAD GREAT DIFFICULTY JUST GETTING UP TO THE HOME THAT NEEDED HELP. I ALSO DO NOT WANT TO EXPERIENCE BRIGHT PARKING LOT LIGHTS DESTROYING THE PRIVACY OF OUR NEIGHBORHOOD.

ENVIRONMENTALLY, DAY AND NIGHT WOULD BE CHANGED AND THIS IS BECAUSE DON'T FORGET, TREES ARE ALL GOING TO BE REMOVED. THAT CAUSES AN EXTENSION OF DAYLIGHT DUE TO LIGHTING MY HOME AND SBC WAS BUILT TO BE A WELCOMING, PLEASING, SAFE AND QUIET AREA TO RAISE FAMILIES AND TO LIVE IN PEACE. THIS PROJECT SHOULD BE BUILT ON OPEN LAND THAT DOES NOT NEGATIVELY IMPACT OR CHANGE ANY ESTABLISHED DEVELOPMENTS, AND I KNOW THESE AREAS DO EXIST. THANK YOU MA'AM, APPRECIATE IT, ONE MORE SMALL PARAGRAPH. GO AHEAD. THANK YOU. ONLY ONLY BECAUSE YOU CAME UP AND WENT BACK AND CAME UP. OKAY. I'M ASKING FOR ME AND MY FELLOW NEIGHBORS FOR A UNANIMOUS NO VOTE FOR THIS PROJECT. REMEMBER, THIS IS A NOT AN ESTHETICALLY PLEASING, AND WILL OR IT MAY DETER FUTURE PROSPECTIVE HOMEOWNERS FROM SETTLING IN OUR COMMUNITY. AND I THANK YOU FOR YOUR TIME. THE

[00:40:01]

SECOND TIME. THANK YOU, I BELIEVE, JODELLE. HOLLIDAY HAS ALSO SIGNED UP TO SPEAK TO THIS ITEM. GOOD EVENING, AND THANK YOU FOR LETTING US SPEAK. WE ARE IN OPPOSITION OF THE REZONING. I LIVE IN STONEBROOK CROSSING AS WELL, I'LL GO SUPER FAST BECAUSE I KNOW WE DON'T HAVE A LOT OF TIME, BUT FOR THE REZONING, HEARING THAT WE HAD, WE HAD OVER 100 PLUS RESIDENTS PHYSICALLY HERE IN OPPOSITION. AND OF COURSE, YOU GUYS RECEIVED TONS OF COMMUNICATIONS AS WELL. THE STONY BROOK CROSSING THE ENTRANCE, WE ONLY HAVE TWO ENTRANCES AND TWO THE SAME ENTRANCE AND EXITS FOR OUR ENTIRE COMMUNITY. SO WE DO ANTICIPATE A LOT OF TRAFFIC AND PARKING ISSUES. ONE OF THE THINGS I DO WANT TO NOTE IS THAT IF YOU GO TO THE MIA WEBSITE AND OR THE MATERIALS THEY ARE ANTICIPATING AND ENCOURAGING GROWTH, WHICH IS CLEARLY STATED ON ALL OF THEIR INFORMATION. THIS IS THIS ZONING THAT THEY'RE ASKING FOR THE REZONING, AND WE KNOW IT'S GOING TO BE RESUBMITTED, IN 2017. THIS LITTLE AREA WAS FOR SINGLE FAMILY RESIDENTS. REZONE NOT FOR THIS BIG, LARGE COMMERCIAL BUILDING. OF COURSE, EVERYONE HAS STATED THERE'S GOING TO NOT BE ENOUGH PARKING FOR WHAT'S PROJECTED CAPACITY AND OR GROWTH. WE DON'T WANT PARKING IN OUR NEIGHBORHOOD. MAJOR TRAFFIC CONCERNS. WE ARE REQUESTING A TRAFFIC STUDY WHEN SCHOOL IS BACK IN SESSION. AND FOR THE TRAFFIC STUDY WE ASK THAT YOU TAKE INTO ACCOUNT THAT THE EVENT CENTER THAT WAS APPROVED, THAT WILL BE ON VIRGINIA IN LAKE FOREST. SO THAT IS THE ONE THING THERE THAT THAT WILL START Q1 2025. GOOGLE AND YOUTUBE. IF YOU HAVE TIME AT YOUR LEISURE, LOOK AT THE ATTENDANCE OF SERVICES ON FRIDAYS. THE LAST ONE THAT, WE VIEWED, THEY WERE LIKE OVER A THOUSAND IN ATTENDANCE ON A FRIDAY. AND THEIR CURRENT LOCATION ON EL DORADO, ALSO, WE WANT TO MAKE SURE THAT WE NOTE THAT WE ARE CONCERNED ABOUT THE DISRUPTING OF THE CREEK, THE REROUTING. WE ARE REQUESTING A FORMAL SURVEY OF WHAT THIS WOULD DO, REMOVING THE CREEK, ALSO, THE PLAN THAT WE WERE SHOWN REMOVES A LOT OF TREES. SO WE ARE ABSOLUTELY CONCERNED ABOUT THAT. AS WAS PREVIOUSLY STATED, WE'RE ALSO CONCERNED ABOUT POSSIBLE FLOODING ISSUES. SO AGAIN, WE ARE ASKING FOR A FORMAL SURVEY TO ADDRESS THE CREEK REROUTING THE DRAINING ISSUES, HARMING THE CRITTERS. WE'RE CONCERNED ABOUT THE SIZE, NOISE, PRIVACY, AND WE ASK THAT YOU PROTECT THE INTEGRITY OF OUR COMMUNITY. AND ONE THING I WANT TO NOTE REALLY QUICK THE MEDIA HAS REPRESENTED, NOT REPRESENTED US AT ALL. WE HAVE SEEN TWO DIFFERENT NEWS ARTICLES IN FAVOR OF MIA. NO ONE HAS CONTACTED US ABOUT OUR CONCERNS OR WHAT OUR ISSUES ARE WITH THE REZONING. SO I WANT TO MAKE SURE THAT I STATE THAT BECAUSE THAT'S NOT A GOOD LOOK WHEN THEY DO NOT INTERVIEW THE COMMUNITY. THANK YOU. THANK YOU. ALL RIGHT. SO THIS ITEM HAS BEEN REQUESTED WITH BE WITHDRAWN. MARK WE STILL NEED A MOTION ON IT. SO JUST JUST SO OUR SPEAKERS ARE AWARE, I DON'T KNOW IF THEY'RE FULLY AWARE, BUT THEY DO HAVE THE RIGHT TO DEVELOP ON THAT PROPERTY ALREADY WITHIN. THEY HAVE TO DEVELOP WITHIN THE CONFINES OF WHAT'S ALLOWED THERE. BUT THEY HAVE REMOVED THE REQUEST FOR THE LARGE BUILDING. SO I DIDN'T KNOW IF YOU WERE AWARE OF THAT ALREADY, BUT, THE 40,000 SQUARE FOOT BUILDING. YEAH. IS THERE IS THE REZONING REQUEST THEY HAVE REMOVED. SO THAT'S NO LONGER THEY HAVE THEY HAVE NO, NO, NOT NOT TO BE RUDE, BUT THAT'S JUST NOT THE WAY IT WORKS, YES. AS SHE STATED, THEY THEY HAVE THE RIGHT TO BUILD EXACTLY WHAT THEY WANT TO BUILD. IF THEY WERE TO TAKE THE BUILDING THEY PROPOSED AND CUT IT INTO NO LARGER THAN 15,000 SQUARE FOOT BLOCKS, THEY CAN BUILD IT, HAVE THE USE, HAVE THE OCCUPANCY, HAVE EVERYTHING THEY WANT FROM WHAT I UNDERSTAND, AND I CERTAINLY DON'T WANT I'M NOT SPEAKING FOR THEM. I'M SPEAKING WHAT I BELIEVE IS THEIR PATH FORWARD RIGHT NOW WITH THEIR CONTEMPLATING OR CONSIDERING IS A REDESIGN TO ADHERE TO THE STANDARDS THAT ARE CURRENTLY IN PLACE. SO IF THAT DOES HAPPEN, THERE WON'T BE ANOTHER P AND Z MEETING. THERE WON'T BE A COUNCIL MEETING, THERE WILL BE NO VOTE. SO THAT WILL BE BY RIGHT. THEY HAVE VESTED RIGHTS IN THAT PROPERTY. ENTITLEMENTS CURRENTLY. SO IF THEY DO, THAT WILL AGAIN WILL NOT REQUIRE ANYTHING. MY SUGGESTION WOULD BE JUST WE'VE BEEN WE'VE ALL SEEN THIS MOVIE A FEW TIMES WHERE IT DOESN'T PLAY OUT THE WAY THAT EVERYONE HAD HOPED. SO WHAT I WOULD SUGGEST JUST TAKE THIS ADVICE. I HOPE THAT YOU DO, REACH OUT TO THEM BEFORE THEY'RE IN HERE. WELL, THEY WON'T BE IN HERE BEFORE THEY JUST PULL A PERMIT DOWN THE ROAD AT SOME POINT WITH ALL OF THEIR USES AND WHATNOT, JUST ADHERING TO THE STANDARDS THAT ARE CURRENTLY IN PLACE, I'D REACH OUT TO THEM AND WANT TO KNOW WHAT THAT LOOKS LIKE. AND SEE WHAT THAT DOES TO THE OTHER THINGS THAT YOU'RE YOU'RE CONCERNED WITH WHAT WE'VE SEEN IN THE PAST FOR EXAMPLE, A LARGER BUILDING MIGHT ALLOW THEM TO BE REMOVED MUCH FARTHER FROM THE RESIDENTIAL AREA THAN IF THEY HAVE TO PUT IN MULTIPLE BUILDINGS WITH FIRE LANES IN BETWEEN THEM. THAT MIGHT BE

[00:45:04]

PUSHING THINGS AGAINST THE NEIGHBORHOOD. I WOULD JUST HIGHLY, HIGHLY, HIGHLY RECOMMEND. AND I'VE RECOMMENDED TO THEM THEY REACH OUT TO YOU. I WANT I WANT THEM COMMUNICATING WITH THE, HOMEOWNERS. AND I'M ENCOURAGING HOMEOWNERS TO REACH OUT TO THEM BECAUSE THEY DO OWN THAT PIECE OF PROPERTY. THEY DO HAVE ENTITLEMENTS. AND MY STRONG GUESS IS THAT THEY'RE GOING TO DO WHAT I SAID BASED ON CONVERSATIONS I'VE HEARD. AND THEY ARE NOT GOING TO JUST SIT ON THE PROPERTY AND DO NOTHING WITH IT. SO BE IN COMMUNICATION AND HOPEFULLY EVERYONE CAN ARRIVE AT THE RIGHT RESOLUTION. ULTIMATELY SO THERE'S NO MOTION THAT'S NECESSARY AT THIS POINT

[Conduct a Public Hearing to Consider/Discuss/Act on a Specific Use Permit Request for Minor Vehicle Repair (Service Street Auto), Located at 4051 South Lake Forest Drive, and Accompanying Ordinance]

BASED ON THE FACT THAT THEY HAVE WITHDRAWN IT, NEXT ITEM, RICK, I THINK YOU'RE GOING TO RECUSE YOURSELF. ITEM 240013 SUB TWO CONDUCT A PUBLIC HEARING TO CONSIDER AN ACT ON A SPECIFIC USE PERMIT REQUEST FOR MINOR VEHICLE REPAIR. SERVICE STREET AUTO LOCATED AT 4051 SOUTH LAKE FOREST DRIVE AND ACCOMPANYING ORDINANCE. THANK YOU, MR. MAYOR. AS YOU READ THIS, A REQUEST FOR A SPECIFIC USE PERMIT OR AN SUP TO ALLOW FOR AUTO REPAIR ON THE SITE, THE PROPERTY IS LOCATED AT 4051 SOUTH LAKE FOREST DRIVE AT MCKINNEY RANCH IN LAKE FOREST, IT IS JUST OFF THE HARD CORNER AND THE OVERALL TRACT IS ZONED C2 COMMERCIAL, WHICH REQUIRES CONSIDERATION OF THIS SUP FOR THE AUTO REPAIR TO BE DEVELOPED ON THE PROPERTY. STAFF HAS REVIEWED THE REQUEST AND THE ASSOCIATED SUP EXHIBIT AGAINST THE CITY'S TYPICAL ZONING AND DEVELOPMENT STANDARDS. WE DO FIND THAT IT COMPLIES WITH THOSE GIVEN THAT THIS IS A LARGE, LARGER COMMERCIAL CORNER. WE ALSO NOTE THAT THE BAY DOORS ASSOCIATED WITH THIS PROJECT ARE ACTUALLY ORIENTED AWAY FROM THE STREET FRONTAGE, NOT A REQUIREMENT, BUT CERTAINLY WE WOULD SAY A NICE UPGRADE TO A SITE WITH ALL THOSE FACTORS IN MIND, WE ARE RECOMMENDING APPROVAL OF THE REQUEST P AND Z IS ALSO RECOMMENDING APPROVAL. AND I'M HAPPY TO ANSWER ANY QUESTIONS, ANY QUESTIONS FOR JENNIFER, THE APPLICANT IS HERE. I BELIEVE THAT THEY ARE. YEP. MR. CHRISTIE. GOOD EVENING.

COUNCIL, CLAY CHRISTIE, CLAYMORE ENGINEERING, 1903 CENTRAL DRIVE. I APPRECIATE YOUR TIME. WE'RE BACK UP HERE AGAIN. IF YOU REMEMBER, WE WERE JUST BACK REZONING THIS PROPERTY. PROBABLY ABOUT A MONTH OR SO AGO, WHENEVER WE ORIGINALLY HAD THAT, JUST GIVEN A LITTLE BIT LARGER HISTORY, WE HAD THIS USE, WE WERE MOVING FORWARD WITH IT, AND THEN WE FOUND THE OVERLAY THAT WAS IN CONFLICT WITH IT. SO WE HAD TO FIRST COME. WE REZONED IT WITH YOU GUYS AND GOT THAT WHENEVER WE WENT FROM A C3 BASED ZONING TO A C2, THIS REQUIRED AN SUP. AND SO HERE WE ARE NOW WITH THAT REVISED ZONING. WE'RE HERE IN FRONT OF YOU, TO GIVE YOU JUST A QUICK RUNDOWN ON THE SERVICE STREET AUTO, TO MAYBE ANSWER A FEW OTHER QUESTIONS ABOUT THE ACTUAL OPERATION AND THE, THE DEVELOPMENT ITSELF, IT IS A PROPOSED AUTO REPAIR, IT'S MORE OF WHAT THEY CALL KIND OF A BUTLER SERVICE. AUTO REPAIR. THAT'S AN AUTO REPAIR STORE WHERE YOU GO GET IN LINE AND YOU BACK UP, AND YOU JUST SIT IN LINE AND WAIT FOR YOUR CAR TO BE DONE OR TAKEN, GET YOUR INSPECTION, YOUR OIL CHANGE. YOU ACTUALLY COME IN TO THE BEGINNING. YOU'LL PARK YOUR VEHICLE, YOU COME INSIDE WHERE YOU MEET YOUR SERVICE ATTENDANT. THEY WILL TAKE IT. THEY WILL THEN TAKE YOUR CAR TO THE BAY THEMSELVES THROUGH THAT, NOT SOMETHING THAT THE PERSON DOES.

AND WE WILL. THEY'LL MAKE THE SERVICE, THE REPAIRS, WHATEVER THEY HAVE. AND THEN EITHER A YOU CAN COME BACK, THEY DO HAVE SOME COURTESY CAR TRAVEL THAT THEY CAN GO TAKE YOU TO AND FROM YOUR PLACE OF WORK. IF YOU NEED TO GET BACK TO WORK, OR OTHER ITEMS LIKE THAT TO KIND OF BE A LITTLE BIT MORE THAN JUST THE PULL UP, SIT IN LINE AND WAIT, I KNOW THERE WAS QUESTIONS IN IN P AND Z THAT WE WANTED TO CLARIFY AND WE'LL REITERATE WITH CITY COUNCIL IS THAT THERE'S NOT ANY PLANS FOR OVERNIGHT CARS TO BE STORED. OUTSIDE IN THE OUTSIDE FACILITY IN THE EVENT THAT A CAR GETS BROUGHT TO THE FACILITY THAT IS DAMAGED OR IS IN TOO MUCH WHERE THEY CAN'T MAKE A QUICK REPAIR UNTIL THEY CAN GET IT SITUATED, IT WILL BE STORED INSIDE IN ONE OF THE BASE, WITH THAT, I'M HAPPY TO ANSWER ANY QUESTIONS. QUESTIONS FOR THE APPLICANT. OKAY, THIS IS A PUBLIC HEARING. IS THERE ANYONE THAT LIKE TO SPEAK TO THIS ITEM? SEEING NONE. MR. MAYOR, I MOVE THAT WE CLOSE THE PUBLIC HEARING AND APPROVE THIS ITEM. SECOND, CAST YOUR VOTES. MOTION PASSES.

GOOD LUCK SIR. THANK YOU. THAT IS THE END OF OUR AGENDA. AND REGULAR ITEMS AND PUBLIC HEARING

[COUNCIL AND MANAGER COMMENTS]

ITEMS. WE'VE ALREADY HEARD CITIZEN COMMENTS. SO COUNCIL AND MANAGER COMMENTS, IF ANY. I'LL START DOWN THERE. MR. BELLER. ALL RIGHT. I CAN GET STARTED WITH THIS. I MAY BE REDUNDANT TO SOME OF, SOME OF THE OTHER PEOPLE THAT WANT TO SPEAK ABOUT THINGS, BUT, BACK TO SCHOOL STARTS, THIS WEEK. IF YOU'VE GOT IF YOU'RE MARRIED TO A TEACHER LIKE I AM, THEY'VE PROBABLY BEEN IN SCHOOL FOR A COUPLE OF WEEKS. BUT THE KIDDOS GOING BACK THIS WEEK, IMAGINE, STARTED EARLIER THIS WEEK. MCKINNEY, FRISCO. LOVEJOY I THINK THEY ALL START THIS WEEK. PROSPER A COUPLE OF

[00:50:05]

ORGANIZATIONS THAT DID REALLY GREAT BACK TO SCHOOL PROGRAMS, MR. MAYOR, AND MALEY AND LOVE LIFE, THE GROUP THAT ALWAYS SUPPORTS WEBB ELEMENTARY, LOTTIE AND JASON HERNANDEZ, KIM HUGHES, OSCAR GARZA WITH OGS, CHOP SHOP, LEONARD BARBOSA, MISS DEBORAH BRADFORD IN THE BACK IN HER GROUP. SUPPORTED WOODSIDE VILLAGE AND RAISED A BUNCH OF SCHOOL SUPPLIES AND I THINK YOU SAID IT WAS OVER 90 KIDS THAT WERE OUT THERE, THE BARBER SHOP ON NORTH TENNESSEE HAD A HAD AN OUTING OF THE BURROS, HAD AN EVENT. I KNOW LOTS OF CHURCHES HAD AN EVENT. THERE WERE A TON OF EVENTS AROUND TOWN TO CELEBRATE THE INCREASED TRAFFIC THAT WE'RE ALL GOING TO EXPERIENCE AT THE END OF THE WEEK. SO, JUST WANTED TO RECOGNIZE EVERYBODY WHO DID THAT. I GOT TO MEET THE NEW CEO OF HABITAT FOR HUMANITY, HUMANITY, MISS SHONDA SCHAEFER, AND ENJOYED VISITING WITH HER. AND, SOMEONE FAMILIAR TO THIS GROUP, MR. SCOTT ELLIOTT, ABOUT THE FUTURE OF HABITAT. AND THEY'RE GOING TO HAVE A KIND OF A KICKOFF OF HER, TERM WITH HABITAT AND KIND OF THE REIMAGINING OF THEIR PROJECT THAT THEY'VE GOT, GOING OVER ON BUMPUS STREET. AND THAT IS ON SEPTEMBER 19TH. AND SO JUST SOMETHING TO MARK ON YOUR CALENDARS, A DAY TO CELEBRATE WITH THEM, LEADERSHIP MCKINNEY STARTED THEIR CLASS, THEIR NEW CLASS. I THINK THEY HAVE 35 PEOPLE. THEY DIDN'T THEY BARELY HAD ENOUGH ROOM TO TAKE A PICTURE, BUT THEY GATHERED AT THE BODY SHOP, AS THEY ALWAYS DO TO KICK OFF THE CLASS. AND A BUNCH OF ALUMNI WERE THERE TO CHEER THEM ON, INCLUDING ONE OF MY FAVORITE, PEOPLE, DEB FITZGERALD WAS THERE, SO I WAS HAPPY TO SEE DEB, WHO IS NOT AROUND THAT MUCH. AND WE ALSO, DAVID KELLY, GAVE A LITTLE BIT OF A, DISCUSSION ABOUT MONEY RAISED IN HONOR OF BUZZ, COLBY, WHO PASSED AWAY LAST WEEK, LAST WEEK. AND BUZZ WAS A FACILITATOR FOR THAT GROUP. AND I THINK DAVID RAISED ENOUGH MONEY, THAT DAY TO SET UP A SCHOLARSHIP FOR LEADERSHIP. MCKINNEY FOR THE NEXT TEN YEARS IN HONOR OF BUZZ, WILL TRULY BE MISSED. AND DID A LOT FOR THAT. THAT PROGRAM IN THIS COMMUNITY, LASTLY, TOMORROW NIGHT IS OUR LAST INTERVIEW SESSION FOR BOARDS AND COMMISSIONS, AND WHILE I HAVEN'T BEEN HERE FOR ALL OF THEM, I'VE GOTTEN TO WATCH A BUNCH OF THEM ON, VIDEO. AND I'M ALWAYS IMPRESSED WITH THE TALENT WE HAVE IN THIS COMMUNITY. AND THANK YOU ALL FOR APPLYING AND LOOK FORWARD TO FINDING A PLACE FOR YOU TO SERVE. THAT'S ALL I'VE GOT. THANK YOU. I'D JUST LIKE TO AGAIN, THANK THE COMMITTEE THAT HELPED US WITH THE CHARTER AMENDMENT, IF YOU DON'T KNOW, THEY PUT A LOT OF HOURS IN THE LAST TWO MONTHS MEETING EVERY OTHER WEEK FOR ABOUT TWO HOURS. THEY. I FEEL LIKE THEY THEY REPRESENTED A GOOD CROSS SECTION OF MCKINNEY AND THEIR INPUT WAS HIGHLY REGARDED. AND THANK THE STAFF FOR STAYING UP HERE AND HELPING US WITH THOSE, WITH THOSE MEETINGS, AND ON ANOTHER NOTE, THE FIRST UNITED METHODIST CHURCH ALSO ADOPTED, CALDWELL SCHOOL FOR BACKPACKS. AND WHOEVER DID ALL THE BACKPACK, THEY DID A TREMENDOUS JOB THROUGHOUT THE CITY. AND I JUST WANT TO THANK ALL THOSE PEOPLE. THANK YOU. JEN, SINCE WE'RE GIVING ALL THE THANKS ON BACKPACKS, I DO WANT TO POINT OUT THAT I BELIEVE THE BOHRA MOSQUE ON SOUTH TENNESSEE ADOPTED FINCH ELEMENTARY, AND THEY HANDED OUT A BUNCH OF BACKPACKS. SO MAN, IF YOU'RE IN THE BACKPACK BUSINESS, YOU DID REAL WELL HERE IN THE LAST COUPLE OF WEEKS HERE IN MCKINNEY. A COUPLE OF THINGS, WE HAD, I BELIEVE, SINCE THE LAST MEETING WE HAD DRUM CORPS INTERNATIONAL. I DON'T THINK I'VE TALKED ABOUT IT, BUT, DEAN SCHMIDT AND HIS GROUP PUT THAT ON, AND, MAN, WE GET A LOT OF PEOPLE AT THAT MISD STADIUM TO WATCH THESE. VERY IMPRESSIVE, BANDS COME AND ENTERTAIN US. AND IT IS REALLY SOMETHING. IT IS A GREAT AD FOR MCKINNEY, THE BACK TO SCHOOL AT, WEBB. I WAS THERE WITH COUNCILMAN BELLER, AND THAT WAS PHENOMENALLY WELL RUN. HE GAVE THANKS TO THE FOLKS THAT WERE OUT THERE CUTTING HAIR. BUT, YOU KNOW, JASON SAID SOMETHING. JASON HERNANDEZ, WHO KIND OF HEADS THAT UP, SAID SOMETHING I THOUGHT WAS REALLY IMPORTANT. IS THAT YOU BECOME MORE CONFIDENT IF YOU FEEL MORE CONFIDENT. AND FOR THESE KIDS, MAN, THEY GET A HAIRCUT THAT IS A $50 HAIRCUT THAT THEY DON'T EVER GET. THEY GET IT FOR FREE.

AND IT REALLY MAKES A DIFFERENCE, I THINK, WITH THOSE KIDS. AND SO JUST THE WORK THAT

[00:55:03]

JASON DOES, THE LOVE AND THE CREATIVITY I THINK IS SO HELPFUL FOR THOSE PEOPLE, FOR THOSE FOLKS OVER THERE, AND LAST, I WANT TO DO WANT TO SAY A FEW WORDS ABOUT BUZZ. BUZZ COLBY FOR TEN YEARS, WAS ONE OF THE PRIMARY FACILITATORS OF THE LEADERSHIP MCKINNEY PROGRAM, AND HE TOUCHED A WHOLE LOT OF LIVES AROUND HERE. AND MCKINNEY WAS AWFULLY IMPORTANT TO HIM. AND, SO IT WAS A BIG LOSS FOR MCKINNEY. AND I DO THANK DAVID KELLY, WHO'S IN THE AUDIENCE FOR, GETTING THE SCHOLARSHIP UP AND RUNNING. BUT I THINK AND BUZZ GOT TO LEARN ABOUT THAT SCHOLARSHIP RIGHT BEFORE HE PASSED AWAY. AND SO IT WAS JUST REALLY, REALLY A COOL THING. BUT WE'RE SO SORRY TO LOSE HIM. THANK YOU, MR. MAYOR. YES. STICKING ON THE THEME OF BACKPACKS, MISS BRADFORD BACK THERE IN WOODSIDE VILLAGE APARTMENTS, HAVE WE BEEN KIND OF, SPONSORING THIS YEAR? I WASN'T ABLE TO ATTEND THE EVENT OVER THE WEEKEND, BUT I WAS ABLE TO HELP WITH THE BACKPACK SPONSORSHIP, AND, MISS BRADFORD TOLD ME THEY HAD 75 BACKPACKS THAT THEY HANDED OUT WITH SCHOOL SUPPLIES, GAVE OVER 150 LUNCHES DURING THAT TIME, AND HAD ALL TYPES OF GAMES AND THINGS GOING ON DURING THAT WEEKEND. SO, MISS BRADFORD, WE THANK YOU AND EVERYBODY THAT'S INVOLVED. I MEAN, WE HAVE LOTS OF PEOPLE ON OUR BOARDS AND COMMISSIONS THAT ARE HELP WITH THE WOODSIDE VILLAGE APARTMENTS AND, ANGELA, ANGELA WOODS IF SHE WAS HERE.

BUT YEAH. SO THAT WAS A GREAT EVENT THERE, I HAD THE, I ATTENDED THIS EVENT HERE THAT WAS HERE IN THE MCKINNEY AND AT THE SHERATON HOTELS, DESTINATION GAMING DISCUSSION. IT WAS A UNIQUE, UNIQUE DISCUSSION. WE GOT TO MEET WITH THE, THE EXECUTIVES FROM THE SANDS HOTEL GROUP WHO BOUGHT THE DALLAS MAVERICKS AND DISCUSSED ABOUT NOT JUST GAMING. YOU LEARNED A LOT, REALLY? GAMING IS ABOUT 5% OF WHAT THEY DO. IT'S REALLY, DESTINATION RESORTS. AND, WE LEARNED ABOUT THE ABSENCE OF CONVENTION SPACE IN NORTH TEXAS. THAT WAS REALLY THE THEME. AND I DIDN'T KNOW HOW MUCH OF A CONVENTION DESERT WE HAD IN NORTH TEXAS. AND IT DOESN'T, YOU KNOW, THAT GROUP, YOU KNOW, MULTI-BILLION DOLLAR FIRM THAT DID ALL THE MARKET STUDIES FOR US AND JUST KIND OF LET US KNOW THAT THE LACK OF CONVENTION SPACE IN OUR AREA AND THE NEED FOR IT AND SO IT'S ONE OF THE THINGS I WANT TO LOOK AT, IN THE FUTURE IS, HOW DO WE BRING MORE CONVENTION SPACE TO NORTH TEXAS, WHETHER IT'S, YOU KNOW, ESPECIALLY IN OUR CITY, MCKINNE, LASTLY, I NEVER SPEAK ABOUT THIS, BUT I AM STILL ON THE HOA BOARD IN MY COMMUNITY, I KNOW, WE HAD A GREAT MEETING, AND, I JUST WANT TO JUST CONGRATULATE THE GUYS THAT ARE ON THAT BOARD.

I TOLD THEM I WOULD. THERE'S HARD DECISIONS AT THE LOCAL, LOCAL, LOCAL LEVEL. I WOULD SAY ABOUT, YOU KNOW, WHERE TO SPEND FUNDS AND THERE'S BUDGETS ON EVERY LEVEL, IN THE CITY, FROM, FROM THE HOA, ALL THE WAY TO CITY COUNCIL. AND THERE'S JUST LOTS OF PEOPLE WE HAVE BOARDS AND COMMISSIONS GOING ON. I JUST, I JUST THANKFUL IN THE CITY OF MCKINNEY, THERE'S SO MANY PEOPLE THAT WANT TO SERVE, WHETHER IT'S AT THE HOA BOARD TO THE VOLUNTEER. MCKINNEY, IT'S JUST A LOT OF VOLUNTEERISM THAT GOES ON IN MCKINNEY THAT THAT GOES ON KNOWN AND, AND THAT PEOPLE DON'T REALLY, YOU KNOW, KNOW ABOUT. BUT I JUST WANT TO SAY THANK YOU TO MY HOA COMMUNITY FOR, FOR STEPPING UP AND DEALING WITH THE BUDGET ISSUES THAT WE DEAL WITH ON A DAILY OR A MONTHLY BASIS. THERE'S SOMETHING ABOUT GOING LAST. IT'S NOT SO FUN BECAUSE EVERYONE'S COVERED JUST ABOUT EVERYTHING. BUT I WANTED TO JUST REITERATE A FEW THINGS. MANY OF US HAVE BEEN DEEPLY AND PROFOUNDLY TOUCHED BY BUZZ COLBY AND WHAT HE LEFT IN OUR HEARTS.

AND, YOU KNOW, FOR ME, GOING INTO LEADERSHIP MCKINNEY, I WAS KIND OF TRYING TO FIND MY WAY AND WHAT I WANTED TO DO IN THIS CITY IN TERMS OF JUST SERVING. AND IT NEVER OCCURRED TO ME TO THINK ABOUT POLITICS IN ANY WAY. I WAS JUST DOING SOME COMMUNITY SERVICE, AND HE WAS ONE OF THE FEW PEOPLE WHO SAW SOMETHING VERY EARLY AND ENCOURAGED IT AND NURTURED IT, AND WAS SO ENCOURAGING ALL ALONG THE WAY. AND SO I JUST WANTED TO SHOUT OUT BUZZ, BECAUSE HE WAS JUST AN AWESOME, AWESOME GUY, DCI WAS A LOT OF FUN. I'M A I'M A BAND NERD, AS YOU ALL KNOW. SO FOR ME, THIS EVENT EVERY YEAR HAS BECOME ONE OF THE HIGHLIGHTS OF THE YEAR FOR ME. WE ARE SEEING AN INCREASE IN THE ATTENDANCE TOO, SO IT'S A GREAT WAY TO KIND OF PUBLICIZE MCKINNEY AND HOW GREAT OF A COMMUNITY WE ARE. THEY DID HAVE A AN EVENT THE NIGHT BEFORE. I WASN'T ABLE TO ATTEND OVER AT TUPPS WITH THE DRUM CORPS, AND APPARENTLY IT WAS ONE OF THE MOST WELL ATTENDED EVENTS THEY'VE HAD OVER THERE. SO JUST WANTED TO THANK TUPPS FOR HOSTING THEM AND SHOWCASING MCKINNEY. SO, IN SUCH A POSITIVE LIGHT, DEBORAH BRADFORD DID A FANTASTIC JOB. I ACTUALLY WAS THERE AT WOODSIDE VILLAGE ON FRIDAY, SHE AND HER TEAM, IT WAS HOT, HOT, HOT, HOT.

AND THEY WERE IN THERE ENTERTAINING KIDS GAMES, GIVEAWAYS, BACKPACKS. THEY FED THEM. THEY LOVED THEM. AND THAT'S THE MOST IMPORTANT THING I THINK THIS COMMUNITY REALLY NEEDS IS TO KNOW THAT THERE ARE PEOPLE WHO LEGITIMATELY CARE ABOUT THEIR WELL-BEING. SO I JUST WANT TO SAY PUBLICLY, DEBORAH, THANK YOU AND YOUR TEAM FOR EMBRACING THAT COMMUNITY.

[01:00:05]

AND SHOWING THEM WHAT IT REALLY MEANS TO BE A GOOD NEIGHBOR. SO THANK YOU FOR THAT. AND THEN LASTLY, I GOT A CHANCE IN MY BRAND NEW MAYOR PRO TEM ROLES HERE TO TAKE A TRIP OUT WITH OUR CITY MANAGER, PAUL GRIMES, BARRY SHELTON, TREVOR MINYARD AND KEN CALI. WITH THE AIRPORT, WE WENT OUT TO GO TALK TO OUR ELECTED OFFICIALS ABOUT MCKINNEY AND THE NEED FOR INFRASTRUCTURE SUPPORT AND GRANT FUNDING FOR ALL THE DIFFERENT THINGS THAT WE'RE DOING SO THAT IT'S NOT LEFT ON THE OUR BACKS TO CARRY THE LOAD FOR THE REGION, VERY, VERY PRODUCTIVE CONVERSATIONS. I CANNOT TELL YOU HOW IMPRESSED I AM WITH OUR CITY STAFF AND HOW WELL THEY PRESENT ON BEHALF OF US AS THE RESIDENTS OF MCKINNEY, DID A FANTASTIC, FANTASTIC JOB, REALLY JUST KIND OF LOBBYING FOR SUPPORT AS WE CONTINUE TO GROW AS A COMMUNITY AND PREPARE FROM AN INFRASTRUCTURE PERSPECTIVE, PREPARE FOR THE GROWTH THAT'S STILL AHEAD OF US. SO JUST WANTED TO THANK YOU ALL PUBLICLY FOR THAT. AWESOME. THANK YOU. THANK YOU FOR THOSE KIND COMMENTS. MAYOR PRO TEM, JUST A COUPLE THINGS, REMINDER, OF COURSE, WE'VE BEEN TALKING ABOUT BACKPACKS. SCHOOL STARTS THIS WEEK FOR MISD. ON THURSDAY, RIGHT? THURSDAY THE EIGHTH. THAT MEANS EVERYBODY REALLY NEEDS TO BE A LITTLE MORE PATIENT. SLOW DOWN A LITTLE BIT. IT'S GOING TO TAKE YOU A LITTLE LONGER, PERHAPS TO GET TO WORK IN THE MORNING, BECAUSE THERE WILL BE A LOT OF STUDENTS ON THE ROAD WITH PARENTS DROPPING THEM OFF OR STUDENTS DRIVING, AND IT'S ALWAYS A LITTLE CHAOTIC FOR A FEW WEEKS. AND THEN EVERYBODY KIND OF SETTLES INTO A RHYTHM. BUT WE JUST WOULD ADVISE FOLKS, PLEASE BE PATIENT AND SLOW DOWN AND GIVE YOURSELF A LITTLE EXTRA TIME HERE IN THE COMMUNITY. THE OTHER THING IS, OF COURSE, JUST A REMINDER THAT THIS FRIDAY IS OUR BUDGET PRESENTATION RIGHT HERE IN THIS ROOM, IF YOU WOULD WISH TO WATCH, MEMBERS OF THE PUBLIC, YOU CAN TUNE IN OR YOU CAN COME OF COURSE, IT'S A PUBLIC MEETING, SO YOU'RE WELCOME TO COME. AND THERE WILL BE LOTS OF AND LOTS OF INFORMATION ON OUR WEBSITE. OUR WEBSITE STILL IS THE BEST PLACE FOR YOU TO GO AS A ONE STOP SHOP TO GATHER ALL KINDS OF INFORMATION, INCLUDING THE BUDGET THAT WILL BE PROPOSED ON FRIDAY. THAT WILL BE POSTED SHORTLY AFTER THE BUDGET PRESENTATION. AND THAT'S ALL I HAVE, SIR. ALL RIGHT. I'M GOING TO ECHO SOME OF THE THINGS THAT HAVE BEEN SAID. OF COURSE. BUZZ COLBY, WHAT A WHAT A FORCE HE WAS WITH NOT JUST LEADERSHIP MCKINNEY, BUT JUST IN MCKINNEY IN GENERAL AND WITH WITH PEOPLE AND MENTORING AND ENCOURAGING.

THAT'S THAT'S WHAT I WOULD SAY. I THINK WHEN I THINK ABOUT BUZZ COLBY, I THINK ABOUT ENCOURAGING AND HOW HE ENCOURAGED PEOPLE. SHE SAID, SAW SOMETHING IN YOU AND SPEAKING OF YOU, YOU TALKED ABOUT STAFF UP IN DC AND HOW IMPRESSED YOU WERE. I CAN TELL YOU THAT STAFF WAS EQUALLY IMPRESSED WITH YOU AND HOW YOU REPRESENTED THE CITY COUNCIL AND REPRESENTED ALL OF US AND THE ENTIRE CITY TO OUR LEGISLATORS AND OTHERS THAT YOU MET WITH UP THERE. SO THANK YOU FOR STEPPING IN AND HANDLING THAT. SO, SO GREATLY, I WAS AT CONVOCATION MISD. WE TALKED ABOUT SCHOOL IS STARTING AND IT WAS SO GREAT TO LISTEN TO BOTH HARVEY OAXACA, WHO SPOKE, IF YOU IF I'M SURE IT'S OUT THERE ON VIDEO, IT IS SO WORTH GOING AND SPENDING FIVE MINUTES AND WATCHING HARVEY ADDRESS THE TEACHERS AND STUDENTS THAT WERE AT THAT CONVOCATION. SEAN PRATT SUPERINTENDENT AS WELL. VERY MUCH WORTH WATCHING. BUT TO LISTEN TO THOSE TWO AND JUST TALK ABOUT OUR SCHOOLS AND OUR CHILDREN AND EDUCATION HERE IN THE CITY, YOU CANNOT YOU CANNOT DENY THE TRUE DEEP, DEEP, DEEP PASSION. AND WATCH THOSE TWO LITTLE THOSE THOSE FIVE MINUTES AND 3 OR 4 MINUTES AND YOU WILL BE, YOU WILL BE ENCOURAGED ABOUT OUR, OUR ISD, DONUTS WITH SUPERHEROES THAT WAS ONE OF THE, ONE OF THE EVENTS THAT LOVE LIFE PUT ON WAS A LOT OF PEOPLE THAT WERE THERE AND HELPED. AND AGAIN, MANY IN THIS ROOM, DAVID, RJ, SO MANY OTHERS. JEN, BUSHMAN, I'M NOT GOING TO TRY TO NAME EVERYBODY, BUT TONS THAT WERE THERE. BUT AGAIN, RAISING, OR BRINGING IN MORE BACKPACKS, SUPPLIES FOR THE OVER 300 BACKPACKS THAT THEY PUT TOGETHE.

I ALWAYS HAVE A DIFFERENT TAKE ON THIS EVERY YEAR. I OF COURSE, I'M ALWAYS IMPRESSED WITH ALL THE HARD WORK THAT THEY DO. AND THEN I'M ALWAYS SO RELIEVED WHEN MY OFFICE GETS UNLOADED OF THE TRUCKLOADS OF SUPPLIES THAT I HAVE TO WALK AROUND AND USE BACK DOORS TO GET TO MY OWN OFFICE, BUT I DO IT WITH A SMILE. DON'T I, HONEY? JUST LOVE IT, NO. IT'S GREAT. AND THE WORK THAT YOU ALL DO, AND EVERYONE IN DEBORAH AND YOUR YOUR OUTREACH AND JASON HERNANDEZ, JUST TAKING CARE OF KIDS THAT DON'T HAVE THE ABILITY TO MAYBE DO SOME OF THOSE THINGS, IT'S SO IMPORTANT. AS PATRICK SO ELOQUENTLY SAID, THEY HAVE CONFIDENCE WHEN THEY GO IN WITH THE NEW HAIRCUT AND

[01:05:01]

SUPPLIES AND, AND ALL THAT, THEY'RE ON EQUAL GROUND, AND IT'S GREAT. I WANT TO GIVE A SHOUT OUT TO MEDICAL CITY MCKINNEY. I'VE BECOME A FREQUENT FLIER THERE. I SPENT TWO WEEKS IN A ROW IN THE E.R, I GOT A CARD. NOW, I THINK I GET A DISCOUNT AFTER THE FOURTH VISIT.

IT'S GOING TO BE FREE, SO I LOOK FORWARD TO THAT, NOW THAT I GOT INTO RIDING, APPARENTLY, I'M GOING TO NEED IT, SPEAKING OF RIDING THE TRAILS AT ERWIN FARMS, I TALKED ABOUT LAST TIME, BUT I WANT TO SHOUT OUT TO MCKINNEY PARKS FOUNDATION, ALL VOLUNTEER ORGANIZATION. I WENT AND EXPERIENCED THE TRAILS AT, AT A GREAT RANCH THAT THEY PUT IN ABOUT, I GUESS, FOUR MILES OR SO OF TRAILS AND CLEARED IT ALL. AND THEN THEY THEY CONTINUED TO MAINTAIN IT. AND THAT WAS A GREAT EXPERIENCE. AND TO THINK ABOUT THOSE ARE JUST VOLUNTEERS GETTING OUT THERE AND DOING THAT ALONG WITH THE MANY, MANY OTHER THINGS THE PARKS FOUNDATION DOE, DAVID KELLY, THANK YOU FOR STEPPING UP REGARDING, BUZZ AND YOU WERE YOU WERE REACHING OUT IMMEDIATELY WHEN HE CAME BACK INTO A HOSPICE AND, AND PUT TOGETHER, YOU KNOW, PEOPLE RAISED MONEY AND PUT TOGETHER AND TOOK THE LEAD ON THAT AND YOUR OWN MONEY AS WELL, AND SET UP THAT SCHOLARSHIP THAT'S GREAT.
