COMMISSIONER. ALL RIGHT. NEXT IS PUBLIC COMMENTS ON AGENDA ITEMS. BUT I BELIEVE. WE ONLY HAVE A
[PUBLIC COMMENTS ON AGENDA ITEMS (for Non-Public Hearing Items)]
FEW A HANDFUL OF NON-AGENDA. SO I'M GOING TO GO AHEAD AND CALL ALL OF THEM. YOU'LL HAVE THREE MINUTES. WHEN YOU COME UP, PLEASE STATE YOUR NAME AND ADDRESS FOR THE RECORD. IF YOU HAVE NOT SPOKEN IN PUBLIC COMMENTS BEFORE, YOU WILL NOTICE A TIMER TO YOUR LEFT AND RIGHT.IT WILL BE GREEN UNTIL YOU GET TO 30S. IT'LL TURN YELLOW. IT'LL TURN RED AT FIVE SECONDS REMAINING AND THEN A BUZZER. PLEASE WRAP UP YOUR COMMENTS PRIOR TO THAT BELL WOULD BE APPRECIATED, SO WE CAN HAVE EVERYONE BE ABLE TO SPEAK. BETH BENTLEY. HOW DO YOU. GOOD EVENING, BETH BENTLEY, 508 NORTH CHESTNUT MCKINNEY, TEXAS. 75069. JUST A COUPLE OF THINGS REGARDING THE FEDERAL LEGISLATIVE PRIORITIES. JUST SOME RECOMMENDATIONS. SO THE FIRST ONE WITH THE MCKINNEY NATIONAL AIRPORT. THE FIRST PROMPT THAT I BELIEVE I READ WAS FOR EAST SIDE DEVELOPMENT AND FURTHER IN THE EXPLANATION, IT MENTIONED EAST SIDE DEVELOPMENT OF AT THE MCKINNEY NATIONAL AIRPORT. IF THAT PROMPT COULD EITHER JUST BE EXPANDED ON JUST A LITTLE BIT MORE, BECAUSE AT FIRST READING IT SOUNDS LIKE THE DEVELOPMENT IS GOING TO ENCOMPASS THE EAST SIDE AND THERE ARE ALREADY INITIATIVES THAT ARE TAKING PLACE UNDER THE GUISE OF EAST SIDE DEVELOPMENT. AND SO JUST TO MAKE SURE THERE'S CLARIFICATION FOR THOSE, UNLESS THERE ARE OPPORTUNITIES THAT WILL GO FIT INTO THE EAST SIDE DEVELOPMENT OVERALL. SO THAT'S THE FIRST ONE. AND THE SECOND ONE HAS TO DO WITH THE POTENTIAL FOR MAYBE RE-ENVISIONING THE HOMELESSNESS OPPORTUNITIES THAT ARE IN MCKINNEY, THERE'S BEEN A LOT, A LOT, A LOT, A LOT OF WORK THAT HAS BEEN DONE IN THE COMMUNITY REGARDING THIS MASSIVE MAMMOTH THAT EXISTS IN OUR COMMUNITY, AND HOMELESSNESS IS NOW IT NOW HAS A PRESENCE THAT IT HAS NOT HAD IN MANY YEARS.
AND SO IF THERE'S AN OPPORTUNITY TO NOT ONLY GALVANIZE, NOT PUTTING IT ON THE CITY NECESSARILY, BUT CITY, COUNTY, STATE, FEDERAL, HAVING A COLLABORATIVE OPPORTUNITY FOR ALL OF THOSE ENTITIES TO COME TOGETHER ALONGSIDE OF CHURCHES, ALONGSIDE OF MAYBE SOME CORPORATE ENTITIES THAT COULD MAYBE BE INVOLVED, I KNOW PLACES LIKE CAPITAL ONE, THEY HAVE REIMAGINED TYPE, OPPORTUNITIES ALL THE TIME TO HAVE DIFFERENT PARTNERSHIPS, TO COME TOGETHER, TO WORK THROUGH VERY DIFFICULT CONVERSATIONS AND VERY DIFFICULT TASKS FOR COMMUNITIES AND SO PERHAPS MCKINNEY COULD SERVE AS AN OPPORTUNITY FOR A MODEL FOR ADDRESSING HOMELESSNESS IN A WAY THAT BRINGS PEOPLE THAT ARE MAKING THEIR BED IN THE IN THE GRASS, MAKING THEIR BED ON CONCRETE, IN A WAY THAT REALLY ADDRESSES THEIR, THEIR LIVES AND BRINGS THEM TO A PLACE OF DIGNITY. THANK YOU. THANK YOU. BETH. THANK YOU. LIZ. MICHELLE. HELLO. I'M ELIZABETH MICHELLE, 6205 EAGLE STONE DRIVE, MCKINNEY. I WANT TO SPEAK TONIGHT ABOUT ONE OF THE CITY OF
[00:15:02]
MCKINNEY EMPLOYEES, MCKINNEY IS SORT OF A UTOPIA, RIGHT? THE DOWNTOWN AREA IS STRAIGHT UP OUT OF A MOVIE, THE BEAUTIFUL PEOPLE WALKING AROUND AND THE MAYOR PICKING AND CHOOSING WHO RUNS FOR OFFICE. AND WHO GETS ELECTED FOR OFFICE. SO MCKINNEY STILL OPERATES WITHIN GOOD OLD BOY, SMALL TOWN FEEL, WHICH IS WHY I WANTED TO HIGHLIGHT AN EXPERIENCE THAT I HAD DURING MY TIME IN LEADERSHIP MCKINNEY. ONE OF MY CLASSMATES, ANDREW JONES, A CITY EMPLOYEE, AND I HAD A VERY INTERESTING CONVERSATION ABOUT LIFE BEING MORE ABOUT WHO YOU KNOW AS OPPOSED TO WHAT YOU KNOW. AND IF YOU KNOW, ANDREW, HE'S A VERY BY THE BOOK TYPE OF GUY. I TOLD HIM ABOUT MY EXPERIENCE AND MY FRIEND JUSTIN'S HOSTING THE MCKINNEY PRIDE EVENT IN GLENN MITCHELL PARK. FOR THE PAST FEW YEARS, WE'VE HAD GUIDANCE AND TEMPLATES THAT USING THE EXACT SAME PAPERWORK AS A LONG TIME EVENT THERE FOR MULTIPLE MULTIPLE TIMES DURING THE YEAR. BUT FOR SOME REASON, OUR PAPERWORK HAD COMPLICATIONS. ROADBLOCKS PUT IN THE WAY ALL THE WAY UP UNTIL THE VERY DAY OF THE EVENT. SO I EXPLAINED THIS TO ANDREW THAT THIS WAS JUST ONE EXAMPLE OF HOW QUEER PEOPLE HAVE A VERY DIFFERENT EXPERIENCE HERE IN MCKINNEY. THINGS LIKE US GETTING AN EMAIL THE NIGHT BEFORE THE EVENT TO SAY THAT THE PERMITS FOR THE FOOD TRUCKS WEREN'T RECEIVED AND WE COULDN'T HAVE THEM. ANDREW TRIED TO JUSTIFY IT OF COURSE, AS HUMAN NATURE.RIGHT. AND THEN I TOLD HIM ABOUT THE FIRE MARSHAL COMING DURING THE SETUP OF THE EVENT TO PHYSICALLY MEASURE THE VENDOR TENTS, MAKING SURE THAT THE SIZE AND DISTANCE WAS EXACTLY AS IT WAS SUPPOSED TO BE. AGAIN, THE PERSON WITH THE LONG STANDING EVENT SAID SHE HAD NEVER HAD THE FIRE MARSHAL OUT AT HER EVENTS. SHE WAS SHOCKED AND ANDREW AGAIN SAID, WELL, LIZ, MAYBE THE FIRE MARSHAL WAS BUSY ON THE REST OF THOSE OTHER DAYS, RIGHT? SO IF YOU KNOW ME, YOU PROBABLY KNOW THE LOOK THAT I GAVE HIM WHEN HE SAID THAT. AND I TOLD HIM, EVEN IF THIS WERE TRUE, I SAID, DO YOU UNDERSTAND HOW THESE TYPES OF THINGS HAPPENING TO A QUEER LED EVENT ARE PERCEIVED BY THE EVENT ORGANIZERS? SO THIS LAST TIME WHEN JUSTIN TRIED TO CANCEL THE MCKINNEY PRIDE EVENT, IT WAS ANDREW THAT REACHED OUT ASKING WHAT HE COULD DO TO HELP. AND IT WAS ANDREW THAT MADE SURE JUSTIN HAD EVERYTHING THAT HE NEEDED AND IT WAS ANDREW THAT WAS WILLING TO SEE A SITUATION FROM A PERSPECTIVE DIFFERENT THAN HIS AND BE UNDERSTANDING. AND FOR THAT, I WANTED TO PUBLICLY THANK MY LEADERSHIP MCKINNEY CLASSMATE ANDREW JONES, FOR BEING THE EXAMPLE OF WHAT MCKINNEY NEEDS, BECAUSE EVEN THIS PAST WEEK AT THE LIBRARY ADVISORY BOARD MEETING AND LAST MONTH, THERE'S A MAN THAT KEEPS COMING, SHOWING UP, COMPLAINING ABOUT THE PUBLIC CITY LIBRARY CELEBRATING PRIDE MONTH. APPARENTLY, FAMILY VALUES IS ONLY IMPORTANT ACCORDING TO HIS DEFINITION OF WHAT A FAMILY SHOULD BE, AND I WONDER IF THAT FAMILY IS PART OF THIS UTOPIA OF MCKINNEY. THANK YOU. LUCIA RUTENBERG. GOOD EVENING. MY NAME IS LUCIA ROTENBERG. I'M AT 321 BLUE SAGE DRIVE IN NORTH MCKINNEY, 75071. AND I'M HERE TONIGHT TO ASK YOU IF YOU CAN FAST TRACK AN APPLICATION THAT WAS TURNED IN BY AT&T FOR A SOUTH CELL TOWER AT 2500 COMMUNITY DRIVE THERE. THIS I WAS SO HOPING THIS COULD GET DONE BEFORE SCHOOL STARTED. THAT TOWER WAS. THERE'S AN ELEMENTARY SCHOOL, A JUNIOR OR MIDDLE SCHOOL. MCKINNEY NORTH HIGH SCHOOL, AND OF COURSE, COLLIN COLLEGE. RIGHT BEHIND US. MOST IMPORTANT, IT WILL BE A STONE'S THROW FROM THE MCKINNEY POLICE DEPARTMENT. AND A COUPLE BLOCKS DOWN THE STREETS OF FIRE STATION. NOT TO COUNT THOSE 5000 APARTMENTS THAT ARE GOING UP ON THE NORTHEAST CORNER OF WILMOTH AND COMMUNITY. SO THIS IS JUST REALLY, REALLY NEEDED. AND I KNOW AT&T HAS GOT THE APPLICATION TURNED IN AND ALL THE T'S WERE CROSSED AND THE I'S DOTTED, AND IF YOU COULD SPEED THAT IN SOME WAY, WE'D APPRECIATE IT. AND WHILE I'M HERE, I'M GOING TO THANK YOU ALSO FOR WORKING ON THAT INTERSECTION ON HARDIN AND WILMOTH THAT GOT TORN UP LIKE 2 OR 3 YEARS AGO, AND NOTHING WAS HAPPENING. AND I UNDERSTAND THERE WAS A PROBLEM WITH UTILITIES AND NOW, BUT I HONESTLY DIDN'T THINK IT WAS GOING TO GET DONE IN MY LIFETIME. BUT I WENT OUT THERE WEEK BEFORE. WELL, I MEAN, I'M OUT THERE ALL THE TIME. BUT ANYWAY, WEEK BEFORE LAST, I ACTUALLY SAW PEOPLE OUT THERE WORKING FOR THE FIRST TIME IN FOREVER. AND I JUST THANK YOU FOR STANDING THERE AND PUSHING AND PUSHING AND GETTING THAT DONE. THAT IS GOING TO BE SO WONDERFUL. AND THANK YOU AGAIN. THANK YOU MA'AM. JUSTIN MUHLENKAMP. HI. HEY. MY NAME IS
[00:20:05]
JUSTIN MUHLENKAMP. MY ADDRESS IS 500 SINGLETON IN DALLAS, I DID LIVE HERE FOR THREE YEARS AT DAVIS AT THE SQUARE. AUGUST 2021 TO MAY 2024. SO I'D JUST LIKE TO LET YOU KNOW SOME OF THE REASONS THAT I DID NOT FEEL WELCOME IN THIS CITY, ONE I GUESS THE FIRST WOULD BE I DID WALK IN THE MCKINNEY'S 4TH OF JULY PARADE. I DID KISS MY PARTNER ON THE SIDELINES, AND WE WERE TOLD THAT WE WERE DISGUSTING. AND THIS ISN'T THE PLACE FOR THAT, WHEN THE MAYOR PROCLAIMED IN JUNE TO BE PRIDE MONTH, ONLY ONE OTHER CITY COUNCIL MEMBER VOICED HIS SUPPORT. THANK YOU, JUSTIN, AFTER THAT MEETING, THERE WAS ANOTHER CITY COUNCIL MEMBER THAT LET ME KNOW THAT IT WASN'T THE RIGHT TIME TO VOICE THEIR SUPPORT. AND, AS ALLYSHIP IS NOT SUPPOSED TO BE COMFORTABLE. SO, WHEN I WAS PROMOTING A DRAG SHOW, I GOT THROWN OUT OF A BUSINESS TELLING ME THAT THIS WASN'T THE PLACE FOR THAT, WHEN I WALKED IN MCKINNEY PRIDE IN THE CHRISTMAS PARADE, WE HAD ADULTS TELLING THEIR CHILDREN TO LOOK AWAY. WE HAD PEOPLE BOOING US, YELLING AT US. WE'RE TOLD THIS WASN'T THE PLACE FOR THAT, I'VE WITNESSED BUSINESS OWNERS BEING TOLD THAT THEY NEED TO TAKE THEIR QUEER ITEMS OUT OF THE STORE, SAID THIS ISN'T THE PLACE FOR THAT, I GUESS THE QUESTION IS TO Y'ALL IS WHEN IS THE APPROPRIATE TIME OR PLACE TO BE QUEER IN MCKINNEY, TEXAS, I GUESS IF YOU GUYS CAN THINK ABOUT THAT AND LET PEOPLE KNOW THAT STILL LIVE HERE, I APPRECIATE IT. TRICIA GERTEL. SO MY NAME IS TRICIA GERTEL, AND I OWN TEXAS BEST GYMNASTICS, AND I AM CELEBRATING 25 YEARS THIS JANUARY. AND I'VE HAD A WONDERFUL EXPERIENCE IN MCKINNEY AND I'VE HAD NOTHING BUT GOOD THINGS TO SAY ABOUT. I HAVE LIVED IN MCKINNEY. I HAVE OWNED A BUSINESS IN MCKINNEY. I'VE BUILT FROM SCRATCH IN MCKINNEY, AND I'M DOING SO WELL THAT I NEED TO EXPAND. AND I JUST AS SOON AS LAST NIGHT, I WAS HAVE SOMEONE THAT WANTS TO BUY MY BUILDING, AND I HAVE A PIECE OF PROPERTY THAT I'M TRYING TO PURCHASE. AND LUCKILY I GOT AN EMAIL RESPONSE FROM TAYLOR AND FROM KATELYNN THAT WERE TELLING ME ABOUT THE ETJ AND THE WATER PROBLEMS THAT WE'RE HAVING, AND I IMAGINE THIS IS VERY DIFFICULT FOR YOU ALL. I UNDERSTAND, BUT I, I DO SEE ALL THE APARTMENTS AND THINGS GOING UP. AND MY QUESTION HERE TODAY IS MAYBE WOULD I FIT IN THE THREE CATEGORIES OF EXCEPTIONS FOR THESE, THIS PROJECT. I WOULD LIKE TO I DID SINCE I JUST CAME TODAY. I DO HAVE A PICTURES. I DIDN'T SUBMIT IT. CAN I PASS THEM OUT? IF YOU JUST HAND THEM TO THE SECRETARY, SHE'LL GET THEM TO US AND YOU'RE JUST WHAT I'M TRYING TO FILL. SO IN THE EXCEPTIONS, IT WAS AN ONGOING PROJECT. I HAVE BEEN WORKING ON THE PROJECT, A LITTLE LESS THAN A YEAR. I WAS SUPPOSED TO CLOSE ON A PROPERTY RIGHT BESIDE MYERS PARK DECEMBER 20TH. BUT MY BUYERS LOST THEIR FUNDING, AND SO WE HAD TO REGROUP. I DID FIND ANOTHER BUYER, AND I DO HAVE A DIFFERENT PIECE OF PROPERTY, SO I'M NOT SURE IF THAT IS CONSIDERED AS AN ONGOING PROJECT, BUT TO ME, IT'S ONGOING BECAUSE I'VE SPENT ABOUT $60,000 OF MY MONEY TRYING TO MAKE THIS EXPANSION WORK. SO TO ME, IT'S ONGOING. THE SECOND IS THE ANNEXATION. I DON'T KNOW IF THAT, IF THE PROJECTS THAT Y'ALL ARE DOING, IF THAT THIS PIECE OF PROPERTY, WHICH I DID PUT ON THERE, THE ADDRESS THAT I'M TRYING TO PURCHASE NOW IS 59, 44 FRANKLIN BRANCH ROAD. AND I DO HAVE THAT. AND IF THAT IS, IT IS IN THE ETJ. BUT WOULD YOU GUYS CONSIDER THAT AS AN EXEMPTION? AN EXCEPTION FOR ATTAINING WATER FOR THE PROJECT. AND THE THIRD IS THE DEVELOPMENT AGREEMENT FOR ME, I GUESS THE DEVELOPMENT AGREEMENT AS I READ IT AND I TEACH CARTWHEELS AND FLIPS, I DON'T KNOW ANYTHING ABOUT THE LAW AND IN THIS, BUT FROM WHAT I UNDERSTAND, READING IT IS THAT YOU GUYS COULD HAVE EXCEPTIONS IF YOU SEE FIT. FOR ME TO REMAIN IN THE ETJ SO I CAN BUILD WHAT I NEED TO BUILD, BUT YET ATTACHED TO THE CITY WATER SO THAT I CAN DO WHAT I NEED TO DO. SO I GUESS MY QUESTION IS TO Y'ALL. MY BUSINESS IS ITS CHILDREN. IT'S NOT A PRODUCT THAT CAN WAIT. AND THERE'S A TIME FRAME. I HAVE ATHLETES HAVE GIRLS WITH SCHOLARSHIP POTENTIAL AND OPPORTUNITY, AND I CAN'T HAVE GAPS IN BETWEEN MY BUILDING. AND THEN GETTING IN THE NEW BUILDING. SO I JUST NEED TO KNOW HOW MUCH TIME IT'S GOING TO TAKE. IF I DO GET AN ANNEXATION, POSSIBILITY. IS THERE AN ADEQUATE WHAT'S THE TIME FRAME I'M LOOKING AT FOR THAT? OR IF THE DEVELOPMENT AGREEMENT IS, YOU KNOW, WOULD I FALL INTO ONE[00:25:02]
OF THESE THREE? SO I GUESS WHEN YOU I DON'T EVEN KNOW IF IT'S APPROPRIATE FOR ME TO BE HERE TO ASK THAT, BUT THIS IS WHAT I'M TRYING TO DO AND MAKE A DECISION IF I DO WANT TO BUY THIS PROPERTY OR NOT. SO WOULD YOU DO ME A FAVOR AND ASSUMING IF IT'S IF ALL THE INFORMATION I'M ABOUT TO ASK YOU FOR IS NOT IN WHAT YOU JUST HAND US, WHICH WE WILL RECEIVE LATER. WOULD YOU EMAIL ME WITH ALL THE SPECIFICS, THE PARTICULARS THAT ADDRESS AGAIN, FOR EXAMPLE, AND, AND THE USE WHICH I KNOW YOU'VE STATED, BUT IF YOU'LL PUT IT IN WRITING. YEAH, JUST ALL THE PERTINENT DETAILS OF WHAT EXACTLY YOU'RE, YOU'RE TRYING TO DO IN THE ADDRESS AND TIME FRAME AND ALL THAT. ALL RIGHT. AND EMAIL IT IF YOU WOULD. THANK YOU VERY MUCH. OKAY. THANK YOU. SO MUCH.APPRECIATE YOUR TIME. OKAY. THOSE ARE ALL THE COMMENTS THAT I HAVE FOR CARDS FOR COMMENTS. I HAVE BOTH AGENDA NON AGENDA. WE DO HAVE A FEW THAT HAVE SIGNED UP TO SPEAK FOR ON PUBLIC
[CONSENT AGENDA]
HEARING ITEMS. THOSE WILL BE HEARD DURING THAT ITEM. MOVE TO CONSENT AGENDA. THESE ITEMS CONSIST OF NON-CONTROVERSIAL HOUSEKEEPING ITEMS REQUIRED BY LAW. ITEMS MAY BE CONSIDERED INDIVIDUALLY BY ANY COUNCIL MEMBER MAKING SUCH REQUEST PRIOR TO A MOTION AND VOTE ON THE CONSENT ITEMS. IS THERE A MOTION TO APPROVE THE CONSENT ITEMS, OR IS THERE AN ITEM THAT WOULD LIKE TO BE PULLED DOWN? I'LL MAKE A MOTION. WE APPROVE THE ITEM. PLEASE CAST YOUR VOTES. EMPRESS, I DON'T HAVE A BUTTON AND I'M SORRY ABOUT THAT. IT MAY BE MY FAULT. I DON'T EITHER. I DON'T KNOW WHERE TO START, SO I DON'T EITHER RIGHT NOW. ALL IN FAVOR? I OPPOSED? YOU DIDN'T SAY I, BUT I KNOW I. YEAH, SORRY. NOT NOT HE DIDN'T OPPOSE. HE WAS AN EYE ON THE FIRST QUESTION. AND I'LL[Citizen Input on the FY 2024-25 Budget]
TRY TO GET MINE FIXED AS WELL, REGULAR AGENDA AND PUBLIC HEARING ITEMS. ITEM 241893.CITIZEN INPUT ON THE FISCAL YEAR 20 2425 BUDGET. MR. HOLLOWAY. GOOD EVENING, MAYOR AND COUNCIL, MARK HOLLOWAY. I'M THE CHIEF FINANCIAL OFFICER FOR THE CITY, TONIGHT WE HAVE CITIZEN INPUT ON THE 20 ON THE FISCAL YEAR 25 BUDGET. THIS IS NOT AN OFFICIAL PUBLIC HEARING. WE WILL HAVE ON ONE OF THOSE ON SEPTEMBER THE 3RD, WHEN WE ADOPT OUR BUDGET AND OUR TAX RATE. BUT THIS IS ANOTHER OPPORTUNITY FOR CITIZENS TO SPEAK OUT ON THE FY 25 BUDGET. I DO HAVE A VERY SHORT PRESENTATION, AND THEN I'LL GET OUT OF THE WAY AND ALLOW FOR ANY POSSIBLE PUBLIC COMMENTS, THIS IS OUR THIS IS OUR OUR BUDGET HIGHLIGHTS FOR FISCAL YEAR 25. WE ARE ANTICIPATING DECREASING THE OVERALL PROPERTY TAX RATE BY 1.2 CENTS TO JUST OVER OVER 41.5 CENTS, AS YOU KNOW, OUR SALES TAX HAS REMAINED VERY STRONG. WE'RE GROWING IT A LITTLE OVER 5%, SO IT'S GOOD TO SEE WE'VE SEEN THAT THE LAST TWO FISCAL YEARS. THIS BUDGET WILL PROVIDE FOR ALL OF OUR MARKET ADJUSTMENTS FOR ALL OF OUR NON-SWORN PERSONNEL. WE'RE MAKING AN ALLOWANCE FOR A MARKET STUDY THAT'S GOING THAT'S BEEN COMPLETED. AND WE ANTICIPATE DOING ALL OF OUR STEP INCREASES FOR FISCAL YEAR 25. ALSO, PLAN STEP INCREASES IN LINE WITH OUR MEET AND CONFER AGREEMENTS FOR OUR SWORN PERSONNEL. WE ARE CONTINUING TO RAMP UP AND DO OUR STREET MAINTENANCE PROGRAM, AND WE ARE ANTICIPATING FILLING SOME STAFFING NEEDS IN PUBLIC SAFETY, POLICE AND FIRE. I'LL BE DETAILING THOSE IN ANOTHER SLID. JUST A SECOND, I DO WANT TO JUST TOUCH ON THE GENERAL FUND FOR A SECOND. WE'RE ANTICIPATING REVENUES JUST UNDER $220 MILLION FOR FISCAL YEAR 25, WITH 51% OF THAT BEING IN THE FORM OF PROPERTY TAXES, STILL GROWING STRONG. THERE IS OUR 21% BEING SALES TAX. WE'VE SEEN SALES TAX TAKING OVER THE PIECE OF THAT OVERALL PIE. NOT AS MUCH THIS YEAR, GROWTH A LITTLE BIT, NOT FLAT. IT'S 5% GROWTH. BUT WE'RE SEEING THE SAME AMOUNT OF GROWTH. SALES TAX GROWTH WERE DOUBLE DIGITS FOR SEVERAL YEARS. SO WE WERE SEEING SOME SOME LARGER GROWTH. THERE EXPENDITURES. IT'S A BALANCED BUDGET, AS I MENTIONED EVERY YEAR WITH ABOUT 49% BEING, EXCUSE ME, 47% BEING ON THE PUBLIC SAFETY SIDE WITH THE REST DIVVIED UP BETWEEN OUR PUBLIC WORKS, WHICH IS JUST THE GENERAL FUND PORTION OF PUBLIC WORKS DEVELOPMENT SERVICES, PARKS AND LIBRARY AND THEN OUR GENERAL GOVERNMENT, WHICH ARE ALL OF OUR INTERNAL SERVICES. I DID MENTION, 39 ADDITIONAL STAFFING REQUESTS BEING FILLED BY THIS FH 21 OF THOSE BEING IN OUR PUBLIC SAFETY, POLICE AND FIRE, SO YOU CAN SEE THEIR DEVELOPMENT SERVICES SEEING SIX AND IN PUBLIC WORKS, THAT'S JUST THE GENERAL FUND PORTION FOR MORE.
SO MOST OF THOSE COME, COME FROM FROM THOSE FOUR DEPARTMENTS ON THE WATER AND WASTEWATER SIDE,
[00:30:02]
JUST A FEW HIGHLIGHTS. WE WANT TO CONTINUE OUR WATER LINE REPLACEMENT PROGRAM THAT'S BEEN ONGOING FOR SEVERAL YEARS, AS YOU CAN SEE IN FISCAL YEAR 14, WE HAD WATER LOSS, OF 28%. IT'S DOWN TO 7%, WHICH IS WELL UNDER INDUSTRY STANDARDS AT THIS POINT. BUT WE INTEND TO CONTINUE TO HUNT DOWN EVERY LEAK, EVERY BIT OF WATER THAT'S GOING ON, THAT'S BEING LOST, AND HUNT IT DOWN AND MAKE SURE THAT WE'RE CHARGING FOR IT OR THAT IT IS BEING, YOU KNOW, BEING CONSERVED, SUPPLEMENTALS ON THE WATER SIDE ARE FAIRLY MODEST. THIS YEAR. WE DO HAVE A CONSTRUCTION INSPECTOR, SOME OPERATORS AND THEN A NEW TEST BENCH FOR, FOR OUR METER SERVICES. I DO WANT TO TOUCH ON WATER AND WASTEWATER RATES, WE WILL BE PROPOSING AN INCREASE OF OUR WATER RATES BY ABOUT 2% FOR FISCAL YEAR 25, A 9% ON WATER, ON WASTEWATER, WE ARE PASSING THROUGH SOME SOME INCREASES FROM NORTH TEXAS MUNICIPAL WATER DISTRICT, 4% INCREASE ON WATER, WHICH WAS LESS THAN WHAT THEY HAD ORIGINALLY TOLD US. SO THAT'S GOOD NEWS. BUT A 17% INCREASE ON WASTEWATER, SO WE'LL BE PASSING THOSE ALONG WITH A TWO AND 9% INCREASE IN KIND, WITH THAT, SEPTEMBER 3RD IS THE NIGHT OF OUR OFFICIAL BUDGET, PUBLIC HEARING AND ADOPTION, ALSO, WE'LL HAVE A PUBLIC HEARING ON THE TAX RATE AND THE ADOPTION OF THE TAX RATE THAT EVENING. I'LL BE HAPPY TO TAKE ANY QUESTIONS ON THE BUDGET AND IF NOT, I'LL BE HAPPY TO STAND ASIDE FOR ANY PUBLIC COMMENTS. ANY QUESTIONS FOR MR. HOLLOWAY? IS THERE ANYONE HERE THAT WOULD LIKE TO SPEAK ON THE BUDGET? SEEING NONE, I EXPECT SOCIAL MEDIA WILL BE EVERY BIT AS QUIET AFTER WE PASS THE BUDGET, SINCE NO ONE IS SINCE NO ONE HAS COME HERE TO VOICE THEIR OPINION OR GIVE ANY CONSTRUCTIVE OPINION OR ADVICE. SO IT'S GOING TO BE QUIET THIS YEAR. I GUESS WE'LL SEE YOU ON SEPTEMBER THIRD THEN. OKAY. THANK YOU. THAT'S GOOD TO GOOD TO KNOW. THANK YOU, MR.[Conduct a Public Hearing to Consider/Discuss Fare Change for Collin County Transit Program]
HOLLOWAY. NEXT ITEM 241894. CONDUCT PUBLIC HEARING TO CONSIDER. AND DISCUSS FARE CHANGE FOR COLLIN COUNTY TRANSIT PROGRAM. HELLO. SO AS YOU ALL KNOW, THE MCKINNEY URBAN TRANSIT DISTRICT IS A ELIGIBILITY BASED ON DEMAND SERVICE FOR SENIORS, RESIDENTS WITH DISABILITIES, AND LOW INCOME RESIDENTS. OPEN FOR RESIDENTS OF MCKINNEY. MELISSA LOWRY CROSSING, PRINCETON, PROSPER AND SALINA, ENCOMPASSING ALL 886MI■S OF COLLIN COUNTY. AD WE ARE DOING THAT WHILE ALSO MEETING OUR PROGRAM GOAL, WHICH IS MEETING THE NEEDS OF THESE PEOPLE WHILE ALSO KEEPING A FISCALLY SUSTAINABLE MANNER FOR OUR PROGRAM. SO IN 2023, MTD COMPLETED A SYSTEM WIDE ANALYSIS OF THE SERVICE AND ITS FARE POLICY. THE GOAL OF THAT STUDY WAS TO IDENTIFY MTD'S CUSTOMER TRAVEL BEHAVIOR, WITH A FOCUS ON THE TRIP DISTANCE AND THE FREQUENCY OF TRIPS. THE RESULT OF THE STUDY WAS A PROPOSED FARE POLICY UPDATE THAT WAS APPROVED BY THE BOARD IN THE FALL OF 2023. THIS DYNAMIC FARE PRICING WILL ALLOW ANY TRIP SEVEN MILES OR LESS TO BE $5, WITH A 75 CENT INCREASE PER MILE, WITH A MAX OF $17 FOR A 23 MILE TRIP. AND I THOUGHT IT BEST TO LEAVE IT OPEN TO ANY PUBLIC COMMENT THAT MAY STAND. WE'RE GOING TO HAVE TWO PUBLIC HEARINGS ON THIS.OBVIOUSLY, THIS ONE AND ANOTHER ONE ON OCTOBER 21ST TO END THE TOWN OF PROSPER. SO. ALL RIGHT, IS THERE ANYBODY HERE WHO WOULD LIKE TO SPEAK TO THIS ITEM? THANK YOU NEED TO CLOSE THE PUBLIC HEARING. MR. MAYOR, I MOVE THAT WE CLOSE THE PUBLIC HEARING. SECOND, CAST YOUR VOTE.
ANY DISCUSSION FROM COUNCIL ON THE ITEM? THE ONLY REMARK I WOULD MAKE IS THAT, YOU KNOW, THE CITY WAS THE BENEFICIARY OF A GREAT DEAL OF FEDERAL MONEY TO HELP FUND THIS PROGRAM. AND IT'S OUR GOAL ON COUNCIL TO SUSTAIN IT FOR THE PEOPLE WHO NEED IT TO GET AROUND. IT'S THE ONLY PUBLIC TRANSPORTATION THAT WE HAVE IN THIS AUGMENTATION. AND THE FARES MAKES IT MORE SUSTAINABLE FOR US IN THE FUTURE. THERE'S A TREMENDOUS AMOUNT OF DISCUSSION AND EFFORT TO GET TO THIS PLACE.
SO TO THE BOARD. ALL RIGHT. WE'LL MOVE TO ITEM 241895. CONDUCT A PUBLIC HEARING TO
[Conduct a Public Hearing to Consider/Discuss/Act on an Ordinance Reaffirming the City of McKinney’s Continued Participation in the Texas Enterprise Zone Program and Nominating Globe Life and Accident Insurance Company to the Office of the Governor Economic Development and Tourism Through the Economic Development Bank as an Enterprise Project]
CONSIDER. AND DISCUSS. ACT ON AN ORDINANCE REAFFIRMING THE CITY OF MCKINNEY'S CONTINUED[00:35:04]
PARTICIPATION IN THE TEXAS ENTERPRISE ZONE PROGRAM AND NOMINATING GLOBE LIFE AND ACCIDENT INSURANCE COMPANY TO THE OFFICE OF THE GOVERNOR, ECONOMIC DEVELOPMENT AND TOURISM THROUGH THE ECONOMIC DEVELOPMENT BANK AS AN ENTERPRISE PROJECT. MR. MAYOR, COUNCIL. MARK HAUSER, CITY ATTORNEY I'M HERE TO OPEN THIS UP AND I'M GOING TO TURN IT OVER TO MY COLLEAGUE REESE MCDONALD HERE IN A MOMENT. BUT THIS IS A AN ORDINANCE THAT WILL FOLLOW A PUBLIC HEARING THAT YOU WILL HAVE ON THIS ITEM. BUT IT IS A NOMINATION FOR ONE OF OUR, FINEST CORPORATE CITIZENS, GLOBE LIFE HERE IN MCKINNEY, WHO HAS BEEN HERE FOR MANY YEARS. BUT THIS NOMINATION IS FOR INCENTIVES FROM THE GOVERNOR'S OFFICE FOR EMPLOYMENT PURPOSES. I'M GOING TO LET REESE, GIVE YOU THE SPECIFICS, NONE OF THESE, IF AWARDED, NONE OF THESE FUNDS WOULD BE FROM CITY OF MCKINNEY.BUT WE AS THE CITY ARE THE NOMINATING ENTITY FOR THE PROJECT, AND IT IS FOR, THEIR FINE WORK AND EMPLOYMENT IN THE CITY OF MCKINNEY. SO I'M GOING TO TURN IT OVER TO MR. MCDONALD.
BUT BEFORE THAT, I WANT TO THANK TWO OTHER PEOPLE, MADISON CLARK AT THE MEDC, WHO HAS BEEN WORKING WITH THE COMPANY. I BELIEVE THERE'S SOME REPRESENTATIVES HERE FROM THE COMPANY, MADISON CLARK AND OF COURSE, MR. KOSKI, WHO'S THE PRESIDENT OF THE MEDC AND THEIR THEIR OFFICES HAVE BEEN WORKING WITH GLOBE LIFE TO GET THIS GOING. SO MR. REESE MCDONALD.
MR. MAYOR, COUNCIL MEMBERS, CITY STAFF, THANK YOU FOR YOUR TIME TONIGHT REGARDING THIS ITEM, MY NAME IS REESE MCDONALD WITH RYAN LLC SITTING IN THE AUDIENCE WITH ME IS REBECCA ZAUN. SHE'S THE CHIEF TALENT OFFICER FOR GLOBE LIFE, AS WELL AS ALICE LOWRY, THE SENIOR VICE PRESIDENT OF TAX. SO WE ARE BEFORE YOU TODAY TO CONSIDER AN ORDINANCE. OFFICIALLY NOMINATING GLOBE LIFE TO THE TEXAS ENTERPRISE ZONE PROGRAM. THE PROGRAM ITSELF, AT ITS CORE, IS AN ECONOMIC DEVELOPMENT TOOL FOR THE STATE OF TEXAS TO PARTNER WITH, THE CITIES, THE CITY OF MCKINNEY, AS WELL AS THE BUSINESSES THAT OPERATE WITHIN THOSE THOSE MUNICIPALITIES. SO SPECIFIC TO THIS PROJECT, GLOBE LIFE IS PROPOSING TO DEPLOY $25 MILLION IN INFRASTRUCTURE TECHNOLOGY IMPROVEMENTS, AS WELL AS SOME OTHER OFFICE, BUSINESS, PERSONAL PROPERTY, IN ADDITION TO THESE COMMITMENTS, THE COMPANY IS COMMITTING TO RETAIN THE NORTH OF 2000 EMPLOYEES THAT THEY HOUSE HERE IN MCKINNEY, AS WELL AS CREATE TEN NEW JOBS OVER THE LIFE OF THE FIVE YEAR DESIGNATION PERIOD. APPLICATIONS ARE ACCEPTED BY THE GOVERNOR'S OFFICE QUARTERLY FIRST BUSINESS DAY OF MARCH, JUNE, SEPTEMBER, AND DECEMBER. SO WE ARE EFFECTIVELY APPLYING FOR THE NEXT CYCLE, WHICH IS THE SEPTEMBER 3RD, 2024 ROUND. THE PROGRAM IS COMPETITIVE, SO 12 DESIGNATIONS ARE AWARDED BY THE GOVERNOR'S OFFICE. EACH QUARTER, IF SUCCESSFULLY DESIGNATED BY THE GOVERNOR'S OFFICE, THE RETURN AS A RESULT OF THESE INVESTMENTS IN THE COMMUNITY IS A $1.25 MILLION STATE SALES TAX REFUND. SO, AS MR. HAUSER MENTIONED, IT'S VERY IMPORTANT TO NOTE THAT, AS A RESULT OF THIS NOMINATION, THERE IS NO FISCAL IMPACT TO THE CITY'S BUDGET. SO WITH THAT, I WILL STAND FOR QUESTIONS. ANY QUESTIONS? OKAY. THIS IS A PUBLIC HEARING. I DO NOT HAVE ANYONE THAT SIGNED UP TO SPEAK ON THIS ITEM. IS THERE ANYBODY HERE THAT WOULD LIKE TO SPEAK TO THE ITEM? SEEING NONE. ENTERTAIN A MOTION. MR. MAYOR, I MOVE THAT WE APPROVE THIS ITEM OR CLOSE THE PUBLIC HEARING AND APPROVE THIS ITEM. I'LL SECOND. PLEASE CAST YOUR VOTES. THE MOTION PASSES, AND I BELIEVE THAT WE ARE GOING TO TAKE A PHOTO SECOND. IS THAT CORRECT? GO AHEAD AND TAKE A QUICK MINUTE. BUDDY. OH, NO. I THOUGHT IT WAS JUST ME. YEAH. ANYTHING MORE? PLEASE. OKAY MAKE YOU LOOK LIKE CHARLIE WITH THE WIND. DON'T ACT LIKE YOU LOVE ONE ANOTHER. ALL RIGHT. THANK YOU. THANK YOU. REMEMBER WE SAID. THAT.

ALL RIGHT. WE'RE GOING TO MOVE ON TO ITEM 2400038. CONDUCT A PUBLIC HEARING TO CONSIDER, DISCUSS A REQUEST BY THE CITY OF MCKINNEY TO ENLARGE AND EXTEND THE BOUNDARY LIMITS OF THE CITY, AND TO ANNEX CASE NUMBER 240003A THE SUBJECT PROPERTY LOCATED FROM THAT PORTION OF FARM TO MARKET ROAD 2478 CUSTER ROAD, RIGHT OF WAY, LOCATED NORTH OF U.S. HIGHWAY 380 WEST UNIVERSITY DRIVE AND SOUTH OF FARM MARKET ROAD 1461 FRONTIER PARKWAY. THAT PORTION OF U.S. HIGHWAY 380 WEST UNIVERSITY DRIVE, RIGHT OF WAY FROM APPROXIMATELY 310FT EAST OF REDBUD DRIVE TO ITS INTERSECTION WITH FARM TO MARKET ROAD 2478. THAT PORTION OF COUNTY ROAD 1461 RIGHT OF WAY FROM ITS INTERSECTION WITH THE FORMER RIGHT OF WAY TO FARM TO MARKET ROAD 2478 TO ITS INTERSECTION WITH THE EXISTING RIGHT OF WAY OF FARM TO MARKET ROAD 2478. FROM THE RIGHT OF WAY CENTER LINE SOUTH TO THE SOUTHERN RIGHT OF WAY BOUNDARY AND THAT PORTION OF FARM TO MARKET 2478 NORTH OF COUNTY ROAD 1461 AND SOUTH OF COUNTY ROAD 170 FROM THE RIGHT OF WAY CENTER LINE EAST TO THE EASTERN RIGHT OF WAY BOUNDARY INTO THE CITY OF MCKINNEY'S CORPORATE LIMITS. CAN ANYONE TELL ME WHERE I JUST DESCRIBED IT? TO KEEP THAT ON THE NEXT. GOT IT. THANK YOU, MR. MAYOR.THAT HEADING WAS WRITTEN BY AN ATTORNEY. I'D LIKE YOU TO DRAW ON A MAP WHERE I JUST. THERE YOU GO, THERE YOU GO. SO THANK YOU VERY MUCH, MR. MAYOR. THIS ITEM AND THE NEXT ONE ARE ACTUALLY COMPLIMENTARY ITEMS TO EACH OTHER. THERE IS NO REQUESTED ACTION FROM THE COUNCIL TONIGHT OTHER THAN TO CONDUCT A PUBLIC HEARING FOR THE CONSIDERATION OF THIS ANNEXATION, WHICH IS FOR THE CENTER FROM THE WESTERN MCKINNEY BOUNDARY TO THE CENTER LINE OF CUSTER ROAD. ALL THE WAY UP TO OUR NORTHERN LIMIT. THE REASON FOR THIS IS TO CLEAN UP SOME ENFORCEMENT AND MAINTENANCE ISSUES THAT WE HAVE WITH OUR BOUNDING CITIES. AND SO THIS IS VERY SIMILAR TO THE ACTIVITIES THAT YOU ALL TOOK EARLIER THIS YEAR WHEN WE ANNEXED THE SOUTHERN PORTION OF CUSTER ROAD AS WELL. SO WE'RE NOW JUST DOING PART TWO OF THAT. AGAIN, THIS IS NO ACTION TONIGHT. JUST TO CONDUCT A PUBLIC HEARING. WE WILL BE BACK IN SEPTEMBER WHERE WE ACTUALLY WILL PROPOSE THE ANNEXATION OF THIS RIGHT OF WAY AND ALL THAT GOES WITH IT. SO FOR THOSE WHO DON'T REALIZE IF THEY ARE NOW GOING TO BE SPEEDING ON THAT ROAD, THEY MAY ACTUALLY GET A TICKET CORRECT.
THERE WAS SOME CONFUSION OR OR ENFORCEMENT, GRAY AREA BEFORE. I WOULD NOT KNOW THAT FROM PERSONAL EXPERIENCE. JUST YOU'VE HEARD IT. I'VE HEARD THIS. ALL RIGHT. THIS IS A PUBLIC HEARING ITEM, AND I DO NOT SHOW THAT ANYONE HAS SIGNED UP TO SPEAK TO THAT ITEM. SEEING NONE. THERE'S NOT ACTION. I MOVE TO THE NEXT ITEM, BUT MY CITY ATTORNEY SAID I DO NOT HAVE TO READ THAT ITEM.

YOU NEED TO CLOSE THE PUBLIC HEARING. YEAH, I'LL OPEN 24000382, WHICH WOULD BE CONDUCTED PUBLIC HEARING. TO DISCUSS REQUESTS BY THE CITY OF MCKINNEY TO DO THE SAME THING. I READ FIVE MINUTES AGO. AND THIS IS A PUBLIC HEARING. IS THERE ANYONE WOULD LIKE TO SPEAK TO THIS ITEM? SEEING NONE, I'LL ENTERTAIN A MOTION TO CLOSE PUBLIC HEARINGS ON BOTH ITEMS. I MOVE THAT WE CLOSE THE PUBLIC HEARING ON BOTH ITEMS. I'LL SECOND. PLEASE CAST YOUR VOTE. I WAS REALLY HOPING I WAS GOING TO GET TO READ THAT AGAIN. I'LL STAY LATE FOR YOU TO DO IT AFTE.[Conduct a Public Hearing to Consider/Discuss/Act on a Request to Rezone the Subject Property from “PD” - Planned Development District to “C2” - Local Commercial District, Located at the Southeast Corner of Custer Road and Silverado Trail and Accompanying Ordinance]
THE. MOTION PASSES. ITEM 2400533. CONDUCT A PUBLIC HEARING TO CONSIDER AN ACT ON A REQUEST TO REZONE SUBJECT PROPERTY FROM PD PLANNED DEVELOPMENT DISTRICT TO C2 LOCAL COMMERCIAL DISTRICT LOCATED AT THE SOUTHEAST CORNER OF CUSTER ROAD AND SILVERADO TRAIL AND ACCOMPANYING ORDINANCE. THANK YOU, MR. MAYOR. JENNIFER ARNOLD, DIRECTOR OF PLANNING. SO AS YOU READ THIS AS A REQUEST TO REZONE THE SUBJECT PROPERTY HERE ON THE LOCATION MAP, YOU'LL SEE IT IS AT THE SOUTHEAST CORNER OF CUSTER ROAD AND SILVERADO TRAIL. THE CURRENT ZONING ON THE PROPERTY IS ACTUALLY ALREADY FOR COMMERCIAL USES AND DEVELOPMENT. IT IS ENCUMBERED BY A PD PLAN DEVELOPMENT DISTRICT WITH THE REC OVERLAY, WHICH REQUIRES A MORE URBAN DEVELOPMENT FORM HERE. ALONG THIS PARTICULAR STRETCH OF CUSTER ROAD, THE APPLICANT IS PROPOSING TO REZONE TO OUR STRAIGHT C2 ZONING DISTRICT, WHICH IS COMPLEMENTARY TO THE ZONING. THAT'S JUST NORTH OF THIS, AND IT IS FOR THE DEVELOPMENT OF THE REMAINING THREE AND A HALF ACRES HERE AT THIS CORNER. STAFF'S REVIEWED THE REQUEST. WE HAVE NO CONCERNS WITH MOVING FROM THAT PD INTO A STRAIGHT ZONING DISTRICT FOR COMMERCIAL USES. AND PLANNING AND ZONING COMMISSION ALSO CONSIDERED THE ITEM AND IS RECOMMENDING APPROVAL, AND I WILL STAND FOR ANY QUESTIONS.ANY QUESTIONS FOR JENNIFER? IS THE APPLICANT HERE? THEY ARE. OKAY. HELLO HELLO. I'M CARLOS

DONUT SHOPS, RETAIL. OFFICE, VERY SIMILAR TO WHAT WAS DONE BY THE COSTCO OVER THERE. BUT THAT'S PRETTY PRETTY MUCH IT. ALL RIGHT. ANY QUESTIONS FOR THE APPLICANT? THIS IS A PUBLIC HEARING. I DO NOT HAVE ANYONE SIGNED UP. BUT AGAIN, IF THERE'S SOMEBODY HERE, I'M DONE. NO NOBODY. YOU CAN SIT DOWN, SIR, IS THERE A MOTION? MR. MAYOR, I MOVE THAT WE CLOSE THE PUBLIC HEARING AND APPROVE THIS ITEM AS RECOMMENDED BY STAFF. I'LL SECOND. PLEASE CAST YOUR VOTES. THE MOTION PASSES. ITEM 240004W CONDUCT A PUBLIC HEARING TO[Conduct a Public Hearing to Consider/Discuss/Act on a Request to Close a Portion of Enloe Road Located within the Runway Protection Zone of Runway 18 at McKinney National Airport, from a Point Approximately 2,300 Feet East of Airport Drive to a Point Approximately 11,600 Feet Northwest of FM 546, and Accompanying Ordinance (24-0004RW)]
CONSIDER AND ACT ON A REQUEST TO CLOSE A PORTION OF ENLOE ROAD, LOCATED WITHIN THE RUNWAY PROTECTION ZONE OF RUNWAY 18 AND MCKINNEY NATIONAL AIRPORT, FROM A POINT APPROXIMATELY 2300FT EAST OF AIRPORT DRIVE TO A POINT APPROXIMATELY 11,600FT NORTHWEST OF FM 546 AND ACCOMPANYING ORDINANCE, GOOD EVENING, MAYOR AND COUNCIL. MATT RICHARDSON, MATT RICHARDSON, ASSISTANT DIRECTOR OF ENGINEERING, I'VE ALSO GOT, AIRPORT DIRECTOR, KEN CARLY HERE AS WELL. THIS IS A REQUEST TO PERMANENTLY CLOSE A PORTION OF ENLOE ROAD, AS YOU STATED. THAT IS WITHIN THE RUNWAY PROTECTION ZONE FOR THE UPCOMING RUNWAY EXTENSION, WITH THE, WITH THE CONSTRUCTION CONTRACT FOR THE RUNWAY EXTENSION. I'M EXPECTED TO COME BEFORE YOU IN THE NEXT MONTH OR SO, AND CONSTRUCTION EXPECTED TO START BY THE END OF THE YEAR. WE WANTED TO GET THIS, GET THIS IN FRONT OF YOU SO THAT, AGAIN, WE COULD TAKE ACTION TO PERMANENTLY CLOSE THE ROADWAY, BECAUSE THE RUNWAY EXTENSION IS SO CLOSE TO THE FLOODPLAIN FOR THE EAST FORK OF THE TRINITY RIVER, THERE REALLY ISN'T ANY REASONABLE WAY TO RELOCATE. AND LOW ROAD. SO THE ONLY FEASIBLE ALTERNATIVE IS TO ULTIMATELY CLOSE IT. HAPPY MYSELF OR CANTOR, HAPPY TO TAKE ANY QUESTIONS YOU MAY HAVE. ANY QUESTIONS? THANK YOU SIR. THIS IS A PUBLIC HEARING. I DO HAVE TWO PEOPLE THAT HAVE SIGNED UP TO SPEAK ON THE ITEM. LISA GRIFFIN. OKAY. MY NAME IS LISA GRIFFIN, 2360 COUNTY ROAD 722 MCKINNEY, TEXAS 75069. AND I REALIZE PROBABLY NOTHING I SAY IS GOING TO CHANGE THE VOTE, BUT I WANTED IT TO BE ON THE RECORD THAT I OPPOSE IT. THE CLOSING OF THE PORTION OF ENLOE ROAD, COMING FROM AIRPORT ROAD, ENLOE TURNS INTO COUNTY ROAD 722 FROM 546, FROM 546, COUNTY ROAD 722 TURNS INTO ENLOE ROAD. I CONSIDER IT THE SAME ROAD, BUT, EMERGENCY VEHICLES WOULD BE DELAYED OUT TO 722 IN LOWE ROAD. IF THEY NEEDED TO GO, THEY'D HAVE TO GO UP TO 546 AND COME BACK. THERE ARE TWO PROPERTY OWNERS BETWEEN OUR LAND AND THE CITY OWNED PROPERTY. NORTH OF THE RUNWAY AND SOUTH OF US, THERE'S OTHER PROPERTY OWNERS TOO, AND CLOSING THE ROAD WOULD AFFECT THE VALUE OF THE PROPERT. DUMPING PEOPLE CURRENTLY DUMPED TRASH AND DOGS AND OTHER THINGS ON ENLOE ROAD. COUNTY ROAD 722. IF THE ROAD IS CLOSED, I FEEL LIKE THE DUMPING WILL INCREASE AND THE TRAFFIC. WHILE I'M NOT EXCITED ABOUT THE HEAVY TRAFFIC CURRENTLY ON COUNTY ROAD 722 ENLOE, IT IS SAFER WAY TO TRAVEL TO MCKINNEY THAN GOING. 546 HARRY MCKILLOP BOULEVARD. NOT ALL OF THE TRAFFIC TURNS NORTH ON AIRPORT ROAD WHEN THEY GO TO AIRPORT ROAD ON 722 ENLOE WHEN 546 IS SHUT DOWN DUE TO A WRECK. ENLOE ROAD IS USED BY SHERIFF'S DEPARTMENT TO ROUTE THE TRAFFIC BACK TO THE AIRPORT ROAD, AND ENLOE ROAD IS USED WHEN TRAFFIC IS BACKED UP ON THE EASTBOUND HIGHWAY 380. IN THE PROPOSED ORDINANCE THAT YOU WILL SIGN TONIGHT, THE PART THAT CAUGHT MY[00:50:03]
EYE WAS THE LAST. WHEREAS THAT READS AFTER PUBLIC HEARING HELD BEFORE CITY COUNCIL. THE CITY COUNCIL HAS DETERMINED AND FINDS THAT THE ROADWAY IS NOT NEEDED FOR TRAVEL BY THE GENERAL PUBLIC AND THAT THE CLOSURE OF THE ROADWAY IS IN THE BEST INTEREST OF THE CITY AND THAT THE ROADWAY SHOULD BE CLOSED. I WOULD LIKE TO KNOW WHAT THE CRITERIA IS USED TO DECIDE ON CLOSING A ROAD, VERSUS REROUTING A ROAD, DO YOU CONDUCT A TRAFFIC COUNT TO SEE HOW MUCH TRAFFIC IS ON THE ROAD? I'VE SEEN A TRAFFIC COUNTER ACROSS THE ROAD ABOUT A YEAR AGO, AND IT WAS OUT IN THE MORNING AND PICKED UP BEFORE FIVE IN THE AFTERNOON. I WOULD ALSO LIKE TO KNOW THE DEFINITION OF GENERAL PUBLIC. I, AS WELL AS MANY OTHERS WHO TRAVEL THIS ROAD DAILY, WOULD CONSIDER OURSELVES GENERAL PUBLIC WHEN THE ROAD, WHEN THE WHEN WILL THE ROAD CLOSE? TOMORROW THERE WILL BE A LOT OF SURPRISED AND DISAPPOINTED TRAVELERS THAT WERE NOT AWARE OF THIS MEETING. I JUST HAPPENED TO SEE THE ITEM ON THE AGENDA. AMEND THE ETJ. BUT I DO LOOK SEE WHAT'S GOING ON EVERY NOW AND THEN, AND USUALLY WHEN THERE'S A PUBLIC HEARING, I'M ALWAYS USED TO SEEING SIGNS POSTED FOR ZONING OR SOMETHING LIKE THAT FOR CLOSING A ROAD. I KNOW IT IS APPARENTLY A DIFFERENT PROCEDURE. YOU JUST HAVE TO NOTIFY THE PEOPLE THAT OWN THE LAND BESIDE IT, WHICH IS THE CITY. SO THAT'S DONE, BUT THERE'S SO MANY PEOPLE THAT TRAVEL THIS ROAD THAT WOULDN'T BE HAPPY IF THEY KNEW ABOUT THIS PUBLIC MEETING. AND I, ON BEHALF OF THE GENERAL PUBLIC, ASKED THE PORTION OF ENLOE ROAD THAT SMALL PORTION, THAT IS WITHIN THE RUNWAY PROTECTION ZONE, BE REROUTED AROUND THE NORTHERLY EXTENSION OF RUNWAY 18 ON THE SOUTH END. THEY REROUTED 546, I DO UNDERSTAND HE WAS TALKING ABOUT THE FLOOD AREA, BUT I'M HOPING SOMETHING COULD BE DONE BECAUSE IT IS A HIGHLY TRAVELED ROAD. THANK YOU. THANK YOU. BILL. LOLLY. WE CAN TELL THEM THAT YOU DID. I SAT TOO LONG, MY NAME IS BILL LOLLY. I'M AT 2301 COLONIAL DRIVE IN PLANO, AND I'M A TEXAS REAL ESTATE AGENT. I REPRESENT DEAD END ENLOE 500 ACRES, RIGHT AT THE AT THE SOUTHERN DEAD END THAT IS PROPOSED UNDER THIS, AND I ASSUME THAT SINCE I'M AT THE DEAD END, YOU'RE PROBABLY NOT GOING TO SERVE ME WITH ANY, POLICE OR FIRE OR ANY OF THE THINGS THAT WE MIGHT NEED. WE HAVE A 149 ACRES OF THAT LAND THAT IS UPLANDS OR HIGH AND DRY, AND THEN 400 ACRES IS IN THE FLOODPLAIN. THE NEW SPUR IS GOING KIND OF THROUGH THE MIDDLE OF US, BUT BASED ON BEING DRUG THROUGH RAZOR BLADES WITH TXDOT AS TO WHEN THEY'RE GOING TO DO IT, IT LOOKS LIKE TO ME IT WILL BE 29 OR 30 BEFORE WE GET IT. AND YOU'RE BASICALLY TAKING THIS OUT OF THE MAINSTREAM OF HOW WE GET PEOPLE THERE. I MEAN, I'M SHOWING THE PROPERTY QUITE A BIT NOW BECAUSE OF THE SPUR APPROVA. AND I JUST I JUST DON'T KNOW HOW I'M GOING TO GET THEM THERE FROM THE SOUTH END. 546 SEVEN 2022 TO GIVE YOU A LITTLE HISTORY OF THE PROPERTY, IT WAS OWNED, PURCHASED IN 95 OR SO BY A GUY NAMED GORDON DAVIS WHO WAS MY PARTNER IN BUSINESS, AND HE PASSED AWAY IN 2015, ASKED ME TO SELL IT FOR THE GIRLS, AND I SAID, I'LL SELL IT AS LONG AS I LAST. WELL IT'S BEEN EIGHT YEARS. IT'S AND NO ONE'S TALKED TO ME MUCH ABOUT IT FOR THE LAST EIGHT YEARS BECAUSE WE DON'T HAVE ANY WAY TO GET TO IT EXCEPT ENLOE ROAD. AND NOW YOU'RE BASICALLY TAKING THAT AWAY FROM US. AND I UNDERSTAND THE PROTECTION ZONE THAT'S ESTABLISHED THERE. AND I GET IT, IS THERE A SENSE OF URGENCY ABOUT IT? IS THERE SOME REASON WHY IT HAS TO BE DONE NOW? AND, IS THERE AND WHEN WILL IT BE CLOSED? I THINK LISA ASKED THAT QUESTION TO. NO ANSWERS. I GUESS. ANYWAY, I'VE GOT TO OPPOSE IT BECAUSE WE NEED TO GET TO THE PROPERTY AND I DON'T THINK ANYBODY THAT WANTS TO SEE IT'S GOING TO WANT TO TAKE A PARACHUTE OR A HELICOPTER TO GET THERE, WHICH IS KIND OF WHERE YOU'RE LEAVING US BECAUSE WE THAT, THAT, THAT, THAT LAND THAT ROAD THAT YOU'RE CLOSING IS THE WAY YOU GET TO IT. YOU KNOW, I, I RARELY TELL PEOPLE TO COME IN FROM THE SOUTH END BECAUSE IT TURNS AND MOVES AROUND SO MUCH.[00:55:02]
IT'S HARD TO GET THERE. BUT ANYWAY, THAT IT MY QUESTION TO YOU IS I KNOW YOU'RE PROBABLY GOING TO APPROVE IT, BUT MY QUESTION TO YOU IS DOES IT HAVE TO BE NOW AND WHEN IS NOW? AND THANK YOU VERY MUCH. THANK YOU SIR, MATT, IS THERE ANYONE ELSE FIRST THAT WOULD LIKE TO SPEAK TO THIS ITEM? I DON'T SHOW ANYBODY. HAS SIGNED UP. BUT, MATT, COULD YOU COME UP AND ADDRESS A FEW THINGS? THE QUESTION THAT'S BEEN ASKED A COUPLE OF TIMES, TIMING. YEAH, SO WE'RE EXPECTING A KEN'S EXPECTING TO BRING THE CONSTRUCTION CONTRACT FOR THE RUNWAY TO COUNCIL PROBABLY NEXT MONTH, IN ORDER TO GET THE CONTRACT SIGNED, GET EVERYONE GET EVERYTHING SIGNED. IT'S PROBABLY THE END OF THE YEAR, FIRST OF THE YEAR BEFORE THEY ACTUALLY START WORK, AND I BELIEVE THE DISCUSSIONS WE'VE HAD SO FAR THAT IT'S PROBABLY AROUND THAT TIME WHEN THE ROADWAY WOULD ACTUALLY CLOSE, OUR PLAN WOULD BE PRIOR TO THAT HAPPENING, PUTTING UP SIGNAGE. PUTTING UP SIGNAGE, SIGNAGE IN ADVANCE, WARNING THAT THE ROADWAY IS GOING TO BE CLOSED O, ON, ON, CLOSED ON THE DATE. THAT'S ULTIMATELY, ULTIMATELY DECIDED, AND THEN BEING SURE THERE IS NEW PERMANENT SIGNAGE SO THAT PEOPLE AREN'T GOING DOWN THERE AND FINDING THEMSELVES UNEXPECTEDLY AT A DEAD END. SO OBVIOUSLY, AND I UNDERSTAND IT MAY NOT OBVIOUSLY BE AS CONVENIENT, BUT, CERTAINLY WHEN THEY TALK ABOUT THE SOUTH END, THERE'S THERE IS ACCESS TO THAT PORTION OF LAND HAS TO BE OTHERWISE, AND THE ROAD WOULD BE A ROAD TO NOWHERE. WHAT IS THE ACCESS NOW? WHAT DO YOU WANT TO. DO YOU WANT TO PULL UP THE RUNWAY EXHIBIT EMPRESS. THE RUNWAY SAFETY ZONE, EXHIBIT. ONE OF THE OTHER ATTACHMENTS.RUNWAY. OUT OF THAT ONE. GO TO THE SECOND PAGE IF YOU CAN. CAN I DO THAT ON THE TOUCH SCREEN? NOW THERE YOU GO. SO THIS IS KIND OF A BIGGER EXHIBIT OF THE WHOLE AREA. AND THE DOTTED BLACK LINE GOING DOWN THE EAST LINE THERE. THAT IS THE, THE EAST SIDE. THAT'S THE EXISTING ALIGNMENT OF ENLOE ROAD. SLASH CR 722 FROM 546 UP UP TO THAT POINT. YEAH. THAT ROAD IS THERE ANY IS THERE ANY LEEWAY. DOES IT HAVE TO BE CLOSE. IS IT IT'S IN THE FPPC. I'LL, I'LL LET KEN SPEAK A LITTLE MORE TO WHAT THE FAA RULES ARE. SO YEAH, THE IT'S BASICALLY THE FAA LOOKS AT IT AS A SAFETY ISSUE. THE PURPOSE OF THE RUNWAY PROTECTION ZONE IS TO PROTECT PEOPLE AND PROPERTY ON THE GROUND. AND SO ABOUT 2012, THE FAA CHANGED THEIR CRITERIA FOR RUNWAY PROTECTION ZONES. AND YOU CAN NO LONGER HAVE A PUBLIC ROAD IN A RUNWAY PROTECTION ZON. AND YOU YOU KNOW, IF YOU HAD AN EXISTING ROAD IN THE RUNWAY PROTECTION ZONE, THE THING THAT TRIGGERS YOU HAVING TO CORRECT THAT ACTION IS ACTUALLY GOING IN AND DOING SOME KIND OF MODIFICATION TO THE RUNWAY, WHICH IS WHERE WE'RE AT NOW. SO WITH THIS PROJECT THAT EXTENDS THE RUNWAY TO THE NORTH, THAT'S WHAT'S TRIGGERING THE REQUIREMENT TO CLOSE THE ROAD. THE OTHER THING I WANTED TO AT LEAST SAY WAS ABOUT IN TERMS OF, EMERGENCY RESPONSE AND ACCESS, THE ROAD WILL STILL BE THERE. IT WILL STILL EXIST. WE'LL STILL USE IT FOR PERIMETER CHECKS, YOU KNOW, AROUND THE PROPERTY OF THE AIRPORT AND EMERGENCY RESPONSE, FIRE AND LAW ENFORCEMENT WILL HAVE THE ABILITY TO GO THROUGH GATES THAT ARE THERE, SIMILAR TO THE WAY LIKE FIRE RESPONDS TO AN EMERGENCY ON THE AIRPORT TODAY THROUGH THROUGH A PERIMETER FENCE. SO THERE WILL STILL BE ACCESS FOR EMERGENCY VEHICLES THROUGH THOSE GATES. IT'S JUST CLOSED TO THE PUBLIC AND IT'S REALLY, AS MATT SAID, THERE'S REALLY NOT A PRACTICAL WAY TO EXTEND THAT ROAD TO THE NORTH, SIMILAR TO WHAT, 546, IS TODAY TO THE SOUTH, TODAY, TO THE SOUTH. 546 IS ALL, SOUTH OF THE RUNWAY PROTECTION ZONE. AND ARE YOU FAMILIAR ENOUGH WITH THE RUNWAY PROTECTION ACT TO TELL US WHETHER OR NOT IT REQUIRES AT THE BEGINNING OF CONSTRUCTION THAT NO PUBLIC ROAD IS IN THAT ZONE? OR IS IT WHEN THE RUNWAY ACTUALLY OPENS FOR OPERATION? I THINK IT WOULD BE WHEN AND I'LL. I'LL VERIFY THIS. I THINK IT WOULD BE WHEN WE'RE TO THE POINT WHERE THE CONSTRUCTION IS, BEING COMPLETED AND WE ARE, YOU KNOW,
[01:00:03]
PUBLISHING BASICALLY. NEW AIRPORT DIAGRAMS AND APPROACHES, AS, AS MATT SAID, THE PROJECT'S GOING TO START, AND THERE'S A LOT OF FILM MATERIAL THAT HAS TO COME INTO THAT AREA. SO I THINK JUST IN, YOU KNOW, SOME PRELIMINARY CONVERSATIONS WITH THE ENGINEERS AND STUFF, THE PLAN WAS BASICALLY TO IMPLEMENT THAT CLOSURE AROUND JANUARY, ASSUMING WE STAY ON THAT SCHEDULE, IF THERE'S A WAY TO MOVE THAT BACK AND NOT AFFECT THE PROJECT WILL CERTAINLY, TRY TO DO THAT. THE FILL DIRT, IT'S GOING TO HAVE TO BE DEPOSITED AND IT'S GOING TO BE ACTED AND IT'S GOING TO HAVE TO HAVE SOME CURE TIME. YES, IT'S GOING TO HAVE ABOUT NINE MONTHS TO SETTLE TIME. SO CERTAINLY Y'ALL WOULD BE OPEN TO EXTENDING THAT ROADWAY BEING OPEN AS LONG AS POSSIBLE UNDER THAT FEDERAL. SURE. YEAH. I'LL LOOK INTO THAT FOR SURE. IF WE CAN DELAY IT AND NOT IMPACT THE PROJECT NEGATIVELY, WE WE'D BE HAPPY TO DO THAT. THANK YOU FOR BEING HERE. YEAH, YEAH. AND EMERGENCY VEHICLES WILL CONTINUE TO HAVE ACCESS BEYOND THE CLOSED DURING THE TERM OF THE CONSTRUCTION. YOU MEAN I UNDERSTOOD THAT THEY'D HAVE ACCESS, AFTER AS WELL? YES IN PERPETUITY. AFTER THE PROJECT'S CONCLUDES, THERE WILL BE GATES THERE, AND THEY'LL THEY'LL STILL HAVE THE ABILITY TO ACCESS IT. THANK YOU. ALL RIGHT. WITH THAT, ENTERTAIN A MOTION. MAKE A MOTION. WE CLOSE THE PUBLIC HEARING AND APPROVE THIS ITEM. I'LL SECOND, PLEASE CAST YOUR VOTES. ALL RIGHT, NEXT ITEM, CONDUCT A PUBLIC HEARING TO CONSIDER AN[Conduct a Public Hearing to Consider/Discuss/Act on a Right-Of-Way Abandonment of Bloomdale Road Located Approximately 150 Ft West of the Intersection of Bloomdale Road and Ridge Road and on the North Side of Bloomdale Road, and Accompanying Ordinance (24-0005RW)]
ACT ON A RIGHT OF WAY. ABANDONMENT OF BLOOMINGDALE ROAD, LOCATED APPROXIMATELY 150FT WEST OF INTERSECTION OF BLOOMINGDALE ROAD AND RIDGE ROAD, AND ON THE NORTH SIDE OF BLOOMINGDALE ROAD AND ACCOMPANYING ORDINANCE 240005 RW. THANK YOU AGAIN, MR. MAYOR, THIS IS A REQUEST TO ABANDON A RELATIVELY SMALL SLIVER OF RIGHT OF WAY ALONG THE NORTH SIDE OF BLOOMINGDALE ROAD, THIS IS ASSOCIATED WITH PHASE ONE, PHASE ONE OF THE HIGHLAND LAKES SUBDIVISION, WHICH THAT PLAT JUST GOT FILED LAST YEAR, IN BETWEEN THAT PLAT BEING SUBMITTED, APPROVED AND FILED AND NOW, TXDOT ESTABLISHED THE FINAL ALIGNMENT FOR THE US 380 BYPASS AND THE CITY AS A RESULT, MADE SOME CHANGES TO THE MASTER THOROUGHFARE PLAN ALIGNMENT OF BLOOMDALE ROAD THAT IS GOING TO RESULT IN A NEW ALIGNMENT THAT SWINGS FURTHER SOUTH IN THIS AREA. SO WHAT THAT MEANS IS A PORTION OF THE RIGHT OF WAY THAT WAS DEDICATED BY HIGHLAND LAKES IS NO LONGER GOING TO BE A MAJOR, A MAJOR ARTERIAL ROADWAY. WE HAVE EXCESS WIDTH THERE, THAT THE PROPERTY OWNER HAS REQUESTED AND WE ARE IN IN SUPPORT OF GIVING THAT PROPERTY BACK TO THE PROPERTY OWNER WHO DEDICATED IT IN THE FIRST PLACE, THE PROPERTY OWNER DID HAVE A, DID HAVE A IMPACT FEE CREDIT AGREEMENT FOR THE RIGHT OF WAY DEDICATION, ASSUMING THIS IS APPROVED TONIGHT, YOU WILL SEE A REVISED IMPACT FEE CREDIT AGREEMENT ON THE SEPTEMBER 3RD AGENDA TO REMOVE SOME OF THOSE CREDITS. ANY QUESTIONS FOR MATT? ALL RIGHT. I BELIEVE THERE MIGHT BE A REPRESENTATIVE OF THE PROPERTY OWNER HERE TONIGHT. IS THERE? MAYBE NOT. THIS IS A PUBLIC HEARING. WOULD ANYONE LIKE TO SPEAK TO THE ITEM? SEEING NONE, MR. MAYOR, I MOVED THAT WE CLOSE THE PUBLIC HEARING AND APPROVE THE ITEM. SECOND. MICHAEL PLEASE CAST YOUR VOTES. HARRIS, ITEM 241896. CONSIDER AND ACT ON AN ADOPTION OF A RESOLUTION DETERMINING A PUBLIC NECESSITY TO ACQUIRE A PROPERTY EASEMENT RIGHTS FOR THE PUBLIC USE BY EMINENT DOMAIN FOR A WATER LINE EASEMENT AND TEMPORARY CONSTRUCTION EASEMENT ASSOCIATED WITH THE SH FIVE UTILITY RELOCATION PROJECT FOR 1633 AND WW 1633. WHICH PROPERTY IS LOCATED AT THE SOUTHEAST CORNER OF UNIVERSITY AVENUE AND NORTH MACDONALD STREET, AND AUTHORIZING THE CITY MANAGER TO ESTABLISH PROCEDURES FOR ACQUIRING THE EASEMENTS ON SAID PROPERTY AND TAKE ALL STEPS NECESSARY TO ACQUIRE THE NEEDED PROPERTY RIGHTS AND COMPLIANCE WITH ALL APPLICABLE LAWS AND RESOLUTIONS. THANK YOU, MAYOR COUNCIL GARY GRAHAM, DIRECTOR OF ENGINEERING WE'RE HERE TO ASK FOR YOUR SUPPORT ON EMINENT DOMAIN REQUEST, THIS IS FOR TXDOT STATE HIGHWAY FIVE PROJECT, WHERE THEY HAVE ASKED US TO REMOVE ALL CITY UTILITIES FROM WITHIN THE RIGHT OF WAY.AND WE HAVE A PROJECT ESTABLISHED TO, MOVE THOSE INTO PRIVATE EASEMENTS. JUST A COUPLE OF QUICK STATS, REAL QUICK FOR THIS PROJECT BEFORE I GO INTO THIS PARTICULAR ONE, WE ARE
[01:05:03]
DOING 56 PROPERTY ACQUISITIONS. THERE'S MULTIPLE EASEMENTS PER PER PROPERTY, BUT 56 PROPERTIES OF THOSE WE'VE HAD TO COME, INCLUDING THIS ONE TO ASK FOR EMINENT, EMINENT DOMAIN ON 15 OF THOSE. WE HAVE REACHED SETTLEMENT ON TEN OF THOSE, FIVE OF THEM, FIVE OF THE 15 OR 5 OF THE TEN THAT WE'VE SETTLED DID END UP GOING TO EMINENT DOMAIN. SPECIAL COMMISSIONERS HEARING FIVE OF THE OTHER ONES, THOUGH, WE WERE ACTUALLY ABLE TO SETTLE BEFORE WE WENT TO SPECIAL COMMISSIONERS. THIS WAS THAT THAT IMPROMPTU, MOTIVATION ON THE PROPERTY OWNERS PART TO GET THAT DEAL DONE WITH THE CITY. SO, NOT ALL OF THEM DO GO, WE STILL HAVE FIVE MORE THAT WE ARE. WE HAVE YET TO SETTLE, WE ARE ACTUALLY DELAYING MOVING FORWARD WITH THOSE BECAUSE OF THE TERMS OF THE AGREEMENT WITH THE PROPERTY OWNER. AS SOON AS WE PAY THEM OUR EASEMENT STARTS, THE CLOCK STARTS FOR THE EASEMENT THAT WE FOR THE TEMPORARY CONSTRUCTION EASEMENT.SO WE'RE WAITING UNTIL OUR CONTRACTOR IS READY FOR TO WORK IN THOSE AREAS. BUT FOR THIS PARTICULAR PROPERTY, IT'S UP THERE AT 380 AND HIGHWAY FIVE. WE NEED A WATER EASEMENT AND A TEMPORARY CONSTRUCTION EASEMENT, AS IN ALL EMINENT DOMAIN CASES, THE PROCESS THAT WE FOLLOW IS WE GO ACQUIRE AN EASEMENT. I MEAN, EXCUSE ME, WE GO ACQUIRE AN APPRAISAL TO ESTABLISH WHAT THE FAIR MARKET VALUE OF THE PROPERTY IS. WE USE THAT TO MAKE AN INITIAL OFFER. THE PROPERTY OWNER HAS THE OPPORTUNITY TO ACCEPT THAT OFFER OR MAKE A COUNTEROFFER. THE CITY REVIEWS THAT INFORMATION. WE MAKE A FINAL OFFER THE SAME NEGOTIATION PROCESS CAN TAKE PLACE IF THE NO RESOLUTION IS, MET WITH THE PROPERTY OWNER. WE HAVE THE ABILITY TO ASK FOR EMINENT DOMAIN, THE EMINENT DOMAIN PROCESS IS AGAIN, IT'S A IT'S A PROCESS TO ESTABLISH FAIR MARKET VALUE. THE COLLIN COUNTY COMMISSIONERS SELECT THREE SPECIAL COMMISSIONERS TO HEAR A CASE THAT THE PROPERTY OWNER AND THE CITY BOTH MAKE THEIR CASES TO, WE PRESENT ALL THE FACTS.
PROPERTY OWNER CAN MAKE THEIR FACTS OF WHY THEY THINK OF A CERTAIN VALUE OF THE PROPERTY.
SHOULD BE THOSE THREE INDIVIDUALS. THE SPECIAL COMMISSIONERS WILL THEN DETERMINE WHAT THE FAIR MARKET VALUE IS. THIS IS NOT A TAKING. THIS IS A PROCESS TO ESTABLISH COMPENSATION FOR THE EASEMENT NEEDED FOR PUBLIC GOOD. SO WITH THAT, I'M HAPPY TO TAKE ANY QUESTIONS. QUESTIONS FOR GARY. I THINK WE'VE BEEN DOWN THIS ROAD A NUMBER OF TIMES. ALL RIGHT.
ONE SECOND. IS THERE ANY ANY COMMENTS, ANY DISCUSSION WITH THAT ENTERTAIN A MOTION. MAYOR.
I'LL MAKE A MOTION. I MOVE THAT THE CITY OF MCKINNEY, TEXAS CITY COUNCIL APPROVE THIS ITEM AS WRITTEN AND ADOPT THE RESOLUTION DESCRIBED IN THIS AGENDA ITEM. COMMENTS. NOT ON THE AGENDA. COUNCIL LIAISON, COMMENTS START DOWN THERE, COUNCILMEMBER BELLER. OKAY, I'LL, MENTION A COUPLE OF QUICK THINGS. ONE, I WENT TO THE, TWO EVENTS THIS WEEKEND. ONE WAS THE LITERARY FEST AT THE LIBRARY ACROSS THE STREET OVER HERE, WHICH BROUGHT TOGETHER A BUNCH OF LOCAL ARTISTS, AND WAS PUT ON BY THE FAIRLY RECENTLY FORMED LIBRARY FOUNDATION, ALONG WITH OUR LIBRARY STAFF AND, I HAD SEEN A CITY EMAIL ABOUT IT. WEEKS AGO, BUT I ALSO HEARD IT ADVERTISED ON KERA ON FRIDAY, WHICH REMINDED ME OF IT. BUT IT WAS A GOOD TURNOUT. IT WAS A GOOD EVENT AND HAPPY FOR, THE LIBRARY STAFF, AND THE LIBRARY[01:10:01]
FOUNDATION, SECOND THING WAS THE LOVE MCKINNEY EVENT THAT, I BELIEVE TAMMY MANLEY PUT TOGETHER WITH, A LOT OF CITY STAFF THAT CAME OUT TO KIND OF SHOWCASE ALL THE DIFFERENT DEPARTMENTS IN THE CITY, THERE WAS SOME REALLY NEAT AREAS, LIKE THE TOUCH A TRUCK AREA WHERE YOU COULD GO SEE FIRE TRUCKS AND GARBAGE TRUCKS AND BACKHOES AND ALL SORTS OF THINGS. AND I THINK THAT SOMEONE WAS BEEPING A HORN FOR THE ENTIRE THREE HOURS THAT WE WERE OUT THERE. WASN'T ME, ALSO, FRONTIER WASTE MANAGEMENT, OUR NEW WASTE MANAGEMENT PARTNER, WAS OUT THERE, THERE WAS WILL WITH THE PARKS DEPARTMENT, WAS FLOATING AROUND ON A KAYAK ALL ALL THE WHOLE TIME ADVERTISING THE PARKS KAYAKS OUT THERE. AND I SAW OUR ASSISTANT CITY MANAGER, KIM FLOM, WAS HELPING THE ANIMAL SERVICES WITH SOMEONE WITH A KITTEN. THAT SOMEONE HAD BROUGHT. AND SO IT WAS A GOOD EVENT BY STAFF, TO JUST SHOWCASE THE CITY AND KIND OF CREATE A CONTACT POINT THAT OTHER THAT PEOPLE MAY NOT GET IN THE NORMAL COURSE OF BUSINESS. SO I APPRECIATE, THAT EVENT EVEN THOUGH IT WAS SO HOT. I ALSO GOT A TEXT FROM BETH BENTLEY JUST NOW, AND SHE ASKED, FOR ME TO RECOGNIZE TWO, BIRTHDAYS THAT HAPPENED IN THE LAST WEEK. ONE WAS FOR, MISS BETTY HOLLINS, WHO TURNED 89 TODAY. SHE'S BEEN A LIFELONG RESIDENT OF THE LEWISVILLE COMMUNITY. SHE WAS A, ATTENDEE OF IS DODIE AND MCKINNEY HIGH SCHOOL, AND THE OTHER WAS MISS BETTY GREER, WHO CELEBRATED 88 YEARS EARLIER TODAY. EARLIER THIS WEEK, AND SHE IS FROM A MULTIGENERATIONAL FAMILY IN THE ROCKWALL COMMUNITY. AND SO, HAPPY BIRTHDAY TO, THOSE THOSE LADIES, THAT THAT IS QUITE A QUITE AN AGE. I DON'T KNOW THAT ANYBODY UP HERE HAS GOTTEN TO THAT POINT. HAVE YOU? 88, 89 DO WE LOOK LIKE WE HAVE? THAT'S ALL I HAVE. MR. MAYOR. THANK YOU. I DON'T HAVE ANYTHING TONIGHT, I'VE GOT TWO THINGS. NUMBER ONE, I TRY TO MEET WITH CONSTITUENTS. THE MONDAY BEFORE THE TUESDAY CITY COUNCIL MEETING AND, NEXT, THE NEXT MONDAY, TWO WEEKS FROM YESTERDAY IS GOING TO BE LABOR DAY. AND THE JOHN AND JUDY GAY LIBRARY, WHERE I MEET IS CLOSED. AND SO, THE GOOD FOLKS AT THE MCKINNEY NATIONAL AIRPORT ARE GOING TO ALLOW ME TO USE THE FBO BUILDING, WHICH HAS A JUST A MAGNIFICENT VIEW. SO I'D LIKE TO INVITE EVERYBODY THERE. AND I THINK I'M GOING TO HAVE A SPECIAL GUEST STAR WHOSE INITIALS ARE JUSTIN BELLER. JOIN ME AND WE'RE GOING TO SEE ABOUT THAT. SO WE'D LOVE TO HAVE ANYBODY OUT THERE FROM 5 TO 7, I ATTENDED A THING AT COLLIN COLLEGE LAST WEEK. YOU KNOW, THEY HAVE THE TRADE CAMPUS THERE IN ALLEN CALL IT ROUGHLY 121 AND THEY'RE EXPANDING THAT A LITTLE BIT FOR HIGHER EDUCATION. AND THEY HAD REPRESENTATIVES FROM UTD AND TEXAS STATE OUT THERE.AND THE SPEAKER FOR TEXAS STATE, ONE OF THEM WAS THE PRESIDENT OF TEXAS STATE. AND HE SAID SOMETHING TO ME THAT SAID SOMETHING TO US THAT I THOUGHT WAS QUITE REMARKABLE, A KID OR AN ADULT FROM COLLIN COUNTY CAN GET A FOUR YEAR DEGREE FROM TEXAS STATE AT THAT CAMPUS IN ALLEN FOR UNDER $20,000. THAT'S PRETTY REMARKABLE. THAT'S A GREAT OPPORTUNITY FOR HIGHER EDUCATION HERE IN COLLIN COUNTY. AND JUST A SHOUT OUT TO THE GREAT TEAM AT COLLIN COLLEGE, WHO CONTINUES TO WORK TO MAKE EDUCATION MORE AFFORDABLE FOR US. THAT'S ALL I HAVE, MR. MAYO.
YES SIR, GRACE STEVENS IS A GRADUATE OF MCKINNEY HIGH SCHOOL AND A FORMER MCKINNEY HIGH MARQUETTE. SHE IS THE FIRST, YOUNG LADY TO MAKE IT TO THE RANK OF OFFICER WITH THE KILGORE RANGERETTES, WHO PERFORM REGULARLY AT THE WHITE HOUSE AND THROUGHOUT THE UNITED STATES.
SHE IS RANKED AS LIEUTENANT, AND SHE IS THE FIRST PERSON TO GRADUATED FROM MCKINNEY HIGH SCHOOL TO REACH THE RANK OF LIEUTENANT OR AN OFFICER FOR THE RANGER. KILGORE RANGERETTES.
SINCE ROCKS AND JOPLIN DID THE SAME IN 1966, SO CONGRATULATIONS TO GRACE AND THANKS TO GRACE FOR CARRYING THE LEGACY OF MCKINNEY OUT INTO THE WORLD. FOR US, HIGH SCHOOL FOOTBALL STARTS IN NINE DAYS ON THE 29TH OF AUGUST. YOU CAN SEE THREE DIFFERENT FOOTBALL TEAMS, ALL LOCATED HERE IN
[01:15:04]
MCKINNEY. ONE WOULD BE MCKINNEY. BOYD WILL BE PLAYING AT THE MCKINNEY HIGH STADIUM, MCKINNEY HIGH SCHOOL WILL BE PLAYING AT THE STAR OVER IN FRISCO, AND THEY WILL BE PLAYING FRISCO EMERSON, WHICH IS WHOLLY LOCATED WITHIN MCKINNEY'S CORPORATE CITY LIMITS. AND THEN ON FRIDAY THE 30TH, YOU CAN SEE MCKINNEY NORTH HERE AT HOME IN THE MCKINNEY STADIUM. GET OUT AND ENJOY SOME GOOD HIGH SCHOOL FOOTBALL. SEPTEMBER 1ST KICKS OFF DOVE SEASON. IF YOU OWN TEN ACRES OR MORE, YOU CAN SHOOT A SHOTGUN ON YOUR OWN PROPERTY, WHETHER IT'S IN THE CITY LIMITS OR NOT. SO IF YOU HEAR SOMEBODY ON YOUR NEIGHBORING PROPERTY AND IT'S MORE THAN TEN ACRES, PLEASE DON'T CALL OUR POLICE DEPARTMENT BECAUSE THEY'RE SHOOTING LEGALL. THANK YOU. ASSUMING IT'S A DOVE.YES, IT'S A DOVE, RIGHT? YEAH. I DON'T HAVE MUCH TODAY, BUT THE, SINCE OUR LAST MEETING, PRETTY MUCH EVERY SCHOOL DISTRICT SHOULD HAVE STARTED SCHOOL BY NOW. PROSPER BEING ONE OF THE LAST ONES. WHEN MY KIDS ATTEND. BUT I JUST WANT TO SAY A BIG SHOUT OUT TO ALL THE TEACHERS, FIRST RESPONDERS, AND OFFICERS THAT ARE SUPPORTING OUR KIDS RIGHT NOW. MCKINNEY IS HOME TO MANY SCHOOL DISTRICTS AND IT TAKES A LOT OF PEOPLE IN OUR COMMUNITY TO MAKE THIS WORK. AND JUST A BIG THANK YOU TO EVERYBODY AND, BE SAFE OUT THERE. SPEED ZONES ARE IN PLACE NOW AGAIN. SO YOU GOT TO SLOW DOWN. AND I KNOW WE WERE GETTING TO WORK A LOT EARLIER, A COUPLE WEEKS AGO. AND NOW THINGS HAVE SLOWED DOWN A LITTLE BIT. BUT, YOU KNOW, PAY ATTENTION TO OUR KIDS AND, HAVE A GOOD EVENING, EVERYBODY. ALL RIGHT. I HAVE JUST A FEW THINGS TODAY. FIRST OF ALL, WE GOT A CHANCE TO ATTEND THE BOYS AND GIRLS CLUB RIBBON CUTTING FOR THEIR EXPO GAMES GAMING ROOM, WHICH WAS PARTIALLY FUNDED BY OUR CDC BOARD. AND IT WAS AN AWESOME OPPORTUNITY TO GET OUT, TO GO SEE JUST A WONDERFUL ORGANIZATION. I MEAN, WE HAD A BOARD MEMBER, OUR VICE CHAIR OF THE BOARD WHO ACTUALLY WENT TO THAT BOYS AND GIRLS CLUB AS HE WAS GROWING UP. AND IT WAS REMARKABLE TO SEE HIM GO BACK AND JUST CONTRIBUTE IN A DIFFERENT WAY. BUT THE IMPACT THAT THEY'RE HAVING ON KIDS IN MCKINNEY AND IN THE SURROUNDING AREA ARE, ARE JUST INVALUABLE. AS I WAS WALKING OUT A YOUNG LADY THAT WORKS IN MY COMPANY WAS THERE TO PICK UP HER SON. I HAD NO IDEA. AND SHE'S A SINGLE MOM WHO STRUGGLES TO KIND OF MAKE IT WORK IN TERMS OF, YOU KNOW, AFTER SCHOOL PROGRAMS AND THINGS LIKE THAT. AND SO SHE STOPPED ME FOR A SECOND AND JUST SPOKE. SO HIGHLY OF THE ORGANIZATION AND HOW MUCH THEY'VE INVESTED IN HER KIDS. SO I JUST WANTED TO THANK THOSE FOLKS BECAUSE THEY DO SUCH A GREAT JOB WITH OUR WITH OUR KIDDOS, ALSO GOT TO GOT TO ATTEND A COUPLE OF RIBBON CUTTINGS HERE OVER THE LAST FEW WEEKS. MOST RECENTLY DREAM YOUR CAKES, WHICH IS OUT ON INDEPENDENCE PARKWAY AND WOUND HEALING CENTER, WHICH IS RIGHT ACROSS FROM MEDICAL CITY, AT BOTH OF THOSE EVENTS, THERE WERE REPRESENTATIVES FROM THE CHAMBE, THEY WEREN'T. I DON'T THINK, OFFICIALLY MEMBERS AND DIDN'T DO THE BIG THING WHERE ALL OF THE MEMBERS COME OUT. BUT THE CHAMBER WAS STILL THERE TO SUPPORT THEM BECAUSE THEY KNEW HOW IMPORTANT IT WAS TO BRING SOME RECOGNITION TO THESE SMALL BUSINESSES, WHICH ARE REALLY THE BACKBONE OF OUR ECONOMIC COMMUNITY HERE. AND SO I JUST WANTED TO THANK THEM AS WELL, BECAUSE THEY COME OUT, THEY'RE SMILING, THEY'RE INFORMATIVE, THEY WANT TO BE HELPFUL, IN ANY WAY THEY CAN. SO YOU KNOW, OF COURSE, THEY'RE TRYING TO RECRUIT MEMBERS TO THE CHAMBER AND THE PROCESS. BUT EVEN WITHOUT THAT OFFICIAL MEMBERSHIP, THEY ARE STILL INVESTED IN THE COMMUNITY HERE.
SO I JUST WANTED TO THANK THOSE STAFF MEMBERS AS WELL. OKAY. WELL, IT IS IN THE MIDDLE OF THE SUMMER, IF WE HAVEN'T NOTICED, AUGUST IS NATIONAL WATER QUALITY MONTH, AND YOU CAN VISIT OUR WEBSITE TO LEARN MORE ABOUT WATER QUALITY, WAYS TO PROTECT OUR QUALITY OF OUR WATER. IT'S ALSO A REMINDER OF ME TO REMIND EVERYBODY ELSE THAT WATER IRRIGATION USES ABOUT 60% OF OUR SUMMER WATER USAGE AT THIS TIME OF YEAR. THAT'S A LOT OF WATER BEING PUMPED AND WE NEED TO MAKE SURE WE HAVE WATER TO GO AROUND. SO THAT'S WHY WE LIMIT WATERING TO TWICE A WEEK. BETWEEN THE HOURS OF 10 A.M. AND 6 P.M. RESIDENTS, IT'S NOT ALLOWED. I'M SORRY. BETWEEN THE HOURS OF 10 A.M. AND 6 P.M. ANY OTHER TIME IS FINE. TWICE A WEEK. THE GOOD RULE OF THUMB IS USE IT WATER ON YOUR TRASH DAY AND THREE DAYS LATER, IF NECESSARY, YOUR GRASS MIGHT GET A LITTLE BROWN, BUT THAT IS OKAY. GRASS GOES DORMANT. IT WILL BOUNCE BACK ONCE WE GET RAINS, BUT IT'S IMPORTANT TO TRY TO ADHERE TO OUR WATERING RESTRICTIONS TO TWICE A WEEK. AND THE OTHER THING I WANTED TO TALK ABOUT, I KNOW COUNCILMAN BELLER MENTIONED IT DESPITE THE HEAT, WE HAD ABOUT A THOUSAND PEOPLE SHOW UP AT THE LOVE MCKINNEY EVENT AT TOWN LAKE, IT WAS ORGANIZED BY A CROSS-FUNCTIONAL GROUP OF OUR CITY STAFF. IT WASN'T JUST ONE DEPARTMENT. IT WAS A CROSS-FUNCTIONAL TEAM THAT DID IT. AND THEY DID A TREMENDOUS JOB. AND PREPARING THE EVENT.
AND SHOWCASING THE AN ARRAY OF CITY SERVICES, WE'RE LOOKING WE'RE VERY EXCITED ABOUT THE
[01:20:04]
SUCCESS OF IT, AND WE'RE CERTAINLY GOING TO LOOK TO SEE IF WE CAN PIVOT THAT, INTO OTHER TYPES OF EVENTS THAT WE CAN CONTINUE TO SHOWCASE THE WIDE ARRAY OF CITY SERVICES AVAILABLE TO THE COMMUNITY. THAT'S ALL I HAVE, SIR. ALL RIGHT. I ATTENDED A RIBBON CUTTING THE OTHER DAY AS WELL FOR THE CHATEAU, FOR THEIR BIG, BIG RENOVATION PROJECT. THE CHATEAU IS A SENIOR LIVING COMMUNITY OF VIRGINIA, AND IT WAS REALLY GREAT TO SEE ALL THE SENIORS THERE AND THAT THEY SHARED WITH ME HOW ENJOYABLE LIVING THERE IS AND HOW GREAT THE STAFF IS. AND THEY'RE JUST REALLY APPRECIATIV, APPRECIATIVE OF THAT FACILITY AND BEING THERE MULTIPLE TIMES.I SEE WHY THEY ARE, I ALSO WANT TO COMPLIMENT OUR EMS. I WALKED OUT OF THE HOUSE YESTERDAY MORNING. IT WAS 530 IN THE MORNING, AND AS I WALKED OUT THERE WAS A FIRE TRUCK AND AN EMS TRUCK. THERE WITH MY NEIGHBOR, UNFORTUNATELY, WHO HAD COLLAPSED, AFTER A SURGERY. BUT BUT HE IS DOING OKAY. HE'S DOING FINE RIGHT NOW. BUT THEY WERE THERE IN LESS THAN 2.5 MINUTES FROM THE CALL, AND I'M SURE THAT PLAYED A GREAT PART IN THE FACT THAT HE IS DOING WELL. ALSO, MAYOR PRO TEM AND I WERE AT AN, AT A I'LL CALL IT AN EVENT. BUT, YOU KNOW, THERE'S BEEN A LOT OF, A LOT OF DISCUSSION, A LOT OF, I WANT TO SAY CONFLICT, BUT DISAGREEMENT ON AN APPLICATION, A ZONING APPLICATION THAT WAS MADE BY THE MCKINNEY ISLAMIC ASSOCIATION ON A PIECE OF PROPERTY THEY HAVE IN A NEIGHBORHOOD, AND BOTH SIDES HAVING CONCERNS. BUT IT WAS GREAT TO SEE THAT THEY GOT TOGETHER. I DON'T KNOW WHAT THE END RESULT WAS BECAUSE WE DID NOT STAY FOR THE EVENT. WE LET THEM HAVE THEIR MEETING, BUT THERE HAD TO BE 120, 30 PEOPLE THERE FROM THE ASSOCIATION. AND THE NEIGHBORHOOD. AND THE POINT IS, THEY WERE TALKING AND RESPECTFULLY TALKING AND HEARING EACH OTHER OUT, AND THEY BOTH CAME WITH THE DESIRE TO DO THAT, TO HEAR, HEAR FROM ONE ANOTHER AND TRY TO UNDERSTAND WHAT THE ULTIMATE GOAL WAS AND HOW IT COULD BE, HOW THERE COULD BE A WIN WIN. HOPEFULLY IN THAT ENDEAVOR. AND THE LAST THING I'LL SAY, I JUST WANT PAUL TO KNOW THAT I'M ON TO YOU. I KNOW THAT YOU HAVE SCHEDULED SUPPOSEDLY THE STATE OF THE CITY FOR NOVEMBER 7TH, WHICH I KNOW IS MY BIRTHDAY. IT'S ACTUALLY A HUGE SURPRISE PARTY. AND I JUST WANT YOU TO KNOW THAT I ALREADY KNOW THAT THAT'S WHAT IT IS THAT YOU'RE. THAT THE STATE OF THE CITY IS ACTUALLY JUST GOING TO BE A BIG CELEBRATION, RIGHT? THAT'S TRY TO PULL THAT OVER ON ME. I WANT YOU TO KNOW THAT I KNOW IT AND I MAY OR MAY NOT ATTEND. I DON'T CONCEAL THAT DATE. YEAH, SO I APPRECIATE YOU USING THAT DATE SINCE I HAD PLANS TO BE SOMEWHERE ELSE, AND WITH THAT, ENTERTAIN A MOTION TO ADJOURN. SO MOVED. SECOND.
SECOND. ALL IN FAVOR? AYE. AYE
