I THOUGHT THE MAYOR AND I WOULD BOTH COME UP HERE AND PRESENT GREG WITH THESE, THIS RECOGNITION. BUT MAYBE WE HAVE LORI. COME ON UP. GREG'S WIFE LORI, COME ON UP. THIS ISN'T DONE WITH ONE PERSON. CERTAINLY. YOU HAVE TO HAVE A STRONG WIFE ABLE TO SUPPORT YOU ALL. ALL THOSE YEARS SERVING IN THE POLICE DEPARTMENT. SO A LITTLE BIT ABOUT GREG CONNELLY. GREG WAS FIRST HIRED AS A POLICE OFFICER IN 1988, IN MESQUITE, AND HE SERVED THERE FOR FOUR YEARS, WENT TO GARLAND IN 92, THREE YEARS. OKAY, THEN HE WENT TO GARLAND, WORKED UP, WORKED HIS WAY UP THE RANKS, AND BECAME AN ASSISTANT CHIEF IN GARLAND AROUND 2000 AND WAS THERE FOR 15 YEARS BEFORE MCKINNEY, 2024 YEARS IN GARLAND. 23. OH, THAT'S RIGHT, 92 I'M SORRY, 15 YEARS AS ASSISTANT CHIEF. THAT'S WHAT I MEANT. I'M SORRY. AND THEN HE WAS HIRED HERE IN MCKINNEY IN 2015, I BELIEVE IT WAS SPRING OF 2015, AND HE WAS HERE RIGHT BEFORE THE POOL PARTY. IF ANYBODY REMEMBERS THE POOL PARTY, I WAS NOT IN MCKINNEY AT THE TIME, BUT I DO REMEMBER WATCHING IT ON THE NATIONAL NEWS. AND GREG HAD JUST GOTTEN HERE AND MAN, DID THEY HIRE THE RIGHT GUY. YOU KNOW, YOU KNOW, YOU'VE GOT THE RIGHT PERSON THERE. SOMETIMES IT'S JUST BE AT THE RIGHT TIME IN THE RIGHT PLACE. AND THEY SERENDIPITY.

THEY PUT GREG IN MCKINNEY'S HANDS OR PUT MCKINNEY IN HIS HANDS AND HIS STEADY LEADERSHIP JUST DID A GREAT JOB REBUILDING TRUST WITHIN THE COMMUNITY. HE ESTABLISHED THE POLICE CHIEF'S ADVISORY COUNCIL. ALL THOSE THINGS HELPED REBUILD THAT TRUST WITH OUR COMMUNITY HERE IN MCKINNEY. HE RETIRED FROM POLICING IN OCTOBER OF 2022, BUT WE KNEW HE WASN'T DONE YET BECAUSE WE WERE BRINGING ON A NEW POLICE CHIEF, CHIEF ELLENBURG, HERE. BUT WE ALSO BROUGHT ON A NEW FIRE CHIEF, AND WE NEEDED GREG'S WISDOM AND HIS SEASONING FOR A COUPLE MORE YEARS, AND HE AGREED TO DO IT. AND HE'S BEEN SERVING AS THE DIRECTOR OF PUBLIC SAFETY SINCE OCTOBER OF 22 UNTIL NOW, AND HE'LL BE RETIRING FOR GOOD, AS IT WERE. I KNOW HE'S GOT SOME OTHER THINGS THAT HE'S DOING IN LIFE, WHICH IS FANTASTIC, BUT WE'RE WE HATE TO SEE HIM GO, BUT HE'S BEEN AN UNBELIEVABLE ASSET FOR THE CITY OF MCKINNEY AND A DELIGHT TO WORK WITH. AND I'LL HAND IT OVER TO THE MAYOR AND SHARE WITH HIM. AND THEN WE'LL PRESENT A FEW THINGS TO GREG.

WELL, I CAN'T HELP TO THINK THAT YOU MADE THE DECISION TO LEAVE BECAUSE YOU DIDN'T HAVE A WINDOW IN YOUR OFFICE HERE, BUT IF YOU JUST WAITED ANOTHER FEW WEEKS, A BEAUTIFUL WINDOW OFFICE AT THE NEW FACILITY. CHIEF, IT'S BEEN, AS PAUL SAID, FROM THE MOMENT YOU GOT HERE AND THE SITUATION YOU WERE THROWN INTO, HOW YOU HANDLED IT WITH SUCH POISE, PROFESSIONALISM AND AS PAUL SAID, BUILT, BUILT TREMENDOUS CONFIDENCE FROM THAT. THAT WAS A SPRINGBOARD EVENT FOR A REVAMPING OF A WHOLE LOT OF THINGS. AND YOU LED THAT AND BROUGHT OUR CITY TO THE PLACE IT

IS OVER THE LAST NUMBER OF YEARS, IT'S JUST BEEN AN HONOR TO SERVE AS MAYOR. AND I KNOW I SPEAK FOR ALL OF COUNCIL, FOR US ALL TO SERVE IN A CITY THAT HAS A POLICE DEPARTMENT. THE LEADERSHIP, SHE AGREES, THE LEADERSHIP THAT YOU HAVE BROUGHT AND YOU CONTINUE TO BRING IN THE IN THE ROLE THAT YOU'VE BEEN IN. SO THANK YOU SO MUCH. IT'S BEEN A GREAT RIDE. SO WE HAVE A PROCLAMATION. WHEREAS MISTER GREG CONLEY HAS BEEN PUBLIC SAFETY SERVANT OF THE NORTH TEXAS AREA SINCE 1988, BEGINNING HIS CAREER IN THE CITY OF MESQUITE BEFORE MOVING ON TO THE CITY OF GARLAND IN 1992. WORKING IN A WIDE VARIETY OF DIVISIONS AND RISKING RISING TO THE RANK OF ASSISTANT CHIEF IN 2000. AND WHEREAS, MISTER CONLEY BECAME OUR CHIEF OF POLICE IN 2015, STEPPING UP TO ADDRESS UNPRECEDENTED CHALLENGES WITHIN THE CITY, WORKING TO ENHANCE ENHANCE SAFETY MEASURES AND HELPING TO STRENGTHEN OUR COLLECTIVE SENSE OF A UNIFIED COMMUNITY. AND WHEREAS, UPON ARRIVAL, CHIEF CONLEY WAS SOON RESPONSIBLE FOR PEACEFULLY NAVIGATING THE AFTERMATH OF THE POOL PARTY INCIDENT, WHICH PLACED MCKINNEY IN THE NATIONAL MEDIA SPOTLIGHT. AND I WOULD ARGUE IT PUT US IN AN INTERNATIONAL SPOTLIGHT. THERE IS REPORTS AND NEWS STORIES IN ENGLAND I REMEMBER SEEING, WHEREAS HE CREATED THE CHIEF'S ADVISORY COUNCIL THAT IS STILL UTILIZED BY HIS SUCCESSOR, CHIEF JOE ELLENBERG, AND HE CREATED AND STAFFED THE INTELLIGENCE UNIT, THE CASE MANAGEMENT, THE NEIGHBORHOOD POLICE OFFICER UNIT AND THE COMMUNITY SERVICES UNIT, ALL OF WHICH OPERATE TO BETTER SERVE RESPONSIVENESS, ACCESSIBILITY AND ENGAGEMENT FOR THE SAFETY NEEDS OF ALL MCKINNEY RESIDENTS. AND WHEREAS, AFTER RETIRING AS POLICE CHIEF IN 2022, GREG CONLEY WAS NAMED THE CITY'S FIRST DIRECTOR OF PUBLIC SAFETY, PROVIDING EXECUTIVE SUPPORT TO THE POLICE, FIRE AND EMERGENCY MANAGEMENT DEPARTMENTS. AND WHEREAS, A MAN OF FAITH WITH AN EDUCATIONAL BACKGROUND AND THEOLOGY, AS WELL AS CRIMINOLOGY AND CRIMINAL JUSTICE, MR. CONLEY LEADS WITH THIS DISTINGUISHMENT CARE AND COMPASSION FOR ALL HE SERVES, WHETHER THEY BE MCKINNEY LAW ENFORCEMENT PROFESSIONALS OR THE RESIDENTS OF OUR CITY. AS YOU KNOW, THE PLAN DESIGNATES THE AREA SUBURBAN LIVING PLACE TYPES WOULD SUPPORT A WIDE VARIETY OF SMALL SCALE RETAIL, DINING, AND SERVICE DESIGNS TO MEET THE DAILY NEEDS OF RESIDENTS IN THE AREA THAT'S NOW UNDEVELOPED. THESE USES ARE INTENDED TO BE CONCENTRATED ALONG THE MAJOR CORRIDORS, AND I BELIEVE THAT THIS FITS WELL WITH THE DESIGNATION AND THE PROJECT IT ALSO OFFERS. IT WOULD OFFER A CONVENIENT AND NEARBY OPTION FOR PARKING OF RVS WITHOUT ENCROACHING ON RESIDENTIAL PROPERTIES. THE SITE ALSO THE SITE UNDER CONSIDERATION, IS ALSO ADJACENT TO AN AREA DESIGNATED AS COMMERCIAL CENTER. CURRENTLY, BY ORDINANCE, THE TWO EMERGENCY OVERNIGHT WARMING SHELTERS IN MCKINNEY, THE OTHER BEING FIRST UNITED METHODIST, HAVE A COMBINED OCCUPANT LOAD OF 80 PEOPLE, WHEREAS THE ESTIMATED THE ESTIMATED NUMBER OF HOMELESS IN OUR CITY IS MORE THAN TWICE THAT. SINCE THE FIRST BAPTIST CHURCH HAS THE FACILITIES TO SERVE MORE OF THOSE WHO DESPERATELY NEED WARMTH AND SHELTER IN COLD TEMPERATURES, THEY'RE ASKING FOR YOUR PERMISSION TO DO SO. HOWEVER, IN 2017, AGAIN IN 2019, AS WELL AS RECENTLY IN 2023, THE STATE OF TEXAS HAS IMPLEMENTED VARIOUS LAWS THAT MAKE DEVELOPMENT UNPREDICTABLE WITHIN THE ETJ.

AND SO THEN ON OCTOBER 9TH OF 2023, THE CITY OF MCKINNEY PETITIONED THE PUBLIC UTILITY COMMISSION OF TEXAS TO PULL BACK THAT CCN BOUNDARY. AND WE'LL TALK A LITTLE BIT ABOUT WHAT THAT BOUNDARY IS HERE IN A SECOND. A COMPANION PIECE TO THAT IS ALSO THE TEMPORARY CESSATION ORDINANCE. AND SO THE PURPOSE OF THIS ORDINANCE, WHICH WAS APPROVED ON JUNE 25TH, WAS TO LIMIT THE WATER SERVICE EXPANSION. AND IT REALLY WAS TO GIVE TIME FOR THE PUC TO ACT ON THE CITY'S APPLICATION. AND THIS ORDINANCE IS VALID THROUGH JULY 1ST OF 2025. SO THE PROPOSED WATER CCN BOUNDARIES. AND SO THIS IS WHAT THE MAP IS. IT SHOWS WHERE OUR BOUNDARIES ARE ACCORDING TO OUR CURRENT PUC APPLICATION. ON THE RIGHT HAND SIDE, YOU CAN SEE THAT THE PROPOSED LAND THERE THAT'S SHOWN IN RED, WHICH IS THE DEVELOPMEN, THE PROPERTY IS LOCATED IN THE ETJ. IT IS ALSO LOCATED IN THE PROPOSED DE-CERTIFICATION AREA. AND THEN LASTLY, THE SITE DOES NOT HAVE WATER OR SEWER SERVICE TO THE SITE. HERE'S THE TIMELINE IN TERMS OF THE APPLICANT'S INTERACTION WITH THE CITY AS WELL AS THE CITY'S DENIAL. SO YOU CAN SEE IMPORTANT DATES HERE. ON SEPTEMBER 16TH, WE RECEIVED THE EXEMPTION APPLICATION FILED BY LUX LOCKER.

THAT APPLICATION WAS DENIED BY THE CITY. ON SEPTEMBER 30TH, THE APPLICANT FILED AN APPEAL ACCORDANCE WITH THE ORDINANCE ON OCTOBER 8TH. AND THEN CERTAINLY WE'RE HERE TONIGHT ON THIS APPEAL IS BEING CONSIDERED BY THE CITY COUNCIL. IN TERMS OF THE APPLICANT'S EXCEPTION APPLICATION. WHAT THEY HAVE STATED IS THAT THE EXCEPTION THEY ARE SEEKING IS FOR AN ONGOING PROJECT. SO HERE YOU CAN SEE THE LANGUAGE THAT'S WITHIN THE ORDINANCE. YOU CAN NOTE THE PART THAT'S UNDERLINED THAT A PROPERTY WHICH HAS RECEIVED ANY PLAN OR PERMIT APPROVAL FROM THE CITY PRIOR TO THE EFFECTIVE DATE OF THE ORDINANCE. SO OUR FACILITY ALMOST ESSENTIALLY WOULD WOULD IT WOULD UTILIZE LESS THAN HALF OF WHAT A STANDARD FAMILY SINGLE RESIDENCE USE, BECAUSE WE'RE BUILDING EVEN LESS UNITS HERE. 92 IS THE COUNT. IN ADDITION TO OUR OTHER PRE-DEVELOPMENT ACTIVITIES, WE REQUESTED A PERMIT TO CONSTRUCT ACCESS DRIVEWAY FACILITIES ON THE HIGHWAY RIGHT OF WAY ON APRIL 8TH, 24 FROM THE TEXAS DEPARTMENT OF TRANSPORTATION. WE RECEIVED THIS PERMIT APPROVAL ON JULY 17TH, 2024. LUX LOCKER IS ESPECIALLY DILIGENT ABOUT OBTAINING ALL NECESSARY PROJECT APPROVALS PRIOR TO CLOSING ON THE PROPERTY, AND THE REASON IS THIS IT'S CRITICAL FOR US TO BE ABLE TO REALISTICALLY PRESENT TO INVESTORS. THESE ARE SHOVEL READY PROJECTS. WE DON'T MAKE HALF PROMISES AND GO IN HALF COCKED AND THEN NOT BE ABLE TO DELIVER.
