TODAY, THOUGH, AT THE MCKINNEY POLICE DEPARTMENT, WE HAVE A MOTTO.

IT'S PRETTY SIMPLE, BUT IT JUST SAYS DO THE RIGHT THING, DO THE BEST YOU CAN DO, AND TREAT OTHERS THE WAY YOU WOULD WANT TO BE TREATED. AND TODAY, I GET TO TELL YOU TWO BRIEF STORIES THAT I THINK JUST EXEMPLIFY THAT MOTTO. AND WE WILL START WITH SERGEANT TINA MELLIFONT.

SERGEANT TINA MELLIFONT HAS DEMONSTRATED EXEMPLARY DEDICATION, TENACITY AND INVESTIGATIVE EXCELLENCE IN NEARLY A YEAR LONG INVESTIGATION INTO A COMPLEX FINANCIAL ABUSE SCHEME. ALONG WITH HER OTHER DUTIES, SHE SPEARHEADED THIS INVESTIGATION WITH PROFESSIONALISM AND PERSISTENCE AND DEDICATED HUNDREDS OF MAN HOURS TO UNCOVER A SOPHISTICATED TRAIL OF FRAUDULENT ACTIVITY TARGETING OLDER MCKINNEY RESIDENTS. THE SCAM INVOLVED APPROACHING ELDERLY PERSONS TO INSTALL A CHEAP VIDEO SECURITY SYSTEM VALUED AT ABOUT 1000, OR IT CAUSED THEM, OR IT'S VALUED AT ABOUT $1,000, BUT THEY WOULD CHARGE THEM UP TO $10,000. BUT WHILE OBTAINING THE ELECTRONIC SIGNATURE FOR THE WORK, THEY WOULD BE USING THE VICTIM'S IP ADDRESS, AND THE SUSPECTS WOULD THEN TAKE OUT A HOME IMPROVEMENT LOAN FOR THE WORK. USING THE VICTIM'S COPIED ELECTRONIC SIGNATURE. SO NOT ONLY WERE THEY ON THE HOOK FOR A $10,000 VIDEO SYSTEM, THAT WAS ONLY WORTH A THOUSAND. THEY ALSO HAD A $32,000 LOAN TAKEN OUT IN THEIR NAME. HER INVESTIGATION INCLUDED TRACKING DOWN NUMEROUS SHELL COMPANIES AND OBTAINING COURT ORDERS FOR NUMEROUS BANKING AND ONLINE ACCOUNTS, AND THIS LED TO THE KNOWLEDGE THAT THIS HAD BEEN A WIDESPREAD ELDERLY SCAM CROSSING MULTIPLE JURISDICTIONS THROUGHOUT THE STATE. THE INVESTIGATION OF THE MCKINNEY VICTIMS LED TO THE ARREST OF THREE KEY SUSPECTS RESPONSIBLE FOR ORCHESTRATING THE SCHEME, AND THIS OPERATION IS NOT ONLY BEING BROUGHT TO JUSTICE FOR THE CITIZENS OF MCKINNEY, BUT IT IS NOW SHED LIGHT ONTO THE SCAM FOR THE HUNDREDS OF OTHER TEXAS RESIDENTS AND OTHER JURISDICTIONS WHO WERE TOLD THAT THEIR PLIGHT WAS SIMPLY A CIVIL MATTER. SERGEANT MALLON FONTS EFFORTS EXEMPLIFY THE HIGHEST STANDARDS OF LAW ENFORCEMENT AND PUBLIC SERVICE, AND HER UNWAVERING COMMITMENT TO JUSTICE AND ADVOCACY FOR THE VICTIMS REFLECT GREAT CREDIT UPON HER, THE DEPARTMENT, AND THE GREATER LAW ENFORCEMENT COMMUNITY. SO I'LL BE PRESENTING HER WITH THE CHIEF'S CHALLENGE COIN. I ALSO GET TO RECOGNIZE THREE OTHER EMPLOYEES.

OFFICER DAMON BARNETT, WHO IS ACTUALLY STILL A IN TRAINING. HIS FIELD TRAINING OFFICER, JACKSON WATTS, AND DISPATCH COMMUNICATION SUPERVISOR CAITLIN GEISMAN. ON AUGUST 7TH OF THIS YEAR, AT APPROXIMATELY 730, WE RESPONDED TO A CALL FOR SERVICE REGARDING A FOUR YEAR OLD CHILD FOUND ALONE AT WINIFRED PARK. OFFICER BARNETT AND HIS FTO OFFICER WHITES WERE DISPATCHED TO THE SCENE AND AFTER AN UNSUCCESSFUL ATTEMPT TO LOCATE A GUARDIAN, THE OFFICERS TOOK THE CHILD INTO THEIR CUSTODY AND TRANSPORTED HIM TO THE MCKINNEY POLICE DEPARTMENT. OFFICER BARNETT, WHO IS VERY NEW BUT ALSO THE PARENT OF A YOUNG CHILD WITH AUTISM, QUICKLY RECOGNIZED THAT THE CHILD WAS NONVERBAL AND AUTISTIC, LEVERAGING HIS PERSONAL EXPERIENCE AND DEEP EMPATHY, HE WAS ABLE TO ESTABLISH A CALMING CONNECTION WITH THE CHILD, SOMETHING NO ONE ELSE HAD BEEN ABLE TO DO UP UNTIL THAT POINT. HIS ABILITY TO UNDERSTAND THE CHILD'S NEED AND RESPOND WITH PATIENCE AND COMPASSION MADE A SIGNIFICANT DIFFERENCE IN HELPING THE CHILD REMAIN CALM DURING THIS INCREDIBLY DISTRESSING SITUATION. WHILE OFFICER BARNETT COMMUNICATED WITH CHILD PROTECTIVE SERVICES TO COORDINATE FUTURE CARE, DISPATCHER CAITLIN GEISSMANN, DISPATCH SUPERVISOR CAITLIN GEISMAN WENT ABOVE AND BEYOND HER DUTIES BY PERSONALLY BRINGING A SPARE DIAPER TO THE ROOM. SHE CHANGED THE CHILD AND STAYED WITH HIM TO HELP HIM REMAIN CALM, PROVIDING COMFORT AND HELPING TO RELAX HIM WITH THE NECESSARY ARRANGEMENTS THAT WERE BEING MADE SEPARATELY. CPS ARRIVED AFTER ABOUT 4.5 HOURS, SO WE WERE THE CARETAKERS OF THIS CHILD FOR QUITE SOME TIME AND TOOK TOOK THE CHILD. THE INDIVIDUALS RESPONSIBLE FOR THE CHILD'S CARE WERE SUBSEQUENTLY TAKEN INTO CUSTODY. BOTH OFFICER BARNETT AND FTO OFFICER WATTS AND DISPATCH SUPERVISOR GEISSMAN DEMONSTRATED EXCEPTIONAL PASSION, PROFESSIONALISM, EMPATHY AND KINDNESS DURING THIS ENTIRE INCIDENT, SO THEY WILL ALSO BE PRESENTED WITH THE CHIEF'S

TO UPDATE YOU TODAY ON THE MUNICIPAL COURT. BEFORE I GET STARTED, I WOULD LIKE TO RECOGNIZE OUR MUNICIPAL COURT TEAM. WE HAVE AN OUTSTANDING DEDICATED TEAM, OUR COURT CLERKS, OUR COURT SUPERVISORS, COURT ADMINISTRATOR, ASSOCIATE JUDGES, JUVENILE CASE MANAGER, MARSHALS ALL DO AN OUTSTANDING JOB. THEY ARE PROFESSIONAL, COURTEOUS, COLLABORATIVE. THEY ARE OUTSTANDING. FOR OVER 25 YEARS, I HAVE SERVED AS A JUDGE IN VARYING CAPACITIES AS A MAGISTRATE FOR THE FELONY DISTRICT COURTS. SO WHAT I'M GOING TO DO IS TALK TO YOU ABOUT WHAT MUNICIPAL COURTS DO, WHAT THE JUDGE'S ROLE IS, AS IN CONTRAST TO WHAT PROSECUTORS DO, AND THEN WHAT WE HAVE GOING ON IN THE MCKINNEY MUNICIPAL COURT. SO I AM GOING TO CONDENSE THAT DOWN TO MOST FREQUENTLY ASKED QUESTIONS THAT WE GET TO KEEP THAT SNAPPY AND INTERESTING. SO NUMBER ONE, PEOPLE ASK, WHAT DO MUNICIPAL COURTS DO? HOW ARE THEY DIFFERENT FROM OTHER COURTS? SO MUNICIPAL COURTS HAVE JURISDICTION OVER CLASS C MISDEMEANORS. THEY ARE PUNISHABLE BY A FINE ONLY. THEY ARE NOT PUNISHABLE BY JAIL TIME. THE TYPES OF CASES THAT WE HANDLE, OBVIOUSLY MOST PEOPLE THINK OF TRAFFIC OFFENSES. WE DO HANDLE TRAFFIC OFFENSES. THAT IS THE BULK OF OUR

BUT WE ALSO HANDLE CASES INVOLVING THEFTS, ASSAULTS, PUBLIC INTOXICATION, DISORDERLY CONDUCT, CRIMINAL MISCHIEF, WHICH IS PROPERTY DAMAGE, CASES UNDER AGE, ALCOHOL AND TOBACCO VIOLATIONS, DOG ATTACK CASES, DISPOSITIONS OF CRUELLY TREATED ANIMALS, CLASS C MISDEMEANORS INVOLVING JUVENILES. SO WE DO HAVE A WIDE VARIETY OF CASES THAT WE DEAL WITH IN MUNICIPAL COURT. WHAT WE DO, ALL MEMBERS OF THE COURT STAFF IN THE JUDICIAL BRANCH, WE APPLY THE LAW TO THE CASES. SO IT'S WHERE THE RUBBER HITS THE ROAD IN TERMS OF LAW. SO WE TAKE THE LAWS THAT ARE ENACTED BY LEGISLATIVE BODIES, CITY COUNCILS, STATE LEGISLATURE, AND APPLY THOSE TWO CASES THAT ARE FILED IN OUR COURTS. AND THERE HAVE BEEN SOME SHIFTS THAT OCCUR IN THE LAW SINCE 2017. NOTICE REQUIREMENTS HAVE INCREASED HEARING REQUIREMENTS IN MUNICIPAL COURTS. MUNICIPAL COURTS ARE REQUIRED TO CONSIDER ALTERNATE MEANS OF SATISFYING CASE BALANCES. APPLYING JAIL CREDIT TO CASES. THERE HAVE BEEN A LOT OF CHANGES IN THE WAY MUNICIPAL COURTS HANDLE JUVENILE CASES. YOUTH DIVERSION PLANS. WE'RE VERY EXCITED ABOUT OUR YOUTH DIVERSION PLAN, AND I'LL TALK TO YOU ABOUT THAT IN A FEW MINUTES. COMMUNITY SERVICE ELECTION FOR JUVENILE CASES IN NOT THE MOST RECENT LEGISLATIVE SESSION, BUT IN 2023, THE LEGISLATURE MADE A CHANGE WHERE JUVENILES CHARGED WITH OFFENSES, INCLUDING TRAFFIC VIOLATIONS, HAVE THE OPTION TO EITHER PAY THEIR CASE BALANCE OR PERFORM COMMUNITY SERVICE TO SATISFY THE CASE BALANCE. AND SO OUR COURT HAS PIVOTED TO ADDRESS THAT CHANGE IN THE LAW. THE TREND OF ALL OF THESE CASES, THE INTENTION IS TO RESOLVE CASES BEFORE THE THE WARRANT PHASE. SO THOSE ARE PREVENTATIVE MEASURES. THE NOTICES, THE HEARING REQUIREMENTS AND ALSO RECONSIDERATION OF THOSE CASES. THERE ARE A LOT OF HEARING OPPORTUNITIES BEFORE CASES REACH THAT WARRANT STATUS. ANOTHER QUESTION THAT WE GET ASKED OFTEN, WHERE THERE SOMETIMES IS SOME CLARIFICATION NEEDED, IS THE ROLE OF THE JUDGE. PEOPLE COME TO MUNICIPAL COURT WITH THE EXPECTATION THAT IF THE JUDGE HEARS WHAT THE SITUATION IS, THE JUDGE CAN DISMISS THE CASE. HOWEVER, IN TEXAS CRIMINAL COURTS GENERALLY, JUDGES DO NOT HAVE THE POWER OF DISMISSAL. THAT IS A PROSECUTORIAL FUNCTION. SO JUST TO ADDRESS WHAT JUDGES DO, JUDGES PRESIDE OVER JURY TRIALS, BENCH TRIALS, COURT HEARINGS.

WE RENDER JUDGMENTS RULE ON VARIOUS LEGAL ISSUES IN COURT, EVIDENTIARY ISSUES, GRANT AND REVOKE DEFERRED DISPOSITION THAT IS A TYPE OF PROBATION AVAILABLE IN MUNICIPAL COURT.

IF SOMEONE SUCCESSFULLY COMPLETES THAT PROBATION, THEN THEY ARE ENTITLED TO HAVE THEIR CASES DISMISSED. THE ROLE OF THE PRESIDING JUDGE IS RESPONSIBLE FOR ESTABLISHING THE COURT'S SECURITY COMMITTEE. WE HAVE HAD THAT COURT SECURITY COMMITTEE ESTABLISHED FOR SOME TIME. IN THE MOST RECENT LEGISLATIVE SPECIAL SESSION, THERE IS THE ADDITIONAL REQUIREMENT TO DEVELOP THE EMERGENCY MANAGEMENT PLAN, AND THAT WILL BE A PART OF OUR STRATEGIC PRIORITY COMING UP IN THE NEXT YEAR. THE JUDGE'S ROLE IS IN CONTRAST TO THE PROSECUTOR'S ROLE PROSECUTORS FILE CASES IN THE COURT. THEY PLEA BARGAIN CASES, THEY CAN AMEND OR CHANGE CASES. THEY HAVE THE POWER TO DISMISS CASES IF CASES MEET THOSE CRITERIA.

TRIAL PRESENTATION THAT IS A PROSECUTORIAL FUNCTION. PROSECUTORS CAN ADVISE THE POLICE. OUR UNITED STATES COURT SYSTEM IS AN ADVERSARIAL SYSTEM. IT IS ONE PARTY VERSUS ANOTHER PARTY. IN CRIMINAL CASES, IT IS THE STATE VERSUS AN ACCUSED PERSON. PROSECUTORS HAVE AN ADDITIONAL DUTY TO SEE THAT JUSTICE IS DONE. SO IT'S NOT JUST PROSECUTING CASES TO THE FULLEST EXTENT OF THE LAW, REGARDLESS OF WHAT THE JUST AND RIGHT THING TO DO IN THE CASE IS. SO PROSECUTORS DO HAVE THAT ADDITIONAL DUTY INITIATIVES THAT WE ARE TAKING IN THE MUNICIPAL COURT INCLUDE THE YOUTH DIVERSION PROGRAM, THAT IS A PROGRAM THAT HAS ALREADY BEEN AVAILABLE TO JUVENILES FOR HIGHER OFFENSES, FELONY CASES AND HIGHER MISDEMEANOR CASES.

THE LEGISLATURE HAS EXPANDED THE AVAILABILITY OF THOSE YOUTH DIVERSION PROGRAMS TO INCLUDE MUNICIPAL COURTS. ALL MUNICIPAL COURTS IN THE STATE OF TEXAS WERE REQUIRED TO ADOPT YOUTH DIVERSION PLANS EFFECTIVE JANUARY 1ST, 2025. WE HAVE ADOPTED OUR PLAN, OUR PLACE, OR OUR PLAN WAS IN PLACE BY THAT EFFECTIVE DATE AND WE'RE VERY EXCITED ABOUT OUR YOUTH DIVERSION PLAN IN MCKINNEY. WE HAVE A JUDICIAL DIVERSION PLAN, THE GOAL OF WHICH IS TO REDUCE RECIDIVISM, HOLD YOUTH ACCOUNTABLE FOR THEIR ACTIONS, BUT ALSO ADDRESS THE ROOT CAUSES UNDERLYING THOSE BEHAVIORS. HOW DO WE DO THAT? WE HAVE A DEDICATED JUVENILE CASE MANAGER, ADRIANA PETRILLO, VERY TALENTED IN ASSESSING JUVENILES CASES. SHE LOOKS AT WHAT THE NEEDS OF THE CHILD ARE. DO THEY HAVE SPECIAL NEEDS? ARE THEY RECEIVING COUNSELING? DO THEY HAVE FAMILY SUPPORT TO SUPPORT THEIR PROGRESS IN THE PROGRAM? AND SHE DESIGNS A PROGRAM CUSTOMIZED TO THAT CHILD. SHE CAN USE EVIDENCE BASED SPECIALIZED COURSES THAT PROMOTE COPING SKILLS, ANGER MANAGEMENT, SUBSTANCE ABUSE PREVENTION, TOBACCO AWARENESS.

SO ALL OF THESE ARE AVAILABLE AS PART OF THAT PROGRAM. IN ADDITION, SHE CAN ALSO RECOMMEND COMMUNITY SERVICE AND TUTORING. SO THOSE ARE WE'RE VERY EXCITED ABOUT THOSE PROGRAMS. WE HAVE COMPLETED A WEBSITE REDESIGN. MOST BUSINESSES AND ORGANIZATIONS ARE SEEING A SHIFT TO ONLINE ACTIVITY. PEOPLE LOOKING TO TAKE CARE OF THEIR BUSINESS ONLINE. SO WE HAVE MADE MONUMENTAL CHANGES IN OUR WEBSITE TO ADDRESS THAT NEED AND CONNECT PEOPLE WITH THE INFORMATION AND OPTIONS THAT THEY ARE LOOKING FOR. ANOTHER HOT LEGAL TREND IS EXPUNCTION HEARINGS. WHAT THAT IS WHEN PEOPLE HAVE CASES THAT MEET THE REQUIREMENTS, THEY'RE VERY INTERESTED IN HAVING THEIR COURT RECORDS EXPUNGED. THAT IS A COMPLEX AREA. THERE ARE A LOT OF DIFFERENT TYPES OF EXPUNCTION DEPENDING ON HOW THE CASE IS RESOLVED, WHETHER IT'S AN ACQUITTAL, WHETHER THERE IS A DEFERRED PROBATION THAT IS DISMISSED, WHETHER THE CASE INVOLVES A JUVENILE OFFENSE OR AN UNDERAGE ALCOHOL OR TOBACCO VIOLATION. SO IT'S A VERY COMPLEX AREA. AND OFTEN ATTORNEYS, IT'S DIFFICULT FOR THEM TO KEEP ON TOP OF THE LEGAL REQUIREMENTS. WITH THAT, OUR COURT HAS DEVELOPED SPECIALIZED PROCESSES AND DOCUMENTS TO STREAMLINE THAT PROCESS. SO THAT IS A BIG ACHIEVEMENT THAT WE HAVE WORKED ON. AND THE REASON WHY I SAY THAT IS A HOT LEGAL TREND FOR THE PAST LEGISLATIVE SESSIONS, FOR AT LEAST THE PAST THREE LEGISLATIVE SESSIONS, INCLUDING THIS SUMMER, THERE HAVE BEEN CHANGES TO THE EXPUNCTION PROCESS. SO IT IS A VERY FLUID PROCESS TO A COMPLEX AREA. AND SO OUR COURT HAS TAKEN STEPS TO STREAMLINE THAT PROCESS. WE HAVE DEVELOPED A COMMUNITY SERVICE TEAM. AS I MENTIONED EARLIER, JUVENILES NOW HAVE THE OPTION TO ELECT COMMUNITY SERVICE. SO OUR TEAM HAS PIVOTED TO ACCOMMODATE THAT CHANGE IN THE LAW. SO WE HAVE A DEDICATED COMMUNITY SERVICE TEAM THAT HAS DEVELOPED COMMUNITY SERVICE RESOURCES IN THE COMMUNITY, AS WELL AS LIAISONS TO EFFICIENTLY TRACK THE COMPLETION OF THOSE COMMUNITY SERVICE REQUIREMENTS. THE NEXT THING THAT WE ARE WORKING ON, STREAMLINING DEDICATED DOCKETS. SO THE MUNICIPAL COURT HAS OPEN DOCKETS, BUT WE ALSO HAVE DEDICATED DOCKETS FOR JURY TRIALS, PRETRIAL HEARINGS, PREJUDGMENT HEARINGS LIKE SHOW CAUSE HEARINGS, PRE WARRANT HEARINGS LIKE PRE K AND RECONSIDERATION HEARINGS. ALL OF THOSE CASE TYPES HAVE CERTAIN CHARACTERISTICS IN COMMON COMMON DOCUMENTS THAT THEY USE. SO IT'S VERY EFFICIENT TO HAVE THOSE DEDICATED DOCKETS HANDLE THOSE TYPES OF CASES. ANOTHER THING THAT WE HAVE WORKED ON IN THE COURT, A ROBUST CASE RESOLUTION SYSTEM, COURT APPEARANCE NOTICES, TEXT REMINDERS, ADDRESS VERIFICATION, PHONE COMMUNICATIONS. WE ARE INTERESTED IN COMPRESSING THE TIME THAT IT TAKES TO RESOLVE CASES. SO THAT'S EFFICIENT FOR THE COURT. IT'S BEST FOR THE COMMUNITY. COMMUNITY OUTREACH COURTS ARE AN OUTWARD FACING DEPARTMENT, AND IT JUST HELPS OUR PRESENCE IN THE COMMUNITY TO EDUCATE PEOPLE ABOUT THE JUSTICE SYSTEM. WHAT'S NEXT FOR THE COURT? WE WILL CONTINUE TO ACCOMMODATE VOLUME. POPULATION OF MCKINNEY IS GROWING. TRAFFIC THROUGH MCKINNEY IS GROWING. SO A LOT OF DEVELOPMENT NOT JUST IN MCKINNEY, BUT IN THE SURROUNDING COMMUNITIES. SO WE ARE WORKING WITH OUR COURT PROCEDURES AND DOCUMENTS TO ACCOMMODATE THAT VOLUME, AS WELL AS RETAINING LEGAL ACCURACY. AND SO THAT IS SOMETHING THAT WE HAVE BEEN DOING. WE WILL CONTINUE TO DO THAT, DEVELOP DESIGN REQUESTS FOR A NEW COURT FACILITY. AT SOME POINT, A NEW COURT FACILITY MAY BE ON THE HORIZON AS WE GROW, AND WE ARE TAKING THIS OPPORTUNITY TO ASSESS WHAT DESIGN REQUIREMENTS WILL BE NEEDED THAT ARE PARTICULAR TO A COURT FACILITY, SUCH AS JURY DELIBERATION ROOMS, A JUVENILE CASE MANAGER MEETING AREA, AND COURTROOMS DESIGNED WITH SECURITY NEEDS IN MIND. THAT BRINGS ME TO THE LAST SUBJECT COURT SECURITY INITIATIVE. AS I MENTIONED EARLIER, IT WAS PART OF THIS PAST SPECIAL LEGISLATIVE SESSION THAT COURTS MAKE CHANGES TO COURT SECURITY COMMITTEES. WE ALREADY HAD A COURT SECURITY INITIATIVE STARTED. MOST PEOPLE, WHEN THEY THINK OF SECURITY, THEY THINK OF PHYSICAL SECURITY, LOCKED DOORS, LOCKED WINDOWS, CAMERAS, THINGS OF THAT NATURE. WE ARE LEVELING UP WITH THAT. WE ARE EXPANDING IT TO DISASTER PREPAREDNESS. IF WE HAVE A FLOOD, A POWER OUTAGE, TORNADO. HOW CAN WE RETAIN OPERATIONAL AND FUNCTIONALITY IN OUR COURT? AND SO WE ARE ENVISIONING DIFFERENT SCENARIOS AND TAKING STEPS TO ENSURE FUNCTIONALITY IN THE EVENT OF VARIOUS DISASTERS. AND THEY OVERSEE OUR JUVENILE DIVERSION PROGRAM, WHICH JUDGE CARLSON MENTIONED EARLIER. GO BACK ONE MOMENT. SO OUR ENFORCEMENT DIVISION CONSISTS OF EIGHT MARSHALS. THERE'S THE CITY MARSHAL, TWO SENIOR MARSHALS AND THEN FIVE DEPUTY CITY MARSHALS. ALL RIGHT. SO A CRUCIAL MEASURE IN THE COURTS IS THE COURT'S CLEARANCE RATE, WHICH COMPARES THE NUMBER OF CASES RESOLVED TO THE NUMBER OF CASES FILED, FILED VERSUS DISPOSED. AND THEN THE CLEARANCE RATE FOR THIS FISCAL YEAR IS 110%, SO THAT ANYTHING UNDER 100% CONSISTENTLY WILL DEMONSTRATE A GROWING BACKLOG. SO WE'RE OVER 100, WELL OVER 100. SO THIS IS THIS IS A GOOD MEASURE THAT SHOWS US THAT OUR SYSTEMS THAT ARE IN PLACE ARE WORKING, AND THAT WE ARE MOVING CASES TIMELY. TIME TO CASE DISPOSITION. YOU'LL SEE FOUR QUARTERS HERE. HE EVALUATED THE FACILITY AND HIS INITIAL FEEDBACK WAS VERY COMPLIMENTARY IN COMPARISON TO SOME OF THE FEDERAL COURTS AND DISTRICT COURTS THAT HE IS EVALUATED, AND HE WILL PROVIDE A 90 DAY REPORT WITH ALL OF HIS ASSESSMENT AND ANY VULNERABILITIES THAT HE IDENTIFIED THAT WE CAN WORK ON, BUT DEFINITELY HIGH MARKS THAT WE'VE WE'VE PUT PRACTICES IN PLACE AND EQUIPMENT THAT WILL THAT MAKES US A VERY SAFE ENVIRONMENT. LET ME GET THE LIGHTS GOING, THE FIRST BEING THE FEEDBACK WE RECEIVED FROM OUR PUBLIC MEETING. ALTHOUGH THAT MAY SEEM LIKE A MOOT POINT GIVEN THE SECOND ITEM, WHICH IS THE LOSS OF FUNDING FOR THE PROJECT, WE STILL FEEL IT'S IMPORTANT TO PRESENT YOU WITH THE FEEDBACK THAT WE RECEIVED.

SO WE'LL START WITH THAT. THE PUBLIC MEETING WAS HELD JULY 30TH AT CITY HALL. OUR CONSULTANT, KIMLEY-HORN AND ASSOCIATES GAVE A PRESENTATION TO THE PUBLIC AND ALSO PROVIDED A LINK TO A PUBLIC SURVEY THAT WAS INTENDED TO SOLICIT COMMUNITY FEEDBACK FOR WHAT AMENITIES OF THE PROJECT WERE MOST IMPORTANT TO THE PUBLIC. THE KEY COMPONENTS BEING SAFETY AND SECURITY, AMENITIES, ACTIVITIES AND PROGRAMING. FOLLOWING THE PRESENTATION, CITY STAFF AND OUR CONSULTANT WERE AVAILABLE TO ANSWER QUESTIONS. WE ALSO HAD REPRESENTATIVES FROM TXDOT IN ATTENDANCE TO ANSWER QUESTIONS RELATED TO THEIR PORTION OF THE PROJECT. WE HAD A PRETTY GOOD TURNOUT. ABOUT 125 PEOPLE SHOWED UP IN PERSON, AND WE ENDED UP WITH 603 TOTAL RESPONSES TO THE ONLINE SURVEY. WON'T GO THROUGH THE ENTIRE LIST OF QUESTIONS AND ANSWERS IN THE SURVEY, BUT THIS IS A GENERAL SUMMARY. MORE THAN 75% OF THE RESPONDENTS WERE MCKINNEY RESIDENTS. MORE THAN 40% OF THE RESPONDENTS SAID THAT THEY WOULD VISIT LOWER FIVE PLAZA A FEW TIMES A MONTH, AND ON THE WEEKENDS. THE PUBLIC INDICATED THE OVERALL THEME OF THE PARK SHOULD INCORPORATE KID AND FAMILY ACTIVITIES,

INCLUDING PLAY ELEMENTS, MUSIC CONCERTS AND EVENTS WITH AMPHITHEATER SEATING AND STAGE, FLEXIBLE OPEN SPACE, ART SCULPTURES AND EDUCATIONAL ELEMENTS. THE FINAL QUESTION ON THE SURVEY WAS A FILL IN THE BLANK QUESTION, WITH OPPORTUNITY TO PROVIDE ADDITIONAL FEEDBACK. OVER A THIRD OF THE RESPONDENTS DID PROVIDE ADDITIONAL COMMENTS OF THOSE WHO DID RESPOND TO THE ADDITIONAL COMMENTS, ALMOST 30% EXPRESSED EXPRESS OPPOSITION TO THE PROJECT AND 15% VOICED CONCERNS OVER HOMELESSNESS AND SAFETY. ALMOST HALF OF THE RESPONDENTS RANKED SAFETY AND SECURITY AS A PRIORITY PARK FEATURE. NOW ON TO PROBABLY THE BIGGER ISSUE, WHICH IS THE PROJECT FUNDING UPDATE OF THE $45 MILLION OF TOTAL FUNDING FOR THE PROJECT, 22.65 MILLION WAS. NORTH COUNCIL, TEXAS COUNCIL OF GOVERNMENT FUNDING, OR COG FUNDING. 15 MILLION WAS FEDERAL FUNDING THROUGH THE RECONNECTING COMMUNITIES AND NEIGHBORHOODS GRANT, AND 4 MILLION WAS TXDOT FUNDING, AND 3.35 WAS LOCAL CITY FUNDING.

THE $15 MILLION RECONNECTING COMMUNITIES GRANT WAS RESCINDED BY US DEPARTMENT OF TRANSPORTATION. OF THE 45 MILLION, 13.8 MILLION OF THE FUNDING WAS FOR TXDOT PORTION OF THE PROJECT, WHICH IS ESSENTIALLY THE ENGINEERING CONSTRUCTION OF THE BRIDGE AND THE REMAINING $31.2 MILLION WAS CITY FUNDING FOR DESIGN AND CONSTRUCTION OF THE PLAZA, INFRASTRUCTURE AND AMENITIES, AND ASSOCIATED UTILITIES AND DRAINAGE IMPROVEMENTS. SO, WITH THE LOSS OF THE $15 MILLION OF FEDERAL FUNDING, STAFF'S RECOMMENDATION IS TO STOP WORK ON LOWER FIVE PLAZA PROJECT AND REDIRECT EFFORTS TO REDIRECT THE REMAINING $22.65 MILLION OF FUNDING TO OTHER IMPROVEMENTS ON THE HIGHWAY FIVE CORRIDOR. THIS INCLUDES MODIFYING THE SCOPE TO INCLUDE ENHANCED GRADE CROSSING IMPROVEMENTS AT VIRGINIA AND LOUISIANA. AND THIS WOULD BE SIMILAR TO ONE OF THE THREE ALTERNATIVES ORIGINALLY PRESENTED BACK IN JULY OF 2022. AND THEN TO PROVIDE ADDITIONAL PEDESTRIAN CROSSING IMPROVEMENTS, WHICH IS RAPID RECTANGULAR FLASHING BEACON PEDESTRIAN CROSSINGS AT EIGHT LOCATIONS AND OTHER PLANNED IMPROVEMENTS ALONG THE HIGHWAY FIVE CORRIDOR. SO THE CITY'S IMPROVEMENT COSTS OUTSIDE OF TEXAS, $56 MILLION OF IMPROVEMENTS INCLUDE STREET LIGHTING, TURN LANES, DRAINAGE IMPROVEMENTS, NOISE WALL ESTHETICS, AND THE ENHANCED AT GRADE CROSSING IMPROVEMENTS AT VIRGINIA AND LOUISIANA AND THE ADDITIONAL PEDESTRIAN CROSSINGS. OF THOSE. THE FIRST FOUR ARE ELEMENTS THAT THE CITY HAS ALREADY WORKED WITH TXDOT TO GET INCORPORATED INTO TXDOT'S PLANS, SO THE ONLY CHANGE WITH THOSE IS WE'RE GOING TO PURSUE CDBG FUNDING FOR THOSE INSTEAD OF FUNDING THEM WITH CITY FUNDS. THE LAST TWO, THE ENHANCE AT GRADE CROSSING IMPROVEMENTS AND THE ADDITIONAL PEDESTRIAN CROSSINGS ARE ELEMENTS THAT WE WOULD NEED TO WORK WITH TXDOT TO GET THOSE INCORPORATED INTO TEXT DOT'S PLANS. AND WE WOULD ALSO APPLY TO COG TO GET FUNDING FOR THOSE. SO THAT'S A TOTAL OF A LITTLE OVER $12 MILLION OF IMPROVEMENTS. THAT WOULD HAVE BEEN CITY COSTS THAT WE ARE GOING TO APPLY FOR CDBG FUNDING.
