INFORMS PEOPLE THAT IT IS THE BASIS OF OUR GREAT HERITAGE AND THE FOUNDATION OF OUR WAY OF LIFE, AND ENCOURAGES THE STUDY OF THE HISTORICAL EVENTS WHICH LED TO THE FRAMING OF THE CONSTITUTION. THAT BUILD COHESIVE FAMILIES AND COMMUNITIES. FOR MOST OF US, THIS SENSE OF COMMUNITY IS NURTURED AND EXPRESSED IN OUR NEIGHBORHOODS, WHERE WE ALLOW EACH OTHER TO SHARE AND FEEL PART OF OUR LARGER FAMILY. THE CITY OF MCKINNEY RECOGNIZES THE IMPORTANCE OF FOSTERING COMPASSION AND RESPECT IN OURSELVES AND FOR OUR NEIGHBORS. IN 2024, 121 HOME FIRE FATALITIES WERE REPORTED IN TEXAS, ACCORDING TO FEMA. MODERN HOMES ARE OFTEN CONSTRUCTED WITH LIGHTWEIGHT MATERIALS THAT BURN FASTER THAN OLDER HOME CONSTRUCTIONS, AND MANY OF TODAY'S FURNISHINGS AND HOUSEHOLD ITEMS PRODUCE TOXIC GASES AND SMOKE WHEN BURNED, MAKING IT NEARLY IMPOSSIBLE TO SEE AND BREATHE. WITHIN MOMENTS, MCKINNEY'S FIRST RESPONDERS ARE DEDICATED TO REDUCING THE OCCURRENCE OF HOME FIRES AND HOME FIRE INJURIES THROUGH PREVENTION, PREPAREDNESS, AND PUBLIC EDUCATION, AND THEY SUPPORT THE 2025 FIRE PREVENTION WEEK THEME CHARGE INTO FIRE SAFETY, WHICH REMINDS EVERYONE TO BUY, CHARGE AND RECYCLE LITHIUM ION BATTERIES SAFELY TO REDUCE FIRE RISK. MANY OF OUR FIREFIGHTERS HAVE GROWN UP AND HAVE SEEN CLOWNS AT SOME POINT. WE'RE ALSO VERY BLESSED BECAUSE SOME OF OUR SURROUNDING CITIES HAVE UNFORTUNATELY CUT THEIR CLOWN PROGRAMS. THAT'S THAT'S WHERE WE SAID THAT'S NOT HAPPENING HERE IN MCKINNEY. WE EMBRACE IT AND WE MAKE SURE THAT WE LEAN INTO IT. HOMELESSNESS IS A SITUATION THAT AFFECTS ALL OF US. THE PROBLEM IS, MOST OF THE SOLUTIONS FOCUS ON THE SYMPTOMS AT A MANUAL LABOR. OUR FOCUS IS ON THE ROOT CAUSE OF HOMELESSNESS, RADICALLY REDUCING THE AMOUNT OF TIME A PERSON STRUGGLES AND THE AMOUNT OF MONEY BEING WASTED. AND THE ROOT CAUSE OF ALL HOMELESSNESS IS A BREAKDOWN OF NUCLEAR RELATIONSHIPS. IT'S NOT A LACK OF ACQUAINTANCES, BUT IT'S FEELING LIKE YOU HAVE NO ONE YOU CAN TURN TO AT 2 A.M. THESE ORDINANCES THAT WE'RE TALKING ABOUT TONIGHT ARE FOCUSED ON THE SYMPTOMS. THEY WILL NOT RADICALLY REDUCE THE AMOUNT OF TIME A PERSON EXPERIENCES HOMELESSNESS, OR THE AMOUNT OF MONEY BEING WASTED. NOT TOO LONG AGO, A FEW YEARS, I DID A LITTLE BIT OF BASIC RESEARCH JUST ON THE COST OF HOMELESSNESS IN OUR NATION. FOR EVERY ONE PERSON THAT IS HOMELESS, THE COST TO THE TAXPAYER AT THAT TIME WAS ABOUT FIVE YEARS AGO. NOW, AT THE TIME, IT'S $35,000 A YEAR PER PERSON, AND AT THAT TIME, THERE WAS AN ESTIMATED OVER 500,000 PEOPLE EXPERIENCING HOMELESSNESS. ON ANY GIVEN NIGHT, THAT MULTIPLIES OUT TO $17.5 BILLION A YEAR SPENT ON HOMELESSNESS. AND MOST OF THAT COST IS SECONDARY COST. POLICE CALLS, AMBULANCE CALLS, OTHER CALLS, ORDINANCES. EVEN NOW, I'M BELIEVING THAT MOST OF YOU

ARE CHRIST FOLLOWERS. I'M ALSO BELIEVING THAT MOST OF YOU ARE POTTY TRAINED, JUST TRYING TO SEE WHO'S STILL PAYING ATTENTION. AND I WANT TO ACKNOWLEDGE THAT. I DON'T KNOW IF YOU'VE EVER THOUGHT ABOUT, BUT NEITHER OF THOSE THINGS ARE INTUITIVE. THEY HAD TO BE INTRODUCED TO YOU. THE CROSS HAD TO BE INTRODUCED TO YOU, POTTY HAD TO BE INTRODUCED TO YOU. IT HAD TO BE EXPLAINED TO YOU. IT HAD TO BE RE-EMPHASIZED WITH YOU. AND I'M GOING TO GUESS IF YOU'RE LIKE ME AND I HAVE A FOUR YEAR OLD, YOU DIDN'T GET IT IN A DAY. IT TOOK A PERIOD OF TIME. THESE ORDINANCES ARE DESIGNED TO CURB BEHAVIOR, TO CHANGE THE WAY PEOPLE BEHAVE, AND WE FEEL THAT PEOPLE OUGHT TO BEHAVE A CERTAIN WAY, BUT THEY'RE NOT.

SO WE FEEL COMPELLED TO WRITE AN ORDINANCE THAT WOULD CHANGE A BEHAVIOR. I'M NOT SAYING THAT THAT'S A BAD THING, BUT I AM SAYING IT'S PROBABLY BECAUSE IT'S NOT INTUITIVE. THE BACK STORY FOR MANY OF THE PEOPLE I SERVE IS A BROKEN HOME. IT'S AN ABSENT PARENT OR PARENTS, AND SOME OF THE THINGS THAT MANY OF US HAD THE BENEFIT OF BEING INTRODUCED TO WERE NEVER INTRODUCED. AND IT'S NOT THAT THEY DON'T WANT TO GET IT, IT WAS JUST NEVER BROUGHT UP TO THEM, NEVER RE-EMPHASIZED WITH THEM, NEVER SUPPORTED. MANY OF OUR FRIENDS HAVE NEVER BEEN TOLD THEY'RE LOVED. AND THAT'S WHY IT'S SO IMPORTANT THAT I TELL PEOPLE THAT I DON'T EVEN KNOW THAT I LOVE THEM. BECAUSE WHEN A PERSON KNOWS THAT THEY'RE LOVED, IT CHANGES THE WAY THEY OPERATE. SOMETIMES YOU SEE PEOPLE SITTING ON THE STREETS AND THEY LOOK CONTENT.

IT COULD BE BECAUSE THEY WERE TOLD THEY WERE LOVED THAT MORNING. I'M HOPING I'M THE ONE THAT TOLD THEM, BUT IT COULD BE YOU TOO. WE WANT TO SEE CHANGE. WE WANT TO SEE PEOPLE BE IN BETTER SITUATIONS. THE COMMON GROUND FOR ALL OF THIS IS THAT WE ALL WANT TO SEE FEWER PEOPLE STRUGGLING. THE PERSON EXPERIENCING HOMELESSNESS MAY WANT IT MORE THAN YOU, JUST AS MUCH AS YOU DON'T WANT TO SEE THEM THERE, THEY DON'T WANT TO BE THERE. AND IF THEY COULD HAVE GOTTEN OUT OF IT BY THEMSELVES, THEY WOULD HAVE. THERE ARE VERY FEW, VERY FEW THAT DON'T WANT TO BE IN A BETTER SITUATION. AND MOST OF IT IS BECAUSE IT WAS NEVER EXPLAINED TO THEM. IT WAS NEVER RE-EMPHASIZED WITH THEM. IT WAS NEVER TAUGHT TO THEM, TO THE CHRIST FOLLOWERS. JESUS TAUGHT US THAT WHATEVER WE DO, FOR THE LEAST, WE DO FOR HIM. AND HE GAVE US A LIST. AND IN THAT LIST, POSSIBLY THE MOST OVERLOOKED THING IS I WAS A STRANGER AND YOU WELCOMED ME. ONE OF THE HALLMARKS OF CHRISTIANITY IS NOT JUST LOVING THOSE WHO LOVE US BACK, BUT TO LOVE OUR ENEMIES AND TO LOVE OUR STRANGERS. BECAUSE WE DID HAVE A WORK SESSION. BUT JUST IN CASE THERE'S ANYBODY NEW LISTENING, I'LL GIVE A LITTLE BIT OF BACKGROUND. THE 89TH LEGISLATIVE SESSION DID ADOPT THREE PRIMARY BILLS THAT IMPACTED LAND USE AND ZONING. SO SB 840 PERTAINS TO MIXED USE AND MULTIFAMILY USES. AND SENATE BILL 15 PERTAINS TO SINGLE FAMILY USES AND IS ALSO REFERRED TO AS THE SMALL LOT BILL. BOTH OF THOSE BILLS ONLY APPLY TO CITIES IN TEXAS THAT ARE OVER 150,000 PEOPLE AND ARE IN A COUNTY OVER 300,000 PEOPLE, AND SO THAT IS NOT ACROSS ALL OF TEXAS. IT HITS ABOUT 19 CITIES TOTAL. I DO ALSO HAVE A BRIEF MENTION OF HOUSE BILL 24, WHICH MAINLY PERTAINS TO ZONING PROTEST PETITION PETITIONS. AS A QUICK NOTE, I WON'T DIVE INTO THIS IN THE PRESENTATION. THERE WERE TWO OTHER BILLS FROM THE LEGISLATIVE SESSION THAT WE DID INCORPORATE INTO THESE AMENDMENTS. THEY WERE FAIRLY MINOR IN SCALE, TALKING ABOUT HOME BASED BUSINESSES OR HOME OCCUPATIONS, AS WELL AS DWELLING UNIT OCCUPANCY CHANGES THAT WE'VE HAD TO MAKE MINOR AMENDMENTS TO. SO YOU MIGHT SEE SOME OTHER CHANGES IN THE CODE, BUT THOSE WERE WERE MINOR IN SCALE WHEN IT COMES TO ADAPTING TO STATE LAW CHANGES. STAFF WANTED TO MAKE RECOMMENDATIONS TO OUR UNIFIED DEVELOPMENT CODE IN ACCORDANCE WITH OUR COMPREHENSIVE PLAN. SO OUR COMPREHENSIVE PLAN IS OUR LAND USE POLICY DOCUMENT THAT'S ADOPTED BY COUNCIL AND IS BUILT OFF OF PUBLIC ENGAGEMENT. SO WHEN WE'RE TRYING TO UNDERSTAND HOW WE WANT TO ADAPT, WE LEANED ON TWO PIECES FROM THE COMP PLAN. WE REALLY WANTED TO FOCUS ON ESTABLISHING TRANSITION BETWEEN LAND USES TO THE EXTENT NOW POSSIBLE, AND WE WANTED TO RELY ON MAINTAINING THOSE EXPECTATIONS FOR EXCELLENCE IN DESIGN AND CONSTRUCTION.

STARTING WITH SENATE BILL 840. THERE ARE THREE MAIN COMPONENTS TO THIS BILL FOR THE LAND USE REGULATIONS. ESSENTIALLY, IT SAYS THAT THE MUNICIPALITY HAS TO ALLOW MULTI-FAMILY AND MIXED USE USES WHERE OFFICE, COMMERCIAL, RETAIL AND WAREHOUSE ARE ALLOWED, AND SO MULTI-FAMILY WOULD BE ALLOWED IN NONRESIDENTIAL ZONING DISTRICTS AND SEPARATELY APPLYING TO MULTIFAMILY AND MIXED USE USES AND ANY ZONING DISTRICT. THERE ARE LIMITS TO THE DEVELOPMENT STANDARDS THAT WE CAN REGULATE, SO WE HAVE TO ALLOW AT LEAST 36 DWELLING UNITS PER ACRE. THE BUILDING HAS TO BE AT LEAST 45FT TALL. AND THERE ARE A FEW OTHER PROVISIONS REGARDING SETBACKS. AND AS FAR AS PARKING GOES, WE CAN ONLY REQUIRE ONE PARKING SPACE PER DWELLING UNIT. SO THOSE FOUR CHANGES TO THE DEVELOPMENT STANDARDS WE WOULD BE REQUIRED TO COMPLY WITH ANOTHER PROVISION. THEY DO TALK ABOUT CONVERSIONS OF COMMERCIAL BUILDINGS, AND IT ALSO ALLOWS SOME CAVEATS FOR HEAVY INDUSTRIAL USES. SO ESSENTIALLY IF THERE IS A ZONING DISTRICT THAT ALLOWS A HEAVY INDUSTRIAL USE, AND WE ARE NOT OBLIGATED TO ALLOW MULTIFAMILY OR MIXED USE USES, THEIR HEAVY INDUSTRIAL USES HAS A REALLY SPECIFIC DEFINITION IN THE STATE LAW. SO IT'S NOT AN EASY TRANSLATION TO OUR HEAVY MANUFACTURING LAND USE. SO THERE'S SOME NUANCE THERE. WHEN IT COMES TO MAKING SPECIFIC CODE CHANGES. WE DECIDED TO APPROACH THIS FROM VIEWING THE BUILDING FORM AS MUCH AS WE ARE ALLOWED TO. AND SINCE WE ARE NOT ALLOWED TO REGULATE NECESSARILY WHERE THESE USES OCCUR, WE CAN START TO MAKE SURE THAT THEY ARE COMPATIBLE WITH THEIR SURROUNDING USES TO THE EXTENT POSSIBLE AS WELL AS, YOU KNOW, ALIGNING WITH THOSE COMMERCIAL USES THAT ARE ALLOWED IN THAT AREA. WE LEANED ON OUR TWO EXISTING MULTIFAMILY LAND USES, COTTAGE AND TRADITIONAL. SO THE COTTAGE PRODUCT HAS SOME DESIGN STANDARDS THAT REALLY FOCUS ON THE BUILDING FORM BEING A LITTLE BIT SMALLER IN MASSING, AS OPPOSED TO OUR MULTIFAMILY TRADITIONAL, WHICH MIGHT BE CLOSER TO THAT FOUR STORY TEXAS RAP THAT WE'RE USED TO SEEING.

AND SO YOU CAN SEE WE'VE ALLOW A PROPOSED TO ALLOW MULTI-FAMILY COTTAGE AS A USE WITH CRITERIA AND C1, C2 AND O1. SO THOSE LOWER INTENSITY DISTRICTS AND THEN WE'VE PROPOSED TO ALLOW MULTIFAMILY TRADITIONAL AS A USE WITH CRITERIA IN C3 AND O2 ARE MORE DENSE AND INTENSE COMMERCIAL DISTRICTS. THE CRITERIA ARE ALL GOING TO BE LOCATED IN ONE SPOT IN OUR CODE AND 206. SO THAT WAY IT'S A KIND OF ONE STOP SHOP FOR SOMEBODY WHO'S DEVELOPING UNDER THESE STANDARDS. AND THOSE ARE GOING TO HAVE SOME OF THOSE BUILDING FORM REGULATIONS TO HELP CONTROL WHAT IS REMAINING IN OUR ABILITY TO CONTROL, WHETHER THAT IS NUMBER OF DWELLING UNITS THAT ARE ATTACHED IN A SINGLE BUILDING, AMENITY REQUIREMENTS. AND WE'LL JUMP INTO THOSE IN A LITTLE BIT, BUT GENERALLY TRYING TO SEPARATE OUT THOSE USES TO MAKE THEM COMPATIBLE WITH THEIR COMMERCIAL COUNTERPARTS. ALONG WITH THIS, BECAUSE WE DO HAVE TO CHANGE THE DENSITY THAT IS ALLOWED IN OUR MULTIFAMILY 30 DISTRICT. WE ARE PROPOSING TO CHANGE THE NAME TO MULTIFAMILY 36. THE 30 IS THE CURRENTLY ALLOWED DENSITY. AND SO AS WE'RE CHANGING THE DENSITY, IT MAKES SENSE TO CHANGE THE NAME OF THAT DISTRICT. WE ARE ALSO PROPOSING TO CHANGE THE RESIDENTIAL ADJACENCY SETBACK

AND REDUCING THAT TO 25FT. THAT IS THE MAXIMUM THAT STATE LAW WILL ALLOW US TO REGULATE. BUT WE ARE NOT PROPOSING ANY OTHER ADDITIONAL CHANGES TO MULTIFAMILY USES IN THIS DISTRICT PERTAINING TO THE WAY THAT THE BUILDING LOOKS OR THE AMENITY REQUIREMENTS. SO THE REQUIREMENTS FOR MULTIFAMILY DEVELOPED IN THIS DISTRICT WILL BE A LITTLE BIT LESS STRICT THAN THOSE DEVELOPED IN NONRESIDENTIAL DISTRICTS. WE'RE ALSO PROPOSING TO MOVE THE FR FLEX RESIDENTIAL ZONING DISTRICT. THERE WAS NOT A PROPERTY IN THE CITY WITH THIS ZONING DESIGNATION, AND IT WAS REALLY INTENDED TO HIT A LOWER DENSITY MULTIFAMILY PRODUCT.

NOW THAT WE CANNOT REGULATE DENSITY OR HEIGHT, IT BECOMES LESS USEFUL. LOOKING AT THE DEVELOPMENT STANDARDS SPECIFICALLY FOR MULTIFAMILY AND NONRESIDENTIAL DISTRICTS, THERE ARE TWO CATEGORIES THAT WE NEEDED TO ACCOMMODATE. WE NEEDED TO ENSURE THAT WE ADOPTED STANDARDS FOR STRICT COMPLIANCE WITH STATE LAW. AND THEN THERE ARE ADDITIONAL PROPOSED STANDARDS THAT ARE AIMING TO HIT THOSE OBJECTIVES. AND THE COMPREHENSIVE PLAN THAT I MENTIONED EARLIER. SO SOME THINGS THAT WE HAVE TO ACCOMMODATE AND INCLUDE IN OUR CODE NOW ARE WE CAN NO LONGER REQUIRE MORE THAN ONE PARKING SPACE PER DWELLING UNIT.

GENERALLY SPEAKING, SETBACKS AND LANDSCAPE BUFFERS HAVE TO MATCH WHATEVER IS APPLICABLE TO NONRESIDENTIAL USES. IN THAT DISTRICT. WE HAVE THAT MAXIMUM DENSITY OF 36 DWELLING UNITS PER ACRE, AND THEN THE MAXIMUM HEIGHTS RANGE FROM 45FT TO 75FT. AND THAT DEPENDS ON THE DISTRICT. SO THOSE ARE THINGS THAT WE HAVE TO ACCOMMODATE. IN ADDITION TO THAT, STAFF IS PROPOSING THAT 75% OF THE PARKING FOR THESE USES MUST BE COVERED, OR SHOULD THEY CHOOSE TO HAVE THEM BE ENCLOSED. WE ARE RECOMMENDING THAT THERE IS A LIMIT ON THE NUMBER OF DWELLING UNITS IN A SINGLE BUILDING, ESPECIALLY SPECIFICALLY FOR THAT COTTAGE PRODUCT. WE ARE ALSO RECOMMENDING THAT THERE'S A MINIMUM FIRST FLOOR HEIGHT OF 14FT. AND SO THE INTENT OF THAT IS IT CAN BE ESTABLISHED AND DEVELOPED AS RESIDENTIAL. BUT SHOULD THERE EVER BE A MARKET TO CONVERT TO COMMERCIAL USES, THERE'S ACTUALLY ROOM IN THE FIRST FLOOR TO ADD ADDITIONAL MECHANICAL SPACES OR ANYTHING ELSE NEEDED TO MEET THAT BUILDING CODE REQUIREMENT. WE CAN ALSO REQUIRE SOME ARCHITECTURAL ENHANCEMENTS. SO LOOKING AT SOME OFFSETS FOR TRADITIONAL MULTIFAMILY BUILDING AND THEN PROHIBITING BALCONIES FACING SINGLE FAMILY RESIDENTIAL. ANOTHER PROVISION THAT WE ARE SUGGESTING IS HIGHLIGHTED IN THIS CHART. IN RED, WE ARE PROPOSING MINIMUM HEIGHTS WITH CERTAIN ZONING DISTRICTS. SO WITH THOSE NONRESIDENTIAL ZONING DISTRICTS, IN ORDER, ESPECIALLY IF WE LOOK AT OUR MORE INTENSE NONRESIDENTIAL DISTRICTS SUCH AS C3 OR O2, WE MIGHT EXPECT THAT A DENSER AND MORE INTENSE PRODUCT IS LOCATED THERE. AND SO BUILDINGS MIGHT LOOK A LITTLE BIT TALLER TO BE MORE COMPATIBLE WITH A MORE INTENSE COMMERCIAL USES. SO, FOR EXAMPLE, IN O2, WE'RE RECOMMENDING A MINIMUM BUILDING HEIGHT OF FIVE STORIES, SO IT MUST BE AT LEAST THAT TALL. BUT THE MAXIMUM HEIGHT OF THE ZONING DISTRICT WOULD STILL ALSO REMAIN IN PLACE, SO IT WOULD NOT EXCEED WHAT IS CURRENTLY ALLOWED IN THAT ZONING DISTRICT. CURRENTLY, ALL OF OUR MULTIFAMILY PROPERTIES DO REQUIRE AMENITIES ON SITE TO ACCOMMODATE THE RESIDENTS. THINGS LIKE POOLS, DOG PARKS, BUSINESS CENTERS FOR MULTIFAMILY PROPERTIES IN NONRESIDENTIAL DISTRICTS. WE'RE PROPOSING THAT THERE ARE ADDITIONAL AMENITIES REQUIRED. SO WITH THE NONRESIDENTIAL DISTRICT WASN'T ORIGINALLY INTENDED TO ACCOMMODATE THOSE RESIDENTS, SO THE ADDITIONAL AMENITIES WILL HELP SUPPORT THOSE RESIDENTS IN THOSE AREAS. WE'VE ALSO ADDED NEW AMENITIES FOR ALL ZONING DISTRICTS FOR THE THE THINGS THAT WE CAN NO LONGER REQUIRE REGULATE, BUT WE STILL PLACE VALUE ON. SO, FOR EXAMPLE, AN ADJACENCY BUFFER NEXT TO SINGLE FAMILY RESIDENTIAL. IF AN ADDITIONAL ADJACENCY BUFFER IS PROVIDED, IT WOULD BE NICE FOR THEM TO GET CREDIT FOR THAT BECAUSE AGAIN, IT IS STILL SOMETHING THAT THE CITY VALUES. SENATE BILL 15 PERTAINS TO SINGLE FAMILY USES. THE OVERARCHING KEY PIECE TO ME IN THIS LEGISLATION IS THAT THE APPLICABILITY IS MUCH SMALLER THAN SB 840, SO THIS WOULD APPLY ONLY TO PROJECTS THAT ARE ZONED FOR SINGLE FAMILY USES, HAVE NO RECORDED PLOT, AND ARE FIVE ACRES OR MORE ESSENTIALLY NEW PROJECTS. THIS WOULD NOT BE RETROACTIVE TO EXISTING NEIGHBORHOODS, BUT IT DOES SAY THAT THE CITY CANNOT REQUIRE A NEW SINGLE FAMILY SUBDIVISION THAT MEETS THESE APPLICABLE APPLICABILITY STANDARDS TO PLOT LOTS LARGER THAN 30FT WIDE, AND SO WE HAVE PROPOSED A SET OF STANDARDS. WITH THAT, ON THE RIGHT HAND SIDE, YOU'LL SEE WHAT THE STATE HAS REQUIRED US TO COMPLY WITH. AND SO THE HIGHLIGHT IS WE AGAIN, ARE NO LONGER ALLOWED TO REQUIRE MORE THAN ONE PARKING SPACE PER DWELLING UNIT. CURRENTLY, EVERY SINGLE FAMILY HOME IS REQUIRED TO PROVIDE FOUR PARKING SPACES. AND SO NOW WE'RE ONLY ALLOWED TO REQUIRE ONE PARKING SPACE AND IT DOES NOT HAVE TO BE COVERED OR ENCLOSED. AND ANOTHER QUICK NOTE THAT LOTS LESS THAN 50FT WIDE DO REQUIRE REAR ACCESS VIA ALLEYS, SO THIS WOULDN'T BE A FRONT SERVING PRODUCT IF IT WAS DEVELOPED AT 30FT WIDE. WE'VE PROPOSED TWO APPROACHES TO ACCOMMODATE THIS. IN OUR CODE.

WE ARE ADDING THE RECOMMENDING ADDING LAND USES FOR SINGLE FAMILY SMALL LOTS. AND SO THAT WOULD BE A USE WITH CRITERIA ALLOWED IN ALL OF OUR RESIDENTIAL DISTRICTS, SPECIFICALLY BECAUSE STATE LAW DOES REQUIRE US TO ALLOW IT. BUT WE ARE ALSO PROPOSING THE ADDITION OF A NEW ZONING DISTRICT, R3. AND SO THAT WOULD MEET STATE LAW REQUIREMENTS.

AND WE CAN DIVE INTO THOSE IN A QUICK SECOND. BUT ESSENTIALLY THIS ALLOWS FLEXIBILITY WHERE WE'RE REQUIRED TO ALLOW THOSE SMALLER LOTS. BY STATE LAW, WE HAVE THE PROVISION AND ABILITY TO DO THAT WITH THE USE WITH CRITERIA. BUT IF THERE'S A CASE WHERE IT MAKES SENSE TO ZONE AN ENTIRE PROPERTY COMPLIANT WITH THOSE REGULATIONS, WE DO HAVE THE OPTION WITH R3. THE R3 STANDARDS ARE HERE BEFORE YOU. AGAIN, THEY'RE PRETTY SIMILAR TO WHAT WE TALKED ABOUT ON THAT FIRST SLIDE. THE ONLY TWO ADDITIONAL THINGS THAT I'LL NOTE IS THAT BECAUSE OF THE MAXIMUM HEIGHT REQUIREMENTS, WE'RE REQUIRED TO ALLOW THREE STORIES IN THESE HOMES, YOU'VE GOT TO BUMP THE MAXIMUM HEIGHT JUST A LITTLE BIT MORE BY THE TIME YOU ADD A ROOF PITCH AND WHATNOT.
