THIS INCLUDES SEEKING LONG TERM SHELTER, BUT EMPHASIZING HOME IS FAR MORE THAN FOUR WALLS AND A CEILING, AND DEVELOPING A PLAN TO MAINTAIN IS AS IMPORTANT AS DEVELOPING A PLAN TO OBTAIN FOR THE ADDITIONAL 99.8% THAT HAVE A PLACE TO STAY.

REMOVING THE LESSNESS FROM HOMELESSNESS IS REMOVING THE STIGMAS AND FALSE NARRATIVES FROM THE LENS. PEOPLE TEND TO VIEW HOMELESSNESS THROUGH. THIS IS UNDOUBTEDLY THE MOST CHALLENGING AND THE MOST CRUCIAL PART OF OUR MISSION, BECAUSE THE WAY HOMELESSNESS IS VIEWED AFFECTS THE WAY HOMELESSNESS IS ADDRESSED AND THE EXTREME VULNERABILITY OF THE PEOPLE EXPERIENCING IT. THE MOMENT A PERSON BECOMES HOMELESS, THEIR LIFE EXPECTANCY DROPS 20 YEARS AND THEIR VULNERABILITY TO ALL CAUSES OF DEATH TRIPLE. AND IF A VULNERABLE PERSON COULD MEET THEIR OWN NEEDS, THEY WOULDN'T BE CALLED VULNERABLE.

HOMELESSNESS ISN'T SIMPLY A HOUSING PROBLEM OR A FINANCIAL PROBLEM. AT THE CORE, HOMELESSNESS IS A RELATIONSHIP PROBLEM. IN PARTICULAR, IT'S A BREAKDOWN OF NUCLEAR

RELATIONSHIPS. I KNOW THIS FROM PERSONAL EXPERIENCE. ROUGHLY 20 YEARS AGO, DESPITE HAVING A FOUR YEAR DEGREE IN MULTIPLE PRESTIGIOUS CERTIFICATIONS, I LOST A NEAR SIX FIGURE JOB.

EVEN AFTER TRIPLING THE REVENUE FOR THE DEPARTMENT I WAS RESPONSIBLE FOR. NOT LONG AFTER THAT, I WENT THROUGH A TERRIBLE DIVORCE. AS I TRIED TO PIECE MY LIFE BACK TOGETHER, I PURSUED HOMEOWNERSHIP OVER RENTING SO I COULD BUILD EQUITY. I CLOSED ON MY HOUSE JUST ONE MONTH BEFORE THE MARKET CRASHED IN 2008. I WAS ALMOST IMMEDIATELY UNDERWATER AND LOST MY HOME.

THE ONLY REASON I DIDN'T HAVE TO SLEEP OUTSIDE IS BECAUSE OF FAMILY, FRIENDS, AND MY CHURCH NUCLEAR RELATIONSHIPS. I HAVE PEACE TODAY KNOWING THAT IF I LOST MY INCOME AND MY HOME, I WOULD HAVE A PLACE TO STAY BECAUSE OF FAMILY, FRIENDS, AND MY CHURCH. NUCLEAR RELATIONSHIPS. WHAT PEOPLE NEED MORE THAN ANYTHING ELSE ARE PEOPLE THAT ARE WILLING TO LOVE AND CARE FOR THEM. NUCLEAR RELATIONSHIPS. IT'S IMPORTANT TO KNOW THAT LOVING AND CARING FOR A PERSON IS NOT DOING EVERYTHING FOR THEM, BUT TEACHING THEM HOW TO GET EVERYTHING DONE. AS LEADERS, YOU KNOW YOU CAN'T DO EVERYTHING YOURSELF, BUT IT'S STILL YOUR RESPONSIBILITY TO MAKE SURE EVERYTHING GETS DONE. SO LET'S TALK ABOUT OUR REAL PROBLEM. OUR REAL PROBLEM ISN'T A LACK OF HARDWARE, BUT FAULTY SOFTWARE. OUR REAL PROBLEM ISN'T A LACK OF STRUCTURES. I'M FAIRLY CONFIDENT THERE ARE MORE SPARE BEDROOMS IN OUR COMMUNITY THAN THERE ARE UNSHELTERED PEOPLE, SO IT'S NOT EVEN A LACK OF APPROPRIATE STRUCTURES. OUR REAL PROBLEM IS A LACK OF COLLABORATIVE PLANNING. THESE ORDINANCES EVEN SUGGEST A DESIRE FOR A SOFTWARE UPDATE, BUT THEY ARE THE WRONG UPDATE. ONE IS USELESS AND THE OTHER IS HARMFUL. IF WE HAVE GOOD SYSTEMS IN PLACE, WE WON'T HAVE TO SAVE FACE BY TELLING PEOPLE THEY HAVE TO GO AWAY. IF WE HAVE GOOD SYSTEMS IN PLACE, WE CAN TELL PEOPLE THAT ARE OUT OF PLACE. THERE IS A WAY I'M UNASHAMED TO SAY THAT WAY IS JESUS CHRIST. AND BEFORE YOU DISMISS ME AS GOING RELIGIOUS ON YOU, LET ME REMIND YOU CHRISTIANITY IS ABOUT RELATIONSHIP. AND THE RELIGIOUS ACTIVITY WE'RE CALLED TO ENGAGE IN IS LOVING AND TAKING CARE OF THE ALIEN, THE WIDOW, AND THE STRANGER. WHILE CHOOSING JESUS IS MY FREE CHOICE AS IT IS YOURS. IT ELIMINATES THE IDEA OF BEING SUBJECTIVE, BUT ESTABLISHES THE IDEA OF BEING OBJECTIVE. BECAUSE I DIDN'T WRITE THE COMMANDMENTS, GOD DID. THEY ARE LAWS THAT I HAVE ADOPTED AND BELIEVE IN, BUT I DID NOT FORMULATE THEM. THEY ARE LAWS THAT HAVE INSPIRED THE MAJORITY OF THE LAWS OF OUR LAND AND THE PROCESSES WE FOLLOW TO MAKE SURE THIS IS TRULY A JUST PROCESS. MY QUESTION TO YOU IS ARE YOU ASKING ENOUGH QUESTIONS? ASKING QUESTIONS IS WHY I BELIEVE ONE ORDINANCE, ONE ORDINANCE IS USELESS AND THE OTHER ONE IS HARMFUL. WE ALL WANT TO SEE FEWER PEOPLE STRUGGLING, INCLUDING THE PEOPLE STRUGGLING.

IN FACT, THEY WANT IT EVEN MORE. THE GREATER PROBLEM IS ONLY WANTING TO SEE FEWER PEOPLE STRUGGLING. WOULDN'T IT BE BETTER TO KNOW THERE ARE FEWER PEOPLE STRUGGLING? THESE ORDINANCES SUGGEST IGNORANCE, NOT UNINTELLIGENCE, BUT IGNORANCE. IT SUGGESTS NOT KNOWING WHAT ELSE TO DO AND TO SETTLE FOR A PERCEIVED VISIBLE GOAL VERSUS AN ACTUAL GOAL. IT MAY PLEASE 99% OF THE POPULATION, BUT WE CAN ACTUALLY HAVE A VERIFIABLE GOAL THAT'S POSITIVE FOR 100%. CHRIST FOLLOWERS ARE CHALLENGED TO NOT LOVE ONLY THOSE THAT LOVE US BACK, BUT EVEN THOSE THAT DON'T, AND TO SHOW HOSPITALITY NOT ONLY TO THOSE WE KNOW, BUT TO THE STRANGERS, EVEN THE WEIRD ONES. THAT DOES NOT MEAN WE DON'T HOLD PEOPLE RESPONSIBLE FOR POOR BEHAVIOR. GOD'S UNCONDITIONAL LOVE DOES NOT MEAN GOD'S UNCONDITIONAL APPROVAL. TRUE ACCOUNTABILITY ISN'T JUST TELLING PEOPLE WHAT THEY'RE DOING IS WRONG, IT'S TEACHING THEM AND GUIDING THEM TO WHAT IS RIGHT. THESE ORDINANCES SEEM TO BE ADDRESSING A PERCEIVED IGNORANCE. THE 2.0. 2% OF THE POPULATION ARE EXPERIENCING HOMELESSNESS HAVE MAYBE SO, BUT PLEASE DON'T LET ANY IGNORANCE BLIND YOU FROM TRYING TO HELP THEM WITH THEIR IGNORANCE. AND WHAT I BELIEVE WAS JESUS'S GREATEST SERMON. HE SAID, FORGIVE THEM FOR THEY KNOW NOT WHAT THEY DO. HE WAS SAYING THIS TO EXECUTIONERS WHO WERE EXPERTS AT WHAT THEY DO, BUT DIDN'T REALIZE THE IMPACT OF WHAT THEY WERE INVOLVED IN. IF YOU WANT PEOPLE TO KNOW WHAT THEY DON'T KNOW, YOU'VE GOT TO BE WILLING TO SHARE WITH THEM WHAT THEY DON'T KNOW, SO THEY'LL KNOW. I HATE THAT IT TELLS PRIVATE PROPERTY OWNERS WHAT THEY CAN AND CANNOT DO WITH THEIR PROPERTY, ESPECIALLY IF THE USE OF THAT PROPERTY IS TO HELP PEOPLE WITH NOWHERE ELSE TO GO. I HATE THAT IT PUNISHES BEING POOR PUNISHES SLIPPING THROUGH THE CRACKS, PUNISHES PEOPLE FOR THE FAILURE OF THE SYSTEM RATHER THAN HOLDING THE SYSTEM TO ACCOUNT. HE WAS REMEMBERED BY OUTREACH WORKERS AS SOMEONE WHO DESPERATELY WANTED HOUSING SO HE COULD LIVE IN SAFETY WITH HIS CAT. MANY OF OUR OLDER NEIGHBORS ARE EXPERIENCING HOMELESSNESS FOR THE FIRST TIME. ADULTS OVER 65 ARE NOW THE FASTEST GROWING SEGMENT OF THE UNHOUSED POPULATION, ACCORDING TO THE 2024 POINT IN TIME DATA FROM THE HUD. THE CRISIS IS DRIVEN BY FIXED INCOMES UNDER RISING RENTS AND A LACK OF AFFORDABLE HOUSING. OLDER ADULTS EXPERIENCING HOMELESSNESS ALSO FACE GREATER HEALTH RISKS DUE TO LIMITED FINANCIAL RESOURCES AND INADEQUATE ACCESS TO CARE. LYDIA, WHO IS 78, SAID THAT SHE BATTLED EXTENDED HOMELESSNESS FOR YEARS AFTER LOSING THE SOCIAL SECURITY BENEFITS THAT SHE WORKED HER WHOLE LIFE FOR. FOR EVERY ARGUMENT THAT PEOPLE WANT TO BE HOMELESS, THERE ARE EASILY 5000 JOE REYES. FOR EVERY PASSING COMMENT ABOUT HOW HOMELESS PEOPLE DON'T WANT TO WORK, THERE ARE PROBABLY 10,000 LYDIA'S. ACCORDING TO A 2021 STUDY BY THE UNIVERSITY OF CHICAGO, 53% OF SHELTERED AND 40% OF UNSHELTERED HOMELESS ARE ACTUALLY EMPLOYED PEOPLE. I HATE THAT MCKINNEY IS GOING TO KILL PEOPLE LIKE JOE AND LYDIA IF THIS AMENDMENT PASSES, SIMPLY BECAUSE SEEING THEM MAKES US FEEL UNCOMFORTABLE. THE RESPONSE TO THIS DISCOMFORT IS TO HOUSE PEOPLE, NOT TO PUNISH THEM FOR BEING VISIBLE OR JAIL THEM FOR BEING POOR. WE CAN DO BETTER. WE CAN MAKE HOUSING MORE AFFORDABLE BY EMBRACING METHODS THAT WORKED IN NEW ZEALAND, WHICH HAD A HOUSING CRISIS SIMILAR TO OURS. SOME OF THESE PROVEN METHODS

ARE ROLLING OUT AT THE STATE LEVEL NOW, THANKS TO THE ABSOLUTELY INCREDIBLE SENATE BILL 840. LIKE MINIMIZING CAR PARKING REQUIREMENTS, WHICH INCREASES THE COST OF HOUSING.

WE KNOW THIS RAISING HEIGHT LIMITS FOR RESIDENTIAL BUILDINGS, WHICH INCREASES THE AMOUNT OF HOUSING IN ON A PLOT SIZE AND INTENSIFYING LAND USE AND EMBRACING UP ZONING SOLUTIONS DO EXIST IF WE EMBRACE THEM. HOUSING FIRST SOLUTIONS, ZONING CHANGES THINGS THAT DON'T REQUIRE PEOPLE TO HIDE AND DIE. SO I REALLY I KNOW NONE OF US WANTS THAT TO HAPPEN. I KNOW WE DON'T WANT TO KILL THE PEOPLE WHO CALL MCKINNEY HOME, WHO SIMPLY DO NOT HAVE AN ADDRESS AT THIS TIME. SO I KNOW WE CAN WE CAN DO BETTER. WE CAN BE SOLUTION FOCUSED INSTEAD OF HAVE A KNEE JERK REACTION TO THINGS THAT MAKE US FEEL UNCOMFORTABLE. I'D ALSO LIKE TO SPEAK ABOUT 2530 302, WHICH IS ALSO CALLED PHYSICAL OCCUPANCY. SINCE THE GRANTS PASSED SUPREME COURT RULING, OVER 260 CITIES HAVE PASSED LAWS CRIMINALIZING VISIBLE HOMELESSNESS. THESE POLICIES DON'T REDUCE HOMELESSNESS. THEY SIMPLY DISPLACE UNHOUSED PEOPLE AND MAKE THE CRISIS WORSE. THIS IS EXACTLY WHY I'M AGAINST THE PROPOSED ORDINANCE AMENDMENT TO CHAPTER 70, ALSO CALLED PHYSICAL OCCUPANCY WITHIN DOWNTOWN PUBLIC SPACES. IT SOUNDS HARMLESS UNTIL YOU REALIZE IT CRIMINALIZES SLEEPING. PAIRED WITH THE PROPOSED CAMPING AMENDMENT, IT IS A RECIPE FOR DISASTER.

KENTUCKY PASSED SOMETHING LIKE THIS. IT IS CALLED THE SAFER KENTUCKY ACT. IT PASSED A YEAR AGO. THE BILL MADE IT ILLEGAL FOR A PERSON TO SLEEP IN TENT, TO SLEEP, OR SET UP CAMP ON UNDESIGNATED PUBLIC PROPERTY, LIKE SIDEWALKS OR UNDERNEATH OVERPASSES. SOUND FAMILIAR? METRO RELIEF, WHO WE DISCUSSED EARLIER, AMAZING AGENCY, PARTNER AGENCY OF OURS. AND JUST IN THEIR ONE YEAR OF PART TIME WORK, THEY DEALT WITH 145 UNIQUE HOMELESS INDIVIDUALS IN A MANUAL LABOR, WAS SERVING AN AVERAGE OF 56 A NIGHT DURING THIS LAST OVERNIGHT WARMING TIME FRAME. THIS IS ONLY DATA FROM A SMALL NUMBER OF AGENCIES. FOR EACH OF US, IT IS MORE THAN JUST HOUSING. THOSE THAT WE SERVE NEED ACCESS AND CONNECTION TO OTHER THINGS AS WELL. IT TAKES MONEY TO MAKE THOSE THINGS HAPPEN AND OTHER TIMES IT TAKES GUIDANCE, SUPPORT AND TIME. EXAMPLES COULD BE HOW MANY ARE CONNECTED TO SUPPORTIVE SERVICES FOR THEIR MENTAL HEALTH NEEDS OR SUBSTANCE ABUSE PEER SUPPORT. WE'VE HELPED 40 INDIVIDUALS OBTAIN IDS, WITHOUT WHICH AN INDIVIDUAL CANNOT GET INTO HOUSING. THEY CAN'T APPLY FOR SOCIAL SECURITY, THEY CAN'T DO MUCH OF OF OF ANYTHING. WE'VE HELPED 23 INDIVIDUALS QUALIFY FOR SOCIAL SECURITY BENEFITS. WE'VE HELPED GET 73 INDIVIDUALS CONNECTED TO EITHER SUBSTANCE ABUSE OR MENTAL HEALTH SERVICES, AND WE'VE HELPED 33 INDIVIDUALS OBTAIN AND REGULARLY RECEIVE THEIR LIFE SAVING PRESCRIPTION MEDICATIONS. THAT'S JUST KIND OF A SMALL SNAPSHOT OF WHAT WE'VE BEEN ABLE TO DO. AND THAT WAS PRIMARILY WITH WITH JUST TWO CASEWORKERS THAT WE HAD THROUGH OUR NEIGHBORS HELPING NEIGHBORS PROGRAM. THINK OF WHAT WE WILL BE ABLE TO DO WITH THE BUILDING TOGETHER PROGRAM WITH FIVE CASEWORKERS. CONSIDER AN ORDINANCE AMENDING CHAPTER 70 OF THE MCKINNEY CODE OF ORDINANCES TO INCORPORATE A NEW ARTICLE ENTITLED ARTICLE 12 PHYSICAL OCCUPANCY WITHIN DOWNTOWN PUBLIC SPACES, MISS ARNOLD. THANK YOU, MR. MAYOR. THERE IT IS. OKAY, SO WE HAVE TALKED ABOUT THIS ITEM A COUPLE OF TIMES BEFORE AT A PREVIOUS WORK SESSION, AS WELL AS THE SEPTEMBER MEETING. WE DID COMMIT TO BRINGING THESE ITEMS BACK AT TONIGHT'S MEETING, ALONG WITH THAT COMPANION ITEM ON THE BROADER BETTER TOGETHER INITIATIVE. SO THIS PARTICULAR ORDINANCE AMENDMENT WOULD ADDRESS THE OCCUPANCY OF PUBLIC SPACES IN THE DOWNTOWN AREA ONLY BY AMENDING CHAPTER 70, WHICH ALREADY INCLUDES A NUMBER OF DIFFERENT OFFENSES AND MISCELLANEOUS PROVISIONS FOR THE CITY. SO, AS PROPOSED, THE PHYSICAL OCCUPANCY WITH DOWNTOWN SPACES ORDINANCE WOULD MAKE IT AN UNLAWFUL FOR SOMEBODY TO SLEEP OR LIE DOWN IN PUBLIC SPACES. SO THAT WOULD BE A PUBLIC STREET, A PUBLIC SIDEWALK, ANYTHING THAT IS NOT MEANT TO BE SAT ON. SO WE DID, FROM THE LAST DISCUSSION, MODIFY THE ALLOWANCES WITHIN THAT ORDINANCE SO THAT IF THERE IS A BENCH, AN ARCHITECTURAL FEATURE, OR A CHAIR THAT IS MEANT TO BE USED FOR THAT SORT OF PURPOSE, THAT WOULD STILL BE PERMITTED. THIS IS PRIMARILY TARGETED AT LAYING DOWN SLEEPING IN PUBLIC SPACES. WE HAVE ALSO MODIFIED IT SO THAT THE SITTING COMPONENT IS REALLY, REALLY TAILORED TO PUBLIC RIGHTS OF WAY AND STREETS, WHICH OBVIOUSLY WE SEE AS A SAFETY CONCERN IN GENERAL. WHAT THIS ORDINANCE DOES NOT NECESSARILY PROHIBIT IS FROM SOMEBODY ENJOYING A PUBLIC PARK OR A PARADE OR A SPECIAL EVENT THAT'S HAPPENING IN DOWNTOWN. AS PROPOSED, THIS ORDINANCE WOULD HAVE A ONE YEAR SUNSET CLAUSE SO THAT WE CAN MONITOR HOW ITS ENFORCEMENT IS GOING AND HOW IT'S WORKING OR NOT WORKING AT THE COUNCIL'S DISCRETION. OF COURSE, ANY TIME DURING THAT ONE YEAR INITIAL PERIOD, IF THE COUNCIL IS CONCERNED ABOUT THE WAY THAT IT IS OPERATING, THEY CAN ALWAYS ASK FOR STAFF TO BRING IT BACK FORWARD TO RECONSIDER THE ORDINANCE. THE ONE THING I DO WANT TO HIGHLIGHT IS WHAT THIS ORDINANCE DOES, IS IT PUTS SOME PARAMETERS OR SOME TOOLS IN THE TOOL BELT FOR THE CITY DOES NOT NECESSARILY MEAN THAT STAFF AND POLICE ENFORCEMENT ARE GOING TO GO OUT TOMORROW AND START LAYING DOWN THE HAMMER. IT IS ONE OF THOSE TOOLS, AGAIN, THAT WE SEE THAT MAY BE BENEFICIAL, AS WE'RE TRYING TO ADDRESS CERTAIN BEHAVIORS IN AND AROUND DOWNTOWN, BUT WE DEFINITELY RECOGNIZE THAT IT'S ONE THAT NEEDS TO BE MONITORED CLOSELY.

WHAT I'M ABOUT TO SAY, BUT THERE IS SOMETHING THAT I'VE OFTEN REFERRED TO AND I DIDN'T MAKE IT UP. I READ IT SOMEWHERE CALLED THE SOCIAL CONTRACT. THAT'S UNWRITTEN HOW WE BEHAVE, HOW WE SHOULD BEHAVE, THAT WE SHOULDN'T HAVE TO CODIFY. WE JUST KNOW WHAT THE RIGHT THING TO DO HERE IS. THIS ITEM IS TO TALK ABOUT THE ORDINANCES PERTAINING TO CAMPING WITHIN THE CITY OF MCKINNEY. ONE THING THAT I DO WANT TO NOTE AS I LAUNCH INTO THIS PRESENTATION IS THAT THE CAMPING ORDINANCES ALREADY EXIST WITHIN THE MCKINNEY OVERALL CODE. THERE ARE, I WOULD SAY, THREE PRIMARY CHANGES THAT THE CITY IS PROPOSING. THE FIRST WOULD

THE SECOND IS TO CLARIFY AND ADD TO THE DEFINITION OF CAMPING THE IDEA OF SLEEPING IN A VEHICLE OVERNIGHT. AND I DO WANT TO MAKE SURE THAT WE SPEND SOME TIME TALKING ABOUT THAT, BECAUSE I DO THINK WE TALKED ABOUT IT QUITE A BIT BEFORE IN OUR PREVIOUS DISCUSSIONS, ADDING THAT COMPONENT TO THE DEFINITION OF CAMPING. IT DEFINITELY POINTS TO SLEEPING IN YOUR VEHICLE, BUT FURTHER DOWN IN THE ORDINANCE, IT CLARIFIES THAT CAMPING IN YOUR VEHICLE OR SLEEPING IN YOUR VEHICLE WOULD ONLY BE PROHIBITED PER THIS ORDINANCE. ON CITY OWNED PARKING LOTS AND ON THE CITY RIGHTS OF WAY, THERE IS A SPECIAL CARVEOUT IN THE CODE THAT WOULD ALLOW FOR FOLKS TO BE ABLE TO SLEEP IN THEIR VEHICLES ON A PRIVATE PARKING LOT. SO THERE WAS DEFINITELY, I KNOW, A LOT OF DISCUSSION, MAYBE A LITTLE BIT OF CONFUSION ABOUT THAT WHEN WE FIRST BROUGHT THIS FORWARD. AND I WANT TO MAKE SURE I NOTE FOR THE RECORD THAT THAT HAS BEEN MODIFIED. THE OTHER MAIN THING THAT THIS ORDINANCE AMENDMENT CHANGES IS IT DOES MAKE A PRIVATE PROPERTY OWNER SOMEWHAT RESPONSIBLE OR RESPONSIBLE. IF THEY KNOWINGLY ALLOW SOMEBODY TO CAMP ON THEIR PROPERTY IN VIOLATION OF THE CODE. AND WHAT THAT DOES IS IT DOES PUT SOME LEVEL OF RESPONSIBILITY TO ENSURE THAT BOTH PROPERTY OWNERS AND THE UNHOUSED ARE RESPONSIBLE FOR ABIDING BY THE REQUIREMENTS THAT ARE PUT IN THIS PARTICULAR CODE. EXCUSE ME. SO THOSE ARE THE REALLY THE THREE MAIN CHANGES THAT ARE COMING ABOUT WITH THIS PARTICULAR AMENDMENT. SO AGAIN, MOVING IT OUT OF THAT PARKS SECTION OF THE CODE, CLARIFYING WHAT IT MEANS TO SLEEP IN A VEHICLE OVERNIGHT AS IT RELATES TO CAMPING AND WHERE THAT WOULD BE PERMITTED, AND MAKING IT SOME RESPONSIBILITY ON A PROPERTY OWNER TO ALLOW SOMEBODY TO KNOWINGLY VIOLATE THE CODE. SIMILAR TO THE PREVIOUS ORDINANCE. WE ARE SUGGESTING A ONE YEAR SUNSET ON THIS PARTICULAR ORDINANCE. VERY SIMILAR. WE RECOGNIZE THAT IT IS A BIT OF A CHANGE AND IT'S CERTAINLY A SENSITIVE TOPIC. SO BE MONITORING HOW THE ENFORCEMENT IS GOING IF THERE IS A NEED TO REVISIT IT PRIOR TO THE ONE YEAR SENTENCE, THAT WE CAN CERTAINLY DO THAT AS WELL. BUT AGAIN, THE CITY SEES THIS AS A POTENTIAL TOOL IN THE TOOLBOX FOR US AS WE'RE NAVIGATING THAT BROADER INITIATIVE RELATED TO HOMELESSNESS AND MAKING SURE THAT WE'VE GOT THE TOOLS THAT WE NEED. IF THERE IS AN ENFORCEMENT ACTION THAT THE CITY NEEDS TO TAKE THE ORANGE BOX ON YOUR SCREEN, I THINK DOES A REALLY NICE JOB OF CLARIFYING THE THINGS YOU CAN AND CAN'T DO AS THE ORDINANCE PROPOSES. SO CAMPING AND DESIGNATED CAMPING AREAS AND PARKS SUCH AS IRWIN PARK WOULD STILL BE PERMITTED. BEING ABLE TO CAMP ON YOUR OWN PRIVATE PROPERTY WOULD STILL BE PERMITTED. HOWEVER, CAMPING OR SLEEPING AND STAYING IN A IN A CITY, IN A VEHICLE, ON A CITY LOT OR PUBLIC RIGHT OF WAY WOULD NOT BE PERMITTED. AND OF COURSE, NOT ALLOWING OTHERS TO KNOWINGLY CAMP ON YOUR PROPERTY IN VIOLATION OF THE CODE. THIS PARTICULAR CODE IS CITYWIDE, WHEREAS THE PREVIOUS ONE WAS DOWNTOWN SPECIFIC ONLY. I MEAN, BUT SO WOULD THAT BE IN VIOLATION. WOULD NOT BE. SO AGAIN, THE SLEEPING IN A VEHICLE OVERNIGHT AND A AND A COMMERCIAL PRIVATE PARKING LOT WOULD STILL BE ALLOWED THAT OVERNIGHT. SLEEPING IN A VEHICLE WOULD ONLY BE PROHIBITED ON CITY RIGHTS OF WAY AND CITY OWNED PARKING LOTS. SO THINK ABOUT THE ON STREET PARKING SPACES IN AND AROUND DOWNTOWN. IT WOULD NOT BE PERMITTED THERE, BUT PERHAPS A WALMART OR A RACETRACK. IF THERE IS A PARKING LOT THERE AND SOMEBODY STAYS IN THEIR CAR THERE, THEY WOULD BE ALLOWED TO DO THAT. IT DOES NOT MEET THE PERCENTAGE THAT THIS COMMUNITY STARTED WITH, THAT THIS COMMUNITY STARTED TO GROW WITH AND THE LACK OF THAT INVESTMENT BY THE FEDERAL GOVERNMENT LEAVES US WITH A LOT OF WE DON'T HAVE OPTIONS FOR PEOPLE WITH DISABILITIES, FOR PEOPLE WITH WITH MENTAL INCAPACITIES, FOR ELDERLY THAT SHOULD BE USING THESE RESOURCES. THE SECOND THING IS WE ARE 49TH OR SOMETHING IN THE COUNTRY AND OUR INVESTMENT IN IN MENTAL HEALTH AND ACCESS TO MENTAL HEALTH IN THIS STATE, IN THIS COUNTY, IS, IS FAILING. FROM A PLANNING PERSPECTIVE, THIS PROPOSAL IS NOT AN APPROPRIATE USE FOR THIS LOCATION. A GAS STATION IS ONE OF THE MOST INTENSIVE COMMERCIAL USES YOU CAN INTRODUCE INTO A NEIGHBORHOOD. IT BRINGS CONSTANT TRAFFIC, LATE NIGHT ACTIVITY, DELIVERY TRUCKS, BRIGHT LIGHTING AND NOISE, ALL OF WHICH ARE INCOMPATIBLE WITH SINGLE FAMILY HOMES LOCATED JUST ACROSS THE PROPERTY LINE. THE INTERSECTION AT HARDIN AND FM 543 IS ALREADY HEAVILY TRAVELED. ADDING A GAS STATION WILL ONLY WORSEN CONGESTION AND SAFETY RISKS, ESPECIALLY FOR THE FAMILIES IN OUR NEIGHBORHOOD WHO WALK, BIKE AND DRIVE THROUGH THAT INTERSECTION DAILY. THERE'S ALSO BUS DROP OFF AND PICK UP JUST NORTH OF WHERE THIS WILL BE. FUEL TANKERS AND DELIVERY TRUCKS ENTERING AND EXITING THE SITE WILL CREATE EVEN MORE TURNING CONFLICTS AND HAZARDS. THERE ARE ALSO SERIOUS QUALITY OF LIFE AND PUBLIC SAFETY CONCERNS. GAS STATIONS ROUTINELY ATTRACT LOITERING, THEFT AND NUISANCE ACTIVITY.

THOSE ARE NOT ASSUMPTIONS. THEY ARE WELL DOCUMENTED PATTERNS FROM SIMILAR SITES. THESE PROBLEMS WILL FALL SQUARELY ON THE RESIDENTS WHO LIVE IMMEDIATELY ADJACENT TO THIS PROPERTY. FURTHERMORE, THIS PROJECT DOES NOT COMPLY WITH THE CITY'S DEVELOPMENT STANDARDS, SPECIFICALLY, THE REQUIRED 250 FOOT BUFFER BETWEEN FUEL STATIONS AND RESIDENTIAL PROPERTIES. AND LET'S ALSO MENTION THE FACT THAT THE CONVENIENCE STORE IS EVEN CLOSER THAN THAT. I LOST MY PLACE. THE HOMES IN THE PRESERVE ARE WELL WITHIN THAT DISTANCE. I'M HERE TONIGHT BECAUSE MANY OF US IN HONEY CREEK AND THE SURROUNDING COMMUNITIES ARE DEEPLY CONCERNED ABOUT THE PROPOSED 7-ELEVEN GAS STATION AT THE ENTRANCE TO OUR NEIGHBORHOOD. THIS ISN'T ABOUT BEING ANTI-GROWTH OR ANTI-BUSINESS. WE UNDERSTAND DEVELOPMENT IS PART OF MCKINNEY'S SUCCESS. WE JUST WANT GROWTH THAT FITS, GROWTH THAT SUPPORTS NEIGHBORHOODS INSTEAD OF DISRUPTING THEM.

THIS PARTICULAR PROJECT SIMPLY DOESN'T FIT WITH 12 FUEL PUMPS. IT'S CLEARLY DESIGNED TO SERVE COMMUTER AND CONTRACTOR TRAFFIC. COMING OFF FM 543, NOT THE FAMILIES THAT LIVE HERE. THAT SCALE MEANS MORE LARGE VEHICLES, MORE CUT THROUGH TRAFFIC AND MORE CONGESTION AT AN INTERSECTION THAT'S ALREADY BUSY DURING RUSH HOUR. AND IT'S NOT AS IF WE LACK FUELING OPTIONS. WE ALREADY HAVE STATIONS NEARBY, ONE AT H-E-B AND ANOTHER JUST DOWN LAKE FOREST, SO THIS ISN'T MEETING A LOCAL NEED. IT'S DUPLICATING WHAT ALREADY EXISTS WHILE ADDING MORE OUTSIDE TRAFFIC TO OUR STREETS. THEN THERE IS THE PROXIMITY ISSUE, THE CITY CODE CALLING FOR A 250 FOOT BUFFER BETWEEN FUEL CANOPIES AND HOMES FOR GOOD REASON TO LIMIT LIGHT POLLUTION, FUMES AND 24 HOUR NOISE. THIS PLAN SITS CLOSER THAN THAT, WHICH MEANS BRIGHT LIGHTS ALL NIGHT, EARLY MORNING DELIVERIES AND CONSTANT MOVEMENT RIGHT OUTSIDE OUR WINDOWS. AND EVEN BEYOND THAT, A SITE OF THIS SIZE WILL BRING MORE POLICE AND EMERGENCY CALLS NOT BECAUSE OF SERIOUS CRIME, BUT BECAUSE OF NUISANCE ISSUES THAT PULL LIMITED RESOURCES AWAY FROM NEARBY NEIGHBORHOODS. IT WOULD ALSO BE A LITTLE CHALLENGING TO GET THE REQUIRED AMENITIES IN THERE FOR SINGLE FAMILY, JUST GIVEN THE AMOUNT OF SPACE THAT YOU WOULD BE TRYING TO PUT AS MUCH DENSITY IN THERE TO MAKE SENSE OF THE LAND COULD BE CHALLENGING AND NOT VERY COST EFFECTIVE TO BE ABLE TO GET COMMUNITY CENTERS, POOLS, TRAILS, DOG PARKS, ALL THE AMENITIES THAT WE'RE ABLE TO SORT OF SPREAD ACROSS, MAYBE A LARGER BUCKET OF UNITS ON A MULTIFAMILY PROJECT, BUT IT WOULD BE COST PROHIBITIVE, POTENTIALLY ON THE SINGLE FAMILY DEAL. AS WE LOOK AT THE ADJACENCY USES, AGAIN, THREE QUARTERS OF THE SITE SORT OF BORDER MUNICIPAL USES AND MULTIFAMILY. AND THEN JUST AS WE KIND OF LOOKED AT IT, IT WAS IT WAS A CHALLENGING SITE TO MAKE SINGLE FAMILY WORK. AND SO WE EVALUATED IT AND LOOKED AT A MULTIFAMILY USE. AND THE APPROACH WAS, HOW DO WE DEVELOP MULTIFAMILY AND STILL TAKE INTO ACCOUNT, TRY TO MITIGATE ANY CONCERNS OF WHAT THE IMPACTS WOULD BE TO THE NEIGHBORS IN THE SURROUNDING AREAS. SO WE TRIED TO PULL THE UNITS AS FAR AWAY FROM THAT NEIGHBORHOOD AS POSSIBLE. AGAIN, WE AGREED TO SORT OF PULL BALCONIES OFF SO THERE WON'T BE ANY BALCONIES FACING NEIGHBORS. THE LARGER STRUCTURES, THE BULK OF THE DENSITY IS PULLED TOWARDS THE SOUTH, WHICH IS REALLY ABUTTING COMMERCIAL USES. SO THERE'S VIRTUALLY ALMOST 100FT BEFORE A BUILDING COMES INTO CONNECTION WITH ONE OF THE OR THE ADJACENT SINGLE FAMILY. SO WE DID WHAT WE COULD TO TRY TO TAKE THAT INTO CONSIDERATION. AND I THINK WE'VE HAD SOME REALLY GOOD MEETINGS AND SOME GOOD OPEN DIALOG WITH THE NEIGHBORS

BUT EVEN MORE IMPORTANTLY THAN THAT, WE LOOK AT THE MICRO-MARKETS, AND THESE ARE JUST SOME OF THE EXCITING PROJECTS THAT ARE HAPPENING WITHIN A 2 TO 3 MILE RADIUS OF THE SUBJECT SITE. THESE ARE JUST A LIST OUT OF WHAT THESE ARE. BUT YOU GUYS KNOW THESE PROJECTS. YOU'VE APPROVED THEM.

THE AMPHITHEATER, THE MCKINNEY AIRPORT EXPANSION, SLOAN QUARTERS, KALAHARI RESORT, CANAAN BEACH, J.W. MARRIOTT RESORT. SOME OF THESE ARE WITHIN MCKINNEY, SOME ARE IN ALLEN, BUT THEY'RE ALL VERY, VERY CLOSE BY. WHAT'S MORE IMPORTANT TO US IS THE AMOUNT OF JOBS AND THE TYPES OF JOBS THAT THESE CREATE. WHEN YOU LOOK AT THE MCKINNEY AIRPORT EXPANSION AND THESE ARE JUST PULLED OFF OF ARTICLES AND SIGHTINGS, BUT 1800 EMPLOYEES, THE SUNSET AMPHITHEATER IS ESTIMATED TO PRODUCE 1300 JOBS, SKIPPING OVER SLOAN QUARTERS, WHICH IS A LONG, LONG, MULTI-GENERATIONAL DEVELOPMENT. BUT KALAHARI RESORT, A THOUSAND CANNON BEACH 700. J.W. MARRIOTT 500 OVER 5300 JOBS WITHIN AGAIN A 2 TO 3 MILE RADIUS. AND WHEN WE LOOK AT THESE JOBS, THESE ARE JOBS THAT ARE HOTEL EMPLOYEES.
