WE THANK YOU FOR THE OPPORTUNITY TO HELP STEWARD THE CITY AND ITS MANY GREAT PEOPLE AND GREAT, TALENTED PEOPLE. WE ASK YOU TO BLESS THIS COUNCIL, HELP US MAKE WISE DECISIONS. WE ASK YOU TO BLESS ALL THE PEOPLE OF MCKINNEY, ESPECIALLY THIS WEEKEND AS WE'RE GETTING BAD WEATHER. THANK YOU. COUNCILMAN. NEXT ITEM WILL BE THE OPPORTUNITY FOR ANYONE IN THE AUDIENCE TO ADDRESS THE CITY COUNCIL. WE HAVE TWO PEOPLE SIGNED UP. THIS WOULD BE BOTH FOR NON PUBLIC HEARING ITEMS AND ALSO ITEMS ON OUR AGENDA. FIRST ITEM, FIRST NAME IS DENTON. WOULD. MISTER WOULD. MAYOR AND CITY COUNCIL. GOOD EVENING. MY NAME IS DENTON. WOULD I RESIDENT OF AND REGISTERED VOTER IN THE CITY OF MCKINNEY. I HAD HOPED TO SPEAK AT THE END OF THE MEETING BECAUSE IT'S ABOUT SOMETHING DURING THE MEETING, BUT I'LL JUST TRY TO SPEAK ABOUT IT AHEAD OF TIME. MY FAMILY'S LIVED HERE SINCE THE 1980S, AND WE HAVE WATCHED THE CITY SWELL TO ITS CURRENT SIZE. I AM VERY GRATEFUL THAT THE CITY HAS TAKEN SEVERAL MEASURES OVER THE YEARS TO MANAGE THIS GROWTH. MOST RECENTLY THE SUSTAINABILITY REPORT PRESENTED THIS EVENING. I AM HERE RIGHT NOW BECAUSE WHILE REVIEWING THE SUSTAINABILITY REPORT ONLINE, I WAS VERY EXCITED TO SEE PUBLIC TRANSIT UNDER THE AIR QUALITY SECTION OF THE REPORT. I WAS SUBSEQUENTLY DISAPPOINTED TO HEAR THAT THE CITY WAS NOT PUBLICLY CONSIDERING FURTHER PARTNERSHIP WITH ANY OF THE PROVEN TRANSIT PROVIDERS IN THE REGION, ALTHOUGH I'M GRATEFUL FOR THE COLLIN COUNTY TRANSIT PROGRAM, WHICH WAS DISCUSSED EARLIER THIS EVENING. AS DISCUSSED, IT IS RUNNING LOW ON FUNDING, WHICH IS SET TO EXPIRE IN A COUPLE OF YEARS. I AM NOT ELIGIBLE TO JOIN THE PROGRAM, UNFORTUNATELY, AND I CANNOT CONVINCE MY GRANDMOTHER TO JOIN IT AS MUCH AS I HAVE TRIED. SHE IS VERY STUBBORN AND HAS ONE MORE APP THAT SHE HAS TO DOWNLOAD. AS WE CONTINUE TO GROW, WE WILL NEED TO FIND BETTER WAYS TO GET CARS OFF THE ROAD TO IMPROVE OUR AIR QUALITY AND TO KEEP PEOPLE FROM BEING STUCK IN THE PARKING LOT THAT IS US 75 DURING RUSH HOUR. I PLAN TO TAKE THE TRAIN TO AUSTIN THIS WEEKEND TO VISIT FRIENDS, SAVING ME GAS MONEY AND REDUCING MY CONTRIBUTIONS TO AIR POLLUTION. HOWEVER, THE TRANSIT PORTION OF MY JOURNEY CAN'T START UNTIL I CONVINCE MY FAMILY OR AN UBER DRIVER TO GET ME TO PLANO. SOME OF YOU MAY BE AWARE THAT THE NORTH CENTRAL TEXAS COUNCIL OF GOVERNMENTS IS CONSIDERING STUDYING A RAIL LINE TO THE CITY OF MCKINNEY. YOU MAY ALSO BE AWARE THAT THIS STUDY WAS PUT ON HOLD BECAUSE OF THE CURRENT TRANSIT UPRISING BEING LED BY OUR NEIGHBOR IN THE COUNTY, THE CITY OF PLANO. THEIR ACTIONS ARE NOT ONLY IMPEDING THE GROWTH OF REGIONAL TRANSIT IN COLLIN COUNTY, THEY ARE THREATENING TO TEAR APART THE LARGEST TRANSIT PROVIDER IN THE METROPLEX, DART. I'LL GET TO THE POINT. THE CITY OF MCKINNEY IS THE SEAT OF POWER IN COLLIN COUNTY. WE HAVE AN OPPORTUNITY TO LEAD OUT IN SHAPING THE FUTURE OF TRANSIT IN OUR COUNTY. THE CITY HAS INVESTED HEAVILY IN CREATING EXCELLENT DESTINATIONS FOR THE COUNTY, INCLUDING THE UPCOMING SUNSET AMPHITHEATER HUB 121, THE MCKINNEY AIRPORT SET TO OPEN SOON, AND THE NEW STANDARD FOR HISTORIC DOWNTOWNS DOWNTOWN MCKINNEY. WE HAVE TO FINISH THE EFFORT TO CONNECT THE COUNTY AND THE ENTIRE METROPLEX TO THESE DESTINATIONS TO SEE LARGE ECONOMIC RETURNS AND CLOGGED HIGHWAYS ARE NOT GOING TO CUT IT. THE CITY NEEDS TO TAKE A STAND FOR REGIONAL TRANSIT AND SUPPORT PROVEN PROVIDERS WHO MOVE PEOPLE DAILY, NOT COSTLY MICROTRANSIT SOLUTIONS WHICH CAN LEAVE PEOPLE STRANDED. PLEASE SUPPORT DART IN THIS CURRENT FIGHT AND PLEASE CONSIDER A GREATER PARTNERSHIP WHICH WILL BENEFIT THE CITY FOR DECADES TO COME. THANK YOU. THANK YOU, MR. WOOD. NEXT SPEAKER, ROBERT DICK. BOBBY

DICK MCKINNEY, RESIDENT AND REPRESENTING MY IN-LAWS, CHARLES AND LINDA DOUGLAS. AND THEY LIVE AT 801 COUNTRY CLUB ROAD. WE'VE HAD NUMEROUS MEETINGS WITH THE CITY OF MCKINNEY DRAINAGE, AS WELL AS THE TOWN OF FAIRVIEW, TEXDOT, AND BASICALLY STODDARD ROAD, WHICH IS IN FRONT OF MY IN-LAWS PROPERTY. THERE'S SEVEN DRAINAGES THAT COME INTO A 48 INCH PIPE THAT THEN COME UNDER COUNTRY CLUB AND THEN POUR ONTO THEIR PROPERTY. THE SIGNIFICANCE IS ABOUT A THIRD OF THE PROPERTY IS UNDER WATER. ANYTIME WE HAVE RAIN, THEY HAVE 30 ACRES. LAND HAS BEEN IN THEIR FAMILY FOR 150 YEARS. PECAN TREES, ALL THE EROSION, IT'S TERRIBLE. AND TEXDOT AND TOWN OF FAIRVIEW HAVE MET. AND SUPPOSEDLY OUR CITY MANAGER HAS SOME DIRECTION. I'VE MADE NUMEROUS EMAILS AND PHONE CALLS WITH NO RESPONSE. THE DRAINAGE TEAM HAS REACHED OUT AND SAID THAT THERE'S SOME DISCUSSION. I'M JUST ASKING THE MAYOR AND THE CITY COUNCIL FOR SOME HELP. MY IN-LAWS ARE IN THEIR 80S AND THE PICTURES ARE TERRIBLE. AND MARCH AND APRIL ARE COMING, AND THERE'S NEW TRAFFIC PEDESTALS THAT HAVE BEEN INSTALLED.

THERE'S A BAR DITCH IN WHICH THE CULVERTS HAVE BEEN INCREASED IN SIZE. YOU INCREASE THE SIZE OF CULVERTS UNDERNEATH THE DRIVEWAYS, BOTH ON OUR PROPERTY, WHICH IS RIGHT NEXT DOOR, AND THEIR PROPERTY, WHICH ALLOWS WATER TO GO UNDERNEATH THE DRIVEWAY. THAT'S WHAT IT'S MADE FOR. WHEN THEY DID THE INITIAL CONSTRUCTION, THEY ALLEVIATED ON THE SOUTH SIDE OF COUNTRY CLUB, A PIPE THAT HELPED ALLEVIATE, YOU KNOW, DEVIATE SOME OF THAT WATER. NOW ALL THAT WATER IS COMING DIRECTLY ONTO OUR PROPERTY. WE DID BUILD A BURN. THAT BURN, THERE WAS A CITY CODE VIOLATION. AND AGAIN, THE CITY OF MCKINNEY DRAINAGE TEAM WAS AMAZING, ALLOWING US AND HELPING US TO FOLLOW THE PROCESS TO MAKE SURE THAT THAT CODE VIOLATION WAS NOT DONE. THE ONLY REASON THAT BURN WAS PUT IN PLACE WAS TO ALLEVIATE SOME OF THAT WATER COMING ON DIRECTLY ONTO THEIR PROPERTY. WE'RE JUST ASKING FOR SOME HELP AND ASKING FOR RESPONSE. I THINK, YOU KNOW, I'M IN THE PROFESSIONAL WORLD. I'VE GOT MILLIONS OF DOLLARS AND LOTS OF PEOPLE UNDER MY RESPONSIBILITY. WHEN I GET AN EMAIL, I RESPOND TO IT. IF I GET A PHONE CALL FROM A CLIENT, I'M GOING TO RESPOND TO IT. I EXPECT THE SAME. THE MAYOR HAS DONE THAT. MR. LYNCH HAS DONE THAT. MR. FRANKLIN HAS DONE THAT. AND I APPRECIATE THAT.

THANK YOU, MR. MAYOR. MEMBERS OF COUNCIL TREVOR MINYARD, ASSISTANT CITY MANAGER. THE TWO ITEMS IN QUESTION ARE. THE FIRST IS A BUDGET AMENDMENT TO ALLOCATE $7.5 MILLION TO THE WATER FUND TO PURCHASE A PIECE OF PROPERTY. THE SECOND ITEM IS THE PURCHASE AND SALE AGREEMENT AND AN INTERLOCAL AGREEMENT WITH THE SCHOOL DISTRICT, MCKINNEY ISD. TO BE SPECIFIC ON A PIECE OF PROPERTY THEY OWN. THE $7.5 MILLION IS A PORTION OF THE TOTAL PURCHASE AND SALE AGREEMENT WITH THE SCHOOL DISTRICT. THE BALANCE OF THAT PURCHASE AND SALE AGREEMENT IS AROUND $11 MILLION IN IN-KIND FUNDING, WHICH IS AN ONGOING AGREEMENT THAT WE ARE RECOMMENDING TO ENTER INTO WITH THE SCHOOL DISTRICT FOR THEIR USE OF SWIM LANES AT THE CURRENT APEX AND AT A FUTURE MULTI-GENERATIONAL FACILITY, VERY LIKELY ON THE SITE OF THE LAND THAT WE'RE RECOMMENDING TO PURCHASE. THIS HAS BEEN A ENDEAVOR THAT THE CITY STAFF AND THE SCHOOL DISTRICT STAFF HAVE BEEN TALKING TO, AND ALSO BEEN BRIEFING BOTH OF OUR RESPECTIVE ELECTED BODIES AND EXECUTIVE SESSION FOR THE PREVIOUS FEW MONTHS. AND IT IS NOW BEFORE YOU. IT IS ALSO BEFORE THE BOARD THIS EVENING AT THE SCHOOL BOARD'S MEETING, THEY HAD A MEETING OF THEIR BOARD THIS EVENING AS WELL FOR CONSIDERATION. SO WE'RE RECOMMENDING YOUR APPROVAL NOT ONLY OF THE BUDGET AMENDMENT, BUT ALSO OF THE PURCHASE AND SALE AGREEMENT AND THE ILA, WHICH WILL ALLOW US TO ENTER INTO THAT LONG RANGE USE AGREEMENT WITH THE SCHOOL DISTRICT. I'M HAPPY TO ANSWER ANY QUESTIONS OR FILL IN ANY GAPS THAT I MAY HAVE IN MY ORATORY. SO THE LET ME SUMMARIZE THIS. YOU TELL ME WHERE I'M WRONG. THE 7.5 MILLION IS BASICALLY COMING FROM OUR WATER FUND. WE'RE GOING TO CONSTRUCT HERE SOMETHING THAT WE NEED, WHICH IS A PLACE TO PULL WATER FROM THE NORTH TEXAS MUNICIPAL WATER DISTRICT FOR THE HOUSES AND BUSINESSES AND DEVELOPMENT IN THIS AREA. AND WE KNOW WE'VE KNOWN WE'VE NEEDED THAT FOR SOME TIME, AND WE HAVE OTHER AREAS IN THE CITY THAT WE DO THAT. CORRECT? THAT'S CORRECT. IT'S GREAT THAT YOU POINT THAT OUT. WE ARE GOING TO DEVELOP A FIFTH, WHAT'S CALLED A FIFTH TAKE POINT ON THE LOCATION OF THE LAND THAT WE'RE PURCHASING. THAT FIFTH TAKE POINT HAS BEEN IDENTIFIED AS A NEED IN OUR WATER SYSTEM FOR SOME TIME NOW, WITH NO RESPECT TO THIS LAND TRANSACTION IN THIS GENERAL AREA OF THE CITY, WE WERE TRYING TO LOCATE LAND, TO BE ABLE TO BUY DOWN, TO BE ABLE TO DEVELOP THE FIFTH TAKE POINT. THE SCHOOL DISTRICT COME TO CAME TO US ON THE USE OF AN AQUATICS FACILITY THAT MAY BE DEVELOPED THERE OR THEREABOUTS. AND IT JUST SO HAPPENED TO BE IN THE SAME SECTION OF THE CITY THAT WE NEEDED TO DEVELOP THE FIFTH TAKE POINT. THAT'S WHERE THE WATER FUNDING COMES INTO PLAY. IN THE EVENT THAT THERE'S EXCESS ACREAGE THAN WHAT THE FIFTH TANK POINT NEEDS, OTHER CITY USES MAY BE DEVELOPED ON THAT PIECE OF PROPERTY. IF THERE ARE OTHER CITY USES DEVELOPED ON THE PROPERTY, THOSE CITY USES WILL REIMBURSE THE WATER FUND IN KIND. OKAY, SO THE WATER FUND WILL BE REIMBURSED FOR LAND THAT IT WINDS UP NOT USING FOR THE TAKE POINT, WHETHER THAT'S PUBLIC WORKS OR PARKS OR SOMETHING ELSE THAT MIGHT MANIFEST. SO I THINK IT'S FAIR TO SAY FROM OUR ROUGH ANALYSIS, THAT THIS WAS A GOOD OPPORTUNITY FOR THE TAXPAYER TO BE ABLE TO PAY A RELATIVELY MODEST AMOUNT FOR THIS AMOUNT OF ACREAGE, THE IN-KIND USE BEING SOMETHING GOOD, BECAUSE WE HAD THE PARKS BOND PASSED THAT INCLUDED THIS MULTI-GENERATIONAL SLASH APEX FACILITY. SO THIS IS KIND OF COMBINING A LOT OF THINGS INTO ONE THAT WE ARE OPTIMISTIC AT THIS POINT IS GOING TO BE ACCRETIVE TO THE TAXPAYER IN TERMS OF, YOU KNOW, A REDUCED COST ON EVERYTHING BY LUMPING THE STUFF ALL TOGETHER ON THIS LAND.
