SO IMPACT FEES, UM, JUST TO COVER THE, SOME OF THE BASICS, UH, ARE A ONE-TIME FEE, UH, ASSESSED TO NEW DEVELOPMENT.
SO THEY'RE NOT RECURRING FEES AND THEY'RE ALSO NOT ASSESSED TO, UH, CURRENT, UH, RESIDENTS UNLESS OF COURSE THEY'RE ALSO DEVELOPING PROPERTY WITH HIM.
UM, IT'S LARGELY DESIGNED AS A MECHANISM TO, UH, RECOVER INFRASTRUCTURE COSTS REQUIRED TO SERVE NEW DEVELOPMENTS.
UH, IT'S NOT FOR, YEAH, LIKE AN EXISTING, UM, EXISTING NEEDS.
UH, AND IT'S A LEGAL WAY TO COLLECT A FLEXIBLE FEE FOR INFRASTRUCTURE, UH, TO GIVE THE CITY FLEXIBILITY TO SPEND THOSE FUNDS ON HIGH PRIORITY PROJECTS THAT ARE, THAT ARE ON THE, UH, CAPITAL IMPROVEMENT PLANS.
UM, THIS, THERE'S A LIST ON THIS SLIDE THAT'S DIRECTLY FROM, UH, CHAPTER 3 95 OF THE TEXAS LOCAL GOVERNMENT CODE.
UH, WHICH STIPULATES WHAT IMPACT FEES CAN BE USED TO FUND AND WHAT THEY CAN'T BE USED TO FUND.
UH, PRIMARILY IT'S CONSTRUCTION COSTS AND ANY, UH, FEES THAT GO ALONG WITH, WITH CONSTRUCTION SUCH AS SURVEY AND ENGINEERING.
ALSO, UH, LAND ACQUISITION AND COURT REWARDS, UH, DEBT SERVICE FOR THE IMPACT FEE, UH, PROJECTS THEMSELVES.
SO THE IMPACT FEES CAN BE USED FOR THE IMPACT FEE REPORTS THEMSELVES.
WHAT THEY CAN'T FUND, UH, THEY CAN'T FUND, UH, PROJECTS THAT ARE NOT INCLUDED IN THE IMPACT FEE.
CIP, UH, THEY CAN'T BE, THEY CAN'T FUND REPAIR OPERATION OR MAINTENANCE OF EXISTING FACILITIES UPGRADES TO SERVE EXISTING DEVELOPMENT OR ADMINISTRATIVE COSTS OF OPERATING THE IMPACT FEE PROGRAM.
UH, SO SOME, WHAT ARE SOME OF THE REASONS THAT CITIES WILL CONTINUE TO, LIKE MCKINNEY WILL CONTINUE TO USE IMPACT FEES IS THAT THEY'RE EQUITABLE, MEANING THAT, UM, ARE ANY, ANY EXISTING ORDINANCES DEVELOPMENT PAYS THE SAME FEE, WHETHER THEY'RE THE FIRST DEVELOP OR LAST DEVELOP, UH, OFTEN, UH, IN THE PAST BEFORE IMPACT FEES, THE FIRST DEVELOP OFTEN, UH, BEARED A HIGHER BURDEN OF THE COST OF THAT INFRASTRUCTURE.
SO IMPACT FEES ARE DESIGNED TO HELP SPREAD THAT OUT, UM, A LITTLE BIT MORE, A LITTLE BIT MORE EVENLY.
UH, THEY'RE, THEY'RE PREDICTABLE SO THAT THE FEE SCHEDULES ARE AVAILABLE ONLINE SO THAT, UM, DEVELOPERS CAN SEE THOSE FEE SCHEDULES.
UH, WHEN, WHEN THEY'RE LOOKING AT PROPERTIES, UH, LOOKING TO COME INTO CITY OF MCKINNEY, UH, THEY ASSURE ACCOUNTABILITY.
SO STATE LAW, UH, GOVERNS ALMOST EVERY ASPECT OF HOW THE IMPACT FEE STUDIES ARE DONE, HOW THEY'RE ADOPTED, AND THEY'RE REQUIRED, UH, THE FEES ARE REQUIRED TO BE SPENT WITHIN A CERTAIN AMOUNT OF TIME OR TO BE REFUNDED TO THE PROPERTY OWNER.
UH, ALSO THAT THEY'RE, THEY'RE PROPORTIONAL.
THAT'S WHAT THE BULK OF OUR WORK AS CONSULTANTS IS TO DO, IS TO MAKE SURE THAT THE FEES THAT, UH, MCKINNEY'S ALLOWED TO ASSESS ARE PROPORTIONAL TO THE DEMAND THAT'S, UH, COMING IN AND, AND THE INFRASTRUCTURE NEEDS IN THE CITY.
UH, JUST A FEW THINGS ABOUT, UM, ARE THERE ANY CHECKS AND BALANCES TO MAKE SURE THIS IS BEING DONE CORRECTLY? AGAIN, I ALREADY MENTIONED, UH, CHAPTER 3 95, THE LOCAL GOVERNMENT CODE, UH, STIPULATES ESSENTIALLY HOW THESE ARE TO BE DONE AND THE CITY CONTRACTS WITH, UH, OUTSIDE PROFESSIONALS TO, UH, LIKE US TO DO THE LAND ASSUMPTIONS, UH, CAPITAL IMPROVEMENT PLANS, MA UH, MASTER PLANS AND THE MAXIMUM IMPACT FEE CALCULATIONS.

AND THAT ROLE IS TO ADVISE AND ASSIST THE CITY COUNCIL IN ADOPTING LAND USE ASSUMPTIONS.
IT'S TO REVIEW THE CAPITAL IMPROVEMENT PLAN, UH, CAPITAL IMPROVEMENT PLANS AND FILE WRITTEN COMMENTS.
UH, ESSENTIALLY THAT'S THE MAIN DELIVERABLE FOR THIS GROUP, IS TO PROVIDE WRITTEN COMMENTS TO CITY COUNCIL, UH, BEFORE THE PUBLIC HEARING, UH, WILL EVENTUALLY BE HELD AFTER THE IMPACT FEES ARE ADOPTED.
UH, THIS COMMITTEE ALSO HAS A ROLE, AND THAT'S TO MONITOR AND EVALUATE IMPLEMENTATION OF THE CAPITAL IMPROVEMENTS PLAN, UH, TO FILE SOME ANNUAL REPORTS, UM, WITH REGARDS TO THIS, UH, PROGRESS OF THE CAPITAL IMPROVEMENT PLAN AND REPORT THAT BACK, UH, TO THE CITY.
AND ALSO TO JUST TO ADVISE, UH, COUNCIL OF THE NEED TO UPDATE OR REVISE LAND USE ASSUMPTIONS IF THERE'S A SIGNIFICANT CHANGE IN, IN GROWTH OR THE MARKET, UH, CHANGES SIGNIFICANTLY TO ADVISE COUNCIL THAT THOSE NEED TO BE UPDATED.
UH, DIVING BACK INTO A LITTLE BIT MORE OF THE IMPACT FEES THEMSELVES, UM, ON HOW THEY'RE ADMINISTERED, UH, THEY ARE CURRENTLY ADMINISTERED IN THE CITY, UM, SO I KNOW THE STAFF'S FAMILIAR WITH THEM, UH, BUT JUST TO GIVE YOU A BASIC, UH, LOOK AT HOW THEY'RE ADMINISTERED IS WHEN A DEVELOPMENT COMES IN, THEIR WATER AND SEWER IMPACT FEES ARE BASED ON THE SIZE OF THEIR METER.
SO, AND THAT'S A SINGLE FAMILY EQUIVALENT, UM, COMPARISON.
SO IF YOU'RE HAVE, UH, THE SINGLE FAMILY METER SIZE IS JUST THE STANDARD THREE QUARTER INCH METER.
IF YOU HAVE A LARGER METER, THERE'S A, AN EQUIVALENT, UH, SCALE BASED OFF OF THAT, OF WHAT YOU PAY.
UH, FOR ROADWAY IMPACT FEES, IT'S BASED ON THE TYPE OF LAND USE, UH, THAT THE DEVELOPMENT IS AND HOW LARGE LAND USE IS.
AND THERE'S A TABLE, UH, AND THE ORDINANCE AND, UH, ONLINE TO WHERE YOU CAN GO AND SEE BASED ON HOW LARGE YOUR DEVELOPMENT AND WHAT LAND USE IT IS, THERE'S A MULTIPLIER THAT SHOWS WHAT THE FEE IS, DEPENDING ON WHAT SERVICE AREA YOU IN YOU ARE IN.
SO IT'S, THERE'S A LITTLE MORE TO IT ON THE ROADWAY SIDE, UH, BUT, UH, WE TRY TO MAKE IT AS CLEAR AS POSSIBLE WITH, UH, THE TABLES THAT ARE, UH, INCLUDED IN THE ORDINANCE.
UM, ONE REQUIREMENT THAT'S TRUE OF BOTH ROADWAY AND WATER AND WASTEWATER IS THAT THOSE STUDIES MUST BE UPDATED, UH, EVERY FIVE YEARS IN ORDER TO MAINTAIN COMPLIANCE WITH CHAPTER 3 95.
UM, AND ONE IMPORTANT THING TO POINT OUT IS THAT THERE CAN BE DIFFERENCES BETWEEN THE ASSESSMENT OF THE IMPACT FEE AND THEN THE COLLECTION.
SO THE ASSESSMENT OF THE IMPACT FEE IS ESSENTIALLY THE MAXIMUM FEE.
THAT'S WHAT OUR STUDIES, UH, SAY, IS THE MAXIMUM THAT THAT CAN BE ASSESSED TO A DEVELOPMENT.
THE COLLECTION CAN BE LOWER, UH, AS DETERMINED BY COUNCIL THAN, THAN THE MAXIMUM FEE.
AND, UM, AND THEN IMPACT FEES COLLECTED IN A SERVICE AREA, UH, MUST BE SPENT WITHIN THAT SAME SERVICE AREA.
SO, WE'LL, WE'LL GO OVER SERVICE AREAS HERE, UH, IN A FEW SLIDES FROM NOW.
UH, BUT YOU CAN'T COLLECT FEES IN ONE SERVICE AREA AND SPEND THEM IN A DIFFERENT SERVICE AREA.
UM, SOME, A QUICK OVERVIEW OF SOME OF THE UPDATES THAT WERE MADE, UH, IN RECENT LEGISLATION FROM LAST YEAR IS THERE'S SOME INCREASED, UH, PUBLIC INVOLVEMENT REQUIRED IN THE ADOPTION PROCESS.
UH, PREVIOUSLY, UH, UH, AN ADVANCED NOTICE WAS REQUIRED 30 DAYS BEFORE, UH, PUBLIC HEARING WAS TO TAKE PLACE, AND THE REPORTS WERE TO BE MADE AVAILABLE ON OR BEFORE THAT DAY.
NOW THE REPORTS NEED TO BE MADE AVAILABLE ON THE CITY WEBSITE 60 DAYS BEFORE THAT NOTICE GETS SENT OUT.
SO EFFECTIVELY, 90 DAYS BEFORE THE PUBLIC HEARING, A LOT MORE TIME FOR REVIEW.
UH, THERE'S ALSO, UH, INCREASED LIMITATION ON HOW OFTEN THE FEES CAN BE INCREASED.
UH, SO AT MINIMUM NOW FEES CAN BE INCREASED, NO, UH, NO MORE THAN, UH, NO SOONER THAN THREE YEARS FROM THE LAST TIME THEY WERE INCREASED.
UH, HOWEVER, THERE'S A STIPULATION THAT A PROGRAMMED ESCALATION IS ALLOWED IF THAT'S DECIDED, UH, AT THE TIME OF ADOPTION BY, UH, COUNSEL.
UM, ADDITIONALLY, UH, Y'ALL ARE PROBABLY WELL AWARE NOW THAT THERE'S, UH, REQUIRE NEW REQUIREMENTS ON THE CIAC ON HOW THAT THIS GROUP IS COMPOSED AND, AND HOW, UH, REPRESENTATION FROM REAL ESTATE DEVELOPMENT AND BUILDING INDUSTRIES IS NOW, UH, 50% MINIMUM, USED TO BE 40%.
UM, AND, UH, THE P AND Z CAN NO LONGER ACT AS DE FACTO CIC.
UH, THE LAST TWO THINGS THAT ARE PART OF THE RECENT LEGISLATION INCLUDE AN EXTERNAL, UH, FINANCIAL AUDIT, WHICH THE CITIES ARE UNDERGOING RIGHT NOW TO JUST LOOK AT HOW THE IMPACT FEE PROGRAM HAS BEEN ADMINISTERED, UH, IN THE PAST, AND HOW THOSE, UH, FUNDS HAVE BEEN ALLOCATED AND

HOW THOSE PROJECTS HAVE BEEN, UH, BUILT, UH, ON THE, ON THE CIP.SO GOING THROUGH THAT PROCESS AND THOSE RESULTS WILL BE, UH, PROVIDED, UH, TO THIS GROUP LATER ON IN THE PROCESS.
UM, AND THE LAST ONE IS IMPACT FEE CREDITS.
UH, SO CITIES THAT CHARGE WATER AND WASTEWATER IMPACT FEES ARE NOW REQUIRED TO PROVIDE A MEANS WHERE CREDITS CAN BE OFFERED TO DEVELOPMENT, UM, FOR, UH, THAT DEMONSTRATE WATER CONSERVATION AND REUSE TECHNOLOGIES AS PART OF THEIR DEVELOPMENTS.
I'M GONNA GO INTO SOME OF THE COMPONENTS OF THE STUDIES THEMSELVES ON AND HOW WE DO THEM BEFORE WE, UH, DIVE INTO THE DRAFT LAND USE ASSUMPTIONS.
UH, SO THOSE COMPONENTS INCLUDE THE SERVICE AREAS, THE LAND USE ASSUMPTIONS, SERVICE UNITS, CAPITAL IMPROVEMENT PLANS, AND THE MAXIMUM FEE FOR SERVICE AREAS.
UH, CHAPTER 3 95 REQUIRES THAT FOR ROADWAY IMPACT FEES, THERE'S A SIX MILE LIMIT TO THOSE SERVICE AREAS.
IN MCKINNEY, THE SERVICE AREAS, MOST OF THEM ARE SMALLER THAN THAN SIX MILES.
SO WE HAVE 13 SERVICE AREAS IN THE CITY, MCKINNEY CURRENTLY, AND THAT IS PLANNED TO CONTINUE WITH THE ADDITION OF ANNEXATIONS THAT HAVE OCCURRED SINCE THE LAST UPDATE.
UM, AND ONE IMPORTANT DISTINCTION FOR ROADWAY IMPACT FEES IS THOSE SERVICE AREAS CANNOT INCLUDE ANY PART OF THE ETJ.
UH, THEY CAN ONLY INCLUDE THE CITY LIMITS, UH, FOR WATER AND WASTEWATER.
UH, IT'S EVERYWHERE IN THE CITY LIMITS, UH, CAN INCLUDE AREAS IN THE ETJ THAT HAVE SERVICE IN THE WATER OR WASTEWATER CCNS AND, OH, LET ME HIT THAT LAST BULLET POINT REAL QUICK, AND THAT, THAT'S JUST SAYING THAT FUNDS COLLECTED WITHIN A SERVICE AREA, UH, MUST BE SPENT ON PROJECTS IN THAT SERVICE AREA WITHIN 10 YEARS OR BE REFUNDED TO THE, UH, ORIGINAL PAYER.
THIS IS A MAP OF THE SERVICE AREAS FOR THE ROADWAY IMPACT FEES, AND THE, IN THE BLUE, YOU'LL SEE THE CITY LIMITS.
SO SOME OF THE SERVICE AREAS ONLY HAVE, UM, A REALLY SMALL PORTION OF THE CITY LIMITS WITHIN THEM, UH, BUT GENERALLY THEY'RE ALL FAIRLY SIMILAR IN SIZE AND SPREAD OUT THROUGH ACROSS THE CITY.
AGAIN, NO MAJOR CHANGES EXCEPT FOR, UM, ADDING IN SOME ANNEX PROPERTIES SINCE THE LAST STUDY, AND THIS IS THE DRAFT, UH, WATER SERVICE AREA, UH, WE ARE, UH, STAFF IS WORKING WITH FREEZING NICHOLS, UH, AND THERE WILL BE SOME CHANGES TO THE, UH, WATER AND WASTEWATER SERVICE AREAS, BUT THIS IS THE DRAFT, UH, AS OF RIGHT NOW.
SO WE'LL CONTINUE TO FOLLOW UP WITH THIS GROUP TO PROVIDE UPDATES ON THAT.
