4. PUBLIC HEARING ITEMS:
4.1 FILIPINO ASSEMBLIES OF THE FIRST BORN EG-11-010 - CONDITIONAL USE PERMIT; (Adam Petersen, Planner). A Conditional Use Permit (CUP) to operate a church composed of four existing structures on the property totaling 12,596 square feet. The applicant is proposing to construct a twenty-foot wide fire apparatus road along the northern portion of the property, with a hammerhead turning point. Access to the site is from Waterman Road at the northern end of the property. The project site is located at 8933 Bradshaw Road APN 127-0040-031. Recommendation: The Planning Commission adopt a resolution finding the Filipino Assemblies of the First Born - Conditional Use Permit project (EG-11-010) exempt from CEQA under State CEQA Guidelines Section 15301(a) (Existing Facilities), subject to the findings contained in the draft resolution; and approve a Conditional Use Permit for the Filipino Assemblies of the First Born project (EG-11-010) subject to the findings and conditions of approval contained in the draft resolution.
4.2 LARGE FORMAT RETAIL ESTABLISHMENT ORDINANCE; (Christopher Jordan, Planning Manager). The Planning Commission will consider making a recommendation to the City Council to adopt an Ordinance amendment Title 23 of the Municipal Code to modify the descriptions of certain land use categories, including "convenience store;" "neighborhood market;" "grocery store/supermarket;" "retail, discount store;" "retail, discount superstore;" "retail, general;" "retail, large format discount superstore;" and "retail, discount warehouse/club." The purpose of the modifications is to provide clear definitions and eliminate the possibility that any given retail establishment be classified under more than one category. The Ordinance would also create a new land use category called "retail, department store." As part of these changes, the Ordinance would modify the square footage ranges and percent of total floor area that is dedicated to non-taxable goods that define these various uses. In addition, the requirement for Conditional Use Permits will be clarified and updated, as needed. Recommendation: The Planning Commission adopt a Resolution recommending that the City Council find the proposed amendments to Title 23 of the Elk Grove Municipal Code exempt from the California Environmental Quality Act pursuant to Section 15061(b)(3), subject to findings contained in the August 4, 2011 staff report; and a Resolution recommending that the City Council adopt an Ordinance amendment Title 23 of the Elk Grove Municipal Code regarding land use category descriptions and allowed use provisions for Large Format Retail Establishments, subject to the findings contained in the August 4, 2011 staff report.
