[00:00:06]

WE'RE IN COUNCIL CHAMBERS AT 2 22 NORTH TENNESSEE STREET IN THE GREAT CITY OF MCKINNEY AND PEONS IF YOU LIKE TO CALL YOURS MEETING. PRESENT OF THE PLANNING AND ZONING COMMISSION AND WE WILL BE READY TO WORK. RIGHT? FIRST ORDER OF BUSINESS IS PUBLIC COMMENTS ON AGENDA ITEMS. AND I DO NOT SHOW ANYBODY ON MY LIST. BUT, UH HAVE ANYWAY. NOBODY HAS SIGNED UP TO SPEAK. WE WILL NOW MOVE. TO OUR AGENDA ITEM. 200838 UPDATE ON NEW CODE MCKINNEY INITIATIVE DEVELOPMENT
[Update on the New Code McKinney Initiative (Development Regulations Update)]
REGULATIONS. UPDATE JENNIFER ARNOLD, HOWEVER YOU THANK YOU, MR MAYOR, JENNIFER COLONEL DIRECTOR OF PLANNING. I'M GOING TO BE JOINED TONIGHT WITH AARON BLOXHAM, OUR LONG RANGE PLANNING MANAGER TO PROVIDE A BRIEF UPDATE ON OUR. CODE OVERHAUL INITIATIVE KNOWN AS NEW CODE. MCKINNEY. WE WERE HOPING THAT OUR CONSULTANT WITH CLEARY ON WOULD BE JOINING US TONIGHT. THEY ARE LOCATED IN DENVER. ONE OF OUR TEAM MEMBERS ENDED UP COMING DOWN. WITH SOME SYMPTOMS, AND SO THEY WERE UNABLE TO TRAVEL, SO WE'LL BE TAKING POINT ON THIS PRESENTATION TONIGHT, BUT WE'RE EXCITED TO BE HERE. UH THIS IS HOPEFULLY GOING TO BE THE FIRST IN A SIRI'S OF INTERACTIONS THAT WE HAVE WITH BOTH THE COUNCIL. AND A JOINT SESSION OF PLANNING AND ZONING AS WE START TO REALLY DIG INTO THE MEAT AND DEVELOPMENT OF OUR CODE OVERHAUL PROJECT, SO SOME OF YOU HAVE HEARD SOME OF THIS PRESENTATION BEFORE THROUGH OUR OUTREACH WITH THE DEVELOPMENT COMMUNITY THROUGH OUR M D. C. A CZ WELL AS JUST BEING OUT THERE ON THE STREET, SO I APOLOGIZE IF ANY OF IT IS REPETITIVE, BUT WE ARE EXCITED TO JUMP INTO THE FIRST SECTION OF OUR NEW CODE. A CZ WERE DEVELOPING IT. SO WITH THAT ERIN'S GONNA COME PROVIDE A BIT OF A BACKGROUND GET EVERYBODY UP TO SPEED ON WHERE WE'VE BEEN, AND THEN I'LL JUMP BACK IN AND DIG INTO SOME DETAILS. GOOD EVENING COUNCIL. GOOD EVENING. MISSION OF HERS COULD BE HERE TO AMERICA BLOCKS AND LONG RANGE PLANNING PLANNING MANAGER HERE WITH CITY MCKINNEY. IT'S GOOD TO BE HERE TALKING ABOUT THE NEW CODE, MCKINNEY AND THE ADMINISTRATION PROCEDURE SECTION GIVING YOU AN UPDATE ON THAT. EXCITED NOT TO BE TALKING ABOUT IMPACT FEES FOR TWO MINUTES. SO TODAY, I JUST WANT TO GIVE A REMINDER KIND OF WHAT THE GOALS ARE FOR THE PROJECTS AND THEN WE'LL TALK A LITTLE BIT OF BACKGROUND SO REALLY LOOKING TO IMPLEMENT THE ONE MCKINNEY 2040 PLAN THAT'S ALWAYS BEEN THE BIG FOCUS FOR REGULATIONS. I WANT TO SIMPLIFY THE REGULATIONS INTRODUCED FLEXIBLE TOOLS. WE'VE HEARD THAT QUITE A BIT, UH, USER FRIENDLINESS. THAT'S A BIG KEY TO THIS IS MAKING SURE THAT OUR ORDNANCE IS USER FRIENDLY. UM ANYONE WHO HAS HAD TO DEAL WITH IT? I'M SURE YOU UNDERSTAND SOME OF THE CONFUSION THAT WE'VE HAD. IMPROVED PROCESSES AND PROCEDURES WILL TALK A LITTLE BIT ABOUT THAT TONIGHT FROM THE HIGH HIGH LEVEL STOP GENERAL TALK OVER A LITTLE THOSE POINTS TODAY. REALLY ENCOURAGING HIGH QUALITY AND MIXED USE DEVELOPMENT WITHIN THE CITY.IT'S ANOTHER GOAL THAT WE HAVE FOR THIS INTEGRATING BEST PRACTICES AND CURRENT TRENDS ON DH, THEN ALIGNING WITH FEDERAL AND STATE LAW. ALWAYS A KEY TO MAKING A SUCCESSFUL DEVELOPMENT CODE. SO IF YOU WERE CALLED THIS PROBABLY SOMETHING YOU'VE SEEN BEFORE, BUT IT'S BEEN A LITTLE WHILE. THIS IS THE OVERALL PROBE. THE OVERALL PROJECT SCOPE IN TIMELINE.
WE'RE HERE IN THE ADMINISTRATION OF PROCEDURE SECTION. WE'RE KIND OF. BETWEEN BOTH 12 ON THIS. IF YOU REALLY WANT TO LOOK AT IT THAT WAY. WE'VE ALSO BEEN DOING REVIEW ON ARIZONA DISTRICT'S AND USES SECTION. SO JUST KIND OF A LOOK BACK OF WHAT WE'VE DONE UP TO THIS POINT AND KIND OF WHERE WE'RE HEADED. SO BACK IN SUMMER OF 2019. THIS IS REALLY WHEN WE GOT KICKED OFF FOR THIS PROJECT. A LOT OF STAKEHOLDER INTERVIEWS. WE HOSTED SURVEYS ONLINE. WE CREATED THE WEBSITE AT THAT TIME. THAT WAS ALL DURING THAT SUMMER. THEN WE MOVED IN THE CODE ASSESSMENT PHASE, WHICH WAS IN THE FALL AND WINTER OF 2019. I REALLY HAVE THE PROJECT TEAM GO THROUGH AND ASSESS THAT. CURRENT REGULATIONS AND KIND OF READ A REPORT AS TO WHAT WAS HAPPENING. GOING ON AT THAT TIME MOVING KIND OF THERE TO KIND OF SOME OF THE SHORT TERM PRIORITY AMENDMENTS. IF YOU REMEMBER WE HAD LEGISLATIVE UPDATES THAT WERE ADOPTED. SHOT CLOCK IS ONE OF THOSE THAT GOT ADOPTED THAT TIME STAFF AMENDMENTS WERE ALSO ADOPTED IN NOVEMBER OF 2019. SO WE'VE BEEN DOING WORK ON THAT. I WOULD KIND OF HIT SOME STALL OUT ON SOME OF THE OTHER SHORT TERM PRIORITY AMENDMENTS WERE REVIEWING PARKING. UPDATES CURRENTLY AND THEN LOOKING AT, UH, PROGRESS ON OUR SIGN CODE UPDATES AS WELL. SO WHERE WE
[00:05:01]
ARE TODAY, I WAS JUST KIND OF GONE THROUGH THE ADMINISTRATION PROCEDURES REALLY HAVE DONE THAT STAFF DRAFT WHERE WE'VE HAD TIME TO REVIEW IT. REVIEW IT WITH OUR CONSULTANT.CLARENCE MADE CHANGES. WE'VE BEEN. REVISING THAT AGAIN, AND WE'RE CREATING THAT PUBLIC DRAFT RIGHT NOW. WE'VE MET WITH THE MDC AND GIVEN THIS PRESENTATION TO THEM AS WELL.
SO WHAT? YOU KIND OF SEE FROM US NEXT AS FARAS. THE ADMINISTRATION PROCEDURES IS.
ACTUALLY TAKING THE FINAL DOCUMENT FOR THE PUBLIC DRAFT AND POSTING THAT ONLINE AND HOSTING A SURVEY. JUST KIND OF GET SOME OF THE GENERAL INFORMATION ABOUT THE WAY PEOPLE THINK AND FEEL ABOUT THE NEW ORGANIZATION OF THE DOCUMENT. SOME OF THE THINGS THAT WE'LL TALK ABOUT TONIGHT. I DIDN'T HAVE THIS PRESENTATION WAS CREATED BEFORE. WEI HAD AN UPDATE TO THE ZONING DISTRICTS. WE ACTUALLY HAVE FINISHED OUR STAFF DRAFT REVIEW. FOR THE ZONING DISTRICTS AND USES SO THAT'S ACTUALLY BACK WITH CLARION RIGHT NOW, SO THEY'RE MAKING REVISIONS THAT SO AS WE MOVE FORWARD, WILL KIND OF SEE CEM CEM. NEW CHANGES ON THAT.
WE'RE EXPECTING AND ANTICIPATING THAT YOU KIND OF BE BEFORE YOU LIKE JENNIFER SAID IN THE NEXT FEW MONTHS AROUND NOVEMBER, DECEMBER TIME FOR HIM TO KIND OF SHOW YOU SOME OF THE PUBLIC DRAFT. FOR THE FOR THE ZONING DISTRICTS AND USE AND SO AS WE MOVE ON, WITH THAT I'M GOING TO TURN IT BACK OVER TO JENNIFER, AND SHE'S GONNA WALK THROUGH SOME OF THE DETAILS. OF THE ADMINISTRATION PROCEDURES. HEIDI TELL WHAT WE'VE GOT SO FAR. ACTUALLY GOING TO GO BACK TO SLIDES AND LINGER ON THIS ONE FOR JUST A FEW MINUTES. I THINK AARON DID A GREAT JOB OF TALKING ABOUT SOME OF THE THINGS THAT WE'VE BEEN DOING OVER THE LAST YEAR. UM, AND A LOT OF THAT HAS BEEN CENTERED AROUND LAYING THE FOUNDATION FOR INFORMING WHAT THE NEW CODE ACTUALLY LOOKS. FEELS AND FUNCTIONS LIKE. AND SO IT MAY SEEM LIKE WE'VE BEEN IN A BLACK HOLE FOR A PERIOD OF TIME. BUT THERE'S BEEN A LOT OF THINGS HAPPENING FOR US INTERNALLY WITH OUR CONSULTANT TEAM DOING ALL THAT OUTREACH THE CREATION OF THAT ASSESSMENT REPORT. EYES ACTUALLY A REALLY CRITICAL STEP IN THIS PROCESS BECAUSE IT INFORMS AGAIN. WHAT CHANGES WE REALLY ARE LOOKING AT IN HIGHLIGHTING IN OUR CODE, I THINK IF WE WERE TO TALK TO ANYBODY INDIVIDUALLY. OR IS A STAFF MEMBER? WE COULD SAY, I GUESS WE KNOW WE WANNA LOOK AT THIS LITTLE THAT WE WANT TO CHANGE THIS. WE WANT TO CONSOLIDATE THESE THINGS. THERE'S A LOT OF THAT INFORMATION IN THAT ASSESSMENT REPORT REALLY HELPS TO FRAME ALL OF THOSE THINGS IN A ONE COMPREHENSIVE DOCUMENT THAT HELPS US MOVE FORWARD. MOVING OUT OF THAT WE'RE ACTUALLY MOVING INTO THE FUN. THE REALLY FUN PART OF THIS, WHICH IS CREATING WHAT COULD EVENTUALLY BECOME OUR NEW SET OF DEVELOPMENT REGULATIONS AND WHEN WE'RE TALKING ABOUT DEVELOPMENT REGULATIONS. WE'RE TALKING ABOUT OUR ZONING ORDINANCE AND OUR SUBDIVISION ORDINANCE, AND WE'RE ALSO TALKING ABOUT A SET OF SORT OF ANCILLARY ORDINANCES THAT THE CITY HAS THAT REGULATE HOW DEVELOPMENT OCCURS IN THE CITY. THINGS LIKE. CONSTRUCTION PERMITS AND SIGNS AND LIGHTING.
ALL OF THOSE THINGS ARE PART AND PARCEL TO DEVELOPMENT IN THE CITY, AND SO WE'RE LOOKING AT ALL OF THOSE AS WE'RE GOING THROUGH THIS. AND MOVING INTO THIS NEXT PHASE. YOU SEE THESE DOTS, 12 AND THREE WERE PRESENTING THOSE TWO PEONS E AND THE COUNCIL AND OUR DEVELOPMENT COMMUNITY IN WHAT WE CALL MODULES OR SECTIONS SO THAT WE'RE FOCUSING ON ONE BITE AT A TIME AS WE'RE GOING THROUGH THIS DEVELOPMENT CODE, AND SO TONIGHT WE'RE PRESENTING WHAT THE RECOMMENDATIONS ARE FROM OUR CONSULTANT AS WELL. A STAFF ON IMPROVING THIS ADMIN AND PROCEDURES COMPONENT TO OUR NEW DEVELOPMENT CODE. ADMITTEDLY THIS IS NOT THE SEXIEST PART OF OUR CODE, BUT IT IS ONE OF THE MOST IMPORTANT BECAUSE IT IS WHAT MAKES THIS PROCESS A LITTLE BIT EASIER FOR THE STAFF TO ADMINISTER AND FOR THE DEVELOPMENT COMMUNITY. TO UTILIZE AND FOR THE GENERAL PUBLIC TO UNDERSTAND HOW DEVELOPMENT IS ACTUALLY OCCURRING IN THE CITY. SO BEFORE WE JUMP IN THE SEA. I WANT TO HIGHLIGHT A COUPLE OF THE MAIN ELEMENTS THAT CAME OUT OF THAT ASSESSMENT REPORT. THESE WERE THE TOP FIVE FINDINGS ON THAT OUR DEVELOPMENT TEAM IDENTIFIED THROUGH THESE INTERVIEWS AND ONLINE SURVEYS THAT WE DID THROUGHOUT THE END OF LAST YEAR. ON THE ADMINISTRATION AND PROCEDURE SECTION OF A NEW CODE ARE REALLY HITTING AT THOSE FIRST TWO ITEMS ON THIS LIST, WHICH IS CREATING A MORE USER FRIENDLY CODE AS WELL. A SIMPLIFYING PROCEDURES DIGGING INTO HOW OUR ZONING DISTRICTS FUNCTION ARE USE REGULATIONS IN OUR DEVELOPMENT STANDARDS.
THOSE WILL COME IN THE NEXT TWO MODULES. AND HIS ERRAND MENTIONED. WE HAVE ALREADY BEEN THROUGH A DRAFT AND REVISION WITH OUR CONSULTANT ON THOSE USES AND DISTRICT SECTION. WHAT WE CALL OUR INTERNAL STAFF REVIEW OF THAT. OUR EXPECTATION IS THAT WILL BE MAKING THAT SORT OF OUR PUBLIC PRESENTATION OF THAT INFORMATION LATER THIS YEAR IN THE DECEMBER I'M SORRY THAT NOVEMBER AND DECEMBER TIME FRAME SO. THAT IS TO COME ON. AND SO THERE MAY BE SOME QUESTIONS THAT WE HAVE TONIGHT THAT ARE RELATED TO OUR CERTAIN ZONING DISTRICTS OR YOU STANDARDS AND OUR ANSWER MIGHT BE. WE'RE JUST GONNA HAVE TO WAIT UNTIL WE GET TO THAT POINT. SO TONIGHT IS REALLY ABOUT HOW THE CODE FUNCTIONS. SO AS WE'RE LOOKING AT CHANGES
[00:10:07]
TO THE ADMINISTRATION AND PROCEDURES FOR THE CITY, THE TWO MAIN THINGS THAT YOU'RE GOING TO SEE AS WE WALK THROUGH WHAT HE SUGGESTED CHANGES ARE OUR AGAIN GERDA BEING MORE USER FRIENDLY, AND THAT'S GOING TO BE GEARED UP THINGS LIKE PAGE LAYOUT AND GRAPHICS. AS WELL AS SIMPLIFYING OUR PROCEDURES, WHICH WE'RE GOING TO BE THE BIG TICKET ITEMS I WOULD SAY ON THESE CHANGES WOULD BE WHAT WE CALL A UNIFIED DEVELOPMENT CODE OR A UDC. UM. MODIFYING THAT DATING SOME OF OUR SUBDIVISION AND PLANNING PROCEDURES AND CREATING A STANDALONE ADMINISTRATIVE MANUAL. SO WE'RE JUST GOING TO HIGHLIGHT A COUPLE OF THOSE THINGS REALLY QUICKLY AND THEN I WILL BE HERE TO ANSWER ANY QUESTIONS THAT YOU MIGHT HAVE. SO IMPROVED A PREVIOUS PAGE LAYOUT. THIS SEEMS KIND OF NONSENSICAL, BUT IN THE LONG RUN, IT ACTUALLY IS A VERY USEFUL IMPROVEMENT ARE CURRENT ORDINANCE IS NOTHING BUT BLACK AND WHITE TEXT. YOU HAVE VERY FEW PICTURES AND IMAGES, IF ANY, AT ALL. AFTER OUR EXISTING CODE. WHAT OUR NEW CODE SHOULD AND COULD LOOK AND FUNCTION LIKE IS GOING TO BE A BIT MORE SEGMENT IN TERMS OF THE WAY THE INFORMATION IS PRESENTED. USING PAGE GREAT, SIMPLE THINGS LIKE PAGE BREAKS, SAID HEADINGS AND TITLES WILL REALLY HELP IMPROVE THE FLOW AND ORGANIZATION OF THE OVERALL REPORT AS WELL AS INTRODUCING GRAPHICS INSTEAD OF TALKING ABOUT WHAT A FRONT YARD SETBACK IS AND WHAT 15 FT IS. WOULD ACTUALLY LOOK AT SHOWING IT OUT ON ON A GRAPHIC SO THAT PEOPLE CAN SEE WHAT WE'RE ACTUALLY REFERRING TO. WHEN WE'RE TALKING ABOUT THESE TYPES OF THINGS. SIMPLIFYING PROCEDURES, AND THIS IS WHERE WE'RE ACTUALLY TALKING ABOUT THE PROCESS THAT PEOPLE ARE GOING THROUGH. THESE ARE SOME OF THE MAIN HIGHLIGHTED COMMENTS THAT ARE DEVELOPMENT CONSULTANT HEARD. THROUGH THE INTERVIEW. PROCESS IS THE FACT THAT THE ORGANIZATION OF THE DOCUMENT OVERALL SIRI'S OF DOCUMENTS CAN BE DIFFICULT. IT'S OFTEN NOT CLEAR WHAT PROCEDURES THEY'RE SUPPOSED TO BE FOLLOWING FOR PARTICULAR PROJECT. AMBIGUOUS CODES. UH, IMPROVING THE ABILITY TO DO MINOR AMENDMENTS OR DELEGATION OF AUTHORITY FOR THINGS THAT ARE SEEMINGLY MINOR. UM REQUIRING A HIGH LEVEL OF DETAIL EARLY ON IN THIS SUBMISSION PROCESS. THIS IS MOST NOTABLY. FOR THINGS LIKE OUR SPECIFIC USE PERMITS AND SOMETIMES WITH RPG ZONING DISTRICT AND A LACK OF A CLEAR OBJECTIVE AND REVIEW CRITERIA, WHICH CAN LEAD TO. CONCERN RISK UNPREDICTABILITY, SO ADMIN AND PROCEDURE SECTION IS GOING TO HIT ON A NUMBER OF THESE, BUT NOT ALL OF THEM. SOME OF THESE ITEMS ARE GOING TO BE ADDRESSED IN THESE ADDITIONAL MODULES THAT WILL LOOK AT A CZ. WE CONTINUE THROUGH A COAT OVER HOME. BUT AS IT RELATES TO THE ADMINISTRATION PROCEDURES, THE NUMBER ONE THING THAT STAFF IS RECOMMENDING WITH OUR CONSULTANT FIRM IS TO CREATE WHAT WE CALL A UNIFIED DEVELOPMENT CODE, AND WHAT THAT DOES IS, IF IT'S ALL THE REGULATIONS IN ONE SPOT.INSTEAD OF HAVING IT PEPPERED THROUGHOUT OUR CODE OF ORDINANCES. SOME OF THEM ARE STAND ALONE, AND PEOPLE ARE FLIPPING AND MOVING AROUND TRYING TO FIGURE OUT WHAT THEY NEED TO KNOW TO DEVELOP THEIR ONE PIECE OF PROPERTY. AND SO UNIFIED DEVELOPMENT CODE IS FAIRLY COMMON IN NORTH TEXAS, AND THROUGHOUT THE STATE. WE DO FEEL LIKE IT WILL BE MAKE A GOOD IMPROVEMENT TO THE OVERALL ORGANIZATION. OF OUR DEVELOPMENT STANDARDS, SO. WHAT YOU SEE UP HERE IS JUST A VISUAL OF HOW WE CONSIDER CONSOLIDATING THAT CODE BECAUSE CERTAIN STANDARDS ARE REGULATED BY DIFFERENT SECTIONS OF OUR STATE LAW. AND CITY ORDINANCES AS WELL. WE DON'T WE'RE NOT RECOMMENDING THAT EVERYTHING IT BLENDED INTO ONE, YOU KNOW, CONTINUOUS DOCUMENT MORE SO IT IS A CONSOLIDATED DOCUMENT WITH VERY SEGMENTED SECTIONS WITHIN IT. SOMEBODY WHO WAS LOOKING FOR INFORMATION ABOUT FENCING. THEY KNOW THEY CAN GO TO THE FENCING SECTION IF THEY'RE LOOKING FOR INFORMATION ABOUT ZONING, THEY KNOW EXACTLY WHERE TO GO ON ZONING RIGHT NOW. IT'S SCATTERED THROUGHOUT A VARIETY OF CHAPTERS IN OUR CODE OF ORDINANCES. COMMON REVIEW PROCEDURES. THIS IS SOMETHING THAT IS NOT REALLY WELL EARNED, NOT OVERLY PRESENT TO PEOPLE WHO ARE WORKING THROUGH THE DEVELOPMENT PROCESS. WE HAVE A SERIES OF FORMS AND CHECKLISTS AND FLOW CHARTS. SCATTERED THROUGHOUT OUR WEBSITE ON IN HANDOUTS THAT WE HAVE IN OUR LOBBY. HOWEVER, IT'S NOT CONSOLIDATED IN ONE SPOT FOR SOMEBODY TOO EASILY. GO, OK, I KNOW I HAVE THIS PROJECT THAT I WANT TO GET THROUGH. WHAT WHAT DO I NEED TO FOLLOW TO DO THAT? WE'RE RECOMMENDING THAT THIS INFORMATION BE FOLDED INTO OUR ADMIN AND PROCEDURE SECTION AS A HIGH LEVEL OVERVIEW FOR SOMEBODY WHO'S JUST WANTING TO GET SOME BASIC INFORMATION ON WHAT TO EXPECT IN THE PROCESS. THE CITY IS WORKING WITH AN OUTSIDE CONSULTANT TO DEVELOP SOME DECISION MAKING ONLINE TOOLS THAT WOULD COMPLEMENT THIS A CZ. WELL, I DON'T KNOW HOW MANY OF YOU ARE FAMILIAR WITH THE CAMINO PROJECT THAT WE'RE WORKING ON. BUT THAT WOULD WORK IN CONJUNCTION WITH THIS SORT OF PROCESS FLOW CHART SO THAT SOMEBODY HAS A BETTER UNDERSTANDING OF WHAT THEY NEED TO DO TO GET THEIR PROJECTS
[00:15:02]
THROUGH THE THROUGH THE CYCLE ON DH HAVE IT READY FOR HOWEVER, THEY ULTIMATELY WANT TO DO. ONE OF THE BIGGER CHANGES THAT WERE RECOMMENDING AS PART OF THIS UPDATE IS MODIFYING THE PLANNING PROCEDURES FOR THE CITY OF MCKINNEY. CURRENTLY, THE CITY OF MCKINNEY IS SOMEWHAT UNIQUE AND HOW WE, UH, HANDLE PLANNING. WE HAVE WHAT WE CALL PRELIMINARY FINAL CLASS AND RECORD PLATZ. OFTENTIMES THE CITY COUNCIL DOESN'T SEE THE PRELIMINARY FINAL PLATZ. THEY'RE TYPICALLY. GIVEN OVER TO THE PLANNING AND ZONING COMMISSION TO CONSIDER AND IN RECORD FLATS ARE TYPICALLY CONSIDERED STAFF APPROVAL. THIS IS NOT COMMON THROUGHOUT NORTH TEXAS. IT WAS SOMETHING THAT WAS DONE FOR THE CITY MCKINNEY.DECADES AGO ON IT'S SOMETHING THAT WE'VE UTILIZED AND IT'S BEEN SUCCESSFUL HERE, BUT IT IS SOMEWHAT INCONSISTENT WITH OUR SISTER CITIES ON DH WITH SOME OF THE CHANGES IN STATE LAW. WE DO RECOMMEND THAT WE ACTUALLY MOVED TO A PLAT. AND I'M SORRY. PRELIMINARY, FLAT AND FINAL PLATT PROCESS. THIS IS VERY COMMON FOR MOST OF OUR OTHER SISTER CITIES IN NORTH TEXAS AND THROUGHOUT THE STATE AND SO IN ORDER TO BE MORE CONSISTENT WITH THEM, WE RECOMMEND THAT THIS CHANGE BE CONSIDERED. IT MAKES US MORE CONSISTENT. IT HELPS TO AVOID CONFUSION FOR FOLKS WHO ARE USED TO DOING PLOTTING ELSEWHERE WHEN THEY'RE COMING IN TO MAKE ANY SOMETIMES WE'RE LIKE, WHAT'S THIS PRELIMINARY FINAL PLOT THING WE'RE DOING HERE? THIS WILL HELP TO ALLEVIATE SOME OF THOSE ISSUES, AND IT ALSO HELPS TO SHORTEN A RE PLATT PROCESS. IF SOMEBODY NEEDS TO COME IN AND MAKE A CHANGE, SO THAT'S SOMETHING THAT THAT WE'RE RECOMMENDING IS PART OF THIS UPDATE. AFRICAN QUICK QUESTION. ABSOLUTELY. SO IS IT FAIR TO SAY THAT? I MEAN, YOU KNOW THE SHOT CLOCK TOOK AWAY A LOT OF YOUR. CHANCES FOR INTERACTION.
IS THIS RESTORE SOME OF THE BRAINSTORMING THAT CAN BE DONE AHEAD OF TIME? WHERE IS THIS? JUST TRY AND MAKE IT FASTER. GOING BACK. YEAH UNFORTUNATELY, IT DOESN'T IT ACTUALLY. ONCE A PLAT IS SUBMITTED IN THAT CLOCK STARTS TICKING FORMALLY. IT DOESN'T REALLY ADDRESS THAT.
WHAT THIS DOES DO IS WITH THE CHANGES IN STATE LAW BECAUSE ACTION IS REQUIRED, AND ACTUALLY, I SHOULD. I SHOULD REPHRASE THAT. APPROVAL OR DISAPPROVAL IS REQUIRED WITHIN 30 DAYS. NOW WHETHER YOU'RE COMING IN WITH THE PRELIMINARY FINAL, PLATT OR A PRELIMINARY, PLATT, YOU KNOW A CERTAINTY NOW THAT YOU'RE GOING TO GET AN APPROVAL OR DISAPPROVAL WITHIN 30 DAYS, SO THE OVERALL TIMELINES. DON'T REALLY SHIFT. IT'S KIND OF LOOKING AT IT FROM TWO DIFFERENT ANGLES. BUT WHAT THE BENEFIT IS MAKING US CONSISTENT WITH OUR SISTER CITIES AND, YOU KNOW, PLANTING GENERALLY IN NORTH TEXAS, SO THAT WE'RE A BIT MORE.
CONSISTENT MAKE IT POSSIBLY EASIER OR BETTER, MORE PREDICTABLE THAT YOU WOULD GET TO FINAL. NOT NECESSARILY. UNFORTUNATELY, ONDA ULTIMATELY. YOU GET WELL, NOW IT'S FINE, YOU KNOW, WITH PLANNING, THERE'S NOT A LOT OF DISCRETION ON STAFF SIDE, WHETHER OR NOT WE RECOMMEND APPROVAL OR DISAPPROVAL. IT REALLY COMES DOWN TO WHAT THE ORDINANCE REQUIRES. AND GETTING THAT PLATT TO MEET THAT ORDINANCE REQUIREMENT ON DSO. THAT'S WHY OFTENTIMES YOU C PLATTS ON THAT CONSENT AGENDA BECAUSE THERE'S NOT DISCRETION IST OR WHETHER OR NOT WE LIKE THE WAY THEY'RE SUBDIVISION SUB DIVIDING THE PROPERTY. IT'S THEIR SUBDIVIDING IT IT MEETS THE REQUIREMENTS OF OUR ORDINANCES, AND SO BY LAW, IT NEEDS TO BE APPROVED. AND SO WE CONSIDER THAT MINISTERIAL IN NATURE AND GIVEN THAT IT'S MINISTERIAL IN NATURE, LET'S BE MORE CONSISTENT WITH OUR SISTER CITY SO THAT WHEN PEOPLE ARE COMING IN TO DO BUSINESS, IT'S A FAMILIAR PROCESS FOR THEM. SO IN PARTNERSHIP WITH ACTUALLY AMENDING OUR CREATING THIS NEW ADMINISTRATION PROCEDURE SECTION AND A NEW DEVELOPMENT CODE WERE ACTUALLY ALSO RECOMMENDING THAT SOME OF OUR COMMON PROCEDURES. BE EXTRACTED FROM THE CODE ITSELF AND PUT INTO AN ADMINISTRATIVE MANUAL. THERE'S A COUPLE OF REASONS FOR THIS ONE IS PROCESS IS DIFFERENT THAN REGULATION. SO THE FACT THAT WE HAVE ONLINE MIDDLES EVERY MONDAY AND THEY HAVE TWO PEOPLE NEED TO SUBMIT ONLINE TO DO THAT. IS NOT A REQUIREMENT OF THE ORDINANCE. IT'S THE WAY IN WHICH WE PROCESS THESE APPLICATIONS THAT COME THROUGH THE DETERMINATION OF WHAT IS ADMINISTRATIVELY COMPLETE WHEN A PLAT COMES THROUGH OUR OUR DOOR IS SOMEWHAT ADMINISTRATIVE IN THE CITY'S DETERMINATION OF IT, AS OPPOSED TO BEING A REQUIREMENT OF THE REGULATIONS. AND RIGHT NOW, OUR CODE HAS ALL OF THESE THINGS TOGETHER, UM, IN OUR ZONING ORDINANCE IN OUR SUBDIVISION ORDINANCE, AND SO WHEN WE NEED TO BE INVALUABLE TO CHANGING TIMES, FOR EXAMPLE, INSTEAD OF HAVING OUR MIDDLE WINDOWS BEING ON MONDAYS, WE WANT TO MAKE THEM ON WEDNESDAYS. IT WOULD REQUIRE US TO COME INTO THE ORDINANCE. MACON ORDINANCE AMENDMENT TO ACTUALLY MAKE THAT CHANGE AND THEN WE COULD DO IT. BUT BYSE IT ALLOWS US TO BE A BIT MORE FLEXIBLE TO MODIFY THOSE TYPES OF PROCEDURAL ITEMS IF YOU WILL. WITHOUT THE NEED TO GO THROUGH AN ORDINANCE AMENDMENT.
[00:20:06]
THERE COULD STILL BE SOME CHECKS AND BALANCES THAT ARE INCLUDED WITH THIS. I WILL POINT TO THINGS LIKE OUR ENGINEERING DESIGN MANUAL. UM, THAT CHECK AND BALANCES AND ENGINEERING DESIGN MANUAL AMENDMENT OR CHANGE HAS TO BE PROVIDED PUBLICLY THROUGH THE CITY SECRETARY'S OFFICE FOR 30 DAYS BEFORE IT BECOMES. FINAL, SO THOSE KINDS OF THINGS CAN STILL BE INJECTED. IF THERE'S A CONCERN THAT YOU KNOW THE CITY'S JUST ALWAYS CHANGING THE RULES ON HOW THIS PROCESS WORKS, BUT THE BENEFIT IS THESE THINGS THAT ARE GENERALLY PROCEDURAL IN NATURE CAN BE STAND ALONE FROM THE REQUIREMENTS OF THE ORDINANCE IN TERMS OF. YOU HAVE TO HAVE A 15 FT SETBACK. YOU HAVE TO HAVE A BUILDING HEIGHT. THESE ARE THINGS THAT ARE RELATED TO HOW ACTUALLY PROCESSING THE ESCAPED CASES. SO ONE OF THE OTHER RECOMMENDATIONS THAT WERE MAKING OUT OF THIS ADMIN IN PROCEDURE SECTION IS TO SEPARATE. PROCESSING PROCEDURE FROM THE REQUIREMENTS OF THE ORDINANCE SO THAT WE'LL HAVE TO STAND ALONE PIECE IS FOR FOLKS TO BE ABLETO TOOK THEM THROUGH. AND THE NEXT STEPS IF IT'S ALL RIGHT HERE AND DISCOVERED THINGS. SORRY WE WERE GOING TO ATTACK TEAM THIS LAST FIVE, BUT IT'S THE LAST ONE. SO I'LL JUST TAKE IT. SO MOVING FORWARD AND I TALKED A LITTLE BIT ABOUT THIS ON THAT PREVIOUS PROCESS. SLIDE. UH, WE'RE PRESENTING SORT OF THE HIGH LEVEL ITEMS ON THESE. THE NEW CODE FOR ADMINISTRATION AND PROCEDURES. IN THE MONTH OF OCTOBER. A FULL DRAFT OF THAT CODE WILL BE PRESENTED ONLINE. WE'LL SEND AN E MAIL OUT ARE PROVIDED IN COUNCIL NOTES WITH THE PLANNING AND ZONING COMMISSION MEETINGS. SO THAT YOU'LL KNOW THAT IT'S AVAILABLE TO ACTUALLY START SOMETHING THROUGH AND LOOK THROUGH THAT WILL BE COMPLIMENTED WITH AN ONLINE SURVEY WITH SOME SPECIFIC QUESTIONS ABOUT FEEDBACK ON HOW THAT'S ACTUALLY FUNCTIONING. AND THEN WE'LL TAKE ALL THAT INFORMATION TO COMPILE WHAT WE WOULD CONSIDER A FINAL DRAFT OF THAT ADMIN AND PROCEDURE SECTION. BUT FOR TONIGHT, IT'S THE HIGH LEVEL OVERVIEW OF THE BIG TICKET ITEMS THAT WERE RECOMMENDING TO CHANGE. AND THAT WILL BE FOLLOWED UP WITH THE DRAFT IN OCTOBER AND ONLINE SURVEY AND THEN WE'LL BE HOPEFULLY FINALIZING THAT SECTION BY THE END OF THIS YEAR FOR FINAL PUBLIC CONSUMPTION, SO. THAT'S WHAT YOU SEE FOR SEPTEMBER AND OCTOBER. DISTRICT AND USES WERE GEARING UP FOR THAT TO PRESENT PUBLICLY AS WELL. THROUGHOUT THE END OF THIS YEAR, SO I BELIEVE THAT IS OUR LAST SLIDE. JUST A REMINDER OF WHO I AM WHO ERIN IS. THERE IS A DEDICATED WEB SITE FOR THE CODE OVERHAUL ITS A NEW CODE, MCKINNEY .COM. IT'S WHERE WE'RE COMPILING AND CONSOLIDATED AND POSTING ALL OF THE RELATED INFORMATION TO THE UPDATE. SO ANYBODY CAN GO TO THAT WEB SITE AT ANY TIME TO SEE THINGS THAT ARE GOING ON. AND WITH THAT WE'RE HERE TO ANSWER ANY QUESTIONS. QUESTIONS FROM COUNSEL. JENNIFER I WAS JUST. ABOUT SIX YEARS AGO, BEFORE I WAS ON COUNCIL. I HAD A CLIENT. HE WAS JUST LAMENTING HIM. HE HAD BUILT SEVERAL BUILDINGS IN MCKINNEY AND. AND THIS LAST ONE THAT HE HAD BUILT TOOK HIM TWO YEARS. IT WASN'T A VERY BIG ONE AND THE AGGRAVATION BETWEEN HIM AND HIS HIS BUILDER CONTRACTOR WAS JUST EVIDENT AND. AND HE SAYS, I SWEAR I'LL NEVER BUILD ANOTHER BUILDING IN MCKINNEY, AND HE HASN'T AND HE'S BUILT SOME AND MELISSA SEES IN ANNA, AND HE'S MOVED ON. AND SO THAT'S ONE OF THE REASONS I RAN WAS TO HELP KIND OF. INITIATE ALL THIS TO HELP FIX ALL YOU KNOW, TO HELP MAKE IT EASIER TO DO BUSINESS IN MCKINNEY ON DH, SO I REALLY APPRECIATE THE FACT THAT THIS IS THIS IS GOING ON AND MAKING IT EASIER FOR PEOPLE. TO SPEND THEIR MONEY AND BUILDING MCKINNEY. WE NEED THIS. SO THANK YOU VERY MUCH. THANK YOU. THAT'S THE GOAL. THANK YOU. AND I JUST WANT TO THANK YOU AND STAFF. MICHAEL HAS BEEN HOLDING ALL THESE MEETINGS WITH DEVELOPMENT THAT DEVELOPMENT COMMUNITY. MOM'S BEEN GOING ON FOR QUITE SOME TIME AND GATHERING ALL THESE DIFFERENT DEVELOPMENT PARTNERS AND LISTENING TO FEEDBACK AND ALL THAT INTERACTION, ENGAGEMENT, YOU GUYS. AND IF YOU WANT TO GET RID OF A MYTH, WHAT DO YOU DO YOU RECREATE SOMETHING TO GET RID OF IT TO SHOW? WE DON'T DO BUSINESS LIKE THAT. WHERE THIS IS HOW WE'RE MOVING FORWARD WITH THE NEW NARRATIVE, AND THIS IS HOW IT WORKS. AND THIS IS HOW YOU GO IN THERE, AND THIS IS HOW TO GET TO YOUR BUSINESS DONE. AND SO THAT THANK YOU ALL FOR DOING THIS BECAUSE WE LAY THAT WENT THAT URBAN LEGEND. TEO TO DEATH BECAUSE IT'S BEEN THERE FOR US LONG AS I'VE BEEN HERE, AND I DIDN'T COME HERE ON HORSEBACK LIKE RICK, SO IT'S A LONG TIME CAME IN A WAGON. YES WELL WAGON HORSES PULLED IT. SO THANK YOU[00:25:06]
